IMPLEMENTING COMPREHENSIVE AND PROGRESSIVE AGREEMENT FOR TRANS-PACIFIC
PARTNERSHIP (CPTPP) OF THE MINISTRY OF INDUSTRY AND TRADE
THE MINISTER OF INDUSTRY AND TRADE
Pursuant to the Government's Decree No.
98/2017/ND-CP dated August 18, 2017 on functions, tasks, powers and
organizational structure of the Ministry of Industry and Trade;
Pursuant to Decision No. 121/QD-TTg dated
January 25, 2019 of the Prime Minister on approval for Plan for implementing
CPTPP;
At the request of the Director of Department of
Multilateral Trade Policy;
HEREBY DECIDES:
Article 1. Issue together with this Decision
a plan for implementing comprehensive and progressive agreement for
Trans-Pacific Partnership (CPTPP) of the Ministry of Industry and Trade.

- On December 30, 2018, the Agreement officially
entered into force for 6 signatories including Mexico, Japan, Singapore, New
Zealand, Canada and Australia after they have notified New Zealand in writing
of the completion of their parliamentary approval for ratification.
- For Vietnam, on November 12, 2018, the National
Assembly of Vietnam ratified Resolution No. 72/2018/QH14 on approval for CPTPP
and related instruments. On November 15, 2018, Ministry of Foreign Affairs of
Vietnam notified New Zealand in writing of the completion of their parliamentary
approval for ratification. Pursuant to effective provisions of the Agreement,
January 14, 2019 will be the date on which CPTPP enters into force in Vietnam.
- On January 25, 2019, in Decision No. 121/QD-TTg,
the Prime Minister Nguyen Xuan Phuc approved the Plan for implementing CPTPP
and assigned the Ministry of Industry and Trade to take charge and cooperate
with Government Office in monitoring and expediting ministries, agencies and
local governments and enterprises’ representatives to implement the Plan.
- In the Official Letter No 9552/BCT-KH of the
Ministry of Industry and Trade dated November 23, 2018 signed by Minister Tran
Tuan Anh, the Minister Tran Tuan Anh assigned the Department of Multilateral
Trade Policy to assume the responsibility for formulation of plan, roadmap, and
assignment of works to implement CPTPP.
2. Necessity
- The Prime Minister has assigned the Ministry of
Industry and Trade to assume the prime responsibility for implementing the Plan
for implementation of CPTPP . Therefore, the Ministry of Industry and Trade
needs to prepare a clear Plan to ensure the full performance of the tasks
assigned by the Prime Minister.
- CPTPP is the first new generation FTA that
Vietnam has negotiated, signed and ratified. This Agreement has a deeper and
broader commitment than many of Vietnamese previous FTAs. This Agreement is
expected to not only bring great opportunities but also comes with many
challenges for Vietnam, including many areas under responsibility of the
Ministry of Industry and Trade. Therefore, the formulation of the Action Plan
of the Ministry of Industry and Trade will both help the Ministry to fulfill
tasks of designated contact point assigned by the Government and help the
Ministry to take initiative in making use of the opportunities as well as
limiting challenges under areas of responsibility.
- Currently, the need to learn information of the
people and business community about CPTPP is very large, especially after this
Agreement was ratified by the National Assembly of Vietnam. Although they have
been many seminars recently held in some localities, they are mainly
spontaneous, not according to the systematic propagation program of the
Government. Therefore, the public is looking forward to the Government, in
specific, the Ministry of Industry and Trade as the designated contact point
will preside over negotiation of CPTPP, hold highly-qualified and professional
seminars and talks and fully and thoroughly explain CPTPP to interested
entities.
II. OBJECTIVES, ENTITIES, SCOPE, ROADMAP AND
FUND SOURCES

- Focus on supporting all Ministries, agencies and
local governments to prepare and initiate the Action Plan to implement CPTPP.
- Effectively perform the tasks assigned by the
Ministry of Industry and Trade as designated contact point during
implementation of CPTPP on the basis of mobilizing participation of all
relevant functional units of the Ministry of Industry and Trade. This will
contribute to improve the role and position of the Ministry of Industry and
Trade in the negotiation process of FTAs in particular and the field of
international integration in general.
- Assist agencies, organizations and the public to
observe the content of the commitments of CPTPP and how to implement the
Agreement in each sector properly and consistently through a Plan which is
effective, consistent and connected with relevant agencies and organizations,
especially journalism and reporting.
- Apply and promote effectively the incentives of
the Agreement, thereby taking full advantage of opportunities and minimizing
the challenges of CPTPP in the production and business activities of
enterprises, contributing a positive part of Vietnam's international economic
integration process, promoting the country's socio-economic development,
creating jobs and reducing poverty.
- Help to develop plans for receiving technical
support from partners as well as using the state budget for implementing CPTPP
effectively and economically.
2. Entities
Focus on the following main target groups of
entities:
- Ministries, agencies and local governments;
- Associations and representing organizations of
enterprises and enterprises nationwide;

- State management officials of ministries, central
branches and relevant departments and branches of provinces and cities
nationwide;
- Scholars, researchers and staff who teach
institutes and universities about international economic integration
nationwide.
3. Scope
All activities of this Plan will focus on
initiation in provinces and cities nationwide.
4. Roadmap for initiation
- Phase 1 (2019): including the following main
tasks:
+ Focus on completing the works related to issuing
necessary legal documents to implement CPTPP;
+ Prepare and implement a propagation plan,
focusing on propagation and introduction of information about CPTPP and
specific chapters of the Agreement;
+ Develop and operate an FTA portal based on
coordination with the World Bank and Australia's Embassy in Hanoi;

+ Improve the capacity to provide information of
units in the Ministry of Industry and Trade, especially the business system,
information center, trade promotion center, Vietnam Trade Promotion Office in
foreign countries to provide effective information to the business community;
+ Develop programs, support and improve
competitiveness and participate in regional and global value chains for lines
and services under the management of the Ministry of Industry and Trade;
+ Develop market development programs for potential
export goods and advantaged of Vietnam in the market of CPTPP countries;
+ Develop and improve technical measures (national
standards, national technical regulations, food hygiene and safety, etc.) in
accordance with international commitments to support the development of
enterprises, Vietnamese products and consumer protection;
+ Develop a scheme to strengthen the operation of
an early warning system on trade defence in order to support export enterprises
in the risk of applying trade defence measures as well as actively develop
trade defence measures in line with international regulations and commitments
to protect domestic production, prevent evasion of trade defence measures to
protect legitimate interests of Vietnamese enterprises;
+ Build and strengthen inter-branch and local
coordination mechanisms in cases of trade defence;
+ Support Vietnamese enterprises to respond to
trade defence investigations of Vietnamese goods, use the dispute settlement
mechanism of the Agreement or other mechanisms when necessary to protect
legitimate interests of Vietnamese enterprises;
+ Coordinate and participate in activities of CPTPP
Council, CPTPP Committees and other related works.
- Phase 2 (2020 - 2025, vision to 2035):

+ Initiate intensive propagation activities,
focusing on training courses, knowledge training on CPTPP for central and local
officials and enterprises;
+ Continue to improve the capacity to provide
information of units affiliated to the Ministry of Industry and Trade,
especially the business system, information center, trade promotion center,
Vietnam Trade Promotion Office to provide effective information to the business
community;
+ Continue to develop and improve technical
measures (national standards, national technical regulations, food hygiene and
safety, origin, environment protection, etc.) in accordance with international
commitments to support the development of enterprises, Vietnamese products and
consumer protection;
+ Continue to carry out the tasks related to the
formulation of the scheme for an early warning on trade defence, reinforce the
inter-branch and local coordination mechanisms in trade defence cases, and
support enterprises to deal with trade defence lawsuits, etc.;
+ Initiate other assigned tasks.
5. Fund sources
In order to perform the activities of this Plan,
there are expectedly 3 sources of funds as follows:
- State budget;
- Fund sources of foreign partners, focusing on
developed countries in CPTPP such as Canada, Australia, New Zealand, Japan,
etc. and some international organizations such as the World Bank (WB), etc.;

6. Implementation
6.1. For group of activities to get funding
from the state budget
- Based on the content of the approved Plan above,
every year, Department of Multilateral Trade Policy shall take charge and
cooperate with relevant units affiliated to the Ministry in making a general
proposal of specific activities to be performed and budget estimate for the
entire phase suitable to the forms of activities mentioned in this Plan and the
functions and tasks assigned in order to prepare a report to the Ministry's
head for approval;
- On the basis of the approval of the Ministry's
head, the Department of Finance and Enterprise Innovation is assigned to take
charge and coordinate with the Ministry's Office and the Office of the Inter-Branch
Steering Committee for international integration in preparing annual budget
plan, allocating sufficient necessary funds, and at the same time assigning and
guiding units necessary procedures related to finance to initiate the Plan for
implementing CPTPP of the Ministry of Industry and Trade.
6.2. For group of activities to get funding
not included in state budget
- Assign Department of Multilateral Trade Policy to
take charge and cooperate with relevant units affiliated to the Ministry in
receiving proposals for technical assistance from foreign partners,
international organizations and enterprises related to the implementation of
tasks outlined in this Plan;
- Assign Department of Multilateral Trade Policy
and Office of the Inter-Branch Steering Committee for international integration
to take charge and cooperate with television and press agencies, institutes,
universities in developing contents and mobilizing funding from various sources
for television programme, journalism, social networking, curricula and research
programs.
6.3. Evaluation and review mechanism
- Every year, periodically before November 15, the
relevant units affiliated to the Ministry send summary reports on evaluation
result to Department of Multilateral Trade Policy for consolidation, submit
them to the Ministry’s head and report Prime Minister the performance result
and propose adjustment measures in the following year, ensuring that the Plan
is implemented effectively and consistently.
