QUYẾT ĐỊNH

PHÊ DUYỆT ĐỀ ÁN QUẢN LÝ NHẬP KHẨU ĐẾN NĂM 2020 PHÙ HỢP VỚI CÁC CAM KẾT QUỐC TẾ

Căn cứ Luật Tổ chức Chính phủ ngày 25 tháng 12 năm 2001;

Căn cứ Quyết định số 2471/QĐ-TTg ngày 28 tháng 12 năm 2011 của Thủ tướng Chính phủ phê duyệt Chiến lược xuất nhập khẩu hàng hóa thời kỳ 2011 - 2020, định hướng đến năm 2030;

Căn cứ Quyết định số 950/QĐ-TTg ngày 25 tháng 7 năm 2012 của Thủ tướng Chính phủ ban hành Chương trình hành động thực hiện Chiến lược xuất nhập khẩu hàng hóa thời kỳ 2011 - 2020, định hướng đến năm 2030;

Xét đề nghị của Bộ trưởng Bộ Công Thương tại Tờ trình số 4125/TTr-BCT ngày 24 tháng 4 năm 2015 về việc phê duyệt Đề án các biện pháp quản lý nhập khẩu đến năm 2020 phù hợp với các cam kết quốc tế,

QUYẾT ĐỊNH:

Điều 1. Phê duyệt Đề án quản lý nhập khẩu đến năm 2020 phù hợp với các cam kết quốc tế với những nội dung chủ yếu sau:

I. MỤC TIÊU CỦA ĐỀ ÁN

1. Mục tiêu tổng quát

Định hướng xây dựng một hệ thống các biện pháp quản lý nhập khẩu hàng hóa phù hợp với cam kết quốc tế và tiến trình hội nhập kinh tế quốc tế đến năm 2020 nhằm thực hiện thành công các mục tiêu của Chiến lược xuất nhập khẩu hàng hóa thời kỳ 2011 - 2020, định hướng đến năm 2030.

2. Mục tiêu cụ thể

a) Xây dựng bộ công cụ các biện pháp quản lý nhập khẩu trong thời gian tới phù hợp với các cam kết quốc tế nhằm tạo dựng môi trường pháp lý công khai, minh bạch, ổn định, có thể dự báo được cho doanh nghiệp, góp phần kiểm soát nhập khẩu, đảm bảo mục tiêu phát triển kinh tế - xã hội bền vững.

b) Định hướng công tác quản lý nhập khẩu đảm bảo mục tiêu đề ra tại Chiến lược xuất nhập khẩu hàng hóa thời kỳ 2011 - 2020, định hướng đến năm 2030: Xuất khẩu hàng hóa tăng bình quân 11%/năm, nhập khẩu hàng hóa tăng bình quân dưới 10%/năm trong giai đoạn 2016 - 2020. Giảm dần thâm hụt thương mại và tiến tới cân bằng thương mại vào năm 2020.

II. NỘI DUNG CÁC BIỆN PHÁP QUẢN LÝ NHẬP KHẨU

1. Về định hướng chung

a) Duy trì, tận dụng các biện pháp thuế quan và phi thuế quan được phép áp dụng theo các cam kết với Tổ chức Thương mại thế giới (WTO) và tại các Hiệp định thương mại tự do (FTA) song phương và đa phương.

b) Tăng cường sử dụng các biện pháp phi thuế quan, các quy định về hàng rào kỹ thuật trong thương mại (TBT), kiểm dịch động thực vật (SPS) và các biện pháp phòng vệ thương mại.

c) Xây dựng Luật Quản lý ngoại thương nhằm đảm bảo tính ổn định, thống nhất về mặt chính sách cũng như các quy định có tính thực tiễn, khả thi để tạo thuận lợi cho hoạt động của doanh nghiệp.

d) Tạo dựng và áp dụng các biện pháp quản lý nhập khẩu một cách đồng bộ và hiệu quả, chú trọng công tác thông tin cũng như theo dõi, đánh giá hiệu quả các biện pháp áp dụng.

đ) Thường xuyên rà soát, xem xét, sửa đổi, bổ sung, bãi bỏ những quy định, thủ tục hành chính không cần thiết để vừa bảo đảm mục tiêu quản lý là đảm bảo an ninh quốc gia, an ninh trật tự, an toàn thực phẩm, an toàn giao thông, bảo vệ môi trường, bảo vệ sức khỏe nhân dân và các mục tiêu công cộng khác, vừa đảm bảo cải cách thủ tục hành chính, tạo thuận lợi cho doanh nghiệp.

2. Về các biện pháp cụ thể

a) Biện pháp thuế quan

Sử dụng hiệu quả công cụ thuế nhập khẩu và các loại thuế khác (thuế bảo vệ môi trường...) nhằm hỗ trợ ở mức độ phù hợp cho sản xuất trong nước, nâng cao sức cạnh tranh của hàng hóa trong nước theo đúng cam kết. Với những hàng hóa trong nước có thể sản xuất được, xem xét duy trì mức trần thuế nhập khẩu theo cam kết trong WTO và có lộ trình xóa bỏ thuế phù hợp cho hàng hóa có xuất xứ từ các nước có Hiệp định thương mại tự do (FTA).

b) Biện pháp hạn ngạch thuế quan

Nghiên cứu và đàm phán với các đối tác trong các Hiệp định thương mại song phương và đa phương để có lộ trình quản lý nhập khẩu bằng phương thức hạn ngạch thuế quan đối với những mặt hàng cần bảo hộ sản xuất trong nước một cách hợp lý, phù hợp với xu hướng hội nhập quốc tế về kinh tế.

c) Biện pháp cấm nhập khẩu

Giữ nguyên hệ thống hiện hành trong việc áp dụng biện pháp cấm nhập khẩu đối với một số mặt hàng nhằm bảo đảm an ninh quốc gia, an toàn môi trường, an toàn lao động và các mục tiêu công cộng chính đáng khác phù hợp với những điều ước quốc tế mà nước ta đã ký kết, tham gia.

d) Biện pháp hạn ngạch nhập khẩu

Tuân thủ cam kết với WTO không sử dụng biện pháp hạn ngạch nhập khẩu. Có thể xem xét khả năng áp dụng hạn ngạch nhập khẩu trên cơ sở không phân biệt đối xử trong một số trường hợp khẩn cấp WTO cho phép áp dụng.

đ) Biện pháp giấy phép nhập khẩu

- Sử dụng biện pháp quản lý nhập khẩu dưới hình thức giấy phép nhập khẩu đối với một số mặt hàng có ảnh hưởng tới an ninh quốc phòng, trật tự xã hội, an toàn lao động, an toàn giao thông, môi trường và sức khỏe nhân dân.

- Xây dựng hệ thống quản lý liên ngành để trao đổi thông tin, phối hợp kiểm soát nhập khẩu đối với những mặt hàng an ninh quốc phòng, mặt hàng lưỡng dụng, hóa chất, hóa chất độc và tiền chất.

- Ban hành cụ thể Danh mục hàng hóa nhập khẩu theo giấy phép và thuộc diện quản lý chuyên ngành. Quy định rõ hình thức và nguyên tắc quản lý, có mã số HS đúng trong Biểu thuế xuất khẩu, nhập khẩu giúp tạo thuận lợi cho doanh nghiệp thực hiện đúng các quy định.

- Biện pháp giấy phép nhập khẩu tự động được xem xét áp dụng trong những trường hợp cần thiết để theo dõi, kiểm soát việc nhập khẩu nhằm phục vụ công tác điều hành cũng như phân tích và nghiên cứu số liệu để xây dựng chính sách.

- Việc cấp phép nhập khẩu, thủ tục cấp phép nhập khẩu phải tuân thủ đúng thủ tục cấp phép theo cam kết WTO và Quyết định số 41/2005/QĐ-TTg ngày 02 tháng 3 năm 2005 của Thủ tướng Chính phủ ban hành Quy chế về cấp phép nhập khẩu hàng hóa.

e) Biện pháp kỹ thuật, chuyên ngành

- Tăng cường xây dựng và áp dụng các biện pháp cần thiết, phù hợp với các cam kết quốc tế dưới hình thức hàng rào kỹ thuật trong thương mại (TBT) và kiểm dịch động thực vật (SPS) nhằm bảo vệ sức khỏe nhân dân, môi trường, vật nuôi, cây trồng, đảm bảo an toàn lao động, an toàn giao thông, an toàn xây dựng.

- Hoàn thiện các văn bản quy phạm pháp luật, xem xét điều chỉnh những quy định chưa phù hợp về quản lý chất lượng sản phẩm hàng hóa. Ban hành hệ thống các quy chuẩn kỹ thuật tương ứng với các mặt hàng thuộc Danh mục sản phẩm, hàng hóa có khả năng gây mất an toàn (hàng hóa nhóm 2).

- Chủ động nghiên cứu, xây dựng các yêu cầu kỹ thuật của hàng hóa dưới dạng tiêu chuẩn, quy chuẩn kỹ thuật, các hình thức đánh giá sự phù hợp với tiêu chuẩn hoặc quy chuẩn kỹ thuật bảo đảm phù hợp với tính chất của sản phẩm, mức độ ảnh hưởng tới kim ngạch nhập khẩu cũng như tác động của các biện pháp này tới các doanh nghiệp trong nước.

- Tăng cường đàm phán, ký kết các thỏa thuận thừa nhận lẫn nhau về kết quả đánh giá sự phù hợp, thừa nhận lẫn nhau về Giấy chứng nhận sự phù hợp theo từng chuyên ngành.

- Nghiên cứu kinh nghiệm của nước ngoài để áp dụng quản lý nhập khẩu thông qua biện pháp kiểm dịch động, thực vật và an toàn thực phẩm theo hướng chỉ những doanh nghiệp được cơ quan có thẩm quyền của Việt Nam công nhận đáp ứng đầy đủ các yêu cầu về cơ sở sản xuất, an toàn thực phẩm mới được phép xuất khẩu vào Việt Nam.

- Đối với một số chủng loại trái cây, vật nuôi, cây trồng, các mặt hàng ảnh hưởng tới sức khỏe con người, nghiên cứu áp dụng các biện pháp kiểm tra tại nước xuất khẩu và cấp giấy chứng nhận được phép xuất khẩu sang Việt Nam.

- Việc xây dựng cơ sở pháp lý cho các biện pháp này phải đảm bảo các nguyên tắc đối xử quốc gia (NT) và tối huệ quốc (MFN).

g) Biện pháp phòng vệ thương mại

- Hoàn thiện, sửa đổi các văn bản quy phạm pháp luật điều chỉnh biện pháp phòng vệ thương mại để phù hợp với các quy định của WTO. Bổ sung những quy định chi tiết hơn về các thủ tục, quy trình, phương pháp tính toán để tạo điều kiện cho việc áp dụng các công cụ phòng vệ thương mại thuận lợi, tránh sai sót khi áp dụng.

- Tuyên truyền, phổ biến pháp luật về các biện pháp phòng vệ thương mại, nâng cao nhận thức, năng lực của doanh nghiệp về sử dụng các biện pháp chống bán phá giá, chống trợ cấp và tự vệ.

- Nâng cao năng lực của cơ quan chuyên trách về phòng vệ thương mại. Hỗ trợ các Hiệp hội ngành hàng trong công tác tập hợp thông tin, khởi xướng điều tra các vụ việc về phòng vệ thương mại.

h) Biện pháp về xuất xứ hàng hóa

- Quy tắc xuất xứ trong đàm phán các Hiệp định thương mại tự do (FTA) là biện pháp quản lý nhập khẩu hàng hóa với thuế quan ưu đãi giúp sàng lọc, hạn chế ưu đãi tiếp cận thị trường đối với những mặt hàng cần hỗ trợ sản xuất trong nước.

- Tăng cường công tác quản lý chống gian lận xuất xứ đối với hàng hóa nhập khẩu, ngăn chặn tình trạng hàng hóa không đáp ứng tiêu chí xuất xứ, hàng hóa có xuất xứ giả được hưởng ưu đãi thuế, tạo lợi thế cạnh tranh không chính đáng, góp phần bảo vệ nền sản xuất trong nước và quyền lợi người tiêu dùng.

i) Biện pháp tỷ giá hối đoái

Điều hành linh hoạt tỷ giá hướng tới mục tiêu ổn định kinh tế vĩ mô, phù hợp với định hướng điều hành xuất nhập khẩu và góp phần duy trì khả năng cạnh tranh của hàng hóa Việt Nam trên thị trường quốc tế.

k) Các biện pháp quản lý nhập khẩu khác

- Tăng cường và nâng cao hiệu quả công tác kiểm tra chuyên ngành trên cơ sở ban hành danh mục cụ thể hàng hóa kiểm tra chuyên ngành, quy định trình tự, thủ tục kiểm tra theo hướng tạo thuận lợi cho hoạt động của doanh nghiệp và bảo đảm yêu cầu quản lý nhập khẩu. Tăng cường sự phối hợp giữa các Bộ, ngành để đảm bảo thống nhất quản lý, giảm sự chồng chéo trong triển khai công tác kiểm tra chuyên ngành.

- Xây dựng các tiêu chuẩn và quy chuẩn kỹ thuật đối với hàng hóa, sản phẩm theo các quy định về môi trường (nhãn sinh thái, bao bì phế thải và tái chế bao bì...).

- Hàng hóa nhập khẩu từ nước ngoài được in cảnh báo, in hướng dẫn sử dụng bằng tiếng Việt, không cho phép sử dụng nhãn phụ. Trước mắt, xem xét thí điểm áp dụng đối với một số mặt hàng.

- Nghiên cứu khả năng áp dụng bảo hộ sở hữu trí tuệ trong quản lý nhập khẩu có xét đến tương quan trình độ phát triển của Việt Nam và các quy định khác liên quan.

Điều 2. Tổ chức thực hiện

1. Các Bộ, ngành theo nhiệm vụ được phân công theo phụ lục kèm theo Quyết định này tổ chức triển khai, bảo đảm tiến độ thực hiện.

2. Để bảo đảm sự đồng bộ về chính sách quản lý nhập khẩu hàng hóa, khi ban hành các chính sách, giải pháp mới liên quan đến quản lý nhập khẩu, các Bộ, ngành phối hợp, trao đổi với Bộ Công Thương để thống nhất trước khi triển khai thực hiện.

3. Bộ Công Thương chủ trì thành lập Tổ liên ngành về công tác xuất nhập khẩu do Lãnh đạo Bộ Công Thương làm Tổ trưởng, đại diện các Bộ, ngành liên quan làm thành viên. Tổ công tác theo dõi tình hình triển khai Đề án, tình hình hoạt động nhập khẩu, kiến nghị các giải pháp điều chỉnh kịp thời.

4. Kinh phí thực hiện Đề án được bố trí từ nguồn Ngân sách Nhà nước và các nguồn kinh phí hợp pháp khác theo quy định của pháp luật.

Điều 3. Quyết định này có hiệu lực thi hành kể từ ngày ký ban hành.

Điều 4. Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Thủ trưởng các cơ quan, đơn vị, cá nhân có liên quan chịu trách nhiệm thi hành Quyết định này./.

5	Biện pháp giấy phép nhập khẩu
a)	Ban hành chi tiết Danh mục hàng hóa nhập khẩu theo giấy phép và thuộc diện quản lý chuyên ngành theo Nghị định số 187/2013/NĐ-CP ngày 20 tháng 11 năm 2013 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hóa quốc tế và các hoạt động đại lý mua, bán, gia công và quá cảnh hàng hóa nước ngoài. DECISION

APPROVING IMPORT MANAGEMENT SCHEME BY 2020 IN CONFORMITY WITH INTERNATIONAL COMMITMENTS

THE PRIME MINISTER

Pursuant to the Law on Government Organization dated December 25, 2001;

Pursuant to the Prime Minister’s Decision No. 2471/QD-TTg dated December 28, 2011 on approving the strategy for exporting and importing goods for the period 2011 - 2020 with a vision to 2030;

Pursuant to the Prime Minister’s Decision No. 950/QD-TTg dated July 25, 2012 on promulgating the Action Plan to implement the strategy for exporting and importing goods for the period 2011 - 2020 with a vision to 2030;

After considering the request made by the Minister of Industry and Trade in the Report No. 4125/TTr-BCT dated April 24, 2015 on approving the Scheme for import management measures by 2020 in compliance with international commitments,

I. OBJECTIVES OF THE SCHEME

1. General objective

The scheme is aimed at setting up the system of measures to manage import of goods in conformity with international commitments and the progress of integration into the international economy by 2020 with the intention of achieving objectives set out in the strategy for import of goods for the period 2011 - 2020 with a vision to 2030.

2. Specific objectives

a) Create the import management toolkit in the upcoming time which conforms to international commitments in order to provide an open, transparent, stable and foreseeable legislative environment for enterprises, and contribute to controlling import activities as well as ensure that the objective of sustainable socio-economic development will be achieved.

b) Provide guidance on import management activities in order to meet the objectives stated in the strategy for export and import of goods for the period 2011 - 2020 with a vision to 2030, such as an average increase of 11%/year in the export of goods, an average increase of less than 10%/year in the import of goods reported for the period 2016 – 2020. Gradually reduce the trade deficit and work towards the trade balance in 2020. 

II. CONTENTS OF IMPORT MANAGEMENT MEASURES

1. General orientation

a) Sustain, make best use of tariff and non-tariff measures permitted for implementation in commitments to the World Trade Organization (WTO), and bilateral and multilateral Free Trade Agreements.

c) Make the Law on Foreign Trade Management in order to assure that policies are stable and consistent, and regulations are practical and feasible to serve the purpose of facilitating enterprises’ business operations.

d) Design and apply import management measures in a uniform and efficient manner, and focus on information-related tasks as well as monitor and assess the effectiveness of measures which have been applied. 

dd) Regularly review, check, amend, modify or abolish unnecessary regulations and administrative procedures to both reach the managerial objectives of guaranteeing the national security, social order, food and traffic safety, and protecting environment and the people’s health  as well as other public ones, and assure the administrative procedure reform with a view to creating favorable conditions for enterprises.  

2. Specific measures

a) Tariff

Use import duty and other tax (green tax, etc.) as an effective instrument to support domestic production activities at an appropriate level and improve the competitive capacity of domestic goods in compliance with commitments. As for goods that can be produced domestically, consider maintaining ceilings on the import tariffs as agreed upon in WTO commitments, and outline the roadmap for abolishing relevant custom tariffs imposed on goods imported from FTA member countries.

b) Tariff quota

Carefully examine and negotiate with opposing parties to bilateral and multilateral Trade Agreements in order to sketch out the roadmap for import management by employing the method of imposing tariff quotas on goods of which domestic production must be protected in a reasonable and appropriate manner to adapt to the tendency towards international economic integration.

c) Import ban

d) Import quota

Comply with WTO commitments under which the measure to impose import quotas is not allowed. There is a possibility that import quotas are imposed in a non-discriminatory manner to cope with certain emergencies which are allowed by WTO. 

dd) Import permit

- Apply import management measures in the form of permits for import of goods that may cause impact on the national security and defence, social order, occupational and traffic safety, and environment as well as the people's health.

- Set up the interdisciplinary management system in order to exchange information and collaborate in controlling import of goods relating to the national security and defence, dual-use goods, chemicals, toxic chemicals and precursors.

- Specify the nomenclature of specific goods permitted for import according to import permits and those subject to specialized management. Clearly specify the management form and principle, and use correct HS codes specified in export and import tariffs in order to enable enterprises to comply with regulations.

- Consider applying automatic import permits to necessary situations to monitor and control import activities in order to assist in the work of administration, data analysis and study to draw up policies.

- Make sure that issuance of import permits and procedures for issuance of import permits conforms to procedures for issuance of import permits under WTO commitments and the Prime Minister's Decision No. 41/2005/QD-TTg dated March 2, 2005 on introducing the Regulation on issuance of permits for import of goods.

e) Technical and specialized measures

- Perfect legislative documents, consider modifying regulations which have not been consistent with the standards of product quality management. Promulgate the system of technical regulations that apply to specific goods specified in the nomenclature of goods or products that may pose risk to the safety (2^ndcommodity headings). 

- Take proactive action to study and set out technical requirements of goods in the form of technical regulations and standards, and generate forms of evaluation of conformity with technical standards or regulations appropriate for the features of products, and level of impact on the import turnover as well as impact of these measures on domestic enterprises. 

- Stimulate negotiation and conclusion of mutual recognition agreements with regard to conformity assessments and certificates of conformity categorized by specialized sectors.

- Learn international experience so that it will apply to the import management by implementing sanitary, phytosanitary and food safety measures in which only enterprises accredited for food production activities and food safety practices by Vietnam’s competent authorities will be permitted for import of their goods into Vietnam.   

- With respect to several types of fruits, livestock, plants and goods that can cause impact on human health, study implementation of measures to carry out inspection at exporting countries and issue certificates to allow them to be exported to Vietnam.

- Form the legal bases for these measures with strict adherence to principles of national treatment (NT) and most-favored-nation treatment (MFN).

g) Trade defence

- Perfect and amend legislative documents on trade defence measures so that they conform to WTO regulations. Supplement more specific provisions on procedures, processes and methods for calculation in order to create necessary conditions for easy and flawless use of trade defence instruments.  

- Disseminate legislative documents on trade defence measures, increase awareness and capability of enterprises in implementing antidumping, anti-subsidy and self-defence measures.

h) Product origin

- Rules of origin negotiated as part of a Free Trade Agreement serve as the measure to manage import of goods in which preferential tariffs are imposed to help sort out and restrict preferences for goods that need domestic production assistance to have access to market.   

- Intensify the work of preventing fraudulent origins of imported products, and taking control of the situation in which goods that fail to conform to product origin standards, or goods with fraudulent origins, will be treated as preferential ones which can result in illegal competitions and contribute to protecting domestic production and consumer rights.

i) Exchange rate

Manage the exchange rate in a flexible manner with a view to maintaining the macroeconomic stability, and in a way to match the export and import management orientation as well as contribute to sustaining the competitive capacity for Vietnamese goods on the international market.

k) Other import management measures

- Intensify and improve the efficiency in specialized inspection activities on the basis of promulgating the nomenclature of specific goods subject to the specialized inspection, and regulations on the process and procedure for inspection with the aim of facilitating enterprises' business operations and ensuring that requirements for import management are all satisfied. Stimulate the cooperation amongst Ministries and departments in order to guarantee the consistent management and reduced overlapping in organizing the work of specialized inspection.

- Outline technical standards and regulations that apply to goods or products in accordance with environmental regulations (such as ecolabels, waste and recycling package, etc.).

- Attach warnings and instructions printed in Vietnamese language on goods imported from overseas, but do not allow auxiliary labels to be attached to these goods as well.  For the time being, consider piloting implementation of this regulation on several kinds of goods.

Article 2. Implementation

1. Ministries and departments under their assigned duties specified in the appendix enclosed herein shall carry out the scheme and adhere to implementation stages. 

2. In order to ensure the uniform policies on goods import management, when issuing new policies and solutions concerning the import management, Ministries and departments are obliged to cooperate and consult with the Ministry of Industry and Trade to enter into mutual agreements prior to implementation of the Scheme.

3. The Ministry of Industry and Trade shall preside over the establishment of an interdisciplinary coalition in charge of export and import activities of which the leader is coming from the leadership of the Ministry of Industry and Trade, and members are representatives of relevant Ministries or departments. The coalition shall monitor the progress in implementation of the Scheme and import situations, and propose measures to make on-time adjustments.

4. Budget for implementation of the Scheme shall be funded by the State Budget and other legitimate financial sources in accordance with legal regulations.

Article 3. This Decision shall enter into force as from the signature date.

Article 4. Ministers, Heads of Ministry-level agencies, Heads of Government agencies, and Heads of organizations or individuals concerned shall be responsible for implementing this Decision./.
