CIRCULAR
REGARDING FEES FOR EXTRACTION AND USE OF LAND DOCUMENTS ON
THE NATIONAL LAND INFORMATION SYSTEM AND COLLECTION, PAYMENT, TRANSFER,
MANAGEMENT, AND USE OF FEES THEREFOR
Pursuant to the Law on
Fees and Charges dated November 25, 2015;
Pursuant to the Land
Law dated January 18, 2024; Law on Amendments to the Land Law No. 31/2024/QH15,
Housing Law No. 27/2023/QH15, Law on Real Estate Trading No. 29/2023/QH15 and
Law on Credit Institutions No. 32/2024/QH15 dated June 29, 2024;
Pursuant to the Law on
State Budget dated June 25, 2015;
Pursuant to the Law on
Tax Administration dated June 13, 2019;
Pursuant to the
Government's Decree No. 120/2016/ND-CP dated August 23, 2016 on elaboration and
guidance on certain articles of the Law on Fees and Charges; Decree No.
82/2023/ND-CP dated November 28, 2023 of the Government on Amendments to the
Government's Decree No. 120/2016/ND-CP dated August 23, 2016 on elaboration and
guidance on certain articles of the Law on Fees and Charges;
Pursuant to the
Government's Decree No. 101/2024/ND-CP dated July 29, 2024 providing for
baseline land surveys; registration of land and property attached to land,
issuance of Certificates of land use rights and ownership of property attached
to land and land information system;

Pursuant to the
Government's Decree No. 11/2020/ND-CP dated January 20, 2020 on administrative
procedures for state treasury operations; Decree No. 123/2020/ND-CP dated
October 19, 2020 of the Government on invoices and records;
Pursuant to the
Government's Decree No. 14/2023/ND-CP dated April 20, 2023 on the functions,
tasks, powers and organizational structure of the Ministry of Finance;
At the request of the
Director of the Department of Management and Supervision of Tax, Fees and
Charges Policies;
The Minister of
Finance promulgates the Circular regarding fees for extraction and use of land
documents on National Land Information System and collection, payment,
transfer, management, and use of fees therefor,
Article 1. Scope and
regulated entities
1. This Circular
prescribes fees for extraction and use of land documents on the National Land
Information System and collection, payment, transfer, management, and use of
fees therefor.
Fees for extraction and
use of land documents that are not yet available on the National Land
Information System shall comply with regulations of the provincial-level People's
Councils.
2. This Circular applies
to fee payers; fee collectors; other organizations and individuals involved in
collection, payment, transfer, management, and use of fees for extraction and
use of land documents on National Land Information System.

Article 3. Fee
collectors
Fee collectors specified
in this Circular are authorities providing land information and data as
prescribed in Article 60 of the Government's Decree No. 101/2024/ND-CP .
Article 4. Fees and
fee exemption
1. Fees for extraction
and use of land documents on the National Land Information System are specified
in the Fee Schedule enclosed herewith.
In case the Minister of
Public Security, the Minister of National Defense or the Presidents of the
People's Committees of provinces and municipalities apply for extraction and
use of land information and data for defense and security purposes in
accordance with the Law on National Defense, the fees shall be 60% of the
corresponding fees specified in the Fee Schedule enclosed herewith; except for
the case specified at point b, clause 2 of this Article.
2. Cases of fee exemption
a) Entities specified in
clause 1, Article 10 of the Law on Charges and Fees extract their information
and other land users' information with the consent of authorities managing
national land databases in accordance with the land law.
b) Ministers, Directors
of ministerial agencies, Directors of governmental agencies, Presidents of the
People’s Committees of provinces and municipalities apply for extraction and
use of land information and data on the National Land Information System for:
- national defense and
security in emergency cases as prescribed by the Law on National Defense.

c) Cases of fee exemption
specified in Article 62 of the Government's Decree No. 101/2024/ND-CP dated
July 29, 2024.
Article 5.
Declaration, collection and payment of fees
1. Fee payers applying
for extraction and use of land information and data on the National Land Information
System shall pay fees to fee collectors via payment methods specified in the
Circular No. 74/2022/TT-BTC.
2. Collectors shall
transfer total amount of fees collected in the previous month to the dedicated
account opened at the State Treasury by the 05th of each month. Fee collectors
shall declare, collect, transfer and make statements of fees in accordance with
regulations of the Circular No. 74/2022/TT-BTC (fees collected and managed by
central collectors shall be transferred to central government budget and fees
collected and managed by local collectors shall be transferred to local
government budgets).
Article 6. Management
and use of fees
1. Each collector shall
be allowed to retain 70% of total amount of collected fees for covering its
expenses incurred during provision of services and fee collection as prescribed
in clause 4, Article 1 of the Government's Decree No. 82/2023/ND-CP and
transfer the remaining amount of collected fees (30%) to state budget, except
for the case specified in clause 2 of this Article.
2. If the collector is a
regulatory authority not allowed to retain a portion of collected fees to cover
its operating expenses according to regulations in clause 3 Article 1 of the
Decree No. 82/2023/ND-CP , it shall transfer the entire amount of collected
fees to state budget. Expenditures on provision of services and fee collection
shall be covered by funding derived from state budget and specified in the
collector’s cost estimate according to policies and levels of state budget
expenditures in accordance with law.
Article 7.
Implementation provisions
1. This Circular comes
into force from August 01, 2024.

3. In case the
legislative documents citied in this Circular are amended or replaced, the
newest document shall be apply.
4. Any difficulty arising
during the implementation of this Circular shall be promptly reported to the
Ministry of Finance for amendment./.
