CIRCULAR

GUIDING MANAGEMENT OF NATIONAL TECHNOLOGICAL INNOVATION PROGRAM UNTIL 2030

Pursuant to Law on Technology Transfer dated June 19, 2017;

Pursuant to the Law on Science and Technology dated June 18, 2013;

Pursuant to Decree No. 76/2018/ND-CP dated May 15, 2018 of the Government on elaborating to Law on Technology Transfer;

Pursuant to Decree No. 95/2017/ND-CP dated August 16, 2017 of Government on functions, tasks, powers and organizational structure of Ministry of Science and Technology;

At request of Director of Department of Technology Application and Development and Director of Department of Legal Affairs;

Minister of Science and Technology promulgates Circular guiding management of National technological innovation program until 2030.

GENERAL PROVISIONS

Article 1. Scope and regulated entities

1. This Circular provides guidelines for management of National technological innovation program until 2030 approved under Decision No. 118/QD-TTg dated January 25, 2021 of Prime Minister (hereinafter referred to as “Program”).

2. This Circular applies to organizations, agencies, and individuals participating in, implementing, and managing the Program.

Article 2. Term interpretation

In this Circular, terms below are construed as follows:

1. “technology map” refers to documents describing, analyzing current conditions and usability of technology in a defined period of time; correlation between technology and technology development demand based on use purposes; technology development trends, prioritized technology, technology, technology demand forecast.

2. “technological innovation roadmap” refers to the process of identifying objectives and contents of technological innovation; procedures and methods of utilizing resources to implement technological innovation in a defined period of time.

3. “primary product” refers to product identified by Prime Minister, ministries, People’s Committees of provinces or central-affiliated cities under strategies, planning, and plans of the country, ministry, sector, local administrative division.

5. “Board of directors of National technological innovation program” (hereinafter referred to as “Board of Program directors”) refers to an organization assisting the Minister of Science and Technology in organizing Program implementation established and regulated by Minister of Science and Technology.

Article 3. Program tasks

1. Tasks of developing and implementing roadmap for national technology capacity improvement consist of following schemes, projects:

a) Develop national technology maps and roadmap for technological innovation for manufacturing of primary products and national products;

b) Develop and implement technological innovation roadmap for enterprises;

c) Organize training and provide assistance in providing training for technology management, administration, and update for enterprises and facilities that provide training; training and improvement for management personnel and technicians;

d) Conduct research to develop policies promoting technological innovation and encouraging establishment of research and development organizations in enterprises.

2. Tasks of researching, applying, harnessing advanced technology in manufacturing of primary products with added value and high competition on the market consist of following tasks and schemes:

a) Conduct research, apply, and harness advanced technologies to assist enterprises in improving functionality and quality of products, renovating equipment, technology line and procedures for creating primary products;

c) Assist cooperation between enterprises and agencies, organizations, individuals engaging in science and technology to implement projects for investing in technological innovation, infrastructure investment serving research, application, and innovation of technology.

d) Implement administration and business models for enterprises in form of smart production for manufacturing primary products.

3. Tasks of assisting small and medium enterprises in innovating technology consist of following projects:

a) Receive, transfer, research, conduct test manufacturing, and apply new, advanced technologies; manufacture new products and alter technology process to create appealing products dominating domestic market;

b) Develop communication systems for managing enterprise resources, applying digitalization, extracting technology data, and transferring technology.

4. Task of promoting financing for technological innovation in rural areas, mountainous regions, areas with difficult and particularly socio-economic conditions consist of following projects:

a) Apply advanced technology, and automate smart cultivation model, post-harvest and processing technologies; renovating cultivars and domestic animal breeds with high yield, high quality, and high adaptability to climate change; improving breeding technology, large-scale cultivation and disease control techniques;

b) Perform technological innovation in traditional crafts and traditional craft villages;

c) Assist enterprises engaging in business lines that benefit from preferential treatment in receiving technology transfer from science and technology organizations.

a) Investigate, assess, develop, and update database on current conditions, level and capacity of technologies in sectors; develop, collect, update database on new technology, advanced technology, technology demands, and technology experts; develop standard systems for assessing technological innovation and competitiveness of enterprises (include statistic and criteria systems for assessing technological innovation of enterprises); investigate, survey models of applying technological and scientific advance on a regional basis to develop planning and create technological innovation model networks for each region;  

b) Assist in developing automatic consulting network; assist enterprises in extracting database on industrial ownership in order to apply in business operation and serve technological innovation; promote technology transfer, assessment, price appraisal, and inspection;

c) Identify models of applying technological and scientific advance on a regional basis to serve as the basis for assisting technology application, transfer and typical multiplication;

d) Assist research centers for applying technological and scientific advances and technology connection point in technology transfer, service connection, technical support for applying technology, connecting with market, advertising products created from application of technology, searching, connecting with domestic and foreign partners, improving capacity of successfully popularizing and multiplying application model;

dd) Organize media activities regarding application, transfer, innovation of technology, praising, commending enterprises, organizations, individuals attaining achievements in creating, innovating technology;

e) Assist international cooperation in applying, transferring, and innovating technology.

Tasks under this Clause shall be identified and organized for implementation according to Article 11 of this Circular.

6. Program management activities consist of:

a) Activities of Board of Program directors; management, organization of Program implementation of Department of Technology Application and Development, National Technology Innovation Fund, and authorities affiliated to Ministry of Science and Technology;

c) Consolidate and assess annual reports in order to report to heads of Ministry of Science and Technology and Prime Minister;

d) Other activities in management and organization of Program implementation.

Article 4. General principles for selecting tasks

1. Tasks satisfying regulations under Clauses 1, 2, 3, 4, and 5 Article 3 hereof.

2. Task objectives must be clear, quantified, and promoting socio-economic development of the country, region, sector.

3. Prioritize tasks of domestic science and technology enterprises and organizations, tasks implemented in areas with difficult and particularly difficult socio-economic conditions; tasks regarding transferring, applying, and harnessing technology encouraged for transfer according to Article 9 of Law on Technology Transfer; tasks financed by ministries and local governments or agreed in terms of address of application.  

4. Feasible tasks whose presiding entities obtain specialized capacity, facility, finance capability or prove the ability to mobilize external resources to implement tasks.

Article 5. Code of Program tasks

Code of Program tasks shall use the following format: DM.DA.XX/YY or DM.DT.XX/YY or DM.ĐA.XX/YY or DM.DK.XX/YY.

- DM is short of “Chương trình đổi mới công nghệ quốc gia” (National technological innovation program).

- DA is short for “project”; DT is short for “topic”; ĐA is short for “schemes”; “DK” is short for “periodically implemented tasks”.

- XX is number of Program task in each category of DA, DT, DA, DK.

- YY is the last 2 digits of the year in which the task is implemented.

Chapter II

CRITERIA FOR SELECTING PROGRAM TASKS

Article 6. Task of developing and implementing roadmap for improving national technology capacity

Serve management and preparation of technology development strategies of the Government, ministries, sectors, and enterprises, in which, tasks of developing technology map and technological innovation roadmap, and tasks of developing and implementing technological innovation roadmap must satisfy criteria specified under Form No. A1.2-PDX-BDCN-LTCN, training tasks must satisfy criteria specified under Form No. A1.3-PDX-NVDT under Annex attached hereto.  

Article 7. Tasks of researching, applying, harnessing advanced technology in manufacturing of primary products with added value and high competition on the market

a) Created products have functionality, quality, and competitiveness higher than products of the same type manufactured domestically or imported;

b) Research, application, and harnessing of advance technology in manufacturing must increase at least 5% of products’ value and working capacity compared to those value before project execution;

c) Organizations and enterprises manufacturing national products and primary products must guarantee to apply researched and harnessed technology in at least the first 2 years after finishing projects and guarantee to establish research and development organizations in enterprises (if not yet) after finishing projects.

2. Promote cooperation between enterprises with agencies, organizations, and individuals engaging in science and technology to search, transfer, apply, harness, and decode new, advanced technologies while satisfying following criteria:

a) Perform cooperation between enterprises and domestic and foreign science, technology agencies and organizations (including science, technology organizations of companies, corporations) or via science, technology organizations cooperating with foreign enterprises; 

b) Identify required technology: necessity, level of necessity, conformity of technology, well-defined technology, and assessment of roles and impact on enterprises;

c) Propose solutions for searching, detecting technology, and decoding at request or order of organizations and enterprises; identify conditions for technology transfer;

d) Prove ability to apply, harness, and transfer effective utilization of required technology;

dd) Technologies to be transferred, applied, harnessed, and decoded are new technology and advanced technology serving socio-economic development of the country, sectors, regions, local administrative divisions.

a) Implement cooperation between enterprises and science, technology agencies and organizations in order to conduct science, technology activities;

b) Produce feasibility reports for research, application, and innovation of technology;

c) Organizations and enterprises investing in technological innovation and development of infrastructure serving research, application, and innovation of technology must commit to scientific research and technological innovation in at least the first 2 years after finishing projects. 

4. Implement administration and business models for enterprises in form of smart production for manufacturing primary products while satisfying following criteria:

a) Models of administration and smart production focus on prioritized sectors, leading sectors, and service sectors with high added-value;

b) Model implementation must serve to improve business effectiveness of enterprises and increase product’s value;

c) Estimate scale of application and market expansion of models. 

Article 8. Tasks of assisting small and medium enterprises in innovating technology

1. Receive, transfer, research, conduct test manufacturing, and apply new, advanced technologies; manufacture new products and alter technology process to create appealing products dominating domestic market while satisfying following criteria:

b) Created products are highly competitive, socially beneficial, economically beneficial, and allowing enterprises to develop rapidly in terms of quality and quantity;

c) Prove effectiveness of projects:

- For projects of receiving, transferring, researching, and test manufacturing, estimated products and results must include address of application or transfer;

- Projects of applying new and advanced technologies must be able to create products and services implemented at least in provinces and central-affiliated cities;

- Projects of manufacturing new products must be able to produce products with competitive functions, quality, and prices compared to products of the same type domestically manufactured or imported;  

- Shift in technology procedures must increase at least 5% of product value and improve working capacity.

2. Develop communication systems for managing enterprise resources, applying digitalization, extracting technology data, and transferring technology while satisfying following criteria:

a) Develop plans for operating, extracting data, and conducting business in a coherent manner while ensuring resources for project implementation and maintenance;

b) Identify specific demands and technical-economic effectiveness of applying information systems in managing enterprise resources and advertising products;

Article 9. Task of promoting financing for technological innovation in rural areas, mountainous regions, and areas with difficult and particularly socio-economic conditions

1. Apply advanced technology, and automate smart cultivation model, post-harvest and processing technologies; renovating cultivars and domestic animal breeds with high yield, high quality, and high adaptability to climate change; improving breeding technology, large-scale cultivation and disease control techniques while satisfying following criteria:

a) Identify market and competitiveness of products; deal with socio-economic development issues of project location, and satisfy ecosystem protection requirements;

b) Models must satisfy development requirements and practical conditions of regions and Program objectives;

c) Presiding organizations must be able to prove their capacity to mobilize reciprocal capital sources, utilize and multiple project models; prioritize assisting enterprises that utilize funding sources from their science and technology development fund.

2. Innovate technology for developing traditional crafts and traditional craft villages while satisfying following criteria:

a) Objectives and contents of support for technological innovation must conform to local economic development planning;

b) Identify potentials and strengths of products of regions, craft villages, and traditional craft villages;

c) Cooperate with agricultural extension, industrial extension, and fishery extension programs to develop projects for researching implementation and application of technology depending on strengths and characteristics of regions;

3. Assist enterprises engaging in business lines that benefit from preferential treatment in receiving technology transfer from science and technology organizations while satisfying following criteria:

a) Prove legitimate ownership for transferred technology;

b) Obtain principle contracts or documents proving technology transfer; obtain commitment regarding address of implementation and application of transferred technology;

c) Objectives and details of transfer of technology fall under sectors benefitting from preferential investment treatment and conform to economic development plans in administrative divisions benefitting from preferential investment treatment; 

d) Identify transferred technology depending on administrative divisions; advanced technologies that improve productivity and product quality.

Chapter III

ORGANIZING IMPLEMENTATION OF PROGRAM TASKS

Article 10. Identify and organize implementation of science and technology tasks of the Program

Task proposal shall use Form No. A1.1-PDX (topic, project proposal), A1.2-PDX-BDCN-LTCN (proposal for tasks of developing technology map and technological innovation roadmap, tasks of developing and implementing technological innovation roadmap), or A1.3-PDX-NVDT (proposal for training tasks) under Annexes attached hereto. Scheme proposal shall utilize Form No. A1-DXNV under Circular No. 03/2017/TT-BKHCN dated April 3, 2017 of Minister of Science and Technology on amendment to Circular No. 07/2014/TT-BKHCN.

b) Procedures for identifying and approving list of tasks shall conform to Circular No. 07/2014/TT-BKHCN dated May 26, 2014 of Minister of Science and Technology and Circular No. 03/2017/TT-BKHCN dated April 3, 2017 of Minister of Science and Technology.

Feedback and assessment form shall utilize Form No. A2.1-PDG (feedback and assessment of topic, project), A2.2-PDG-BDCN-LTCN (feedback and assessment for tasks of developing technology map and technological innovation roadmap, tasks of developing and implementing technological innovation roadmap), A2.3-PDG-NVDT (feedback and assessment for training tasks) under Annexes attached hereto. Scheme feedback and assessment form shall utilize Form No. B2-TVHD Annex of under Circular No. 03/2017/TT-BKHCN dated April 3, 2017 of Minister of Science and Technology on amendment to Circular No. 07/2014/TT-BKHCN.

2. Selection and direct assignment of tasks

Principles, conditions, and procedures for selecting, directly assigning organizations and individuals to implement tasks shall conform to Circular No. 08/2017/TT-BKHCN dated June 26, 2017 of Minister of Science and Technology.

Presentation of topics and projects shall conform to Form No. B1.1-TMDT (topic presentation), B1.2-TMDA (project presentation), B1.3-TMNVDT (topic, project presentation for training tasks) and assessment of task dossiers shall utilize Form No. B2.1-PDG-TMDT (assessment of application for selection and assignment of organizations and individuals hosting topics), B2.2-PDG-TMDA (assessment of application for selection and assignment of organizations and individuals hosting projects) B2.3-PDG-TMNVDT (assessment of application for selection and assignment of organizations and individuals hosting topics and projects in training tasks) under Annexes attached hereto. Scheme presentation and assessment shall conform to Circular No. 08/2017/TT-BKHCN dated June 26, 2017 of Minister of Science and Technology.

3. Appraisal of task expenditure

Task expenditure appraisal team consists of 5 members, in which: head of Department of Technology Application and Development shall act as the Director; Representative of Department of Planning-Finance shall act as the Vice Director; A representative of Board of Program directors shall act as a member; A representative of National Technology Innovation Fund shall act as a member; The Director, the Vice Director, or review member of the Council shall select the last member.

In specific cases, Minister of Science and Technology can decide on number of members of task expenditure appraisal team other than 5 members as regulated under this Clause.

4. Signing of contracts for task implementation (using model contracts for scientific research and technology development attached to Circular No. 05/2014/TT-BKHCN dated April 10, 2014 of Minister of Science and Technology).

5. Periodic examination, assessment, amendment, and termination of contracts during task implementation.

Procedures for examining, assessing, amending, and terminating contracts during task implementation shall conform to Circular No. 04/2015/TT-BKHCN dated March 11, 2015 of Minister of Science and Technology.

6. Assessment, inspection for acceptance, and acknowledgement of results and settlement of contracts of task implementation

Procedures for assessing, inspecting for acceptance, and acknowledging task implementation results shall conform to Circular No. 11/2014/TT-BKHCN dated May 30, 2014 of Minister of Science and Technology. Reports on consolidated task results shall conform to Form No. B3-BCTH under Annex attached hereto.

7. Registration, storage, disposal of property, ownership, and use right of task implementation results

a) Registration and storage of task implementation results shall conform to Circular No. 14/2014/TT-BKHCN dated June 11, 2014 of Minister of Science and Technology.

b) Disposal of property, transfer of ownership and use right of task implementation results shall conform to Law on Management and Use of Public Property and relevant applicable documents.

Article 11. Identification and organization for implementation of other periodic tasks for technological innovation

2. Based on Decision on approving list of tasks under Clause 1 of this Article, Department of Technology Application and Development shall request Minister of Science and Technology to establish Consulting council and task expenditure appraisal team (hereinafter referred to as “Appraisal council”).  

3. Appraisal council:

a) Appraisal council consists of 5 members, in which: head of Board of Program directors shall act as the Director; An expert in technological innovation shall act as the Vice Director; A representative of Department of Technology Application and Development shall act as a member; A representative of the Department of Planning-Finance shall act as a member; A representative of National Technology Innovation Fund shall act as a member. Administrative secretaries of the Appraisal council are responsible for preparing and sending documents to all council members.

b) Working principles of Appraisal council:

- The Council shall hold a meeting when at least 4 out of 5 council members are present, including at least the Director or authorized Vice Director.

- Records of appraisal of details and task expenditure shall be prepared using Form No. C2-BBTDDK under Annex attached hereto.

4. Based on appraisal results of the Appraisal council, Department of Technology Application and Development shall request Minister of Science and Technology to consider and approve presiding entities, hosts, implementation expenditure, and implementation period.

5. Based on Decisions on approving presiding entities, hosts, implementation expenditure, and task implementation period, Department of Technology Application and Development shall take charge and cooperate with National Technology Innovation Fund in signing contracts for task implementation with presiding entities using Form No. C3-HD under Annex attached hereto.

6. Presiding entities are responsible for developing reports on task results using Form No. C4-BCKQ under Annex hereof and sending to Department of Technology Application and Development for consolidation and presentation to Minister of Science and Technology for establishment of Council for task assessment and inspection.

a) Council for assessment and inspection consists of 5 members, in which: head of Board of Program directors shall act as the Director; An expert in technological innovation shall act as the Vice Director; A representative of Department of Technology Application and Development shall act as the member; A representative of the Department of Planning-Finance shall act as a member; A representative of National Technology Innovation Fund shall act as a member. Administrative secretaries of the Council are responsible for preparing and sending documents to all council members.

b) Working principles of Council for task assessment and inspection:

- The Council shall hold a meeting when at least 4 out of 5 council members are present, including at least the Director or authorized Vice Director.

- Records of assessment and inspection for task implementation results shall be prepared using Form No. C5-BBNTDK under Circular attached hereto.

8. Based on records of assessment and inspection of task implementation results, Department of Technology Application and Development shall request Minister of Science and Technology to consider and acknowledge task implementation results. Procedures for liquidating contracts for task implementation shall conform to Schedule C6-TLHD under Annex attached hereto.

Article 12. Expenditure on Program implementation

1. Expenditure on Program implementation shall be covered by: state budget; contributions of organizations and enterprises; National Technology Innovation Fund; Science and technology development funds of enterprises; contributions of domestic and foreign organizations and individuals; other legal funding sources as per the law.

2. Expenditure on Program implementation covered by state budget shall fund implementation of tasks and activities under Article 3 hereof. 

3. Management of finance for Program implementation shall conform to applicable regulations on finance for National science and technology programs and other relevant documents for management and implementation of science and technology tasks utilizing state budget.

Chapter IV

PROGRAM MANAGEMENT

Article 13. Responsibilities and powers of Ministry of Science and Technology

1. Direct and coordinate organization for Program implementation according to assignment of Prime Minister under Decision No. 118/QD-TTg dated January 25, 2021 of Prime Minister.

2. Provide guidelines for identifying, selecting, assigning, and appraising task implementation expenditure; approve list of tasks; approve task details and expenditure; organize inspection and supervision of task implementation; revise and terminate contracts for task implementation; approve plans for selecting contractors for procuring machinery, equipment, goods, materials, ingredients, and services with state funding; organize assessment, inspection, result acknowledgement, and liquidation of contracts for implementing Program tasks. 

3. Consolidate annual expenditure statement of Program tasks and send to Ministry of Finance.

4. Approve works and general expenditure of Program; consolidate and balance estimates on total Program expenditure for inclusion in annual science and technology budget plans.  Cooperate with Ministry of Planning and Investment and Ministry of Finance in ensuring financing for Program activities.

5. Assess results, conclude Program activities, and report to Prime Minister on implementation and results of Program.

6. Perform other tasks as authorized by Director of Steering Committee.

Management entity of Program tasks shall be Department of Technology Application and Development affiliated to Ministry of Science and Technology and are responsible for:  

1. Taking charge mobilizing, receiving, consolidating proposed list of Program tasks; organizing identification, selection, assignment, appraisal of task expenditure; signing contracts for task implementation; verifying workload; assessing, inspecting, acknowledging results, and liquidating contracts for Program tasks.

2. Presenting to head of Ministry plans for selecting contractors for procuring machinery, equipment, materials, ingredients, and services with state funding.

3. Taking charge developing plans, budget estimates, organizing Program implementation; developing periodic reports, preliminary reports, assessment reports, and final reports on Program implementation; organizing preliminary conclusion and final conclusion regarding Program implementation.

4. Cooperating with National Technology Innovation Fund in regularly or irregularly inspecting, assessing tasks, revising expenditure, terminating contracts during task implementation, and disposing property once Program tasks have been completed.

5. Recommending methods of commendation and praise for organizations and individuals attaining achievements in creation and innovation of technology that yields socio-economic effectiveness to Minister of Science and Technology.

6. Managing other periodic tasks for technological innovation; developing, updating databases on current conditions, level and capacity of technology in sectors, new technology, advanced technology, technology expert, and automatic consulting network to utilize these databases in technological innovation.

7. Developing, maintaining, updating task implementation on website of the Government; publicizing Program activities; popularizing and multiplying implementation results of Program tasks; operating technology utilities and software for managing and organizing Program implementation online/offline.

8. Implementing other tasks assigned by Minister of Science and Technology.

Entity in charge of managing expenditure on Program task implementation shall be National Technology Innovation Fund affiliated to Ministry of Science and Technology, are responsible for:

1. Taking charge and cooperating with Department of Technology Application and Development in receiving financial instrument, managing expenditure, providing funding, verifying funding, settling funding; inspecting and assessing tasks regularly or irregularly, revising expenditure, terminating contracts during task implementation; disposing property after finishing Program tasks and other assigned tasks relating to managing expenditure on Program  implementation according to regulations on managing finance of the Program and applicable regulations on using state funding. 

2. Cooperating with Department of Technology Application and Development in developing plans, preparing budget estimates on Program implementation; selecting, assigning, appraising task funding; signing task implementation contracts; assessing, inspecting, accrediting results, and liquidating contracts for Program tasks; requesting head of Ministry to select contractors for procuring machinery, equipment, goods, materials and services with state funding.

3. Cooperating with relevant entities in producing periodic reports, preliminary reports, assessment reports, and final reports on Program implementation, organizing preliminary conclusion and final conclusion regarding Program activities within assigned functions.

Article 16. Board of Program directors

1. Board of Program directors shall be established by Minister of Science and Technology. Board of Program directors consists of 9 to 11 members, including a Director, a Vice Director, a Secretary, and other members designated by Minister of Science and Technology.

2. Board of Program directors shall perform tasks according Article 8 of Circular No. 05/2015/TT-BKHCN dated March 12, 2015 of Minister of Science and Technology.

Article 17. Responsibilities and powers of ministries, ministerial agencies, Governmental agencies, People’s Committees of provinces and central-affiliated cities

1. Guiding organizations and individuals to register for Program participation.

3. Cooperating with Ministry of Science and Technology in identifying tasks, monitoring, inspecting, supervising implementation of science and technology tasks of ministries and local governments.

4. On an annual basis, submitting reports on Program to Ministry of Science and Technology.

Article 18. Responsibilities and powers of presiding entities and hosts of tasks

1. Presiding entities have the responsibilities and powers as follows:

a) Developing, completing documents on selecting, appraising tasks as per the law;

GUIDELINES

FOR REPORT CONSOLIDATING TASK RESULTS WITHIN THE NATIONAL TECHNOLOGICAL PROGRAM UNTIL 2030

Report consolidating task results within the National technological program until 2030 (hereinafter referred to as “consolidating report”) is a document concluding implementation and attained results produced when a topic, project, scheme expires in order to assist inspection and shall serve as the basis for accrediting research results, contract liquidations, and storage as per the law once the consolidating report has been revised according to the national assessment council.

For convenience purposes, the consolidating report must be subject to regulations on basic format similar to other scientific reports and must reflect all science and technology contents mentioned under task presentation outline, to be specific:

2.7. List of reference documents

Only include documents referred to, used, or mentioned for research and discussion in the report. While writing the report, if a detail is relevant to a reference document, the detail must be numbered under list of reference document or placed in brackets [].

2.8. Annex

III. PRESENTATION OF CONSOLIDATING REPORT

The report must be presented in a concise, coherent, and clean manner, containing any erasure, having pages and schedules, illustrations, charts numbered.

3.1. Document composing

The report must be printed on a blank A4 paper (210 mm x 297 mm) and assembled into a book; presentation: portrait orientation. If the contents involve schedules or tables which cannot be included in separate annexes, the report can be produced in landscape orientation; page margins: 20 - 25 mm for top and bottom margins, 30 - 35 mm for left margin, and 15 - 20 mm for right margin; font: Times New Roman font, using Unicode in accordance with National Standards No. 6909:2001, black in color; font size of 13 to 14 and regular character spacing.

3.2. Schedules, illustrations, and equations

The numbering of schedules, illustrations, and equations must adhere to chapter number; for example, Figure 3.4 means the fourth illustration in Chapter 3. All graphs and schedules gathered from other sources must be excerpted properly. Sources of reference must be listed adequately under Reference documents section. Title of a schedule must be positioned above the schedule, title of an illustration must be positioned below the schedule.

A mathematic equation can be presented on a single line or over multiple lines as long as the presentation stays consistent throughout the report. When a symbol is mentioned for the first time, its clarification and unit of measurement must accompany the equation that contains the symbol. All equations must be numbered and placed in parentheses or positioned on the right margin.

3.3. Acronyms and abbreviations

Refrain from abusing the use of acronyms and abbreviations in the report. If the report contains multiple acronyms and/or abbreviations, place the list of acronyms and abbreviations (arranged in alphabetical order) at the beginning of the report.

3.4. Annexes of the report

This section includes necessary contents aiming to visualize or support report contents such as figures, schedules, illustrations, etc. If the report utilizes answers to investigation report or inquiry, this investigation report or inquiry must be included in the Annex in its complete form; do not include such investigation report or inquiry after it has been summarized or revised. The annexes must not be thicker than the primary section of the report.

3.5. Summarized report

The summarized report aims to inform the readers about basic and unique characteristics of the topic/scheme/project in a concise manner. The summarized report must ranges within 25-30 pages in A4 format with presentation adhering to instructions under Section 3.1 hereof.

Article 4. Rights and obligations of parties

2. Rights and obligations of Party B

a) Organize adequate implementation of task contents in a manner that satisfies quality, progress, and criteria in accordance with the Presentation;

b) Guarantee to implement and transfer final products satisfactory to approved criteria;

c) Hold the right to act and decide on the use of assigned fundings for task execution by themselves;

d) Request Party A to provide information necessary for Contract execution;

e) Request Party A to provide adequate funding in accordance to progress specified under the Contract after completing tasks within guaranteed progress. Make sure to mobilize other funding sources as per commitment. Use the fundings for the right purposes, in accordance with applicable policies, and effectively;

f) Develop plans for bidding, procuring equipment, machinery, materials, and services of the task utilizing fundings provided by A (if any), request Party A to approve, and procure in accordance with regulations and law;

h) Produce reports on execution results and submit to Party A to enable assessment and inspection in accordance with regulations and law;

i) Assume responsibilities for cooperating with Party A in liquidating the Contract as per the law;

k) Publicize task execution results after obtaining Party A’s permission;

Article 5. Contract termination

This Contract shall be terminated in any of the following cases:

1. The task has been concluded and inspected for acceptance.

2. Task execution or continuation of task execution is considered unnecessary on a grounded basis and both parties have agreed to prematurely terminate the Contract.

3. The Party B is suspended from executing the task in accordance with decision of competent authority.

5. Party A fails to provide adequate funding in accordance with task execution progress without justifiable reasons;

Article 6. Financial disposition in case of Contract termination

1. Regarding tasks that have been completed and inspected for acceptance:

a) If the task has been completed and inspected for acceptance where the task is ranked “Đạt” (Qualified) or higher, Party A shall settle all expenses with Party B in accordance with this Contract.

b) If the task has been completed and inspected for inspection where the task is ranked “Không đạt” (Unqualified), Party B is responsible for returning all granted and unused state budget fundings. Party B shall return …...^1 of total state budget fundings used for the task in case of objective errors or ……^2 of total state budget fundings used for the task in case of subjective errors.

2. Regarding task that are terminated on a well-grounded basis that continuation of the tasks is no longer necessary, both parties shall identify workload completed by Party B which serves as the basis for calculating expenses used by Party B for the tasks and recovering the remaining expenses granted to Party B.

3. Regarding tasks that are suspended in accordance with decisions of competent authority or tasks under contracts which are terminated due to failure of Party B to submit documents to enable assessment and inspection of the tasks in accordance with regulations and law, Party B is responsible for returning all granted, unused state budget fundings. Party B shall return …...^3 of total state budget fundings used for the task in case of objective errors or ……^4 of total state budget fundings used for the task in case of subjective errors.

4. Regarding tasks that are not completed as a result of Party A’s fault which leads to Contract termination, Party B is not required to return the fundings used for task execution but is required to finalize the fundings in accordance with regulations and law.

Article 8. General terms

1. During Contract execution, if either party wishes to amend or present the basis for terminating Contract execution, this party must inform the other party at least 15 working days in advance before amending or terminating Contract execution, identify each party's responsibilities, and resolutions. All amendments (if any) must be recorded in writing, bear signatures of both parties, shall be considered parts of the Contract, and serve as the basis for inspecting task results for acceptance.

2. In case either party fails to promptly fulfill obligations agreed upon under the Contract due to a force majeure event, that party is responsible for informing the other party within 10 working days from the date on which the force majeure event occurs. Both parties are responsible for cooperating in identifying the cause(s) and reporting to competent regulatory authority for resolution in accordance with regulations and law.

3. Both parties are committed to comply with the Contract and assume responsibilities for cooperating and resolving difficulties that arise during implementation. The party that violates commitments under the Contract shall assume responsibilities in accordance with the law.

4. All disputes that arise during Contract execution shall be settled by both parties on the basis of negotiation. If unable to settle, both parties hold the right to bring the dispute to arbitration (or file a lawsuit at a competent court of law in accordance with regulations and law on civil proceeding).
