DECISION
ISSUING THE PROVISIONAL REGULATION ON THE
GRANTING AND MANAGEMENT OF ORIENTED TRAINING AND EDUCATION CERTIFICATES FOR
LABORERS SENT TO WORK ABROAD FOR DEFINITE TERMS
THE MINISTER OF LABOR, WAR
INVALIDS AND SOCIAL AFFAIRS
Pursuant to the Government’s Decree No. 96/CP
of December 7, 1993 on the functions, tasks, powers and organizational
structure of the Ministry of Labor, War Invalids and Social Affairs;
Pursuant to the Government’s
Decree No. 152/1999/ND-CP of September 20, 1999 stipulating the sending of
Vietnamese laborers and specialists to work abroad for definite terms;
Pursuant to Decision No. 1635/1999/QD-BLDTBXH of December 13, 1999 of the
Minister of Labor, War Invalids and Social Affairs, issuing the Regulation on
oriented training and education for Vietnamese laborers sent to work abroad for
definite terms;
At the proposal of the Director of the Department for Management of Labor
Cooperation with Foreign Countries,
DECIDES:
Article 1.- To issue together with this Decision the
Provisional Regulation on the granting and management of oriented training and
education certificates for laborers sent to work abroad for definite terms.
Article 2.- This Decision takes
effect 15 days after its signing.
Article 3.- The Director of the
Department for Management of Labor Cooperation with Foreign Countries; the
Director of Social Labor Publishing House; the directors of the
provincial/municipal Labor, War Invalids and Social Affairs Services; the
directors and the headmasters of the establishments providing oriented training
and education for Vietnamese laborers sent to work abroad for definite terms;
the heads of the concerned agencies and units shall have to implement this
Decision.

Chapter I
GENERAL PROVISIONS
Article 1.- Oriented training and education certificates
granted to laborers sent to work abroad for definite terms (hereafter referred
collectively to as the oriented training and education certificates for short)
mentioned in this Regulation are the oriented training and education
certificates issued together with Decision No. 1635/1999/QD-BLDTBXH of December
13, 1999 of the Minister of Labor, War Invalids and Social Affairs issuing the
Regulation on oriented training and education for Vietnamese laborers sent to
work abroad for definite terms.

Chapter II
MANAGEMENT OF ORIENTED
TRAINING AND EDUCATION CERTIFICATES
Article 3.- To assign the Department for Management of Labor
Cooperation with Foreign Countries to coordinate with the Social Labor
Publishing House in uniformly printing, managing and issuing oriented training
and education certificates throughout the country.
The oriented training and
education certificates shall be sealed with embossed stamp of the Department
for Management of Labor Cooperation with Foreign Countries on their cover (page
1) and ordinally numbered.
Article 4.- The training
establishments shall receive oriented training and education certificates from
the Department for Management of Labor Cooperation with Foreign Countries for
granting them to the laborers according to the quantity registered annually;
and quarterly and annually report to the Department for Management of Labor
Cooperation with Foreign Countries on the quantity already granted.
Article 5.- The Department for
Management of Labor Cooperation with Foreign Countries and the training
establishments shall have to open books to monitor the management and granting
of oriented training and education certificates; in cases where oriented
training and education certificates are lost or misplaced, the training
establishments shall, apart from reporting such to the Police office for
investigation and consideration, have to promptly report it to the Department
for Management of Labor Cooperation with Foreign Countries for consideration
and settlement.
Article 6.- The training
establishments shall perform the following tasks: Affixing photos of the
trainees granted with certificates, sealing stamp of the training
establishments on photos (in the right lower corner) and inscribing full
contents in the certificates; the contents inscribed in the certificates (pages
2 and 3) shall be written in black ink, handwriting must be clear; full names
of the trainees shall be written in capital letters.
Article 7.- The Department for
Management of Labor Cooperation with Foreign Countries shall guide the
withdrawal of original copies and replace them with new certificates if the
oriented training and education certificates are damaged.

Article 8.- The headmasters or the directors of the training
establishments shall have the competence to grant oriented training and
education certificates as prescribed in this Regulation.
Article 9.- The training establishments
shall organize the granting of oriented training and education certificates to
the trainees who have finished their study course according to the course-end
examinations decision within 05 days after the end of the course.
Article 10.- The trainees, who
have finished their oriented training and education course and passed the
examinations, shall be granted certificates. Those who have already received
certificates but lost them which is certified by the competent body, shall be
considered for re-granting. The re-granting of certificates shall be specified
by the Department for Management of Labor Cooperation with Foreign Countries.
Article 11.- The trainees shall
have the right to file their complaints to the Department for Management of
Labor Cooperation with Foreign Countries about the granting of oriented
training and education certificates by the training establishments according
the provisions of law. Within 15 days after receiving the complaints, the
Department for Management of Labor Cooperation with Foreign Countries shall
have to reply the complainants according to its competence.
Chapter IV
IMPLEMENTATION ORGANIZATION
Article 12.- Organizations and/or individuals committing
acts of violating the regulation on printing, issuance, management or granting
of oriented training and education certificates shall, depending on the
seriousness of their violations, be disciplined, administratively handled or
examined for penal liability.
Article 13.- The Department for
Management of Labor Cooperation with Foreign Countries shall have to guide the
training establishments in the granting and management of oriented training and
education certificates; regularly inspect and report on the implementation of
this Regulation.
