CIRCULAR
ON
SPEED AND SAFETY DISTANCE OF MOTOR VEHICLES AND HEAVY-DUTY VEHICLES
PARTICIPATING IN ROAD TRAFFIC
Pursuant to Law on Road traffic order and safety
dated June 27, 2024;
Pursuant to the Law on road dated June 27, 2024;
Pursuant to Decree No. 56/2022/ND-CP dated
August 24, 2022 of the Government on functions, tasks, powers and
organizational structure of the Ministry of Transport;
At the request of Director General of Department
of Road Infrastructure and Director General of Department for Roads of Viet
Nam;
The Minister of Transport issues a Circular on
speed and safety distance of motor vehicles and heavy-duty vehicles
participating in road traffic.

Article 1. Scope
This Circular provides for design speed of roads;
allowable speed and safety distance of motor vehicles and heavy-duty vehicles
participating in road traffic.
Article 2. Regulated entities
This Circular applies to vehicle operators,
heavy-duty vehicle operators and organizations, individuals related to
management and implementation of regulations on design speed of roads;
allowable speed and safety distance of motor vehicles and heavy-duty vehicles
participating in road traffic.
Article 3. Term interpretation
For the purposes of this Circular, the terms below
shall be construed as follows:
1. “A residential road” means a road in
urban city, urban commune, urban town, and roads where many people live nearby;
indicated by traffic signs signaling beginning with “Start of residential zone”
and ending with “End of residential zone”.
2. “Dual carriageway” means a road whose
directions of travel area separated by dividers
3. “One-way road” means a road that only
facilitates one direction of travel.

5. “Payload” means the permitted gross
weight, determined according to Certificate of conformity from inspection of
technical safety quality and environmental protection of road motor vehicles,
certificate of conformity from inspection of technical safety quality and
environmental protection for imported motor vehicles, Certificate of conformity
from inspection of technical safety quality and environmental protection for
the types of produced, assembled automobiles.
6. “Maximum allowable speed” means the
highest speed allowed for vehicles to participate in road traffic to ensure
traffic safety and efficient operation of the route.
7. “Minimum allowable speed” means the
lowest speed allowed for vehicles to participate in road traffic to ensure
traffic safety and efficient operation of the route.
8. “Safety distance” means the minimum
distance between the vehicle behind and the vehicle moving directly ahead in
the same lane, ensuring to prevent collisions in case the vehicle ahead
suddenly reduces speed or stops.
9. “Speed” means the velocity of a vehicle
at the time it participates in road traffic.
Article 4. Rules on compliance
with regulations on allowable speed and distance during participation in road
traffic
1. While participating in road traffic, vehicle
operators, heavy-duty vehicle operators must comply with regulations on
allowable speed and safety distance specified in Article 12 of Law on Road
Traffic Order and Safety.
2. With respect to roads that are not installed with
maximum allowable speed signs or signs prescribing safety distance between 2
vehicles, the vehicle operators participating in road traffic must comply with
Articles 5, 6, 7, 8 and 11 hereof.

Article 5. Design speed of
roads
1. Design speed of roads is a value used for
calculating technical parameters of roads. Design speed of road is determined
during road construction, upgrade, and renovation of roads to ensure safe
vehicle operation; determined by technical grade of the roads and natural
geography.
2. Design speed of expressways is a value used for
calculating technical parameters of expressways and determined by technical
grade of the expressways. When designing expressways, different design speeds
can be applied for each transition segment, but the length requirements for
transition segments and intermediate design speeds between segments must be
ensured. The design speed of expressways is determined according to the
National Technical Regulation on Expressways QCVN 115:2024/BGTVT.
3. Road design speed is determined according to
National Standard TCVN 4054: 2005 Highway - Specifications for design.
4. The design speed of roads within urban areas is
determined according to the National Technical Regulation on technical
infrastructure system QCVN 07-4:2023/BXD.
5. The design speed of rural roads is determined
according to National Standard TCVN 10380:2014 Rural Roads – Specifications for
Design.

Article 7. Maximum allowable
speed for heavy-duty vehicles, mopeds and similar vehicles participating in
road traffic (except for expressways)
Maximum allowable speed for heavy-duty vehicles,
mopeds and similar vehicles participating in road traffic is 40km/h.
Article 8. Maximum allowable
speed for four-wheeled motor passenger vehicles, four-wheeled motorized goods
transport vehicles participating in road traffic (except for expressways)
1. Maximum allowable speed for four-wheeled motor
passenger vehicles within the permitted operating range and time is 30km/h.
2. Maximum allowable speed for four-wheeled
motorized goods transport vehicles within the permitted operating range and
time is 50km/h.

1. Highways must be installed with maximum
allowable speed and minimum allowable speed signs.
2. The maximum allowable speed on the expressway is
120 km/h.
3. The minimum allowable speed on the expressway is
60 km/h. In case the expressway has a design speed of 60 km/h, the minimum
allowable speed shall comply with the traffic organization plan approved by the
competent authority.
4. Maximum and minimum allowable speeds on
expressways, including roads leading to and from expressways, are determined in
the traffic organization plan approved by competent authorities.
Article 10. Erection of speed
limit signs
1. The erection of speed limit signs shall comply
with road signal laws and take into account practical conditions of routes and
segments of the roads relating road infrastructure, rate and type of vehicles
and time frames within the day.
2. The competent authority specified in Clause 3 of
this Article shall make decisions on placing signs in the following cases:
a) For dual carriageways, place separate maximum
allowable speed signs for each direction of the road;
b) Place signs indicating maximum allowable speed
for a period of time during the day (sub-signs, electronic signs);

d) Place speed limit signs in the cases specified
in Clause 4 of this Article.
3. The competent authority shall decide to place
signs in the cases specified in Clause 2 of this Article, including:
a) Department for Roads of Vietnam, Vietnam
Expressway Authority (for expressways assigned to manage by the Ministry of
Transport);
b) Department for Roads of Vietnam (for
expressways assigned by the State to enterprises to manage, operate, use;
national highway systems and other roads managed by the Ministry of Transport;
c) People's Committees of provinces,
centrally-affiliated cities for expressways, national highways, provincial
roads, district roads, commune roads, village roads, urban roads and special-use
roads with public transport activities under their management.
4. Competent road authorities specified in Clause 3
of this Article shall take charge and cooperate with the traffic police force
on the route and the People's Committee at the district where the road section
requiring allowable speed signs is located in reviewing and deciding on the
allowable speed and organize the placement of such signs in the following
cases:
a) Roads in operation are located in residential
areas with unfavorable conditions (one-way or two-way roads with a total road
width of less than 3.0m with infrastructure works concentrated and close to the
edge of the road, providing limited vision).
b) Roads in operation outside residential areas of
class IV, class V, and class VI roads and roads with technical grades specified
in Point d of Clause 2 of Article 10 of the Road Law, with unfavorable
conditions, posing potential risks to traffic safety (small curve radius,
consecutive curves, large longitudinal slope, limited vision).

2. Safety distance between two vehicles when
participating in road traffic
a) In dry road conditions, no fog, non-slippery
road surface, flat terrain, straight road, clear vision, the safe distance for
each speed is specified as follows:

When controlling a vehicle slower than 60 km/h, a
vehicle operator, heavy-duty vehicle operator must maintain the appropriate
safe distance from the vehicle in his/her immediate front; this distance
depends on actual vehicle density and traffic to ensure traffic safety.
b) With respect to rain, fog, slippery road, roads
with hairpin turns, steep slopes or limited vision, the operator must adjust
the safe distance value to be greater than that displayed on the sign or the
value specified in Point a of this Clause.
Chapter III
EFFECT
Article 12. Effect
1. This Circular comes into force from January 1,
2025 and replaces Circular No. 31/2019/TT-BGTVT dated August 29, 2019 of the
Minister of Transport regulating the speed and safe distance of motor vehicles
and heavy-duty vehicles participating in road traffic, replacing Article 15 of
Circular No. 06/2023/TT-BGTVT dated May 12, 2023 of the Minister of Transport
amending Circulars related to management, operation, use, maintenance and
protection of roads.
