CIRCULAR
ON TEACHING OVERLOAD
PAY FOR TEACHERS IN PUBLIC EDUCATION INSTITUTIONS
Pursuant to the Law on Education No.
43/2019/QH14;
Pursuant to the Labor Code No. 45/2019/QH14;
Pursuant to Decree No. 37/2025/ND-CP dated
February 26, 2025 of the Government on functions, tasks, powers, and
organizational structures of Ministry of Education and Training;
Pursuant to Decree No. 204/2004/ND-CP dated
December 14, 2004 of the Government on salaries for cadres, civil servants,
public servants, and armed forces;
Pursuant to Decree No. 145/2020/ND-CP dated
December 14, 2020 of the Government elaborating the Labor Code pertaining to
working conditions and labor relations;

Article 1. Scope
1. This Circular prescribes teaching overload pay
for teachers in public education institutions of national education system.
2. This Circular does not apply to teachers in
education institutions affiliated to the Ministry of National Defense and the
Ministry of Public Security.
Article 2. Regulated entities
1. Teachers and teachers holding managerial
positions in education institutions (hereinafter referred to as “teachers”)
under payroll approved by competent authorities and teaching in public
education institutions in national education system.
2. Teachers under payroll approved by competent
authorities and guiding practice at workshops, stations, facilities,
laboratories in public education institutions or guiding practice on training
vessels.
Article 3. General provisions pertaining to
calculation of teaching overload pay
1. Standard teaching hours/school year for
preschool teachers; teaching load/school year for teachers in formal education,
continuous education, college-preparatory education systems; standard lecturing
hours/school year for lecturers in higher education institutions, education and
training facilities of ministries, ministerial agencies, Governmental agencies,
political organizations, socio-political organizations, political education
institutions of provinces and central-affiliated cities are generally referred
to as teaching load/school year.
2. Monthly salaries used as the basis for
calculating teaching overload pay of teachers include: salaries determined by
salary factor (or working positions), allowances for leadership positions (if
any), salary-based allowances, and retained difference coefficient (if any).

a) Total number of overload periods in a school
year of a teacher eligible for teaching overload pay shall not exceed 200
periods except for cases detailed under Point b of this Clause;
b) Where total number overload periods in a school
year of a teacher exceeds 200 due to insufficient number of teachers assigned
to the subject, figureheads of the relevant education institution shall be
required to inform competent authorities in writing.
4. Total number of overload periods in a school year
of all teachers
a) Total number of overload periods in a school
year of all teachers in an education institution shall not exceed the total
number of overload periods in a school year of an education institution
according to Clause 1 Article 4 hereof except for cases detailed under Point b
of this Clause;
b) Where total number of overload periods in a
school year of all teachers in an education institution is higher than the
maximum number of overload periods in a school year of the education institution
due to insufficient number of teachers assigned to a subject, figureheads of
education institutions are required to inform competent education authorities
in writing.
5. Where teachers have received salaries or wages
for tasks, periods of time that they spent on executing the tasks shall not be
converted to number of periods or used as deduction to teaching load for the
purpose of calculating teaching overload pay unless otherwise prescribed by the
law.
6. A school year under this Circular starts from July
1 of a year to June 30 inclusive of the following year (summer break included).
In case of emergency or irregular situations for
the purpose of preventing, preparing for natural disasters, epidemic, or other
emergencies where schedule of school year must be adjusted, starting date and
ending date of a school year shall be compliant with documents on adjustment of
the school year issued by competent authorities.
7. Teachers shall receive teaching overload pay at
the end of school year. Where teachers retire, are discharged, transferred, or
re-assigned, teaching overload payment shall occur on the date on which
decision on retirement, discharge, transfer, or reassignment is issued by
competent authorities.

9. Periods of time in which teachers do not
directly participate in teaching but are deemed to have fulfilled the teaching
load and which are counted towards total number of periods in a school year of
the teachers include:
a) Periods of time in which teachers perform other
tasks under assignment or mobilization of education institutions or competent
authorities (except for tasks for which teachers have received wages);
b) Periods of time in which teachers are sent by
competent authorities to attend training or advanced training and do not
directly participate in teaching;
c) Other periods of time that are counted towards
fulfillment of teaching load as per the law.
10. Teaching overload pay for seconded teachers or
teachers who carry out inter-school teaching shall be determined as follows:
a) Education institutions to which teachers are
seconded shall pay seconded teachers teaching overload pay;
b) Education institutions where teachers carry out
inter-school teaching shall pay the teachers engaging in inter-school teaching
teaching overload pay. Where teachers are assigned to carry out inter-school
teaching at at least 3 education institutions (including education institution
where the teachers are employed), the teachers shall be paid for teaching
overload by education institutions where they carry out inter-school teaching
on the basis of percentage of periods that the teachers are assigned to at
these education institutions.
Article 4. Total number of overload periods in a
school year
1. The maximum number of overload periods that are
eligible for teaching overload pay incurred by an education institution shall
be determined as follows:

Where:
a) Total number of periods for performance of other
tasks/school year includes: total converted number of periods/school year as
per the law; total additional number of periods/school year as per the law;
b) Total teaching load of all teachers/school year
includes: total teaching load/school year of all teachers in a full school year
(excluding teachers assigned to carry out inter-school teaching); total number
of periods conducted by teachers assigned to carry out inter-school teaching
(if any)/school year at education institutions where the teachers are employed;
total teaching load/actual working time in case working period does not cover a
full school year (including invited and seconded teachers).
Teaching load/actual working time shall be
calculated in accordance with Point a, Point b, and Point c Clause 2 Article 6
hereof.
2. Total number of overload periods in a school
year for teachers shall be determined as follows:
Number of overload periods of teachers/school year
= (Total number of periods in practice/school year) - (Teaching load/school
year).
Where:
a) Total number of periods in practice/school year
includes: number of periods fulfilled in practice/school year; converted number
of periods/school year as per the law (if any); additional number of
periods/school year as per the law (if any); number of periods counted towards
fulfillment of teaching load/school year as per the law (if any).
In respect of teachers seconded or assigned to
carry out inter-school teaching, number of periods in practice/school year
means total number of periods in practice/school year in all education
institutions where the seconded or assigned teachers teach;

c) Teaching load/school year of teachers in other
education institutions shall conform to applicable regulations of the law on
working regimes of teachers;
d) Where regulations on teaching load/school year
of teachers are not available, figureheads of education institutions shall
prescribe in writing after negotiating and reaching a consensus with all
teachers and managerial personnel of the education institutions.
3. On the basis of the maximum number of overload
periods in a school year which education institutions use in determination and
payment of teaching overload pay and number of overload periods of each
teacher, figureheads of education institutions shall determine number of
overload periods of each teacher eligible for teaching overload pay in a manner
compliant with Clause 3 Article 3 hereof.
Article 5. Teaching overload pay
1. Salaries of 1 period of teachers shall be
determined as follows:
a) For teachers in preschool, formal education
institutions, continuous education institutions, college-preparatory schools,
specialized schools, and vocational education and training facilities:

c) For female teachers holding managerial positions
of education institutions or teachers assigned to act as personnel in charge of
teams, associations, groups in education institutions, teaching load/school
year under Point a and Point b of this Clause shall be teaching load/school
year of teachers in the same education level and training level in the
education institutions.
2. Salaries of 1 overload period = Salaries of 1
period x 150%.
3. Teaching overload pay/school year = Number of
overload periods/school year x Salaries of 1 overload period.
4. Teaching overload pay for teachers under Clause
2 Article 2 hereof shall conform to regulations on overtime pay of labor laws.
Article 6. Teaching overload pay for teachers
who do not work a full school year

2. Salaries of 1 period for teachers who do not
work a full school year shall be determined as follows:

b) For teachers in formal education institutions,
continuous education institutions, college-preparatory schools, specialized
schools: Teaching load/actual working time = (Average teaching load in 1 week)
x (Actual number of teaching weeks corresponding to actual working time);
c) For teachers in other education institutions:
Teaching load/actual working time = [(Teaching load/school year) x (Actual
number of teaching weeks corresponding to actual working time)] / (Number of
teaching weeks in school year);
d) Number of weeks lecturing or teaching kids as per
the law excluding the reserved weeks.
3. Total number of overload periods in a school
year for teachers under this Article shall be determined as follows:
Number of overload periods of teachers/school year
= (Total number of periods fulfilled during actual working time) - (Teaching
load/actual working time).
Where:
Total number of periods fulfilled during actual
working time includes: Number of periods fulfilled during actual working time;
number of periods converted during actual working time as per the law (if any);
number of periods added in actual working time as per the law (if any); number
of periods deducted in actual working time as per the law (if any); number of
periods counted towards fulfillment of teaching load in actual working time as per
the law (if any).
For seconded teachers or teachers assigned to carry
out inter-school teaching, number of periods in actual working time refers to
total number of periods during actual working time at all education
institutions where the teachers teach or deliver lectures at.
4. Salaries of 1 overload period and hourly
salaries of teaching overload/school year for teachers under Clause 1 of this
Article shall be determined in accordance with Clause 2, Clause 3 Article 5
hereof.

Article 7. Funding sources
1. Funding sources for incurring teaching overload
pay shall be covered by financial sources of public service providers in
accordance with Decree No. 60/2021/ND-CP dated June 21, 2021 of the Government;
Decree No. 111/2025/ND-CP dated May 22, 2025 of the Government, and guiding
documents.
2. Preparation of estimates, payment, settlement of
expenditure on teaching overload pay shall conform to regulations of the law
applicable to public service providers, and relevant documents. Public
education institutions shall, depending on their conditions, pay or give
advance teaching overload pay every month or semester or school year
accordingly.
Article 8. Entry into force and responsibilities
for implementation
1. This Circular comes into force from the date of
signing.
2. Payment of teaching overload pay for teachers in
2024 - 2025 school year shall conform to Joint Circular No.
07/2013/TTLT-BGDDT-BNV-BTC dated March 8, 2013 of the Minister of Education and
Training, the Minister of Home Affairs, and the Minister of Finance.
3. Annul Joint Circular No.
07/2013/TTLT-BGDDT-BNV-BTC dated March 8, 2013 of the Minister of Education and
Training, the Minister of Home Affairs, and the Minister of Finance.
4. Figureheads of higher education institutions,
colleges, training and advanced training facilities of ministries, ministerial
agencies, Governmental agencies, political organizations, socio-political
organizations, political schools of provinces and central-affiliated cities
shall, in accordance with this Circular, working regimes of teachers, relevant
law provisions, and practical situations of education institutions, prescribe
teaching overload payment for teachers under their management.
5. If documents referred to under this Circular are
amended or superseded, the new documents shall prevail.
