CIRCULAR
PROMULGATING REGULATION ON REGULAR REFRESHER TRAINING OF
TEACHERS, MANAGERS OF EARLY CHILDHOOD EDUCATION INSTITUTIONS, GENERAL EDUCATION
INSTITUTIONS AND TEACHERS OF CONTINUING EDUCATION CENTERS
Pursuant to the Law on
Education dated June 14, 2005 and Law on Amendments to the Law on Education
dated November 25, 2009;
Pursuant to the
Government’s Decree No. 69/2017/ND-CP May 25, 2017 defining the functions,
tasks, powers and organizational structure of the Ministry of Education and
Training;
Pursuant to the
Government's Decree No. 75/2006/ND-CP dated August 02, 2006 detailing and
guiding the implementation of a number of articles of the Education Law; the
Government's Decree No. 31/2011/ND-CP dated May 11, 2011 amending and
supplementing a number of articles of the Government's Decree No. 75/2006/
ND-CP of August 2, 2006, detailing and guiding a number of articles of the
Education Law; the Government’s Decree No. 07/2013/ND-CP dated January 9, 2013
amending Point b, Clause 13, Article 1 of the Government's Decree No.
31/2011/ND-CP of May 11, 2011 amending, supplementing a number of articles of
the Government's Decree No. 75/2006/ND-CP dated August 2, 2006 detailing and guiding
the implementation of a number of articles of the Education Law;
Pursuant to the
Government’s Decree No. 101/2017/ND-CP dated September 01, 2017 on training and
refresher training of officials and public employees;
At the request of the
Director General of Teachers and Educational Managers Department;
The Minister of
Education and Training promulgates a Circular on regulation on regular
refresher training of teachers, managers of early childhood education
institutions, general education institutions and teachers of continuing
education centers.

Article 2. This Circular comes into force from December 28, 2019. The
Circular supersedes Circular No. 26/2012/TT-BGDDT dated July 10, 2012 of the
Minister of Education and Training on regulation on regular refresher training
of teachers of early childhood education institutions, general education
institutions and continuing education centers.
Article 3. Chief of Office, Director General of Teachers and
Educational Managers Department, Heads of units under the Ministry of Education
and Training, Directors of Education and Training Departments, relevant
organizations and individuals shall be responsible for the implementation of
this Circular./.

Article 1. Scope
This Regulation
promulgates regular refresher training of teachers, managers of early childhood
education institutions, general education institutions and teachers of
continuing education centers, including: organization of regular refresher
training; assessment and recognition of the result of regular refresher
training of teachers, managers of early childhood education institutions,
general education institutions and teachers of continuing education centers.
Article 2. Regulated
entities:
This Regulation applies
to:
1. Teachers who are taking care of, nurturing and educating
children at preschools, kindergartens, nursery schools, daycare groups,
independent kindergarten classes (hereinafter referred to as “early childhood
education institutions”); teachers who are working at primary schools, middle
schools, high schools, combined schools, selective schools, boarding schools
for ethnic minority students and day schools for ethnic minority students
(hereinafter referred to as “general education institutions”) and teachers who
are working at continuing education centers. The teachers who are taking care
of, nurturing and educating children at early childhood education institutions
and teachers who are working at general education institutions and continuing
education centers are referred to as “teachers”.
2. Principals and deputy principals of early childhood
education institutions and general education institutions (hereinafter referred
to as “managers”).
3. Relevant organizations, individuals.
Article 3. Purposes of
regular refresher training
1. Provide refresher training according to requirements for
the working positions. Annually, provide refresher training in specialized
knowledge and skills that are compulsory for teachers and managers. This is the
basic for management, direction and organization of refresher training and
self-improvement in order to improve the qualities and capacity for
professional skills of teachers and managers. Raise the level of responsiveness
of teachers and managers according to the requirements for working positions;
meet requirements for the development of early childhood education, general
education, continuing education and meet the professional standards.

Article 4. Principle
of regular refresher training
1. Meet requirements for tasks throughout the school year;
meet professional standards; meet requirements for working positions and the
development needs of early childhood education institutions, general education
institutions, continuing education centers of sectors and administrative
divisions.
2. Ensure the development of awareness of self-study,
continuous refresher training at early childhood education institutions,
general education institutions and continuing education centers; selection for
the programs for refresher training according to professional standards and
working positions of teachers and managers.
3. Carry out assignment, delegation and mechanism for
cooperation in provision of regular refresher training.
4. Ensure reality, quality, publicity, transparency and
effectiveness.
Chapter II
ORGANIZATION OF REGULAR REFRESHER TRAINING
Article 5. Regular
refresher training programs
Develop regular refresher
training programs according to the programs issued by the Minister of Education
and Training (hereinafter referred to as “the regular refresher training
programs”), including: the regular refresher training programs for teachers,
managers of early childhood education institutions; the regular refresher
training programs for teachers, managers of general education institutions; the
regular refresher training programs for teachers of continuing education
centers.

2. Forms of regular refresher training:
a) Full time: Carry out
full-time refresher training; instruct teachers, managers in self-study,
practice, systematization of knowledge, reply to questions, contents of regular
refresher training in order to meet the needs of teachers and managers for
regular refresher training; facilitate exchange, sharing and discussion about
expertise, professionalism and practice of skills for teachers and managers.
The duration and number
of teachers and managers who participate in full-time refresher training shall
comply with delegation of management, ensure the requirements for purposes,
objectives, contents, methods, the duration of refresher training specified in
the regular refresher training programs and the regulations of this Regulation.
b) Distance: Carry out
the distance refresher training, promote the application of information
technology to online refresher training and training for teachers and managers
in order to ensure the requirements for purposes, objectives, contents, methods
and duration of refresher training specified in the regular refresher training
programs and the regulations of this Regulation;
c) Part time: Combine the
full-time refresher training with distance refresher training specified at
Points a and b of this Clause in order to ensure the efficiency and
requirements for regular refresher training of teachers and managers.
Article 7. Regular
refresher training documents
1. Drafting of the documents on regular refresher training
a) The drafted documents
shall conform to requirements for refresher training of teachers and managers
according to the professional standards, working positions, requirements for
innovation and improve the quality of teaching and education in conformity with
the plans for refresher training and the needs for development of human
resource of early childhood education institutions, general education
institutions, continuing education centers of the sectors and administrative
divisions.
b) The drafted documents
shall ensure a combination of theory and practice; knowledge, experience and
practical skills;

d) The drafted documents
shall conform to the forms of regular refresher training:
- Full-time regular refresher training documents: the documents
shall be drafted and distributed in forms of printed matters, audio tapes,
video tapes and other information storage devices in accordance with the
regulations of the regular refresher program and this Regulation.
- Distance regular refresher training documents: the
documents shall be drafted in form of learning materials (including: video
tapes, short films; radio programs, television programs; printed books, guiding
documents on teaching and learning via computers; online lessons, online discussions
and teleconferences; virtual exercises, simulation exercises and practical
exercises or other relevant materials) in order to ensure adequate provision
and conveyance of the contents and objectives of the regular refresher training
programs for learners. The learners can self-study and self-improvement
according to regulations of this Regulation.
- Part-time regular refresher training documents: Combine the
full-time regular refresher training documents with the distance regular
refresher training documents.
2. The education institutions performing the tasks in regular
refresher training (hereinafter referred to as “education institutions
performing tasks”) shall be responsible for drafting and evaluation of the
documents on regular refresher training. The teachers and managers can use the
refresher training materials drafted by the education institutions; extract and
use other appropriate documents.
Article 8. Regular
refresher training plan
1. The regular refresher training plan shall be made according
to the school year, including the plans of teachers, managers, early childhood
education institutions, general education institutions, continuing education
centers, Education and Training Divisions, and Departments of Education and
Training.
2. The plan shall clearly state the objectives, contents,
forms of regular refresher training and the outputs in order to meet the
requirements for the continuing professional development for teachers and
managers.

b) Early childhood
education institutions, general education institutions, continuing education
centers: According to the guidance of Departments of Education and Training,
the Education and Training Divisions, the delegation of management and the
regular refresher training plans of teachers and managers, the early childhood
education institutions, general education institutions and continuing education
centers shall develop the regular refresher training plans and submit them to
the superior education management authorities in June every year;
c) Education and Training
Divisions: According to the guidance of Departments of Education and Training
and the regular refresher training plans of early childhood education
institutions, general education institutions and continuing education centers,
the Education and Training Divisions shall develop the regular refresher
training plans and submit them to the Departments of Education and Training in
June every year;
d) Departments of
Education and Training: According to guidance of the Ministry of Education and
Training and the regular refresher training plans of the Education and Training
Divisions, high schools, general education institutions under their management and
continuing education centers, the Departments of Education and Training shall
develop the regular refresher training plans in order to implement in July
every year,
Article 9. Regular
refresher training speakers
1. Regular refresher training speakers are teachers of the
education institutions performing tasks; key experts, educational managers,
teachers and managers of early childhood education institutions and general
education institutions. The speakers shall meet the standards specified in
Clause 2 of this Article.
2. Standards of speakers:
a) Have obtained at least
a bachelor's degree. Have excellent qualities and professional capacity;
b) Master the regular
refresh training programs. Be capable of conveying the contents of documents on
regular refresher training in conformity with subjects of regular refresher
training;
c) Have experience of
regular refresher training of teachers and managers (from 3 years or more).
Have sense of responsibility, the ability to cooperate with colleagues. Have
the ability to guide and consult teachers and managers for self-study. Master
the process of organization, contents, techniques, methods and forms of
evaluation of the results of regular refresher training according to
regulations;

3. Responsibility of speakers: the speakers shall be
responsible for carrying out tasks assigned by the governing body, the
facilities that perform the regular refresher training according to the
visiting regime or labor contracts.
Article 10. Education
institutions performing tasks
1. The education institutions shall include:
a) Teachers: pedagogy
schools, education institutions with pedagogy faculties, education institutions
that are allowed to train and carry out refresher training of teachers;
b) Managers: pedagogy
schools, education institutions with pedagogy management faculties, education
institutions that are allowed to train and carry out refresher training of
educational managers.
2. Education institutions that carry out regular refresher
training shall meet the following requirements:
a) Education institutions
specified at Clause 1 of this Article;
b) Ensure the capacity
for development of the documents on regular refresher training according to
regulations of Article 7 of this Regulation;
c) Ensure the contingent
of speakers that meet standards according to regulations of Article 9 of this
Regulation;

3. The education institutions preforming tasks shall carry out
regular refresher training according to the method of assigning tasks or
signing the contracts.
Chapter III
EVALUATION AND RECOGNITION OF RESULTS OF
REGULAR REFRESHER TRAINING
Article 11. Evaluation
and classification of the results of regular refresher training
1. Carry out evaluation of the application of the knowledge of
regular refresher training to the practice of teaching and learning, education
for children and students; the practice of management of early childhood
education institutions, general education institutions and continuing education
centers. Carry out evaluation through the system of multiple-choice questions
(theoretical contents), research exercises and essays (practical contents) in
order to meet requirements for objectives and contents of the regular refresher
training program and regulations of this Regulation.
2. The theory and practice tests shall be graded on a 10-point
scale. A test is satisfactory if its score is 05 or higher.
3. Classification of the results:
a) Completion of the
plans for regular refresher training: the teachers and managers shall conform
to regulations of the refresher training courses; pass all the tests according
to regulations of Clause 2 of this Article;
b) Non-completion of the
plans for regular refresher training: the teachers and managers fail to meet
the requirements specified in Point a of this Clause.

Article 12. Issuance
of certificates of regular refresher training
Comply with regulations
of training, refresher training of officials and public employees.
Chapter IV
IMPLEMENTATION
Article 13. Mechanism
for cooperation between Departments of Education and Training, Education and
Training Divisions and education institutions performing tasks in performance
of the tasks.
1. Departments of Education and Training, Education and
Training Divisions according to their competence shall take charge and
cooperate with education institutions performing tasks in carrying out the
following tasks:
a) Carry out survey on
the needs for regular refresher training of teachers and managers in order to
develop the plans for regular refresher training in conformity with subjects
and practical needs;
b) Carry out regular
refresher training of teachers and managers according to the regular refresher
training programs and regulations of this Regulation.
2. The education institutions performing tasks shall take
charge and cooperate with Departments of Education and Training, Education and
Training Divisions in carrying out the following tasks:

b) Promptly provide
materials of refresher training and information about the situations of
refresher training of teachers and managers;
c) Carry out regular
refresher training and evaluate the results of regular refresher training
according to regulations.
Article 14.
Responsibilities of units under the Ministry of Education and Training
1. Teachers and Educational Managers Department;
a) Take charge and
cooperate with the functional units under the Ministry of Education and
Training in promulgation of the regulatory documents on regular refresher
training of teachers and managers; inspection of regular refresher training of
teachers and managers in the whole country; periodical organization of mid-term
and final evaluations of regular refresher training of teachers and managers;
b) Carry out other
relevant tasks assigned by the Minister of Education and Training.
2. The inspectorate of the Ministry of Education and Training
shall take charge and cooperate with the Teachers and Educational Managers
Department and the functional units under the Ministry of Education and
Training in inspecting the regular refresher training.
3. Other units under the Ministry of Education and Training
shall cooperate in inspecting and examining regular refresher training in order
to ensure the quality and effectiveness.
Article 15.
Responsibilities of Departments of Education and Training

2. Direct and inspect regular refresher training of teachers
and managers of Education and Training Divisions, education institutions under
their management
3. Take charge and decide selection of education institutions
performing tasks that are capable of regular refresher training of teachers and
managers according to their competence and regulations of this Regulation.
4. Advise the People's Committees of the provinces of the
funding sources for regular refresher training and relevant conditions serving
regular refresher training in accordance with regulations. The funding shall be
estimated in the annual budget for frequent expenditure from the support
funding of programs and projects or other sources according to regulations of
the Law (if any).
5. Report on regular refresher training of teachers and
managers to the Ministry of Education and Training (via Teachers and
Educational Managers Department) in June every year (after the end of school
year) according to request of the competent authority.
Article 16.
Responsibilities of Education and Training Divisions
1. Comply with the mechanism for cooperation specified in
Article 13 of this Regulation.
2. Direct and inspect regular refresher training of teachers
and managers of education institutions under their management
3. Advise the People's Committees of the districts of the
funding sources for regular refresher training and relevant conditions serving
regular refresher training in accordance with regulations. The funding shall be
estimated in the annual budget for frequent expenditure from the support
funding of programs and projects or other sources according to regulations of
the Law (if any).
4. Report on regular refresher training of teachers and
managers to the Departments of Education and Training in June every year (after
the end of school year) according to request of the competent authority.

1. Instruct teachers and managers to make the plans for
regular refresher training; make plans for regular refresher training of
teachers, managers and carry out the plans for regular refresher training.
2. Summary and report on implementation of the plans for
regular refresher training of teachers and managers in June every year (after
the end of school year) according to delegation of management and request of
the competent authority.
3. Carry out regimes and policies on teachers and managers who
participate in regular refresher training according to regulations.
Article 18.
Responsibilities and interests of teachers and managers
1. Develop and complete their plans for regular refresher
training; strictly implement regulations on regular refresher training
according to this Regulation.
2. Be entitled to full salary and allowances (if any) and
other regimes and policies according to regulations during the implementation
of the plans for regular refresher training.
Article 19.
Responsibilities of education institutions performing tasks
1. Comply with the mechanism for cooperation specified in
Article 13 of this Regulation; publicize the list of speakers; build a system
of multiple-choice questions (theoretical contents), research exercises and
essays (practical contents) to evaluate the results of refresher training
according to each content of the regular refresher training program and send
them to the Ministry of Education and Training (via the Teachers and
Educational Managers Department) before organization of regular refresher
training.
2. Cooperate with the other education institutions in training
and regular refresher training of teachers and managers (if necessary). Be
responsible for the quality and conditions for assurance about the
implementation of regular refresher training and in accordance with regulations
of this Regulation./.
