DECISION
APPROVING THE SCHEME
ON PILOT INNOVATION OF OPERATIONAL MECHANISM OF THE UNIVERSITY OF ECONOMICS HO
CHI MINH CITY DURING 2014 - 2017
THE PRIME MINISTER
Pursuant to the Law on the Organization of the
Government dated December 25, 2001;
Pursuant to the Law on Education dated June 14,
2005 and the Law on amendments to the Law on Education dated November 25, 2009;
Pursuant to the Law on Higher Education dated
June 18, 2012;
Pursuant to the Government’s Decree No.
49/2010/ND-CP dated May 14, 2010; the Government’s Decree No. 74/2013/ND-CP
dated July 15, 2013 amending certain articles of the Government’s Decree No.
49/2010/ND-CP dated May 14, 2010 on reduction and exemption of tuition fees,
support for learning cost, collection and use of tuition applicable to educational
institutions belonging to the national education system from the 2010 – 2011
academic year to the 2014 – 2015 academic year;
Pursuant to the Government’s Resolution No.
77/NQ-CP dated October 24, 2014 on pilot renovation of the operational mechanism
of public tertiary education institutions during 2014-2017;

DECIDES:
Article 1. To approve the Scheme on the
pilot innovation of the operational mechanism of the University of Economics Ho
Chi Minh City during 2014 – 2017 (referred to as the Scheme) with the following
principal contents:
I. Objectives
1. General objectives
The University of Economics Ho Chi Minh City
(referred to as “UEH”) shall actively, reasonably and effectively utilize its
resources to innovate and improve its operational quality in terms of training,
scientific research, organizational apparatus and personnel, and reduction of
funding from state budget; and provide opportunity to approach UEH’s training
programs for poor students and social policy beneficiaries.
2. Specific objectives
a) Improve training quality, ensuring that learners
are trained to meet standards of graduate quality as committed by UEH; are
provided with the opportunity of approaching scientific and technological
applications; and are provided with skill training and improvement of
professional ethics.
b) Develop training programs by referring training
programs provided by the world’s modern tertiary education institutions for
meeting social needs.
c) Develop training scale in a reasonable way in
conformity with UEH’s sources; attach special importance to high-quality
training programs and ordered programs.

dd) Strengthen the international cooperation for
supporting and stepping up UEH's training activities and scientific research.
e) Evolve UEH’s organizational structure and
personnel under the model of the world’s modern tertiary education institution;
revise procedures and apply information technology to the quality management
system for improving UEH’s managerial capacity; create environment and
conditions for developing UEH’s potentials and strengths in the best way.
g) Fulfill the social responsibility of the
national’s key public tertiary education institution with scholarship and study
encouragement policies and student credit policies; facilitate poor students,
social policy beneficiaries and student with difficult circumstance in getting
opportunity to study at this university.
II. Innovation
contents
1. Performance of scientific research and training
duties
a) Establish and perform training programs,
ensuring qualifications and skills of graduates; ensure that its lecturers,
managers, textbooks, learning materials and facilities shall satisfy
requirements as regulated.
b) Actively open bachelor's programs, master's
programs and doctoral programs in conformity with the UEH’s lecturers, managers
and facilities to meet the needs of the society.
c) Carry out the educational quality accreditation
in accordance with regulations on quality accreditation of tertiary education
institutions for the purpose of ensuring training quality.
d) Make plans on enrolment in accordance with
requirements and schedules of the Ministry of Education and Training and in
conformity with the social needs.

e) Exercise the autonomy in scientific research;
determine scientific research duties and appoint entities to perform scientific
research duties.
g) Exercise the autonomy in organizing educational
association programs (with issuance of diplomas), research and development with
foreign partners.
2. Organizational apparatus
a) Define functions and tasks of UEH's affiliated
units through its operational and operation regulations; decide and assume
responsibility for the establishment, merger, division, separation and
dissolution of UEH’s affiliated units for ensuring the apparatus’s operational
effectiveness.
b) Carry out the recruitment on the basis of
project on job positions approved by the university council; ensure the
openness, transparency, impartiality, objectiveness and compliance with the
law; and ensure the competitiveness while taking into account the preference
for priority objects as regulated.
3. Finance
a) Tuition
- UEH shall collect tuition on the stable basis in
accordance with the plan stated in the following scheme:

- UEH must calculate and publicly announce specific
tuition rates for groups of training disciplines before the enrollment,
ensuring that the average tuition rate (of general programs) shall not exceed
UEH’s maximum tuition rate as prescribed in this Decision.

b) Non-business revenues
UEH shall perform training support activities and
services to improve training quality and serve learners. Revenues from
these activities are publicly announced on the basis of taking revenues to
offset expenses without accumulations.
c) Salaries and incomes
Apart from rank and grade-based salaries as
prescribed by the State, UEH shall decide on additional incomes for its
employees by using the positive difference between revenues and expenses under
its internal spending regulations on the grounds of impartiality and
transparency.
d) Use of revenues
- Exercise the autonomy in making plans and
decisions on using UEH’s lawful revenues to invest in facilities as regulated
by the government.
- After covering recurrent expenses, UEH’s
remaining positive difference between revenues and expenses may be used to set
aside to the following funds: the fund for the development of non-business activities,
the award fund, the welfare fund, the fund for income stabilization and student
assistance funds.
- Collected tuition and non-business revenues shall
be deposited at commercial banks.
4. Policies on scholarships and tuition

b) Other than students who are eligible for tuition
reduction and exemption under State’s policies, UEH establishes and implements
policies on scholarship and study encouragement for students with excellent
achievements and policy beneficiaries.
5. Investment and purchase
a) Actively balance sources of revenues and mobilize
other lawful sources for promoting the overall development of UEH’s facilities
under the model of the world’s modern tertiary education institution.
b) Continue the execution of UEH’s investment
projects under the Decision on approving investment projects with funds from
state budget and UEH’s accumulations by the Minister of Education and Training
(Decision No. 3971/QD-BGDDT dated September 26, 2014).
6. Regulations on supervision
a) The university council shall make decision on
operational strategies and orientations of UEH; supervise the implementation of
resolutions made by the university council, the execution of democracy
regulations on its activities and the implementation of this Decision.
b) UEH shall publicly announce its internal
spending regulations. UEH’s internal spending regulations shall be annually
amended and supplemented by means of taking opinions in the whole university,
and approved at the meeting of delegates of its officials and public employees.
c) UEH shall publicly announce regulations on
supervision of lecturers, officials, public employees and learners on the
operation of UEH’s leading apparatus.
7. UEH shall exercise other rights and obligations
as regulated in the Government’s Resolution No. 77/NQ-CP dated October 24, 2014
on the pilot renovation of the operational mechanism of public tertiary
education institutions during 2014-2017 and other relevant documents.

1. Relevant ministries, regulatory bodies and local
governments shall, within the ambit of their functions and tasks regulated in
the Government’s Resolution No. 77/NQ-CP dated October 24, 2014 on the pilot
renovation of the operational mechanism of public tertiary education
institutions during 2014-2017 and other relevant legislative documents, perform
the supervision and give assistance to UEH during the implementation of this
Decision.
2. Relevant state authorities shall continue to
provide guidance and assistance to UEH on the performance and completion of
UEH’s investment projects.
Article 3. This decision takes effect as of
January 01, 2015.
Article 4. Ministers, Heads of
ministerial-level agencies, Heads of Government’s agencies, Chairpersons of
People’s Committees of provinces and central-affiliated cities, heads of
relevant organizations and relevant individuals shall implement this
Decision./.
