CIRCULAR
ON NOTARIAL APPRENTICESHIP
Pursuant to the Law on
Notarization dated November 26, 2024;
Pursuant to Government's Decree No.
98/2025/ND-CP dated February 26, 2025 on functions, tasks, powers and
organizational structure of the Ministry of Justice;
At the request of the Director of
the Department of Judicial Support;
The Minister of Justice promulgates
a Circular on notarial apprenticeship.

This Circular lays down notarial
apprenticeship and notarial apprenticeship management; notarial apprenticeship
examination.
Article 2.
Regulated entities
This Circular applies to notary
apprentices; notarial apprenticeship examinees; notary mentors; notarial
practice organizations that admit notary apprentices (hereinafter referred to
as notarial apprenticeship organizations); socio-professional organizations of
notaries; notarial authorities and relevant entities.
Chapter II
NOTARIAL APPRENTICESHIP
Article 3.
Registration of notarial apprenticeship
1. A person eligible for
registration of notarial apprenticeship under the Law on Notarization shall
independently arrange the apprenticeship with a notarial practice organization
on the list of notarial apprenticeship organizations eligible for accepting
apprentices, as announced by the Department of Justice on the Information
Portal or the Electronic Portal of the Department of Justice.
In case the notarial apprenticeship
organization accepts the apprenticeship, it shall assign a qualified notary
mentor and certify the application form for registration of notarial
apprenticeship of the applicant. In case of refusal, it must clearly state the
reason for refusal in the application form for registration of notarial
apprenticeship of the applicant.
2. An application for registration
of notarial apprenticeship includes the following documents:

b) Certificate of completion
of notary training course or certificate of recognition of equivalence for
persons who have completed notary training abroad;
The documents specified in Point b
of this Clause shall be originals, certified copies or electronic copies.
3. The person admitted by the
notarial apprenticeship organization shall prepare one set of application for
registration of notarial apprenticeship as specified in Clause 2 of this
Article and submit it directly or via postal service or electronically to the
Department of Justice where the notarial apprenticeship organization is
registered.
Within 07 working days from the
date of receipt of a complete and valid application, the Department of Justice
shall issue a decision on registration of notarial apprenticeship (Form
TP-TSCC-02), and concurrently send the decision to the applicant and the
notarial apprenticeship organization. In case of refusal, a written reply
specifying the reason must be provided.
4. Where an eligible person has
arranged with at least 03 notarial apprenticeship organizations eligible for
accepting apprentices within a province or centrally-affiliated city, or has
arranged with 01 notarial apprenticeship organization in case that province or
city has 03 or fewer eligible organizations, but has been refused, he/she shall
submit directly or via postal service or electronically 01 set of the
application as specified in Clause 2 of this Article to the Department of
Justice where the apprenticeship was arranged, for the Department of Justice to
assign an apprenticeship and register the apprenticeship.
Within 10 working days from the
date of receipt of a complete and valid application, the Department of Justice
shall consider and designate a notarial apprenticeship organization and issue a
decision on registration of notarial apprenticeship, and concurrently send the
decision to the applicant and the notarial apprenticeship organization. In case
there is no notarial apprenticeship organization eligible for accepting
apprentices in such province or city, the Department of Justice shall reply in
writing stating the reason. The person refused has the right to arrange
apprenticeship in another province or centrally-affiliated city.
Where necessary, the Department of
Justice shall verify the conditions for registration of apprenticeship and
acceptance of apprenticeship under the Law on Notarization and this Circular;
the verification time limit shall be a maximum of 10 working days and shall not
be included in the time for considering and designating the notarial
apprenticeship organization and registering the apprenticeship.
5. Any person falling into one of
the following cases shall not be eligible for registration of notarial
apprenticeship:
a) A person under criminal
prosecution; a person who has been convicted of an unintentional crime and
whose conviction record has not yet been expunged; a person who has been
convicted of an intentional crime, including cases where the conviction record
has been expunged;

c) A person who is incapacitated or
has limited active legal capacity; a person who has limited cognition or
behavior control;
d) A person who is an official,
public employee, except a public employee of a public notary office; an
officer, non-commissioned officer, soldier, professional soldier, worker, or
public employee of an agency or unit under the People’s Army; an officer,
non-commissioned officer, soldier, or worker of an agency or unit under the
People’s Public Security;
dd) A person who is a bailiff,
lawyer, auctioneer, asset manager, legal consultant, price appraiser, or
performing work as specified at Point h Clause 1 Article 9 of the Law on
Notarization;
e) An official disciplined by
dismissal; a public employee disciplined by removal; an officer,
non-commissioned officer, soldier, professional soldier, worker, or public
employee of an agency or unit under the People’s Army disciplined by stripping
of the soldier title or dismissal; an officer, non-commissioned officer,
soldier, or worker of an agency or unit under the People’s Public Security
disciplined by stripping of the People’s Public Security title or dismissal;
g) A bailiff, lawyer, auctioneer,
asset manager, legal consultant, or price appraiser who has been dismissed or
had the practicing certificate revoked due to law violations and whose 3-year
period from the effective date of the dismissal or revocation decision has not
yet expired;
h) A person working under an
employment contract for an agency, organization, or enterprise, except where working
under an employment contract with the notarial apprenticeship organization at
which he/she is apprenticing, or having an employment contract with an agency,
organization, or enterprise with working hours that do not coincide with the
working hours of the notarial apprenticeship organization.
6. The person registered for
apprenticeship by the Department of Justice shall be referred to as the notary
apprentice. The apprentice has the rights and obligations prescribed in the Law
on Notarization and this Circular.
Article 4.
Apprenticeship period
1. The apprenticeship period shall
comply with Clause 1 Article 12 of the Law on Notarization.

Article 5.
Apprenticeship skills and tasks
1. The
apprenticeship skills and tasks include:
a) Skills in receiving and classifying
notarization requests; skills in checking the authenticity and legality of
documents included in the documentation seeking notarial service; skills in
reviewing and identifying entities and active legal capacity of participants
signing transactions;
b) Skills in dealing with
notarization petitioners, behaving according to the Code of Ethics for notary
practice; skills in explaining to notarization petitioners their legal rights,
obligations and interests, the meaning and legal consequences of notarization;
skills in explaining reasons for refusing notarization requests;
c) Skills in studying and proposing
solutions to documentation seeking notarial service;
d) Skills in drafting transactions
at the request of a notarization petitioner; skills in checking the
authenticity and legality of drafts prepared by the notarization petitioner;
skills in verification as requested by the notarization petitioner;
dd) Skills in performing direct
electronic notarization, online electronic notarization for notarial practice
organizations that provide electronic notarization services; skills in
authenticating copies from originals, authenticating signatures in papers and
documents, authenticating translators’ signatures in accordance with laws on
authentication;
e) Skills in drafting testimonies;
g) Skills in checking, arranging,
classifying notarized and authenticated dossiers for record-keeping;

i) Skills in administrating
notarial practice organizations;
k) Other skills and tasks related
to notarization as assigned by the notary mentor.
2. The notary
mentor shall be responsible for guiding the apprentice in performing the
apprenticeship skills and tasks specified in Clause 1 of this Article.
Article 6.
Change of notary mentor
1. The change of the notary mentor
shall be effected if the notary mentor falls into any of the following cases:
a) Fails to fully perform
obligations prescribed in Article 13 of this Circular;
b) Dies or is declared dead or
missing by the Court; is declared by the Court to have no active legal
capacity, limited active legal capacity, or limited cognition or behavior
control;
c) Is temporarily suspended from
notarial practice, dismissed as notary, or no longer practices at the notarial
apprenticeship organization;
d) Is subject to disciplinary
actions, administrative sanctions in notarial practice, or found unqualified
for mentorship at the time of accepting mentorship;

2. Within 05 working days from the
date the notary mentor falls into any case prescribed in Clause 1 of this
Article, the notarial apprenticeship organization shall assign another
qualified notary to continue mentorship and notify the Department of Justice in
writing. Within 07 working days from the date of receiving the notice from
the notarial apprenticeship organization, the Department of Justice shall
record the change of notary mentor in the notarial apprenticeship logbook and
notify in writing the apprentice and the notarial apprenticeship organization.
In case the notarial apprenticeship
organization no longer has a qualified notary mentor, it shall notify the
Department of Justice in writing. Within 07 working days from the date of
receiving such notice, the Department of Justice shall designate another
notarial apprenticeship organization to accept the apprentice. Where no
eligible notarial apprenticeship organization remains in the locality, the
Department of Justice shall provide a written reply specifying the reason. The
apprentice has the right to change the place of apprenticeship to a notarial
practice organization in another province or centrally-affiliated city to
continue the apprenticeship.
Article 7.
Change of notarial apprenticeship organization
1. An
apprentice may change the notarial apprenticeship organization in any of the
following cases:
a) The notarial apprenticeship
organization suspends operation, ceases operation, is converted or dissolved in
accordance with the Law on Notarization and relevant legal documents;
b) The notarial apprenticeship
organization is no longer eligible for apprenticeship according to the Law on
Notarization;
c) The notary mentor falls into any
of the cases requiring replacement as provided in this Circular and the
notarial apprenticeship organization has no other qualified notary mentor;
d) The apprentice is an officer of
a public notary office who is transferred to another public notary office;
dd) The apprentice changes their
place of residence to another province or centrally-affiliated city and seeks
to change the notarial apprenticeship organization, or falls under the cases
where it is required to change the notarial apprenticeship organization as
prescribed in Points a and b and c in this clause but there is no more
qualified notarial apprenticeship organization in their province.

Within 03 working days from the
date of admission by the new notarial apprenticeship organization, the
apprentice shall submit an application for change of the notarial
apprenticeship organization (Form TP-TSCC-03) either directly, via postal
service or electronically to the Department of Justice where the apprenticeship
is registered. Within 5 working days from the date of receipt of the
application, the Department of Justice shall send a notice of approval for the
change to the apprentice, the old notarial apprenticeship organization, and the
new notarial apprenticeship organization. If the application is rejected, the
Department of Justice shall provide the applicant with a written explanation.
If the apprentice fails to arrange
apprenticeship with a new notarial apprenticeship organization and requests the
Department of Justice to arrange a new apprenticeship organization, within 10
working days from the date of receipt of the application for change, the
Department of Justice shall consider, designate a notarial apprenticeship
organization, and issue a written notice to the apprentice and the designated
notarial apprenticeship organization. In case of refusal, the Department of
Justice shall reply in writing stating the reasons to the applicant.
3. In
case of changing the notarial apprenticeship organization to another province
or centrally-affiliated city under Point dd Clause 1 of this Article, the
apprentice shall submit the application for change either directly, via postal
service or electronically to the Department of Justice where the apprenticeship
is registered. Within 05 working days from the date of receipt of the
application for change of notarial apprenticeship organization, the Department
of Justice shall issue a decision on deregistration of apprenticeship (Form
TP-TSCC-04), and send it to the apprentice and the notarial apprenticeship organization.
The apprentice shall either independently arrange the apprenticeship or request
the Department of Justice to designate a notarial apprenticeship organization
and register apprenticeship at the new notarial apprenticeship as prescribed in
Article 3 of this Circular to continue the apprenticeship. The application for
registration of apprenticeship must be accompanied by a decision on
apprenticeship deregistration as per this clause.
4. The
apprenticeship period before the apprentice changes to the new notarial
apprenticeship organization shall be included in the apprenticeship period.
Article 8.
Suspension of apprenticeship
1. An
apprentice may suspend their apprenticeship in any of the following cases:
a) The apprentice is on maternity
leave, or cannot travel due to health reasons, or is receiving inpatient
treatment, or is under quarantine as prescribed by a competent medical
establishment, or has other legitimate reasons preventing the apprenticeship;
b) The Private notary office
suspends operation and the apprentice does not request to change the
apprenticeship organization.
2. In the case specified in Point
a, Clause 1 of this Article, the apprentice must notify the notarial practice
organization where he or she is practicing in writing at least 5 working days
before the suspension date and provide documentation supporting the reason for
suspension. Where a force majeure event or objective impediment occurs
preventing notification within this time limit, the apprentice must notify as
soon as the event or impediment ceases.

3. An apprentice may suspend the
apprenticeship for a maximum of 02 times, each time not exceeding 06 months.
4. The
apprenticeship suspension period is not included in the apprenticeship period.
The apprenticeship period before
the suspension date is included in the apprenticeship period, unless the
apprentice has to re-register the apprenticeship as prescribed in clause 3 Article
9 of this Circular.
Article 9.
Termination of apprenticeship and re-registration of apprenticeship
1. The
apprenticeship ends when the apprentice falls into one of the following cases:
a) The apprentice terminates their
apprenticeship;
b) Is recruited as an official,
public employee (except a public employee working for a public notary office),
commissioned officer, professional soldier, national defense worker in an
agency or unit under the People’s Army; or commissioned officer,
non-commissioned officer, worker in an agency or unit under the People’s Public
Security;
c) The apprentice is working under
an employment contract for an agency, organization, or enterprise, unless that
person is working under an employment contract for a notarial practice
organization that he/she is serving the apprenticeship or that person signed an
employment contract with an agency, organization, or enterprise with working
hours that do not coincide with the working hours of the notarial practice
organization providing the apprenticeship;
d) The apprentice no longer
permanently resides in Vietnam;

e) The apprentice faces a criminal
prosecution or is convicted of a crime under a legally effective judgment of
the Court;
g) The apprentice is subject to an
administrative sanction;
h) Fails to undertake the
apprenticeship within 30 days from the effective date of the decision on
registration of apprenticeship issued by the Department of Justice, except as
provided in Point a Clause 1 Article 8 of this Circular;
i) The apprentice suspends the
apprenticeship not in accordance with regulations; or suspends the
apprenticeship more than the prescribed number of times, or fails to resume the
apprenticeship after the apprenticeship suspension period expires;
k) The apprenticeship is terminated
by the Department of Justice under Clause 3 Article 11 of this Circular;
l) Violates regulations on
apprenticeship as prescribed in this Circular and, despite being reminded and
requested for correction in writing by the notarial apprenticeship
organization, still continues to violate;
m) Is ineligible for registration
of apprenticeship at the time of registration.
2. Within 05
working days from the date of termination of apprenticeship under Points a, b,
c, d, dd, e, g, h, i, l and m Clause 1 of this Article, the notarial
apprenticeship organization must submit a written report either directly, via
postal service or electronically to the Department of Justice where it is
registered, clearly stating the reason for termination. Within 5 working days
of receiving the report, the Department of Justice shall issue a decision on
termination of the notarial apprenticeship (Form TP-TSCC-05) and then send a
notice to the apprentice and the notarial apprenticeship organization. In case
the notarial apprenticeship organization does not report but the Department of
Justice has information about the case falling into termination, the Department
of Justice shall verify and consider issuing a decision on termination.
3. A person
whose apprenticeship is terminated under Clause 1 of this Article may be
considered for re-registration if he/she meets the conditions prescribed in this
Circular and falls into any of the following cases:

b) A decision on suspension of
investigation or suspension of the case is issued, or the legally effective
judgment of the Court declares the person not guilty; his/her conviction record
has been expunged, except for convictions of intentional crime;
c) He/she has finished abiding by
an administrative sanction as per the law on administration sanctions;
d) One year has passed from the
effective date of the decision of the Department of Justice on termination of
apprenticeship under Points l and m Clause 1 of this Article.
4. A person
who was not recognized for apprenticeship completion, had the recognition
canceled, or failed three apprenticeship examinations may re-register if
eligible under this Circular.
5. Re-arrangement
with an notarial apprenticeship organization and procedures for re-registration
shall comply with Article 3 of this Circular; the application for
re-registration must follow Clause 2 Article 3 of this Circular, attached with
documents proving eligibility.
6. The
apprenticeship period before the apprenticeship termination is not included in
the apprenticeship period.
Article 10.
Apprenticeship journal and Apprenticeship performance report
1. The
apprentice must prepare an Apprenticeship journal to record daily
apprenticeship activities that he/she has performed during the notarial
apprenticeship period. The Apprenticeship journal shall be weekly certified by
the notary mentor and certified by the notarial apprenticeship organization
upon completion of the apprenticeship. The Apprenticeship journal shall be
prepared according to Form TP-TSCC-06.
In case the
apprentice changes the notarial apprenticeship organization, a separate
Apprenticeship journal must be prepared for each organization. Certification by
notary mentor and notarial apprenticeship organization shall comply with the
provisions of this Clause.

Where the apprentice changes
apprenticeship organization, a single Apprenticeship performance report shall
be prepared covering the entire apprenticeship process at all organizations.
The Apprenticeship performance report shall specify the names of the notarial
apprenticeship organizations, information about the notary mentors, and the
apprenticeship results at each organization. The notary mentor and the last
notarial apprenticeship organization shall be responsible for commenting and
certifying the Apprenticeship performance report for the period of
apprenticeship under their responsibility.
Article 11.
Completion of notarial apprenticeship
1. Within 30
days from the end of the notarial apprenticeship period, the notary apprentice
shall prepare a set of application documents for recognition of apprenticeship
completion, and submit it either directly, via postal service, or
electronically to the Department of Justice where the apprenticeship was
registered.
Required registration documents:
a) A written request for
recognition of apprenticeship completion;
b) The Apprenticeship performance
report and the Apprenticeship journal.
The documents specified in Point b
of this Clause shall be originals, certified copies or electronic copies.
Within 10 working days from the
date of receipt of a complete and valid application, the Department of Justice
shall issue a decision to recognize the completion of notarial apprenticeship
(Form TP-TSCC-08). In case of refusal, a written response must be provided
clearly stating the reasons.
Where the information in the
application is incomplete, inconsistent, or requires verification, the
Department of Justice shall request the apprentice to provide explanation,
supplement information, or conduct verification. The time limit specified in
this Clause shall be calculated from the date the Department of Justice
receives the explanation, supplement, or verification result.

a) The apprentice
satisfies the conditions for apprenticeship and does not fall into cases of
ineligibility for apprenticeship registration;
b) The notary
mentor is qualified for mentorship and does not fall into cases requiring
change of mentor during the mentorship process;
c) The apprentice
has completed the apprenticeship period; has submitted an Apprenticeship
performance report and Apprenticeship journal in accordance with the
requirements of this Circular and attached forms, has not copied from others,
and has submitted on time; if the submission is overdue due to force majeure
events or objective obstacles, supporting documents must be provided;
d) The apprentice
has fulfilled all other obligations of an apprentice.
3. A person
who meets the conditions specified in Clause 2 of this Article but fails to
request recognition of apprenticeship completion or submits such request beyond
the prescribed time limit without proving a force majeure event or objective
obstacle shall not be recognized as completing the apprenticeship. The
Department of Justice shall issue a decision on termination of apprenticeship
and send it to the apprentice and the notarial apprenticeship organization. A
person whose apprenticeship is terminated under this Clause may re-register
apprenticeship if he/she satisfies the apprenticeship conditions specified in
this Circular.
Where a person has been recognized as
completing the apprenticeship but is subsequently found not to have met the
conditions for recognition, the Department of Justice shall issue a decision to
cancel the recognition of apprenticeship completion. A person whose
apprenticeship performance is canceled may re-register for apprenticeship if
they meet the apprenticeship requirements specified in this Circular.
The re-arrangement of
apprenticeship, the application, and the procedures for re-registration of
apprenticeship shall be carried out in accordance with Clause 5 Article 9 of
this Circular.
Article 12.
Rights and obligations of apprentices
1. An
apprentice has the following rights:

b) The apprentice may receive
mentorship from the notary mentor as to apprenticeship skills and tasks,
performance of rights and obligations;
c) The apprentice may change the
notary mentor, change the notarial apprenticeship organization, suspend the
apprenticeship, terminate the apprenticeship, and re-register the
apprenticeship as prescribed in Articles 6, 7, 8 and 9 of this Circular;
d) The apprentice may receive the
recognition of apprenticeship completion as per Article 11 of this Circular;
dd) The apprentice may register to
sit a notarial apprenticeship exam as per Article 16 of this Circular;
e) Other rights prescribed by law
or agreed upon with the notarial apprenticeship organization in compliance with
the law.
2. An
apprentice has the following obligations:
a) Comply with the rules and
regulations of the notarial apprenticeship organization;
b) Completely and diligently
perform the apprenticeship tasks as specified in Article 5 of this Circular as
assigned by the notary mentor;
c) Ensure the apprenticeship period
shall comply with Clause 1 Article 12 of the Law on Notarization.

dd) Maintain confidentiality of
notarial wording and related information that he/she knows during the
apprenticeship process;
e) Prepare the Apprenticeship
journal and Apprenticeship performance report as prescribed in Article 10 of
this Circular;
g) Other obligations as prescribed
by the Law on Notarization, this Circular, relevant legal documents, and as
agreed with the notarial apprenticeship organization in compliance with the
law.
Article 13.
Rights and obligations of notary mentors
1. Refuse to instruct an apprentice
if not meeting the eligibility conditions as prescribed by the Law on
Notarization; to instruct the apprentice on the apprenticeship skills and tasks
specified in Article 5 of this Circular.
2. Monitor and
inspect the performance of the apprentice regarding the assigned tasks.
3. Certify the
Apprenticeship journal; to comment on and evaluate the apprenticeship in the
Apprenticeship performance report, and to be responsible for the accuracy,
honesty, and objectivity in their certification, comments, and evaluation.
4. The rights
and obligations according to the Law on Notarization and this Circular.
Article 14.
Rights and obligations of notarial apprenticeship organizations

2. Prepare, manage and use Notarial
apprenticeship logbook of notarial practice organizations (Form TP-TSCC-09)
each year.
The apprenticeship logbook must
record the date of opening the book, the date of closing the book and be
affixed seal across the margins of the pages as per the law.
3. Consider the notary mentor's
refusal to instruct the apprentice, and the change of notary mentors.
4. Manage apprentices during their
apprenticeship at their organization; monitor and supervise the performance of
notary mentors; ensure the performance of rights and obligations of apprentices
5. Submit a written report to the
Department of Justice on the admission and mentorship of apprentices at their
organization on an annual basis. The annual reporting period is from January 1
to December 31 of each year. Within 15 days after the end of the year, the
notarial practice organizations shall submit the report to the Department of
Justice.
The report shall include at least
the following:
a) Number and basic information
about apprentices, suspension of apprenticeship, change of notarial apprenticeship
organizations, change of notary mentors, termination of apprenticeship,
apprenticeship de-registration;
b) Evaluate the quality of the
apprentice's apprenticeship;

Chapter III
NOTARIAL APPRENTICESHIP
EXAMINATION
Article 15.
Contents and formats of examination
1. Examination contents include:
a) Laws on notarization and
authentication, Code of ethics of notarial practice and relevant regulations on
notarization;
b) Performance of notarial skills
and tasks as prescribed in Article 5 of this Circular.
2. Examination forms include a
written test lasting 180 minutes and a computer-based multiple-choice test
lasting 60 minutes.

a) He/she has received the
recognition of apprenticeship completion as per Article 11 of this Circular;
b) Those who have taken the
previous examination but did not meet the requirements, except those who failed
three examinations and have not re-apprenticed.
2. An apprentice may not register
for an examination if:
a) Those who have been recognized
as completing the apprenticeship but whose recognition has been cancelled;
b) Those who copied another
person’s Apprenticeship performance report or Apprenticeship journal or
committed other fraudulent or dishonest acts to register for examination;
c) Those who failed three
apprenticeship examinations and have not re-apprenticed.
3. The person registering for
examination shall prepare a set of registration documents and submit it either
directly, via postal service, or electronically to the Department of Justice
where the apprenticeship was registered.

a) A registration form to take the
notarial apprenticeship examination (Form TP-TSCC-10);

appraisal of notary standards and requirements.
The documents specified in Points b
and c of this Clause must be originals, certified copies, or electronic copies.
4. Within 15 working days from the date
of receipt of complete and valid documents, the Department of Justice shall
notify in writing the registrant of eligibility to request the Ministry of
Justice to allow examination; in case of refusal, a written response shall be
provided stating the reasons.
5. A person
notified by the Apprenticeship Examination Council as eligible shall be
considered an examinee. Persons who have submitted registration documents but
are notified of ineligibility, or who are eligible but fail to attend the
examination, shall not have their documents and fees returned. For subsequent
registration, they must submit documents and pay fees as prescribed in Clause 3
of this Article.
Article 17.
Rights and obligations of examinees
1. Take the examination at the
announced time and location.
2. Comply
with this Circular, the Examination regulations, and the decisions and notices
of the Examination Council; and to bear sanctions for violations as prescribed
by law and Examination regulations.
3. Be
granted a notarial apprenticeship passing certificate in case they passed the
examination.
4. Other
rights and obligations as prescribed by this Circular, relevant legal
documents, and Examination regulations.

1. The
Ministry of Justice shall organize notarial apprenticeship examinations in
accordance with this Circular and other relevant legal regulations.
2. The
expected plan for the examination shall be notified by the Ministry of Justice
to the Departments of Justice and posted on the Ministry of Justice's website
at least 02 months before the examination date. The Departments of Justice are
responsible for notifying those wishing to submit registration documents as
prescribed in this Circular and the Ministry’s plan; preparing lists and
submitting written proposals to the Ministry of Justice for eligible examinees,
accompanied by their registration documents.
Article 19.
Notarial Apprenticeship Examination Council
1. The
Notarial Apprenticeship Examination Council (hereinafter referred to as the
Examination Council) shall be established under a decision of the Minister of
Justice. The Examination Council may use the seal of the Ministry of Justice to
perform its tasks according to this Circular. The Examination Council terminates
upon completion of its tasks.
2.
The Examination Council consists of 07 to 09 members, including
representatives of the following agencies and organizations:
a) A leader of the
Ministry of Justice shall be the President of the Examination Council;
b) A leader of the
Department of Judicial Assistance shall be the Vice President of the
Examination Council;
c) Members of the
Examination Council as nominated by the Director of the Department of Judicial
Assistance, including representatives of certain relevant agencies and
organizations.
3. The
Examination Council is assisted by the Secretariat, Examination Paper Board,
Invigilation Board, Answer Sheet Heading Board, Marking Board and Review Board
(hereinafter referred to as the Boards of the Examination Council).

Article 20.
Tasks and powers of the Examination Council
1. Issue a
plan to conduct the examination and decide amendments to the plan where
necessary; issue Examination regulations and documents related to the
examination.
2. Establish
Boards of the Examination Council.
3. Review
and decide the list of persons eligible to sit the examination and those
ineligible to sit the examination, and to notify the Departments of Justice
having examinees; concurrently, to publish this information on the Ministry of
Justice’s website no later than 15 days prior to the examination date. Where
necessary, the Examination Council may request or conduct verification of
information in the examination registration applications.
4. Decide
the number and structure of questions and answers used for the computer-based
multiple-choice test; to direct the engagement of experts in developing the
bank of questions and answers (hereinafter referred to as the Question Bank).
5. Direct
the preparation of the computer-based multiple-choice test questions and
answers (hereinafter referred to as the Multiple-choice Test Papers), as well
as the questions, answers, and marking scales for the written test (hereinafter
referred to as the Written Test Papers).
6. Direct
the organization of the examination, the marking of examination papers, the
review of examination papers, and the announcement of scores and examination results.
Within 20 days from the date of
announcing the review scores, the Examination Council shall approve and publish
the examination results on the Ministry of Justice’s website and concurrently
notify in writing the Departments of Justice where examinees registered.
7. Issue
passing certificates to examinees who meet the examination requirements.

In case an examinee is discovered
to fall into one of the above cases at the time the Examination Council has
been dissolved, the Minister of Justice shall consider cancelling the
examination results and revoke their passing certificate.
9. Settle
complaints and whistleblowing reports relating to the examination in accordance
with the law.
10. Report
and be held accountable to the Minister of Justice for the conduction and
results of the examination.
11. Perform
other tasks and powers as prescribed in this Circular.
Article 21.
Tasks and powers of the President and members of the Examination Council
1. The
President of the Examination Council has the following tasks and powers:
a) Perform the tasks and powers of
the Examination Council specified in Article 20 of this Circular; be
accountable to the Minister of Justice for performing the tasks and powers of
the Examination Council;
b) Assign responsibilities to each
member of the Examination Council;
c) Decide on the number of members,
tasks and powers of the Boards of the Examination Council;

other members.
2. Tasks, powers,
and responsibilities of the Supervisory Board:
a) To supervise compliance with
regulations on examination; the performance of tasks and powers by the members
of the Examination Council and the Boards of the Examination Council;
b) To supervise the implementation
of this Circular, the regulations and rules of the Examination Council, and the
settlement of complaints and whistleblowing reports concerning the examination;
c) To perform
other supervisory tasks related to the examination as requested by the Minister
of Justice.

a) To receive the
sealed bags of written test papers from the Examination Council for numbering,
ensuring that the heading numbers do not coincide with the examinee’s
registration numbers;
b) To remove the
headings; to seal the written test papers after heading removal and the
headings themselves. The storage of the separated written test papers and
headings shall be decided by the Examination Council;
c) After the
Marking Board completes the marking of written test papers, the Answer Sheet
Heading Board shall match the headings with the registration numbers, seal and
hand over the headings and the matching table to the Examination Council for
consolidation of written test scores;

Article 29.
Preparation of Examination Papers

2. Preparation
of the examination papers must satisfy the following conditions:

b) Members of the Examination Paper
Board participating in preparation must be isolated from the outside from the
time of commencing preparation until the conclusion of the respective test.
Where necessary, with the written consent of the Head of the Examination Paper
Board, members may leave or contact the outside via landline or cell phone, in
which case the speakerphone must be on, the call must be recorded, and must be
supervised or witnessed by a member of the Supervisory Board and a
representative of the public security authority (if invited);
c) Preparation
must take place at a secure, isolated location, equipped with proper means of
storage, fire prevention and firefighting;
d) Envelopes
containing the examination papers for delivery and transportation must be made
of sufficiently durable, opaque paper, tightly sealed so no edges can be opened
without breaking the seal;
dd) The entire
process of delivery and transportation must be supervised by a member of the
Supervisory Board, and the sealed envelopes must be stored in locked metal
boxes that remain sealed during transport and delivery.
3. The
examination papers must satisfy the following requirements:
a) They must be
appropriate to the apprenticeship requirements;
b) Their contents
and questions must be scientific, precise, coherent, clear, grammatically
correct, and analytical;
c) The
multiple-choice test papers must comply with the design requirements of the
computer-based examination software, ensuring that the number of prepared questions
is at least 3 times the number of required questions.

preparation of multiple-choice test papers:

b) The person commissioned shall
prepare the questions and answers and submit the results to the Examination
Council or to the Secretariat (if authorized) for compilation into the Question
Bank, and shall keep all related information confidential;
c) The Examination Paper Board
shall receive the Question Bank from the Examination Council, review the
questions and answers, and prepare the multiple-choice test papers as per
Clause 2 of this Article.
5. The Examination
Paper Board shall be responsible for preparing the written test papers and the
marking guide.
The contents of the written
examination questions, answer keys and marking guidelines, after being drafted,
shall be subject to peer review among the members of the Examination Paper
Board as organized by the Head of the Examination Paper Board, who shall
propose any revisions or amendments if deemed necessary. After the peer review
has been conducted, the Head of the Examination Paper Board shall randomly
select questions to compile at least three different written examination
papers. The Head of the Examination Paper Board shall initial each written
examination paper, seal them, and report to the Chairperson of the Examination
Council for consideration and decision on the approval of the official written
examination papers and the reserve written examination papers.
Article 30.
Marking of Examination Papers
1. The
tests shall be marked on a scale of 100 points.
a) Each written test shall be
independently marked by two members of the Marking Board in accordance with the
guide, answer key, and marking scale decided by the President of the
Examination Council. The score of each written test shall be the average of the
scores given independently by the two members of the Marking Board. If two
examiners give marks that differ by 20 points or more, two other members of the
Examination Board, as designated by the Head of the Examination Board, will
re-mark the examinee's papers. The mark given by the second group of examiners
will be the official mark for the test.
In the event that a written test
shows signs of marking for identification, the Head of the Marking Board shall
decide whether to conduct a third marking or a collective marking session.
The third marking or a collective marking score shall be the official
mark for the written test;
b) Multiple-choice tests shall be
marked by computer.

3. Within
20 days from the completion of marking, the Examination Council shall approve
and publish the results on the Ministry of Justice’s website and concurrently
notify in writing the Departments of Justice where the examinees are
registered.
Article 31.
Management of Examination Papers, Results, and Registration Documents
1. Written
test papers shall be sealed immediately after the examination. The headings and
scores must be sealed at the end of each working day and immediately after
completion of numbering, removal of headings, matching, marking, and
consolidation of scores.
2. The
examination papers and results shall be retained by the Ministry of Justice for
3 years from the date of publication of results as per Clause 6, Article 20 of
this Circular. Examination registration documents are kept for a period
of 1 year from the examination date.
3. Upon
expiry of the retention periods, the Minister of Justice shall decide on the
destruction of the retained examination papers, results, and registration
documents.
Article 32.
Review of Written Tests
1. Within
10 working days from the date the scores are published on the Ministry of
Justice’s website, examinees dissatisfied with their written test scores may
submit a request for review to the Examination Council. Computer-based
multiple-choice tests shall not be subject to review.
2. Within
15 working days from the end of the submission period, the President of the
Examination Council shall decide to establish the Review Board.
3. The
marking in examination review is carried out according to Article 30 of this
Circular. The President of the Examination Council shall decide on whether to
conceal the original scores and names of prior markers and to reassign new
heading numbers to the reviewed tests.

Chapter IV
MANAGEMENT OF NOTARIAL
APPRENTICESHIP
Article 33.
Duties and powers of the Department of Judicial Assistance and related units
under the Ministry of Justice
1. The Department of Judicial Assistance, Ministry of
Justice has the following tasks and powers:
a) Provide guidance and answer
questions related to the implementation of this Circular;
b) Assist the Minister of Justice
in establishing the Examination Council, the Supervisory Board and performing
other necessary tasks for organizing the notarial apprenticeship examinations;
c) Inspect, handle violations, and
resolve complaints and whistleblowing reports related to apprenticeship as
prescribed by law;
d) Perform other rights and
obligations according to the Law on Notarization, this Circular and other relevant
legal documents.
2. The
Judicial Academy, the Personnel and Organization Department, and other relevant
units under the Ministry of Justice shall perform their respective duties and
powers related to apprenticeship and shall coordinate with the Department of
Judicial Assistance in carrying out the duties and powers specified in Clause 1
of this Article.

1. Prepare and
publish the List of notarial practice organizations qualified to accept
apprentices in the locality on the website or the online public administration
center of the Department of Justice; regularly review and update this list.
2. Appoint a
qualified notarial practice organization in the locality to accept an
apprentice in case the apprentice cannot make arrangements themselves; consider
the refusal to accept apprentices by notarial practice organizations, the
refusal to mentor apprentices, or the change of notary mentors as prescribed.
3. Carry out
registration of apprenticeship, re-registration of apprenticeship,
deregistration of apprenticeship, change of notarial apprenticeship
organization, suspension of apprenticeship, termination of apprenticeship, and
recognition of apprenticeship completion in accordance with regulations.
4. Maintain
the notarial apprenticeship logbook of the Department of Justice (Form
TP-TSCC-11); promptly update information on apprenticeship registration, change
of notary mentors, change of notarial apprenticeship organization, suspension
of apprenticeship, termination of apprenticeship, and recognition of
apprenticeship completion into the logbook and the software for management of
notarial activities of the Ministry of Justice.
5. Monitor and
manage the admission of apprentices, the mentorship, and the apprenticeship
according to this Circular and relevant legal regulations.
6. Inspect,
handle violations, and resolve complaints and whistleblowing reports related to
apprenticeship in accordance with regulations.
7. Perform
other rights and obligations according to the Law on Notarization, this
Circular and other relevant legal documents.
Article 35.
Duties and powers of socio-professional organizations of notaries
1. Collect and
reflect on the thoughts, aspirations, feedback, and recommendations related to
apprenticeship from apprentices, notary mentors, and notarial practice
organizations to the notarial authorities.

Circular No. 08/2023/TT-BTP dated
October 2, 2023 of the Minister of Justice providing guidance on notarial
apprenticeship shall cease to be effective from the effective date of this
Circular, except for the provisions in Clause 9 Article 38 of this Circular.
Article 38.
Transitional provisions
1. Persons who
have completed their apprenticeship before January 1, 2015 but have not been
appointed as notaries before the effective date of this Circular shall have
their apprenticeship recognized and must take the notarial apprenticeship
examination under this Circular.
2. Persons who
are undertaking their apprenticeship under Circular No. 08/2023/TT-BTP as of
the effective date of this Circular shall have their completed apprenticeship
time recognized and shall continue their apprenticeship in accordance with this
Circular.
Apprentices who have suspended
their apprenticeship a sufficient number of times according to Circular No.
08/2023/TT-BTP may not suspend their apprenticeship again.
3. People who
are qualified for apprenticeship and have submitted an application for
apprenticeship registration before the effective date of this Circular will
have their apprenticeship and apprenticeship registration carried out in
accordance with this Circular.
4. Persons
whose apprenticeship terminated before the effective date of this Circular
shall be eligible to apply for re-registration of apprenticeship if they meet
the conditions specified herein.
5. Persons who
completed their apprenticeship under Circular No. 08/2023/TT-BTP shall be
eligible to register to take the notarial apprenticeship examination under this
Circular.
6. In case an
examinee fails to meet the requirements in the notarial apprenticeship
examinations conducted under Circular No. 04/2015/TT-BTP dated April 15, 2015
of the Minister of Justice on guidelines for notarial apprenticeship and
Circular No. 08/2023/TT-BTP, the number of such failures shall be included in
the total number of examination failures as prescribed in this Circular for the
purpose of determining whether the examinee must re-apprentice before
registering for the subsequent examination.

8. A
person who has a written notice from the Examination Council of previous
examinations permitting the postponement of the examination shall be eligible
to register for the examination in accordance with this Circular; the
examination registration application shall be prepared in accordance with this
Circular and attached with the written notice of the Examination Council
permitting the postponement of the examination.
9. The notarial
apprenticeship logbooks issued together with Circular No. 08/2023/TT-BTP shall
be used until December 31, 2025.
10. Examination
papers and results of notarial apprenticeship examinations conducted under
Circular No. 04/2015/TT-BTP and Circular No. 08/2023/TT-BTP which have exceeded
the retention period prescribed in those Circulars shall be disposed of in
accordance with Clause 3 Article 31 of this Circular.
The registration applications for
examinations conducted under Circular No. 04/2015/TT-BTP and Circular No.
08/2023/TT-BTP shall be disposed of in accordance with Clause 3 Article 31 of
this Circular./.

- In
case the apprentice did not change the apprenticeship organization but was mentored
by more than one notary, specify the information of each notary mentor and the
mentoring duration of each.
- In
case the apprenticeship was performed in more than one notarial practice
organization, specify the name, address of each organization, the period of
apprenticeship in each, the information of each notary mentor, the mentoring
duration of each, and report the tasks performed under Article 5 of Circular
No. 06/2025/TT-BTP for each organization where the apprenticeship was
performed.
- Requirements
for the Apprenticeship performance report:
+ The report must be presented
clearly, honestly, seriously, without erasure or copying from other reports.
+ The total number of pages of the
report (excluding the mentor’s comments and the confirmation of the receiving
notarial practice organization) must be at least 15 A4 pages in portrait
orientation (page setup: line spacing 18pt,
paragraph spacing 6pt, top margin 2cm,
bottom margin 2cm, left margin 3cm, right margin 2cm; page numbers placed in
the center at the top of each page, using Arabic numerals 1, 2, 3…).
+ The report must be prepared in
Winword, using Times New Roman font, size 14, normal character density,
justified alignment.
+ The report must be stamped
across the pages by the receiving notarial practice organization; if the
apprenticeship was performed in more than one organization, the report must be
stamped across the pages by the last notarial practice organization where the
apprenticeship was performed.
