CONDITIONS AND IMPLEMENTATION OF MEASURES TO EXPEDITE PROJECTS IN SERVICE OF
THE APEC SUMMIT 2027 IN PHU QUOC CITY, KIEN GIANG PROVINCE

the Standing Government at the meeting to review preparations for hosting the
APEC Economic Leaders’ Week 2027;
Pursuant to Notice No.
200/TB-VPCP dated April 24, 2025, of the Government Office on the conclusions
of Deputy Prime Minister Nguyen Chi Dung at the working session with leaders of
Kien Giang Province; and Notice No. 219/TB-VPCP dated May 8, 2025, of the
Government Office on the conclusions of Deputy Prime Minister Nguyen Chi Dung
at the meeting on assignment of tasks for preparation of enabling conditions
and implementation of measures to expedite projects serving external affairs
and national political missions for hosting the APEC Summit 2027 in Phu Quoc
City, Kien Giang Province;

At the proposal of the
province-level People’s Committee of Kien Giang Province in Official Statement
No. 145/TTr-UBND dated May 8, 2025, on assignment of tasks for preparation of
enabling conditions and implementation of certain measures to expedite projects
serving the APEC Summit 2027 in Phu Quoc City, Kien Giang Province, and
Official Letter No. 1195/UBND-KT dated May 16, 2025, on feedback and
finalization of the draft Decision of the Prime Minister on assignment of tasks
for preparation of enabling conditions and implementation of certain measures
to expedite projects serving the organization of the APEC Summit 2027 in Phu
Quoc City, Kien Giang Province;
HEREBY DECIDES:
Article 1.
Assign the People’s Committee of Kien Giang Province
to take the lead and coordinate with relevant ministries and agencies in
preparing infrastructure conditions to ensure successful organization of the
APEC Summit 2027 in Phu Quoc City, Kien Giang Province, in association with the
sustainable development of the locality and the nation. This is a
national external affairs activity and political mission.
Article 2.
Approve the policy on adjustment of the Kien Giang
Provincial Planning for the period 2021 - 2030, with a vision to 2050,
following expedited procedures in accordance with the law on planning and
relevant laws.
Article 3.
Implement certain measures to accelerate projects to
meet the timeline for organizing the APEC Summit 2027, in association with the
sustainable development of the locality and the nation. Specifically:
1. Approve the application of
regulations on licensing for exploitation of minerals used as common
construction materials (marine sand mines in Phu Quoc City) in accordance with
the licensing provisions for Group IV mineral exploitation for contractors
implementing urgent public investment projects as prescribed in Point a, Clause
2, Article 72 and Points c, d, Clause 2, Article 73 of the Law on Geology and
Minerals, to supply construction materials for the project on embankment and
site leveling for the construction of the APEC Conference Center and related
functional facilities.
2. The People’s Committee of Kien
Giang Province:
a) Review, decide within its
competence, and be responsible for implementing urgent public investment
projects in accordance with the Law on Public Investment and relevant laws with
respect to the projects specified in Section I of the Appendix enclosed with
this Decision; and report to the People’s Council of Kien Giang Province at the
nearest session.
b) Review, decide within its
competence, and be responsible for the application of the form of investor
selection in special cases in accordance with the Law on Bidding, the Law on
Investment under the Public-Private Partnership (PPP) method, and relevant laws
with respect to the projects specified in Section II of the Appendix enclosed
with this Decision.

Article 4.
The central budget shall provide 70% support for
public investment projects listed in Section I of the Appendix enclosed with
this Decision, while the local budget shall balance 30% (not lower than the
funding required for land clearance of the projects). For the APEC Boulevard
Project, the central budget shall provide 50% support, and the local budget
together with investors shall contribute the remaining 50%. The amount of
central budget funding for each project shall be determined based on the total
investment amount specified in the investment policy, investment decision, or
project approval decision issued by the competent authority in accordance with
the Law on Public Investment, the Law on State Budget, and relevant laws.
Article 5.
Responsibilities of the People’s Committee of Kien
Giang Province
1. Take full responsibility for the
contents stated in Official Statement No. 145/TTr-UBND mentioned above and
related explanatory and feedback reports.
2. Be responsible for reviewing,
selecting, and deciding on projects for implementation to serve the
organization of the APEC Summit 2027, in association with the sustainable
development of the locality and the nation; develop plans for effective
utilization and long-term use of projects after the APEC Summit 2027; propose
demands for central budget support and balance and allocate local budget
capital in accordance with the funding mechanism stipulated in Article 4 of
this Decision; while also mobilizing other lawful funding sources to implement
the projects. The implementation of the projects must ensure progress, quality,
and efficiency, maintain landscape, protect the natural ecological environment,
and must not affect national defense and security tasks. Under no circumstances
shall corruption, negativity, loss, waste, or group interest occur.
3. Review and determine the
specific locations, areas, and types of forest land and the actual needs for
conversion of forest use purposes to implement projects directly serving the
APEC Summit 2027; report to competent authorities for consideration and
decision in accordance with law.
4. Strictly control the volume of
extracted minerals to ensure that organizations and individuals fully fulfill
their financial obligations as prescribed; prevent any loss of State assets.
Terminate exploitation activities as prescribed in Clause 1, Article 3 of this
Decision after sufficient mineral quantities have been extracted for the projects.
Inspect, supervise, and strictly handle in accordance with law any investors or
contractors violating regulations in mineral exploitation and utilization.
Report to the Standing Board of the Provincial Party Committee to coordinate
with the Party Committee of the Ministry of Agriculture and Environment to
report to the competent Party authority on implementation of measures as
provided in Clause 1, Article 3 of this Decision.
5. Proactively and closely
coordinate with the Ministry of Finance and relevant ministries and agencies in
formulating plans for asset transfer and expansion investment of Phu Quoc
International Airport, ensuring the schedule serves the APEC Summit 2027, in
association with the sustainable development of the nation and the locality.
6. In the course of implementation,
if any relevant issues arise or the laws are amended, the People’s Committee of
Kien Giang Province shall coordinate with relevant ministries and agencies to
report to the Prime Minister for adjustment and supplementation of the contents
specified in this Decision as appropriate.
Article 6.
The President of the People’s Committee of Kien Giang
Province shall bear overall responsibility before the law and before the Prime
Minister for all information, data, documents, reports, and proposed project
lists specified in the Appendix enclosed with this Decision; organize
implementation in a public and transparent manner; absolutely prevent
corruption, loss, waste, and group interest; and closely supervise the projects
serving the APEC Summit 2027.

1. The Ministry of Finance shall:
a) Based on the central budget
support proposals submitted by the People’s Committee of Kien Giang Province
and the central budget balancing capacity, coordinate with relevant ministries
and sectors to consolidate and report to the Prime Minister for consideration
and decision on central budget support for project implementation; the maximum
level of central budget support shall comply with the mechanism specified in
Article 4 of this Decision.
b) Take charge and coordinate with
the Ministry of Construction, Ministry of Justice, the Airports
Corporation of Vietnam – JSC (ACV), the People’s Committee of Kien Giang
Province, and relevant agencies to urgently study and propose a plan for
handling ACV’s assets at Phu Quoc International Airport and report to the
Government within May 2025.
2. The Ministry of Construction
shall proactively coordinate closely with the Ministry of Finance during the
drafting process of the Government’s Resolution on asset transfer and expansion
investment of Phu Quoc International Airport; direct the immediate handover of
assets under the management of the Ministry of Construction to Kien Giang
Province for selecting and assigning investors to expand the airport, ensuring
timely implementation and quality assurance.
3. The Ministry of Agriculture and
Environment shall:
a) Consolidate the demand for land
use target adjustments as proposed by the People’s Committee of Kien Giang Province;
report to the Government for submission to the National Assembly at the nearest
session and submit to the Prime Minister for allocation according to the Law on
Land after approval by the National Assembly.
b) Issue written guidance to the
People’s Committee of Kien Giang Province on procedures for mineral
exploitation and advise the Prime Minister to report to the National Assembly
on implementation of measures as specified in Clause 1, Article 3 of this
Decision.
c) Closely inspect and supervise the
conversion of forest land use purposes for project implementation to ensure
compliance with legal regulations.
4. The Ministries of Foreign
Affairs, Finance, Construction, Agriculture and Environment, Justice, Home
Affairs, Culture, Sports and Tourism, Science and Technology, Public Security,
and National Defense, within their assigned functions and duties, shall:

b) Direct their affiliated agencies
and units to promptly process administrative procedures related to project
documentation to ensure timely implementation and progress of projects serving
the APEC Summit 2027.
Article 8.
This Decision shall come into force as of the date of
signing.
Article 9.
Ministers, Heads of ministerial agencies, and the
President of the People’s Committee of Kien Giang Province shall implement this
Decision. On a quarterly basis, the People’s Committee of Kien Giang Province
shall report on the implementation and progress of projects to the Government
Office for consolidation and submission to the Prime Minister./.
