DECISION
IMPOSITION OF HANOI HIGHWAY TOLLS FOR RECOVERY OF
INVESTMENT IN THE BOT PROJECT FOR EXPANSION OF HANOI HIGHWAY AND HIGHWAY 1
WITHIN THE SEGMENT FROM TRAM 2 JUNCTION TO TAN VAN JUNCTION

Pursuant to the Law on
Local Government Organization dated June 19, 2015;
Pursuant to the Law on
Pricing dated June 20, 2012;
Pursuant to the
Government’s Decree No. 177/2013/ND-CP dated November 14, 2013 elaborating some
Articles of the Law on Pricing; the Government’s Decree No. 149/2016/ND-CP
dated November 11, 2016 on amendments to Decree No. 177/2013/ND-CP;
Pursuant to Circular
No. 56/2014/TT- dated April 28, 2014 providing guidelines for implementation of
the Government’s Decree No. 177/2013/ND-CP dated November 14, 2013 elaborating
some Articles of the Law on Pricing; Circular No. 233/2016/TT-BTC dated
November 11, 2016 on amendments to some Articles of Circular No.
56/2014/TT-BTC;
Pursuant to Circular
No. 35/2016/TT-BGTVT dated November 15, 2016 of the Ministry of Transport on
maximum tolls on roads for commercial purpose under the management of the
Ministry of Transport;

Pursuant to BOT
contract No. 03/2009/HD-B.O.T dated November 25, 2009 and Appendix No.
3027/2018/PLHD-B.O.T dated July 09, 2018 between the People’s Committee of Ho
Chi Minh City, Ho Chi Minh City Infrastructure Investment JSC (CII), CII
Bridges and Roads Investment JSC (CIIBR) and Hanoi Highway Construction and
Investment JSC (HNHC JSC);
Pursuant to Decision
No. 907/QD-UBND dated March 17, 2021 of the People’s Committee of Ho Chi Minh
City on maximum tolls for roads that belong to the BOT project for expansion of
Hanoi Highway and Highway 1 within the segment from Tram 2 junction to Tan Van
junction;
At the request of CII
in Document No. 86/2021/CV-CII dated March 12, 2021 on the draft agreement on
adjustments to Hanoi Highway tolls;
Pursuant to the
Agreement dated March 18, 2021 between the People’s Committee of Ho Chi Minh
City, CII, CIIBR and HNHC JSC on imposition of Hanoi Highway tolls for recovery
of investment in the BOT project for expansion of Hanoi Highway and Highway 1
within the segment from Tram 2 junction to Tan Van junction;
In consideration of
the request of Director of the Services of Transport in Document No.
2619/TTr-SGTVT dated March 18, 2021 on Hanoi Highway tolls for recovery of
investment in the BOT project for expansion of Hanoi Highway and Highway 1
within the segment from Tram 2 junction to Tan Van junction; opinions of
Department of Finance in Official Dispatch No. 1370/STC-QLG dated March 15,
2021 and of Department of Justice in Official Dispatch No. 929/STP-VB dated
March 15, 2021.
DECIDES:
Article 1. Initiation of the collection of tolls for the BOT project
for expansion of Hanoi Highway and Highway 1 within the segment from Tram 2
junction to Tan Van junction:
1.1. Name of tollbooth:
Hanoi Highway Toll Station
1.2. Tollbooth location:
From Km 4+300 to Km 4+900 of Hanoi Highway.

1.4. Collection
technology: RFiD and single stop collection using barcodes.
1.5. Collection method:
entry-based.
1.6. Eligibility for toll
exemption and toll reduction:
a) The entities eligible
for toll exemption are specified in Article 2 of Decision No. 907/QD-UBND dated
March 17, 2021 of the People’s Committee of Ho Chi Minh City on maximum tolls
for roads that belong to the BOT project for expansion of Hanoi Highway and
Highway 1 within the segment from Tram 2 junction to Tan Van junction.
b) Entities eligible for
toll reduction:
- Public transportation
buses of Ho Chi Minh City operating fixed routes that go through Hanoi Highway
Toll Station are eligible for 100% toll reduction.
- Any motor vehicle that
satisfies the following conditions shall be eligible for 50% toll reduction:
(i) It has fewer than 12 seats; (ii) it is not used for commercial purposes;
(iii) its owner has a permanent residence or long-term temporary residence (over
06 months before inauguration date of Hanoi Highway Toll Station) at a location
along either parallel road of Hanoi Highway segment in Thu Duc City. Owners of
these motor vehicles shall pay tolls using electronic toll collection (ETC)
technology and must obtain the confirmation of residence from the People’s
Committee of the district and the confirmation that the vehicle is not used for
commercial purposes from the Department of Transport.

Article 2. Organization of implementation
2.1. CII shall:
a) Organize the Hanoi
Highway toll collection in accordance with regulations of law. Announce the
toll collection 05 consecutive days in advance and post the collection time,
technology, method, payers, tolls etc. at the toll station.
b) Prepare a plan, provide
rescue equipment and forces to respond to emergencies that occur on the route.

2.2. Police Authority of
Thu Duc City shall prepare a plan for assurance of public security, order and
traffic safety throughout the operation of the toll station.
2.3. The People’s
Committee of Thu Duc City shall carry out frequent inspections, provide assistance,
cooperate with relevant units and CII in assurance of public security and order
during the toll collection process.
2.4. Department of
Transport shall cooperate with CII in identification of entities eligible for
toll reduction.
Article 3. This Decision comes into force from the day on which it is
signed.
Article 4. Chief of Office of the People’s Committee of Ho Chi Minh
City, Directors of Department of Transport, Department of Finance, Department
of Planning and Investment, Department of Justice, Department of Construction,
Department of Information and Communications, Department of Taxation, Traffic
Project Management Board, Police Authority of Ho Chi Minh City, the President
of the People’s Committee of Thu Duc City, General Director of CII, General
Director of CIIBR, Director of HNHC JSC, heads of relevant units and
individuals are responsible for the implementation of this Decision./.
