DECISION
ON CREDIT FOR STUDENTS WITH DIFFICULT FAMILY CIRCUMSTANCES
TO BUY PERSONAL COMPUTERS AND EQUIPMENT FOR ONLINE LEARNING
Pursuant to the Law on
Organization of the Government dated June 19, 2015; the Law on Amendments to
the Law on Organization of the Government and the Law on Organization of the
Local Government dated November 22, 2019;
Pursuant to the Law on
Public Investment dated June 13, 2019;
Pursuant to Resolution
No. 43/2022/QH15 dated January 11, 2022 of the National Assembly on fiscal and
monetary policies for supporting socio-economic recovery and development
program;
Pursuant to the
Government's Decree No. 78/2002/ND-CP dated October 4, 2002 on credit for poor
people and other policy beneficiaries;
Pursuant to the
Government’s Decree No. 07/2021/ND-CP dated January 27, 2021 on
multidimensional poverty standard 2021 - 2025;

Article 1. Scope
This Decision provides
for the policy on credit for students with difficult family circumstances to
buy personal computers and equipment for online learning according to Decree
No. 43/2022/QH15 dated January 11, 2022 of the National Assembly on fiscal and
monetary policies for supporting the socio-economic recovery and development
program (hereinafter referred to as “Decree No. 43/2022/QH15”) and Resolution
No. 11/NQ-CP dated January 30, 2022 of the Government on the socio-economic
recovery and development program and implementation of Decree No. 43/2022/QH15
(hereinafter referred to as Resolution No. 11/NQ-CP).
Article 2. Regulated
entities
1. The Bank for Social
Policies
2. Borrowers.
3. Relevant organizations
and individuals.
Article 3. Eligible
entities and eligibility criteria for loans
1. Eligible entities:
a) Students at various
levels who are learning in educational institutions of the national education
system in accordance with the Law on Education and satisfy the criteria
specified in Clause 2 of this Article;

2. Criteria for loans:
a) A student who is a
member of a poor household, a near-poor household, a household with average
living standard as prescribed by law, or a household with difficult
circumstances due to the influence of the COVID-19 epidemic (with father and/or
mother loss due to the COVID-19 epidemic);
b) A student who does not
have his/her personal computer and equipment to satisfy requirements for online
learning and has yet to receive benefits from the policy on support for
personal computers and equipment for online learning in any form.
Article 4. Loan
methods
1. Grant of loans to
students shall be carried out in the form of lending to households. The
representative of a household of a student shall be the borrower and carry out
transactions with the Bank for Social Policies.
2. An eligible entity
specified in Point b Clause 1 Article 3 of this Decision who is 18 years old or
older may become the borrower and directly carry out a loan agreement with the
Bank for Social Policies in his/her lodging area or the headquarter of his/her
school if his/her household does not have any member who is 18 years old or
older or other members of the household do not have full civil act capacity,
labor capacity as prescribed by law.
3. The grant of loans of
the Bank for Social Policies shall be made by entrustment methods to
socio-political organizations under entrustment contracts or directly to
borrowers.
Article 5. Purpose of
using loans
Loans are used to buy
personal computers and equipment to satisfy requirements for online learning
including: desktop computers, laptop computers, tablets, webcams, and
microphones.

The maximum loan is 10
million VND/student.
Article 7. Currency of
loans and debt payment
Vietnam Dong.
Article 8. Loan term
1. The maximum loan term
is 36 months.
2. Regarding students who
are borrowers as prescribed in Clause 2 Article 4 of this Decision:
a) At the time of
borrowing, if the estimated time to finish the learning course is 24 months or
more, the maximum loan term is from the date of borrowing to the end of 12
months after the expected time of completion of the learning course;
b) The expected time of
completion of the learning course of a student prescribed in Point a of this
Clause is determined in accordance with the school’s verification papers.

2. The overdue debt
interest rate is equal to the interest rate applicable to poor households at
the time of borrowing.
Article 10. Loan
source and loan disbursement time
1. The loan source
according to this Decision and loans according to Decision No. 157/2007/QD-TTg
dated September 27, 2007 of the Prime Minister on credit for students and
amendment documents (if any) is up to 3000 billion VND from the bond issuance
source guaranteed by the Government of the Bank for Social Policies in
accordance with regulations of Resolution No. 11/NQ-CP.
2. The use of capital
sources shall be in accordance with regulations of Resolution No. 43/2022/QH15,
Resolution No. 11/NQ-CP, and relevant guiding documents.
3. The disbursement time
of loan sources shall not exceed December 31, 2023 or the time when the loan
source prescribed in Clause 1 of this Article is used up, whichever comes
first.
Article 11.
Classification of debts and handling of risky debts
1. The Bank for Social
Policies shall classify debts from loans according to this Decision in
accordance with Decision No. 976/QD-TTg dated July 1, 2015 of the Prime
Minister on promulgation of regulation on classification of Debts at Vietnam
Bank for Social Policies and amendment documents or replacement documents (if
any).
2. The Bank for Social
Policies shall handle risky debts in accordance with Decision No.
50/2010/QD-TTg dated July 28, 2010 of the Prime Minister on promulgation of
handling mechanisms of risky debts at the Bank for Social Policies, Decision
No. 08/2021/QD-TTg dated March 11, 2021 of the Prime Minister on amendments to
the handling mechanisms of risky debts at the Bank for Social Policies
promulgated with Decision No. 50/2010/QD-TTg dated July 28, 2010 of the Government,
and other amendment documents or replacement documents (if any).

Article 13.
Regulations on reports
1. Periodically every
quarter, year, and at the end of the program, the Bank for Social Policies
shall submit reports on the results of the grant of loans according to Appendix
I and Appendix II promulgated with this Decision to the Ministry of Finance.
2. Deadline and time for
finalizing data and report submission methods:
a) Deadline for
submission of reports:
- Quarterly reports:
Within 15 days from the end date of the quarter;
- Annual reports: Within
60 days from the end date of the year;
- Reports on the end of
the program: Within 60 days from the end date of the program.
b) The time for
finalizing the data for annual or quarterly reports: The time to start
collecting data is the first day of the reporting quarter or year; the end time
for collecting data is the last day of the reporting quarter or year.
c) The time for
finalizing data on reports on the end of the program: The time to start
collecting data is the time this Decision comes into force; the end time for collecting
data is December 31, 2023 or the time of announcement that the loan source is
used up, whichever comes first.

- Send directly in the

- Send by the email
system or the specialized reporting information software system;
- Other methods as
prescribed by law.
Article 14.
Implementation
1. Borrowers shall use
their loans for the right purposes in accordance with regulations of this
Decision and fully and timely pay debts to the Bank for Social Policies.
2. The Bank for Social
Policies shall:
a) Promulgate regulations
prescribed in Article 12 of this Decision;
b) Manage and use the
capital source, grant loans to correct entities, criteria, and purposes as
prescribed in this Decision; report on the result of grant of loans as
prescribed in Article 13 of this Decision to the Ministry of Finance;

d) Cooperate with
ministries and central authorities in submitting reports to competent
authorities to settle difficulties during the process of granting loans as
prescribed in this Decision.
3. The Ministry of
Finance shall take charge and request the Prime Minister to make amendments to
this Decision (if necessary).
4. The Ministry of
Education and Training, the Ministry of Labor – War Invalids and Social
Affairs, and relevant agencies shall direct universities, colleges,
intermediate schools, and vocational education centers under their management
to cooperate with People’s Committees at various levels and the Bank for Social
Policies in disseminating and implementing policies of this Decision.
5. People’s Committees of
provinces and centrally affiliated cities shall direct People’s Committees of
communes to check and verify eligible entities and criteria for enjoying the
policy as prescribed in Article 3 of this Decision.
6. Relevant agencies
shall, based on their functions and assigned tasks, cooperate in implementing
this Decision.
Article 15. Violation
handling
Agencies, organizations,
or individuals that take advantage of policies prescribed in this Decision for
personal benefits or law violations shall, depending on the nature and severity
of their violations, pay compensation, be disciplined, receive administrative
penalties, or be charged with legal liability in accordance with the law.
Article 16.
Implementation provisions
1. This Decision comes
into force as of its date of signing.
