DECREE

DEFINING FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF MINISTRY OF HEALTH OF VIETNAM

Pursuant to the Law on Government Organization dated February 18, 2025;

At the request of the Minister of Health of Vietnam;

The Government promulgates a Decree defining the functions, tasks, powers and organizational structure of the Ministry of Health of Vietnam.

Article 1. Position and functions

The Ministry of Health of Vietnam is a governmental agency in charge of performing the state management of the following fields: preventive medicine; medical examination and treatment, functional rehabilitation; medical assessment, forensic examination and forensic psychiatric assessment; maternal and children’s affairs; population; prevention and fight against social evils (except detoxification and post-detoxification management); social protection; traditional medicine and pharmacy; pharmaceutical products and cosmetics; food safety; medical devices; health insurance and state management of public services rendered in the fields within the scope of management of the Ministry of Health.

1. Submit the following documents to the Government, including bills and draft resolutions of the National Assembly, draft ordinances and draft resolutions of the Standing Committee of the National Assembly, draft decrees, resolutions of the Government which are formulated in conformity with the Ministry of Health’s approved annual law-making programs or plans, and other programs, projects and/or schemes as assigned by the Government or the Prime Minister; submit to the Government or the Prime Minister annual, medium-term and long-term development strategies, plannings and plans, and nationally significant programs, projects and/or works in the fields falling within the scope of state management of the Ministry of Health.

2. Submit the following documents to the Prime Minister, including draft decisions, draft directives and other legislative documents in the fields falling within the scope of state management of the Ministry of Health or as assigned.

3. Promulgate circulars, decisions, directives and other legislative documents on state management of the fields falling within the scope of state management of the Ministry of Health.

4. Direct, provide guidance on and organize the implementation of legislative documents, strategies, plannings, plans, national target programs, and nationally significant programs, projects and/or works after they have been approved; examine, review, systematize, consolidate, codify the system of legislative documents, disseminate information on, educate about, and monitor the implementation of laws in the fields falling within the scope of state management of the Ministry of Health.

5. Regarding preventive medicine:

a) Formulate and promulgate specialized regulations, national standards, national technical regulations, and economic - technical norms for surveillance, prevention and control of infectious diseases, HIV/AIDS, non-communicable diseases, occupational diseases, accidents and injuries; vaccination; laboratory biosafety; border health quarantine; environmental health and hygiene, occupational health, hygiene and health services for offices and schools; community nutrition; prevention and control of harmful effects of tobacco; prevention and control of harmful effects of alcoholic beverages; domestic water quality; management of insecticidal and germicidal chemicals and preparations for household and medical use, or submit them to competent authorities for promulgation;

b) Promulgate, review and modify the list of infectious diseases sorted by groups of infectious diseases, the list of infectious diseases for which the use of vaccines and biological products is mandatory; manage vaccination activities and organize the provision of vaccines and biological products to eligible entities in accordance with regulations of law;

c) Play the leading role and cooperate with relevant ministries and regulatory authorities in promulgating and amending occupational health standards for each occupation or job, the list of diseases requiring long-term treatment under which patients are entitled to enjoy sickness benefits and the list of occupational diseases under which patients are entitled to enjoy social insurance benefits in Vietnam;

d) Formulate and promulgate regulations on biomedical waste management, environmental protection within the precincts of health facilities and hygienic requirements in burial and cremation of bodies of people who have died as a result of epidemics;

e) Request competent authorities to make decisions, or make decisions within its competence, on implementation of epidemic prevention and control measures; inspect, expedite and assist relevant agencies and local governments in implementing epidemic prevention and control measures; formulate and organize the implementation of public health emergency response plans;

g) Provide guidance on and organize the conduct of border health quarantine activities at border checkpoints; provide timely information and reports on dangerous infectious diseases and public health issues in the world so as to proactively take prevention and control measures;

h) Manage, provide guidance on and conduct workplace environment monitoring activities; direct the conduct of workplace environment monitoring activities at industrial parks and industrial clusters posing high risks of occupational diseases; evaluate, monitor and manage workplace hazards; establish workplace environment monitoring database, announce the list of eligible providers of workplace environment monitoring services and the list of entities suspended from provision of workplace environment monitoring services as prescribed by law;

i) Provide instructions within its competence on management of occupational sanitation, health examination for employees, examination for early detection of occupational diseases and monitoring of employees’ health at workplaces; take charge of managing the issuance of professional and training certificates of occupational health, workplace first aid and emergency skills in accordance with the law regulations;

k) Direct, provide guidance on the organization of the control of impacts of environmental pollution on human health;

l) Direct, provide guidance on the organization of assessment of scope, subjects and impacts of environmental emergencies on human health; implementation of measures for preparedness and response to environmental emergencies caused by epidemics; and measures for prevention and minimization of impacts of environmental emergencies on human health;

m) Direct, provide guidance on and organize the implementation of regulations of law on classification, collection, storage and management of biomedical waste, environmental protection within the precincts of health facilities and hygienic requirements in burial and cremation of bodies of people who have died as a result of epidemics in accordance with regulations of law;

n) Direct and provide guidance on the provision of primary healthcare services in community;

o) Appraise, issue, re-issue and revoke certificates of biosafety level-3 and level-4 laboratories, except those laboratories under the management of the Ministry of National Defence of Vietnam;

q) Issue, re-issue, modify and revoke certificates of eligibility to run HIV confirmatory tests, suspend HIV confirmatory tests conducted by laboratories affiliated to the Ministry of Health, make decisions on designation and decisions on modification or revocation of decisions on designation of laboratories conducting reference HIV confirmatory tests, and suspend reference HIV confirmatory tests;

r) Designate certification bodies to assess the conformity of tobacco products with regulations; issue, suspend, revoke and re-issue certificates of declaration of conformity of tobacco products in accordance with regulations of law;

s) Manage, provide guidance on and organize HIV/AIDS prevention and control activities; HIV testing and consulting activities; treatment for opioid and tobacco addiction;

t) Direct, provide guidance on and organize the implementation of specialized regulations and national technical regulations on preventive medicine nationwide.

6. Regarding medical examination and treatment, functional rehabilitation, medical assessment, forensic examination and forensic psychiatric assessment:

a) Formulate and promulgate specialized regulations, national standards, national technical regulations, economic - technical norms and quality criteria for medical examination and treatment, out-of-hospital emergency care, blood transfusion safety, nursing, functional rehabilitation, clinical pharmacy, clinical nutrition, infection control; cosmetic surgery; donation, receipt and transplantation of human organs and tissues; medical assessment, forensic examination, and forensic psychiatric assessment, or submit them to competent authorities for promulgation in accordance with regulations of law;

b) Formulate and submit the planning for the system of health facilities to competent authorities for approval; promulgate detailed regulations on determination of technical and professional levels of health facilities;

c) Manage, organize issuance, re-issuance, renewal and modification of medicine practicing licenses, suspension of practicing, revocation of medicine practicing licenses of persons working at health facilities falling under its management; issuance, re-issuance, modification, operational suspension and revocation of licenses to provide medical services of health facilities falling under its management; suspension of operation of other health facilities nationwide in accordance with regulations of law;

d) Appraise and give permission to health facilities to adopt new medical techniques in accordance with regulations of law;

e) Play the leading role and cooperate with relevant ministries and regulatory authorities in performing professional medical activities in rendering healthcare services to central-level officials as prescribed;

g) Direct, provide guidance on and organize the implementation of legislative documents, specialized regulations, national standards and national technical regulations on medical examination and treatment, functional rehabilitation, cosmetic surgery, medical assessment, forensic examination and forensic psychiatric assessment.

7. Regarding maternal and children’s affairs:

a) Formulate and promulgate legislative documents, national strategies, policies, programs, plans and objectives on maternal and children’s affairs, or submit them to competent authorities for promulgation;

b) Formulate and promulgate the systems of material and children’s affairs-related objectives and indicators; specialized regulations and national technical regulations on reproductive health services and child protection services, or submit them to competent authorities for promulgation;

c) Provide guidance on and organize the provision of reproductive health consulting and care services; provision of consulting, nutritional and healthcare services for mothers and children; provision of prenatal and newborn consulting, screening, diagnosis and treatment services;

d) Coordinate the exercise of children's rights; play the leading role and cooperate with relevant authorities and organizations in ensuring exercise of children's rights; protection of children and children’s participation in children-related affairs;

dd) Provide guidance on and organize the implementation of legislative documents, national strategies, policies, programs, plans and objectives on children’s affairs and action months for children; protection of children from accidents and injuries, and caring for and nurture of disadvantaged children;

e) Appraise and make decisions on certification of health facilities' eligibility to conduct altruistic surrogacy procedures and sex reassignment procedures in accordance with regulations of law;

h) Manage the National Child Helpline.

8. Regarding population:

a) Formulate and promulgate legislative documents, strategies, policies, programs and plans on population, or submit them to competent authorities for promulgation;

b) Formulate and promulgate the systems of material and population-related objectives and indicators; specialized regulations and national technical regulations on population, or submit them to competent authorities for promulgation;

c) Direct, provide guidance on and organize the implementation of legislative documents, strategies, policies, programs, plans, specialized regulations and national technical regulations on population.

9. Regarding social protection, and prevention and fight against social evils:

a) Formulate and promulgate legislative documents, policies, programs and plans on social support, social retirement benefits, social affairs, elderly and disability affairs and other social support affairs, or submit them to competent authorities for promulgation;

b) Formulate and promulgate legislative documents, policies, programs and plans on prostitution prevention and control, and support for victims and persons undergoing trafficking victim identification, or submit them to competent authorities for promulgation;

c) Promulgate, or submit to competent authorities for promulgation, and organize the implementation of legislative documents on emergency social support for recovery from disaster, catastrophes, epidemics or other force majeure events;

dd) Direct, provide guidance on and organize the implementation of regulations on eligibility requirements, procedures for establishment, registration and licensing for operation of social support facilities, and disability care facilities;

e) Provide guidance on and organize the implementation of legislative documents, policies, programs and plans on social affairs, elderly and disability affairs, promotion of roles of and caring for the elderly, health care and functional rehabilitation of disabled people;

g) Direct, provide guidance on and organize the implementation of regulations of law on prostitution prevention and control;

h) Provide guidelines for screening of workers for human trafficking; provide guidance on and organize the implementation of medical support and psychological support measures for victims of human trafficking and persons undergoing victim identification, and support for community reintegration of victims of human trafficking;

i) Direct and provide guidance on inclusion of human trafficking prevention and combat-related contents in programs on prevention and control of social evils and children protection, women’s advancement programs, and other socio-economic development programs.

10. Regarding traditional medicine and pharmacy:

a) Formulate and promulgate specialized regulations, national standards and national technical regulations on traditional medicine and pharmacy, or submit them to competent authorities for promulgation;

b) Formulate and submit mechanisms and policies on inheritance, conservation, development and modernization of traditional medicine and pharmacy; development of herb planting areas, and combination of traditional medicine and pharmacy and modern medicine to competent authorities for promulgation;

c) Compile and promulgate the list of controlled rare, precious and endemic herbs; organize the implementation of measures for conservation, exploitation and rational and sustainable use of herbal resources;

dd) Issue, renew, modify and revoke marketing authorizations for herbal materials and traditional drugs in accordance with regulations of law; issue, re-issue, modify and revoke certificates of eligibility for pharmacy business of establishments trading in herbal materials and traditional drugs; GACP (Good Agricultural and Collection Practices) certificates under its management in accordance with regulations of law;

e) Issue and re-issue certificates of approval of advertising contents for traditional medicine services; certificates of approval of advertising contents for traditional drugs and modifications thereof under its management in accordance with regulations of law;

g) Direct, provide guidance on and organize the implementation of mechanisms, policies, legislative documents, specialized regulations and national technical regulations on traditional medicine and pharmacy, and combination of traditional medicine and pharmacy and modern medicine.

11. Regarding pharmaceutical products and cosmetics:

a) Formulate and promulgate or submit to competent authorities for promulgation specialized regulations and national technical regulations on pharmaceutical products and cosmetics; sets of national standards for medicines; promulgate and update Vietnamese Pharmacopoeia and Vietnamese National Drug Formulary;

b) Compile and promulgate or submit to competent authorities for promulgation the list of controlled drugs and medicinal materials; the list of rare drugs; the list of essential drugs; the list of drugs procured through bidding; the list of drugs procured through centralized bidding; the list of drugs procured through price negotiation; announce the list of OTC drugs;

c) Issue, renew, modify, amend and revoke marketing authorizations of drugs and medicinal materials; issue certificate of pharmaceutical products; license to import and export drugs, medicinal materials and primary packages thereof in accordance with regulations of law and international practices;

d) Issue, renew, modify, amend and revoke: examinations-based pharmacy practicing certificates, certificates of eligibility for pharmacy business and certificates of good practices for drug and medicinal material manufacturers and traders in accordance with regulations of law and international practices; announce the list of foreign drug and medicinal material manufacturers, traders and storage service providers applied for supply of drugs and medicinal materials in Vietnam; assess the conformity with GMP (Good Manufacturing Practices) requirements by foreign drug and medicinal material manufacturers that apply for marketing authorizations of their drugs and medicinal materials in Vietnam in accordance with regulations of law;

dd) Issue and revoke receipt numbers of written declarations of imported cosmetic products; approve changes in contents of such written declarations; issue, re-issue, modify and revoke CGMP (Cosmetic Good Manufacturing Practices) certificates in accordance with regulations of law;

g) Organize the drug information and pharmacovigilance system; manage and carry out provision of drug information and drug advertising in accordance with regulations of law;

h) Provide guidelines for bidding for procurement of drugs serving medical prevention, examination and treatment with funding from state budget, health insurance fund and other lawful funding sources of health facilities; organize the national centralized drug procurement and play the leading role in negotiating drug prices in accordance with regulations of law;

i) Direct, provide guidance on and organize the implementation of regulations of law on pharmaceutical products and cosmetics, and rational, safe and effective use of drugs.

12. Regarding medical devices and works:

a) Formulate and promulgate national standards, national technical regulations, strategies, policies and plans on medical devices, or submit them to competent authorities for promulgation;

b) Promulgate detailed regulations and guidelines on standards and norms for use of specialized machinery and equipment in medical sector; promulgate the list of medical devices subject to inspection and inspection procedures for each type of such listed medical devices;

c) Issue, suspend and revoke registration numbers of medical devices; issue and revoke certificates of free sale of medical devices; promulgate documents on cancellation of classification results of medical devices and make them publicly available; issue licenses to import medical devices; publicly disclose information and applications for declaration of raw materials for manufacture of medical devices, substances for external quality assessment that contain narcotic substances and precursors; announce the list of medical devices whose registration number has been revoked;

d) Issue, re-issue, modify and revoke certificates of registration of medical device inspection services within the assigned scope of its management as prescribed by law; publicly disclose information and applications for declaration of eligibility to provide technical consultancy on medical devices;

dd) Play the leading role and cooperate with relevant authorities in directing, providing guidance on and organizing the implementation of legislative documents, national standards and national technical regulations on medical devices;

13. Regarding food safety:

a) Play the leading role in formulating and promulgating national technical regulations on foods and food products within the assigned scope of its management; promulgate national technical regulations or regulations on safety limits of food product groups at the request of supervisory ministries; promulgate the list of food additives and food processing aids;

b) Formulate and submit to competent authorities for promulgation regulations on food safety conditions to be satisfied by establishments manufacturing and/or trading foods and food products within the assigned scope of its management, food and beverage trading establishments and street food vendors;

c) Play the leading role in disseminating information and knowledge, and educate about laws on food safety within the scope of its management;

d) Play the leading role and cooperate with relevant ministries and regulatory authorities in building an alert system on food safety incidents; providing specific provisions on statement of food safety incidents; organizing the supervision, analysis of food safety risks, prevention, investigation and cooperation in preventing food poisoning as well as responding to food safety risks within the scope of its management;

dd) Manage the compliance with regulations on food safety in course of production, preparation, processing, storage, transportation, import, export and trading in foods and food products within the assigned scope of its management;

e) Organize receipt and management of applications, issuance and revocation of certificates of registered product disclosure for foods and food products within the assigned scope of its management; issuance of certificates of approval of advertising contents and certificates of free sale for food products in the fields within the assigned scope of its management; issuance of health certificates and other certificates for exported food products in accordance with regulations of law;

g) Issue and revoke certificates of fulfillment of food safety requirements to eligible manufacturers and traders of foods and food products within the assigned scope of its management; issue and revoke GMP certificates for dietary supplements in accordance with regulations of law;

h) Appoint, re-appoint, suspend and revoke decisions on appointment of food testing laboratories serving the performance of state management tasks and reference testing laboratories within the assigned scope of its management;

k) Direct, provide guidance on and organize the implementation of legislative documents, national standards, and national technical regulations on food safety within the scope of its management;

l) Review and prepare periodical and ad hoc statistical reports on food safety management on the basis of supervising and consolidating reports submitted by supervisory ministries and local governments.

14. Regarding health insurance:

a) Formulate and promulgate policies and regulations of law on health insurance, master plans and strategies for development of health insurance, or submit them to competent authorities for promulgation;

b) Play the leading role and cooperate with relevant ministries and regulatory authorities in formulating and promulgating principles and criteria for compiling lists of covered drugs, medical devices and medical technical services; the list of covered drugs, chemicals, medical devices and medical technical services, payment percentage and conditions thereof;

c) Promulgate regulations on sharing of health insurance-related data, connection and use of subclinical results shared between health facilities providing covered medical services to meet specialized requirements;

d) Promulgate within its competent or submit to competent authorities for promulgation solutions for ensuring the balance of the health insurance fund;

dd) Direct and instruct health facilities and relevant organizations and individuals to implement regulations of the law on health insurance.

15. Regarding management of public employees working in the fields of medicine, pharmacy, population and social affairs:

b) Provide guidelines on holders of leadership or management positions and other professional titles in the fields of medicine, pharmacy, population and social affairs; professional titles-based structure of public employees and number of persons working in units providing public services in medical sector;

c) Formulate, promulgate specific regulations on standards and conditions for consideration for promotion of professional titles of public employees working in the fields of medicine, pharmacy, population and social affairs to grade II, grade I in accordance with regulations of law; organize consideration for promotion of professional titles of public employees working in the fields of medicine, pharmacy, population and social affairs in accordance with regulations of law;

d) Play the leading role and cooperate with relevant authorities in formulating and submitting to competent authorities for promulgation policies for public employees and contractual workers working in medical sector, and amendments thereto;

dd) Promulgate detailed regulations on contents, programs, forms and duration of training for public employees working in the fields of medicine, pharmacy, population and social affairs in conformity with standards of their professional titles, and provide guidance on and organize the implementation of such regulations.

16. Regarding health workforce training:

a) Formulate and promulgate within its competence or submit to competent authorities for promulgation strategies, plans and specific mechanisms and policies for health workforce training, and provide guidance on the implementation thereof;

b) Formulate and promulgate professional qualification standards which shall be used as the basis for formulation and development of standards for training programs and expected learning outcomes for health workforce training levels; cooperate with the Ministry of Education and Training of Vietnam in formulating standards for training programs and expected learning outcomes for each health workforce training vocation or level;

c) Formulate and promulgate requirements regarding training quality and expected learning outcomes for training courses in medical specialties and ensuring continuous health workforce training;

d) Manage training in medical specialties and continuous health workforce training in accordance with regulations of law;

e) Promulgate regulations and provide guidance on, and organize examinations and assessment for granting practicing licenses to eligible healthcare workers in accordance with regulations of law.

17. Regarding science, technology and innovation in medical sector:

a) Formulate and submit to competent authorities for promulgation mechanisms, policies, strategies and plans for scientific research, technological development and innovation in the fields within the scope of its management;

b) Manage, provide guidance on and organize biomedical research on human participants, research and development of new methods, techniques, technologies and products in the fields within the scope of its management;

c) Provide guidance on and inspect the compliance with law regulations during the performance of science and technology tasks; technology transfer and dissemination and application of findings on scientific research and technological development in the fields within the scope of its management; manage and use science and technology resources in the fields within the scope of its management;

d) Organize the implementation of regulations of law on intellectual property and initiatives within the scope of its management;

dd) Manage the formulation and promulgation of national technical regulations in the fields within the scope of its management in accordance with regulations of law; provide guidance on, monitor and manage the dissemination and application of national standards and national technical regulations in the fields within the scope of its management;

e) Organize the implementation of Technical Barriers to Trade (TBT) Agreement in the fields within the scope of its management.

18. Regarding application of information technology and digital transformation in medical sector:

b) Formulate and promulgate or submit to competent authorities for promulgation specialized regulations, technical processes, national standards and national technical regulations on application and development of information technology, electronic transactions, digital transformation in the fields within the scope of its management, and assurance of medical information safety and security in cyberspace;

c) Build, maintain, update and organize the development of e-government architecture of the Ministry of Health of Vietnam towards the development of digital government; build, manage, maintain, update and ensure safety and security of national health information system and database, other health information systems; manage, connect and share digital data in medical sector in accordance with regulations of law;

d) Direct, provide guidance on and organize the implementation of strategies, plans, regulations and technical processes on application and development of information technology, artificial intelligence, digital transformation and electronic transactions in the fields within the scope of its management, assurance of cybersecurity and safety of medical information systems nationwide in accordance with regulations of law.

19. Formulate, direct, provide guidance on, organize and inspect the implementation of programs and plans on health education and dissemination of information in medical sector.

20. Perform state management of public services in the fields within the scope of its management in accordance with regulations of law; formulate and promulgate or submit to competent authorities for promulgation mechanisms and policies on provision of public services in the fields within the scope of its management; promulgate technical – economic norms on public healthcare services under the state management; stipulate quality criteria and standards for public healthcare services, and mechanisms for inspection and assessment of quality of public healthcare services and operational performance of public service providers in the fields within the scope of its management.

21. Provide guidance on and organize the implementation of regulations of law on management of prices of services, goods and products in the fields within the scope of its management in accordance with regulations of law.

22. Play the leading role and cooperate with relevant authorities in preventing, controlling and providing first aid and treatment for disaster victims.

23. Formulate and organize the implementation of plans on national reserves of drugs, chemicals, medical devices and other instruments for epidemics and disaster prevention and control according to the list of national reserves decided by the Government and in accordance with regulations of law.

24. Manage non-governmental organizations and associations engaged in the fields within the scope of its management in accordance with regulations of law.

26. Carry out international cooperation and integration in the fields within the scope of its management in accordance with regulations of law. Organize negotiations and signing of international conventions in accordance with regulations of law and with the authorization of competent authorities; play the leading role and cooperate in signing international agreements in the name of the Ministry of Health of Vietnam; join international organizations as assigned by the Government.

27. Manage organizational structure, official payroll, number of employees, job positions, structure of official ranks, professional title-based structure of public employees; make decisions on internal transfer, assignment, appointment, discharge, dismissal, secondment, commendation, disciplinary actions, resignation, retirement; implement policies on salaries and other benefits; provide training and retraining for officials, public employees and contractual workers within the scope of its management in accordance with regulations of law.

28. Manage assigned assets and financial sources, manage and use allocated funding derived from state budget in accordance with regulations of law; manage the Vietnam Tobacco Control Fund (VNTCF) in accordance with regulations of law.

29. Carry out inspection of performance of functions, tasks and powers, and implementation of policies and laws of regulatory authorities, organizations and individuals; carry out administrative inspection of regulatory authorities, organizations and individuals under its management; carry out specialized inspection in the fields within the scope of its management in accordance with regulations of law. Organize prevention and fight against corruption and misconduct; thrift practices and waste combat; receipt of citizens and settlement of complaints, denunciations and petitions in the fields within the scope of its management; take actions against violations in the fields within the scope of its management or transfer them to competent authorities for consideration in accordance with regulations of law.

30. Formulate and promulgate the system of statistical indicators and regulations on statistical reports in medical sector in accordance with regulations of law; collect, consolidate, analyze, manage and retain statistical data in medical sector; establish the national health database.

31. Perform other tasks and powers as assigned by the Government or the Prime Minister and as prescribed by law.

The Minister of Health of Vietnam shall issue decisions defining functions, tasks, powers and organizational structure of its affiliated organizations and units.

Article 4. Effect

This Decree comes into force from March 01, 2025.

The Government’s Decree No. 95/2022/ND-CP dated November 15, 2022 defining functions, tasks, powers and organizational structure of Ministry of Health of Vietnam shall cease to have effect from the effective date of this Decree.

Article 5. Responsibility for implementation

Ministers, heads of ministerial agencies, heads of Governmental agencies, and Chairpersons of provincial People’s Committees are responsible for the implementation of this Decree.
