What are regulations on visa duration for foreign tourists to enter Vietnam? What are conditions for visa issuance to enter Vietnam? Mr. Faulen applied for visa issuance to enter Vietnam for tourism. The valid time printed on the visa is from November 3rd 2014 to February 3rd 2015. What are regulations on visa duration for foreign tourists to enter Vietnam?

Pursuant to Clause 17, Article 8 of the Law on Entry, Exit, Transit, and Residence Of Foreigners in Vietnam in 2014 (amended by Clause 3, Article 1 of the Law on Entry, Exit, Transit, and Residence Of Foreigners in Vietnam in 2019) stipulating visa symbols as follows:

17. DL - Issued to tourists.

Pursuant to Article 9 of the same Law (amended by Point d and e, Clause 4, Article 1 of the Law on Entry, Exit, Transit, and Residence Of Foreigners in Vietnam in 2019) stipulating visa duration as follows:

1. The duration of a SQ visa is not longer than 30 days.

2. The duration of a HN or DL visa is not longer than 03 months.

3. The duration of a VR visa is not longer than 06 months.

4. The duration of a NG1, NG2, NG3, NG4, LV1, LV2, DN, NN1, NN2, NN3, DH, PV1, PV2 or TT visa is not longer than 12 months.

5. The duration of a LĐ visa is not longer than 02 years.

5a. The duration of a DT3 visa visa is not longer than 03 years.

6. The duration of a ĐT visa is not longer than 05 years.

7. When a visa is expired, its reissuance shall be considered.

8. The duration of a visa shall be at least 30 days shorter than that of a passport or international laissez-passer.

9. International agreements to which Vietnam is a signatory shall prevail in case such international agreements specify otherwise.

As regulations above, Mr. Faulen enters Vietnam for tourism so his visa is labelled as DL as prescribed in Clause 2. Therefore, his maximum visa duration is 03 months. After this period of time, Mr. Faulen will either leave Vietnam or re-issue his visa if he wants to stay longer in Vietnam. 

What are conditions for visa issuance to enter Vietnam?

Pursuant to Article 10 of the same Law (amended by Clause 5, Article 1 of the Law on Entry, Exit, Transit, and Residence Of Foreigners in Vietnam in 2019) stipulating conditions for visa issuance as follows:

1. Has a passport or laissez-passer. 

2. Invited or sponsored by agencies, organizations or individuals in Vietnam, except for cases specified in Article 16a, Article 16b and Clause 3 Article 17 of this Law.

3. Not suspended from entry in the cases mentioned in Article 21 of this Law.

4. Proof of entry purposes must be provided when applying for a visa in the following cases:

a) Any foreigner who comes to make investment must have papers proving the investment in Vietnam in accordance with the Law on Investment;

b) Any foreigner who works as a lawyer in Vietnam must have a practice license in accordance with the Law of Lawyers;

c) Any foreigner who comes to work in Vietnam must have work permits in accordance with the Labor Code;

d) Any foreigner who comes to study in Vietnam must have written acceptance of a school or an education institution in Vietnam.

Therefore, foreigers, who want to enter Vietnam, have to meet all above conditions.
