Pursuant to Article 55 of the Law on Social Insurance 2014 as amended by Point b, Clause 1, Article 219 of the Labor Code 2019 stipulating the conditions for pension enjoyment when working capacity decreases:

1. The employees specified at Points a, b, c, d, g, h and i, Clause 1, Article 2 of this Law, when they leave their jobs and have paid social insurance premiums for full 20 years or more, are entitled to a pension at the rate of 1. lower than those eligible for pensions specified at Points a, b and c, Clause 1, Article 54 of this Law if they fall into one of the following cases:

a) Having a maximum age of 5 years younger than the retirement age specified in Clause 2, Article 169 of the Labor Code when having a working capacity decrease of between 61% and under 81%;

b) Having a maximum age of 10 years lower than the retirement age specified in Clause 2, Article 169 of the Labor Code when having a working capacity decrease of 81% or more;

c) Having worked for full 15 years or more in particularly heavy, hazardous or dangerous occupations or jobs on the list promulgated by the Ministry of Labor, War Invalids and Social Affairs and suffering a working capacity decrease of 61% or more. up.

2. The employees specified at Points dd and e, Clause 1, Article 2 of this Law, when they quit their jobs, have paid social insurance premiums for full 20 years or more, and suffer a working capacity decrease of 61% or more, are entitled to a salary. retire at a lower rate than those eligible for pension enjoyment specified at Points a and b, Clause 2, Article 54 of this Law in one of the following cases:

a) Have a maximum age of 10 years younger than the retirement age specified in Clause 2, Article 169 of the Labor Code;

b) Having 15 years or more of working in particularly heavy, hazardous and dangerous occupations or jobs on the list promulgated by the Ministry of Labor, War Invalids and Social Affairs.

Accordingly, if an employee who is a full 51-year-old male or full 46-year-old female employee who has paid social insurance premiums for 20 years or more but suffers a working capacity decline of 61% or more, he or she will be entitled to early retirement. . Persons suffering from occupational accidents who are entitled to support will be entitled to occupational accident support and early retirement pension. So in your case, you do not meet the above conditions, so you cannot retire before age.

In Vietnam, what does the dossier to receive pension include?

Căn cứ theo Điều 108 Luật Bảo hiểm xã hội 2014 quy định về hồ sơ hưởng lương hưu như sau:

1. Hồ sơ hưởng lương hưu đối với người lao động đang tham gia bảo hiểm xã hội bắt buộc bao gồm:

a) Sổ bảo hiểm xã hội;

b) Quyết định nghỉ việc hưởng chế độ hưu trí hoặc văn bản chấm dứt hợp đồng lao động hưởng chế độ hưu trí;

c) Biên bản giám định mức suy giảm khả năng lao động của Hội đồng giám định y khoa đối với người nghỉ hưu theo quy định tại Điều 55 của Luật này hoặc giấy chứng nhận bị nhiễm HIV/AIDS do tai nạn rủi ro nghề nghiệp đối với trường hợp người lao động quy định tại Điều 54 của Luật này.

2. Hồ sơ hưởng lương hưu đối với người lao động đang tham gia bảo hiểm xã hội tự nguyện, người bảo lưu thời gian tham gia bảo hiểm xã hội gồm cả người đang chấp hành hình phạt tù bao gồm:

a) Sổ bảo hiểm xã hội;

b) Đơn đề nghị hưởng lương hưu;

c) Giấy ủy quyền làm thủ tục giải quyết chế độ hưu trí và nhận lương hưu đối với người đang chấp hành hình phạt tù;

d) Văn bản của cơ quan nhà nước có thẩm quyền về việc trở về nước định cư hợp pháp đối với trường hợp xuất cảnh trái phép;

đ) Quyết định có hiệu lực pháp luật của Tòa án hủy bỏ quyết định tuyên bố mất tích đối với trường hợp người mất tích trở về.
