According to current regulations, how is the handling competence of the head of a commune-level company in the field of petroleum and petroleum trading in Vietnam?

In accordance with Clause 3 Article 57 of the Decree No. 99/2020/ND-CP, there are regulations on the power to impose penalties of Heads of Police Authorities of communes related to petroleum, petroleum business and petroleum industry as follows:

Chiefs of police stations of communes, chiefs of police stations at checkpoints and export-processing zones are entitled to:

- Impose fines of up to VND 2,500,000 upon an individual and up to VND 5,000,000 upon an organization;

- Confiscate the exhibits and instrumentalities for committing administrative violation worth less than the fine specified in Point a of this Clause;

- Apply mitigation and relief measures against consequences as stipulated in point a of clause 3 of Article 4 herein.

In accordance with Clause 4 Article 59 of the Decree No. 99/2020/ND-CP, there are regulations on the power to impose administrative penalties of Heads of Coast Guard Fleet in the petroleum sector, trading in petroleum and gas as follows:

Commanders of coastguard fleets are entitled to:

1. a) Impose fines of up to 50,000,000 VND for individuals and 100,000,000 VND for organizations that commit the violations mentioned in Chapter II of this Decree; impose fines of up to 30,000,000 VND for individuals and 60,000,000 VND for organizations that commit other violations prescribed in this Decree;
2. b) Confiscate the exhibits and instrumentalities for committing administrative violation worth less than the fine specified in Point a of this Clause;
3. c) Enforce the remedial measures mentioned in Points a, b and e Clause 3 Article 4 of this Decree.

Sanctioning competence of Commander of Coast Guard Region in the petroleum sector in Vietnam?

Announcement: Pursuant to Clause 5, Article 59 of Decree No. 99/2020/ND-CP, there is a regulation on competence of administrative sanction of Commander of Coast Guard Region in the petroleum sector, petroleum and gas trading as follows:

Commanders of regional coastguard command centers shall have the power to:

1. a) Impose a fine of up to 100,000,000 dong on individuals and a fine of up to 200,000,000 dong on organizations for violations stipulated in Chapter II of this Decree; impose a fine of up to 50,000,000 dong on individuals and a fine of up to 100,000,000 dong on organizations for other violations stipulated in this Decree;
2. b) Confiscate the exhibits and instrumentalities for committing administrative violation worth less than the fine specified in Point a of this Clause;
3. c) Enforce the remedial measures mentioned in Points a, b and e Clause 3 Article 4 of this Decree.
