CIRCULAR
PRESCRIBING QUALITY MANAGEMENT OF
BUILDING MATERIAL PRODUCTS AND GOODS
Pursuant to the Law on
Quality of Products and Goods No. 05/2007/QH12, as amended by the Law No.
78/2025/QH15;
Pursuant to the Law on
Technical Standards and Regulations No. 68/2006/QH11, as amended by the Law No.
70/2025/QH15;
Pursuant to the
Construction Law No. 135/2025/QH15;
Pursuant to the
Government’s Decree No. 33/2025/ND-CP dated March 08, 2025 defining functions,
tasks, powers and organizational structure of the Ministry of Construction of
Vietnam;
Pursuant to the
Government’s Decree No. 209/2026/ND-CP dated June 15, 2026 elaborating and
providing measures for implementation of the Construction Law regarding
management of building materials;
Pursuant to the
Government’s Decree No. 207/2026/ND-CP dated June 15, 2026 elaborating the
Construction Law regarding quality management, construction execution, and
maintenance of construction works;

Pursuant to the
Government’s Decree No. 22/2026/ND-CP dated January 16, 2026 elaborating and
providing measures for implementation of the Law on Standards and Technical
Regulations;
At the request of the
Director General of the Department of Science, Technology, Environment and
Building Materials;
The Minister of
Construction hereby promulgates a Circular prescribing quality management of
building material products and goods.
Chapter
I
GENERAL
PROVISIONS
Article
1. Scope
1. This Circular provides
detailed regulations on Point a Clause 2 Article 94 of the Government's Decree
No. 37/2026/ND-CP dated January 23, 2026 elaborating and providing measures and
guidelines for implementation of the Law on Quality of Products and Goods, and
Point c Clause 2 Article 16 of the Government's Decree No. 209/2026/ND-CP dated
June 15, 2026 elaborating and providing measures for implementation of the
Construction Law regarding management of building materials, including:
a) Regulations on quality
management of building material products and goods in manufacturing, export,
import, placing on the market, and use in construction works.
b) List of building
material products and goods classified into high-risk and medium-risk groups,
together with their corresponding HS codes in conformity with the Vietnam
Nomenclature of Exports and Imports.

Article
2. Regulated entities
1. Regulatory authorities
in charge of performing state management of building materials.
2. Organizations and
individuals that manufacture, trade, place on the market, import, export, and
use building material products and goods.
3. Conformity assessment
bodies, including testing bodies, inspection bodies and certification bodies;
and organizations providing judicial expertise in the quality of building
material products and goods.
4. Quality inspection
agencies for building material products and goods, and other relevant agencies,
organizations and individuals.
Article
3. Building material products and goods, and risk classification
1. Building material
products and goods subject to quality management under this Circular are those
under the state management of the Ministry of Construction. The list of
building material products and goods is provided in Appendix I enclosed
herewith.
2. Building material
products and goods are classified by risk level as follows:
a) High-risk group:
building material products and goods specified in Appendix II enclosed herewith;

c) Low-risk group:
building material products and goods other than those included in the lists
specified in Appendix II and Appendix III enclosed herewith, unless otherwise
provided by specialized laws.
3. HS codes of building
material products and goods shall be determined in accordance with Vietnam
Nomenclature of Exports and Imports issued by the Ministry of Finance, and
regulations of the Law on customs.
In case of discrepancies
or inconsistencies in the classification and determination of HS codes for
goods included in the lists of building material products and goods enclosed
with this Circular, such classification and determination of HS codes shall
comply with regulations of the Law on customs.
For exported or imported
building material products and goods whose HS codes have not been determined in
the lists enclosed with this Circular, the determination of HS codes shall
comply with regulations of the Law on customs. After customs clearance,
exporters or importers shall send reports on such cases to the Ministry of
Construction of Vietnam to serve as a basis for coordinating with the Ministry
of Finance in considering and agreeing on the updating and addition of such
products and goods to the relevant Lists in accordance with regulations.
Article
4. Labeling of building material goods
1. The labeling of goods,
use of electronic labels, and provision of information on building material
products and goods shall comply with Chapter IV of the Government's Decree No.
37/2026/ND-CP dated January 23, 2026 and relevant laws.
2. Organizations and
individuals are encouraged to apply numbering codes, barcodes, QR codes, RFID
and other digital technology solutions to facilitate traceability and quality
management of building material products and goods. For building material goods
classified into the medium-risk group and high-risk group distributed on
e-commerce platforms, traders shall be responsible for publicly displaying
images of the goods' labels and conformity marks as prescribed.
3. Where a national
technical regulation contains specific provisions on label contents or
mandatory information on a label, the labeling of goods must comply with the
Decree No. 37/2026/ND-CP dated January 23, 2026 and the corresponding national
technical regulation.

Article
5. General requirements for quality management of building material products
and goods
1. Building material
products and goods must meet quality requirements in accordance with the Construction
Law; and shall have their applicable standards announced and be traceable in
accordance with the Law on quality of products and goods, and the Law on
standards and technical regulations.
The management of building
material products and goods manufactured from materials derived from waste,
scrap, or industrial by-products shall comply with the Law on environmental
protection and other relevant laws.
2. For building material
products and goods classified into the low-risk group:
a) A quality management
system shall be applied to ensure that the products meet the applicable
standards announced in accordance with the Law on standards and technical
regulations, and the products shall be labeled in accordance with Article 4 of
this Circular before they are placed on the market;
b) Declaration of
conformity of such products and goods with the corresponding standards is
optional. The declaration of conformity with standards shall comply with the
Law on standards and technical regulations, the Law on quality of products and
goods, the guidance of the Ministry of Science and Technology provided in the
Circular No. 14/2026/TT-BKHCN dated April 09, 2026, and Article 11 of this
Circular.
3. For building material
products and goods classified into the medium-risk group and high-risk group:
a) A quality management
system shall be applied to ensure that the products meet the corresponding
technical regulations, and the products shall be labeled in accordance with
Article 4 of this Circular before they are placed on the market;
b) Declaration of
conformity of such products and goods with the corresponding technical
regulations is compulsory. Except for products and goods manufactured
specifically for a construction work, declaration of conformity with technical
regulations shall comply with the Law on standards and technical regulations,
the Law on quality of products and goods, the guidance of the Ministry of
Science and Technology provided in the Circular No. 14/2026/TT-BKHCN dated
April 09, 2026, and Article 12 of this Circular.

1. Quality management of
building material products in manufacturing shall comply with Article 28 of the
Law on Quality of products and goods, as amended by Clause 17 Article 1 of the
Law No. 78/2025/QH15, and Articles 66 and 67 of the Decree No. 37/2026/ND-CP
dated January 23, 2026.
2. Building material
manufacturing establishments shall have the following responsibilities:
a) Strictly comply with
Clause 1 of this Article;
b) Ensure the quality of
products during manufacturing before placing them on the domestic market in
accordance with Article 66 of the Decree No. 37/2026/ND-CP dated January 23,
2026;
c) Establish, apply and
maintain a quality management system suitable for the type of products,
technology, and scale of production, and the requirements of the applicable
standards and technical regulations;
d) Control the quality of
input materials, semi-finished products, and finished products; and fully
maintain technical dossiers, quality control dossiers, and traceability
dossiers as prescribed.
3. The quality management
of building material products produced or manufactured specifically for a
construction work shall comply with regulations of the Construction Law.
4. State inspection of the
quality of products during manufacturing shall be conducted by product and
goods quality inspection agencies in accordance with Article 79 of the Decree
No. 37/2026/ND-CP dated January 23, 2026.

2. State inspection of the
quality of exported goods and handling of violations shall comply with Article
87 of the Decree No. 37/2026/ND-CP dated January 23, 2026.
Article
8. Quality management of imported building material goods
1. Before being placed on
the market, imported building material goods must meet quality requirements as
set out in Article 34 of the Law on quality of products and goods, as amended
by Clause 19 Article 1 of the Law No. 78/2025/QH15, Article 68 of the Decree
No. 37/2026/ND-CP dated January 23, 2026, and regulations of law on management
of building materials.
2. State inspection of the
quality of imported goods:
a) State inspection of the
quality of imported building material goods shall comply with Article 82 of the
Decree No. 37/2026/ND-CP dated January 23, 2026;
b) The state agency in
charge of inspecting the quality of imported building material goods classified
into the high-risk group is the Department of Construction (hereinafter
referred to as the "Inspecting Agency") of the province or city where
the importer follows business registration procedures (or where its
representative office, branch, or manufacturing plant is located); or where the
border checkpoint through which the goods are imported; or where the importer
carries out customs procedures for its shipment.
c) The order, procedures
and documentation requirements for state inspection of the quality of imported
building material goods classified into the high-risk group shall comply with
Article 83 of the Decree No. 37/2026/ND-CP dated January 23, 2026.
3. Recognition of
conformity assessment results issued by foreign organizations or bodies shall
comply with the laws of Vietnam and international treaties to which Vietnam is
a signatory.
4. The application of
measures for exemption from or reduction of quality inspection for imported
building material goods classified into the high-risk group, and the exemption
from re-declaration of conformity with technical regulations for imported
building material goods classified into the medium-risk group, shall comply
with Article 86 of the Decree No. 37/2026/ND-CP dated January 23, 2026.

Article
9. Quality management of building material goods placed on the market
1. Quality management of
building material goods placed on the market shall comply with Article 34a of
the Law on quality of products and goods, as amended by Clause 19 Article 1 of
the Law No. 78/2025/QH15, and Article 69 of the Decree No. 37/2026/ND-CP dated
January 23, 2026.
2. Quality inspection of
building material goods placed on the market shall comply with Article 88 of
the Decree No. 37/2026/ND-CP dated January 23, 2026, on the basis of:
a) Management information
and data;
b) Reports, feedbacks and
recommendations from organizations and individuals;
c) Results of risk
analysis and assessment;
d) State management
requirements in each period.
3. The order and
procedures for inspection, and handling of violations involving building
material goods placed on the market, shall comply with Articles 89 and 90 of
the Decree No. 37/2026/ND-CP dated January 23, 2026.

2. The responsibilities of
investors, construction contractors, and organizations and individuals
supplying building material goods for ensuring the quality of building material
products and goods used in construction works shall comply with Article 14 of
the Decree No. 207/2026/ND-CP dated June 15, 2026 elaborating the Construction
Law regarding quality management, construction execution, and maintenance of
construction works, the Law on quality of products and goods, and other
relevant laws.
Chapter
III
MANAGEMENT
OF CONFORMITY ASSESSMENT ACTIVITIES FOR BUILDING MATERIAL PRODUCTS AND GOODS
Article
11. Declaration of conformity with standards
1. The subjects of
declaration of conformity with standards are building material products and
goods.
2. Organizations and
individuals shall declare the conformity of building material products and
goods with the corresponding standards on the basis of certification of
conformity with standards issued by a certification body which has been duly
registered or accredited, or on the basis of self-assessment results of
conformity as prescribed by law.
3. The procedures for
declaration of conformity with standards and the responsibilities of
organizations and individuals making such declarations of conformity shall
comply with Articles 9 and 10 of the Circular No. 14/2026/TT-BKHCN dated April
09, 2026.
Article
12. Declaration of conformity with technical regulations
1. The subjects of
declaration of conformity with technical regulations are building material
products and goods classified into the high-risk group and medium-risk group
specified in the national technical regulations issued by the Ministry of
Construction and in Appendix II and Appendix III enclosed herewith.

a) For products and goods
classified into the high-risk group: the declaration of conformity with
technical regulations shall be made on the basis of certification of conformity
with technical regulations issued by a certification body designated by the
Ministry of Construction;
b) For products and goods
classified into the medium-risk group: the declaration of conformity with
technical regulations shall be made on the basis of certification of conformity
with technical regulations issued by a certification body accredited or
designated as prescribed by law; or on the basis of self-assessment results of
organizations and individuals based on testing results issued by a testing body
accredited or designated as prescribed by law.
3. Where conformity
assessment results issued by a foreign certification body or testing body are
used, such bodies must be recognized in accordance with the laws of Vietnam or
international treaties to which Vietnam is a signatory.
4. Documentation
requirements, order and procedures for declaration of conformity with technical
regulations, and the responsibilities of organizations and individuals making
such declarations, shall comply with the Decree No. 22/2026/ND-CP dated January
16, 2026 and the guidance in Articles 13 and 14 of the Circular No.
14/2026/TT-BKHCN dated April 09, 2026.
5. Where the National
Database on Standards, Metrology and Quality malfunctions or its infrastructure
has not been completed, organizations and individuals shall submit applications
for registration of declaration of conformity with technical regulations
directly or by post to the Inspecting Agency. To be specific:
a) For domestically
manufactured products and goods, the relevant organization or individual shall
follow procedures for registration of declaration of conformity with technical
regulations with the Inspecting Agency of the province or city where they
follow business registration procedures or where their representative office,
branch or manufacturing plant is located, as prescribed by law;
b) For imported products and
goods, the relevant organization or individual shall follow procedures for
registration of declaration of conformity with technical regulations with the
Inspecting Agency competent to conduct State inspection of the quality of
imported goods in accordance with Article 8 of this Circular.
Article
13. Conformity assessment bodies and organizations providing judicial expertise
in quality of building material products and goods
1. Conformity assessment
bodies carrying out testing, inspection and certification of building material
products and goods shall satisfy the eligibility conditions for provision of
conformity assessment services and follow procedures for registration of their
scope of operation in accordance with Chapter V of the Decree No. 22/2026/ND-CP
dated January 16, 2026.

3. Conformity assessment
bodies that have registered their scope of operation or that have been
designated by the Ministry of Construction must comply with regulations on
conformity assessment activities and shall be subject to inspection and
supervision by competent authorities. The list of conformity assessment bodies
that have registered their scope of operation or that have been designated
shall be published as prescribed by law.
4. Foreign conformity
assessment bodies carrying out certification and testing of building material
products and goods shall be considered for recognition in accordance with the
laws of Vietnam, and international treaties to which Vietnam is a signatory.
5. Organizations providing
judicial expertise in the quality of building material products and goods shall
comply with regulations of law on judicial expertise in the construction sector
and the provisions of this Circular.
Chapter
IV
IMPLEMENTATION
ORGANIZATION
Article
14. Responsibilities of ministries and ministerial agencies
1. The Ministry of
Construction shall:
a) Provide guidance on,
urge and inspect the implementation of this Circular;
b) Issue, modify,
re-issue, revoke, or annul decisions on designation of conformity assessment
bodies for the quality of building material products and goods; inspect and
handle violations in the operation of conformity assessment bodies as
prescribed by law.

Article
15. Responsibilities of People's Committees of provinces and cities
1. Organize and conduct
state inspection of the quality of building material products and goods within
their provinces or cities in accordance with regulations of decentralization of
authority, and relevant laws.
2. Authorize or
decentralize authority to local inspecting agencies to issue, modify, re-issue,
revoke or annul certificates of registration of conformity assessment
activities of conformity assessment bodies for the quality of building material
products and goods; and to designate local conformity assessment bodies, and
revoke decisions designating such bodies as prescribed by law.
3. Authorize or
decentralize authority to local inspecting agencies to receive and manage
applications for registration of declaration of conformity with technical
regulations; suspend or annul the validity of declarations of conformity with
technical regulations as prescribed by law; and receive and process
applications for state inspection of imported building material goods.
4. Authorize or
decentralize authority to local inspecting agencies to receive, confirm or
reject applications for exemption from or reduction of quality inspection of
imported building material goods; and give notification of the discontinuation
of exemption from or reduction of inspection as prescribed by law.
5. Manage and inspect
certification and declaration of conformity with technical regulations for
building material products and goods within their provinces or cities; and
coordinate with customs authorities and other relevant agencies in inspecting
the quality of imported building material goods.
6. Prepare consolidated
reports on quality management of building material products and goods within
their provinces or cities by December 31 each year, or on an ad-hoc basis at
the request of the Ministry of Construction; the contents and form of the
report shall comply with Appendix IV enclosed herewith. Such reports
shall be submitted electronically via the electronic document exchange system.
7. Organize inspections
and handle violations in the quality management of building material products
and goods within their provinces or cities and their competence.
Article
16. Responsibilities of conformity assessment bodies and organizations
providing judicial expertise in quality of building material products and goods

2. Submit reports on
conformity assessment activities by December 15 each year, or on an ad-hoc
basis at the request of the Ministry of Construction. Update the results of
their performance of conformity assessment activities in accordance with Clause
1 Article 68 of the Decree No. 22/2026/ND-CP dated January 16, 2026 and Clause
2 Article 77 of the Decree No. 37/2026/ND-CP dated January 23, 2026.
3. Promptly notify
competent authorities of any change affecting their conformity assessment
capacity within 15 days from the date of occurrence of such change.
Article
17. Transition
1. Certificates of
conformity with technical standards and certificates of conformity with QCVN
16:2023/BXD, for building material products and goods which were issued before
the effective date of this Circular and remain valid shall continue to be used
until the expiry date stated thereon, unless otherwise provided by law.
2. Conformity assessment
bodies that were designated and granted certificates of registration for
certification or testing activities for building material products and goods
under QCVN 16:2023/BXD before the effective date of this Circular may continue
to operate within the scope and duration stated in the issued designation
decisions or registration certificates; where the contents thereof are no
longer conformable with this Circular, they must be modified in accordance with
regulations of law.
3. Products and goods
which fall within the scope of QCVN 16:2023/BXD but are not included in
Appendix II or Appendix III enclosed herewith shall be managed in accordance
with regulations on quality management of building material products and goods
classified into the low-risk group, and other relevant laws.
4. For products and goods
included in Appendix II or Appendix III enclosed herewith for which no
corresponding national technical regulation has yet been issued, declaration of
conformity with technical regulations and certification of conformity with
technical regulations shall be carried out after the corresponding national
technical regulation is issued and takes effect; pending the issuance of such
national technical regulation, relevant organizations and individuals shall
announce their applicable standards, ensure compliance with requirements on the
quality, labeling and traceability of products and goods, and perform other
responsibilities in accordance with the Law on quality products and goods, and
other relevant laws.
5. Where any legislative
documents referred to in this Circular are amended or replaced, the new ones
shall apply.

2. Section 1.4.3 of Part
1, and Parts 3, 4 and 5 of the National Technical Regulations on Building
Material Products and Goods (QCVN 16:2023/BXD), issued together with the
Circular No. 04/2023/TT-BXD dated June 30, 2023 of the Minister of
Construction, are hereby annulled. The names of products and goods and their HS
codes in Appendix II and Appendix III enclosed herewith shall replace the names
of products and goods and HS codes in Table 1 - List of Building Material
Products and Goods enclosed with QCVN 16:2023/BXD.
3. The Circular No.
10/2024/TT-BXD dated November 01, 2024 of the Minister of Construction on
quality management of building material products and goods is hereby annulled
from the effective date of this Circular.
Difficulties that arise
during the implementation of this Circular should be promptly reported to the
Ministry of Construction for consideration and guidance./.
