During the monitoring and operation of the
VNACCS/VCIS system, the General Department of Customs received feedback from
relevant units regarding the VNACCS/VCIS system, which affected the customs
clearance process for imported and exported goods. Through system checks, the
General Department of Customs determined that the main cause was that the
number of messages sent to the electronic data processing system of customs did
not comply with the regulations on sending/receiving/responding to data
messages. This issue mainly occurs with export and import declarations through
border checkpoints, which are group 2 goods specified in Clause 5, Article 2 of
Circular No. 56/2019/TT-BTC dated August 23, 2019 sent via express delivery
service. This is the main reason the VNACCS/VCIS system is overloaded many
times, seriously affecting the receipt and processing of declarations of the
system. To ensure the VNACCS/VCIS system runs smoothly, as well as to
facilitate the export and import activities of businesses, the General
Department of Customs has held working meetings with businesses that provide
the above services. Accordingly, the General Department of Customs requires the
Customs Departments of provinces and cities to implement customs procedures for
group 2 export and import goods sent via international express services as
follows:
I. For cargo sent via international
express delivery services transported by air or sea, the Customs Department of
provinces and cities and express delivery businesses carry out customs
procedures on the VNACCS/VCIS system according to current regulations.
II. For cargo sent via
international express delivery services transported by road, the Customs
Department of provinces and cities and express delivery businesses carry out
customs procedures as follows:
1. Express service providers shall process paper
customs declarations in accordance with Clause 6 and Clause 8, Article 2 of
Circular No. 56/2019/TT-BTC dated August 23, 2019 of the Minister of Finance.
2. Customs Department of provinces and cities shall
comply with Clause 2, Article 10 of Circular No. 191/2015/TT-BTC dated November
24, 2015, amended in Clause 8, Article 2, Circular No. 56/ 2019/TT-BTC dated
August 23, 2019 and Articles 45 to 51 of customs procedures for exported and
imported goods issued together with Decision No. 1966/QD-TCHQ dated July 10,
2015 of the General Department of Customs. In addition, please note the
following:
a) Cargo Declaration
+ For cargo declared on paper at the port of entry:
Complete the Cargo Declaration Form in Excel (xlsx) format according to
Appendix I (imported goods) or Appendix II (exported goods) attached to this
Circular. Use the HYS function to attach the Cargo Declaration Form to the
VNACCS/VCIS system and use the HYS file attachment number to fill in the paper
declaration.

b) Customs declaration:
The customs declarant shall complete the customs
declaration form according to form HQ/2015/XK or form HQ/2015/NK issued with
Circular No. 38/2015/TT-BTC. Filling in information entries on the declaration
is explained in Part III, Appendix II, List 2 issued with Circular No.
56/2019/TT-BTC.
+ The HYS attachment file number (Cargo
Declaration) in the entry "Other notes" on the paper customs
declaration is filled in as follows: #&HYS attachment file number&#.
The customs declarant shall submit to the customs
authority 2 paper copies of the customs declaration form according to form
HQ/2015/XK or form HQ/2015/NK (do not submit the Cargo Declaration).
c) Receipt and processing of paper declarations:
+ Customs officers will review the information on
the customs declaration submitted by the enterprise and the Cargo Declaration
on the system to ensure that they are complete.
+ Assign the declaration number when the declarant
has completed the declaration in accordance with Article 46 of the Procedures
issued together with Decision No. 1966/QD-TCHQ dated July 10, 2015 of the
General Department of Customs.
Customs officers enter declaration information into
the System (except for information on the Cargo Declaration).
+ Stamp the officer's seal in the “Customs
clearance confirmation” box and transfer 2 copies of declaration to the customs
officer in the inspection division. All the shipments listed on the Cargo
Declaration are cleared as declared by the customs declarant.

+ The Customs Sub-department shall assign staff to
analyze and assess risks on the Public Service Online or VNACCS/VCIS system.
+ The Chief Sub-department is authorized to select
some shipments at random for physical inspection, with the inspection rate not
exceeding 0.2% of the total number of shipments/bills of lading under the Cargo
Declaration Form attached to the paper declaration. Notify the customs
declarant of the list of shipments that must be physically inspected according
to Appendix III attached to this Circular.
+ Screen all group 2 cargo before being brought to
the inspection area, except for goods that have been physically inspected.
+ For shipments that are screened and found to be
not suspicious, they shall be allowed to pass through the inspection area. The
customs officer shall sign and seal in the confirmation box of the customs
inspector on 2 copies of declaration. At the confirmation box of the customs
inspector on the customs declaration, the customs officer shall clearly
indicate the number of shipments under the declaration that are not allowed to
pass through the inspection area. Then the customs officer shall sign and seal
on 2 copies of declaration, the enterprise shall keep 1 copy, and the customs
authority shall keep 1 copy (attached to Appendix III).
+ For goods subject to inspection according to
Appendix III: After a physical inspection of the cargo, if the cargo is in
accordance with the declaration, the customs authority shall enter "in
accordance with the declaration" in the comments section and sign and
stamp their seal (number 8) on Appendix III.
In case the cargo does not conform to the
declaration, clearly state the number of the bill of lading containing the
cargo that does not conform to the declaration in the notes box (No. 5) and in
the comments section of the customs authority (No. 6), clearly state the number
of bills of lading that are not in accordance with the declaration in Appendix
III and take appropriate action against the violation.
4. Paper-based customs procedure For group 2 cargo
handled with paper-based customs procedures, the Customs Sub-departments of
provinces and cities should prioritize staffing to expedite clearance and
prevent congestion at ports of entry and other centralized locations for
collection and inspection of postal and express delivery cargo.
