PROMULGATING
ACTION PLAN FOR IMPLEMENTATION OF NOTICE 47-TB/TW DATED NOVEMBER 11, 2024 OF
THE POLITBURO ON BUILDING REGIONAL AND INTERNATIONAL FINANCIAL CENTERS IN
VIETNAM
THE GOVERNMENT
Pursuant to Law on Governmental Organization
dated June 19, 2015; Law on amendments to Law on Government Organization and
Law on Local Governmental Organization dated November 22, 2019;
Pursuant to Decree No. 39/2022/ND-CP dated June
18, 2022 of the Government on Working Regulation of the Government;
Pursuant to Notice No. 47-TB/TW dated November
15, 2024 of the Politburo on building a regional and international financial
center in Vietnam;
At the request of the Minister of Planning and
Investment in Statement No. 9884/TTr-BKHDT dated November 29, 2024 and
Statement No. 10545/BKHDT-DTNN dated December 20, 2024;
Based on the voting results of the Government

Article 1. Approval of the
Action Plan for implementation of the Politburo's Conclusion on building
regional and international financial centers in Vietnam in Notice No. 47-TB/TW
dated November 15, 2024.
Article 2. The Ministry of
Planning and Investment shall
1. Take charge and cooperate with the Government
Office in completing the draft Decision of the Prime Minister on the establishment
of the Steering Committee on Regional and International Financial Centers in
Vietnam, to be issued in December 2024.
2. Urgently submit to competent authorities to
issue the Regulations on organization and operation of the Steering Committee on
Regional and International Financial Centers in Vietnam after the Steering
Committee is established.
Article 3. This Resolution
comes into force from the date on which it is signed.
Article 4. Ministers, Heads
of ministerial agencies, Heads of Government agencies, Secretary of the City
Party Committee, President of the People’s Committee of Ho Chi Minh City and
Secretary of the City Party Committee, President of the People’s Committee of
Da Nang City, relevant organizations and individuals are responsible for
implementing this Resolution../.

ACTION PLAN
FOR
IMPLEMENTATION OF NOTICE 47-TB/TW DATED NOVEMBER 11, 2024 OF THE POLITBURO ON
BUILDING REGIONAL AND INTERNATIONAL FINANCIAL CENTERS IN VIETNAM
(Attached to Resolution No. 259/NQ-CP dated December 31, 2024 of the
Government)
Pursuant to Conclusion Notice No. 47-TB/TW dated
November 15, 2024 of the Politburo on building regional and international
financial centers in Vietnam, the Government assigns ministries and agencies
with the following tasks:
I. VIEWPOINTS, PURPOSES,
REQUIREMENTS
1. Thoroughly execute and ensure the drastic,
effective, synchronous, comprehensive and consistent implementation of the
guiding viewpoints, objectives and contents of the Scheme for building a
regional and international financial center in Vietnam approved by the
Politburo in the Notice No. 47-TB/TW, in the spirit of strong innovation for
breakthroughs.
2. Clearly determine the contents, tasks,
solutions, key activities, presiding agencies, coordinating agencies,
submission levels, expected output and specific completion time so that
ministries, ministerial agencies, agencies under the Government, the People's
Committees of Ho Chi Minh City and Da Nang, and relevant agencies are able to
focus on directing, formulating action plans, organizing implementation,
inspecting, supervising and assessing the implementation of the Action Plan;
focusing on institutionalizing solutions, models, and policies applied to build
regional and international financial centers (hereinafter referred to as
“FCs") in Vietnam of the Scheme in accordance with Notice No. 47-TB/TW.
3. Ensure harmony and coherence with the economic
and social development strategies, planning, and plans of each ministry,
central and local authority to maximize feasibility in implementing the Action
Plan.
4. Central and local authorities must cooperate
synchronously and closely; follow the progress and roadmap in line with the
directives of the Politburo, be determined in formulating document providing
for Regional and International FCs in Vietnam; establish and operate the FC in
Ho Chi Minh City, Da Nang in 2025.
II. KEY ACTIVITIES, TASKS,
SOLUTIONS

a) Establish an Inter-sectoral Steering Committee
for the Regional and International Financial Center to enable inter-sectoral
cooperation and assist the Government and the Prime Minister in directing
orientation, strategy, and coordination to ensure smooth and consistent
operation in line with the directives of the Politburo, especially in the phase
of establishing policies and benefits.
b) Propose that the Ho Chi Minh City CPV Committee
and the Da Nang CPV Committee establish Steering Committees/Working groups for
building FCs, with the Secretaries of the City Party Committees serving as the
Heads to lead and direct the establishment and operation of the FCs in Ho Chi
Minh City and Da Nang with the following main tasks:
- Directing the concentration of resources for
investment in developing the infrastructure of the FCs, developing a plan to
mobilize resources, including resources from the state budget and private
resources to develop infrastructure serving the FCs.
- Directing the development and implementation of
investment plans for human resource development for the FC.
- Cooperate with the Inter-sectoral Steering
Committee for the Regional and International Financial Center, the Board for Drafting
of Resolution of the National Assembly on building the FCs, and the Working
group for building the organizational structure and operation of the FCs and
relevant ministries and central authorities in the formulation of legislative
documents and the establishment of the management and operation apparatus for
the FCs.
2. Building and completing institutions and
policies with respect to FCs
a) Formulate Resolution of National Assembly on FCs
- Establish Board for Drafting of Resolution of the
National Assembly on FCs to:
Direct the impact assessment, complete 08 groups of
policies for immediate application and 06 groups of policies for application
according to the roadmap agreed by the Politburo in the Notice No. 47-TB/TW,
ensuring compliance with Vietnam's conditions, international practices and
international commitments to which Vietnam is a member.

+ Prepare application for formulating Resolution,
draft Resolution on FCs, and submit it to the National Assembly in accordance
with the Law on Promulgation of Legislative Documents.
b) Formulate documents regulating and guiding the
implementation of the National Assembly's Resolution on FCs (according to the
specific Plan after the National Assembly issues the Resolution).
c) Handle arising legal problems, provide/propose
guidance on the application of the Resolution on FCs and related legislative
documents or review and propose amendments to related legislative documents
(according to the specific Plan after the National Assembly issues the
Resolution).
3. Arranging and mobilizing resources to build
infrastructure and develop FCs
a) Invest in building infrastructure for the FCs in
Ho Chi Minh City and Da Nang;
b) Prepare and train human resources in the state
apparatus to serve the management and operation of FCs
c) Hire domestic and international consultants and
experts in the process of building and operating FCs.
4. Establishing FCs:
a) Prepare the location to be ready for the
development of FCs, satisfying the following requirements:

- Having modern and synchronous infrastructure
system; available conditions for available conditions for traffic, telecommunications
and ancillary services, etc.
- Ensuring readiness in terms of legal status;
being ready to be established as soon as possible.
b) Build the management and operation apparatus of
FCs
- Establishing a Working Group on building the
management and operation apparatus of the FC (with the Minister of Home Affairs
as the Head, the President of the People’s Committee of Ho Chi Minh City and Da
Nang City as the Deputy Heads and the members being leaders of relevant
agencies) to initiate the establishment of agencies within the FC follows:
+ The Agency managing and operating the FC: is the
agency that directly manages and operates the Financial Center, affiliated to
the People's Committees of the cities. The composition thereof includes the
Board of Directors of the operating agency and specialized departments and
offices.
+ Agency supervising the FC: supervises the
operation of financial institutions in the FC.
+ Dispute resolution agency: establishes an
international arbitration center under the Financial Center following the model
of a commercial arbitration center but with some specific characteristics to
ensure the effective and quick resolution of disputes and enforcement of
judgments.
- Establishing and operating the management
apparatus of the FC (according to the authority and regulations in the National
Assembly's Resolution on FCs).
5. Communication and investment promotion

b) Develop a plan and implement domestic and
foreign communication on the FCs of Ho Chi Minh City and Da Nang.
c) Promote investment, call for investment in the
FCs in Ho Chi Minh City and Da Nang;
6. Organizing the preliminary and final review of
the Scheme
a) Organize the annual and periodic preliminary review
of each stage to learn and effectively implement the Scheme according to Notice
No. 47-TB/TW, report to competent authorities if new issues arise.
b) Conduct a comprehensive review of the 2025-2030
roadmap of the Scheme at the end of 2029 (beginning of 2030) to prepare for the
effective implementation of the 2030-2035 roadmap.
III. IMPLEMENTATION
1. Depending on the content of the Plan, Ministers,
Heads of ministerial agencies, heads of government agencies, Secretaries of
City CPV Committees, and Presidents of the People's Committees of Ho Chi Minh
City and Da Nang shall, within their jurisdiction shall effectively implement
and closely monitor the assigned tasks, ensuring timely detection of
difficulties, obstacles, and issues for appropriate handling within their
jurisdiction or reporting to the relevant authorities for resolution.
2. The Minister of Planning and Investment shall
a) Monitor and urge the implementation of the Plan,
report and propose to the Prime Minister and the Government any necessary
measures to ensure a consistent and effective implementation of the Plan.

3. Ministries, central authorities, the People's
Committees of Ho Chi Minh City and Da Nang are responsible for taking charge
and cooperating in implementing the tasks and activities specified in the
Appendix attached hereto.
4. Resources for implementing the tasks and
activities of the Action Plan for building the Regional and International FCs
include:
a) State budget: central government budget, local
government budget.
b) International support: official development
assistance (ODA), support funds and concessional loans for the establishment
and development of FCs.
Market loans and private investment sources:
foreign direct investment (FDI) for the establishment and development of FCs,
domestic investment capital for the development FCs.
d) Other community and social capital sources:
public-private partnership (PPP) funds for FC establishment projects, domestic
funds for FC development.
5. Reporting
a) Ministries, central and local authorities, and
relevant agencies shall conduct periodic reviews of the implementation of tasks
and activities assigned in the Action Plan for the establishment of the
Regional and International FCs as prescribed.
b) The Ministry of Planning and Investment shall
coordinate the establishment of the Regional and International FCs, regularly
monitor and supervise the implementation progress, consolidate information,
report to the relevant authorities for guidance on organizing preliminary and
final reviews of the implementation of assigned tasks; promptly address
emerging issues that arise, and report to the National Steering Committee for
review and decision.
