Trong khuôn khổ đàm phán nâng cấp Hiệp định Thương mại Tự do ASEAN - Ốt-xtrây-li-a - Niu Di-lân (AANZFTA), các nước hiện đang hoàn tất nội dung lời văn về thương mại và phát triển bền vững. Trong đó, lời văn hiện tại được đảm bảo tiêu chí giới hạn ở các hoạt động hợp tác, chia sẻ thông tin, xây dựng năng lực trong các lĩnh vực chung như: khí hậu và môi trường; kinh tế xanh và kinh tế biển; năng lượng; lao động; và các vấn đề liên quan đến các Mục tiêu phát triển bền vững của Liên Hợp Quốc. Các nước vẫn đang trao đổi về việc đưa vào danh mục hợp tác thêm 01 lĩnh vực mới là trao quyền kinh tế cho phụ nữ.

Để chuẩn bị cho việc xây dựng phương án kết thúc đàm phán nội dung về thương mại và phát triển bền vững trong Hiệp định AANZFTA, Bộ Công Thương xin gửi dự thảo lời văn hiện tại và đề nghị quý Bộ nghiên cứu, cho ý kiến trong phạm vi phụ trách. Article 1

Basic Principles

1. The Parties recall the UN 2030 Agenda for Sustainable Development adopted by the UN General Assembly Resolution 70/1 on 25 September 2015 and its Sustainable Development Goals.

2. The Parties recognise Trade and Sustainable Development as a new area for economic cooperation under this Agreement. The Parties recognise the importance of cooperation as a mechanism to strengthen the Parties' joint and individual efforts and capacities to protect the environment, to collaborate on labour [^AU 2Aug22 NZ and women's economic empowerment] issues as they strengthen their trade and investment relations.

3. The Parties recognise that sustainable development encompasses economic development, social development and environmental protection, all three being interdependent and mutually reinforcing and affirm their desire to promote the development of international trade and investment in a way that contributes to the objective of sustainable development.

4. The Parties respect the sovereign rights of each Party to develop, set, administer and enforce its laws and policies in the area of trade and sustainable development.

5. The Parties [^AU NZ reaffirm] [^ID ^PH: recognise] their commitment to multilateral environmental and labour agreements to which they are individually a Party, as well as the 2030 agenda for sustainable development.

6. The Parties share a common aspiration to promote high standards of environmental and labour protection commensurate with the Parties' respective needs, capabilities and national circumstances and according to respective Parties' laws and regulations; and, to uphold these in the context of sustainable development.

7. The Parties recognise that it is inappropriate to use environmental or labour standards as a disguised means of trade protectionism. The Parties also recognise that weakening or reducing levels of protection in their environmental or labour standards to encourage trade or investment is inappropriate.

Article 2

Co-operation

1. The Parties may engage in economic cooperation activities consistent with Article 1 (Basic Principles) in the area of trade and sustainable development.

2. _Cooperation may be undertaken through ways and means considered appropriate by the Joint Committee.

3. Such economic cooperation may cover topics related to:

a) Climate and environment;

b) Green and blue economy;

c) [^NZ AU: environmentally harmful subsidies]

d) Energy;

e) Labour;

f) Issues under the Sustainable Development Goals; and

g) Any other areas as mutually agreed by the Parties.

Note: all sub-topics or sub-areas of cooperation that have been agreed by all Parties will be reflected in the SOD, for reference in the future.

4. All economic cooperation activities under this Chapter are subject to the availability of funds and human and other resources, and to the applicable laws and regulations of the Parties.

5. Mindful of this, where implementation of this Chapter is inhibited by capacity constraints, the Parties may provide cooperation through the Economic Cooperation Work Programme under Chapter 12 of the Agreement to assist ASEAN Member States with such implementation. Cooperation is subject to trade and sustainable development policy-related needs being identified and the availability of resources, having regards to respective Parties' laws and regulations.

Article 3

Contact Points

To ensure that technical co-operation under this Chapter occurs on an ongoing basis, the Parties shall designate contact points for technical cooperation and information exchange under this Chapter.

Article 4

Non-Application of Chapter 17 (Consultations and Dispute Settlement)

Chapter 17 (Consultations and Dispute Settlement shall not apply to any matter arising under this chapter.
