DECREE
AMENDMENTS TO CERTAIN ARTICLES OF THE
DECREE NO. 87/2024/ND-CP DATED JULY 12, 2024 ON PENALTIES FOR ADMINISTRATIVE
VIOLATIONS AGAINST REGULATIONS ON MANAGEMENT OF PRICES
Pursuant to Law on
Government Organization No. 63/2025/QH15;
Pursuant to Law on
Actions against administrative violations No. 15/2012/QH13 á amended by Law No.
67/2020/QH14 and Law No. 88/2025/QH15;
Pursuant to Law on
Inspection No. 84/2025/QH15;
Pursuant to the Law on
Prices No. 16/2023/QH15, as amended by Law No. 140/2025/QH15;
At the request of the
Minister of Finance;
The Government hereby
promulgates a Decree on amendments to certain Articles of the Decree No.
87/2024/ND-CP dated July 12, 2024 on penalties for administrative violations
against regulations on management of prices.

The phrase "thanh tra
chuyên ngành về giá, kiểm tra việc chấp hành pháp luật về giá, thẩm định giá”
(“specialized price inspection, inspection of compliance with laws on prices
and valuation”) is replaced with the phrase “thanh tra, kiểm tra về giá, thẩm định
giá” (“price inspection and valuation”).
Article
2. Amendments to Article 3
1. Clause 9 is added as
follows:
“The handling of
administrative violations in the electronic environment within the field of price
management shall comply with the provisions of the Law on Handling of
Administrative Violations and its guiding documents; provided the conditions
regarding infrastructure, techniques, and information are ensured.”
2. Clause 10 is added as
follows:
“10. Principles for
determining the competence to impose administrative violations and apply
remedial measures in price management shall comply with the Law on Handling of
Administrative Violations and its guiding documents.”.
3. Clause 11 is added as
follows:
“11. If otherwise
prescribed by Decrees on administrative penalties in other fields of state
management, such regulations shall be applied.”

4. Amendments to Article 27
“Article 27. Competence
of the Inspectorate to impose administrative penalties
2. Heads of the Vietnam
Maritime Inspectorate, the Vietnam Aviation Inspectorate, the Inspectorates of
regional SBV branches or provincial-level Public Security; Heads of
Inspectorates of at the military region level or of the Hanoi Capital Command
shall have the power to impose administrative penalties in the field of prices
as follows:
a) Impose a maximum fine
of up to 75.000.000 dong
b) Apply the remedial
measures prescribed in Clause 7, Article 3 of this Decree.
3. The Chief Inspector of
the Vietnam Maritime Inspectorate; the Chief Inspector of the Vietnam Aviation
Inspectorate; the Chief Inspector of National Defense of military regions; the
Chief Inspector of National Defense of the Hanoi Capital Command; Chief
Inspectors of regional SBV branches; Chief Inspectors of provincial-level
Public Security shall have the power to impose administrative penalties in the
field of prices as follows:
a) Impose a maximum fine
of up to 120.000.000 dong
b) Apply supplementary
penalties prescribed in Point b, Clause 1, Article 3 and remedial measures
prescribed in Clause 7, Article 3 of this Decree.
4. Chief Inspectors of:
Ministry of National Defense, Ministry of Public Security, SBV; Heads of
inspectorates established by Chief Inspectors of Ministry of National
Defense, Ministry of Public Security; SBV shall have the power to impose
administrative penalties in the field of prices as follows:

b) Apply supplementary
penalties prescribed in Point b, Clause 1, Article 3 and remedial measures

5. Amendments to Article 28
“Article 28. Competence
of Heads of agencies performing state
management tasks in price management to impose administrative penalties
1. Heads of Sub-departments
of cropping, plant protection, livestock production, veterinary medicine,
agro-forestry-fisheries quality management, water resources, dikes, and natural
disaster prevention and control under the Department of Agriculture and Rural
Development; Heads of Food Safety Sub-departments; Directors of Regional Radio
Frequency Centers; Heads of Northern Maritime and Waterway Sub-departments; and
Heads of Southern Maritime and Waterway Sub-departments shall have the power to:
a) Impose a maximum fine
of up to 75.000.000 dong;
b) Apply supplementary
penalties prescribed in Point b, Clause 1, Article 3 and remedial measures
prescribed in Clause 7, Article 3 of this Decree.
2. The Director of the
Price Management Department; the Director of the Department of Judicial Support;
the Director of the Department of Judicial Administration; the Director of the
Department for Roads of Vietnam; the Director of the Vietnam Maritime and
Waterway Administration; the Director of the Civil Aviation Authority of
Vietnam; the Director of the Vietnam Railway Authority; the Director of the
Vietnam Register; the Director of the Department of Water Resources
Construction and Management; the Director of the Land Administration
Department; the Director of the Intellectual Property Office of Vietnam; the
Director of the Authority of Radio Frequency Management; the Director of the
Authority of Telecommunications; the Chairperson of the National Commission for
Standards, Metrology and Quality; the Director of the Department of Vocational
Education and Continuing Education; the Director of the Department of Medical
Service Administration; the Director of the Drug Administration of Vietnam; the
Director of the Vietnam Food Administration; the Director of the Vietnam
Population Authority; the Director of the Department of Disease Prevention; the
Director of the Vietnam Industrial Agency; the Director of the Electricity
Regulatory Authority of Vietnam; the Director of the Vietnam Chemicals Agency;
the Director of the Industrial Safety Techniques and Environment Agency; the
Director of the Vietnam E-commerce and Digital Economy Agency; the Chairperson
of the National Competition Commission; the Director of the Authority of Press;
the Director of the Authority of Broadcasting and Electronic Information; the
Director of the Authority of Publication, Printing and Distribution; the
Director of the Department of Overseas Labor; the Director of the Department of
Employment; and Heads of organizations under ministries or ministry-level
agencies assigned to perform examination tasks within the scope of state
management of such ministries or ministry-level agencies shall have the power
to impose administrative penalties as follows:
a) Impose a maximum fine
of up to 150.000.000 dong;
b) Apply supplementary
penalties prescribed in Point b, Clause 1, Article 3 and remedial measures
prescribed in Clause 7, Article 3 of this Decree.

Heads of Inspectorates
established by Ministers or heads of ministerial-level agencies shall have the competence
to impose administrative penalties as prescribed in Clause 2 of this Article.
4. Chairpersons of
People's Committees of communes, wards, or special zones shall have the power
to impose administrative penalties as follows:
a) Impose a maximum fine
of up to 75.000.000 dong;
b) Apply supplementary
penalties prescribed in Point b, Clause 1, Article 3 and remedial measures
prescribed in Clause 7, Article 3 of this Decree.
5. Chairpersons of
People's Committees of provinces shall have the power to impose administrative
penalties as follows:
a) Impose a maximum fine
of up to 150.000.000 dong;
b) Apply supplementary
penalties prescribed in Point b, Clause 1, Article 3 and remedial measures
prescribed in Clause 7, Article 3 of this Decree.
6. Directors of Departments
shall have the power to impose administrative penalties as follows:
a) Impose a maximum fine
of up to 120.000.000 dong;

Article
6. Amendments to Article 29
“Article 29. Competence
of the Market Surveillance Agency to impose administrative penalties
Competent persons of the
market surveillance agency shall have the competence to impose administrative
penalties prescribed in Article 6, Clause 1 of Article 7, Article 8, Article
10, Article 11, Article 13, and Article 15 of this Decree. To be specific:
1. Market surveillance
officers on duty shall have the power to impose a maximum fine of up to 15.000.000
dong.
2. Heads of Market
Surveillance Teams under Market Surveillance Sub-departments of the Department
of Industry and Trade shall have the power to:
a) Impose a maximum fine
of up to 45.000.000 dong;
b) Apply the remedial
measures prescribed in Points a, b, c, d, dd, e, and t, Clause 7, Article 3 of
this Decree.
3. Heads of Market
Surveillance Sub-departments under the Department of Industry and Trade, and
Heads of the Market Surveillance Division under the Department of Domestic
Market Management and Development shall have the power to:
a) Impose a maximum fine
of up to 75.000.000 dong;

4. The Director of the
Department of Domestic Market Management and Development shall have the power
to:
a) Impose a maximum fine
of up to 150.000.000 dong;
b) Apply the remedial
measures prescribed in Points a, b, c, d, dd, e, and t, Clause 7, Article 3 of
this Decree.
Article
7. Amendments to Article 30
“Article 30. Competence
of the People's Public Security forces to impose administrative penalties
1. Public Security
officers on duty shall have the power to impose a maximum fine of up to
15.000.000 dong.
2. Heads of Mobile Police
units at company level shall have the power to:
a) Impose a maximum fine
of up to 30.000.000 dong;
b) Apply the remedial
measures prescribed in Clause 7, Article 3 of this Decree.

Religious Security, Head of the Division of Ethnic Security, Head of the
Division of Counter-Reactionary, Head of the Division of
Counter-Terrorism, Head of the Division of Social Security; Heads of
divisions under the Internal Political Security Department, including: Head of
the Division for Internal Protection of Central CPV and State Agencies, Head of
the Division for Security of Central Judicial, Law-making, and Political-Social
Organizations, Head of the Division for Press and Publication Security, Head of
the Division for Health and Education Security, Head of the Division for
Culture, Sports and Social Labor Security, Head of the Division for Post,
Telecommunications and Information Technology Security, Head of the Division
for State Management on State Secret Protection; Heads of divisions under the
Economic Security Department, including: Head of the Division for Industry and
Trade Security, Head of the Division for Monetary Security, Head of the
Division for Transport and Construction Security, Head of the Division for
Financial and Investment Security, Head of the Division for Agriculture,
Forestry and Fishery Security, Head of the Division for Science, Technology and
Resources, Environment Security; Heads of divisions under the Counter-Narcotics
Police Department, including: Head of the Division for Crime Prevention and

Division for Crime Prevention and Investigation in the Field of Illegal
Production of Narcotics, Head of the Division for Crime Prevention and
Investigation in Legal Activities Related to Narcotics; Heads of divisions
under the Police Department for Administrative Management of Social Order,
including: Head of the Division for Guidance and Management of Weapons,
Explosives, Combat Gears and Explosives, Head of the Division for Guidance and
Management of Investment and Business Sectors with Conditions on Security and
Order and Seals, Director of the National Population Data Center; Heads of
divisions under the Traffic Police Department, including: Head of the Division
for Guidance on Propaganda, Investigation, and Resolution of Traffic Accidents,
Head of the Division for Guidance, Registration, and Inspection of Vehicles,
Head of the Division for Guidance, Training, Testing, and Management of Driving
Licenses, Head of the Division for Guidance on Road and Railway Traffic Patrol
and Control, Head of the Division for Traffic Control and Escort Guidance, Head
of the Division for Guidance on Patrol, Control, and Crime Prevention and
Control on Inland Waterways, Commander of the Water Police Squadron; Heads of
divisions under the Police Department of Fire Prevention, Fighting and Rescue,
including: Head of the Division for Fire Prevention Work, Head of the Division
for Fire Prevention and Fighting Design Review, Head of the Division for
Firefighting and Rescue Work, Head of the Division for Science - Technology
Management and Inspection of Fire Prevention, Fighting and Rescue Vehicles;
Heads of divisions under the Cyber Security and High-Tech Crime Prevention and
Control Department, including: Head of the Division for Prevention and Control
of Crimes Using Cyberspace to Infringe upon Economic Management Order, Head of
the Division for Prevention and Control of Crimes Using Cyberspace to Infringe
upon Social Order, Head of the Division for Cyber Information Security, Head of
the Division for Security Protection of National Information Network Systems,
Head of the Division for Cyber Information Monitoring and Prevention and
Control of Activities Using Cyberspace to Infringe upon National Security;
Heads of divisions under the Immigration Department, including: Head of the
Division for Entry, Exit, and Residence Management of Foreigners, Head of the
Division for Exit and Entry Management of Vietnamese Citizens, Director of the
National Aviation Security Center; Heads of divisions under the National Data
Center, including: Head of the Division for General Staff, Head of the Division
for Application Management, Head of the Division for Data Management, Head of
the Division for System Security and Safety, Head of the Division for Management
and Operation of Information Technology Systems, Head of the Division for
Management and Operation of Data Center Enclosures; Heads of divisions under
the Professional Dossiers Department, including: Director of the Center for
Professional Information and Data of the Ministry of Public Security, Director
of the Center for Receiving and Processing Professional Information, Head of
the Division for Informatics and Management of Professional Dossier Databases;
Regiment-level Commanders of Mobile Police units; Heads of divisions under
provincial-level Police, including: Head of the Homeland Security Division,
Head of the Internal Political Security Division, Head of the Division for
Administrative Management of Social Order, Head of the Criminal Investigation
Division, Head of the Police Division for Investigation of Crimes against
Corruption, Economy, Smuggling, and Environment, Head of the Counter-Narcotics
Police Division, Head of the Traffic Police Division, Head of the Mobile Police
Division, Head of the Police Division for Criminal Judgment Execution and
Judicial Support, Head of the Police Division for Fire Prevention, Fighting and
Rescue, Head of the Division for Cyber Security and High-Tech Crime Prevention
and Control, Head of the Economic Security Division, Head of the Foreign
Security Division, Head of the Professional Dossiers Division, Chief of the
Office of the Investigation Agency under provincial-level Police, and Head of
the Immigration Division under provincial-level Police shall have the power to:

Internal Political Security Department, the Director of the Economic Security
Department, the Chief of the Office of the Investigation Agency under the

Administrative Management of Social Order, the Director of the Criminal
Investigation Department, the Director of the Police Department for
Investigation of Crimes against Corruption, Economy, and Smuggling, the
Director of the Counter-Narcotics Police Department, the Director of the
Traffic Police Department, the Director of the Police Department of Fire
Prevention, Fighting and Rescue, the Director of the Environmental Crime
Prevention and Control Police Department, the Director of the Cyber Security
and High-Tech Crime Prevention and Control Department, the Director of the
Homeland Security Department, the Director of the Police Department for
Management of Detention, Custody and Criminal Judgment Execution in the
Community, the Commander of the Mobile Police, the Director of the National
Data Center, and the Director of the Professional Dossiers Department shall
have the power to:
a) Impose a maximum fine
of up to 150.000.000 dong;
b) Apply supplementary
penalties prescribed in Point b, Clause 1, Article 3 and remedial measures
prescribed in Clause 7, Article 3 of this Decree.”.
Article
8. Implementation clauses
1. This Decree shall come
into force from May 20, 2026.
2. Ministers, Heads of
ministerial-level agencies, Heads of Governmental agencies, Chairpersons of
People's Committees of provinces, and relevant organizations and individuals
shall implement this Decree./.
