DECREE
Amendments to certain
Articles of the Government's Decree No. 67/2023/ND-CP dated September 06, 2023
on compulsory civil liability insurance of motor vehicle owners, compulsory
fire and explosion insurance and compulsory insurance for construction
investment activities
Pursuant to Law on Government
Organization No. 63/2025/QH15;
Pursuant to Law on Construction
No. 135/2025/QH15;
Pursuant to the Law on Insurance
Business No. 08/2022/QH15 amended by Law No. 139/2025/QH15;
At the request of the Minister
of Finance;
The Government hereby promulgates
a Decree on amendments to certain articles of the Government's Decree No. 67/2023/nD-cp dated September 06, 2023 on
compulsory civil liability insurance of motor vehicle owners, compulsory fire
and explosion insurance and compulsory insurance for construction investment
activities.
Article 1.

Project developers shall purchase
compulsory insurance for construction investment activities for the following
construction works:
1. Construction works that have
significant impacts on public safety and the public interest as prescribed by
the law on construction.
2. Construction works that pose a
high risk of causing adverse environmental impacts or pose a risk of causing adverse
environmental impacts as prescribed by the law on environmental protection.
3. Large-scale construction works
involving complex engineering, as prescribed by the law on construction.”
Article 2.
Amendments to Article 33
“Article 33. Minimum sums insured
Minimum sums insured for compulsory
insurance for works in progress refer to the full values of construction works
upon completion, including all building materials, workforce costs, equipment
installed on works, transport costs, taxes, other fees and other items provided
by project developers. The minimum sum insured for a construction work in
progress shall not be less than the total value of the construction contract,
including any adjustments or additions thereto (if any).
The minimum sum insured shall be
prescribed in the Insurance policy. Where the minimum sum insured changes as a
result of an adjustment to the value of the construction work, the policyholder
shall notify the insurer within 05 working days from the date on which the
value of the construction work is adjusted or within such period as agreed in
the insurance policy.”

n) Losses incurred by hard scale
formation such as rust, dregs or other similar phenomena.”
Article 4.
Amendments to Article 37
1. Amendments to point a and point
b Clause 1 Article 37:
“1. Insurance premium and
deductible for a compulsory insurance for works in progress shall be as
follows:
a) For construction works valued at
less than VND 1.000 billion, excluding the installation of building equipment
and technological equipment (hereinafter collectively referred to as “equipment
installation”), or including equipment installation where the value of the
equipment installation accounts for less than 50% of the total value of the
insured construction work item: The insurance premium rates and deductibles
shall be those specified in Section I, Clause 1 of Appendix III enclosed
herewith.
b) For construction works valued at
less than VND 1.000 billion, including equipment installation where the value
of the equipment installation accounts for 50% or more of the total value of
the insured construction work item: The insurance premium rates and deductibles
shall be those specified in Section II, Clause 1 of Appendix III enclosed
herewith."
2. Amendments to Clause 2 of
Article 37:
“2. For construction works that are
prescribed in Point a, Point b Clause 1 of this Article:
The insurer shall determine any
increase or decrease in the insurance premium, not exceeding 25% of the
applicable premium, based on the level of risk of the insured entity.

3. Addition of Clause 2a after
Clause 2 of Article 37:
"2a. The insurer shall not
reduce the premium below the premium rates prescribed in Appendix III to this
Decree for construction works in the following cases:
a) Construction works located in
provinces or cities classified as areas at risk of flash floods, landslides,
land subsidence caused by heavy rain or water flows, in accordance with the
regulations on natural disaster forecasting, warning, information transmission
and natural disaster risk levels;
b) Where the insurer has incurred a
net underwriting loss in its property insurance business for 03 consecutive
financial years, as determined under Form No. 3 in Appendix X to this Decree.
4. Amendments to Point d Clause 1
Article 37:
“d) For nuclear power plants and
construction works not specified at Points a, b and c of this Clause:
The insurer and policyholder may
reach an agreement on the insurance terms and conditions, insurance premiums
and deductibles, provided that documentary evidence is available showing that
the lead foreign reinsurer has confirmed its acceptance of the reinsurance on
the same insurance terms and conditions, insurance premiums and deductibles as
those offered by the insurer to the policyholder. The lead foreign
reinsurer and any foreign reinsurer assuming reinsurance amounting to 10% or
more of the total liability under each reinsurance policy shall satisfy the
requirements specified in Clause 9, Article 4 of this Decree.”

2. Where compulsory insurance is
purchased for the construction work in progress, the project developer shall
purchase insurance with the minimum sum insured as prescribed in Article 33 of
this Decree.
3. Where compulsory insurance is purchased
separately for each construction work item in progress, the project developer
shall ensure that the sum insured for each construction work item is not less
than its full value upon completion, and that the aggregate sum insured for all
construction work items in progress is not less than the minimum sum insured
prescribed in Article 33 of this Decree.
4. For a construction work
comprising multiple construction work items, the project developer shall
provide information on the value of each construction work item to serve as the
basis for determining the corresponding insurance premium rate in accordance
with Appendix III to this Decree.
Article 6.
Amendments to Article 45
Addition of Clause 3 and Clause 4
after Clause 2 Article 45:
“3. Where the construction period
and the warranty period is extended beyond the period specified in the
investment decision issued by the competent authority at the time of conclusion
of the insurance policy, the policyholder and the insurer shall reach an
agreement on the insurance premium applicable to the extended period.
The insurance premium applicable to
the extended period shall be calculated on the basis of the insurance premium
under the compulsory professional liability insurance contract for construction
consultancy at the time of conclusion of the insurance contract and the ratio
of the extended period to the term of the compulsory professional liability
insurance contract at the time of its conclusion.
4. Survey consultancy contractors
and construction design consultancy contractors shall provide information on
the value of the construction work referred to in Clauses 1 and 2 of this
Article for the purpose of determining the applicable insurance premium rate.
The project developer shall cooperate in providing such information to the
construction consultancy contractors.”

enclosed herewith.

1. Replacing the phrase “third
person” with the phrase “third party” in Clause 5, Article 3; Article 5; Point
a, Clause 1, Article 7; Point dd, Clause 2, Article 10; Clause 2 and Point a,
Clause 6, Article 12; Clause 5, Article 13; Article 41; Clause 1 and Point dd,
Clause 2, Article 43; Clauses 1, 3 and 4, Article 46; Clause 3, Article 47; Articles

2. Replacing the phrase
“construction investment activities” with the phrase “construction activities”

the phrase “compulsory professional liability insurance for construction
consultancy” in the title of Section 2, Chapter IV; Articles 41, 44 and 47;
Clause 1, Article 45; and Appendix IV.
4. Replacing the phrase “in
accordance with Article 47 of Decree No. 06/2021/ND-CP dated 26 January 2021 of
the Government elaborating certain provisions on quality management,
construction execution and maintenance of construction works” with “in
accordance with the law on quality management, construction execution and
maintenance of construction works” in Point a, Clause 3, Article 40; Point a,
Clause 5, Article 47; and Point a, Clause 5, Article 60.

1. This Decree comes into force
from July 01, 2026.
2. Insurance policies concluded
before the effective date of this Decree that remain in force shall continue to
be performed in accordance with the terms and conditions agreed therein, unless
the parties to the insurance policy reaches an agreement on amendments or
supplements to the policy, in which case such amendments or supplements shall
comply with the provisions of this Decree.
3. For projects covered by a
Government Guarantee that contains a stabilization clause, the provisions of
the Government Guarantee and Undertaking Agreement shall apply.

Insurance premiums and
deductibles shall be determined in accordance with the provisions of point d
clause 1 Article 37 of Decree No. 67/2023/ND-CP.
Notes:

deductibles specified in Point b Clause 1 Section II of this Appendix.
b) Deductibles:
Deductibles for works specified in
Clause 1 Section II of this Appendix shall be applied according to the
provisions of Point b Clause 1 Section I of this Appendix.
2. For a construction work with a
value of VND 1.000 billion or higher as prescribed in Clause 1 Section II of
this Appendix: the provisions of Point c Clause 1 Article 37 of this Decree
shall apply. In all cases, the deductible shall not be lower than the
insurance deductible prescribed in Point b Clause 1, Section I of this
Appendix.
3. For construction works which are
not specified in Clause 1 and Clause 2 Section II of this Appendix: the provisions
of Point d Clause 1 Article 37 of this Decree shall apply. In all cases,
the deductible shall not be lower than the insurance deductible prescribed in
Point b Clause 1, Section I of this Appendix.
