QUY ĐỊNH DANH MỤC MUA SẮM TẬP TRUNG CẤP QUỐC GIA ĐỐI VỚI THUỐC

Căn cứ Luật Đấu thầu số 22/2023/QH15 ngày 23 tháng 06 năm 2023;

Căn cứ Nghị định số 24/2024/NĐ-CP ngày 27 tháng 02 năm 2024 của Chính phủ quy định chi tiết một số điều và biện pháp thi hành Luật Đấu thầu về lựa chọn nhà thầu;

Căn cứ Nghị định số 95/2022/NĐ-CP ngày 15 tháng 11 năm 2022 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Y tế;

Theo đề nghị của Vụ trưởng Vụ Kế hoạch - Tài chính; Cục trưởng Cục Quản lý Dược;

Bộ trưởng Bộ Y tế ban hành Thông tư quy định danh mục mua sắm tập trung cấp quốc gia đối với thuốc.

Điều 1. Phạm vi điều chỉnh

Thông tư này quy định nguyên tắc, tiêu chí xây dựng và danh mục mua sắm tập trung cấp quốc gia đối với thuốc.

Điều 2. Nguyên tắc, tiêu chí xây dựng danh mục mua sắm tập trung cấp quốc gia đối với thuốc

Thuốc đưa vào danh mục phải đáp ứng tất cả các nguyên tắc, tiêu chí sau đây:

1. Thuốc mua sắm với số lượng lớn, chủng loại tương tự ở một hoặc nhiều cơ quan, tổ chức, đơn vị.

2. Thuốc có chủng loại tương tự là thuốc có ít nhất đồng thời từ 03 giấy đăng ký lưu hành của ít nhất 03 cơ sở sản xuất đáp ứng tiêu chuẩn kỹ thuật nhóm 1, nhóm 2 theo quy định về đấu thầu thuốc tại cơ sở y tế công lập do Bộ trưởng Bộ Y tế ban hành.

Điều 3. Danh mục mua sắm tập trung cấp quốc gia đối với thuốc

Danh mục mua sắm tập trung cấp quốc gia đối với thuốc được quy định tại Phụ lục ban hành kèm theo Thông tư này.

Điều 4. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 20 tháng 4 năm 2024.

2. Thông tư số 15/2020/TT-BYT ngày 10 tháng 8 năm 2020 của Bộ Y tế ban hành Danh mục thuốc đấu thầu, Danh mục thuốc đấu thầu tập trung, Danh mục thuốc được áp dụng hình thức đàm phán giá và Điều 2 Thông tư số 15/2022/TT-BYT ngày 09 tháng 12 năm 2022 của Bộ trưởng Bộ Y tế sửa đổi, bổ sung một số điều và Phụ lục tại Thông tư số 03/2019/TT-BYT ngày 28 tháng 3 năm 2019 của Bộ trưởng Bộ Y tế ban hành Danh mục thuốc sản xuất trong nước đáp ứng yêu cầu về điều trị, giá thuốc và khả năng cung cấp và Thông tư số 15/2020/TT-BYT ngày 10 tháng 8 năm 2020 của Bộ trưởng Bộ Y tế ban hành Danh mục thuốc đấu thầu, Danh mục thuốc đấu thầu tập trung, Danh mục thuốc được áp dụng hình thức đàm phán giá hết hiệu lực kể từ ngày Thông tư này có hiệu lực thi hành.

Điều 5. Tổ chức thực hiện

1. Đơn vị được giao nhiệm vụ mua sắm tập trung cấp quốc gia có trách nhiệm:

a) Thực hiện mua sắm tập trung cấp quốc gia đối với thuốc thuộc Danh mục thuốc mua sắm tập trung cấp quốc gia ban hành kèm theo Thông tư này;

b) Có văn bản thông báo:

- Về danh mục các thuốc dự kiến tổ chức mua sắm tập trung cấp quốc gia của kỳ đấu thầu tập trung cấp quốc gia tiếp theo trước ngày 15 tháng 3 của năm thông báo;

- Về việc chưa hoặc không có kết quả lựa chọn nhà thầu trong thời gian tối đa 20 ngày kể từ ngày có văn bản xác định chưa hoặc không lựa chọn được nhà thầu.

2. Các đơn vị, địa phương có trách nhiệm chủ động tổ chức lựa chọn nhà thầu mua thuốc theo quy định của pháp luật trên cơ sở thông báo của Đơn vị được giao nhiệm vụ mua sắm tập trung cấp quốc gia quy định tại điểm b khoản 1 Điều này.

3. Trong thời gian tối đa 02 năm, căn cứ tình hình thực tiễn và nguyên tắc, tiêu chí xây dựng danh mục quy định tại Điều 2 Thông tư này, Bộ Y tế sửa đổi, bổ sung danh mục mua sắm tập trung cấp quốc gia đối với thuốc.

Điều 6. Trách nhiệm thi hành

Chánh Văn phòng Bộ, Vụ trưởng Vụ Kế hoạch - Tài chính, Cục trưởng Cục Quản lý Dược, Thủ trưởng đơn vị được giao nhiệm vụ mua sắm tập trung cấp quốc gia, Thủ trưởng các đơn vị và các cơ quan, tổ chức cá nhân khác có liên quan chịu trách nhiệm thi hành Thông tư này.

Trong quá trình thực hiện, nếu có vướng mắc, đề nghị các cơ quan, tổ chức, cá nhân kịp thời phản ánh về Bộ Y tế để xem xét, giải quyết./.

Ghi chú:

1. Về cách ghi tên hoạt chất của thuốc:

- Thuốc có cách ghi danh pháp khác với cách ghi tên hoạt chất tại Cột (2) và cách ghi này được ghi tại các tài liệu chuyên ngành về dược (như Dược điển, Dược thư Quốc gia và các tài liệu khác) thì vẫn thuộc danh mục (Ví dụ: Paracetamol hay Acetaminophen; Acyclovir hay Aciclovir; Cefuroxime hoặc Cefuroxim; Sodium hay Natri; Hydrochloride hoặc Hydroclorid ...).

- Trường hợp hoạt chất tại Cột (2) không ghi gốc muối thì các thuốc có dạng muối khác nhau của hoạt chất này sau khi quy đổi về dạng base có cùng nồng độ - hàm lượng tại Cột (3) (nếu có cùng chỉ định, liều điều trị) thì vẫn thuộc danh mục.

2. Việc dự thầu của thuốc có dạng bào chế khác với dạng bào chế ghi tại Cột (4) thực hiện theo quy định về đấu thầu thuốc.

3. Đối với dạng bào chế của thuốc ghi tại Cột (4):

- Dạng bào chế “Viên”, “Thuốc tiêm” ghi tại Cột 4 là các dạng bào chế quy ước (Thuốc viên: Viên nén, Viên nang; Thuốc tiêm: Dung dịch tiêm, Hỗn dịch tiêm, Nhũ tương dùng đường tiêm).

- Các đơn vị, cơ sở y tế được xây dựng kế hoạch lựa chọn nhà thầu đối với các thuốc có dạng bào chế đặc biệt hoặc thuốc có sinh khả dụng khác với dạng bào chế quy ước (Ví dụ: Viên bao tan ở ruột, Viên giải phóng có kiểm soát, Viên hòa tan nhanh, Viên sủi, Viên đặt dưới lưỡi; Thuốc tiêm đông khô, Thuốc tiêm liposome/nano/phức hợp lipid, Thuốc tiêm nhãn cầu, Thuốc tiêm tác dụng kéo dài, Thuốc tiêm định liều đóng sẵn trong dụng cụ tiêm ...).

CIRCULAR

PRESCRIBING LIST OF DRUGS PROCURED THROUGH NATIONAL CENTRALIZED PROCUREMENT

Pursuant to the Law on Bidding No. 22/2023/QH15 dated June 23, 2023;

Pursuant to the Government’s Decree No. 24/2024/ND-CP dated February 27, 2024 on elaboration of and measures for implementation of the Bidding Law regarding contractor selection;

Pursuant to the Government’s Decree No. 95/2022/ND-CP dated November 15, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Health;

At the request of the Director General of the Department of Planning and Finance; the Director General of the Drug Administration of Vietnam;

The Minister of Health hereby promulgates a Circular prescribing the list of drugs procured through national centralized procurement.

Article 1. Scope

Article 2. Rules and criteria for compiling the list of drugs procured through national centralized procurement

A drug to be included in the list must fully adhere to the rules and criteria below:

1. The drug is procured in a large quantity and is of a similar category to serve demands of one or more authorities, organizations and units.

2. Drug of a similar category is a drug that is granted at least 03 marketing authorizations by at least 03 manufacturers and meets group 1 and group 2 technical standards according to the regulations on bidding for supply of drugs to public health facilities issued by the Minister of Health.

Article 3. List of drugs procured through national centralized procurement

The list of drugs procured through national centralized procurement is specified in the Appendix to this Circular.

Article 4. Effect

1. This Circular comes into force from April 20, 2024.

2. The Circular No. 15/2020/TT-BYT dated August 10, 2020 of the Ministry of Health promulgating the List of drugs procured through bidding, List of drugs procured through centralized bidding, and List of drugs procured through price negotiation and Article 2 of the Circular No. 15/2022/TT-BYT dated December 09, 2022 of the Minister of Health amending certain Articles and Appendices of the Circular No. 03/2019/TT-BYT dated March 28, 2019 of the Minister of Health promulgating list of domestically manufactured drugs meeting treatment requirements, drug prices and availability and Circular No. 15/2020/TT-BYT dated August 10, 2020 of the Ministry of Health promulgating the List of drugs procured through bidding, List of drugs procured through centralized bidding, and List of drugs procured through price negotiation shall cease to have effect from the effective date of this Circular.

1. The unit assigned to organize national centralized procurement shall:

a) procure drugs on the list of drugs procured through national centralized procurement enclosed with this Circular through national centralized procurement;

b) issue a notification of:

- The list of drugs expected to be procured through national centralized procurement in the next period of national centralized procurement before March 15 of the year of notification;

- Availability or unavailability of the supplier selection result within 20 days from the date of obtaining a written confirmation that a supplier is yet to be selected or fails to be selected.

2. Units and local authorities shall proactively select drug suppliers as prescribed by law according to the notification issued by the unit assigned to organize national centralized procurement as specified in point b clause 1 of this Article.

3. Within 02 years, the Ministry of Health shall, according to current situation, rules and criteria for compiling the list specified in Article 2 of this Circular, amend the list of drugs procured through national centralized procurement.

Article 6. Responsibility for implementation

Chief of the Ministry Office, Director General of Department of Planning and Finance, Director General of Drug Administration of Vietnam, head of unit assigned to organize national centralized procurement, heads of other units, agencies, organizations and individuals concerned are responsible for the implementation of this Circular.

Note:

1. Regarding names of active ingredients of drugs:

...

...

...

- If the salt base of an active ingredient in Column (2) is not specified, different salts of this active ingredient, after being converted into bases with the same concentrations and content in Column (3) (with the same indications and dosage) still belong to the list.

2. The bidding for a drug whose dosage form is different from that written in Column (4) shall comply with regulations on drug bidding.

3. Regarding dosage forms written in Column (4):

- Dosage forms “Tablets/capsules”, “Injections” written in Column 4 are conventional dosage forms (Pills: Tablets, Capsules; Injections: Solution for injection, Suspension for injection, Emulsion for injection).

- Procuring units and health facilities are permitted to develop their own supplier selection plans in which bidding documents and request for proposals permit bidders to offer imported drugs with special dosage forms or drugs with bioavailability that is different from conventional dosage forms (E.g. Enteric-coated tablets/capsules, Controlled-release tablets/capsules, Fast disintegrating tablets/capsules, Effervescent tablets, Sublingual tablets; Lyophilized injections, Liposomal/nano/lipid complex injections, Intraocular injections, Long-acting injections, Metered-dose injection applicators, etc.).
