BAN HÀNH DANH MỤC THUỐC BẢO VỆ THỰC VẬT ĐƯỢC PHÉP SỬ DỤNG, CẤM SỬ DỤNG Ở VIỆT NAM VÀ CÔNG BỐ MÃ HS ĐỐI VỚI THUỐC BẢO VỆ THỰC VẬT ĐƯỢC PHÉP SỬ DỤNG, CẤM SỬ DỤNG Ở VIỆT NAM.

Căn cứ Nghị định số 199/2013/NĐ-CP ngày 26 tháng 11 năm 2013 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn;

Căn cứ Luật Bảo vệ và kiểm dịch thực vật số 41/2013/QH13 ngày 25 tháng 11 năm 2013;

Căn cứ Nghị định 187/2013/NĐ-CP ngày 20 tháng 11 năm 2013 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hóa quốc tế và các hoạt động đại lý mua, bán, gia công và quá cảnh hàng hóa với nước ngoài;

Căn cứ Thông tư số 156/2011/TT-BTC ngày 14 tháng 11 năm 2011 của Bộ trưởng Bộ Tài chính về việc ban hành danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam;

Căn cứ Thông tư số 164/2013/TT-BTC ngày 15 tháng 11 năm 2013 của Bộ Tài chính ban hành Biểu thuế xuất khẩu, biểu thuế nhập khẩu ưu đãi theo danh mục mặt hàng chịu thuế;

Theo đề nghị của Cục trưởng Cục Bảo vệ thực vật;

Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Thông tư Danh mục thuốc bảo vệ thực vật được phép sử dụng, cấm sử dụng ở Việt Nam và công bố mã HS đối với thuốc bảo vệ thực vật được phép sử dụng, cấm sử dụng ở Việt Nam.

Điều 1. Ban hành kèm theo Thông tư này:

1. Danh mục thuốc bảo vệ thực vật được phép sử dụng ở Việt Nam, Phụ lục I kèm theo Thông tư này, gồm:

a) Thuốc sử dụng trong Nông nghiệp:

- Thuốc trừ sâu: 769 hoạt chất với 1690 tên thương phẩm.

- Thuốc trừ bệnh: 607 hoạt chất với 1295 tên thương phẩm.

- Thuốc trừ cỏ: 223 hoạt chất với 678 tên thương phẩm.

- Thuốc trừ chuột: 10 hoạt chất với 26 tên thương phẩm.

- Thuốc điều hòa sinh trưởng: 51 hoạt chất với 143 tên thương phẩm.

- Chất dẫn dụ côn trùng: 8 hoạt chất với 9 tên thương phẩm.

- Thuốc trừ ốc: 26 hoạt chất với 141 tên thương phẩm.

- Chất hỗ trợ (chất trải): 5 hoạt chất với 6 tên thương phẩm.

b) Thuốc trừ mối: 15 hoạt chất với 21 tên thương phẩm.

c) Thuốc bảo quản lâm sản: 11 hoạt chất với 13 tên thương phẩm.

d) Thuốc khử trùng kho: 5 hoạt chất với 10 tên thương phẩm.

đ) Thuốc sử dụng cho sân golf:

- Thuốc trừ sâu: 1 hoạt chất với 1 tên thương phẩm.

- Thuốc trừ bệnh: 3 hoạt chất với 3 tên thương phẩm.

- Thuốc trừ cỏ: 1 hoạt chất với 1 tên thương phẩm.

- Thuốc điều hòa sinh trưởng: 1 hoạt chất với 1 tên thương phẩm.

e) Thuốc xử lý hạt giống.

- Thuốc trừ sâu: 12 hoạt chất với 16 tên thương phẩm.

- Thuốc trừ bệnh: 10 hoạt chất với 11 tên thương phẩm.

2. Danh mục thuốc bảo vệ thực vật cấm sử dụng ở Việt Nam, Phụ lục II kèm theo Thông tư này, gồm:

a) Thuốc trừ sâu, thuốc bảo quản lâm sản: 21 hoạt chất.

b) Thuốc trừ bệnh: 6 hoạt chất.

c) Thuốc trừ chuột: 1 hoạt chất.

d) Thuốc trừ cỏ: 1 hoạt chất.

3. Bảng chi tiết mã HS thuốc bảo vệ thực vật được phép sử dụng ở Việt Nam, Phụ lục III ban hành kèm theo Thông tư này.

Điều 2. Mã số HS thuốc bảo vệ thực vật

1. Mã số HS đối với thuốc bảo vệ thực vật thành phẩm trong Danh mục thuốc bảo vệ thực vật được phép sử dụng ở Việt Nam (ghi tại cột thứ 4-Tên thương phẩm) theo Danh mục tại Phụ lục I kèm theo Thông tư này, được phân loại thuộc nhóm 3808 và chi tiết tại Phụ lục III của Thông tư này.

2. Mã số HS đối với thuốc bảo vệ thực vật kỹ thuật (chế phẩm trung gian để sản xuất thuốc bảo vệ thực vật) được phép sử dụng ở Việt Nam (ghi tại cột thứ 3-Tên hoạt chất, nguyên liệu) theo Danh mục tại Phụ lục I kèm theo Thông tư này, được phân loại thuộc nhóm 3808 và chi tiết tại Phụ lục III của Thông tư này.

Việc phân loại căn cứ theo bản chất hàng hóa và nguyên tắc phân loại hàng hóa của cơ quan hải quan. Trong trường hợp thuốc bảo vệ thực vật kỹ thuật được phân loại khác nhóm 3808 thì áp dụng theo kết luận của cơ quan hải quan nhưng vẫn chịu sự điều chỉnh về chính sách quản lý của Bộ Nông nghiệp và Phát triển nông thôn.

3. Mã số HS đối với thuốc bảo vệ thực vật kỹ thuật trong Danh mục thuốc bảo vệ thực vật cấm sử dụng ở Việt Nam (ghi tại cột thứ 3-Tên chung) được phân loại chi tiết tại cột thứ 2; Mã số HS đối với thuốc bảo vệ thành phẩm trong Danh mục thuốc bảo vệ thực vật cấm sử dụng ở Việt (ghi tại cột thứ 5-Tên thương phẩm) được phân loại chi tiết tại cột thứ 4 theo Danh mục tại Phụ lục II kèm theo Thông tư này.

Điều 3. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 15 tháng 3 năm 2015.

2. Thông tư này thay thế các Thông tư và Quyết định sau:

a) Thông tư số 21/2013/TT-BNNPTNT ngày 17/4/2013 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc ban hành Danh mục thuốc bảo vệ thực vật được phép sử dụng, hạn chế sử dụng, cấm sử dụng ở Việt Nam;

b) Thông tư số 37/2013/TT-BNNPTNT ngày 2/8/2013 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về sửa đổi, bổ sung một số điều của Thông tư số 21/2013/TT-BNNPTNT ngày 17/4/2013 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục thuốc bảo vệ thực vật được phép sử dụng, hạn chế sử dụng, cấm sử dụng ở Việt Nam;

c) Quyết định số 55/2007/QĐ-BNN ngày 12/6/2007 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc công bố mã số HS thuốc BVTV xuất khẩu, nhập khẩu ở Việt Nam.

Điều 4. Trách nhiệm thi hành

Chánh Văn phòng Bộ, Vụ trưởng Vụ Pháp chế, Cục trưởng Cục Bảo vệ thực vật, Thủ trưởng các đơn vị thuộc Bộ và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này./.

CIRCULAR

INTRODUCING THE LIST OF PESTICIDES PERMITTED OR PROHIBITED IN VIETNAM AND DECLARING HS CODES FOR PESTICIDES PERMITTED OR PROHIBITED IN VIETNAM

Pursuant to the Government’s Decree No. 199/2013/NĐ-CP dated November 26, 2013 on defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Law on Plant Protection and Quarantine No. 41/2013/QH13 dated November 25, 2013;

Pursuant to the Government’s Decree No. 187/2013/NĐ-CP dated November 20, 2013 on providing specific provisions on implementation of the Law on Commerce on international commodity trading operations and operations of commodity buying, selling, processing and transiting agents in association with foreign partners;

Pursuant to the Circular No. 156/2011/TT-BTC of the Minister of Finance dated November 14, 2011 on introduction of the list of imported and exported goods in Vietnam;

Pursuant to the Circular No. 164/2013/TT-BTC of the Minister of Finance dated November 15, 2013 on introduction of the export tax schedule and import incentive tax schedule following the list of taxable commodities;

After considering the request of the Director of Plant Protection Department;

Article 1. The following lists are annexed to this Circular:

1. The list of pesticides permitted in Vietnam given in the Appendix I enclosed herewith, including:

a) Pesticides used in agriculture:

- Pest control products: 769 active ingredients and 1690 commercial names.

- Disease control products: 607 active ingredients and 1295 commercial names.

- Herbicide: 223 active ingredients and 678 commercial names.

- Rodenticides: 10 active ingredients and 26 commercial names.

- Plant-growth regulators: 51 active ingredients and 143 commercial names.

- Insect attractants: 8 active ingredients and 9 commercial names.

- Inert substances (spreaders): 5 active ingredients and 6 commercial names.

b) Termiticides: 15 active ingredients and 21 commercial names.

c) Forestry product preservatives: 11 active ingredients and 13 commercial names.

d) Warehouse disinfectants: 5 active ingredients and 10 commercial names.

dd) Pesticides used on gold courses:

- Pest control products: 1 active ingredient and 1 commercial name.

- Disease control products: 3 active ingredients and 3 commercial names.

- Herbicide: 1 active ingredient and 1 commercial name.

- Growth regulators: 1 active ingredient and 1 commercial name.

- Disease control product: 10 active ingredients and 11 commercial names.

2. The list of pesticides prohibited in Vietnam given in the Appendix II enclosed herewith, including:

a) Pest control products, forestry product preservatives: 11 active ingredients.

b) Disease control products: 6 active ingredients.

c) Raticide: 1 active ingredient.

d) Herbicides: 1 active ingredient.

3. The detailed table of HS codes of pesticides permitted in Vietnam given in the Appendix III enclosed herewith.

Article 2. Pesticide HS codes

2. The HS code heading of technical pesticides (intermediate preparations for the manufacture of pesticides) defined in the list of pesticides permitted in Vietnam (at the 3^rd column – Name of active ingredients and raw materials) according to the list given in the Appendix I enclosed herewith shall be numbered 3808 and described in detail in the Appendix III enclosed herewith.

This classification is based on the characteristics of products and the commodity classification principles laid down by the customs authority. In the event that technical pesticides are classified by any heading other than the heading 3808, the classification shall be subject to the customs authority's resolution but still be governed by the management policy of the Ministry of Agriculture and Rural Development.

3. HS codes of technical pesticides defined in the list of pesticides prohibited in Vietnam (at the 3^rd column – Generic name) shall be classified in detail at the 2^nd column; HS codes of formulated pesticides defined in the list of pesticides prohibited in Vietnam (at the 5^th column – Commercial name) shall be classified in detail at the 4^th column according to the list given in the Appendix II enclosed herewith.

Article 3. Effect

1. This Circular shall come into force from March 15, 2015.

2. This Circular shall replace the followings:

a) The Circular No. 21/2013/TT-BNNPTNT of the Minister of Agriculture and Rural Development dated April 17, 2013 on introducing the list of pesticides permitted, restricted or prohibited in Vietnam;

b) The Circular No. 37/2013/TT-BNNPTNT of the Minister of Agriculture and Rural Development dated August 2, 2013 on amending and supplementing several articles of the Circular No. 21/2013/TT-BNNPTNT of the Minister of Agriculture and Rural Development dated April 17, 2013 on introducing the list of pesticides permitted, restricted or prohibited in Vietnam;

c) The Decision No. 55/2007/QĐ-BNN of the Minister of Agriculture and Rural Development dated June 12, 2007 on declaring HS codes of exported and imported pesticides in Vietnam.

The Chief of Office of the Ministry, the Director of the Department of Legal Affairs, the Director of the Plant Protection Department and the Heads of affiliates of the Ministry as well as other related organizations or individuals shall be responsible for implementing this Circular./.
