DECISION
ON THE
ESTABLISHMENT OF THE STEERING COMMITTEE FOR THE RICE EXPORT AND FERTILIZER
IMPORT MANAGEMENT
THE PRIME MINISTER
Pursuant
to the Law on Organization of the Government of September 30, 1992;
In order to assist the Prime Minister in managing the rice export and
fertilizer import activities in accordance with Decision No.12/1998/QD-TTg of
January 23, 1998,
DECIDES:
Article 1.-
To establish the Steering Committee for the rice export and fertilizer import
management (hereafter referred to as the Steering Committee).
Article 2.-
The contents of operation of the Steering Committee are defined in the
"Regulation on operation of the Steering Committee for the 1998-1999 rice
export and fertilizer import management" issued together with this
Decision.
Article 3.-
This Decision takes effect from the date of its signing to the end of March 31,
1999. The ministers, the heads of the ministerial-level agencies, the heads of
the agencies attached to the Government and the presidents of the People's
Committees of the provinces and cities directly under the Central Government
shall have to implement this Decision.

THE REGULATION
ON OPERATION OF
THE STEERING COMMITTEE FOR THE 1998-1999 RICE EXPORT AND FERTILIZER IMPORT
MANAGEMENT
(Issued together with Decision
No.39/1998/QD-TTg of February 18, 1998)
To step by step overcome limitations and settle
in time problems arising in rice export and fertilizer import business
activities, the Steering Committee for the rice export and fertilizer import
management (hereafter referred to as the Steering Committee) is now established
with the following composition and principal tasks:
I.
REGARDING THE RICE EXPORT MANAGEMENT
1. On the basis of quotas approved by the Prime
Minister and allocated by the Minister of Trade under Decision No.89/TM-XNK of
January 26, 1998, to oversee the signing of contracts and goods delivery tempo
suitable to the domestic and foreign market situation, and ensure the national
food security and efficient export.

3. To monitor the rice price fluctuation on the
world's market so as to formulate and announce every 10 days the guiding price
bracket for export rice of various kinds in compatibility with the rice prices
in the country.
4. To supervise and urge the designated
enterprises to strictly abide by the Prime Minister's direction regarding the
purchase of commercial rice from farmers.
To guide the enterprises in implementing
regulations on rice export under Decision No.12/1998/QD-TTg of January 23, 1998
of the Prime Minister; to handle or propose the Prime Minister to handle
according to law enterprises which violate such regulations.
5. To adjust and allocate quotas to the
designated enterprises taking part in the performance of rice contracts signed
under the Government's agreements in cases of necessity.
6. To propose the presidents of the People's
Committees of provinces and cities to adjust quotas among the enterprises
attached to such provinces and cities and the Minister of Trade to adjust quotas
among the enterprises and provinces which are allocated quotas under Decision
No.89/TM-XNK of January 26, 1998 of the Ministry of Trade, with a view to
ensuring the common interests of the State and the enterprises conducting rice
export with efficiency.
II.
REGARDING THE FERTILIZER IMPORT MANAGEMENT
1. On the basis of import quotas of fertilizers
of various kinds approved by the Prime Minister and allocated by the Minister
of Trade under Decision No.89/TM-XNK of January 26, 1998, to monitor and urge
the importing enterprises to import fertilizers in time, with right quantities
and types and to the prescribed areas.
2. To determine the volume of fertilizers in
stock at the end of each crop so as to guide and urge the signing of contracts
and import of fertilizers for the next crop, with a view to ensuring the
demand-supple balance in each area.
3. To monitor the fertilizer price fluctuation
on the world's market and announce every 10 days the prices of fertilizers of
various kinds imported from various regions in order to guide enterprises for
timely and efficient import.

5. To propose the presidents of the People's
Committees of provinces and cities to adjust the import quotas among the
enterprises under such provinces and cities and recommend the Minister of Trade
to adjust the import quotas among the enterprises and provinces allocated
quotas under Decision No.89/TM-XNK of January 26, 1998 of the Ministry of
Trade, with a view to ensuring the common interests of the State and the
enterprises conducting fertilizer import with efficiency.
6. To handle problems arising in the import of
fertilizers by means of setting up regular reserve storehouses permitted by the
Prime Minister in Decision No.12/1998/QD-TTg of January 23, 1998.
III. THE
COMPOSITION OF THE STEERING COMMITTEE
The Steering Committee for rice export and
fertilizer import management shall include:
1. Mr. Nguyen Xuan Quang, Vice Minister of
Trade, as its Chairman.
2. The Vice-Presidents of the People's Committee
of An Giang, Dong Thap, Tien Giang, Kien Giang and Can Tho provinces, as its
members.
3. The President of the Vietnam Food
Exporters'-Importers' Association, as its member.
4. The Ministry of Agriculture and Rural
Development, the Ministry of Finance, the State Bank of Vietnam, the Government
Office, the Government Pricing Committee and the General Department of Customs,
each shall appoint one departmental-level official as member.
5. The Steering Committee shall set up its
Standing Management Group which shall work at the Office of the Ministry of
Trade in Ho Chi Minh City and assist the Steering Committee in solving daily
matters arising in rice export and fertilizer import management. The head of
the Standing Management Group shall have to report the latest situation to the
Chairman of the Steering Committee and the Committee's provincial members.

1. The members of the Steering Committee shall
work on the principle of democratic discussion to consider and handle or
propose the concerned agencies to handle matters related to the rice export and
fertilizer import.
There must be a resolution on each meeting of
the Steering Committee, which is adopted by its members.
2. The members of the Steering Committee shall
have to perform tasks assigned to them and set forth in resolutions of the
meetings.
V. THE
MEETING AND REPORTING REGIME
1. The Steering Committee shall regularly meet
once in every quarter in the first month of the quarter (extraordinary meetings
shall be convened in cases of necessity) to evaluate the performance by
enterprises, set forth the operation orientation and at the same time handle
arising matters. In cases of matters that are beyond the handling capacity of
the Committee and beyond the competence of the concerned ministries and
branches, the Chairman of the Committee shall report them to the Prime Minister
for direction.
2. Every month, the Chairman of the Steering
Committee shall report to the Prime Minister the rice export and fertilizer
import situation and arising problems related to the management mechanism and
beyond the scope of Decision No.12/1998/QD-TTg of January 23, 1998 of the Prime
Minister.
