DECISION

PROMULGATION OF THE LIST OF WASTE PERMITTED FOR IMPORT AS PRODUCTION MATERIALS

Pursuant to the Law on Governmental Organization dated June 19, 2015; Law on amendments to the Law on Governmental Organization and the Law on Local Government Organization dated November 22, 2019;

Pursuant to the Law on Environmental Protection dated November 17, 2020;

Pursuant to Decree No. 08/2022/ND-CP dated January 10, 2022 of the Government elaborating certain Articles of the Law on Environment Protection;

At the request of the Minister of Natural Resources and Environment;

The Prime Minister hereby promulgates a Decision on the list of waste permitted for import as production materials.

Article 1. The list of waste permitted for import as production materials is promulgated together with this Decision.

Article 3. Implementation Clauses

1. Paper waste with HS code 4707 90 00 which is permitted to be imported according to the component environmental license (certificate of eligibility for environment protection in import of scrap from foreign countries as production materials) issued by a competent authority before the day on which this Decision comes into force may be continually imported until the expiry date of the component environmental license.

2. Waste and scrap from plastic with HS code 3915 90 00 which is permitted to be imported according to the component environmental license or the environmental license issued by a competent authority before the day on which this Decision comes into force may be continually imported until the expiry date of the component environmental license or the environmental license using equivalent HS codes prescribed in Section 2.3 or Section 2.5 in the list of waste permitted for import as production materials enclosed with this Decision.

3. Waste that may be imported according to the component environmental license or the environmental license issued by a competent authority before the day on which this Decision comes into force and has another name (but its HS code is not changed) different from that mentioned in this Decision may be continually imported until the expiry date of the component environmental license or the environmental license.

Article 4. Implementation Clauses

1. This Decision comes into force from June 01, 2023 and replaces Decision No. 28/2020/QD-TTg dated September 24, 2020 of the Prime Minister on promulgation of the list of waste permitted for import as production materials.

2. From the day on which this Decision comes into force, granulated slag (slag sand) from the manufacture of iron or steel (HS code 2618 00 00) shall be imported as materials for cement production according to regulations of product and goods laws on building materials.

3. Ministers, Heads of ministerial agencies, Heads of Governmental agencies, Presidents of the People's Committees of provinces and central-affiliated cities, relevant organizations and individuals are responsible for implementation of this Decision.
