CIRCULAR

ON AMENDING AND SUPLEMENTING A NUMBER OF ARTICLES OF THE CIRCULAR NO.30/2011/TT-NHNN OF SEPTEMBER 28, 2011, PROVIDING FOR THE MAXIMUM INTEREST RATE APPLICABLE TO DEPOSITS IN VIETNAMESE DONG OF ORGANIZATIONS, INDIVIDUALS AT CREDIT INSTITUTIONS, FOREIGN BANK'S BRANCHES

Pursuant to the Law on the State Bank of Vietnam No. 46/2010/QH12 of June 16, 2010;

Pursuant to the Law on Credit Institutions No. 47/2010/QH12 of June 16, 2010;

Pursuant to the Government’s Decree No. 96/2008/ND-CP of August 26, 2008 providing for the functions, duties, powers and organizational structure of the State Bank of Vietnam;

With a view to implementing the Government’s Resolution No.1/NQ-CP of January 03, 2012 on key solutions to direct and operate the implementation of economic-social development plan and the estimation of the state budget in 2012;

At the proposal of the Director General of the Monetary Policy Department;

The Governor of the State Bank of Vietnam hereby issues this Circular amending and supplementing a number of articles of the Circular 30/2011/TT-NHNN of September 28, 2011 providing for the maximum interest rate applicable to deposits in Vietnamese dong of organizations and individuals at credit institutions and foreign bank’s branches,

1. Clause 1 Article 1 is amended and supplemented as follows:

“1. For maximum interest rate applicable to demand deposits and deposits with term of less than one month: to be of 4% per annum.”

2. Clause 2 Article 1 is amended and supplemented as follows:

“2. For maximum interest rate applicable to deposits with term of one month and more: to be of 12% per annum; for local People's credit funds alone, they shall fix their maximum interest rate applicable to deposits with term of one month and more to be of 12.5% per annum.”

Article 2. Implementation organization

1. This Circular takes effect on April 11, 2002 and replaces the Circular No. 05/2012/TT-NHNN of March 12, 2012 of the Governor of the State Bank of Vietnam amending and supplementing a number of articles of the Circular No. 30/2011/TT-NHNN providing for the maximum interest rate applicable to deposits in Vietnamese dong of organizations and individuals at credit institutions and foreign bank’s branches.

2. For interest rates applicable to term deposits in Vietnamese dong mobilized from organizations, individuals at credit institutions arising prior to the effective date of this Circular shall be implemented until their expiry, in cases where in the end of the agreed term, the organizations, individuals do not come to withdraw their deposits, then the credit institutions shall fix the interest rate applicable to those deposits in accordance with provisions of this Circular.

3. The Banking Inspection and Supervision Department and State Bank's branches in provinces and centrally-run cities shall carry out the inspection, supervision over the implementation of provisions on the interest rates applicable to deposits in Vietnamese dong; apply the measures within their scope of power to deal with credit institutions and foreign bank’s branches who violate this Circular

4. The Director of the Administrative Department, Director of the Monetary Policy Department and Heads of units of the State Bank of Vietnam, General Managers of the State Bank’s branches in provinces and centrally-run; the Chairman of Board of Directors, Board of Members and General Directors (Directors) of credit institutions, foreign bank’s branches and related organizations, individuals shall be responsible for the implementation of this Circular./.
