BAN HÀNH QUY ĐỊNH VỀ QUY TRÌNH, THỦ TỤC KIỂM DỊCH ĐỘNG VẬT, SẢN PHẨM ĐỘNG VẬT; KIỂM TRA VỆ SINH THÚ Y

Căn cứ Pháp lệnh Thú y ngày 29 tháng 4 năm 2004;

Căn cứ Nghị định số 33 /2005/NĐ-CP ngày 15 tháng 3 năm 2005 của Chính phủ quy định chi tiết thi hành một số điều của Pháp lệnh Thú y;

Căn cứ Nghị định số 86/2003/NĐ-CP ngày 18 tháng 7 năm 2003 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn;

Theo đề nghị của Cục trưởng Cục Thú y,

QUYẾT ĐỊNH:

Điều 1. Ban hành kèm theo Quyết định này “Quy định về quy trình, thủ tục kiểm dịch động vật, sản phẩm động vật; kiểm tra vệ sinh thú y”.

Điều 2. Quyết định này có hiệu lực sau 15 ngày kể từ ngày đăng Công báo. Bãi bỏ Quyết định số 389/NN-TY/QĐ ngày 15 tháng 4 năm 1994 của Bộ trưởng Bộ Nông nghiệp và Công nghiệp thực phẩm (nay là Bộ Nông nhgiệp và Phát triển nông thôn) quy định về thủ tục kiểm dịch, kiểm soát giết mổ động vật, sản phẩm động vật, kiểm tra vệ sinh thú y.

Điều 3. Chánh văn phòng Bộ, Cục trưởng Cục Thú y, Thủ trưởng các đơn vị, các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Quyết định này.

VỀ QUY TRÌNH, THỦ TỤC KIỂM DỊCH ĐỘNG VẬT, SẢN PHẨM ĐỘNG VẬT; KIỂM TRA VỆ SINH THÚ Y

Chương 1:

NHỮNG QUY ĐỊNH CHUNG

Điều 1. Phạm vi áp dụng

1. Phạm vi áp dụng.

Quy định về quy trình, thủ tục kiểm dịch động vật, sản phẩm động vật; kiểm tra vệ sinh thú y;

2. Đối tượng áp dụng.

Quy định này áp dụng đối với:

a) Các tổ chức, cá nhân Việt Nam, tổ chức, cá nhân nước ngoài có hoạt động vận chuyển động vật, sản phẩm động vật trên lãnh thổ Việt Nam;

b) Cơ sở chăn nuôi, thu gom, kinh doanh, giết mổ động vật; cơ sở sản xuất, kinh doanh con giống;

c) Cơ sở sơ chế, bảo quản, buôn bán sản phẩm động vật ở dạng tươi sống, sơ chế;

d) Cơ sở tập trung động vật, sản phẩm động vật;

đ) Cơ sở, khu cách ly kiểm dịch động vật, sản phẩm động vật (sau đây gọi chung là khu cách ly kiểm dịch);

e) Cơ sở sản xuất, kinh doanh thuốc thú y, chế phẩm sinh học, vi sinh vật, hoá chất dùng trong thú y;

Điều 2. Giải thích từ ngữ

Trong Quy định này, các từ ngữ dưới đây được hiểu như sau:

1. Tạm xuất tái nhập: là việc hàng hoá được đưa ra nước ngoài hoặc từ các khu vực đặc biệt nằm trên lãnh thổ Việt Nam được coi là khu vực Hải quan riêng theo quy định của pháp luật, có làm thủ tục xuất khẩu ra khỏi Việt Nam và làm thủ tục nhập khẩu lại chính hàng hoá đó vào Việt Nam;

2. Tạm nhập tái xuất: là việc hàng hoá được đưa từ nước ngoài hoặc từ các khu vực đặc biệt nằm trên lãnh thổ Việt Nam được coi là khu vực Hải quan riêng theo quy định của pháp luật vào Việt Nam, có làm thủ tục nhập khẩu vào Việt Nam và làm thủ tục xuất khẩu chính hàng hoá đó ra khỏi Việt Nam;

3. Chuyển cửa khẩu: là việc mua hàng từ một nước, vùng lãnh thổ ngoài Việt Nam để bán cho một nước, vùng lãnh thổ ngoài Việt Nam mà không làm thủ tục nhập khẩu vào Việt Nam và không làm thủ tục xuất khẩu ra khỏi Việt Nam;

Quy định này chỉ áp dụng đối với động vật, sản phẩm động vật chuyển cửa khẩu có làm thủ tục gửi hàng tại kho ngoại quan hoặc vận chuyển hàng trên lãnh thổ Việt Nam;

4. Quá cảnh lãnh thổ Việt Nam: là việc vận chuyển hàng hóa thuộc sở hữu của tổ chức, cá nhân nước ngoài qua lãnh thổ Việt Nam, kể cả việc trung chuyển, chuyển tải, lưu kho, chia tách lô hàng, thay đổi phương thức vận tải hoặc các công việc khác được thực hiện trong thời gian quá cảnh.

Điều 3. Quy định về việc xử lý động vật, sản phẩm động vật không đảm bảo các yêu cầu về hồ sơ kiểm dịch.

Khi phát hiện lô hàng động vật, sản phẩm động vật không đảm bảo các yêu cầu về hồ sơ kiểm dịch, cơ quan kiểm dịch động vật xử lý như sau:

1. Trường hợp không có giấy chứng nhận kiểm dịch:

a) Hướng dẫn chủ hàng đưa động vật, sản phẩm động vật đến khu cách ly kiểm dịch để thực hiện kiểm dịch theo quy định;

b) Đối với động vật, sản phẩm động vật nhập khẩu, tạm nhập tái xuất, chuyển cửa khẩu, quá cảnh lãnh thổ Việt Nam thì trả về nơi xuất phát, hoặc tùy từng trường hợp cụ thể mà áp dụng các biện pháp xử lý theo quy định;

2. Trường hợp có giấy chứng nhận kiểm dịch nhưng hết giá trị thời gian sử dụng hoặc có sự tẩy xoá, sửa chữa nội dung giấy chứng nhận kiểm dịch: Hướng dẫn chủ hàng đưa động vật, sản phẩm động vật đến khu cách ly kiểm dịch để kiểm tra, xét nghiệm lại động vật, sản phẩm động vật;

3. Trường hợp có sự đánh tráo, lấy thêm, để lẫn với động vật, sản phẩm động vật chưa qua kiểm dịch hoặc để lẫn với hàng hoá khác có nguy cơ lây nhiễm:

a) Hướng dẫn chủ hàng đưa động vật, sản phẩm động vật đến khu cách ly kiểm dịch để tiến hành kiểm tra, xét nghiệm lại đối với động vật, sản phẩm động vật đã đánh tráo, lấy thêm hoặc để lẫn với hàng hoá khác;

b) Trường hợp số động vật, sản phẩm động vật phải kiểm tra, xét nghiệm lại phát hiện thấy mắc bệnh, mang mầm bệnh thuộc Danh mục các bệnh nguy hiểm của động vật thì phải kiểm tra lại toàn bộ lô hàng.

4. Hồ sơ kiểm dịch không hợp lệ, nội dung chứng nhận kiểm dịch không phù hợp:

a) Thông báo cho cơ quan kiểm dịch động vật có thẩm quyền nơi xuất hàng biết để kiểm tra lại, sửa đổi, hoàn chỉnh hồ sơ kiểm dịch;

b) Theo quy định tại điểm a khoản 1 Điều này nếu chủ hàng có yêu cầu;

5. Trường hợp động vật, sản phẩm động vật vận chuyển trong nước mà không xác định được chủ:

a) Động vật, sản phẩm động vật sau khi kiểm tra, xét nghiệm: Nếu đảm bảo tiêu chuẩn vệ sinh thú y thì cho phép sử dụng;

b) Động vật, sản phẩm động vật sau khi kiểm tra, xét nghiệm: Nếu không đảm bảo tiêu chuẩn vệ sinh thú y thì tuỳ từng trường hợp cụ thể mà áp dụng các biện pháp xử lý theo quy định;

6. Động vật, sản phẩm động vật nhập vào Việt Nam: Nếu không xác định được chủ thì phải tiêu hủy.

Chương 2:

QUY TRÌNH, THỦ TỤC KIỂM DỊCH ĐỘNG VẬT, SẢN PHẨM ĐỘNG VẬT

Mục I . QUY TRÌNH, THỦ TỤC KIỂM DỊCH ĐỘNG VẬT, SẢN PHẨM ĐỘNG VẬT VẬN CHUYỂN TRONG NƯỚC

Điều 4. Kiểm dịch động vật vận chuyển trong tỉnh.

1. Tổ chức, cá nhân (sau đây được gọi là chủ hàng) khi vận chuyển động vật với số lượng lớn ra khỏi huyện trong phạm vi tỉnh phải đăng ký kiểm dịch với Trạm Thú y quận, huyện, thị xã thuộc tỉnh, thành phố trực thuộc Trung ương (sau đây được gọi là Trạm Thú y huyện) theo quy định tại điểm a khoản 1 Điều 30 của Nghị định số 33 /2005/NĐ-CP ngày 15 tháng 3 năm 2005 của Chính phủ quy định chi tiết thi hành một số điều của Pháp lệnh Thú y (sau đây được gọi là Nghị định số 33/2005/NĐ-CP).

2. Hồ sơ đăng ký kiểm dịch gồm:

a) Giấy đăng ký kiểm dịch động vật vận chuyển theo mẫu quy định;

b) Bản sao giấy chứng nhận vùng, cơ sở an toàn dịch bệnh nơi xuất phát của động vật (nếu có);

c) Bản sao giấy chứng nhận tiêm phòng, phiếu kết quả xét nghiệm bệnh động vật (nếu có).

3. Kiểm tra trước khi đưa động vật đến khu cách ly kiểm dịch:

a) Kiểm tra nội dung đăng ký và các giấy tờ có liên quan tại khoản 2 của Điều này;

b) Căn cứ tình hình dịch bệnh, kết quả tiêm phòng, kết quả xét nghiệm bệnh của động vật tại nơi xuất phát, cơ quan kiểm dịch động vật chuẩn bị các điều kiện để kiểm dịch;

c) Trong phạm vi 02 ngày kể từ khi nhận được hồ sơ kiểm dịch hợp lệ, cơ quan kiểm dịch động vật có trách nhiệm thông báo về thời gian, địa điểm, nội dung kiểm dịch;

d) Kiểm tra việc thực hiện các quy định về điều kiện vệ sinh thú y đối với khu cách ly kiểm dịch;

đ) Hướng dẫn chủ hàng đưa động vật đến khu cách ly kiểm dịch và phải tiến hành kiểm dịch chậm nhất sau 02 ngày, kể từ khi động vật được tập trung tại khu cách ly kiểm dịch.

4. Kiểm tra sau khi đưa động vật đến khu cách ly kiểm dịch:

a) Kiểm tra số lượng, chủng loại động vật theo hồ sơ đăng ký kiểm dịch;

b) Kiểm tra lâm sàng, tách riêng động vật yếu, động vật có biểu hiện triệu chứng lâm sàng của bệnh truyền nhiễm hoặc nghi mắc bệnh truyền nhiễm;

c) Lấy mẫu xét nghiệm các bệnh theo quy định trước khi vận chuyển động vật (đối với động vật sử dụng làm giống, lấy sữa); các bệnh theo yêu cầu của chủ hàng (nếu có);

d) Tiêm phòng hoặc áp dụng các biện pháp phòng bệnh khác đối với bệnh thuộc Danh mục bệnh phải tiêm phòng khi vận chuyển động vật (trừ động vật sử dụng với mục đích giết mổ) nếu động vật chưa có giấy chứng nhận tiêm phòng hoặc giấy chứng nhận tiêm phòng không hợp lệ; các bệnh theo yêu cầu của chủ hàng (nếu có);

đ) Đối với động vật xuất phát từ vùng, cơ sở an toàn dịch bệnh thì không phải làm xét nghiệm, áp dụng các biện pháp phòng bệnh đối với những bệnh được công nhận an toàn dịch bệnh;

e) Diệt ký sinh trùng;

f) Đánh dấu động vật đủ tiêu chuẩn vệ sinh thú y theo quy định.

5. Sau khi thực hiện việc kiểm dịch, nếu động vật đủ tiêu chuẩn vệ sinh thú y, đã được tiêm phòng hoặc áp dụng các biện pháp phòng bệnh khác và có miễn dịch thì kiểm dịch viên động vật thực hiện:

a) Cấp giấy chứng nhận kiểm dịch đối với động vật đủ tiêu chuẩn vệ sinh thú y trong phạm vi 24 giờ trước khi vận chuyển. Hồ sơ kiểm dịch cấp cho chủ hàng gồm: Giấy chứng nhận kiểm dịch; bảng kê mã số đánh dấu động vật theo quy định;

b) Kiểm tra điều kiện vệ sinh thú y đối với phương tiện vận chuyển và các vật dụng kèm theo;

c) Thực hiện hoặc giám sát việc vệ sinh, khử trùng tiêu độc đối với phương tiện vận chuyển và các vật dụng kèm theo ít nhất 06 giờ trước khi bốc xếp hàng để vận chuyển;

d) Trong ngày bốc xếp hàng, kiểm dịch viên động vật thực hiện: Kiểm tra lâm sàng động vật; kiểm tra, giám sát quá trình bốc xếp động vật lên phương tiện vận chuyển; niêm phong phương tiện vận chuyển, dụng cụ chứa đựng (đối với động vật không áp dụng biện pháp đánh dấu); hướng dẫn chủ hàng vệ sinh, khử trùng tiêu độc khu cách ly kiểm dịch, nơi bốc xếp động vật.

6. Trường hợp động vật không đảm bảo các yêu cầu vệ sinh thú y, cơ quan kiểm dịch động vật không cấp giấy chứng nhận kiểm dịch và tiến hành xử lý theo quy định.

Điều 5. Kiểm dịch sản phẩm động vật vận chuyển trong tỉnh.

1. Chủ hàng khi vận chuyển sản phẩm động vật với khối lượng lớn ra khỏi huyện trong phạm vi tỉnh phải đăng ký kiểm dịch với Trạm Thú y huyện theo quy định tại điểm b khoản 1 Điều 30 của Nghị định số 33 /2005/NĐ-CP;

2. Hồ sơ đăng ký kiểm dịch gồm:

a) Giấy đăng ký kiểm dịch sản phẩm động vật vận chuyển theo mẫu quy định;

b) Bản sao phiếu kết quả xét nghiệm các chỉ tiêu vệ sinh thú y sản phẩm động vật (nếu có);

c) Các giấy tờ khác có liên quan (nếu có).

3. Kiểm tra trước khi đưa sản phẩm động vật đến khu cách ly kiểm dịch:

a) Kiểm tra nội dung đăng ký kiểm dịch và các giấy tờ có liên quan tại khoản 2 của Điều này;

b) Căn cứ tình hình dịch bệnh động vật tại nơi xuất phát, kết quả xét nghiệm các chỉ tiêu vệ sinh thú y, cơ quan kiểm dịch động vật chuẩn bị các điều kiện để kiểm dịch;

c) Trong phạm vi 02 ngày kể từ khi nhận được hồ sơ kiểm dịch hợp lệ, cơ quan kiểm dịch động vật có trách nhiệm thông báo thời gian, địa điểm, nội dung kiểm dịch;

d) Kiểm tra việc thực kiện các quy định về điều kiện vệ sinh thú y khu cách ly kiểm dịch;

đ) Hướng dẫn chủ hàng đưa sản phẩm động vật đến khu cách ly kiểm dịch và phải tiến hành kiểm dịch chậm nhất sau 02 ngày kể từ khi sản phẩm động vật được tập trung tại địa điểm đã chỉ định.

4. Kiểm tra sau khi đưa sản phẩm động vật đến khu cách ly kiểm dịch:

a) Kiểm tra số lượng, chủng loại sản phẩm động vật theo hồ sơ đăng ký của chủ hàng;

b) Kiểm tra tình trạng bao gói, bảo quản sản phẩm và kiểm tra cảm quan đối với sản phẩm động vật; kiểm tra dấu kiểm soát giết mổ, tem kiểm tra vệ sinh thú y đối với sản phẩm tươi sống sau giết mổ;

c) Lấy mẫu xét nghiệm các chỉ tiêu vệ sinh thú y đối với sản phẩm động vật chưa xét nghiệm các chỉ tiêu vệ sinh thú y theo quy định hoặc chưa có dấu kiểm soát giết mổ, tem kiểm tra vệ sinh thú y; theo yêu cầu của chủ hàng (nếu có);

d) Khử trùng tiêu độc đối với lô hàng theo quy định;

đ) Đánh dấu, niêm phong bao bì chứa đựng đối với sản phẩm động vật đủ tiêu chuẩn vệ sinh thú y.

5. Sau khi thực hiện việc kiểm dịch, nếu sản phẩm động vật đủ tiêu chuẩn vệ sinh thú y, kiểm dịch viên động vật thực hiện:

a) Cấp giấy chứng nhận kiểm dịch đối với sản phẩm động vật đủ tiêu chuẩn vệ sinh thú y trong phạm vi 24 giờ trước khi vận chuyển;

b) Theo quy định tại điểm b, c khoản 5 Điều 4 của bản Quy định này;

c) Trong ngày bốc xếp hàng, kiểm dịch viên động vật thực hiện: Kiểm tra, giám sát quá trình bốc xếp sản phẩm động vật lên phương tiện vận chuyển; niêm phong phương tiện vận chuyển; thực hiện hoặc giám sát việc vệ sinh, khử trùng tiêu độc khu cách ly kiểm dịch, nơi bốc xếp hàng.

6. Trường hợp sản phẩm động vật không đảm bảo các yêu cầu vệ sinh thú y, cơ quan kiểm dịch động vật không cấp giấy chứng nhận kiểm dịch và tiến hành xử lý theo quy định.

Điều 6. Kiểm dịch động vật vận chuyển ra ngoài tỉnh:

1. Chủ hàng khi vận chuyển động vật với số lượng lớn ra ngoài tỉnh (theo quy định về số lượng động vật phải kiểm dịch và miễn kiểm dịch tại Quyết định số 47/2005/QĐ-BNN ngày 25/7/2005 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn) phải đăng ký kiểm dịch với Chi cục Thú y và thực hiện kiểm dịch theo quy định tại khoản 1, 2, 3 Điều 4 của bản Quy định này;

2. Kiểm tra sau khi đưa động vật đến khu cách ly kiểm dịch:

a) Theo quy định tại điểm a, b, đ, e, f khoản 4, khoản 6 Điều 4 của bản Quy định này;

b) Lấy mẫu xét nghiệm các bệnh trước khi vận chuyển động vật nếu động vật chưa xét nghiệm bệnh theo quy định; các bệnh theo yêu cầu của chủ hàng (nếu có);

c) Tiêm phòng hoặc áp dụng các biện pháp phòng bệnh khác: Bệnh thuộc Danh mục các bệnh phải tiêm phòng khi vận chuyển động vật nếu động vật chưa có giấy chứng nhận tiêm phòng hoặc giấy chứng nhận tiêm phòng không hợp lệ; các bệnh theo yêu cầu của chủ hàng (nếu có).

3. Sau khi thực hiện việc kiểm dịch, kiểm dịch viên động vật thực hiện theo quy định tại khoản 5, 6 Điều 4 của bản quy định này.

Điều 7. Kiểm dịch sản phẩm động vật vận chuyển ra ngoài tỉnh:

1. Tổ chức, cá nhân khi vận chuyển sản phẩm động vật với khối lượng lớn ra ngoài tỉnh (theo quy định về khối lượng sản phẩm động vật phải kiểm dịch và miễn kiểm dịch tại Quyết định số 47/2005/QĐ-BNN ngày 25/7/2005 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn) phải đăng ký kiểm dịch với Chi cục Thú y và thực hiện kiểm dịch theo quy định tại khoản 1, 2, 3 Điều 5 của bản Quy định này;

2. Kiểm tra sau khi đưa sản phẩm động vật đến khu cách ly kiểm dịch:

a) Theo quy định tại điểm a, b,d, đ, khoản 4 Điều 5 của bản quy định này;

b) Lấy mẫu xét nghiệm các chỉ tiêu vệ sinh thú y đối với sản phẩm động vật chưa làm các xét nghiệm theo quy định; các chỉ tiêu vệ sinh thú y theo yêu cầu của chủ hàng (nếu có).

3. Sau khi thực hiện việc kiểm dịch, kiểm dịch viên động vật thực hiện theo quy định tại khoản 5, 6 Điều 4 của bản quy định này.

Điều 8. Kiểm dịch động vật, sản phẩm động vật tại Trạm kiểm dịch động vật đầu mối giao thông.

Kiểm dịch viên động vật tại các Trạm kiểm dịch động vật đầu mối giao thông thực hiện:

1. Kiểm tra hồ sơ kiểm dịch bao gồm giấy chứng nhận kiểm dịch và các giấy tờ khác có liên quan;

2. Kiểm tra số lượng, chủng loại động vật, sản phẩm động vật theo giấy chứng nhận kiểm dịch; mã số của động vật; dấu kiểm soát giết mổ, tem vệ sinh thú y; dấu niêm phong phương tiện vận chuyển và các dụng cụ, bao bì chứa đựng;

3. Kiểm tra tình trạng sức khoẻ động vật, thực trạng vệ sinh thú y sản phẩm động vật;

4. Kiểm tra thực trạng vệ sinh thú y phương tiện vận chuyển và các vật dụng có liên quan trong quá trình vận chuyển;

5. Đóng dấu xác nhận vào mặt sau giấy chứng nhận kiểm dịch đối với động vật, sản phẩm động vật có giấy chứng nhận kiểm dịch hợp lệ, phương tiện vận chuyển, các vật dụng khác có liên quan bảo đảm yêu cầu vệ sinh thú y.

6. Các trường hợp phải xử lý:

a) Phương tiện vận chuyển, các vật dụng có liên quan không đảm bảo yêu cầu vệ sinh thú y, kiểm dịch viên động vật lập biên bản đồng thời tạm đình chỉ việc vận chuyển và yêu cầu chủ hàng thực hiện các biện pháp xử lý:

Sau khi xử lý, nếu phương tiện vận chuyển và các vật dụng có liên quan đảm bảo các yêu cầu vệ sinh thú y thì xác nhận vào mặt sau giấy chứng nhận kiểm dịch và cho phép tiếp tục vận chuyển;

Sau khi xử lý, nếu phương tiện vận chuyển hoặc các vật dụng có liên quan vẫn không đảm bảo các yêu cầu vệ sinh thú y thì cơ quan kiểm dịch động vật: Yêu cầu chủ hàng phải thay đổi phương tiện vận chuyển, các vật dụng có liên quan, sau đó mới xác nhận vào vào mặt sau giấy chứng nhận kiểm dịch và cho phép tiếp tục vận chuyển;

b) Khử trùng tiêu độc phương tiện vận chuyển, các dụng cụ có liên quan trong trường hợp phương tiện vận chuyển động vật, sản phẩm động vật đi qua vùng có dịch;

c) Các trường hợp khác, tuỳ theo từng trường hợp cụ thể mà áp dụng các biện pháp xử lý theo quy định.

Điều 9. Kiểm dịch động vật, sản phẩm động vật tại nơi đến.

1. Cơ quan kiểm dịch động vật tại nơi đến chỉ thực hiện kiểm dịch động vật, sản phẩm động vật trong các trường hợp sau:

a) Không có giấy chứng nhận kiểm dịch của cơ quan kiểm dịch động vật nơi xuất phát;

b) Có giấy chứng nhận kiểm dịch của cơ quan kiểm dịch động vật nơi xuất phát, nhưng không hợp lệ hoặc giấy chứng nhận kiểm dịch hết giá trị thời gian sử dụng;

c) Cơ quan kiểm dịch động vật tại nơi đến phát hiện có sự đánh tráo, lấy thêm hoặc bớt động vật, sản phẩm động vật hoặc thay đổi bao bì chứa đựng sản phẩm động vật khi chưa được phép của cơ quan kiểm dịch động vật;

d) Cơ quan kiểm dịch động vật tại nơi đến phát hiện thấy động vật có biểu hiện mắc bệnh hoặc nghi mắc bệnh truyền nhiễm; sản phẩm động vật bị biến đổi chất lượng hoặc nghi nhiễm mầm bệnh.

2. Nội dung kiểm dịch động vật, sản phẩm động vật tại nơi đến: Thực hiện theo quy định tại khoản 2, 3 Điều 6 đối với động vật hoặc khoản 2, 3 Điều 7 đối với sản phẩm động vật của bản quy định này.

Mục II. QUY TRÌNH, THỦ TỤC KIỂM DỊCH ĐỘNG VẬT, SẢN PHẨM ĐỘNG VẬT XUẤT KHẨU

Điều 10. Kiểm dịch động vật xuất khẩu.

1. Chủ hàng khi xuất khẩu động vật phải đăng ký kiểm dịch với cơ quan kiểm dịch động vật có thẩm quyền theo quy định tại điểm a khoản 3 Điều 30 của Nghị định số 33 /2005/NĐ-CP;

2. Hồ sơ đăng ký kiểm dịch gồm:

a) Theo quy định tại khoản 2, Điều 4 của bản Quy định này;

b) Bản sao yêu cầu vệ sinh thú y của chủ hàng hoặc nước nhập khẩu đối với động vật xuất khẩu (nếu có);

c) Bản sao hợp đồng mua bán (nếu có);

d) Các giấy tờ khác có liên quan (nếu có).

3. Kiểm tra trước khi đưa động vật đến khu cách ly kiểm dịch:

a) Kiểm tra nội dung đăng ký kiểm dịch và các giấy tờ có liên quan tại khoản 2 Điều này;

b) Căn cứ yêu cầu của chủ hàng hoặc nước nhập khẩu về vệ sinh thú y đối với động vật xuất khẩu; tình hình dịch bệnh, kết quả tiêm phòng, kết quả xét nghiệm bệnh của động vật tại nơi xuất phát, cơ quan kiểm dịch động vật chuẩn bị các điều kiện để kiểm dịch;

c) Trong phạm vi 05 ngày kể từ khi nhận được hồ sơ đăng ký kiểm dịch hợp lệ, cơ quan kiểm dịch động vật có trách nhiệm vào sổ đăng ký kiểm dịch và thông báo về thời gian, địa điểm, nội dung tiến hành kiểm dịch;

d) Thực hiện theo quy định tại điểm d, đ khoản 3 Điều 4 của bản Quy định này.

4. Kiểm tra sau khi đưa động vật đến khu cách ly kiểm dịch:

a) Theo quy định tại điểm a, b, e, f khoản 4 Điều 4 của bản Quy định này;

b) Lấy mẫu xét nghiệm; tiêm phòng hoặc áp dụng các biện pháp phòng bệnh khác theo quy định tại điểm b, c, khoản 2 Điều 6 của bản Quy định này và các bệnh khác theo yêu cầu của chủ hàng hoặc nước nhập khẩu.

5. Sau khi kiểm tra, kiểm dịch viên động vật thực hiện theo quy định tại khoản 5, 6 Điều 4 của bản Quy định này;

6. Trường hợp chủ hàng hoặc nước nhập khẩu không yêu cầu kiểm dịch xuất khẩu, cơ quan kiểm dịch động vật thực hiện kiểm dịch theo quy định tại Điều 4 hoặc Điều 6 của bản Quy định này tuỳ theo nơi xuất phát của động vật.

Điều 11. Kiểm dịch sản phẩm động vật xuất khẩu.

1. Chủ hàng khi xuất khẩu sản phẩm động vật phải đăng ký kiểm dịch với cơ quan kiểm dịch động vật theo quy định tại khoản 1 Điều 10 của bản quy định này;

2. Hồ sơ đăng ký kiểm dịch gồm:

a) Theo quy định tại khoản 2, Điều 5, điểm c, d khoản 2 Điều 10 của bản Quy định này;

b) Bản sao yêu cầu về vệ sinh thú y của chủ hàng hoặc nước nhập khẩu đối với sản phẩm động vật xuất khẩu (nếu có).

3. Kiểm tra trước khi đưa sản phẩm động vật đến khu cách ly kiểm dịch:

a) Kiểm tra nội dung đăng ký và các giấy tờ có liên quan tại khoản 2 Điều này;

b) Căn cứ yêu cầu vệ sinh thú y đối với sản phẩm động vật của chủ hàng hoặc nước xuất khẩu, kết quả xét nghiệm các chỉ tiêu vệ sinh thú y, cơ quan kiểm dịch động vật chuẩn bị các điều kiện cần thiết để tiến hành kiểm dịch;

c) Trong phạm vi 05 ngày kể từ khi nhận được hồ sơ đăng ký kiểm dịch hợp lệ, cơ quan kiểm dịch động vật có trách nhiệm vào sổ đăng ký kiểm dịch và thông báo về thời gian, địa điểm, nội dung tiến hành kiểm dịch;

d/ Theo quy định tại điểm d, đ khoản 3 Điều 5 của bản Quy định này.

4. Kiểm tra sau khi đưa sản phẩm động vật đến khu cách ly kiểm dịch:

a) Theo quy định tại điểm a, b, d, e, f khoản 4, Điều 5 của bản Quy định này;

b) Lấy mẫu xét nghiệm các chỉ tiêu vệ sinh thú y theo yêu cầu của chủ hàng hoặc nước xuất khẩu.

5. Sau khi kiểm tra, kiểm dịch viên động vật thực hiện theo quy định tại khoản 5, 6 Điều 5 của bản Quy định này;

6. Trường hợp chủ hàng hoặc nước nhập khẩu không yêu cầu kiểm dịch xuất khẩu, cơ quan kiểm dịch động vật thực hiện kiểm dịch theo quy định tại Điều 5 hoặc Điều 7 của bản quy định này tuỳ theo nơi xuất phát của sản phẩm động vật.

Điều 12. Kiểm dịch động vật, sản phẩm động vật xuất khẩu tại cửa khẩu xuất hàng.

Cơ quan kiểm dịch động vật thực hiện:

1. Theo quy định tại khoản 1, 2, 3, Điều 8 của bản quy định này;

2. Hồ sơ kiểm dịch hợp lệ; động vật khỏe mạnh; sản phẩm động vật đảm bảo yêu cầu vệ sinh thú y, được bao gói, bảo quản theo quy định, cơ quan kiểm dịch động vật cửa khẩu làm thủ tục cho phép xuất khẩu hoặc đổi giấy chứng nhận kiểm dịch nếu chủ hàng hoặc nước nhập khẩu có yêu cầu;

Trường hợp phát hiện động vật, sản phẩm động vật không đảm bảo tiêu chuẩn vệ sinh thú y, cơ quan kiểm dịch động vật cửa khẩu thực hiện hiện việc xử lý theo quy định.

3. Thực hiện hoặc giám sát việc vệ sinh, khử trùng tiêu độc đối với nơi bốc xếp, phương tiện vận chuyển, các chất độn, chất thải động vật và các dụng cụ có liên quan sau khi vận chuyển.

Điều 13. Kiểm dịch động vật, sản phẩm động vật xuất khẩu qua đường bưu điện.

1. Chủ hàng khi xuất khẩu động vật, sản phẩm động vật qua đường Bưu điện phải đăng ký kiểm dịch với cơ quan kiểm dịch động vật thuộc Cục Thú y theo quy định tại khoản 1, 2 Điều 10 đối với động vật, khoản 1, 2 Điều 11 đối với sản phẩm động vật của bản quy định này;

2. Nội dung kiểm dịch được thực hiện như sau:

a) Đối với động vật: Kiểm tra lâm sàng; kiểm tra sổ theo dõi sức khoẻ của động vật (nếu có); làm xét nghiệm, tiêm phòng các bệnh theo yêu cầu của chủ hàng hoặc nước nhập khẩu;

b) Đối với sản phẩm động vật: Kiểm tra cảm quan, làm xét nghiệm các chỉ tiêu vệ sinh thú y theo yêu cầu vệ sinh thú y của chủ hàng hoặc nước nhập khẩu;

c) Hướng dẫn chủ hàng thực hiện nhốt giữ động vật, bao gói sản phẩm động vật theo quy định, niêm phong hoặc đánh dấu hàng gửi và cấp giấy chứng nhận kiểm dịch đối với động vật, sản phẩm động vật đủ tiêu chuẩn vệ sinh thú y, được nhốt giữ, bao gói theo đúng quy định;

d) Hướng dẫn chủ hàng xử lý đối với động vật, sản phẩm động vật không đủ tiêu chuẩn vệ sinh thú y để xuất khẩu.

3. Trường hợp chủ hàng hoặc nước nhập khẩu không yêu cầu kiểm dịch xuất khẩu, tuỳ theo số lượng động vật, khối lượng sản phẩm động vật và tuỳ theo nơi xuất phát của động vật, sản phẩm động vật, cơ quan kiểm dịch động vật thực hiện kiểm dịch theo quy định;

4. Cấm xuất khẩu qua đường bưu điện:

a) Động vật, sản phẩm động vật thuộc Danh mục cấm xuất khẩu theo quy định;

b) Sản phẩm động vật ở dạng tươi sống, sơ chế.

Mục III. QUY TRÌNH, THỦ TỤC KIỂM DỊCH ĐỘNG VẬT, SẢN PHẨM ĐỘNG VẬT NHẬP KHẨU

Điều 14. Đăng ký kiểm dịch nhập khẩu động vật, sản phẩm động vật.

1. Chủ hàng có yêu cầu nhập khẩu động vật, sản phẩm động vật có trong Danh mục động vật, sản phẩm động vật thuộc diện phải kiểm dịch hoặc động vật, sản phẩm động vật lạ chưa có ở Việt Nam phải đăng ký kiểm dịch nhập khẩu với Cục Thú y. Hồ sơ đăng ký gồm:

a) Đơn đăng ký kiểm dịch nhập khẩu theo mẫu quy định;

b) Bản sao công chứng giấy đăng ký kinh doanh (đối với doanh nghiệp);

c) Giấy phép của cơ quan quản lý chuyên ngành theo quy định;

d) Tài liệu liên quan đến việc kiểm dịch nhập khẩu động vật, sản phẩm động vật;

Trong phạm vi 07 ngày (không kể ngày nghỉ) kể từ khi nhận được hồ sơ hợp lệ, căn cứ tình hình dịch bệnh động vật của nước xuất khẩu và tình hình dịch bệnh động vật trong nước, Cục Thú y trả lời không chấp thuận hoặc chấp thuận và hướng dẫn việc kiểm dịch nhập khẩu.

2. Sau khi được Cục Thú y chấp thuận, chủ hàng đăng ký kiểm dịch với cơ quan kiểm dịch động vật được Cục Thú y chỉ định theo quy định tại điểm b khoản 3 Điều 30 của Nghị định số 33/2005/NĐ-CP.

Hồ sơ đăng ký kiểm dịch nhập khẩu gồm:

a) Giấy đăng ký kiểm dịch nhập khẩu theo mẫu quy định;

b) Văn bản chấp thuận của Cục Thú y về việc kiểm dịch nhập khẩu động vật, sản phẩm động vật;

c) Bản sao giấy chứng nhận kiểm dịch của nước xuất khẩu (nếu có);

d) Các giấy tờ khác có liên quan (nếu có).

3. Trong phạm vi 05 ngày, kể từ ngày nhận được hồ sơ đăng ký kiểm dịch hợp lệ, cơ quan kiểm dịch động vật có trách nhiệm thông báo cho chủ hàng địa điểm, thời gian, nội dung kiểm dịch; kiểm tra vệ sinh thú y khu cách ly kiểm dịch đối với lô hàng đưa về khu cách ly kiểm dịch để kiểm dịch.

Điều 15. Kiểm dịch động vật, sản phẩm động vật nhập khẩu tại cửa khẩu nhập.

Cơ quan kiểm dịch động vật thực hiện:

1. Kiểm tra hồ sơ kiểm dịch nhập khẩu:

a) Hồ sơ kiểm dịch nhập khẩu theo quy định tại điểm a, b, d khoản 2 Điều 14 của bản Quy định này;

b) Giấy chứng nhận kiểm dịch của nước xuất khẩu (bản gốc);

c) Giấy chứng nhận vệ sinh thú y khu cách ly kiểm dịch đối với lô hàng đưa về khu cách ly kiểm dịch để tiến hành kiểm dịch.

2. Kiểm tra thực trạng hàng nhập; đối chiếu với giấy chứng nhận kiểm dịch của nước xuất khẩu về số lượng, chủng loại hàng nhập;

3. Kiểm tra điều kiện vệ sinh thú y, khử trùng tiêu độc phương tiện vận chuyển; thực hiện hoặc giám sát chủ hàng xử lý chất thải, chất độn phát sinh trong quá trình vận chuyển hàng;

4. Nếu hàng nhập khẩu đảm bảo yêu cầu vệ sinh thú y, giấy chứng nhận kiểm dịch và các giấy tờ khác có liên quan hợp lệ thì cơ quan kiểm dịch động vật làm thủ tục kiểm dịch nhập khẩu để chủ hàng làm thủ tục hải quan;

5. Hướng dẫn chủ hàng những yêu cầu cần thiết trong quá trình vận chuyển hàng từ cửa khẩu đến khu cách ly kiểm dịch. Đối với động vật nhập khẩu để giết mổ được đưa thẳng đến cơ sở giết mổ đã được chỉ định hoặc khu vực nuôi nhốt cách ly chờ giết mổ;

6. Đối với động vật, sản phẩm động vật nhập khẩu không làm thủ tục hải quan tại cửa khẩu nhập mà chuyển làm thủ tục hải quan tại cửa khẩu hoặc điểm thông quan khác, cơ quan kiểm dịch động vật cửa khẩu nhập thực hiện:

a) Theo quy định tại khoản 1, 2, 3, 4, Điều này;

b) Giám sát quá trình bốc xếp động vật, sản phẩm động vật lên phương tiện vận chuyển;

c) Niêm phong phương tiện vận chuyển động vật, sản phẩm động vật;

d) Thực hiện hoặc giám sát việc vệ sinh, khử trùng tiêu độc nơi tập trung bốc xếp động vật, sản phẩm động vật;

đ) Thông báo những thông tin cần thiết về lô hàng cho cơ quan kiểm dịch động vật phụ trách cửa khẩu đến.

7. Trường hợp động vật, sản phẩm động vật nhập khẩu không đảm bảo các yêu cầu vệ sinh thú y, cơ quan kiểm dịch động vật thực hiện xử lý theo quy định.

Điều 16. Kiểm dịch động vật nhập khẩu tại khu cách ly kiểm dịch.

1. Trước khi nhập khẩu ít nhất 10 ngày, cơ quan kiểm dịch động vật phải tiến hành kiểm tra điều kiện vệ sinh thú y khu cách ly kiểm dịch;

a) Hướng dẫn chủ cơ sở cách ly kiểm dịch hoàn thiện các hạng mục để đảm bảo yêu cầu vệ sinh thú y; vệ sinh, khử trùng tiêu độc khu cách ly kiểm dịch, các dụng cụ có liên quan ít nhất 06 ngày trước khi nhập động vật;

b) Kiểm tra hồ sơ sức khoẻ của nhân viên chăm sóc động vật trong thời gian cách ly kiểm dịch;

c) Cấp chứng nhận vệ sinh thú y đối với khu cách ly kiểm dịch.

2. Trong ngày nhập động vật vào khu cách ly kiểm dịch:

a) Hướng dẫn chủ hàng đưa động vật vào khu cách ly kiểm dịch; vệ sinh, khử trùng tiêu độc phương tiện vận chuyển, các dụng cụ có liên quan, chất độn, thất thải của động vật trong quá trình vận chuyển;

b) Kiểm tra hồ sơ kiểm dịch đã được xác nhận tại cơ quan kiểm dịch động vật cửa khẩu nhập;

c) Chuẩn bị phương tiện, dụng cụ để tiến hành kiểm dịch.

3. Chậm nhất sau 03 ngày kể từ khi động vật được tập trung tại khu cách ly kiểm dịch, cơ quan kiểm dịch động vật thực hiện việc kiểm dịch:

a) Theo quy định tại điểm a, b, e, f khoản 4 Điều 4 của bản Quy định này;

b) Lấy mẫu xét nghiệm các bệnh theo quy định; các bệnh theo yêu cầu của chủ hàng (nếu có);

c) Tiêm phòng hoặc áp dụng các biện pháp phòng bệnh khác (trừ động vật để giết thịt) đối với các bệnh trong Danh mục các bệnh phải tiêm phòng; các bệnh theo yêu cầu của chủ hàng (nếu có).

4. Hết thời gian cách ly kiểm dịch, nếu động vật đủ tiêu chuẩn vệ sinh thú y, đã được tiêm phòng hoặc áp dụng các biện pháp phòng bệnh khác và có miễn dịch thì kiểm dịch viên động vật thực hiện:

a) Theo quy định tại điểm b, c, d khoản 5 Điều 4 của bản Quy định này;

b) Cấp giấy chứng nhận kiểm dịch nhập khẩu cho phép đưa vào sản xuất, sử dụng đối với động vật đủ tiêu chuẩn vệ sinh thú y trong phạm vi 24 giờ trước khi vận chuyển về nơi tiếp nhận;

c) Thông báo cho cơ quan thú y nơi tiếp nhận về tình hình dịch bệnh của động vật, kết quả xét nghiệm bệnh, kết quả tiêm phòng và các thông tin khác.

5. Trường hợp động vật không đảm bảo các yêu cầu vệ sinh thú y, cơ quan kiểm dịch động vật không cấp giấy chứng nhận kiểm dịch và tiến hành xử lý theo quy định.

Điều 17. Kiểm dịch sản phẩm động vật nhập khẩu tại khu cách ly kiểm dịch hoặc kho chứa

hàng riêng biệt của chủ hàng hoặc tại cửa khẩu (sau đây gọi chung là khu cách ly kiểm dịch).

1. Trước khi nhập khẩu ít nhất 05 ngày, cơ quan kiểm dịch động vật phải tiến hành kiểm tra điều kiện vệ sinh thú y khu cách ly kiểm dịch và thực hiện các quy định tại điểm a, b, d khoản 1 Điều 16 của bản Quy định này;

2. Trong ngày nhập sản phẩm động vật vào khu cách ly kiểm dịch;

a) Hướng dẫn chủ hàng đưa sản phẩm động vật vào khu cách ly kiểm dịch; vệ sinh, khử trùng tiêu độc phương tiện vận chuyển, các dụng cụ có liên quan, chất độn, thất thải phát sinh trong quá trình vận chuyển;

b) Thực hiện theo quy định tại điểm b, c, khoản 2 Điều 16 của bản Quy định này.

3. Chậm nhất sau 02 ngày kể từ khi sản phẩm động vật nhập được tập trung tại khu cách ly kiểm dịch, cơ quan kiểm dịch động vật phải thực hiện kiểm dịch hàng nhập:

a) Theo quy định tại điểm a, d, đ khoản 4 Điều 5 của bản Quy định này;

b) Kiểm tra tình trạng bao gói, bảo quản sản phẩm và kiểm tra cảm quan đối với sản phẩm động vật;

c) Lấy mẫu làm xét nghiệm các chỉ tiêu vệ sinh thú y theo quy định; các chỉ tiêu vệ sinh thú y theo yêu cầu của chủ hàng (nếu có).

4. Sau khi kiểm dịch, nếu sản phẩm động vật đủ tiêu chuẩn vệ sinh thú y, kiểm dịch viên động vật thực hiện:

a) Theo quy định tại điểm b, c khoản 5 Điều 5 của bản Quy định này;

b) Cấp giấy chứng nhận kiểm dịch nhập khẩu cho phép đưa vào sản xuất, sử dụng đối với sản phẩm động vật đủ tiêu chuẩn vệ sinh thú y trong phạm vi 24 giờ trước khi vận chuyển về nơi tiếp nhận.

5. Trường hợp sản phẩm động vật không đảm bảo các yêu cầu vệ sinh thú y, cơ quan kiểm dịch động vật không cấp giấy chứng nhận kiểm dịch và tiến hành xử lý theo quy định.

Điều 18. Kiểm dịch động vật, sản phẩm động vật nhập khẩu gửi qua đường bưu điện.

1. Chủ hàng phải đăng ký kiểm dịch nhập khẩu với Cục Thú y theo quy định tại khoản 1, 2 Điều 14 của bản Quy định này;

2. Trong phạm vi 2 ngày kể từ khi nhận được hồ sơ hợp lệ, cơ quan kiểm dịch động vật có trách nhiệm vào sổ đăng ký kiểm dịch và thông báo cho chủ hàng biết về thời gian, địa điểm, nội dung tiến hành kiểm dịch;

3. Nội dung kiểm dịch:

a) Kiểm tra hồ sơ kiểm dịch theo quy định tại điểm a, b, khoản 2 Điều 15 của bản Quy định này;

b) Kiểm tra thực trạng hàng tại cơ quan bưu điện với sự có mặt của chủ hàng và nhân viên bưu điện, đối chiếu với giấy chứng nhận kiểm dịch của nước xuất khẩu;

c) Lấy mẫu xét nghiệm, tiêm phòng các bệnh theo quy định; theo yêu cầu của chủ hàng (nếu có);

d) Cấp giấy chứng nhận kiểm dịch khi hàng đủ tiêu chuẩn vệ sinh thú y để chủ hàng làm thủ tục hải quan, bưu điện.

4. Trường hợp hàng không đảm bảo các yêu cầu vệ sinh thú y, cơ quan kiểm dịch động vật không cấp giấy chứng nhận kiểm dịch và tiến hành xử lý theo quy định;

5. Cấm nhập khẩu qua đường bưu điện:

a) Sản phẩm động vật tươi sống, sơ chế; sản phẩm nguồn gốc động vật (trừ các hàng công nghệ như dạ, len, quần áo lông, đồ mỹ nghệ bằng xương, sừng, ngà);

b) Động vật, sản phẩm động vật thuộc Danh mục động vật, sản phẩm động vật cấm nhập khẩu theo quy định.

Điều 19. Kiểm dịch động vật, sản phẩm động vật nhập khẩu mang theo người.

Chủ hàng khi mang động vật, sản phẩm động vật theo người từ nước ngoài vào Việt Nam, thực hiện quy định như sau:

1. Chủ hàng phải đăng ký kiểm dịch nhập khẩu với cơ quan kiểm dịch động vật cửa khẩu và khai báo vào tờ khai xuất nhập cảnh, khi mang theo người động vật, sản phẩm động vật với số lượng, khối lượng như sau:

a) Động vật: Số lượng không quá 02 con, với mục đích để nuôi làm cảnh, sinh hoạt trong gia đình, hoặc đi du lịch, công tác, quá cảnh và không thuộc Danh mục động vật cấm xuất khẩu, nhập khẩu theo quy định;

b) Sản phẩm động vật: Khối lượng không quá 05 kg đối với thực phẩm chín có nguồn gốc động vật hoặc các sản phẩm có nguồn gốc động vật đã qua chế biến công nghiệp dùng để kinh doanh và không thuộc Danh mục sản phẩm động vật cấm xuất khẩu, nhập khẩu theo quy định.

2. Chủ hàng không phải đăng ký kiểm dịch nhập khẩu với cơ quan kiểm dịch động vật cửa khẩu, khi mang theo người sản phẩm động vật với khối lượng theo quy định tại điểm b, khoản 1 Điều này; không dùng để kinh doanh; không thuộc Danh mục sản phẩm động vật cấm xuất khẩu, nhập khẩu theo quy định;

3. Chủ hàng phải đăng ký kiểm dịch nhập khẩu với Cục Thú y khi mang theo người động vật, sản phẩm động vật với số lượng, khối lượng trên mức quy định tại khoản 1 Điều này; thuộc Danh mục động vật, sản phẩm động vật cấm xuất khẩu, nhập khẩu theo quy định;

4. Nghiêm cấm mang theo người sản phẩm có nguồn gốc động vật ở dạng tươi sống, sơ chế.

5. Nội dung kiểm dịch động vật, sản phẩm động vật theo quy định tại khoản 1 Điều này:

a) Động vật: Kiểm tra sổ theo dõi sức khoẻ do cơ quan thú y nơi có động vật xuất phát cấp; giấy chứng nhận kiểm dịch của nước xuất khẩu (nếu có); kiểm tra lâm sàng động vật; xét nghiệm hoặc tiêm phòng các bệnh (nếu cần thiết);

b) Sản phẩm động vật: Kiểm tra giấy chứng nhận kiểm dịch của nước xuất khẩu; kiểm tra thực trạng hàng nhập, đối chiếu với giấy chứng nhận kiểm dịch của nước xuất khẩu; kiểm tra cảm quan, tình trạng bao gói sản phẩm động vật;

c) Cấp giấy chứng nhận kiểm dịch nhập khẩu đối với động vật, sản phẩm động vật đủ tiêu chuẩn vệ sinh thú y để chủ hàng làm thủ tục hải quan;

d) Lập biên bản và tiêu huỷ ngay tại khu vực gần cửa khẩu đối với động vật mắc bệnh, nghi mắc bệnh truyền nhiễm, sản phẩm động vật không đủ tiêu chuẩn vệ sinh thú y;

đ) Trường hợp giấy chứng nhận kiểm dịch của nước xuất khẩu không hợp lệ, cơ quan kiểm dịch động vật cửa khẩu lập biên bản tạm giữ hàng và xử lý theo quy định.

Mục IV. QUY TRÌNH, THỦ TỤC KIỂM DỊCH ĐỘNG VẬT, SẢN PHẨM ĐỘNG VẬT TẠM NHẬP TÁI XUẤT, TẠM XUẤT TÁI NHẬP, CHUYỂN CỬA KHẨU, QUÁ CẢNH LÃNH THỔ VIỆT NAM

Điều 20. Đăng ký kiểm dịch động vật, sản phẩm động vật tạm nhập tái xuất, chuyển cửa khẩu, quá cảnh lãnh thổ Việt Nam.

1. Chủ hàng có yêu cầu tạm nhập tái xuất, chuyển cửa khẩu, quá cảnh lãnh thổ Việt Nam động vật, sản phẩm động vật phải đăng ký kiểm dịch với Cục Thú y. Việc đăng ký kiểm dịch thực hiện theo quy định tại khoản 1 Điều 14 của bản Quy định này;

2. Sau khi được Cục Thú y chấp thuận, chủ hàng phải đăng ký với cơ quan kiểm dịch động vật được Cục thú y chỉ định theo quy định tại điểm c khoản 3 Điều 30 của Nghị định số 33/2005/NĐ-CP;

Hồ sơ đăng ký kiểm dịch gồm:

a) Giấy đăng ký kiểm dịch theo mẫu quy định;

b) Văn bản chấp thuận của Cục Thú y về việc kiểm dịch động vật, sản phẩm động vật tạm nhập tái xuất, chuyển cửa khẩu, quá cảnh lãnh thổ Việt Nam;

c) Bản sao giấy chứng nhận kiểm dịch của nước xuất khẩu (nếu có);

d) Các giấy tờ khác có liên quan (nếu có);

Trong phạm vi 05 ngày, kể từ ngày nhận được hồ sơ kiểm dịch hợp lệ, cơ quan kiểm dịch động vật có trách nhiệm thông báo cho chủ hàng địa điểm, thời gian, nội dung tiến hành kiểm dịch.

Điều 21. Kiểm dịch động vật, sản phẩm động vật tạm xuất tái nhập.

1. Kiểm dịch động vật, sản phẩm động vật tạm xuất theo quy định về kiểm dịch động vật, sản phẩm động vật xuất khẩu;

2. Kiểm dịch động vật, sản phẩm động vật tái nhập theo quy định về kiểm dịch động vật, sản phẩm động vật nhập khẩu.

Điều 22. Kiểm dịch động vật, sản phẩm động vật tạm nhập tái xuất.

1. Tại cửa khẩu nhập, cơ quan kiểm dịch động vật thực hiện:

a) Kiểm tra hồ sơ kiểm dịch theo quy định tại khoản 2 Điều 20 của bản Quy định này;

b) Theo quy định tại khoản 2, 3, 7 Điều 15 của bản Quy định này;

c) Nếu hồ sơ kiểm dịch hợp lệ, động vật, sản phẩm động vật đảm bảo các yêu cầu vệ sinh thú y, cơ quan kiểm dịch động vật cửa khẩu chứng nhận hoặc cấp giấy chứng nhận kiểm dịch để chủ hàng làm thủ tục hải quan;

d) Giám sát quá trình bốc xếp động vật, sản phẩm động vật lên phương tiện vận chuyển;

đ) Niêm phong phương tiện vận chuyển động vật, sản phẩm động vật;

e) Thực hiện hoặc giám sát việc vệ sinh, khử trùng tiêu độc nơi tập trung bốc xếp động vật, sản phẩm động vật;

f) Hướng dẫn chủ hàng thực hiện các yêu cầu vệ sinh thú y trong quá trình vận chuyển trên lãnh thổ Việt Nam.

2. Tại cửa khẩu xuất, cơ quan kiểm dịch động vật thực hiện:

a) Theo quy định tại khoản 1, 3, 4 Điều 12 của bản Quy định này;

b) Nếu hồ sơ kiểm dịch hợp lệ, động vật, sản phẩm động vật đảm bảo các yêu cầu vệ sinh thú y, cơ quan kiểm dịch động vật cửa khẩu xác nhận số hàng xuất khỏi Việt Nam để chủ hàng làm thủ tục hải quan.

Điều 23. Kiểm dịch động vật, sản phẩm động vật chuyển cửa khẩu.

1. Trường hợp chuyển cửa khẩu có gửi kho ngoại quan nhưng không vận chuyển trên lãnh thổ Việt Nam:

a) Thực hiện theo quy định tại khoản 1, 2, 4, 7 Điều 15 của bản Quy định này;

b) Thực hiện việc giám sát động vật, sản phẩm động vật trong thời gian lưu giữ tại kho ngoại quan;

c) Trong ngày xuất hàng, cơ quan kiểm dịch động vật cửa khẩu thực hiện giám sát việc bốc động vật, sản phẩm động vật lên phương tiện vận chuyển;

d) Thực hiện hoặc giám sát việc vệ sinh, khử trùng tiêu độc kho hàng, nơi lưu giữ, nơi bốc xếp và các phương tiện, dụng cụ bốc xếp động vật, sản phẩm động vật.

2. Trường hợp chuyển cửa khẩu có vận chuyển trên lãnh thổ Việt Nam, cơ quan kiểm dịch động vật thực hiện theo quy định tại Điều 22 của bản Quy định này.

Điều 24. Kiểm dịch động vật, sản phẩm động vật quá cảnh lãnh thổ Việt Nam.

1. Tại cửa khẩu nhập, cơ quan kiểm dịch động vật thực hiện:

a) Theo quy định tại khoản 1 Điều 22 của bản Quy định này;

b) Kiểm tra việc thực hiện những quy định đã thông báo trước đối với chủ hàng;

c) Niêm phong, kẹp chì phương tiện vận chuyển sản phẩm động vật;

2. Trong quá trình vận chuyển trên lãnh thổ Việt Nam:

a) Chủ hàng phải thực hiện nghiêm túc các quy định của cơ quan kiểm dịch động vật trong quá trình vận chuyển động vật, sản phẩm động vật trên lãnh thổ Việt Nam;

b) Các phương tiện vận chuyển phải đảm bảo điều kiện vệ sinh thú y, an toàn về mặt thiết bị kỹ thuật, không làm rơi vãi các chất thải trên đường vận chuyển;

c) Không được tự ý bốc dỡ hàng hoặc tháo dỡ phương tiện vận chuyển khi chưa được phép của cơ quan thú y có thẩm quyền; việc thay đổi phương tiện vận chuyển trong thời gian vận chuyển phải được sự chấp thuận của cơ quan hải quan và cơ quan thú y có thẩm quyền;

d) Không được tự ý thay đổi lộ trình hoặc dừng lại tại các địa điểm không được quy định trước;

Trường hợp phương tiện vận chuyển không đi đúng lộ trình hoặc đỗ, dừng không đúng địa điểm quy định, chủ hàng phải giữ nguyên hàng hoá trên phương tiện vận chuyển và báo cho cơ quan thú y nơi gần nhất. Sau khi cơ quan thú y thực hiện các biện pháp xử lý theo quy định thì mới được tiếp tục vận chuyển;

e) Động vật chỉ được phép thả trên lãnh thổ Việt Nam để ăn, uống hoặc các trường hợp đặc biệt khác khi cơ quan thú y có thẩm quyền cho phép và giám sát không cho động vật tiếp xúc với động vật trong nước;

f) Xác động vật, chất độn, thức ăn thừa của động vật, bao bì đóng gói và các chất thải khác trong quá trình vận chuyển không được vứt xuống sân ga, bến cảng hoặc trên đường vận chuyển mà phải được xử lý tại các địa điểm theo hướng dẫn của cơ quan thú y có thẩm quyền.

3. Tại cửa khẩu xuất, cơ quan kiểm dịch động vật cửa khẩu thực hiện theo quy định tại khoản 2 Điều 22 của bản Quy định này.

Điều 25. Kiểm dịch động vật, sản phẩm động vật quá cảnh lãnh thổ Việt Nam vận chuyển bằng công-ten-nơ hoặc phương tiện có dấu niêm phong.

1. Kiểm tra hồ sơ kiểm dịch theo quy định tại khoản 1 Điều 22 của bản Quy định này;

2. Kiểm tra niêm phong, kẹp chì, điều kiện vệ sinh thú y phương tiện vận chuyển;

3. Nếu hồ sơ kiểm dịch hợp lệ, phương tiện vận chuyển đảm bảo yêu cầu vệ sinh thú y thì chứng nhận kiểm dịch và cho phép hàng qua cửa khẩu;

4. Trường hợp phát hiện thấy động vật, sản phẩm động vật hoặc phương tiện vận chuyển, dấu niêm phong hoặc kẹp chì không bình thường, cơ quan kiểm dịch động vật cửa khẩu thực hiện:

a) Phối hợp với cơ quan hải quan lập biên bản yêu cầu chủ hàng mở công-ten-nơ hoặc dấu niêm phong, kẹp chì với sự chứng kiến của chủ hàng để kiểm tra điều kiện vệ sinh thú y đối với hàng hoá;

b) Địa điểm mở công-ten-nơ phải đảm bảo điều kiện vệ sinh thú y, thuận lợi cho việc bốc dỡ hàng hoá do cơ quan thú y có thẩm quyền quy định;

c) Trường hợp động vật, sản phẩm động vật không đảm bảo các yêu cầu vệ sinh thú y, cơ quan kiểm dịch động vật cửa khẩu thực hiện việc xử lý theo quy định tại Điều 3 của bản Quy định này;

d) Phương tiện vận chuyển và các vật dụng có liên quan không đảm bảo tiêu chuẩn vệ sinh thú y, cơ quan kiểm dịch động vật cửa khẩu yêu cầu chủ hàng thực hiện các biện pháp khắc phục hoặc thay đổi phương tiện vận chuyển, thay thế các dụng cụ kèm theo.

5. Thực hiện hoặc giám sát việc vệ sinh, khử trùng tiêu độc phương tiện vận chuyển và các vật dụng có liên quan; nơi bốc xếp động vật, sản phẩm động vật.

Mục V. QUY TRÌNH, THỦ TỤC KIỂM DỊCH ĐỘNG VẬT THAM GIA HỘI CHỢ, TRIỂN LÃM, BIỂU DIỄN NGHỆ THUẬT, THI ĐẤU THỂ THAO; SẢN PHẨM ĐỘNG VẬT THAM GIA HỘI CHỢ, TRIỂN LÃM; GỬI VÀ NHẬN BỆNH PHẨM

Điều 26. Kiểm dịch động vật tham gia hội chợ, triển lãm, biểu diễn nghệ thuật, thi đấu thể thao; sản phẩm động vật tham gia hội chợ, triển lãm.

1. Chủ hàng có động vật tham gia hội chợ, triển lãm, biểu diễn nghệ thuật, thi đấu thể thao; sản phẩm động vật tham gia hội chợ, triển lãm phải tuân theo các quy định sau:

a) Động vật, sản phẩm động vật trong nước phải được kiểm dịch theo quy định tại Điều 4, 5, 6, 7 của bản Quy định này;

b) Động vật, sản phẩm động vật từ nước ngoài phải đăng ký kiểm dịch với Cục Thú y và được cơ quan kiểm dịch động vật có thẩm quyền thực hiện kiểm dịch theo quy định tại Điều 14, 15, của bản Quy định này;

2. Chủ hàng phải đăng ký với Chi cục Thú y địa phương ít nhất 10 ngày trước khi khai mạc;

3. Tại nơi tập trung động vật, sản phẩm động vật, Chi cục Thú y thực hiện:

a) Kiểm tra điều kiện vệ sinh thú y và tiến hành khử trùng tiêu độc ít nhất 03 ngày trước khi tập trung động vật, sản phẩm động vật;

b) Kiểm tra giấy chứng nhận kiểm dịch và các giấy tờ khác có liên quan;

c) Kiểm tra số lượng, chủng loại và thực trạng động vật, sản phẩm động vật, đối chiếu với giấy chứng nhận kiểm dịch;

d) Hướng dẫn chủ hàng đưa động vật, sản phẩm động vật đến địa điểm tập trung;

đ) Thực hiện hoặc giám sát việc vệ sinh, khử trùng tiêu độc phương tiện vận chuyển, các dụng cụ có liên quan, chất độn, chất thải trong quá trình vận chuyển;

e) Giám sát động vật, sản phẩm động vật trong thời gian tham gia hội chợ, triển lãm, biểu diễn nghệ thuật, thi đấu thể thao;

4. Sau thời gian tập trung hội chợ, triển lãm, biểu diễn nghệ thuật, thi đấu thể thao:

a) Chi cục Thú y thực hiện hoặc giám sát việc vệ sinh, khử trùng tiêu độc toàn bộ khu vực tập trung động vật, sản phẩm động vật;

b) Cấp giấy chứng nhận kiểm dịch đối với động vật, sản phẩm động vật đủ tiêu chuẩn vệ sinh thú y để sử dụng trong nước;

c) Nếu chủ hàng có yêu cầu xuất động vật, sản phẩm động vật ra khỏi Việt Nam thì phải làm thủ tục kiểm dịch xuất khẩu theo quy định tại Điều 10, 11 của bản Quy định này;

d) Nếu động vật, sản phẩm động vật không đủ tiêu chuẩn vệ sinh thú y thì áp dụng các biện pháp xử lý theo quy định.

Điều 27. Gửi và nhận bệnh phẩm.

1. Chủ hàng có yêu cầu gửi bệnh phẩm ra nước ngoài hoặc nhập khẩu vào Việt Nam phải đăng ký kiểm dịch với Cục Thú y;

2. Sau khi được Cục Thú y chấp thuận, chủ hàng phải đăng ký kiểm dịch với cơ quan kiểm dịch động vật được Cục Thú y chỉ định ít nhất 05 ngày trước khi nhận hoặc gửi mẫu bệnh phẩm;

3. Gửi bệnh phẩm.

Cơ quan kiểm dịch động vật thực hiện:

a) Kiểm tra văn bản của Cục Thú y về việc cho phép kiểm dịch xuất khẩu bệnh phẩm và các giấy tờ khác có liên quan;

Giám sát việc lấy mẫu bệnh phẩm; bao gói, bảo quản bệnh phẩm đảm bảo không để đổ, vỡ, phát tán mầm bệnh trong quá trình vận chuyển;

b) Dụng cụ chứa đựng bệnh phẩm phải được niêm phong trước khi vận chuyển;

c) Cấp giấy chứng nhận kiểm dịch đối với bệnh phẩm được bao gói, bảo quản đảm bảo yêu cầu vệ sinh thú y.

4. Nhận bệnh phẩm.

Cơ quan kiểm dịch động vật cửa khẩu thực hiện:

a) Kiểm tra văn bản của Cục Thú y về việc cho phép kiểm dịch nhập khẩu bệnh phẩm và các giấy tờ khác có liên quan;

b) Kiểm tra thực trạng bao gói, bảo quản bệnh phẩm;

c) Xác nhận để chủ hàng làm thủ tục hải quan khi hồ sơ hợp lệ, bệnh phẩm được bao gói, bảo quản đảm bảo yêu cầu vệ sinh thú y;

d) Trường hợp phát hiện bệnh phẩm nhập vào Việt Nam khi chưa được sự chấp thuận của Cục Thú y hoặc việc bao gói, bảo quản không đảm bảo yêu cầu vệ sinh thú y và có nguy cơ gây phát tán mầm bệnh, ô nhiễm môi trường, cơ quan kiểm dịch động vật cửa khẩu lập biên bản và tiêu huỷ toàn bộ bệnh phẩm tại khu vực gần cửa khẩu.

Chương 3:

QUY TRÌNH, THỦ TỤC KIỂM TRA VỆ SINH THÚ Y

Điều 28. Thẩm định điều kiện vệ sinh thú y đối với các cơ sở.

1. Tổ chức, cá nhân có yêu cầu lập cơ sở chăn nuôi tập trung, cơ sở sản xuất con giống; cơ sở giết mổ động vật, cơ sở sơ chế, bảo quản sản phẩm động vật; khu cách ly kiểm dịch, nơi tập trung động vật, sản phẩm động vật; cửa hàng kinh doanh động vật, sản phẩm động vật; cơ sở sản xuất thuốc thú y, chế phẩm sinh học, vi sinh vật, hoá chất dùng trong thú y (sau đây gọi chung là cơ sở) phải đăng ký thẩm định điều kiện vệ sinh thú y với cơ quan thú y có thẩm quyền theo quy định tại Điều 43 của Nghị định số 33/2005/NĐ-CP.

Hồ sơ đăng ký bao gồm:

a) Công văn đề nghị khảo sát địa điểm lập cơ sở;

b) Dự án hoặc kế hoạch đầu tư xây dựng cơ sở, thiết kế kỹ thuật;

c) Các giấy tờ liên quan đến việc thành lập cơ sở.

2. Trong phạm vi 07 ngày kể từ khi nhận được hồ sơ hợp lệ, cơ quan thú y phải tiến hành khảo sát điều kiện vệ sinh thú y đối với địa điểm lập cơ sở, đánh giá các chỉ tiêu kỹ thuật liên quan và trả lời bằng văn bản;

a) Nếu đảm bảo các yêu cầu về vệ sinh thú y, cơ quan thú y có thẩm quyền gửi văn bản cho chủ cơ sở và cấp có thẩm quyền là căn cứ để cấp có thẩm quyền cho phép thành lập và đầu tư xây dựng cơ sở;

b) Nếu không đảm bảo các yêu cầu về vệ sinh thú y, chủ cơ sở thực hiện sửa chữa, khắc phục những nội dung chưa đạt yêu cầu và đề nghị kiểm tra lại.

Điều 29. Kiểm tra điều kiện vệ sinh thú y đối với cơ sở.

1.Tổ chức, cá nhân có yêu cầu đưa cơ sở mới thành lập vào hoạt động phải đăng ký kiểm tra điều kiện vệ sinh thú y với cơ quan thú y có thẩm quyền theo quy định tại Điều 43 của Nghị định số 33/2005/NĐ-CP.

Hồ sơ đăng ký bao gồm:

a) Giấy đăng ký kiểm tra điều kiện vệ sinh thú y theo mẫu quy định;

b) Giấy phép đầu tư hoặc giấy phép kinh doanh (bản sao Công chứng);

c) Các giấy tờ liên quan đến việc thành lập cơ sở.

2. Trong phạm vi 05 ngày kể từ khi nhận được hồ sơ hợp lệ, cơ quan thú y có thẩm quyền phải tiến hành kiểm tra điều kiện, tiêu chuẩn vệ sinh thú y đối với cơ sở;

a) Kiểm tra việc thực hiện các quy định về điều kiện vệ sinh thú y;

b) Kiểm tra các tiêu chuẩn kỹ thuật về vệ sinh thú y;

3. Trong phạm vi 10 ngày (kể từ ngày được kiểm tra), cơ quan thú y có thẩm quyền phải trả lời kết quả kiểm tra điều kiện, tiêu chuẩn vệ sinh thú y.

a) Nếu cơ sở đảm bảo yêu cầu về điệu kiện, tiêu chuẩn vệ sinh thú y, cơ quan thú y có thẩm quyền cấp Chứng nhận điều kiện vệ sinh thú y cho cơ sở và có giá trị 02 năm kể từ ngày cấp;

b) Nếu cơ sở không đảm bảo yêu cầu về điệu kiện, tiêu chuẩn vệ sinh thú y, chủ cơ sở tổ chức sửa chữa, khắc phục những nội dung chưa đạt yêu cầu của lần kiểm tra trước và đề nghị kiểm tra lại.

4. Trường hợp cơ sở tạm ngừng hoạt động, chủ cơ sở phải thông báo với cơ quan thú y có thẩm quyền;

5. Trước khi hết thời hạn của chứng nhận điều kiện vệ sinh thú y hoặc trường hợp cơ sở tạm ngừng hoạt động từ 03 tháng trở lên, khi hoạt động trở lại, chủ cơ sở phải đăng ký trước ít nhất 15 ngày với cơ quan thú y có thẩm quyền theo quy định tại điểm a khoản 1 Điều này để kiểm tra điều kiện vệ sinh thú y đối với cơ sở;

Đối với cơ sở giết mổ động vật, sơ chế, bảo quản sản phẩm động vật, trong quá trình kiểm tra định kỳ, cơ quan thú y có thẩm quyền tiến hành lấy mẫu để kiểm tra tiêu chuẩn vệ sinh thú y đối với sản phẩm của cơ sở.

Article 3. Chief of Ministry Office, Director of Department of Veterinary Department, Heads of units, organizations and individuals concerned are liable to execute this Decision.

This Regulation applies to:

a) Vietnamese organizations and individuals and foreign organizations and individuals involved in transport of animals and animal products in the territory of Vietnam;

b) Animal raising, gathering, trading and slaughter establishments; breed production and trading establishments;

c) Preliminary processing, preservation and trading establishment of fresh and primary processing animal products.

Article 2. Explanation of terms

In this Regulation, the following terms are construed as follows:

1. Temporary export for re-import means the goods are sent abroad or from particular areas located in the territory of Vietnam regarded as separate customs area as prescribed by law, and are performed with procedures for export out of Vietnam and procedures for importing the same goods into Vietnam;

2. Temporary import for re-export means the goods are brought from abroad or from the special areas located in the territory of Vietnam regarded as separate customs area as prescribed by law, and are performed with procedures for import into Vietnam and procedures for exporting the same goods out of Vietnam;

3. Transfer of border gate: means the purchase of goods from a country or territory outside Vietnam to sell to a country or territory outside Vietnam without import procedures into Vietnam and without export procedures out of Vietnam;

This regulation only applies to the animals and animal products with transfer of border gate and procedures for goods storage in bonded warehouse or transportation of goods in the territory of Vietnam;

4. Transit through territory of Vietnam means the transportation of goods owned by foreign organizations and individuals through Vietnam territory, including transit, transshipment, warehousing, shipment separation, change of transportation or other work done during transit.

Article 3. Regulation on treatment of animal and animal products not ensuring the required quarantine records.

1. Where there is no quarantine certificate:

a) Guiding the goods owners to take the animals and animal products to the isolated quarantine area for quarantine as prescribed;

b) For animals and animal products imported, temporarily imported for re-exported, transferred border gate or transited through the territory of Vietnam shall be returned to the departure place or origin, or apply handling measures as prescribed depending on each specific case;

2. Where there is quarantine certificate but it is expired or its contents are erased or modified: Guiding the goods owners to take the animals and animal products to the isolated quarantine area for re-inspection or re-testing of animals and animal products

3. Where there is fraudulent exchange, addition taking or mixing with animal and animal product not being quarantined or mixed with other goods at risk of infection:

a) Guiding the goods owner to take the animals and animal products to the isolated quarantine area to re-inspect and re-test the animals and animal products fraudulently exchanged, additionally taken or mixed;

b) Where the animals and animal products re-inspected and re-tested are found with disease or pathogenic disease in the List of animal’s dangerous diseases, the entire batch of goods must be re-inspected.

4. Invalid quarantine record and inconsistent contents of quarantine certification:

a) Informing the competent animal quarantine agency of the port of departure in order to re-inspect, modify and complete the quarantine records.

5. Where the animals and animal products are transported domestically without identifying the owner:

a) Animals and animal products after being inspected and tested: If ensuring the veterinary hygiene standard, these products are permitted for use.

b) Animals and animal products after being inspected and tested: If failing to ensure the veterinary hygiene standard, depending on each particular case, the handling measures shall apply;

6. Animals and animal products imported into Vietnam: If the goods owner cannot be identified, they must be destroyed.

Chapter 2:

PROCESS AND PROCEDURES FOR QUARANTINE OF ANIMAL AND ANIMAL PRODUCTS

Section 1. PROCESS AND PROCEDURES FOR QUARANTINE OF ANIMAL AND ANIMAL PRODUCTS DOMESTICALLY TRANSPORTED

Article 4. Animal quarantine of animals transported in provinces

1. Organizations and individuals (hereafter referred to as goods owner) transporting in large quantities out of district within province must register the quarantine with the Veterinary Station of districts in provinces and centrally-affiliated cities (hereinafter referred as district Veterinary Station) as specified at Point a, Clause 1, Article 30 of Decree No. 33 / 2005/ND-CP dated March 15, 2005 of the Government detailing the implementation a number of articles of the Ordinance on Veterinary Medicine (hereinafter referred to as Decree No. 33/2005/ND-CP).

a) Registration of transported animal quarantine under the prescribed form;

b) A copy of certificate of disease safety establishment or area of animals’ place of origin (if any);

c) A copy of vaccination certificate and test result slip of animal disease (if any).

3. Checking the animals after they are taken to the isolated quarantine area:

a) Checking the registered contents and relevant papers specified in Clause 2 of this Article.

b) Based on the disease situation, vaccination results, test results of animal disease at place of origin, the animal quarantine agencies shall prepared the quarantine conditions;

c) Within 02 days after the receipt of valid quarantine record, the animal quarantine agency shall notify the time, location and contents of quarantine;

d) Inspecting the implementation of regulations on veterinary hygiene conditions for the isolated quarantine area;

dd) Guiding the goods owner to take the animals to the isolated quarantine area and the quarantine must be conducted no later than 02 days after the animals are concentrated in the isolated quarantine area.

a) Checking the number and types of animals under quarantine registration records;

b) Clinically examining, separating weak animals or animals with clinical symptoms of infectious disease or suspected infectious disease;

c) Taking samples for test of diseases as prescribed before transportation of animals (for animals used for breeding or dairy); the diseases at the goods owner’s request (if any);

d) Vaccinating or applying other preventive measures against diseases in the List of diseases to be vaccinated during transportation of animals (except for animals used for slaughtering purpose). If the animals do not have vaccination certificate or the vaccination certificate is not valid; the diseases at the goods owner’s request (if any);

dd) For animals coming from the disease safety establishment or area, it is not required to perform tests or apply preventive measures against the diseases recognized as disease safety;

e) Destroying parasite;

f) Marking the veterinary hygiene eligible animal as prescribed.

5. After performing the quarantine, if the animals are eligible for veterinary hygiene standards, have been vaccinated or applied with other preventive measures and the immunity, the animal quarantine officier shall:

a) Issue the quarantine certificate for the animals which are eligible for veterinary hygiene standards within 24 hours before transportation. The quarantine record issued to the goods owner includes: Quarantine certificate, list of codes of animal marking as prescribed.

c) Performing or supervising the cleaning and disinfection of means of transportation and accompanying items at least 06 hours before loading and unloading for transport;

d) During day of loading and unloading, the quarantine officer shall clinically test animals; check and monitor process of loading and unloading animals onto means of transportation; seal means of transportation and containers (for animal without application of marking method); guide the goods owner to clean and disinfect the isolated quarantine area and place of animal loading and unloading.

6. Where the animals do not ensure the veterinary hygiene requirements, the animal quarantine agency shall not issue the quarantine certificate and handle the case as prescribed;

Article 5. Quarantine of animal products transported in provinces.

1. When transporting the animal products in large quantities out of districts within provinces, the goods owners must register with district Veterinary Station under the provisions of Point b, Clause 1, Article 30 of Decree No. 33 / 2005/ND-CP;

2. The quarantine registration record consists of:

a) Registration of transported animal product quarantine under the prescribed form;

b) The copy of test result slip of veterinary hygiene norms of animal products (if any);

c) Other relevant papers (if any);

a) Checking the contents of quarantine registration and relevant papers specified in Clause 2 of this Article;

b) Based on the situation of animal disease at the place of origin, the test result of veterinary hygiene norms, the animal quarantine agency shall prepare the quarantine conditions;

c) Within 02 days after the receipt of valid quarantine record, the animal quarantine agency shall inform the time, location and contents of quarantine;

d) Checking the implementation of regulations on veterinary hygiene conditions of isolated quarantine area;

dd) Guiding the goods owner to take animal products to the isolated quarantine area and must conduct the quarantine no later than 02 days after the animal products are concentrated at the specified location.

4. Checking the animal products after they are taken to the isolated quarantine area:

a) Checking the number and types of animal products according to the goods owner’s registration records;

b) Checking the status of packaging, product preservation and organoleptic checking of animal products, checking the mark of slaughter control and stamp of veterinary hygiene inspection for fresh products after slaughter;

c) Taking samples for test of veterinary hygiene norms for animal products having no test of veterinary hygiene norms as prescribed or without mark of slaughter control and stamp of veterinary hygiene inspection at the goods owner’s request (if any);

dd) Marking and sealing the packing of animal products which are eligible for veterinary hygiene;

5. After the quarantine, if the animal products are eligible for veterinary hygiene, the quarantine officer shall:

a) Issue the quarantine certificate for the animal products are eligible for veterinary hygiene within 24 hours before transporation;

b) As specified at Point b and c, Clause 5, Article 4 of this Regulation;

c) During the day of loading and unloading, the quarantine officer shall check and monitor the process of loading and unloading the animal products onto the means of transportation; sealing means of transportation; performing or monitoring the cleaning and disinfection of isolated quarantine area and place of loading and unloading.

6. Where the animal products do not ensure the veterinary hygiene requirements, the animal quarantine shall not issue the quarantine certificate and handle the case as prescribed.

Article 6. Quarantine of animals transported out of provinces:

1. When transporting animals in large quantities out of provinces (under the provisions on quantity of animals to be quarantined and exempt from quarantine in Decision No. 47/2005/QD-BNN of the Minister of Agriculture and Rural Development), the goods owner must register the quarantine with the Sub-Department of Veterinary Medicine and carry out the quarantine as specified in Clause 1, 2 and 3, Article 4 of this Regulation;

2. Checking the animalss after they are taken to the isolated quarantine area:

b) Taking samples for test of diseases before transport of animals they are not tested for diseases as prescribed; the diseases at the goods owner’s request (if any);

c) Vaccinating or applying other preventive measures: Diseases in the list of diseases to vaccinated upon transportation of animals if they have no certificate of vaccination or the vaccination certificate is invalid; the diseases at the goods owner’s request (if any);

3. After performing the quarantine, the quarantine officer shall comply with the provisions of Clause 5 and 6, Article 4 of this Regulation.

Article 7. Quarantine of animal products transported out of provinces:

1. When transporting animals in large quantities out of provinces (under the provisions on quantity of animals to be quarantined and exempt from quarantine in Decision No. 47/2005/QD-BNN of the Minister of Agriculture and Rural Development), organizations and individuals must register the quarantine with the Sub-Department of Veterinary Medicine and carry out the quarantine as specified in Clause 1, 2 and 3, Article 5 of this Regulation;

2. Checking the animal products after they are taken to the isolated quarantine area:

a) As specified at Points a, b,d, dd, Clause 4, Article 5 of this Regulation;

b) Taking samples for test of veterinary hygiene norms for animal products having no prescribed tests; the veterinary hygiene norms at the goods owner’s request (if any);

3. After performing the quarantine, the quarantine officer shall comply with the provisions of Clause 5 and 6, Article 4 of this Regulation.

Quarantine officer at wholesale animal quarantine Stations shall:

1. Check the quarantine records including quarantine certificate and other relevant papers;

2. Check the number and types of animal and animal products under quarantine certificate, code of animals; mark of slaughter control, sanitary veterinary stamps, seal of means of transportation and containing equipment and packing;

3. Check the status of animal health, veterinary sanitation state of animal products;

4. Check the veterinary sanitation state of means of transportation and related items during transport;

5. Affix certification mark on the back of the quarantine certificate for the animals and animal products having valid quarantine certificate, means of transportation, and other related items to ensure veterinary hygiene requirements.

6. Cases to be handled:

a) Means of transportation and other relevant items do not ensure the veterinary hygiene requirements, the quarantine officer shall make a record and temporarily suspend the transport and require the goods owner to implement the remedial measures:

After the handling, if the means of transportation and other relevant items meet the veterinary hygiene requirements, the quarantine officer shall make certification on the back of quarantine certificate and allow the continued transport;

b) Disinfecting means of transportation or other relevant items in case the means of transportation of animals and animal products go through infected areas;

c) Other cases shall apply handling measures as prescribed depending on each specific case.

Article 9. Quarantine of animals and animal products at destination

1. The animal quarantine agency at the destination only carry out the animal quarantine and animal products in the following cases:

a) There is no quarantine certificate of the animal quarantine agency at the place of origin;

b) There is quarantine certificate of the animal quarantine agency at the place of origin but it is invalid or expired.

c) The animal quarantine agency at the place of origin fraudulently exchanges, takes more or less animals and animal products or changes packaging containing animal products without permission of animal quarantine agency;

d) The animal quarantine agency at the place of origin has found that the animals have signs of disease or suspected infectious disease;

2. Contents of quarantine of animals and animal products at destination: comply with the provisions in Clause 2 and 3, Article 6 for animals or Clause 2 and 3, Article 7 for animal products of this Regulation.

Article 10. Quarantine of exported

1. The goods owner must register the quarantine with the competent animal quarantine agency as specified at Point a, Clause 3, Article 30 of Decree No. 33 /2005/ND-CP;

2. The quarantine registration record consists of:

a) As specified in Clause 2, Article 4 of this Regulation;

b) Copy of veterinary sanitary requirement of the goods owner or importing country for exported animals (if any);

c) Copy of sale contract (if any);

d) Other relevant papers (if any);

3. Checking the animals before they are taken to the isolated quarantine area:

a) Checking the contents of quarantine registration and other relevant papers specified in Clause 2 of this Article;

c) Within 05 days after the receipt of valid quarantine registration record, the animal quarantine authority shall enter a record in quarantine registration book and inform the time, location and contents of quarantine;

d) Performing as specified at Point Article, dd, Clause 3, Article 4 of this Regulation.

4. Checking the animals after they are taken to the isolated quarantine area:

a) As specified at Point a, b, e, formulas with special medical purposes for infants up to 12 months, Clause 4, Article 4 of this Regulation;

b) Taking samples for test; vaccinating or applying other preventive measures as specified at Point b, c, Clause 2, Article 6 of this Regulation and other diseases at the request of the goods owner or importing country.

5. After checking, the quarantine officer shall comply with the provisions of Clause 5 and 6, Article 4 of this Regulation;

6. Where the goods owner or the importing country does not require the exporting quarantine, the animal quarantine agency shall perform the quarantine as specified in Article 4 or 6 of this Regulation depending on the place of origin of animals.

Article 11. Quarantine of exported animal products

1. When exporting the animal products, the goods owner must register the quarantine with the animal quarantine agency under the provisions in Clause 1, Article 10 of this Regulation;

a) As specified in Clause 2, Article 5, Point c, Article, Clause 2, Article 10 of this Regulation;

b) Copy of veterinary sanitary requirement of the goods owner or importing country for exported animals (if any);

3. Checking the animal products before they are taken to the isolated quarantine area:

a) Checking the registration contents and relevant papers specified in Clause 2 of this Article;

b) Based on the veterinary hygiene requirements for animal products of the goods owner or exporting country, the testing result of veterinary hygiene norms, the animal quarantine agency shall prepare necessary conditions to conduct quarantine;

c) Within 05 days after the receipt of valid quarantine registration record, the animal quarantine authority shall enter a record in quarantine registration book and inform the time, location and contents of quarantine;

d/ As specified at Point d and dd, Clause 3, Article 5 of this Regulation;

4. Checking the animal products after they are taken to the isolated quarantine area:

a) As specified at Point a, b, d, e and f, Clause 4, Article 5 of this Regulation;

5. After checking, the quarantine officer shall comply with provisions in Clause 5 and 6, Article 5 of this Regulation;

6. Where the goods owner or the importing country does not require the exporting quarantine, the animal quarantine agency shall perform the quarantine as specified in Article 5 or 7 of this Regulation depending on the place of origin of animals.

Article 12. Quarantine of exported animals and animal products at exporting border gate

The animal quarantine agency shall:

1. As specified in Clause 1, 2 and 3, Article 8 of this Regulation;

2. If the quarantine record is valid, the animals are healthy, the animal products ensure the veterinary hygiene requirements, are packed and preserved as prescribed, the animal quarantine agency at border gate shall perform procedures to permit the exporting or change the quarantine certificate upon the request of goods owner or importing country;

Where finding the animals or animal products do not ensure the veterinary hygiene standards, the animal quarantine agency at border gate shall handle the case as prescribed;

3. Performing or supervising the cleaning, disinfection at place of loading and unloading, means of transportation, fillers, animal waste and related instruments after transport.

Article 13. Quarantine of animals and animal products by post

2. The content of quarantine is as follows:

a) For animal: Clinically examining, checking animal health book (if any), performing tests and vaccinating against diseases at the request of the goods owners or importing country;

b) For animal products: Organoleptically checking and performing tests of veterinary hygiene at the request of good owner or importing country.

c) Guiding the goods owners to keep their animals and pack the animal products as prescribed, seal or mark consignment and issue the quarantine certificate of animals and animal products that are eligible for veterinary hygiene, kept and packed as prescribed;

d) Guiding the goods owner to deal with the animals and goods products that are eligible for veterinary hygiene for export.

3. Where the goods owner or the importing country does not require the exporting quarantine, depending on the quantity of animals and animal products and place of origin of animals and animal products, the animal quarantine agency shall perform the quarantine as prescribed.

4. Prohibited export by post

a) Animals and animal products in the List of prohibited export as prescribed;

b) Fresh and primary processing animal products.

Article 14. Quarantine registration of imported animals and animal products

1. The goods owner wishing to import the animals and animal products in the List of animals and animal products subject to quarantine or strange animals and animal products not existing in Vietnam must register exporting quarantine with the Department of Veterinary Medicine. The record consists of:

a) Application for importing quarantine under prescribed form;

b) Notarized copy of business registration certificate (for enterprise);

c) License of specialized management agency as prescribed;

d) Documents related to the quarantine of imported animals and animal products;

Within 07 days (excluding days-off) after the receipt of valid record, based on the disease status of animal of the exporting country and in the country, the Department of Veterinary Medicine shall reply with approval or disapproval and guide the importing quarantine.

2. After getting the approval from the Department of Veterinary Medicine, the goods owner shall register the quarantine with the animal quarantine agency appointed by the Department of Veterinary Medicine as specified at Point b, Clause 3, Article 30 of Decree No. 33/2005/ND-CP;

The importing quarantine registration record consists of:

b) The written approval of Department of Veterinary Medicine on quarantine of imported animals and animal products;

c) The copy of quarantine certificate of exporting country (if any);

d) Other relevant papers (if any);

3. Within 05 days after the receipt of valid quarantine registration record, the animal quarantine agency shall inform the goods owner of the location, time and contents of quarantine; check the veterinary hygiene at the isolated quarantine area for the batch of goods carried to the isolated quarantine area for quarantine.

Article 15. Quarantine of imported animals and animal products at importing border gate

The animal quarantine agency shall:

1. Check the importing quarantine record:

a) The importing quarantine record as specified at Point a, b and d, Clause 2, Article 14 of this Regulation;

b) The quarantine certificate of exporting country (the original);

2. Checking the status of imported goods; making comparison with the quarantine certificate of the exporting country about the number and types of imported goods;

3. Checking the veterinary hygiene conditions and disinfection for means of transportation; performing or supervising the goods owner to treat waste and filler generated during transport;

4. If the imported goods ensure the veterinary hygiene requirements, the veterinary certificate and other valid relevant papers, the animal quarantine agency shall perform the importing quarantine procedures so that the goods owner can perform the customs procedures;

5. Giving the goods owner requirements necessary during the transportation of goods from border gate to the isolated quarantine area. For imported animals for slaughter, they shall be carried to the appointed slaughter establishment or isolated captivity area for slaughtering;

6. For imported animals and animal products without performing customs procedures at importing border gate but at another border gate or customs clearance, the animal quarantine agency at the importing border gate shall:

a) As specified in Clause 1, 2, 3 and 4 of this Article;

b) Supervising the process of loading and unloading of animals and animal products onto means of transportation;

c) Sealing means of transportation of animals and animal products;

d) Performing or supervising the cleaning and disinfection at the concentration place for loading and unloading of animals and animal products;

7. Where the imported animals and animal products do not meet the veterinary hygiene requirements, the animal quarantine agency shall handle the case as prescribed.

Article 16. Quarantine of imported animals at isolated quarantine area

1. At least 10 days before import, the animal quarantine agency must check the veterinary hygiene conditions of isolated quarantine area;

a) Guiding the owner of isolated quarantine area to finish items to meet the veterinary hygiene requirements; do the cleaning and disinfecting the isolated quarantine area and related instruments at least 06 days before the import of animal.

b) Checking the health record of animal care staff during the isolated quarantine;

c) Issuing the veterinary hygiene certificate for isolated quarantine area;

2. During the day of animal entry into isolated quarantine area:

a) Guiding the goods owner to carry the animals to isolated quarantine area; do the cleaning and disinfecting means of transporation and related instruments, filler and waste of animal during transport;

b) Checking the quarantine record certified at the animal quarantine agency of importing border gate;

3. Within 03 days after the animals are concentrated in the isolated quarantine area, the animal quarantine authority shall carry out the quarantine:

a) As specified at Point a, b, e, f, Clause 4, Article 4 of this Regulation;

b) Taking samples for test of diseases as prescribed; the diseases at the goods owner’s request (if any);

c) Vaccinating or applying other preventive measures (excluding animals for slaughter) for diseases in the List of diseases to be vaccinated; the diseases at the goods owner’s request (if any);

4. Upon the end of quarantine time, if the animals are eligible for veterinary hygiene, have been vaccinated or applied with other preventive measures and immunity, the quarantine officer shall:

a) As specified at Point b, c and Article, Clause 5, Article 4 of this Regulation;

b) Issue the importing quarantine certificate to put the animals eligible for veterinary hygiene into production and use with permission within 24 hours before transporting them to the destination;

c) Inform the veterinary authority of destination of disease status of animals, the result of disease testing and vaccination result and other information;

5. Where the animals do not ensure the veterinary hygiene requirements, the animal quarantine authority shall not issue the quarantine certificate and handle the case as prescribed;

1. At least 05 days before export, the animal quarantine authority must check the veterinary hygiene conditions of the isolated quarantine area and perform the provisions at Point a, b and d, Clause 1, Article 16 of this Regulation;

2. During the day of animal products entry into isolated quarantine area:

a) Guiding the goods owner to carry the animal products to isolated quarantine area; do the cleaning and disinfecting means of transporation and related instruments, filler and waste of animal during transport;

b) Performing as specified at Point b and c, Clause 2, Article 16 of this Regulation;

3. Within 02 days after the animal products are concentrated in the isolated quarantine area, the animal quarantine authority shall carry out the quarantine of goods:

a) As specified at Point a, d and dd, Clause 4, Article 5 of this Regulation;

b) Checking the status of packaging, product preservation and organoleptically checking animal products;

c) Taking samples for test of veterinary hygiene norms as prescribed; the veterinary hygiene norms at the owner’s requests (if any);

4. After the quarantine, if the animal products are eligible for veterinary hygiene, the quarantine officer shall:

b) Issue the importing quarantine certificate to put the animal products eligible for veterinary hygiene into production and use with permission within 24 hours before transporting them to the destination;

5. Where the animal products do not ensure the veterinary hygiene requirements, the animal quarantine authority shall not issue the quarantine certificate and handle the case as prescribed;

Article 18. Quarantine of imported animals and animal products sent by post

1. The goods owner must register the importing quarantine with the Department of Veterinary Medicine as prescribed in Clause 1 and 2, Article 14 of this Regulation;

2. Within 02 days after the receipt of valid quarantine registration record, the animal quarantine authority shall enter a record in quarantine registration book and inform the time, location and contents of quarantine;

3. Contents of quarantine:

a) Checking the quarantine record as specified at Point a and b, Clause 2, Article 15 of this Regulation;

b) Checking the goods status at the post office in the presence of goods owner and postal employee, making comparison with quarantine certificate of the exporting country;

c) Taking samples for test, vaccinating against diseases as prescribed or at the goods owner’s request (if any);

4. Where the animals do not ensure the veterinary hygiene requirements, the animal quarantine authority shall not issue the quarantine certificate and handle the case as prescribed;

5. Prohibited import by post:

a) Fresh and primary processing animal products and products with animal origin (excluding technology products such as felt, wool, fur clothing, bone, horn and ivory handicrafts);

b) Animals and animal products in the List of animals and animal products of prohibited import as prescribed;

Article 19. Quarantine of carried-along imported animals and animal products

When carrying the animals and animal products along from abroad into Vietnam, the goods owner shall:

1. Register the importing quarantine with the animal quarantine authority of border gate and fill in the entry and exit declaration upon carrying along with the quantity as follows:

a) Animals: No more than 02 units as pet or for family living activities, from traveling, business trip or in transit but not in the List of animals banned from import and export as prescribed;

b) Animal products: No more than 05 kg for cooked foods of animal origin or products of animal origin industrially processed for business and not in the List of animal products banned from export and import as prescribed.

3. The goods owner must register the importing quarantine with the Department of Veterinary Medicine when carrying along the animals and animal products with the number and quantity exceeding the number and quantity specified in Clause 1 of this Article; in the List of animal products banned from export and import as prescribed.

4. Seriously prohibiting the carry-along of fresh and primary processing animal products;

5. The contents of quarantine of animals and animal products are specified in Clause 1 of this Article:

a) For animal: Clinically examining, checking animal health book issued from place of origin of animal, the quarantine certificate of exporting country (if any); clinically checking the animals; testing or vaccinating against diseases (if necessary);

b) Animal products: Checking the quarantine certificate of the exporting country; checking the status of imports, making comparison with the quarantine certificate of the exporting country; organoleptically checking the packaging status of animal products;

c) Issuing the importing quarantine certificate for the animals and animal products eligible for veterinary hygiene so that the goods owner can perform customs procedures;

d) Making record and immediately destroying at the area nearby border gate for animals infected or with suspected infectious diseases, animal products not eligible for veterinary hygiene;

dd) Where the quarantine certificate of exporting country is not valid, the animal quarantine authority at the border gate shall make record to temporarily seize the goods as prescribed.

Section IV. PROCESS AND PROCEDURES FOR QUARANTINE OF ANIMALS AND ANIMAL PRODUCTS OF TEMPORARY IMPORT FOR RE-EXPORT, TEMPORARY EXPORT FOR RE-IMPORT, TRANSFER OF BORDER GATE AND IN TRANSIT OF VIETNAMESE TERRITORY

1. The goods owner having request for temporary import for re-export, transfer of border gate and in transit of Vietnamese territory of animals and animal products must register the quarantine with the Department of Veterinary Medicine. The registration for quarantine shall comply with the provisions in Clause 1, Article 14 of this Regulation;

2. After being approved by the Department of Veterinary Medicine, the goods owner must register with the animal quarantine authority appointed by the Department of Veterinary Medicine as prescribed at Point c, Clause 3, Article 30 of Decree No. 33/2005/ND-CP;

The quarantine registration record consists of:

a) The quarantine registration under the prescribed form;

b) The written approval from the Department of Veterinary Medicine on the quarantine of animals and animal products of temporary import for re-export, transfer of border gate and in transit of Vietnamese territory;

c) The copy of quarantine certificate of exporting country (if any);

d) Other relevant papers (if any);

Within 05 days after the receipt of valid quarantine registration record, the animal quarantine authority shall inform the goods owner of the location, time and contents of quarantine;

Article 21. Quarantine of animals and animal products of temporary export for re-import

2. Quarantine of animals and animal products of temporary import under regulations on quarantine of imported animals and animal products;

Article 22. Quarantine of animals and animal products of temporary import for re-export

1. At importing border gate, the animal quarantine authority shall:

a) Check the quarantine record specified in Clause 2, Article 20 of this Regulation;

b) As specified in Clause 2, 3 and 7, Article 15 of this Regulation;

c) If the quarantine record is valid, the animals and animal products ensure the veterinary hygiene requirements, the animal quarantine authority at border gate shall certify or issue the quarantine certificate to the goods owner for customs procedures;

d) Supervise the process of loading and unloading of animals and animal products onto means of transportation;

dd) Seal means of transportation of animals and animal products;

e) Perform or supervise the cleaning and disinfection at the concentration place for loading and unloading of animals and animal products;

2. At the exporting border gate, the animal quarantine authority shall:

a) As specified in Clause 1, 3 and 4 Article 12 of this Regulation;

b) If the quarantine record is valid and the animals and animal products ensure the veterinary hygiene requirements, the animal quarantine authority at border gate shall certify the goods exported out of Vietnam so that the goods owner performs customs procedures.

Article 23. Quarantine of animals and animal products upon transfer of border gate

1. In case of transfer of border gate with the storage at bonded warehouse but without transportation in the Vietnamese territory;

a) Performing as specified in Clause 1, 2, 4 and 7, Article 15 of this Regulation;

b) Performing the supervision of animals and animal products during the storage in the bonded warehouse;

c) During the day of goods exporting, the animal quarantine authority at border gate shall supervise the loading of animals and animal products onto means of transportation;

d) Performing or supervising the cleaning and disinfection of warehouse, storage and place of loading and unloading, means and instrument of loading and unloading of animals and animal products;

Article 24. Quarantine of animals and animal products in transit of Vietnamese territory

1. At the importing border gate, the animal quarantine authority shall:

a) As specified in Clause 1, Article 22 of this Regulation;

b) Check the implementation of provisions notified in advanced to the goods owner;

c) Seal and seal with lead means of transportation of animal products;

2. During the transport in Vietnamese territory.

a) The goods owner must strictly comply with regulations of animal quarantine authority during the transport of animals and animal products in Vietnamese territory.

b) The means of transportation must ensure the veterinary hygiene conditions and safety in terms of technical equipment, without scattering waste during transport;

c) It is prohibited to arbitrarily load and unload or dismantle means of transportation without permission of the competent veterinary authority. The change of means of transportation of during transport must be approved by the customs authority and competent veterinary authority;

Where the means of transportation moves on the improper route or parks or stops at improper places, the goods owner must keep the goods on means of transportation in tact and notify the nearest veterinary authority. After the veterinary authority implements measures as prescribed, the means of transportation shall be allowed to move on;

e) The animals are only allowed to eat in the Vietnamese territory or other special cases allowed and supervised by the competent veterinary authority to prevent the contact between these animal with the domestic animals;

f) Animal carcasses, filler, animal leftovers, packaging and other waste during transport should not put down on the railway station, port or on way of transport but must be treated at locations under the guidance of competent veterinary authority.

3. At the exporting border gate, the animal quarantine authority of border gate shall comply with provisions specified in Clause 2, Article 22 of this Regulation.

Article 25. Quarantine of animals and animal products in transit of Vietnamese territory transported in containers or means with seal.

1. Checking the quarantine record as prescribed in Clause 1, Article 22 of this Regulation;

2. Checking seal, lead seal and veterinary hygiene conditions of means of transporation;

3. If the quarantine record is valid and means of transportation ensures the veterinary hygiene requirements, the animal quarantine authority shall certify the quarantine and allow for the cross-border movement of goods;

4. Where finding that the animals and animal products or means of transportation, seal or lead seal have abnormal signs, the animal quarantine authority shall:

b) Location for opening the container must ensure the veterinary hygiene conditions, be convenient for loading and unloading of goods and prescribed by the competent veterinary authority;

c) Where the animals and animal products do not ensure the veterinary hygiene conditions, the animal quarantine authority at border gate shall handle the case under the provisions in Article 3 of this Regulation;

d) Means of transportation and related items do not ensure the veterinary hygiene conditions, the animal quarantine authority at border gate shall require the goods owner to take remedial measures or change means of transportation or replace the accompanying instruments.

5. Performing or supervising the cleaning and disinfection of means of transportation and related items, place of loading and unloading of animals and animal products.

Section V. PROCESS AND PROCEDURES FOR QUARANTINE OF ANIMALS AT FAIRS, EXHIBITIONS, ART PERFORMANCE, SPORTS COMPETITION; ANIMAL PRODUCTS AT FAIRS AND EXHIBITIONS; SENDING AND RECEIVING MEDICAL WASTE

Article 26. Quarantine of animals at fairs, exhibitions, art performance, sports competition; animal products at fairs and exhibitions

1. The goods owner having animals at fairs, exhibitions, art performance, sports competition; animal products at fairs and exhibitions must comply with the provisions as follows:

a) Domestic animals and animal products must be quarantined under the provisions of Article 4, 5, 6 and 7 of this Regulation;

b) The animals and animal products from foreign countries must be registered for quarantine with the Department of Veterinary Medicine and shall be quarantined by the competent animal quarantine authority as prescribed in Article 14 and 15 of this Regulation;

3. At the concentration place of animals and animal products, the Sub-Department of Veterinary Medicine shall:

a) Check the veterinary hygiene conditions and disinfect at least 03 days before concentration of animals and animal products;

b) Check the quarantine certificate and other relevant papers;

c) Check the quantity, types and status of animal and animal products, compare with the quarantine certificate;

d) Guide the goods owner to carry the animal and animal products to the concentration place;

dd) Perform or supervise the cleaning, disinfection at place of loading and unloading, means of transportation, fillers and animal waste during the transport.

e) Monitor the animal and animal products during the time of fairs, exhibitions, art performance and sports competition;

4. After the time of concentration at the fairs, exhibitions, art performance and sports competition:

a) The Sub-Department of Veterinary Medicine shall perform or supervise the cleaning and disinfection of entire concentration area of animal and animal products;

c) If the goods owner requests to export the animal and animal products out of Vietnam, he/she must perform the procedures for exporting quarantine specified in Article 10 and 11 of this Regulation;

d) If the animal and animal products are not eligible for veterinary hygiene conditions, the handling measures shall apply as prescribed;

Article 27. Sending and receipt of medical waste

1. The goods owner wishing to send medical waste abroad or import it into Vietnam must register the quarantine with the Department of Veterinary Medicine;

2. After getting the approval from the Department of Veterinary Medicine, the goods owner must register the quarantine with the animal quarantine authority appointed by the Department of Veterinary Medicine at least 05 days before receipt or sending of medical waste;

3. Sending of medical waste

The animal quarantine authority shall:

a) Check document of the Department of Veterinary Medicine concerning the permission for quarantine of exported medical waste and other relevant papers;

Supervise the sampling of medical waste; pack and preserve it to avoid spillage, break and spread pathogens during the transport;

c) Issue the quarantine certificate for medical waste packed and preserved to ensure the veterinary hygiene requirements;

4. Receipt of medical waste

The animal quarantine authority at border gate shall:

a) Check document of the Department of Veterinary Medicine concerning the permission for quarantine of exported medical waste and other relevant papers;

b) Check the status of packing and preservation of medical waste;

c) Give certification so that the goods owner can perform customs procedures when the record is valid, the medical waste is packed and preserved to ensure the veterinary hygiene requirements;

d) Where finding that the medical waste is imported into Vietnam without permission of the Department of Veterinary Medicine or the packing or preservation does not ensure the veterinary hygiene requirements and is at risk of spread of pathogens and environmental pollution, the animal quarantine authority at border gate shall make record and destroy all medical waste in the area nearby border gate;

Chapter 3:

PROCESS AND PROCEDURES FOR VETERINARY HYGIENE INSPECTION

1. Organizations and individuals wish to set up concentrated raising establishment, breed production establishment, slaughter establishment, animal product preservation and production establishment, isolated quarantine area, animal and animal product concentration place, animal and animal products trading shop; production establishment of veterinary drug, biological products, microorganisms, chemicals used in veterinary medicine (hereinafter referred to as establishment) must register the appraisal of veterinary hygiene conditions with the competent veterinary authority under the provisions of Article 43 of Decree No. 33/2005/ND-CP

The registration record consists of:

a) Document requesting for site survey to set up establishment;

b) Investment project or plan for the construction of establishment and technical design;

c) Other papers related to the set-up of establishment.

2. Within 07 days after the receipt of valid record, the veterinary authority shall survey the veterinary hygiene conditions over the site for set-up of establishment, assess the relevant technical indicators and reply in writing;

a) If ensuring the veterinary hygiene requirements, the competent veterinary authority shall send document to the owner of establishment as a basis for the competent authority to allow the set-up and investment in establishment construction;

b) If failing to ensure the veterinary hygiene requirements, the owner of establishment shall correct and remedy the unsatisfactory contents and request for re-inspection.

Article 29. Inspection of veterinary hygiene conditions of establishment

The registration record consists of:

a) Registration for inspection of veterinary hygiene conditions under the prescribed form;

b) Investment certificate or business license (notarized copy);

c) Other papers related to the set-up of establishment.

2. Within 05 days after the receipt of valid record, the competent veterinary authority must conduct the inspection of veterinary hygiene conditions and standards over the establishment;

a) Checking the implementation of provisions on veterinary hygiene conditions;

b) Checking technical standards on veterinary hygiene conditions;

3. Within 10 days (from the day of inspection), the competent veterinary authority shall reply the result of inspection of veterinary hygiene conditions and standards;

a) If the establishment ensures the veterinary hygiene conditions and standards, the competent veterinary authority shall issue the Certificate of veterinary hygiene conditions to the establishment. This Certificate is valid for 02 years from the date of issue;

4. Where the establishment temporarily stops its operation, the owner must inform the competent veterinary authority;

5. Before the expiration of Certificate of veterinary hygiene conditions or where the establishment temporarily stops its operation for 03 months or more, when it resumes its operation, the owner must register at least 15 days in advance with the competent veterinary authority as prescribed at Point a, Clause 1 of this Article for inspection of veterinary hygiene conditions of the establishment;

For the establishment of slaughter, preliminary processing and preservation of animal products, during the periodic inspection, the competent veterinary authority shall take sample for test of veterinary hygiene standards of establishment’s products.
