VỀ BẢO VỆ MÔI TRƯỜNG CỤM CÔNG NGHIỆP, KHU KINH DOANH, DỊCH VỤ TẬP TRUNG, LÀNG NGHỀ VÀ CƠ SỞ SẢN XUẤT, KINH DOANH, DỊCH VỤ

Căn cứ Luật Bảo vệ môi trường ngày 23 tháng 6 năm 2014;

Căn cứ Nghị định số 19/2015/NĐ-CP ngày 14 tháng 02 năm 2015 của Chính phủ quy định chi tiết thi hành một số điều của Luật Bảo vệ môi trường;

Căn cứ Nghị định số 38/2015/NĐ-CP ngày 24 tháng 4 năm 2015 của Chính phủ về quản lý chất thải và phế liệu;

Căn cứ Nghị định số 21/2013/NĐ-CP ngày 04 tháng 3 năm 2013 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Tài nguyên và Môi trường;

Theo đề nghị của Tổng cục trưởng Tổng cục Môi trường và Vụ trưởng Vụ Pháp chế;

Bộ trưởng Bộ Tài nguyên và Môi trường ban hành Thông tư về bảo vệ môi trường cụm công nghiệp, khu kinh doanh, dịch vụ tập trung, làng nghề và cơ sở sản xuất, kinh doanh, dịch vụ.

Chương I

QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Thông tư này quy định chi tiết Điều 67, Điểm đ Khoản 1 Điều 68, Điều 101, Điều 108, Khoản 2 Điều 121, Khoản 3 Điều 123, Khoản 3 Điều 125, Khoản 1 Điều 130 Luật Bảo vệ môi trường; Khoản 1 và Khoản 4 Điều 20 Nghị định số 19/2015/NĐ-CP ngày 14 tháng 02 năm 2015 của Chính phủ quy định chi tiết thi hành một số điều của Luật Bảo vệ môi trường (sau đây viết tắt là Nghị định số 19/2015/NĐ-CP); Điều 37, Điều 39, Điểm a và Điểm c Khoản 1 Điều 43 Nghị định số 38/2015/NĐ-CP ngày 24 tháng 4 năm 2015 của Chính phủ về quản lý chất thải và phế liệu (sau đây viết tắt là Nghị định số 38/2015/NĐ-CP); bao gồm:

1. Bảo vệ môi trường cụm công nghiệp; khu kinh doanh, dịch vụ tập trung.

2. Bảo vệ môi trường làng nghề.

3. Bảo vệ môi trường cơ sở sản xuất, kinh doanh, dịch vụ.

Điều 2. Đối tượng áp dụng

Thông tư này áp dụng đối với cơ quan, tổ chức, cá nhân trong nước, nước ngoài có liên quan đến hoạt động bảo vệ môi trường cụm công nghiệp; khu kinh doanh, dịch vụ tập trung; làng nghề; cơ sở sản xuất, kinh doanh, dịch vụ (sau đây viết tắt là cơ sở).

Điều 3. Giải thích từ ngữ

Trong Thông tư này, các từ ngữ dưới đây được hiểu như sau:

1. Chủ đầu tư xây dựng và kinh doanh hạ tầng cụm công nghiệp là các doanh nghiệp, tổ chức, cá nhân được thành lập và hoạt động theo quy định của pháp luật Việt Nam hoặc đăng ký kinh doanh theo quy định của pháp luật Việt Nam trực tiếp đầu tư xây dựng, quản lý, kinh doanh kết cấu hạ tầng cụm công nghiệp.

2. Khu kinh doanh, dịch vụ tập trung là siêu thị; trung tâm thương mại; chợ; khu du lịch, thể thao, vui chơi giải trí; bến xe khách; nhà ga đường sắt thuộc đối tượng phải lập báo cáo đánh giá tác động môi trường.

3. Ban quản lý khu kinh doanh, dịch vụ tập trung là các doanh nghiệp, tổ chức, cá nhân được thành lập và hoạt động theo quy định của pháp luật Việt Nam hoặc đăng ký kinh doanh theo quy định của pháp luật Việt Nam trực tiếp đầu tư xây dựng, quản lý, kinh doanh kết cấu hạ tầng khu kinh doanh, dịch vụ tập trung.

4. Cụm công nghiệp, khu kinh doanh, dịch vụ tập trung, cơ sở đang hoạt động là cụm công nghiệp, khu kinh doanh, dịch vụ tập trung, cơ sở đã có ít nhất một hạng mục, công trình đã đi vào vận hành chính thức.

5. Phương án bảo vệ môi trường là kế hoạch quản lý môi trường được lập và triển khai thực hiện trong toàn bộ quá trình hoạt động của cụm công nghiệp, khu kinh doanh, dịch vụ tập trung, cơ sở đang hoạt động và làng nghề.

Chương II

BẢO VỆ MÔI TRƯỜNG CỤM CÔNG NGHIỆP, KHU KINH DOANH, DỊCH VỤ TẬP TRUNG

Mục 1. BẢO VỆ MÔI TRƯỜNG CỤM CÔNG NGHIỆP

Điều 4. Yêu cầu bảo vệ môi trường trong lập quy hoạch xây dựng cụm công nghiệp

1. Quy hoạch các khu chức năng và loại hình sản xuất trong cụm công nghiệp phải bảo đảm giảm thiểu ảnh hưởng của các loại hình sản xuất gây ô nhiễm với các loại hình sản xuất khác; thuận lợi cho công tác phòng ngừa, ứng phó sự cố môi trường.

2. Quy hoạch xây dựng hạ tầng cụm công nghiệp phải có đầy đủ hạ tầng kỹ thuật bảo vệ môi trường bảo đảm yêu cầu theo quy định tại Khoản 1 Điều 5 Thông tư này.

3. Diện tích cây xanh trong phạm vi cụm công nghiệp tối thiểu chiếm 10% tổng diện tích của toàn bộ cụm công nghiệp.

Điều 5. Yêu cầu về đầu tư xây dựng, quản lý vận hành hạ tầng kỹ thuật bảo vệ môi trường cụm công nghiệp

1. Đầu tư xây dựng hạ tầng kỹ thuật bảo vệ môi trường cụm công nghiệp phải đáp ứng các yêu cầu sau:

a) Hạ tầng kỹ thuật bảo vệ môi trường cụm công nghiệp bao gồm: hệ thống thoát nước mưa, hệ thống thu gom, xử lý nước thải tập trung, khu vực lưu giữ, xử lý chất thải rắn (nếu có).

Hệ thống thoát nước mưa và hệ thống thu gom, xử lý, thoát nước thải phải được tách riêng, thiết kế đồng bộ, bố trí phù hợp với quy hoạch đã được duyệt và tuân theo quy định, quy chuẩn kỹ thuật về xây dựng, quy định, quy chuẩn kỹ thuật môi trường có liên quan;

b) Hệ thống thu gom, xử lý nước thải tập trung cụm công nghiệp có thể đầu tư xây dựng theo từng đơn nguyên (mô-đun) hoặc toàn bộ tương ứng với tiến độ lấp đầy cụm công nghiệp, bảo đảm xử lý đạt quy chuẩn kỹ thuật môi trường toàn bộ nước thải phát sinh trong quá trình hoạt động của cụm công nghiệp;

c) Hệ thống thu gom, xử lý nước thải tập trung cụm công nghiệp bảo đảm các yêu cầu sau: có đồng hồ đo lưu lượng nước thải đầu vào và đầu ra, công tơ điện tử đo điện độc lập; điểm xả thải có biển báo rõ ràng; sàn công tác có diện tích tối thiểu 01 m^2, lối đi thuận tiện cho việc kiểm tra, giám sát của cơ quan quản lý nhà nước có thẩm quyền; có phương án, hạ tầng, phương tiện, thiết bị để ứng phó, khắc phục sự cố trong trường hợp hệ thống thu gom, xử lý nước thải tập trung gặp sự cố;

d) Hệ thống thu gom, xử lý nước thải tập trung cụm công nghiệp có lưu lượng nước thải từ 1.000 m^3/ngày.đêm trở lên phải lắp đặt hệ thống quan trắc tự động, liên tục theo quy định tại Khoản 1, Khoản 3 Điều 26 Thông tư này;

đ) Trường hợp cụm công nghiệp có phương án tự thu gom, xử lý chất thải rắn thì thực hiện theo quy định của pháp luật về thu gom, xử lý chất thải rắn.

2. Quản lý vận hành công trình hạ tầng kỹ thuật bảo vệ môi trường cụm công nghiệp phải đáp ứng các yêu cầu sau:

a) Hệ thống thu gom, xử lý nước thải tập trung phải vận hành thường xuyên theo đúng quy trình công nghệ để bảo đảm nước thải được xử lý đạt quy chuẩn kỹ thuật môi trường trước khi thải ra nguồn tiếp nhận;

b) Việc vận hành hệ thống thu gom, xử lý nước thải tập trung phải có nhật ký vận hành ghi chép đầy đủ các nội dung: lưu lượng, các thông số đặc trưng của nước thải đầu vào và đầu ra (nếu có); lượng điện tiêu thụ; loại và lượng hóa chất sử dụng, bùn thải phát sinh. Nhật ký vận hành viết bằng tiếng Việt và lưu giữ tối thiểu 02 năm;

c) Hệ thống thu gom, xử lý nước thải tập trung phải duy tu, bảo dưỡng định kỳ, bảo đảm luôn vận hành bình thường;

d) Không pha loãng nước thải trước điểm xả thải quy định tại Điểm c Khoản 1 Điều này;

đ) Bùn cặn của hệ thống thu gom, xử lý nước thải tập trung, hệ thống thoát nước mưa của cụm công nghiệp phải thu gom, vận chuyển và xử lý hoặc tái sử dụng theo quy định của pháp luật về quản lý bùn thải.

3. Các trường hợp được miễn trừ đấu nối vào hệ thống thu gom, xử lý nước thải tập trung của cụm công nghiệp:

a) Cơ sở phát sinh nước thải vượt quá khả năng tiếp nhận, xử lý của hệ thống thu gom, xử lý nước thải tập trung cụm công nghiệp, đồng thời cơ sở có biện pháp xử lý nước thải đạt quy chuẩn kỹ thuật môi trường;

b) Cơ sở trong cụm công nghiệp mà cụm công nghiệp chưa có hệ thống thu gom, xử lý nước thải tập trung, đồng thời cơ sở có biện pháp xử lý nước thải đạt quy chuẩn kỹ thuật môi trường.

Điều 6. Trách nhiệm của cơ sở trong cụm công nghiệp

1. Xử lý nước thải:

a) Ký và thực hiện biên bản, hợp đồng thỏa thuận với chủ đầu tư xây dựng và kinh doanh hạ tầng cụm công nghiệp về đấu nối nước thải vào hệ thống thu gom, xử lý nước thải tập trung của cụm công nghiệp hoặc ký hợp đồng chuyển giao nước thải để xử lý với cơ sở có chức năng theo quy định tại Điều 20 Thông tư này;

b) Cơ sở được miễn trừ đấu nối quy định tại Khoản 3 Điều 5 Thông tư này phải thực hiện các quy định tại Điều 18 Thông tư này.

2. Thực hiện trách nhiệm quản lý chất thải rắn, khí thải, tiếng ồn, độ rung, ánh sáng, bức xạ theo quy định tại Điều 19 Thông tư này.

3. Thực hiện chương trình quan trắc môi trường của cơ sở theo quy định và thông báo kết quả cho chủ đầu tư xây dựng và kinh doanh hạ tầng cụm công nghiệp để tổng hợp báo cáo cơ quan có thẩm quyền. Thông báo cho chính quyền địa phương, cơ quan chuyên môn về bảo vệ môi trường, đồng thời thông báo cho chủ đầu tư xây dựng và kinh doanh hạ tầng cụm công nghiệp khi xảy ra sự cố môi trường và thực hiện việc ứng phó, khắc phục sự cố môi trường theo quy định của pháp luật.

Điều 7. Trách nhiệm của chủ đầu tư xây dựng và kinh doanh hạ tầng cụm công nghiệp

1. Đầu tư xây dựng và quản lý, vận hành các công trình hạ tầng kỹ thuật bảo vệ môi trường cụm công nghiệp theo quy định tại Điều 5 Thông tư này.

2. Không được mở rộng cụm công nghiệp, tiếp nhận thêm dự án đầu tư vào cụm công nghiệp trong trường hợp cụm công nghiệp chưa có công trình hạ tầng kỹ thuật bảo vệ môi trường theo quy định tại Điều 5 Thông tư này.

3. Nộp các loại phí bảo vệ môi trường theo quy định của pháp luật.

4. Bố trí ít nhất 01 cán bộ phụ trách bảo vệ môi trường có trình độ đại học trở lên thuộc một trong các chuyên ngành: quản lý môi trường; khoa học, công nghệ, kỹ thuật môi trường; hóa học; sinh học. Cán bộ phụ trách bảo vệ môi trường được tập huấn định kỳ hàng năm về công tác phòng ngừa, ứng phó sự cố môi trường.

5. Xây dựng và tổ chức thực hiện phương án bảo vệ môi trường theo quy định tại Chương V Thông tư này.

6. Tổng hợp, báo cáo kết quả quan trắc môi trường, công tác bảo vệ môi trường cụm công nghiệp, các cơ sở trong cụm công nghiệp gửi Sở Tài nguyên và Môi trường trước ngày 31 tháng 12 hàng năm. Mẫu báo cáo quy định tại Phụ lục 1 ban hành kèm theo Thông tư này.

Điều 8. Trách nhiệm của Ủy ban nhân dân cấp huyện

1. Chỉ đạo đơn vị trực thuộc có chức năng phù hợp đầu tư xây dựng, quản lý và vận hành hạ tầng kỹ thuật bảo vệ môi trường cụm công nghiệp theo quy định tại Điều 5 Thông tư này trong trường hợp chưa xác định được chủ đầu tư xây dựng và kinh doanh hạ tầng cụm công nghiệp theo quy định của pháp luật.

2. Chỉ đạo các đơn vị chức năng không tiếp nhận các dự án đầu tư mới vào cụm công nghiệp chưa có hạ tầng kỹ thuật bảo vệ môi trường theo quy định tại Điều 5 Thông tư này trên địa bàn quản lý.

3. Kiểm tra, thanh tra việc xây dựng hạ tầng kỹ thuật bảo vệ môi trường cụm công nghiệp trên địa bàn theo quy định của pháp luật.

Điều 9. Trách nhiệm của Ủy ban nhân dân cấp tỉnh

1. Xem xét, bố trí kinh phí hỗ trợ đầu tư xây dựng hạ tầng kỹ thuật bảo vệ môi trường đối với các cụm công nghiệp trên địa bàn theo quy định của pháp luật.

2. Chỉ đạo các cơ quan chuyên môn, Ủy ban nhân dân cấp huyện, Ủy ban nhân dân cấp xã thực hiện các quy định của pháp luật về bảo vệ môi trường cụm công nghiệp.

Mục 2. BẢO VỆ MÔI TRƯỜNG KHU KINH DOANH, DỊCH VỤ TẬP TRUNG

Điều 10. Quản lý nước thải, chất thải rắn

1. Khu kinh doanh, dịch vụ tập trung phải có biện pháp xử lý đối với toàn bộ nước thải phát sinh từ hoạt động kinh doanh, dịch vụ; có hệ thống thoát nước bảo đảm đủ công suất tiếp nhận nước thải từ các cơ sở kinh doanh, dịch vụ trong khu; quản lý, bảo đảm duy trì ổn định dịch vụ thoát nước theo quy định.

2. Các cơ sở, hộ kinh doanh, dịch vụ phải áp dụng các biện pháp phân loại chất thải rắn, không xả chất thải rắn vào hệ thống thoát nước; chuyển giao chất thải rắn cho các đơn vị có chức năng thu gom, vận chuyển, xử lý theo quy định.

3. Ban quản lý khu kinh doanh, dịch vụ tập trung phải thực hiện bảo vệ môi trường nơi công cộng theo quy định tại Khoản 2 Điều 81 Luật Bảo vệ môi trường.

Điều 11. Cán bộ phụ trách về bảo vệ môi trường khu kinh doanh, dịch vụ tập trung

Ban quản lý khu kinh doanh, dịch vụ tập trung phải bố trí tối thiểu 01 cán bộ phụ trách về bảo vệ môi trường để thực hiện các nội dung của phương án bảo vệ môi trường, trách nhiệm bảo vệ môi trường khác theo quy định.

Chương III

BẢO VỆ MÔI TRƯỜNG LÀNG NGHỀ

Điều 12. Điều kiện về bảo vệ môi trường làng nghề

1. Có phương án bảo vệ môi trường làng nghề theo mẫu tại Phụ lục 2 ban hành kèm theo Thông tư này được Ủy ban nhân dân cấp huyện phê duyệt.

2. Các cơ sở hoạt động trong làng nghề phải:

a) Được cơ quan nhà nước có thẩm quyền phê duyệt báo cáo đánh giá tác động môi trường hoặc xác nhận kế hoạch bảo vệ môi trường hoặc có báo cáo về các biện pháp bảo vệ môi trường theo quy định tại Điều 17 Thông tư này (trừ đối tượng quy định tại mục 1, 2, 3, 4, 6, 7, 9, 10, 11 Phụ lục IV ban hành kèm theo Nghị định số 18/2015/NĐ-CP ngày 14 tháng 02 năm 2015 của Chính phủ quy định về quy hoạch bảo vệ môi trường, đánh giá môi trường chiến lược, đánh giá tác động môi trường và kế hoạch bảo vệ môi trường, sau đây viết tắt là Nghị định số 18/2015/NĐ-CP) hoặc hồ sơ, thủ tục tương đương;

b) Thực hiện các biện pháp thu gom, xử lý nước thải (trong trường hợp không xử lý tập trung), khí thải bảo đảm quy chuẩn kỹ thuật môi trường tương ứng; phân loại chất thải rắn, chuyển cho đơn vị thu gom theo đúng quy định.

3. Có hạ tầng về bảo vệ môi trường làng nghề, bao gồm:

a) Hệ thống thu gom nước thải, nước mưa bảo đảm nhu cầu tiêu thoát nước của làng nghề, không để xảy ra hiện tượng tắc nghẽn, tù đọng nước thải và ngập úng;

b) Hệ thống xử lý nước thải tập trung (nếu có) bảo đảm công suất xử lý đạt quy chuẩn kỹ thuật môi trường tương ứng đối với tổng lượng nước thải phát sinh từ làng nghề trước khi thải ra nguồn tiếp nhận;

c) Điểm tập kết chất thải rắn hợp vệ sinh; khu xử lý chất thải rắn bảo đảm quy định về quản lý chất thải rắn hoặc phương án vận chuyển chất thải rắn đến khu xử lý chất thải rắn nằm ngoài địa bàn.

4. Có tổ chức tự quản về bảo vệ môi trường với các điều kiện sau:

a) Có quyết định thành lập và quy chế hoạt động do Ủy ban nhân dân cấp xã ban hành;

b) Được trang bị phương tiện và bảo hộ lao động đầy đủ.

5. Làng nghề phải đáp ứng các điều kiện về bảo vệ môi trường theo quy định tại Khoản 1, 2, 3 và Khoản 4 Điều này để được xem xét, công nhận làng nghề.

6. Đối với làng nghề đã được công nhận làng nghề trước ngày Thông tư này có hiệu lực thi hành nhưng chưa đáp ứng các điều kiện về bảo vệ môi trường theo quy định tại Khoản 1, 2, 3 và Khoản 4 Điều này thì Ủy ban nhân dân cấp tỉnh chỉ đạo các cơ quan chức năng tổ chức thực hiện việc khắc phục.

Điều 13. Đánh giá, phân loại làng nghề theo mức độ ô nhiễm môi trường

1. Ủy ban nhân dân cấp tỉnh có trách nhiệm tổ chức thực hiện việc đánh giá, phân loại các làng nghề trên địa bàn theo mức độ ô nhiễm môi trường theo tiêu chí đánh giá, phân loại tại Phụ lục 3 ban hành kèm theo Thông tư này.

2. Việc đánh giá, phân loại làng nghề theo mức độ ô nhiễm môi trường được thực hiện định kỳ 02 năm/lần.

3. Danh mục làng nghề được đánh giá, phân loại theo mức độ ô nhiễm môi trường phải công bố trên phương tiện thông tin, truyền thông tại địa phương.

Điều 14. Biện pháp quản lý đối với làng nghề ô nhiễm môi trường và ô nhiễm môi trường nghiêm trọng

1. Ủy ban nhân dân cấp xã điều chỉnh, trình Ủy ban nhân dân cấp huyện phê duyệt và tổ chức thực hiện phương án bảo vệ môi trường làng nghề để khắc phục tình trạng ô nhiễm môi trường làng nghề.

2. Cơ sở không thuộc danh mục ngành nghề được khuyến khích phát triển tại làng nghề phải tuân thủ các quy định đối với cơ sở tại Chương IV Thông tư này hoặc phải hoàn thành một trong các biện pháp sau: di dời vào khu, cụm công nghiệp, khu chăn nuôi tập trung bên ngoài khu dân cư; chuyển đổi ngành nghề sản xuất; chấm dứt hoạt động sản xuất.

3. Không cho phép thành lập mới các cơ sở có nguy cơ gây ô nhiễm môi trường cao, được quy định cụ thể tại Phụ lục 4 ban hành kèm theo Thông tư này.

Điều 15. Trách nhiệm tổ chức thực hiện phương án bảo vệ môi trường làng nghề

1. Trách nhiệm của Ủy ban nhân dân cấp xã:

a) Thực hiện các yêu cầu về bảo vệ môi trường theo nội dung của phương án bảo vệ môi trường làng nghề đã được phê duyệt;

b) Trường hợp xảy ra sự cố môi trường, yêu cầu cơ sở để xảy ra sự cố ngừng hoạt động, thực hiện các biện pháp hạn chế phạm vi, mức độ ảnh hưởng, triển khai các hoạt động khắc phục; thông báo ngay cho Ủy ban nhân dân cấp huyện, Ủy ban nhân dân cấp tỉnh và các cơ quan có liên quan.

2. Trách nhiệm của Ủy ban nhân dân cấp huyện:

a) Bố trí kinh phí đảm bảo thực hiện các nhiệm vụ về bảo vệ môi trường làng nghề trên địa bàn theo quy định của pháp luật;

b) Đôn đốc, hướng dẫn, kiểm tra việc thực hiện các yêu cầu bảo vệ môi trường theo phương án bảo vệ môi trường làng nghề đã được phê duyệt;

c) Tiếp nhận, xử lý kiến nghị về bảo vệ môi trường của các cơ quan, tổ chức, cá nhân có liên quan đến môi trường trong quá trình hoạt động sản xuất của làng nghề theo quy định của pháp luật.

Điều 16. Trách nhiệm của tổ chức tự quản về bảo vệ môi trường làng nghề

Ủy ban nhân dân cấp xã hướng dẫn tổ chức tự quản về bảo vệ môi trường làng nghề thực hiện các nội dung sau:

1. Quản lý, vận hành, duy tu, cải tạo các công trình thuộc hạ tầng bảo vệ môi trường làng nghề theo phân công của Ủy ban nhân dân cấp xã.

2. Niêm yết các quy định và theo dõi, đôn đốc việc giữ vệ sinh nơi công cộng.

3. Tham gia xây dựng, tổ chức thực hiện phương án bảo vệ môi trường làng nghề; hương ước, quy ước có nội dung bảo vệ môi trường; tuyên truyền, vận động nhân dân xóa bỏ các hủ tục, thói quen mất vệ sinh, có hại cho môi trường.

4. Tham gia kiểm tra việc thực hiện quy định về bảo vệ môi trường của cơ sở trong làng nghề theo phân công của Ủy ban nhân dân cấp xã.

5. Kịp thời báo cáo Ủy ban nhân dân cấp xã khi phát hiện dấu hiệu về ô nhiễm môi trường, sự cố môi trường hoặc các hành vi vi phạm quy định pháp luật về bảo vệ môi trường trong làng nghề.

6. Báo cáo Ủy ban nhân dân cấp xã về hiện trạng hoạt động, tình hình thu gom, vận chuyển và xử lý chất thải theo phân công 01 lần/năm trước ngày 15 tháng 10 hàng năm hoặc đột xuất theo yêu cầu. Mẫu báo cáo quy định tại Phụ lục 5 ban hành kèm theo Thông tư này.

Điều 17. Trách nhiệm của các cơ sở trong làng nghề

1. Chủ cơ sở trong làng nghề thuộc danh mục ngành nghề được khuyến khích phát triển tại làng nghề theo quy định tại Phụ lục I ban hành kèm theo Nghị định số 19/2015/NĐ-CP có trách nhiệm:

a) Lập báo cáo về các biện pháp bảo vệ môi trường theo mẫu tại Phụ lục 6 ban hành kèm theo Thông tư này đối với trường hợp quy định tại Khoản 1 Điều 16 Nghị định số 19/2015/NĐ-CP và gửi Ủy ban nhân dân cấp xã để kiểm tra, theo dõi;

b) Tổ chức thực hiện các nội dung về bảo vệ môi trường theo kế hoạch bảo vệ môi trường hoặc báo cáo về các biện pháp bảo vệ môi trường hoặc hồ sơ, thủ tục tương đương.

2. Cơ sở trong làng nghề không thuộc danh mục ngành nghề được khuyến khích phát triển tại làng nghề theo quy định tại Phụ lục I ban hành kèm theo Nghị định số 19/2015/NĐ-CP phải tuân thủ các quy định tại Chương IV Thông tư này và các quy định về bảo vệ môi trường có liên quan.

Chương IV

BẢO VỆ MÔI TRƯỜNG CƠ SỞ SẢN XUẤT, KINH DOANH, DỊCH VỤ

Điều 18. Quản lý nước thải

1. Cơ sở nằm ngoài khu công nghiệp, cụm công nghiệp không thuộc đối tượng quy định tại Khoản 1 Điều 17 Thông tư này mà có hệ thống xử lý nước thải và lưu lượng nước thải từ 30 m^3/ngày.đêm trở lên, ngoài việc thực hiện các quy định của pháp luật về quản lý nước thải thì phải có nhật ký vận hành hệ thống xử lý nước thải được ghi chép đầy đủ, lưu giữ tối thiểu 02 năm.

Nhật ký vận hành phải được viết bằng tiếng Việt, gồm các nội dung: lưu lượng, thông số vận hành hệ thống xử lý nước thải, kết quả quan trắc nước thải đầu vào và đầu ra của hệ thống xử lý nước thải (nếu có), loại và lượng hóa chất sử dụng, lượng bùn thải phát sinh.

2. Cơ sở có lưu lượng nước thải từ 1.000 m3/ngày.đêm trở lên, ngoài việc thực hiện theo quy định tại Khoản 1 Điều này, phải thực hiện thêm các nội dung sau:

a) Giám sát, quan trắc tự động, liên tục nước thải đầu ra theo quy định tại Khoản 1, Khoản 3 Điều 26 Thông tư này;

b) Có công tơ điện tử đo điện độc lập của hệ thống xử lý nước thải, lượng điện tiêu thụ phải được ghi vào nhật ký vận hành;

c) Có phương án, hạ tầng, phương tiện, thiết bị để ứng phó, khắc phục sự cố trong trường hợp hệ thống thu gom, xử lý nước thải gặp sự cố;

d) Có điểm kiểm tra, giám sát xả nước thải vào hệ thống tiêu thoát nước đặt ngoài hàng rào, có lối đi thuận lợi và có biển báo.

3. Đối với cơ sở có lưu lượng nước thải từ 1.000 m^3/ngày.đêm trở lên nằm trong khu công nghiệp, cụm công nghiệp mà được miễn trừ đấu nối vào hệ thống thu gom, xử lý nước thải tập trung thì phải thực hiện việc quản lý nước thải theo quy định tại Khoản 2 Điều này.

4. Trường hợp các cơ sở quy định tại Khoản 1, 2 và Khoản 3 Điều này không tự xử lý nước thải không nguy hại mà chuyển giao nước thải cho cơ sở có khả năng xử lý đạt quy chuẩn kỹ thuật về môi trường thì thực hiện theo quy định tại Điều 20 Thông tư này.

Điều 19. Quản lý chất thải rắn, khí thải, tiếng ồn, độ rung, ánh sáng, bức xạ

1. Cơ sở phải thực hiện việc quản lý chất thải rắn sinh hoạt, chất thải rắn công nghiệp thông thường, chất thải rắn y tế và chất thải rắn nguy hại phát sinh từ hoạt động sản xuất, kinh doanh, dịch vụ theo quy định của pháp luật về quản lý chất thải rắn.

2. Cơ sở phát sinh khí thải phải:

a) Đầu tư, lắp đặt hệ thống xử lý khí thải bảo đảm quy chuẩn kỹ thuật môi trường; có sàn thao tác bảo đảm an toàn tại vị trí lấy mẫu khí thải;

b) Có nhật ký vận hành hệ thống xử lý khí thải được ghi chép đầy đủ, lưu giữ tối thiểu 02 năm.

Nhật ký vận hành phải viết bằng tiếng Việt, gồm các nội dung: lưu lượng, thông số vận hành, lượng nước và hóa chất sử dụng (đối với cơ sở có loại hình, quy mô tương đương đối tượng phải lập báo cáo đánh giá tác động môi trường theo quy định tại Phụ lục II ban hành kèm theo Nghị định số 18/2015/NĐ-CP);

c) Thực hiện quan trắc khí thải tự động, liên tục theo quy định tại Khoản 2, Khoản 3 Điều 26 Thông tư này và đăng ký chủ nguồn khí thải theo quy định (đối với cơ sở có phát sinh khí thải công nghiệp thuộc danh mục các nguồn khí thải lưu lượng lớn quy định tại Phụ lục ban hành kèm theo Nghị định số 38/2015/NĐ-CP).

3. Cơ sở phát sinh tiếng ồn, độ rung, ánh sáng, bức xạ phải đầu tư, lắp đặt hệ thống giảm thiểu tiếng ồn, độ rung, ánh sáng, bức xạ bảo đảm quy chuẩn kỹ thuật môi trường và các quy định khác có liên quan.

Điều 20. Yêu cầu về bảo vệ môi trường đối với hoạt động chuyển giao nước thải không nguy hại để xử lý

1. Đối với cơ sở chuyển giao nước thải không nguy hại để xử lý:

a) Có phương án chuyển giao, xử lý nước thải và được nêu rõ tại một trong các hồ sơ sau: báo cáo đánh giá tác động môi trường được phê duyệt, kế hoạch bảo vệ môi trường được xác nhận, đề án bảo vệ môi trường chi tiết được phê duyệt, đề án bảo vệ môi trường đơn giản được xác nhận hoặc hồ sơ tương đương;

b) Áp dụng cùng quy chuẩn kỹ thuật quốc gia về nước thải với cơ sở tiếp nhận nước thải để xử lý;

c) Có hợp đồng xử lý nước thải với cơ sở tiếp nhận nước thải để xử lý bảo đảm các yêu cầu theo quy định tại Khoản 3 Điều này;

d) Có hạ tầng, thiết bị chứa nước thải tạm thời bảo đảm chống tràn, đổ, rò rỉ ra môi trường xung quanh;

đ) Chỉ được chuyển giao nước thải cho cơ sở tiếp nhận để xử lý đã ký hợp đồng xử lý nước thải theo phương thức, khối lượng không vượt quá khối lượng ghi trong phương án chuyển giao, xử lý nước thải quy định tại Điểm a Khoản này;

e) Chịu trách nhiệm vận chuyển nước thải đáp ứng đầy đủ các quy định tại Khoản 2 Điều này; việc chuyển giao nước thải phải thể hiện đầy đủ trong báo cáo giám sát môi trường định kỳ theo quy định;

g) Có sổ ghi chép chi tiết bằng tiếng Việt và lưu giữ tối thiểu 02 năm về thời điểm, phương thức, khối lượng nước thải chuyển giao.

2. Đối với việc vận chuyển nước thải:

a) Chỉ được chuyển giao nước thải bằng đường ống; đường ống phải được thiết kế, lắp đặt bảo đảm các quy định kỹ thuật, không rò rỉ ra môi trường xung quanh, phải có van, đồng hồ đo lưu lượng và được thể hiện đầy đủ trong phương án quy định tại Điểm a Khoản 1 Điều này, trừ trường hợp quy định tại Điểm b Khoản này;

b) Nước thải súc rửa đường ống, thử thủy lực được vận chuyển bằng phương tiện giao thông nhưng phải đảm bảo các yêu cầu sau:

Phương tiện vận chuyển phải có đủ điều kiện tham gia giao thông theo quy định của pháp luật về giao thông; phải dán biển báo “vận chuyển nước thải không nguy hại” có kích thước đủ lớn ở phía trước, sau và bên hông.

Thiết bị, khoang chứa nước thải phải kín, chống thấm, chống rò rỉ, chống ăn mòn do nước thải được vận chuyển.

3. Đối với cơ sở tiếp nhận nước thải để xử lý:

a) Có phương án tiếp nhận nước thải để xử lý và được nêu rõ tại một trong các hồ sơ sau: báo cáo đánh giá tác động môi trường được phê duyệt, kế hoạch bảo vệ môi trường được xác nhận, đề án bảo vệ môi trường chi tiết được phê duyệt, đề án bảo vệ môi trường đơn giản được xác nhận hoặc hồ sơ tương đương;

b) Có hệ thống xử lý nước thải có công nghệ, công suất phù hợp để xử lý nước thải tiếp nhận;

c) Có đồng hồ đo lưu lượng nước thải sau xử lý;

d) Áp dụng cùng quy chuẩn kỹ thuật quốc gia về nước thải với cơ sở chuyển giao nước thải;

đ) Chỉ được tiếp nhận nước thải từ cơ sở chuyển giao nước thải đã ký hợp đồng xử lý nước thải theo phương thức và khối lượng không vượt quá khối lượng ghi trong phương án quy định tại Điểm a Khoản này;

e) Không chuyển giao nước thải đã tiếp nhận cho bên thứ ba để xử lý;

g) Có sổ ghi chép chi tiết bằng tiếng Việt và lưu giữ tối thiểu 02 năm về thời điểm, phương thức, khối lượng nước thải tiếp nhận; việc tiếp nhận nước thải để xử lý phải thể hiện đầy đủ trong báo cáo giám sát môi trường định kỳ theo quy định.

Chương V

PHƯƠNG ÁN BẢO VỆ MÔI TRƯỜNG

Điều 21. Đối tượng và thời điểm lập phương án bảo vệ môi trường

1. Đối tượng phải lập phương án bảo vệ môi trường bao gồm:

a) Cụm công nghiệp, khu kinh doanh, dịch vụ tập trung, cơ sở đang hoạt động có loại hình, quy mô tương đương đối tượng phải lập báo cáo đánh giá tác động môi trường theo quy định tại Phụ lục II ban hành kèm theo Nghị định số 18/2015/NĐ-CP ;

b) Làng nghề.

2. Đối tượng quy định tại Điểm a Khoản 1 Điều này lập phương án bảo vệ môi trường cho các hạng mục, công trình đã hoàn thành và vận hành chính thức theo tiến độ thực tế; trường hợp đã có hệ thống quản lý môi trường, trong đó đã tích hợp nội dung của phương án bảo vệ môi trường theo quy định tại Thông tư này và đã được xác nhận theo quy định tại Điều 25 Nghị định số 19/2015/NĐ-CP thì không phải lập phương án bảo vệ môi trường.

3. Đối tượng quy định tại Điểm a Khoản 1 Điều này đã có đề án bảo vệ môi trường chi tiết được xác nhận thì phải lập phương án bảo vệ môi trường sau khi được cơ quan có thẩm quyền kiểm tra việc hoàn thành toàn bộ các công trình bảo vệ môi trường theo quy định tại Điểm c Khoản 1 Điều 9 Thông tư số 26/2015/TT-BTNMT ngày 28 tháng 5 năm 2015 của Bộ trưởng Bộ Tài nguyên và Môi trường quy định đề án bảo vệ môi trường chi tiết, đề án bảo vệ môi trường đơn giản.

4. Phương án bảo vệ môi trường là một trong các căn cứ để đối tượng quy định tại Khoản 1 Điều này thực hiện các quy định pháp luật về bảo vệ môi trường, các biện pháp bảo vệ môi trường và là cơ sở để cơ quan nhà nước có thẩm quyền kiểm tra, thanh tra.

Điều 22. Nội dung phương án bảo vệ môi trường

1. Đối tượng quy định tại Điểm a Khoản 1 Điều 21 Thông tư này lập phương án bảo vệ môi trường theo mẫu quy định tại Phụ lục 7 ban hành kèm theo Thông tư này và lưu giữ tại cơ sở.

2. Làng nghề lập phương án bảo vệ môi trường theo mẫu quy định tại Phụ lục 2 ban hành kèm theo Thông tư này.

Điều 23. Phê duyệt phương án bảo vệ môi trường làng nghề

1. Ủy ban nhân dân cấp xã có làng nghề lập hồ sơ đề nghị phê duyệt phương án bảo vệ môi trường làng nghề gửi Ủy ban nhân dân cấp huyện xem xét, phê duyệt.

2. Hồ sơ đề nghị phê duyệt phương án bảo vệ môi trường làng nghề:

a) 01 văn bản đề nghị phê duyệt phương án bảo vệ môi trường làng nghề theo mẫu quy định tại Phụ lục 8 ban hành kèm theo Thông tư này;

b) 04 bản phương án bảo vệ môi trường làng nghề theo mẫu quy định tại Phụ lục 2 ban hành kèm theo Thông tư này;

c) 01 bản sao quy hoạch phát triển làng nghề tại địa phương do Ủy ban nhân cấp tỉnh phê duyệt (nếu có).

3. Sau khi tiếp nhận đầy đủ hồ sơ theo quy định tại Khoản 2 Điều này, Ủy ban nhân dân cấp huyện gửi lấy ý kiến tham vấn Sở Tài nguyên và Môi trường, Sở Nông nghiệp và Phát triển nông thôn trong quá trình xem xét, phê duyệt phương án bảo vệ môi trường làng nghề.

4. Sau khi có ý kiến của các cơ quan quy định tại Khoản 3 Điều này, Ủy ban nhân dân cấp huyện có trách nhiệm xem xét, phê duyệt phương án bảo vệ môi trường làng nghề.

5. Thời hạn xem xét, phê duyệt phương án bảo vệ môi trường làng nghề không quá 20 ngày làm việc kể từ ngày tiếp nhận đầy đủ hồ sơ đề nghị phê duyệt phương án bảo vệ môi trường làng nghề; trường hợp không phê duyệt, Ủy ban nhân dân cấp huyện có thông báo bằng văn bản, nêu rõ lý do.

Quyết định phê duyệt phương án bảo vệ môi trường làng nghề theo mẫu quy định tại Phụ lục 9 ban hành kèm theo Thông tư này.

6. Ký, đóng dấu và gửi phương án bảo vệ môi trường làng nghề:

a) Sau khi phương án bảo vệ môi trường làng nghề được phê duyệt, Ủy ban nhân dân cấp huyện ký và đóng dấu xác nhận vào trang bìa của phương án bảo vệ môi trường làng nghề;

b) Ủy ban nhân dân cấp huyện gửi 01 bản Quyết định phê duyệt kèm theo phương án bảo vệ môi trường làng nghề đã phê duyệt cho Ủy ban nhân dân cấp xã; gửi 01 bản phương án bảo vệ môi trường làng nghề đã phê duyệt cho Sở Tài nguyên và Môi trường; gửi bản phương án bảo vệ môi trường làng nghề đã phê duyệt cho Sở Nông nghiệp và Phát triển nông thôn.

Điều 24. Trách nhiệm thực hiện phương án bảo vệ môi trường

1. Chủ đầu tư xây dựng và kinh doanh hạ tầng cụm công nghiệp, ban quản lý khu kinh doanh, dịch vụ tập trung, chủ cơ sở có trách nhiệm cập nhật phương án bảo vệ môi trường bảo đảm phù hợp với tình hình, tiến độ triển khai hoạt động; lưu giữ đầy đủ các chứng từ, hóa đơn, nhật ký vận hành, sổ ghi chép và các giấy tờ liên quan theo hướng dẫn tại Phụ lục 7 ban hành kèm theo Thông tư này.

2. Thực hiện kế hoạch phòng ngừa và ứng phó sự cố môi trường trong phương án bảo vệ môi trường:

a) Chủ đầu tư xây dựng và kinh doanh hạ tầng cụm công nghiệp, ban quản lý khu kinh doanh, dịch vụ tập trung, chủ cơ sở phải xây dựng và bảo đảm năng lực để thực hiện việc phòng ngừa và ứng phó sự cố môi trường trong hoạt động sản xuất, kinh doanh, dịch vụ;

b) Khi xảy ra sự cố môi trường, chủ đầu tư xây dựng và kinh doanh hạ tầng cụm công nghiệp, ban quản lý khu kinh doanh, dịch vụ tập trung, chủ cơ sở có trách nhiệm thông báo kịp thời cho các tổ chức liên quan theo nội dung nêu trong kế hoạch phòng ngừa và ứng phó sự cố môi trường; báo động và huy động nguồn nhân lực, trang thiết bị để ứng phó theo mức độ sự cố môi trường; thực hiện biện pháp khắc phục ô nhiễm và phục hồi môi trường theo yêu cầu của cơ quan quản lý nhà nước về bảo vệ môi trường;

c) Trong thời hạn 30 ngày kể từ khi xảy ra sự cố môi trường, chủ đầu tư xây dựng và kinh doanh hạ tầng cụm công nghiệp, ban quản lý khu kinh doanh, dịch vụ tập trung, chủ cơ sở phải báo cáo Ủy ban nhân dân các cấp, Sở Tài nguyên và Môi trường về kết quả ứng phó, khắc phục sự cố môi trường;

d) Chủ đầu tư xây dựng và kinh doanh hạ tầng cụm công nghiệp, ban quản lý khu kinh doanh, dịch vụ tập trung, chủ cơ sở gây ra sự cố môi trường phải bồi thường thiệt hại theo quy định của Luật Bảo vệ môi trường và các quy định của pháp luật có liên quan.

Chương VI

QUAN TRẮC MÔI TRƯỜNG

Điều 25. Quan trắc phát thải định kỳ

1. Đối tượng phải thực hiện quan trắc nước thải, khí thải phát sinh từ quá trình hoạt động sản xuất, kinh doanh, dịch vụ và tần suất tối thiểu được quy định tại Phụ lục 10 ban hành kèm theo Thông tư này.

2. Đối với các đối tượng đã có hệ thống quan trắc nước thải, khí thải tự động, liên tục theo quy định tại Điều 26 Thông tư này chỉ cần thực hiện quan trắc nước thải, khí thải định kỳ theo quy định đối với các thông số chưa được quan trắc tự động, liên tục.

3. Cơ sở thuộc đối tượng quy định tại Phụ lục IV ban hành kèm theo Nghị định số 18/2015/NĐ-CP , Phụ lục I ban hành kèm theo Nghị định số 19/2015/NĐ-CP thì không phải thực hiện quan trắc phát thải.

Điều 26. Quan trắc phát thải tự động

1. Quan trắc nước thải tự động:

a) Các thông số quan trắc bao gồm: lưu lượng nước thải đầu vào và đầu ra, pH, nhiệt độ, COD, TSS và các thông số đặc trưng theo loại hình (trong trường hợp có công nghệ, thiết bị quan trắc tự động phù hợp trên thị trường) theo yêu cầu của cơ quan quản lý nhà nước có thẩm quyền phê duyệt báo cáo đánh giá tác động môi trường, đề án bảo vệ môi trường chi tiết;

b) Hệ thống quan trắc nước thải tự động phải bao gồm thiết bị lấy mẫu tự động được niêm phong và quản lý bởi Sở Tài nguyên và Môi trường; phải lắp đặt thiết bị camera được kết nối internet để giám sát cửa xả của hệ thống xử lý nước thải và lưu giữ hình ảnh trong vòng 03 tháng gần nhất.

2. Quan trắc khí thải tự động:

a) Các thông số quan trắc được quy định tại Phụ lục 11 ban hành kèm theo Thông tư này;

b) Trường hợp cơ sở có nhiều nguồn thải khí thải công nghiệp thuộc danh mục quy định tại Phụ lục 11 ban hành kèm theo Thông tư này, chủ cơ sở phải quan trắc tự động, liên tục tất cả các nguồn thải khí thải này.

3. Hệ thống quan trắc nước thải, khí thải tự động, liên tục phải hoạt động ổn định, được kiểm định, hiệu chuẩn theo quy định và phải bảo đảm yêu cầu kỹ thuật kết nối để truyền dữ liệu trực tiếp cho Sở Tài nguyên và Môi trường.

Điều 27. Lưu giữ, báo cáo, công bố thông tin và dữ liệu quan trắc môi trường

1. Chủ đầu tư xây dựng và kinh doanh hạ tầng khu công nghiệp, cụm công nghiệp, ban quản lý khu kinh doanh, dịch vụ tập trung, chủ cơ sở phải lưu giữ kết quả quan trắc môi trường tự động dưới dạng tệp điện tử; bản gốc báo cáo kết quả quan trắc định kỳ, bản gốc phiếu trả kết quả phân tích trong thời gian tối thiểu 03 năm.

2. Chủ đầu tư xây dựng và kinh doanh hạ tầng khu công nghiệp, cụm công nghiệp, ban quản lý khu kinh doanh, dịch vụ tập trung, chủ cơ sở có trách nhiệm gửi báo cáo và kết quả quan trắc môi trường theo quy định.

3. Chủ đầu tư xây dựng và kinh doanh hạ tầng khu công nghiệp, cụm công nghiệp, ban quản lý khu kinh doanh, dịch vụ tập trung, chủ cơ sở thuộc đối tượng thực hiện quan trắc phát thải tự động phải công bố kết quả quan trắc môi trường định kỳ trên trang thông tin điện tử của cơ sở (nếu có).

Chương VII

ĐIỀU KHOẢN THI HÀNH

Điều 28. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành từ ngày 01 tháng 12 năm 2016.

2. Thông tư số 46/2011/TT-BTNMT ngày 26 tháng 12 năm 2011 của Bộ trưởng Bộ Tài nguyên và Môi trường quy định về bảo vệ môi trường làng nghề hết hiệu lực thi hành kể từ ngày Thông tư này có hiệu lực thi hành.

3. Các nội dung liên quan đến tần suất giám sát phát thải tại mục 5.2 Phụ lục 2.3; mục 3.3 Phụ lục 5.5 của Thông tư số 27/2015/TT-BTNMT ngày 29 tháng 5 năm 2015 của Bộ trưởng Bộ Tài nguyên và Môi trường về đánh giá môi trường chiến lược, đánh giá tác động môi trường và kế hoạch bảo vệ môi trường; Điểm b Khoản 3 Điều 7 Thông tư số 40/2015/TT-BTNMT ngày 17 tháng 8 năm 2015 của Bộ trưởng Bộ Tài nguyên và Môi trường về quy trình kỹ thuật quan trắc khí thải hết hiệu lực thi hành kể từ ngày Thông tư này có hiệu lực thi hành.

Điều 29. Trách nhiệm thi hành

1. Tổng cục Môi trường hướng dẫn, kiểm tra việc thực hiện Thông tư này, định kỳ báo cáo công tác bảo vệ môi trường cụm công nghiệp, khu kinh doanh, dịch vụ tập trung, làng nghề trình Bộ Tài nguyên và Môi trường báo cáo Thủ tướng Chính phủ.

2. Các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân các cấp, Sở Tài nguyên và Môi trường và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này.

3. Việc thực hiện công tác quản lý nhà nước về bảo vệ môi trường đối với cụm công nghiệp, làng nghề quy định tại Thông tư này được bố trí kinh phí từ nguồn ngân sách sự nghiệp môi trường và các nguồn khác theo quy định của pháp luật.

4. Trong quá trình thực hiện, nếu có khó khăn, vướng mắc, đề nghị các cơ quan, tổ chức, cá nhân phản ánh kịp thời về Bộ Tài nguyên và Môi trường để nghiên cứu sửa đổi, bổ sung cho phù hợp./.

II. KẾT QUẢ QUAN TRẮC MÔI TRƯỜNG

1. Đơn vị thực hiện quan trắc:

2. Đánh giá kết quả quan trắc nước thải tự động (nếu có, báo cáo hàng quý) đối chiếu với quy chuẩn kỹ thuật môi trường hiện hành.

3. Đánh giá kết quả quan trắc theo từng đợt lấy mẫu nước mặt, nước thải nước ngầm... so với tiêu chuẩn, quy chuẩn hiện hành (căn cứ số liệu tại Bảng 1c).

4. Lập biểu đồ và đánh giá diễn biến kết quả quan trắc theo từng đợt, từng năm, theo các thông số quan trắc đối với từng thành phần môi trường.

III. CÔNG TÁC BẢO VỆ MÔI TRƯỜNG

1. Số cơ sở phát sinh khí thải tương ứng với lượng khí thải phát sinh của cụm công nghiệp và có hệ thống xử lý.

2. Kết quả đấu nối vào hệ thống xử lý nước thải tập trung (tính đến thời điểm báo cáo):

- Số cơ sở đấu nối tương ứng với lượng nước thải xả vào hệ thống xử lý nước thải tập trung.

- Số cơ sở được miễn trừ đấu nối tương ứng với lượng nước thải tự xử lý.

- Số cơ sở không/chưa đấu nối theo quy định tương ứng với lượng nước thải phát sinh.

3. Vận hành hệ thống xử lý nước thải tập trung của cụm công nghiệp:

- Tỷ lệ nước thải phát sinh so với công suất xử lý và nước thải đầu ra của hệ thống xử lý nước thải tập trung.

- Số ngày vận hành trong năm/số ngày dừng vận hành hoặc bảo dưỡng.

- Lượng điện tiêu thụ cho việc vận hành hệ thống xử lý nước thải tập trung (KWh/tháng).

- Lượng bùn thải phát sinh, biện pháp xử lý.

- Hoạt động của hệ thống quan trắc tự động nước thải:

+ Số ngày hoạt động/dừng hoạt động;

+ Số ngày có kết quả quan trắc nước thải vượt quy chuẩn kỹ thuật môi trường;

+ Hoạt động lưu giữ và truyền dữ liệu về Sở Tài nguyên và Môi trường địa phương.

4. Tổng lượng chất thải rắn thông thường/nguy hại phát sinh và được xử lý.

IV. CÔNG TÁC PHÒNG NGỪA, ỨNG PHÓ VÀ KHẮC PHỤC SỰ CỐ MÔI TRƯỜNG

1. Việc xây dựng kế hoạch phòng ngừa, ứng phó và khắc phục sự cố môi trường.

2. Báo cáo việc thực hiện công tác phòng ngừa, ứng phó và khắc phục sự cố môi trường (theo Bảng 1b) tập trung làm rõ các nội dung chính như sau:

- Các giải pháp phòng ngừa sự cố môi trường tại cụm công nghiệp.

- Việc ứng phó và khắc phục sự cố môi trường xảy ra tại cụm công nghiệp.

V. KẾT LUẬN VÀ KIẾN NGHỊ

1. Nhận xét chung về chất lượng môi trường tại cụm công nghiệp.

2. Nhận xét và đánh giá chung về sự tuân thủ các quy định bảo vệ môi trường, công tác xử lý chất thải và quan trắc môi trường của cụm công nghiệp và các cơ sở trong cụm công nghiệp.

3. Các kiến nghị, đề xuất (nếu có).

CHƯƠNG 1. MÔ TẢ TÓM TẮT VỀ LÀNG NGHỀ

1.1. Tên làng nghề

Nêu đầy đủ, chính xác tên làng nghề lập phương án.

1.2. Thông tin chung

- Địa chỉ làng nghề: nêu rõ thuộc xã/phường/thị trấn, quận/huyện/thị xã/thành phố, tỉnh/thành phố trực thuộc Trung ương nào.

- Mô tả vị trí địa lý của làng nghề: nêu cụ thể vị trí thuộc địa bàn của đơn vị hành chính từ cấp thôn và/hoặc xã trở lên; tọa độ các điểm khống chế vị trí của làng nghề kèm theo sơ đồ thể hiện vị trí các điểm khống chế đó.

- Mô tả sơ bộ điều kiện tự nhiên, kinh tế - xã hội có khả năng bị ảnh hưởng bởi hoạt động sản xuất của làng nghề (sông suối, hồ ao, dân cư…).

- Mô tả nguồn tiếp nhận nước thải làng nghề: tên nguồn, mục đích sử dụng.

- Nguồn nước cấp cho sinh hoạt và sản xuất (giếng khoan, nước khai thác bề mặt, nước cấp).

- Bản đồ hoặc sơ đồ đính kèm để minh họa vị trí địa lý của làng nghề và các đối tượng xung quanh như đã mô tả (nếu có).

1.3. Quy mô sản xuất

- Loại hình sản xuất: loại hình sản xuất chính, các loại hình khác (nếu có).

- Số cơ sở sản xuất/tổng số hộ trong làng nghề (đối với các làng đa nghề thì thống kê theo từng loại ngành nghề). Lập danh mục cụ thể đính kèm.

- Sản phẩm sản xuất: liệt kê các sản phẩm chính sản xuất của làng nghề; tổng số sản phẩm chính sản xuất/ngày.

CHƯƠNG 2. TÌNH TRẠNG PHÁT SINH CHẤT THẢI VÀ CÁC HOẠT ĐỘNG BẢO VỆ MÔI TRƯỜNG ĐÃ THỰC HIỆN

2.1. Phát sinh chất thải của làng nghề

- Sinh hoạt:

+ Nước thải: tổng lượng trung bình phát sinh (m^3/ngày);

+ Chất thải rắn: tổng lượng phát sinh (kg/ngày).

- Sản xuất:

+ Nước thải: tổng lượng phát sinh (m^3/ngày, tính vào thời điểm sản xuất cao nhất);

+ Chất thải rắn nguy hại và thông thường: tổng lượng phát sinh (kg/ngày);

+ Mô tả hoạt động phát sinh khí thải: mức độ phát thải (định tính/định lượng nếu có);

- Đánh giá hiện trạng ô nhiễm môi trường xung quanh (đất, nước, không khí) và tác động tới sức khỏe cộng đồng.

2.2. Các hoạt động bảo vệ môi trường đã thực hiện

- Mô tả hệ thống thoát nước, thu gom và xử lý nước thải (nếu có) tại làng nghề.

- Biện pháp thu gom chất thải rắn hiện nay, phương tiện, thiết bị thu gom, lưu giữ và xử lý chất thải rắn thông thường và chất thải nguy hại của làng nghề.

- Biện pháp, công trình xử lý khí thải.

- Các biện pháp bảo vệ môi trường khác.

- Thu phí bảo vệ môi trường đối với nước thải, chất thải rắn; phí vệ sinh môi trường.

- Kinh phí phân bổ thực hiện công tác bảo vệ môi trường làng nghề.

- Thành lập và vận hành tổ tự quản về bảo vệ môi trường làng nghề (số lượng nhân sự, cơ chế vận hành).

- Tổng vệ sinh đường làng ngõ xóm, nạo vét kênh mương.

- Việc đưa nội dung về bảo vệ môi trường làng nghề vào hương ước, quy ước.

- Đánh giá hiệu quả thực hiện của các biện pháp nêu trên và so sánh với quy định hiện hành.

CHƯƠNG 3. KẾ HOẠCH THỰC HIỆN CÁC BIỆN PHÁP BẢO VỆ MÔI TRƯỜNG

3.1. Kế hoạch quản lý các cơ sở sản xuất trong làng nghề (theo báo cáo về các biện pháp bảo vệ môi trường, các yêu cầu về bảo vệ môi trường đối với cơ sở)

- Các cơ sở thuộc danh mục quy định tại Phụ lục I Nghị định số 19/2015/NĐ-CP thực hiện theo báo cáo về các biện pháp bảo vệ môi trường.

- Các cơ sở không thuộc ngành nghề được khuyến khích phát triển tại làng nghề thực hiện quy định tại Chương IV Thông tư này hoặc tuân thủ kế hoạch di dời, chuyển đổi ngành nghề sản xuất theo quy định của cơ quan có thẩm quyền.

3.2. Thu gom và xử lý chất thải

3.2.1. Đối với nước thải

- Đối với các làng nghề đã có công trình thu gom, xử lý (nếu có) chất thải tại mục 2.2, đề nghị hoàn thiện cải tạo, nâng cấp đảm bảo thu gom, xử lý nước thải các cơ sở trên địa bàn.

- Kế hoạch vận hành các công trình thu gom, xử lý nước thải.

3.2.2. Đối với chất thải rắn (tương tự nước thải)

3.2.3. Biện pháp kiểm tra sức khỏe định kỳ cho người lao động

3.3. Biện pháp phòng ngừa, ứng phó sự cố, rủi ro

3.3.1. Đối với an toàn lao động tại các cơ sở sản xuất trong làng nghề

- Trang bị bảo hộ lao động; kiến thức về phòng, chống sự cố cháy nổ cho nhân công lao động làm việc trực tiếp tại khu vực sản xuất.

- Bảo dưỡng các thiết bị kỹ thuật đảm bảo vận hành an toàn, đúng kỹ thuật.

3.3.2. Đối với an toàn môi trường lao động tại các cơ sở sản xuất trong làng nghề

- Đối với các công đoạn có khả năng xảy ra sự cố cao như lò hơi, hóa chất, lò nung... phải có thiết bị bảo vệ, phương án phòng ngừa, ứng phó sự cố.

- Bố trí các thiết bị, máy móc tại nơi làm việc đảm bảo an toàn người lao động, phòng ngừa các sự cố có thể xảy ra.

CHƯƠNG 4. TỔ CHỨC THỰC HIỆN PHƯƠNG ÁN BẢO VỆ MÔI TRƯỜNG LÀNG NGHỀ

4.1. Kinh phí thực hiện

Nêu rõ việc bố trí kinh phí sự nghiệp môi trường và các nguồn kinh phí cho công tác bảo vệ môi trường làng nghề.

4.2. Phân công trách nhiệm

- Trách nhiệm của các cơ sở sản xuất tại làng nghề.

- Trách nhiệm của tổ chức tự quản về bảo vệ môi trường làng nghề.

- Trách nhiệm của Ủy ban nhân dân xã.

KẾT LUẬN, KIẾN NGHỊ VÀ CAM KẾT

1. Kết luận

Phải kết luận rõ:

- Đã nhận dạng, mô tả được các nguồn thải và tính toán được các loại chất thải, nhận dạng và mô tả được các vấn đề về môi trường và kinh tế - xã hội.

- Tính hiệu quả và khả thi của các công trình, biện pháp bảo vệ môi trường; giải quyết được các vấn đề về môi trường và kinh tế - xã hội phát sinh từ hoạt động sản xuất của làng nghề.

2. Kiến nghị

Kiến nghị với các cấp, các ngành liên quan ở trung ương và địa phương để giải quyết các vấn đề vượt quá khả năng giải quyết của Ủy ban nhân dân cấp xã.

3. Cam kết

- Cam kết thực hiện đúng nội dung, tiến độ xây dựng, cải tạo và vận hành các công trình, biện pháp bảo vệ môi trường.

- Cam kết thực hiện đúng chế độ báo cáo tại quyết định phê duyệt phương án bảo vệ môi trường làng nghề.

- Cam kết tuân thủ các quy định của pháp luật về bảo vệ môi trường có liên quan đến làng nghề, kể cả các tiêu chuẩn, quy chuẩn kỹ thuật về môi trường.

- Cam kết theo dõi và thực hiện đúng các quy định về xử phạt các cơ sở sản xuất trong làng nghề nếu để xảy ra các sự cố.

TIÊU CHÍ ĐÁNH GIÁ, PHÂN LOẠI LÀNG NGHỀ THEO MỨC ĐỘ Ô NHIỄM MÔI TRƯỜNG

Việc đánh giá, phân loại mức độ ô nhiễm môi trường đối với từng làng nghề được thực hiện theo các bước sau:

Bước 1: Xác định loại hình sản xuất đặc thù của làng nghề (các loại hình cụ thể tại Bảng 2.1).

Bước 2: Xác định các thông số ô nhiễm đặc thù tối thiểu cần phân tích của làng nghề căn cứ vào loại hình sản xuất đặc thù (cụ thể tại Bảng 2.1).

Bước 3: Lấy, phân tích mẫu các thành phần môi trường theo các thông số ô nhiễm đặc thù như đã xác định tại Bảng 2.1.

Tùy thuộc vào điều kiện kinh phí, việc lấy và phân tích mẫu có thể được thực hiện hàng quý, vào một thời điểm nhất định trong các tháng 3, 6, 9 và 12 của năm. Nếu điều kiện kinh phí hạn chế, cần lấy và phân tích mẫu 02 lần/năm: 01 lần vào thời điểm đặc trưng của mùa khô và 01 lần vào thời điểm đặc trưng mùa mưa trong năm. Nếu chỉ đủ kinh phí tiến hành 01 lần thì cần thực hiện vào mùa khô hoặc thời điểm sản xuất cao nhất trong năm.

Việc đo đạc, lấy mẫu cần được thực hiện theo các nguyên tắc sau:

- Nước mặt: mẫu được lấy tại điểm giữa các ao, hồ, mương, kênh... trong khu vực của làng có tiếp nhận nước thải sản xuất. Các điểm lấy mẫu cần đại diện cho chất lượng môi trường nước mặt của làng, trong đó có ít nhất một điểm là nơi thoát nước cuối cùng của làng nghề ra môi trường tiếp nhận xung quanh (kênh mương, ao, hồ, sông, suối...) của toàn khu vực.

- Không khí xung quanh: được đo, lấy mẫu tại chính giữa các khu vực sản xuất và có ít nhất một điểm nằm cuối hướng gió của làng.

- Đất: lấy mẫu tại các khu vực không được bê tông hóa, gần các khu vực sản xuất.

Bước 4: Tính giá trị hệ số ô nhiễm A theo công thức tính dưới đây để làm căn cứ phân loại mức độ ô nhiễm môi trường làng nghề.

Công thức tính hệ số ô nhiễm A:

Trong đó:

A: Hệ số ô nhiễm môi trường của làng nghề tính toán dựa trên các thông số ô nhiễm đặc thù.

C₁, C₂... C_n: Giá trị các thông số ô nhiễm đặc thù trong môi trường xung quanh (các thông số được xác định tại Bảng 2.1), tính trung bình cho các lần lấy mẫu trong năm.

C_q1, C_q2 ... C_qn: Giá trị ngưỡng của các thông số trên được quy định tại quy chuẩn kỹ thuật quốc gia về chất lượng môi trường xung quanh tương ứng.

n: Số lượng các thông số ô nhiễm đặc thù (xác định theo Bảng 2.1).

Bước 5: Phân loại mức độ ô nhiễm môi trường của làng nghề sau khi tính toán hệ số ô nhiễm A, dựa vào Bảng 2.2 dưới đây.

Nhóm I

Là các cơ sở thuộc nhóm ngành nghề có công đoạn sản xuất có nguy cơ gây ô nhiễm môi trường sau:

- Hầm than củi: công đoạn đốt củi và hầm trong lò.

- Ươm tơ: công đoạn kéo kén, xe tơ.

- Chế biến nông sản, thực phẩm (sản xuất mía đường, mứt, bánh kẹo thủ công; sản xuất nước mắm, mắm, nước tương thủ công; sản xuất bún, bánh các loại; nấu rượu): công đoạn vệ sinh, sơ chế nguyên liệu; công đoạn có sử dụng nhiên liệu: than, củi, trấu để làm thay đổi thành phần, đặc tính của nguyên liệu; công đoạn có phát sinh mùi hôi, tanh).

- Chế biến/sơ chế thủy sản/hải sản: công đoạn vệ sinh, sơ chế nguyên liệu; công đoạn có sử dụng nhiên liệu (than, củi, trấu) để làm thay đổi thành phần, đặc tính của nguyên liệu; công đoạn có phát sinh mùi hôi, tanh.

- Sản xuất đồ mỹ nghệ (chế tác đồ đá, đồ gỗ, đồ kim loại hoặc đá quý; sản xuất đồ gốm; sơn mài...): công đoạn chuẩn bị nguyên liệu/tạo hình sản phẩm có phát sinh bụi, mùi; công đoạn có sử dụng hóa chất để xử lý bề mặt; công đoạn ngâm, tẩm, luộc để xử lý nguyên liệu, sản phẩm; công đoạn sấy, nung sử dụng than, củi, trấu để cung cấp nhiệt.

- Sản xuất thủy tinh: công đoạn nấu.

Nhóm II

Là các cơ sở thuộc nhóm ngành nghề sau:

- Sản xuất vật liệu xây dựng: vôi, gạch, ngói, đá xẻ.

- Phân loại, làm sạch, tái chế giấy.

- Phân loại, làm sạch, tái chế kim loại.

- Phân loại, làm sạch, tái chế nhựa.

- Nhuộm có sử dụng thuốc nhuộm công nghiệp.

- Thuộc da.

- Mạ điện hoặc mạ nhúng.

- Sơ chế mủ cao su (đánh đông).

- Chế biến tinh bột: quy mô từ 0,1 tấn sản phẩm/ngày trở lên.

- Gia công cơ khí bằng máy móc: quy mô từ 0,3 tấn sản phẩm/ngày trở lên.

- Chăn nuôi gia súc, gia cầm thường xuyên, với quy mô:

+ Trâu, bò, ngựa: mục đích nuôi sinh sản, phối giống, lấy sữa từ 5 con trở lên; mục đích nuôi lấy thịt từ 10 con trở lên;

+ Lợn: mục đích nuôi sinh sản, phối giống từ 10 con trở lên; mục đích nuôi lấy thịt từ 20 con trở lên;

+ Dê, cừu, chó: từ 50 con trở lên;

+ Thỏ: từ 100 con trở lên;

+ Gia cầm: từ 100 con trở lên; chim cút: từ 1.000 con trở lên.

- Giết mổ gia súc, gia cầm thường xuyên, với quy mô:

+ Gia súc: từ 01 tấn/ngày trở lên;

+ Gia cầm: từ 0,5 tấn/ngày trở lên.

1. Thông tin cơ bản

- Tên, vị trí, diện tích.

- Đối với cụm công nghiệp ghi rõ: tỷ lệ lấp đầy, loại hình sản xuất chính, các khu chức năng (liệt kê, mô tả vị trí, bản đồ đính kèm).

- Đối với khu dinh doanh, dịch vụ tập trung ghi rõ: các hoạt động kinh doanh chính, các khu chức năng (liệt kê, mô tả vị trí, bản đồ đính kèm).

- Thông tin liên hệ của chủ đầu tư: người đại diện, địa chỉ, số điện thoại, địa chỉ email.

2. Yêu cầu của pháp luật về bảo vệ môi trường phải tuân thủ

- Liệt kê các yêu cầu, quy định, giấy phép, chứng chỉ, thủ tục về bảo vệ môi trường mà chủ đầu tư, chủ cơ sở phải tuân thủ (các tiêu chuẩn xả thải, quy định về quản lý chất thải đặc thù).

- Các giấy phép, chứng chỉ, thủ tục môi trường mà chủ đầu tư đã thực hiện (báo cáo đánh giá tác động môi trường, sổ đăng ký chủ nguồn chất thải nguy hại, giấy phép xả thải vào nguồn nước, các chứng chỉ môi trường khác...).

3. Mô tả về hoạt động sản xuất, kinh doanh, dịch vụ

3.1. Mô tả các hoạt động, công đoạn sản xuất, kinh doanh, dịch vụ của cơ sở

- Mô tả hoạt động và sơ đồ khối quy trình sản xuất, kinh doanh, dịch vụ.

- Thời gian, tần suất diễn ra hoạt động, công đoạn (số ca, giờ...).

- Vị trí, khu vực thực hiện trong khuôn viên cơ sở.

- Nhân lực thực hiện.

* Đối với cụm công nghiệp, mô tả:

- Thực hiện quy hoạch các khu chức năng và vị trí các cơ sở trong cụm công nghiệp.

- Mô tả các cơ sở đang hoạt động trong cụm công nghiệp tại thời điểm lập phương án bảo vệ môi trường (tên, loại hình sản xuất, kinh doanh, dịch vụ).

- Mô tả các dự án đầu tư đã được tiếp nhận trong cụm công nghiệp nhưng chưa triển khai (tên, loại hình sản xuất, kinh doanh, dịch vụ, thời gian dự kiến đi vào hoạt động).

- Đối với cụm công nghiệp chưa có hệ thống xử lý nước thải tập trung thì phải mô tả chi tiết kế hoạch xây dựng hệ thống xử lý nước thải tập trung.

* Đối với khu kinh doanh, dịch vụ tập trung, mô tả:

- Thực hiện quy hoạch các khu chức năng và vị trí các hoạt động kinh doanh, dịch vụ.

- Mô tả các hoạt động đang thực hiện tại thời điểm lập phương án bảo vệ môi trường (tên, loại hình kinh doanh, dịch vụ).

- Mô tả hoạt động đầu tư đã được tiếp nhận trong khu kinh doanh, dịch vụ nhưng chưa triển khai (tên, loại hình kinh doanh, dịch vụ, thời gian dự kiến đi vào hoạt động).

- Đối với khu kinh doanh, dịch vụ tập trung chưa có hệ thống xử lý nước thải hoặc không đấu nối vào hệ thống thoát nước của khu vực thì phải mô tả chi tiết kế hoạch xây dựng hệ thống xử lý nước thải.

3.2. Thống kê, tính toán nguyên nhiên vật liệu (nếu có) và dòng thải phát sinh trong quá trình hoạt động

4. Công trình, biện pháp bảo vệ môi trường

4.1. Công trình, biện pháp thu gom, xử lý nước thải

- Công nghệ, thiết bị xử lý nước thải (kèm theo sơ đồ vị trí hệ thống xử lý nước thải, mạng lưới thu gom nước thải, điểm xả thải, sơ đồ công nghệ xử lý).

- Loại và lượng hóa chất, nhiên liệu, vật tư sử dụng trong quá trình xử lý nước thải (nêu rõ nguồn gốc, xuất xứ, tên thương mại).

- Mô tả chi tiết quy trình vận hành hệ thống xử lý nước thải (các thông số vận hành, các bước, thao tác vận hành, vị trí các điểm xả thải, thời điểm nạo vét bùn thải, chế độ bảo trì, bảo dưỡng…).

- Trong trường hợp không xử lý toàn bộ hoặc một phần lượng nước thải, phải nêu rõ phương án chuyển giao nước thải để xử lý (loại và lượng nước thải chuyển giao, biện pháp vận chuyển nước thải, đơn vị tiếp nhận nước thải để xử lý, kèm bản sao hợp đồng xử lý nước thải). Sổ ghi chép về việc chuyển giao nước thải để xử lý phải được lưu giữ trong vòng ít nhất 2 năm.

- Kế hoạch cải tạo, mở rộng, nâng công suất công trình, biện pháp thu gom, xử lý nước thải (nếu có).

4.2. Công trình, biện pháp xử lý khí thải

- Công nghệ, thiết bị xử lý khí thải (kèm theo sơ đồ vị trí hệ thống thu gom, xử lý khí thải, vị trí ống khói, ống thải, sơ đồ công nghệ xử lý).

- Loại và lượng hóa chất, vật tư sử dụng trong quá trình xử lý khí thải (nêu rõ nguồn gốc, xuất xứ, tên thương mại).

- Mô tả chi tiết quy trình vận hành hệ thống xử lý khí thải (các thông số vận hành, các bước, thao tác vận hành, chế độ bảo dưỡng, bảo trì, thay hóa chất...)­.

- Kế hoạch cải tạo, mở rộng, nâng công suất công trình, biện pháp thu gom, xử lý khí thải (nếu có).

4.3. Công trình, biện pháp quản lý chất thải rắn và chất thải nguy hại

- Mô tả vị trí, diện tích, kết cấu khu vực, thiết bị lưu giữ chất thải rắn, chất thải nguy hại.

- Công trình, biện pháp tự xử lý chất thải rắn, chất thải nguy hại (nếu có): mô tả quy trình công nghệ, công trình, thiết bị xử lý, thông số kỹ thuật, thông số vận hành.

- Phương án chuyển giao chất thải rắn, chất thải nguy hại: tần suất, đơn vị thu gom, xử lý.

4.4. Công trình, biện pháp xử lý, giảm thiểu tác động môi trường từ các nguồn thải khác

- Công trình, biện pháp thu gom, xử lý (nếu có) đối với nước mưa chảy tràn.

- Công trình, biện pháp giảm thiểu tác động xấu do tiếng ồn, độ rung, bức xạ (cụ thể với từng công đoạn, hoạt động phát sinh).

5. Kế hoạch phòng ngừa, ứng phó sự cố môi trường

5.1. Xác định nguy cơ xảy ra sự cố môi trường trong quá trình hoạt động

a) Đối với cơ sở sản xuất, kinh doanh, dịch vụ

- Xác định nguy cơ xảy ra các sự cố trong các công đoạn sản xuất, kinh doanh, dịch vụ (tràn, đổ, cháy, nổ, rò rỉ, thiên tai...).

- Xác định nguy cơ xảy ra các sự cố trong các hoạt động xử lý nước thải, xử lý khí thải, quản lý chất thải rắn và chất thải nguy hại (tràn, đổ, cháy, nổ, rò rỉ, thiên tai...).

- Dự báo phạm vi, mức độ ảnh hưởng của từng nguy cơ.

b) Đối với cụm công nghiệp, khu kinh doanh, dịch vụ tập trung

- Thông tin về các sự cố đã xảy ra tại khu vực hoạt động.

- Xác định nguy cơ xảy ra các sự cố môi trường (tràn, đổ, cháy, nổ, rò rỉ, sự cố do thiên tai...) trong các hoạt động tại hệ thống xử lý nước thải tập trung, khu vực lưu giữ chất thải rắn tạm thời, các kho chứa hàng hóa, hóa chất của các cơ sở trong cụm công nghiệp và các hoạt động trong khu kinh doanh, dịch vụ tập trung.

- Xác định các nguy cơ xảy ra sự cố môi trường có khả năng gây tác động vượt quá ranh giới của cơ sở trong cụm công nghiệp (ví dụ: kho xăng dầu, kho hóa chất, dây chuyền sản xuất hóa chất, xử lý chất thải... của các cơ sở trong cụm công nghiệp và các hoạt động trong khu kinh doanh, dịch vụ tập trung) và công trình hạ tầng của cụm công nghiệp, khu kinh doanh, dịch vụ tập trung kèm theo sơ đồ vị trí.

- Dự báo phạm vi ảnh hưởng đối với từng nguy cơ.

5.2. Phương án phòng ngừa, ứng phó sự cố môi trường

a) Đối với cơ sở sản xuất, kinh doanh, dịch vụ

- Phương án kiểm tra, bảo dưỡng, thay thế và danh sách các thiết bị tại các công đoạn sản xuất, kinh doanh, dịch vụ có nguy cơ xảy ra sự cố môi trường.

- Các biện pháp phòng ngừa đối với từng nguy cơ xảy ra sự cố môi trường đã xác định ở điểm a mục 5.1.

- Phương án sắp xếp vị trí của các khu vực sản xuất của cơ sở nhằm giảm mức độ ảnh hưởng tiêu cực khi sự cố xảy ra.

- Phương án đảm bảo nguồn lực (nhân lực, vật tư, trang thiết bị, tài chính) của cơ sở để sẵn sàng ứng phó, khắc phục sự cố môi trường.

- Cơ chế phối hợp và vai trò, trách nhiệm của các tổ chức, cá nhân trong và ngoài cơ sở trong việc phòng ngừa, ứng phó, khắc phục sự cố môi trường.

- Các biện pháp cảnh báo, báo động, đảm bảo an ninh và bố trí giao thông để phòng ngừa và ứng phó sự cố tại cơ sở.

- Phương án đào tạo, tập huấn, diễn tập, phổ biến thông tin về phòng ngừa, ứng phó sự cố cho các cán bộ, công nhân viên của cơ sở và tổ chức, cá nhân có liên quan bên ngoài cơ sở.

- Quy trình ứng phó đối với các tình huống xảy ra sự cố môi trường tại cơ sở (các biện pháp khẩn cấp, ưu tiên; phương thức báo động, thông báo, sơ tán và huy động nguồn nhân lực, trang thiết bị ứng phó...).

b) Đối với cụm công nghiệp, khu kinh doanh, dịch vụ tập trung

- Phương án kiểm tra, bảo dưỡng, thay thế và danh sách các thiết bị tại hệ thống xử lý nước thải tập trung, khu vực lưu giữ chất thải rắn tạm thời và kho chứa hàng hóa, hóa chất của các cơ sở trong cụm công nghiệp, các hoạt động trong khu kinh doanh, dịch vụ tập trung có nguy cơ xảy ra các sự cố môi trường.

- Các biện pháp phòng ngừa đối với từng nguy cơ xảy ra sự cố đã xác định ở điểm b mục 5.1.

- Các phương án sắp xếp vị trí của các phân khu chức năng, cơ sở trong cụm công nghiệp, hoạt động trong khu kinh doanh, dịch vụ tập trung nhằm phòng ngừa và giảm mức độ ảnh hưởng tiêu cực khi sự cố xảy ra.

- Phương án đảm bảo nguồn lực (nhân lực, vật tư, trang thiết bị, tài chính) để sẵn sàng ứng phó, khắc phục sự cố môi trường.

- Các biện pháp cảnh báo, báo động, đảm bảo an ninh và bố trí giao thông trong cụm công nghiệp, khu kinh doanh, dịch vụ tập trung để phòng ngừa và ứng phó sự cố.

- Phương án đào tạo, tập huấn, diễn tập, phổ biến thông tin về phòng ngừa, ứng phó sự cố cho các tổ chức, cá nhân liên quan.

- Cơ chế phối hợp và vai trò, trách nhiệm của các tổ chức, cá nhân liên quan tại địa phương trong quá trình ứng phó, khắc phục sự cố môi trường.

- Quy trình ứng phó đối với các tình huống xảy ra sự cố môi trường (các biện pháp khẩn cấp, ưu tiên; phương thức báo động, thông báo, sơ tán và huy động nguồn nhân lực, trang thiết bị ứng phó...).

5.3. Các thông tin, tài liệu liên quan

a) Đối với cơ sở sản xuất, kinh doanh, dịch vụ

- Các thông tin kỹ thuật liên quan tới hàng hóa, hóa chất hoặc chất ô nhiễm phát sinh do sự cố môi trường.

- Danh mục và các thông tin kỹ thuật của các trang thiết bị, phương tiện, vật tư... ứng phó sự cố của cơ sở.

- Danh mục và các thông tin về các trang thiết bị, phương tiện, vật tư... ứng phó sự cố của các đơn vị lân cận cơ sở, nếu có.

- Bản đồ/sơ đồ tổng thể của cơ sở trong đó bao gồm vị trí của các khu vực có nguy cơ xảy ra sự cố; các khu vực nhạy cảm (ví dụ khu vực dân cư lân cận...); các vị trí sơ tán khi sự cố xảy ra; các vị trí bố trí trang thiết bị, vật tư ứng phó sự cố; hệ thống giao thông khi ứng phó sự cố.

- Tài liệu, thông tin về các cơ sở, công trình lân cận.

- Danh sách liên lạc nội bộ và các đơn vị liên quan tới công tác ứng phó sự cố tại địa phương (Công an tỉnh/thành phố, quận/huyện, xã/phường; Phòng cháy chữa cháy; Bệnh viện, cơ sở y tế gần nhất; Đơn vị quân đội...).

- Sơ đồ tổ chức, chức năng và trách nhiệm cụ thể của lực lượng ứng phó sự cố tại cơ sở và thông tin liên lạc kèm theo.

b) Đối với cụm công nghiệp, khu kinh doanh, dịch vụ tập trung

- Các thông tin kỹ thuật liên quan tới chất ô nhiễm, hóa chất phát sinh do sự cố môi trường.

- Danh mục và các thông tin kỹ thuật của các trang thiết bị, phương tiện, vật tư... ứng phó nội bộ của cụm công nghiệp, khu kinh doanh, dịch vụ tập trung.

- Danh mục và các thông tin về các trang thiết bị, phương tiện, vật tư... ứng phó sự cố của các đơn vị lân cận cụm công nghiệp, khu kinh doanh, dịch vụ tập trung, nếu có.

- Bản đồ/sơ đồ tổng thể của cụm công nghiệp, khu kinh doanh, dịch vụ tập trung trong đó bao gồm vị trí của các khu vực có nguy cơ xảy ra sự cố; các khu vực nhạy cảm (ví dụ khu vực có số lượng người làm việc nhiều, khu vực lân cận khu dân cư...); các vị trí sơ tán khi sự cố xảy ra; các vị trí bố trí trang thiết bị, vật tư ứng phó sự cố; hệ thống giao thông khi ứng phó sự cố.

- Tài liệu, thông tin về các công trình bên ngoài cụm công nghiệp, khu kinh doanh, dịch vụ tập trung có khả năng ảnh hưởng do sự cố môi trường (ví dụ từ kho hóa chất, nhà máy, công trình hồ, đập...), nếu có.

- Các kế hoạch của các cơ sở trong cụm công nghiệp, các hoạt động trong khu kinh doanh, dịch vụ tập trung (kế hoạch ứng phó sự cố môi trường, kế hoạch phòng cháy chữa cháy...), nếu có.

- Danh sách liên lạc nội bộ và các đơn vị liên quan tới công tác ứng phó sự cố tại địa phương (Công an tỉnh/thành phố, quận/huyện, xã/phường; Phòng cháy chữa cháy; Bệnh viện, cơ sở y tế gần nhất; Đơn vị quân đội...).

- Sơ đồ tổ chức, chức năng và trách nhiệm cụ thể của cụm công nghiệp, khu kinh doanh, dịch vụ tập trung và thông tin liên lạc kèm theo.

6. Kế hoạch quan trắc, giám sát môi trường

6.1. Quan trắc phát thải

6.1.1. Quan trắc phát thải định kỳ

a) Quan trắc nước thải:

- Ghi rõ vị trí thực hiện lấy mẫu.

- Các thông số quan trắc.

- Tần suất quan trắc.

b) Quan trắc khí thải:

- Các điểm lấy mẫu từ các vị trí có phát sinh khí thải trong quá trình sản xuất.

- Các thông số quan trắc.

- Tần suất quan trắc.

c) Giám sát chất thải rắn:

Tiến hành thực hiện phân tích đối với loại chất thải rắn phát sinh từ hoạt động sản xuất để phân định chất thải nguy hại.

6.1.2. Quan trắc phát thải tự động (nếu có)

a) Quan trắc nước thải tự động (nếu có):

- Mô tả hệ thống quan trắc nước thải tự động (tên hãng, năm sản xuất, các thông số kỹ thuật cơ bản), thời điểm và vị trí lắp đặt, điểm lắp camera quan sát; đơn vị, tần suất thực hiện kiểm định, hiệu chuẩn.

- Các thông số phải quan trắc.

b) Quan trắc khí thải tự động (nếu có):

- Mô tả hệ thống quan trắc khí thải tự động (tên hãng, năm sản xuất, các thông số kỹ thuật cơ bản), thời điểm và vị trí lắp đặt, vị trí phòng điều khiển; đơn vị, tần suất thực hiện kiểm định, hiệu chuẩn.

- Các thông số phải quan trắc cho từng ống khói, ống thải.

6.2. Thực hiện kế hoạch quan trắc

6.2.1. Thuê đơn vị thực hiện dịch vụ quan trắc môi trường

- Dự kiến đơn vị thực hiện quan trắc.

- Các vấn đề cần lưu ý.

6.2.2. Cơ sở tự quan trắc

Mô tả các thiết bị, nhân lực phục vụ cho việc quan trắc.

7. Tổ chức quản lý môi trường

Mô tả nguồn lực của chủ đầu tư được sử dụng cho công tác bảo vệ môi trường trong giai đoạn hoạt động:

- Kinh phí sử dụng cho từng hoạt động bảo vệ môi trường.

- Bố trí nhân lực/bộ phận quản lý môi trường, phân công trách nhiệm cho các cán bộ tham gia thực hiện phương án bảo vệ môi trường.

- Quy chế/quy định quản lý môi trường của chủ đầu tư đối với các cơ sở trong cụm công nghiệp.

- Kế hoạch tập huấn về việc thực hiện phương án bảo vệ môi trường.

Phụ lục

- Quyết định phê duyệt báo cáo đánh giá tác động môi trường, đề án bảo vệ môi trường chi tiết (nếu có).

- Các loại hồ sơ, thủ tục môi trường khác (nếu có).

- Chứng chỉ/chứng nhận về hệ thống quản lý môi trường của đơn vị tiến hành thi công/xây dựng hạ tầng (nếu có).

- Hợp đồng thi công, xây lắp (chỉ cần phần nội dung liên quan đến môi trường).

- Bản sao giấy xác nhận hoàn thành công trình bảo vệ môi trường (nếu có).

- Bản sao biên bản kiểm tra hoặc văn bản xác nhận của cơ quan có thẩm quyền về việc hoàn thành công trình bảo vệ môi trường (đối với đối tượng có Đề án bảo vệ môi trường chi tiết đã được phê duyệt).

- Bản sao hợp đồng xử lý, chuyển giao nước thải (nếu có).

- Bản sao hợp đồng thu gom, xử lý chất thải rắn, chất thải nguy hại (nếu có).

- Sơ đồ/bản vẽ mặt bằng tổng thể, hệ thống thu gom, thoát nước và xử lý nước thải; bản vẽ hoàn công các công trình bảo vệ môi trường.

- Các tài liệu liên quan khác.

QUYẾT ĐỊNH:

Điều 1. Phê duyệt phương án bảo vệ môi trường làng nghề...(2)... (sau đây gọi là phương án).

Điều 2. Tổ chức thực hiện

2.1. Bố trí nguồn lực thực hiện, phân công trách nhiệm theo đúng nội dung đã nêu tại Chương 4 của phương án.

2.2. Thực hiện đúng và đầy đủ các nội dung về bảo vệ môi trường đã đề ra trong phương án; đảm bảo chất thải và các vấn đề môi trường khác được quản lý, xử lý đạt yêu cầu theo quy định của pháp luật hiện hành.

CIRCULAR

PROVIDING FOR ENVIRONMENTAL PROTECTION FOR INDUSTRIAL CLUSTERS, CONCENTRATIONS OF BUSINESSES, SERVICE PROVIDERS, TRADE VILLAGES, PRODUCTION, COMMERCIAL AND SERVICE ESTABLISHMENTS 

Pursuant to the Law on Environmental Protection dated June 23, 2014;

Pursuant to the Government’s Decree No. 19/2015/ND-CP dated February 14, 2015 specifying implementation of several articles of the Law on Environmental Protection;

Pursuant to the Government’s Decree No. 38/2015/ND-CP dated April 24, 2015 on management of wastes and scrap materials;

Pursuant to the Government’s Decree No. 21/2013/ND-CP dated March 04, 2013 defining functions, duties, powers and organizational structure of the Ministry of Natural Resources and Environment;

Upon the request of the General Director of Vietnam Environment Administration and the Director of the Department of Legal Affairs;

The Minister of Natural Resources and Environment hereby introduces the Circular on environmental protection in industrial clusters, concentrations of businesses, service providers, trade villages, production, commercial and service establishments.

GENERAL PROVISIONS

Article 1. Scope

This Circular provides details of Article 67, Point dd Clause 1 Article 68, Article 101, Article 108, Clause 2 Article 121, Clause 3 Article 123, Clause 3 Article 125, and Clause 1 Article 130, of the Law on Environmental Protection; Clause 1 and 4 of Article 20 of the Government's Decree No. 19/2015/ND-CP dated February 14, 2015 on specifying implementation of several articles of the Law on Environmental Protection (hereinafter referred to as Decree No. 19/2015/ND-CP); Article 37, Article 39, Point a and Point c Clause 1 Article 43 of the Government's Decree No. 38/2015/ND-CP dated April 24, 2015 on management of wastes and scrap materials (hereinafter referred to as Decree No. 38/2015/ND-CP), including:

1. Environmental protection in industrial clusters, concentrations of businesses and service providers. 

2. Environmental protection in trade villages.

3. Environmental protection in production, commercial and service establishments. 

Article 2. Subjects of application

This Circular shall be applied to domestic and foreign institutional and individual entities related to environmental protection activities in industrial clusters; concentrations of businesses and service providers; trade villages; production, commercial and service establishments (hereinafter referred to as establishment).

Article 3. Definition

1. Investor in construction and commercial operation of industrial cluster infrastructure refers to enterprises, organizational or individual entities established and operated under Vietnam's laws, or granted the business registration as defined in Vietnam’s laws and regulations, and directly making its investment in construction, management and business operation of industrial cluster infrastructure.

2. Concentration of businesses and service providers refers to supermarkets, commercial centers, local markets, tourism, sport and recreation attractions, bus terminals, or rail terminals, which require preparation of environmental impact statements.     

3. Management board of concentration of businesses and service providers refers to enterprises, organizational or individual entities established and operated under Vietnam's laws, or granted the business registration as defined in Vietnam’s laws and regulations, and directly making its investment in construction, management and business operation of infrastructure facilities of concentrations of businesses and service providers.

4. Active industrial clusters, concentrations of businesses, service providers and establishments refer to those that have officially brought at least one work item or project into operation.

5. Environmental protection plan refers to the environmental management plan which is devised and implemented during the entire process of operation of active industrial clusters, concentrations of businesses, service providers and establishments, and trade villages.

Chapter II

ENVIRONMENTAL PROTECTION IN INDUSTRIAL CLUSTERS, CONCENTRATIONS OF BUSINESSES AND SERVICE PROVIDERS 

Section 1. ENVIRONMENTAL PROTECTION IN INDUSTRIAL CLUSTERS 

Article 4. Environmental protection requirements in drawing up the construction planning of industrial clusters

2. According to the planning, an industrial cluster must be fully furnished with environmental protection infrastructure meeting requirements referred to in Clause 1 Article 5 hereof.

3. Tree grown within an industrial cluster must cover at least 10% of total area of that industrial cluster.

Article 5. Requirements for development, construction, management and operation of environmental protection infrastructure facilities in industrial clusters 

1. Development of environmental protection infrastructure facilities in an industrial cluster must conform to the following requirements: 

a) Engineering infrastructure of an industrial cluster is composed of rainwater drainage system, centralized wastewater collection and treatment system, solid waste retention and treatment system (if any).

Rainwater drainage system and wastewater collection, treatment and disposal system must be separate, have uniform designs, be installed in conformance to the approved planning, and comply with technical regulations and standards applied to construction activities, and relevant environmental regulations and technical standards; 

b) Centralized wastewater collection and treatment system for an industrial cluster may be built in parts expressed in single segments (or modules) or in whole in proportion to the progress of occupancy of that industrial cluster, ensure that all of wastewater generated from that industrial cluster’s operations must be treated in conformity with technical regulations on environment;  

c) Centralized wastewater collection and treatment system for an industrial cluster must conform to the following requirements: using a meter for measuring inflow and outflow volumes, and electronic meters for independent electricity measurement; installing conspicuous signs at discharge points; designing the working floor covering a space of at least 01 m^2, having walkways convenient for testing and inspection of regulatory authorities; making plans, infrastructure, equipment and instruments available for response and solution to any failure or breakdown that may happen to the system;  

d) The centralized wastewater collection and treatment system for an industrial cluster having the effluent flow volume of at least 1,000 m^3/day and night must be equipped with the automatic and continuous monitoring system as defined in Clause 1 and 3 of Article 26 hereof;

2. Management and operation of environmental protection infrastructure facilities in an industrial cluster must conform to the following requirements: 

a) The centralized wastewater collection and treatment system must be regularly operated in conformance to the regulatory technological process to ensure that wastewater is treated in conformity with technical regulations on environment before being discharged into the receiving source; 

b) Operation of the centralized wastewater collection and treatment system must be recorded into the operational logbook in detail, including flow volume, typical parameters of influent and effluent (if any); volume of electricity consumed; type and amount of chemicals used and waste sludge produced.  The operational logbook must be written in Vietnamese and retained for a period of at least 02 years;

c) The centralized wastewater collection and treatment system must be maintained and serviced on a periodic basis to guarantee its normal working conditions;

d) Effluent must not be diluted before entering into the discharge point referred to in Point c Clause 1 of this Article;

dd) Sewage sludge generated in the centralized wastewater collection and treatment system, and rainwater drainage system, of an industrial cluster must be harvested, transported and treated or reused in accordance with laws and regulations on sewage sludge management.   

3. Exemptions from connection to the centralized wastewater collection and treatment system for an industrial cluster:

a) Any establishment generates an amount of wastewater in excess of the reception and treatment capacity of the centralized wastewater collection and treatment system for the industrial cluster, and is using its wastewater treatment method conformable to environmental technical regulations; 

b) Any establishment is operating within an industrial cluster that has not had the centralized wastewater collection and treatment system, and is using a wastewater treatment method conformable to environmental technical regulations.

1. Treating wastewater:

a) Sign and comply with records of agreement or contracts with investors in construction and business operation of infrastructure facilities installed in an industrial cluster on connecting wastewater to the centralized wastewater collection and treatment system of the industrial cluster, or enter into agreements on transfer of wastewater to be treated with authorized establishments in accordance with regulations laid down in Article 20 hereof;    

b) Establishments eligible for exemptions for connection defined in Clause 3 Article 5 hereof must observe regulations enshrined in Article 18 hereof.

2. Exercising responsibility for management of solid wastes, emissions, noise, vibration, light, heat and radiation as prescribed by Article 19 hereof.

3. Implementing environmental monitoring programs conducted by these establishments in accordance with applicable regulations, and notifying results achieved from such implementation to investors in construction and business operation of the industrial cluster’s establishments to make an integrated report to competent authorities. Informing local governments and environmental protection regulatory authorities, as well as investors in construction and business operation of the industrial cluster's infrastructure in case of environmental emergencies or incidents, and taking measures to respond to and mitigate these situations in accordance with laws and regulations.  

Article 7. Responsibilities of investors in construction and business operation of an industrial cluster’s infrastructure

1. Make investment in construction, management and operation of environmental protection infrastructure facilities for the industrial cluster as defined in Article 5 hereof. 

2. Do not expand the industrial cluster or approving more investment projects in the industrial cluster in the event that industrial cluster has yet to build any environmental protection infrastructure facilities as stipulated by Article 5 hereof. 

3. Pay environmental protection fees defined by laws.

5. Draw up, and allow for implementation of, environmental protection plans in accordance with Chapter V hereof.

6. Prepare and submit an integrated evaluation report on environmental monitoring and environmental protection activities in an industrial cluster and at establishments operating in that industrial cluster to the Department of Natural Resources and Environment ahead of December 31 every year.    The sample report is provided in the Appendix 1 hereto.

Article 8. Responsibilities of district-level People’s Committee

1. Command its subordinate agencies that have appropriate competence to make investment in construction, management and operation of environmental protection infrastructure facilities for an industrial cluster as defined in Article 5 hereof unless investors in construction and business operation of industrial cluster infrastructure have been determined in accordance with laws and regulations.

2. Direct its subordinate competent agencies not to approve any new investment project in an industrial cluster where technical infrastructure for environmental protection purposes is not available as prescribed in Article 5 hereof within its jurisdiction. 

3. Examine and inspect construction of environmental protection infrastructure for industrial clusters within its jurisdiction in accordance with laws and regulations. 

Article 9. Responsibilities of the provincial-level People’s Committee

1. Consider allocating the budget as subsidy on investment in construction of environmental protection infrastructure for industrial clusters that fall within its jurisdiction in accordance with laws and regulations.

Article 10. Management of wastewater and solid wastes

1. Concentrations of businesses and service providers must apply methods for treatment of all sewage generated from business and service activities; have a sewerage system with sufficient capacity to handle sewage produced by businesses and service providers within these concentrations; manage and guarantee stability of sewerage service activities in accordance with laws and regulations.  

2. Establishments, business or service households must apply solid waste sorting methods and not discharge solid waste into the sewerage system; transfer solid wastes to entities that have competence in collection, carriage and treatment thereof in accordance with laws and regulations.

3. The management boards of concentrations of businesses and service providers must carry out environmental protection activities for public places in accordance with Clause 2 Article 81 of the Law on Environmental Protection.

Article 11. Officers undertaking environmental protection tasks in concentrations of businesses and service providers 

The management board of a concentration of businesses and service providers must assign 01 officer in charge of environmental protection activities to carry out tasks specified in environmental protection plans, and exercise other environmental protection responsibilities in accordance with laws and regulations.

Chapter III

ENVIRONMENTAL PROTECTION FOR TRADE VILLAGES

Article 12. Environmental protection requirements for trade villages

2. Establishments operating within trade villages shall be obliged to:

a) obtain a state regulatory authority’s approval of their environmental impact statements or confirmation of their environmental protection plans, or submit their reports on environmental protection solutions as prescribed by Article 17 hereof (except for those referred to in sections 1, 2, 3, 4, 6, 7, 9, 10, 11 of Appendix IV to the Government’s Decree No. 18/2015/ND-CP dated February 14, 2015 on environmental protection scheme, strategic environment assessment, environmental impact assessment and environmental protection plan, hereinafter referred to as Decree No. 18/2015/ND-CP), or equivalent dossiers;

b) Implement methods for collection and treatment of wastewater (in the absence of the centralized treatment method) and emissions in conformity with relevant technical regulations; sort solid wastes and transfer them to licensed collection establishments in accordance with laws and regulations.

3. A trade village must construct environmental protection infrastructure, including the following facilities:

a) Wastewater or stormwater collection system ensuring that it has sufficient capacity to meet water drainage demands in the trade village and prevents any wastewater blockage, stagnation and inundation;

b) The centralized wastewater treatment system (if any) having sufficient capacity to guarantee that total volume of outflow of effluent before being discharged into the receiving source must be treated in conformity with relevant environmental technical regulations; 

c) The solid waste consolidation point that conforms to hygiene standards, and the solid waste treatment area that meets regulations on solid waste management, or agrees with the plan to transport solid wastes to the solid waste management area located away from the trade village.  

4. The trade village must establish an environmental protection self-management organization meeting the following requirements:

a) Have the establishment decision and operational rules adopted by the communal-level People's Committee;

5. The trade village must meet environmental protection requirements referred to in Clause 1, 2, 3 and 4 of this Article to qualify for trade village accreditation.

6. In the event that there is any trade village recognized as accredited trade village before the entry into force of this Circular but failing to meet environmental protection requirements set out in Clause 1, 2, 3 and 4 of this Article, the provincial-level People’s Committee shall direct its subordinate competent authorities to conduct improvements thereto.

Article 13. Evaluation and classification of trade villages by levels of environmental pollution

1. The provincial-level People’s Committee shall take on the burden of evaluating and classifying trade villages within its jurisdiction by levels of environmental pollution according to criteria for evaluation and classification stipulated in the Appendix 3 hereto.

2. Evaluation and classification of trade villages by levels of environmental pollution shall be performed on a biannual basis.

3. The list of trade villages evaluated and classified by levels of environmental pollution must be disseminated through local communication means or media.

Article 14. Measures for administration of trade villages causing environmental pollution and those causing serious environmental pollution

1. The communal-level People’s Committee shall adapt, submit to the district-level People’s Committee for its approval of, and conduct implementation of, the environmental protection plan of a trade village to reduce environmental pollution caused by that trade village.

2. Any establishment that does not belong in the list of trades and industries eligible for incentive policies within a trade village shall be required to observe regulations applicable to it as laid down in Chapter IV hereof, or must be completely relocated to an industrial zone or cluster, or animal farming concentrations outside of the residential area; change their existing trades to others; terminate their production.

Article 15. Responsibilities for making arrangements for implementation of plans for environmental protection for trade villages

1. Responsibilities of the communal-level People’s Committee:

a) Fulfill environmental protection requirements set out in contents of the approved plan for environmental protection of a trade village;

b) In case of environmental emergencies or incidents caused by any establishment, impose suspension of its operations, implement measures to limit the extent and degree of impact, and make mitigation efforts; instantly notify the district- and provincial-level People’s Committee and relevant authorities. 

2. Responsibilities of the district-level People’s Committee:

a) Allocate the funds in the authorized budget for implementation of environmental protection tasks in trade villages within its jurisdiction as stipulated by laws and regulations;

b) Expedite, guide and examine compliance with environmental protection requirements set out in the approved plan for environmental protection in a trade village;

c) Receive and handle environmental protection recommendations from environment-related institutional or individual entities throughout trade villages’ operations in accordance with laws and regulations.

Article 16. Responsibilities of environmental protection self-management organization of a trade village

1. Manage, operate, overhaul and improve environmental protection infrastructure facilities of the trade village as assigned by the communal-level People’s Committee.

2. Post up regulations, oversee and promote compliance with hygiene requirements in public places.

3. Participate in formulation and undertake implementation of the plan for environmental protection in the trade village, village conventions and regulations on environmental protection activities; make communicative and propaganda efforts in dissuading the public from eliminating unsound customs and habits which are unhygienic and harm environment. 

4. Get involved in inspecting compliance of establishments operating within the trade village with environmental protection regulations as assigned by the communal-level People’s Committee.

5. Promptly report to the communal-level People’s Committee if it has discovered any indicator of environmental pollution, environmental incidents or violation against laws and regulations on environmental protection for trade villages.

6. Submit an annual review report to the communal-level People’s Committee on its general operations, collection, transportation and treatment of wastes under its delegated authority before the 15^th day of October, or an ad-hoc report upon request. The sample report is provided in the Appendix 5 hereto.

Article 17. Responsibilities of establishments operating within a trade village

1. Owners of establishments operating within the trade village that belong in the list of trades and industries qualifying for incentive policies, as defined in the Appendix I to the Decree No. 19/2015/ND-CP, shall assume the following responsibilities: 

a) Prepare an evaluation report on environmental protection according to the sample report given in the Appendix 6 hereto as stipulated by Clause 1 Article 16 of the Decree No. 19/2015/ND-CP, and submit it to the communal-level People’s Committee for its inspection and supervision;

2. Establishments operating within the trade village that belong in the list of trades and industries qualifying for incentive policies, as defined in the Appendix I to the Decree No. 19/2015/ND-CP, must comply with provisions of the Chapter IV hereof and relevant environmental protection regulations. 

Chapter IV

ENVIRONMENTAL PROTECTION FOR PRODUCTION, COMMERCIAL AND SERVICE ESTABLISHMENTS

Article 18. Wastewater management

1. If any establishment located outside of an industrial zone or an industrial cluster that is not subject to Clause 1 Article 17 hereof operates its wastewater treatment system and has at least a flow volume of 30 m^3/day-night, in addition to implementing laws and regulations on wastewater management, it must keep a logbook of operation of this system which is fully compiled and retained for a period of at least 02 years.

The operational logbook must be written in the Vietnamese language, including the following details: flow volume, operational parameters, effluent and influent monitoring results (if any), type and amount of chemicals used, and volume of waste sludge produced, of or from the wastewater treatment system. 

2. If any establishment has a wastewater flow volume of at least 1,000 m^3/day-night, in addition to implementing regulations laid down in Clause 1 of this Article, it shall be required to perform the following duties:

a) Automatically and continually oversee and monitor effluent under regulations laid down in Clause 1 and 3 Article 26 hereof;

b) Install a separate digital electricity meter to measure the power consumption of the wastewater treatment system and record all measurement data into the operational logbook;

d) Set up a point of inspection and control of discharge of wastewater into the water drainage system installed outside of the perimeter fence which is located along convenient walkways, and have warning signs.

3. If any establishment that generates at least 1,000 m^3/day – night within the precincts of an industrial zone or industrial cluster is exempted from connecting to the centralized wastewater collection and treatment system, it shall be obliged to manage wastewater in compliance with Clause 2 of this Article.

4. Where establishments referred to in Clause 1, 2 and 3 of this Article do not autonomously treat non-hazardous wastewater and transfer their wastewater to wastewater treatment establishments that meet environmental technical standards, regulations enshrined in Article 20 hereof shall apply.

Article 19. Management of solid wastes, emissions, noise, vibration, light, heat and radiation

1. Production, commercial and service establishments must carry out management of municipal solid wastes, common industrial solid wastes, biomedical solid wastes and hazardous solid wastes generated from production, commercial and service activities in accordance with laws on solid waste management. 

2. Establishments generating emissions shall take on the following obligations:

a) Invest in and install emission the treatment system that meets regulatory environmental technical standards in which the working floor must be available for safe sampling of emission;

b) Keep an operational logbook of the emission treatment system which is fully compiled and retained for a period of at least 02 years. 

The operational logbook must be written in the Vietnamese language, including the following details: flow volume, operational parameters, amount of water and chemicals used (applicable to any establishment of which form and size is equivalent to establishments that require preparation of an environmental impact statement as defined in the Appendix II to the Decree No. 18/2015/ND-CP);

3. Any establishment creating noise, vibration, light, heat and radiation must invest in and install the system for reducing noise, vibration, light, heat and radiation that meets regulatory environmental technical standards and other relevant regulations.

Article 20. Regulatory environmental protection requirements for transfer of non-hazardous wastewater

1. Establishments transferring non-hazardous wastewater to serve treatment purposes must meet the following requirements:

a) Draw up the plan to transfer, handle and treat wastewater which is specified in the following submissions: the approved environmental impact statement, certified environmental protection proposal, approved detailed environmental protection scheme, certified simplified environmental protection scheme or other equivalents;

b) Apply the same national technical regulations on wastewater as those applied to wastewater receiving and treating establishments;

c) Hold a wastewater treatment contract with wastewater receiving and treating establishments in conformity with requirements set out in Clause 3 of this Article;

d) Build infrastructure facilities used for temporarily storing wastewater provided that these facilities help to prevent spills, overflows and leaks into the surrounding environment.

dd) Permissibly transfer wastewater to wastewater receiving and treating establishments which have signed wastewater treatment contracts agreeing to method of wastewater treatment, and volume of wastewater that is not in excess of the volume specified in the wastewater transfer and treatment plan referred to in Point a of this Clause; 

e) Assume responsibilities for transporting wastewater that fully conforms to regulations laid down in Clause 2 of this Article. Wastewater transfer activities must be fully recorded in the mandatory environmental compliance management report prepared on a periodic basis;

2. Wastewater transportation must conform to the following requirements:

a) Transfer wastewater only by drains which are subject to technical regulations on safe design and installation, prevent any spill into the surrounding environment, have valves and flow measurement meters, and are specified in the plan referred to in Point a Clause 1 of this Article, except for the case defined in Point b of this Clause;

b) Carry wastewater generated from drain rinses or hydraulic pressure tests by means of transport, which must conform to the following requirements:

Such means of transport must conform to traffic eligibility requirements as prescribed by laws on transportation, and must be placarded with the sign saying "non-hazardous waste inside" of appropriate size at the front, rear or both sides thereof. 

Storage equipment, holds or compartments must be airtight, watertight, and prevent leakage or corrosion risks from contact with wastewater.

3. Establishments receiving, handling and treating wastewater shall assume the following obligations:

a) Draw up the plan to receive and treat wastewater which is specified in the following submissions: the approved environmental impact statement, certified environmental protection proposal, approved environmental protection scheme, certified simplified environmental protection scheme or other equivalents;

b) Operate the wastewater treatment system built on the suitable technology and having sufficient capacity to treat influent wastewater; 

c) Have the meter to measure the flow volume of wastewater after treatment;

dd) Permissibly receive wastewater from wastewater transferring establishments which have signed wastewater treatment contracts agreeing to wastewater treatment method and volume of wastewater which is not in excess of the volume specified in the plan referred to in Point a of this Clause; 

e) Do not transfer received wastewater to another third party for treatment purposes;

g) Keep a logbook written in the Vietnamese language and retained for a minimum period of 02 years which records details about time, method and volume of received wastewater. Receiving wastewater for treatment purposes must be fully recorded in the environmental compliance management report prepared on a periodic basis as prescribed by laws and regulations.

Chapter V

ENVIRONMENTAL PROTECTION PLAN

Article 21. Entities requiring, and time of, preparation of environmental protection plan

1. Entities requiring preparation of environmental protection plan include:

a) Active industrial clusters, concentrations of businesses and service providers or establishments of which form and size is equivalent to those that require preparation of environmental impact statement as defined in the Appendix II to the Decree No. 18/2015/ND-CP; 

b) Trade villages.

3. Any entity, referred to in Point a Clause 1 of this Article, obtaining certification of its detailed feasibility study on the environmental protection project, must prepare the environmental protection plan after a competent regulatory authority’s inspection of completion of all environmental protection works as stated in Point c Clause 1 Article 9 of the Circular No. 26/2015/TT-BTNMT of the Minister of Natural Resources and Environment dated May 28, 2015 allowing for the detailed and simplified environmental protection scheme.

4. The environmental protection scheme shall be considered as one of the bases for implementation of laws on environmental protection and environmental protection measures by entities specified in Clause 1 of this Article, and the basis for a competent regulatory authority’s inspection and examination of such implementation.

Article 22. Contents of environmental protection plan

1. Entities, referred to in Point a Clause 1 Article 21 of this Circular, shall prepare the environmental protection plan by using the sample given in the Appendix 7 hereto which must be then deposited at establishment’s offices. 

2. Trade villages shall prepare the environmental protection plan by using the sample given in the Appendix 2 hereto.

Article 23. Approval of the environmental protection plan for trade villages

1. The People’s Committee of the commune where trade villages are located shall prepare application for approval of the environmental protection plan for these trade villages for submission to the district-level People’s Committee for its consideration and approval thereof.

2. A set of documents submitted to apply for approval of the environmental protection plan for trade villages shall include the followings:

a) 01 written request for approval of the environmental protection plan for trade villages by using the sample given in the Appendix 8 hereto;

c) 01 duplicate copy of the proposal to develop trade villages within its jurisdiction, approved by the provincial-level People’s Committee (where applicable).

3. Upon receipt of all required documents referred to in Clause 2 of this Article, the district-level People’s Committee shall consult with the Department of Natural Resources, and the Department of Agriculture and Rural Development during the process of considering and approving that plan.

4. Upon receipt of opinions from regulatory authorities, referred to in Clause 3 of this Article, the district-level People’s Committee shall be responsible for considering and approving that plan.

5. The time limit for consideration and approval of the plan shall not exceed 20 business days of receipt of all abovementioned documents. In case of rejection, the district-level People's Committee shall give a written notification in which reasons for such rejection must be clearly stated.

The decision to approve the environmental protection plan for trade villages shall be made by using the sample given in the Appendix 9 hereto.

6. Sign, stamp and send the environmental protection plan for trade villages:

a) after the plan has been approved, and the district-level People’s Committee has put its signature and stamp on the cover page of the plan;

b) The district-level People’s Committee shall send 01 copy of the approved decision to approve the environmental protection plan for trade villages to the communal-level People’s Committee, and 01 copy thereof to the Department of Natural Resources and Environment, as well as the Department of Agriculture and Rural Development.

Article 24. Responsibilities for implementation of the environmental protection plan

2. Preventing and responding to environmental incidents as specified in the environmental protection plan shall be provided for as follows: 

a) Investors in construction and business operation of infrastructure facilities of industrial clusters, management boards of concentrations of businesses and service providers, and owners of establishments, must establish and ensure sufficient capacity to carry out prevention of and response to environmental incidents during production, business and service activities;

b) In the event that any environmental incidents occur, these investors, management boards and owners shall be responsible for promptly notifying organizational entities concerned by using contents specified in the plan to prevent and respond to environmental emergencies or incidents; give alarm and muster workforce and equipment depending on the degree of environmental incidents or emergencies; implement pollution mitigation and environmental remediation measures upon the request of environmental protection authorities ;

c) Within a maximum period of 30 days after any environmental emergency or incident occurs, these investors, management boards and owners must send the People's Committee at all levels and the Department of Natural Resources and Environment the review report on environmental emergency or incident mitigation and response;

d) These investors, management boards and owners of those that cause environmental incidents or emergencies shall be liable for damages as specified in the Law on Environmental Protection and other relevant regulations.

Chapter VI

ENVIRONMENTAL MONITORING PRACTICE

Article 25. Periodic monitoring of waste generation

1. Regulated entities must carry out monitoring of wastewater and gas emissions generated from production, business and service activities, and the minimum frequency rate specified in the Appendix 10 hereto.

3. Establishments referred to in regulations of the Appendix IV to the Decree No. 18/2015/ND-CP and the Appendix I to the Decree No. 19/2015/ND-CP shall not be required to carry out monitoring of waste generation.

Article 26. Automatic monitoring of waste generation

1. Automatic monitoring of wastewater:

a) Parameters that must be measured through the monitoring process shall include the followings: flow volume of influent and effluent wastewater, pH level, temperature, COD, TSS and other activity-specific parameters (if there are technologies and equipment available on the market to be suitable for automatic monitoring activities) as requested by state regulatory authorities having competence in approving the environmental impact statement and detailed environmental protection scheme;

b) The automatic wastewater monitoring system must include the automatic sampler which is sealed and managed by the Department of Natural Resources and Environment; have the attached camera connected to Internet to observe the outlet of the wastewater treatment system and store images taken within the last 03 months.  

2. Automatic monitoring of gas emissions:

a) Parameters measured through the monitoring process are provided for in the Appendix 11 hereto;

b) In case an establishment has various sources of industrial emission generation that belong in the list referred to in the Appendix 11 hereto, the owner thereof shall carry out automatic and constant monitoring of all sources of generation thereof.

3. The system of automatic and constant monitoring of wastewater and gas emissions must operate in a stable manner, must be inspected and calibrated as prescribed, and ensure that it conforms to technical requirements concerning data connection to transmit data directly to the Department of Natural Resources and Environment.

1. Investors in construction and business operation of infrastructure facilities of industrial zones, industrial clusters, management boards of concentrations of businesses and service providers, and owners of establishments, must safely keep results achieved from the automatic environmental monitoring process in the form of electronic files; store the original of periodic report on results achieved from the environmental monitoring process, and the original of notification of analysis results, within a minimum period of 03 years.

2. These investors, management boards and owners shall be responsible for submitting required reports and results achieved from the environmental monitoring process.

3. These investors, management boards and owners that require automatic monitoring of waste generation shall be responsible for posting and publicizing the results achieved from the environmental monitoring process on a periodic basis on their websites (if available).

Chapter VII

ENFORCEMENT PROVISIONS

Article 28. Entry into force

1. This Circular shall enter into force from December 1, 2016.

2. The Circular No. 46/2011/TT-BTNMT of the Minister of Natural Resources and Environment dated December 26, 2011 providing for environmental protection for trade villages shall be repealed from the entry into force of this Circular.

3. Contents pertaining to the frequency rate at which waste generations are monitored as specified in the subsection 5.2 of the Appendix 2.3; subsection 3.3 of the Appendix 5.5 of the Circular No. 27/2015/TT-BTNMT of the Minister of Natural Resources and Environment dated May 29, 2015 on strategic environment assessment, environmental impact statement and environmental protection plan; Point b Clause 3 Article 7 of the Circular No. 40/2015/TT-BTNMT of the Minister of Natural Resources and Environment dated August 17, 2015 on the technical procedure for monitoring of gas emissions, shall become defunct from the entry into force of this Circular.

1. The Vietnam Environment Administration shall provide guidance on, and carry out inspection of, compliance with this Circular, and submit a periodic evaluation report on environmental protection activities for industrial clusters, concentrations of businesses and service providers and trade villages to the Ministry of Natural Resources and Environment that will be then responsible for making a final report to the Prime Minister.

2. Ministries, Ministry-level agencies, Government organs, People's Committee at all levels, Department of Natural Resources and Environment, and organizational or individual entities involved, shall be responsible for implementing this Circular.

3. Exercise of state-delegated authority over management of environmental protection activities for industrial clusters and trade villages referred to herein shall be financed by the state budget appropriations for environmental issues and other funds stipulated by laws and regulations.

4. In the course of implementation hereof, if any difficulty or problem occurs, institutions, organizations or individuals shall be advised to promptly report to the Ministry of Natural Resources and Environment for its review before any possible amendment is made./.

CRITERIA FOR EVALUATION AND CLASSIFICATION OF TRADE VILLAGES BY LEVELS OF ENVIRONMENTAL POLLUTION

Evaluation and classification of level of environmental pollution at each trade village shall be carried out according to the following steps:

Step 1: Identify the typical activity of each trade village (specific activities listed in the Table 2.1).

Step 2: Identify parameters of typical pollutants to be at least analyzed in each trade village, based on its typical activities (specified at the Table 2.1).
