NATIONAL PLAN FOR IMPLEMENTATION OF STOCKHOLM CONVENTION ON
PERSISTENT ORGANIC POLLUTANTS BY 2025 WITH ORIENTATION TO 2030

Pursuant to Stockholm
Convention on Persistent Organic Pollutants;
At the request of the
Minister of Natural Resources and Environment
HEREBY DECIDES:
Article 1. Promulgated with this Decision is the national plan for
implementation of Stockholm Convention on persistent organic pollutants by 2025
with orientation to 2030 (hereinafter referred to as “the Plan”) with the
following main contents:
1. Persistent Organic
Pollutants according to regulations of Stockholm Convention
The Stockholm Convention
on POPs (hereinafter referred to as the “Stockholm Convention”) is concluded
and approved in order to protect human health, biodiversity and the living
environment from the risks of persistent organic pollutants (hereinafter
referred to as “POPs”). The Stockholm Convention takes effect in 2004. This
provides for the stop of production, prohibition and restriction of use,
complete destruction of a number of POPs generated by human and implementation
of necessary measures to continuously minimize unintentinal POPs from
industrial production, livelihood of the people or waste treatment.
According to the
requirements of the Stockholm Convention dated August 10, 2006, the Prime
Minister has approved the national Plan for implementation of the Stockholm
Convention on POPs in Decision No. 184/2006/QD-TTg. In particular, the Prime
Minister has focused on management of 12 groups of POPs. From 2009 to present,
the Conference of Parties (COP) has added 14 new groups of POPs to Appendices
A, B and C of the Convention, risen the quantity of POP groups subject to
management to 28 groups, including plant protection chemicals and medical
chemicals (hereinafter referred to as “POP-BVTV”); industrial chemicals and
unintentinal POPs (hereinafter referred to as “UPOP”). The list of POPs shall
be provided according to the Stockholm Convention in Appendix 1 issued together
with this Decision.
According to the
requirements for environmental protection, protection of health, the result of
comprehensive assessment of economic and social impacts and the capacity for
replacement for POPs, the list of POPs will be continuously added to the
Stockholm Convention.
2. Responsibilities and rights of Vietnam to the
implementation of the Stockholm Convention

To carry out the
responsibilities and obligations of a member state according to regulations of
Article 7 of the Stockholm Convention, Vietnam shall be responsible for
updating the national Plan for implementation of the Stockholm Convention,
sending the Plan to the Secretariat of the Convention and periodically
reporting the implementation of this Plan.
3. Objectives of the Plan
a) General objectives
Safely manage POPs
throughout their life cycles, control pollution, reduce emission, treat and
phase out POPs in Vietnam in order to meet requirements of the Stockholm
Convention on POPs, contribute to protection of human health and environment,
ensure sustainable development in Vietnam and international integration.
b) Specific objectives
- Strengthen the institutional capacity, legal framework and
participation of the parties in management and replacement for POPs and toxic
chemicals.
- Strengthen the scientific and technological capacity for
monitoring, determination and management of POPs and toxic chemicals throughout
their life cycles with appropriate knowledge, information and technical
infrastructure.
- Raise awareness among relevant parties of POPs, toxic
chemicals, environmental health regarding POPs and management plans
(restriction of use, replacement, elimination, treatment and disposal) of POPs.
- Combine the implementation of the Stockholm Convention and
relevant environmental agreements towards achievement in the millennium
development goals and the sustainable development coals; combine the management
of chemicals, wastes and the national sustainable development strategy

- Safely manage materials and equipment with polychlorinated
biphenyls (hereinafter referred to as "PCB"); stop using equipment
with concentration of PCB that is 50 mg/kg and over by 2025.
- Control and restrict the safety management and use of
industrial POPs.
- Manage risks, treat, restore and monitor the environment in
areas that are polluted by dioxin from chemical toxins that the US used during
the war in Vietnam.
- Continuously reduce the emission of UPOPs from production,
trade and livelihood of the people; manage risks of UPOP to environment and
human health.
- Identify, treat, improve and recovery environment at
POP-contaminated areas.
4. Principles of implementation of Plan
a) Prioritize prevention,
safety management and management of the risks of POPs to human health and
environment with obvious awareness. This shows that POPs are immediate and long-term
hazards which have direct effects on human health, biodiversity and living
environment. The information on implementation of the Plan shall be overt
information according to regulations of law, especially information on the
results of implementation and environmental monitoring.
b) The Plan shall be
implemented according to the objectives of environmental protection,
sustainable development of Vietnam, the national strategies and relevant action
plans; combined with other activities and programs for environmental
protection, chemical safety management, sustainable production and consumption
in order to optimize the resources.
c) The central and local
authorities shall mobilize enterprises and community; cooperate with relevant
organizations and individuals in the implementation of this Plan.

5. Tasks on implementation of Plan
a) Formulation,
amendments and enhancement of the efficiency of regulations, policies and
institutions in order to meet the new requirements of the Stockholm Convention
and the requirements in Vietnam.
- Make regulations on environmental protection and safety
management of import, export, production, use, collection, storage, transport
and treatment of POPs, materials, equipment and waste containing POPs.
- Make regulations on assessment of risks and management,
environmental treatment and improvement applied to POP-contaminated areas.
- Review, adjust and amend national technical regulations and
standards on environment, occupational safety, hygiene and health regarding to
POPs.
- Identify and amend regulations on responsibilities and
mechanism for cooperation between central authorities and local authorities in
safety management throughout the life cycles of POPs materials, equipment,
waste containing POPs and POP-contaminated areas.
- Make regulations on assessment of impacts on health and
environment regarding the contact and exposure of POPs and other relevant
hazardous chemicals according to conditions of Vietnam; Make policies on
support for the scientific and technological research on assessment of impacts
on health and environment; identify, warn and overcome obstacles to community
health due to the impact of POPs and relevant hazardous chemicals.
- Make policies on promotion and support for the research and
assessment of impacts on economy, society and environment of POPs that are used
in the production, trade and services to meet the requirements for production,
consumption and sustainable development; encourage the replacement for POPs;
transfer of technology for treatment of POPs; apply the best available
techniques and the best environmental practices (BAT/BEP) in order to reduce
the use of POPs, emission of UPOP from industrial activities and livelihood of
the people, minimize the emission and exposure of POPs.
- Develop and combine the requirements for technology and
human resources with safety management of POPs in the policies on environmental
and health protection and sustainable development.

b) Safety management and
control of POP-BVTV chemicals (Appendix A, Part I of the Stockholm Convention).
- Control the import, trade, use, storage and transport of
POP-BVTV chemicals according to applicable regulations and requirements of the
Stockholm Convention.
- Control emission; inventory and safely manage POP-BVTV
chemicals.
- Monitor environment, control pollution and treat packing,
containers containing POP-BVTV chemicals with expired date and discarded
products, wastes containing POP-BVTV chemicals.
- Assess the impact of some new POP-BVTVs on the environment
and human health in Vietnam.
- Assess and consider registration of exemption and proper
use of some new POP-BVTV chemicals that are added into the Stockholm Convention
in Vietnam.
c) Safety management and
control of PCB-pollution (Appendix A, Part II of the Stockholm Convention).
- Closely control the import of materials, equipment, scraps
and wastes containing PCB into Vietnam.
- Comprehensively inventory materials, equipment and wastes
containing PCB, build and operate database on materials, equipment and wastes
containing PCB.

- Enhance measures for management of PCB according to the
assessment and management of risks of PCB to the environment and health;
assess, identify and handle PCB-contaminated areas.
- Promote the research, assessment, transfer and application
of technology to treatment of materials, equipment and wastes containing PCB;
take measures for storage and effective and safe treatment of materials,
equipment and wastes containing PCB by 2028.
Safety management and
contamination control of chemical groups including hexabromodiphenyl ete,
heptabromodiphenyl ete, tetrabromodiphenyl ete, pentabromodiphenyl ete and
decabromodiphenyl ete (hereinafter referred to as “POP-BDE group) (Appendix A,
Part IV, V, Stockholm Convention) ).
- Control the export and import of materials and products in
the POP-BDE group, focus on electrical and electronic products, fire-proof
materials, means of transport and household appliances.
- Assess the production and trade of materials and products
in the POP-BDE group and inventory chemicals, materials, products and wastes in
the POP-BDE group; make periodical reports according to the requirements of the
Stockholm Convention.
- Apply the best available techniques and the best
environmental practices to the classification, collection, transport, recycling
and safe treatment of materials and wastes containing POP-BDE; control the
recycling and safe treatment of chemicals in the PPOP-BDE group and ensure that
the POP-BDE is not reclaimed for the purpose of re-use; assess and consider the
registration of exemption and proper use of the materials and products
containing POP-BDE in Vietnam.
dd) Safety management and
contamination control of chemical groups including perluorooctanesulfonic and
perfluorooctane sulfonyl fluoride (hereinafter referred to as “PFOS and PFOSF”)
(Appendix B, Part III of the Stockholm Convention).
- Strictly control the export and import of materials,
products and equipment containing PFOS and PFOSF; assess the state of use,
storage, disposal and inventory PFOS and PFOSF.
- Control the use and disposal of PFOS, PFOSF; assess and
consider registration of exemption and proper use of materials, products and
equipment containing PFOS, PFOSF in Vietnam.

e) Safety management and
contamination control of chemical groups including hexabromobiphenyl;
hexabromocyclododecane; hexachlorobutadiene; pentachlorophenol, its salts and
estes; polychlroinated naphthalene; short-chain chlorinated paraffins (Annex A,
Stockholm Convention).
- Assess and identify materials and products containing
chemicals in the group of hexabromobiphenyls (hereinafter referred to as
“HBB”); hexabromocyclododecane (HBCD); hexachlorobutadiene (HCBD);
pentachlorophenol, its salts and esters (PCP); polychlorinated naphthalene
(PCN) and short-chain chlorinated paraffins (SCCP).
- Control the export and import of materials, products and
equipment containing chemical groups including HBCD, HCBD, PCP, PCN,
Decabromodiphenyl ether (DBDE) and SCCP; inventory chemical groups including
HBCD, HCBD, PCP, PCN, DBDE and SCCP.
- Safely manage and reduce the use of chemicals including
HBCD, HCBD, PCP, PCNs, DBDE and SCCP in production and trade; apply the best
available techniques and the best environmental practices to classification,
collection, transportation, recycling and safe treatment of materials and
wastes containing HBCD, HCBD, PCP, PCN, DBDE and SCCP.
- Monitor HBCD, HCBD, PCP, PCN, DBDE and SCCP chemicals in
the environment, materials, products, wastes and polluted areas in order to
assess risks and apply measures for management of environmental health.
- Assess and consider the registration of exemption and
proper use of chemical groups including PCN, HBCD, DBDE and SCCP in Vietnam.
g) Treatment, improvement
and recovery of environmental pollution in agent orange/dioxins-contaminated
areas
- Comprehensively assess the scope, level of contamination,
risk and long-term consequences of agent orange/dioxin for the environment and
people; monitor environmental health in dioxin-contaminated areas with
completed, ongoing or planned remediation
- Sustainably manage dioxin-contaminated areas with ongoing
remediation.

- Raise the awareness, encourage and promote the
participation of community and international organizations in order to enhance
the capacity for monitoring and handling of polluted areas, restriction of
harms and recovery of consequences of agent orange/dioxin; harmonize the
implementation of the Stockholm Convention with the implementation of policies
on recovery of consequences of agent orange/dioxin in Vietnam.
- Enhance the research and application of technology to
thorough treatment of contamination of agent orange/dioxin according to the
conditions of Vietnam.
h) Control and reduction
of emission of UPOP from socio-economic activities (Appendix C, Stockholm
Convention).
- Research and assess level of emission of UPOP and relevant
hazardous chemicals from waste treatment facilities, landfills, agricultural
activities and livelihood of the people; propose and implement measures for
safety management of environment and health.
- Assess and identify level of UPOP emission and relevant
hazardous chemicals from major industrial sources and implement policies,
regulations and the best available techniques and the best environmental
practices in order to reduce emission of UPOP to the environment.
- Assess, manage risks and take measures for reduction of
emission of UPOP from open burning without control including domestic,
agricultural and forest waste burning and explosive incidents.
- Assess emission and take measures for management of risks
of emission of UPOP from transportation activities and other mobile sources;
- Carry out the national inventory and develop the database
on management of emission of UPOP in Vietnam.
i) Control of pollution
and environmental recovery and treatment in POP-contaminated areas (Article 6
of the Stockholm Convention)

- Promote research; apply technology and take measures for
environmental recovery and treatment in hazardous chemicals and
POP-contaminated areas.
- Monitor and supervise the hazardous chemicals and
POP-contaminated areas in order to control emission of POPs.
k) Raising of awareness,
training and education in the risks of POPs and hazardous chemicals (Article 10
of the Stockholm Convention).
- Assess the state of awareness, identify the priority and
formulate training materials, technical guidelines in accordance with the
training programs of each group of subjects.
- Organize training course on improvement of the capacity for
safety management and handling of POPs, hazardous chemicals, toxicological
issues, environment, ecology and labour safety regarding POPs for the relevant
subjects.
- Disseminate information and raise public awareness of risks
to the environment and human health due to contact, exposure, absorption and
accumulation of POPs and hazardous chemicals.
- - Actively provide and exchange information about the risks
to environmental health of POPs; warning about the risks to environment and
health; list, expenses and benefits of the chemicals that are replaced with
POPs; the best available techniques and the best environmental practices in
order to reduce emission and the impact of POPs on the environment and human
health.
- Organize training and communication activities to raise
awareness among manufacturers and consumers of sustainable production and
consumption of products and materials regarding POPs.
l) Enhancement of the
capacity for research, development, monitoring, management of risk, safety
management and handling of materials, products, wastes containing POPs and
hazardous chemicals (Article 11 of the Stockholm Convention).

- Support research and application of chemicals, materials,
products, new equipment to replacement and reduction of use of POPs and
materials, products, equipment containing POPs.
- Strengthen the capacity of laboratories for analysis,
monitoring and assessment of the risks to environment and health of POPs;
integrate monitoring and research on POPs with medical researches and chemical
exposure.
- Monitor the state of national environment about POPs and
hazardous chemicals; integrate with health impact assessment; integrate
information into provincial-level and national reports on the state of
environment.
- Research and assess the impacts of POPs that are used,
discarded and replaced on economy, society and culture
m) Management of
environmental health regarding POPs (Article 11 of the Stockholm Convention).
- Develop programs for monitoring POPs in the environment,
materials, products, wastes and polluted areas in order to assess, warn about
risks and take measures for improvement of environmental health; investigation
and research on epidemiology and assessment of the scale and level of impact of
POPs on health of the community.
- Develop a master plan and take measures for intervention in
order to minimize the level and scope of the risks to people's health in the
hazardous chemicals and POP-contaminated areas.
- Strengthen the environmental health management and
organization network; make national environmental health records including POPs
and hazardous chemicals.
- Formulate and implement the program for raising public
awareness of environmental health regarding POPs and hazardous chemicals;
disseminate information and warn about the harms of POPs and hazardous
chemicals to human health.

- The national presiding authority shall perform the
following main contents: take charge and cooperate with the Stockholm
Convention in collection, synthesis, updating and exchange of information
according to the Convention; make reports on safety management of POPs
according to the Stockholm Convention; summarize information from central and
local authorities, relevant organizations and individuals; periodically report
on the implementation and results of the Plan to the Government; summarize
information and make national reports to the Conference of the parties
according to the request of the Secretariat of the Convention for management of
POPs in Vietnam; monitor, update and adjust contents of the Plan according to
new requirements of the Convention and actual conditions of Vietnam, regions
and the world; summarize information, assess risks, impacts and feasibility in
order to propose or approve propose of other countries for addition of POPs to
the list subject to management of the Stockholm Convention.
- The relevant agencies, organizations and individuals shall
be responsible for synthesizing, exchanging and sharing information about the
results of inventory and management throughout life cycles of POPs, the results
of assessment and management of the risks of POPs, researches on POPs and
products that replace POPs; communication activities in order to raise
awareness of POPs.
6. Prior programs and projects
To meet objectives and
tasks of the Plan, the ministries shall be responsible for conducting and
approving under their competence or submitting the programs and projects
enclosed with Appendix 2 to this Decision to the Prime Minister for
consideration and approval
7. Resources for the purpose of implementation of the Plan
a) The resources for the
purpose of implementation of the national Plan shall be mobilized and optimized
according to the following contents:
- Cooperate and integrate with programs and projects on
sustainable development, climate change, resource management, waste management,
science and technology and other relevant programs, projects and activities in
order to attract investment and increase the efficiency of the use of
resources.
- Mobilize a number of various financial sources from the
state budget, non-refundable ODA, loans and grants from organizations and
individuals.
- Encourage investors, enterprises and social organizations
to invest in projects on remedy for pollution throughout preferential policies
on land, tax exemption and reduction, preferential credit loans and other
public-private partnership activities in the management of POPs.

- Strengthen international cooperation in many sectors
including: technology, grant aid for project construction, capacity
improvement, institutional completion, project-based support, settlement of
problems regarding health and social welfare for relevant subjects.
b) Allocation of funding
- The funding for programs and projects in Appendix 2 issued
together with this Decision shall be mobilized from the following sources:
+ State budget capital
(and official development assistance capital hereinafter referred to as “ODA”),
including: development investment capital, frequent expenditure (economy,
science, training, environment, administrative management expenditure, loans, technical
support,...).
+ Legal funding and
investment capital of domestic and foreign organizations and individuals
- The funding for programs, projects and activities that are
not on Appendix 2 issued with this Decision shall be allocated in the annual budget
expenditure estimates of relevant ministries, agencies, organizations and local
authorities according to the decentralization of current state budget.
According to the contents
of the plan and the list of programs and projects issued together with this
Decision, the central and local authorities shall make budget estimates
according to the structure of funding thereof; summarize in annual budget
estimates of the central and local authorities and submit it to competent
authorities according to regulations of the Law on State Budget and guiding
documents.
8. Monitoring and assessment of implementation of the Plan.
a) The ministries,
ministerial-level agencies, agencies affiliated to the Government, the People's
Committees of provinces, according to their functions and assigned tasks, shall
monitor and assess the result of implementation of the Plan.

- The results of implementation shall be assessed according
to the achieved objectives of the Plan;
- Progress of formulation and implementation of programs and
projects;
- Result of implementation of contents of
the Plan;
- Disbursement and use of capital sources of programs and
projects.
c) Mechanism for
monitoring and assessment:
- The monitoring and assessment shall be annually conducted
and integrated with the process of summary and assessment of the results of
implementation of tasks of the sector and tasks on socio-economic development
of local areas;
- The results of monitoring and assessment shall be published
in the mass media and used as criteria for consideration in emulation and
reward of sectors and local authorities.
9. Implementation
The Government unifies
direction and management of the implementation of the Stockholm Convention in
Vietnam. The relevant agencies, organizations and local authorities shall be
responsible for implementation of the tasks that are assigned in this Plan.

a) The Ministry of
Natural Resources and Environment shall take charge and cooperate in
implementation of the Stockholm Convention in Vietnam according to the Government's
commitments to the Stockholm Convention and the assigned tasks in this Plan;
take charge and cooperate with relevant central authorities in consolidation
and maintenance of operations of the Steering Committee for the Stockholm
Convention in Vietnam; enhance capacity of dedicated agencies for monitoring
and summarizing the implementation of the Stockholm Convention on POPs;
regularly supervise and inspect central authorities and the People's Committees
of provinces for their performance of assigned tasks; periodically report on
the result of implementation of the national Plan and the Stockholm Convention
to the Prime Minister and the Stockholm Convention.
b) The Ministry of
Industry and Trade shall inventory and assess POPs that are used in the industrial
sectors; inventory emission of UPOP from the industrial sectors; apply measures
to reduce, replace and limit emission of POPs in the industrial sectors;
provide information for the Ministry of Natural Resources and Environment on
the demand for use of POPs in order to register for an exemption according to
regulations of the Stockholm Convention; submit a report on the results of
implementation to the Ministry of Natural Resources and Environment before
December 31 every year. The Ministry of Natural Resources and Environment shall
summarize and submit the report to the Prime Minister.
c) The Ministry of
Agriculture and Rural Development shall strictly control the import and export
of POPs that are used in agriculture; inventory, assess the use of plan
protection chemicals containing POPs; provide information for the Ministry of
Natural Resources and Environment in order to register for exemption according
to regulations of the Stockholm Convention; submit a report on the result of
implementation to the Ministry of Natural Resources and Environment before
December 31 every year. The Ministry of Natural Resources and Environment shall
summarize and submit the report to the Prime Minister.
d) The Ministry of Health
shall strictly control the import and export of POPs that are used in the
medical field; submit a report on the results of implementation to the Ministry
of Natural Resources and Environment before December 31 every year. The
Ministry of Natural Resources and Environment shall summarize and submit the
report to the Prime Minister.
dd) The Ministry of
Planning and Investment and the Ministry of Finance shall balance and allocate
capital from the State budget and other capital sources of the annual and
long-term plans in order to effectively carry out contents, programs and
projects of the Plan.
e) The relevant central
authorities, according to their functions and assigned tasks shall be
responsible for building and carrying out the assigned programs and projects of
the Plan; submitting a report on the results of implementation to the Ministry
of Natural Resources and Environment before December 31 every year. The
Ministry of Natural Resources and Environment shall summarize and submit the
report to the Prime Minister.
g) The People's
Committees of provinces shall be responsible for building and carrying out the
assigned programs and projects of the Plan; according to contents of the Plan,
allocating the sources of funding for environmental works for management and
control of POPs and funding for scientific works for support for the
improvement of capacity for assessment and handling of POPs in their province;
directing the Departments of Natural Resources and Environment and provincial
authorities to manage and control POPs; submitting a report on the result of
implementation to the Ministry of Natural Resources and Environment bore
December 31 every year. The Ministry of Natural Resources and Environment shall
summarize and submit the report to the Prime Minister
h) The Vietnam
Environment Administration (the Ministry of Natural Resources and Environment)
shall be responsible for implementation of the Stockholm Convention and the
Plan; making of periodical report on the result of implementation of the Plan
and submitting it to the Ministry of Natural Resources and Environment, the
Prime Minister and the Secretariat of the Stockholm Convention.
i) The research units and
relevant associations shall cooperate with the Ministry of Natural Resources
and Environment in implementation of the Plan.

Article 3. The Ministers, Heads of the ministerial-level agencies,
Heads of agencies affiliated to the Government, the Presidents of the People's
Committees of provinces and Heads of relevant agencies shall be responsible for
the implementation of this Decision.
