CIRCULAR

PRESCRIBING LIST OF LICENSE-EXEMPT RADIO DEVICES AND ACCOMPANYING TECHNICAL AND OPERATIONAL CONDITIONS 

Pursuant to the Law on radio frequency dated November 23, 2009;

Pursuant to the Government’s Decree No. 17/2017/ND-CP dated February 17, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Information and Communications;

Pursuant to the Decision No. 71/2013/QD-TTg dated November 21, 2013 by the Prime Minister promulgating the Plan for national radio spectrum as amended by the Decision No. 02/2017/QD-TTg dated January 17, 2017 by the Prime Minister;

At the request of the Director of the Authority of Radio Frequency Management,

The Minister of Information and Communications promulgates a Circular prescribing list of license-exempt radio devices and accompanying technical and operational conditions.

2. This Circular applies to organizations and individuals that manage, use, produce, import or trade the radio devices exempt specified in Clause 1 of this Article in Vietnam.

3. This Circular does not apply to the radio devices which are produced, imported and used for serving the performance of national defense and security duties of armed forces. The production, import and use of these radio devices shall be subject to regulations adopted by the Ministry of National Defence or the Ministry of Public Security in conformity with corresponding national technical regulations.

Article 2. Definitions

For the purposes of this Circular, the terms below are construed as follows:

1. “Short Range Device” means a radio transmitter or a radio transceiver that has low capability of causing harmful interference to other radio equipment when meeting certain technical and operational conditions.

2. “Non-Specific Short Range Device” means a Short Range Device meeting all of technical and operational conditions as prescribed, regardless of their applications or uses.

3. “Cordless Phone” means a terminal telephonic apparatus that is connected to the public switched telephone network through two-wire analog interface. This device consists of a base unit and a mobile unit connected to each other by means of radio link:

The base unit (also called as the base station) is located at a fixed place and connected to two fixed telephone lines of the PSTN (Public Switched Telephone Network) using an integrated antenna. The integrated antenna is fixed inside or outside the base unit as its part.

The mobile unit (also called as the portable station) is a handset using integrated antenna. The mobile unit shall have the same subscriber number with the base unit.

Medical Implant Communications Systems (MICS) and Medical Implant Telemetry Systems (MITS) mean the systems consisting of an implantable medical device placed in the human body and a radio communication device outside the body to communicate data with the implantable device in a distance around 02 meters; received data shall be transmitted to the data processing center and doctors by means of telecommunication network.

MICS provides two-way communications between an implantable device and a radio communication device. MITS provides one-way communications from an implantable device to a radio communication device at pre-programmed times.

5. Radio Frequency Identification (RFID)

RFID uses the radio waves to automatically identify, manage and track goods, people and animals and have other applications.

RFID consists of a Radio Frequency tag and a Radio Frequency Reader which are connected to each other through the radio interface as follows:

- Radio Frequency tag (RF tag) has an electronic chip, with or without power source, and is attached to the object to be identified. The electronic chip contains information about the object to be identified.

- The Radio Frequency Reader (RF reader) generates signal at a determined frequency to activate the RF tag and read its response. The RF reader shall transmit the information received from the RF tag to the data processing system.

RFID has many applications in the fields of distribution, transportation and retailing, healthcare services, traffic or is used in mobile applications.

Anti-theft device, motion detector and metal detector are certain types of Radio Detection and Alarm Devices.

7. Wireless Audio Device

Wireless Audio Device means a device that uses radio waves to transmit sound in a short distance. There are typical types of Wireless Audio Devices such as wireless lavalier microphone, wireless handset microphone, wireless earphones, personal FM transmitter and hearing aids.

Short-range wireless audio devices prescribed in this Circular exclude wireless audio transmitters using the 470-694 MHz frequency band, with the effective radiated power above 30 mW ERP, used in radio and television sector.

8. Remote Control Device

Remote Control Devices are devices using radio waves to control models and have other control applications in industrial and civil sectors.

Typical types of remote control devices: remote control devices for models in the air such as model airplanes, remote control devices for models on land and water surface such model cars and model ships, remote control devices in industrial and civil sectors such as remote car door openers and remote garage door openers.

9. Wireless Local Area Network (WLAN) or Radio Local Area Network (RLAN)

WLAN/RLAN is used to set up the radio local area network or enable users to connect all devices wirelessly.

10. Telemetry Device

Telemetry Device means a device using radio waves to automatically display or record remotely measured parameters and control functions of other devices by means of radio interface. Telemetry Devices prescribed in this Circular also include short-range radar transceivers used for measuring levels of substances (liquids, adhesives, glues) in closed tanks or on site to serve industrial and production activities.

11. Wireless Video Transmitter

Wireless Video Transmitter is used to send image data (or image and sound data) to the processing system through the radio interface.

Typical types of wireless video transmitters are wireless webcam, wireless camera and wireless video transmitters through computer USB port.

12. Radio devices placed on fishing vessels

Radio devices placed on fishing vessels are used to facilitate communications between fishing vessels operating within the territorial waters of Vietnam.

13. Receive-only radio device is a radio device that has the function to receive radio wave signals only.

14. Automotive Radar, Radar sensor or Road Transport and Traffic Telematics is a short-range radar device that is used in traffic communication applications (road or railway) such as cruise control, detection, warning and avoidance of collisions between vehicles and surrounding objects.

16. Ultra Wide Band Device (UWB) is a short-range radio device that is used to transmit data and radio-frequency energy that spreads over a very large frequency range (a -10 dB bandwidth, sign B-10, of at least 500 MHz, or a -10 dB fractional bandwidth, sign U-10, greater than 0,2). The bandwidth B-10 and fractional bandwidth U-10 are calculated as follows:

B-10 = fH - fL (where: fH is highest frequency and fL is the lowest frequency. At these frequencies, the power spectral density of the UWB transmission is -10 dB relative to fM);

U-10 = B-10/fc (fc  is the centre frequency of the -10 dB bandwidth, and fc = (fH + fL)/2).

17. Inductive Loop is a short-range radio device operating according to electromagnetic field theory (radiative near field) and using low frequency.

18. Automatic Identification System (AIS) means a radio device used in maritime safety systems on vessels/ships and other motorised or non-motorised vehicles with the aims of avoiding collisions and managing surface or underwater vehicles.

19. Emergency Position Indicating Radio Beacon (EPIRB) means a radio device that is used to locate emergency cases in the 406-406.1 MHz frequency band and placed on surface or underwater vehicles such as vessels/ships and other motorised or non-motorised vehicles.

20. Search and Rescue Radar Transponder (SART) means a radio device intended for marine search and rescue operations in the 9 GHz frequency band.

21. AIS Search and Rescue Transmitter (AIS-SART) means a radio device in the group of marine supporting devices used for supporting search and rescue agencies in locating survival equipment or distressed vessels.

22. Emergency Locator Transmitter (ELT) means a device that transmits a distress signal on the 406 MHz frequency and is designed for use in aircrafts.

24. Low Power Wide Area Network (LPWAN) consists of sensors and devices transmitting and receiving sensor data which are connected to each other by means of radio interface, and use the spectrum shared with other short-range radio devices. The LPWAN devices prescribed in this Circular exclude those using the frequency bands granted license to use radio frequencies according to radio frequency planning (e.g.: LPWAN devices using NB-IoT, LTE-M…).

25. Wireless Power Transfer (WPT) means a radio device that transmits electrical energy and signal from a power source to a receiver device according to electromagnetic induction theory.

26. ERP means Effective Radiated Power.

27. EIRP means Equivalent Isotropically Radiated Power.

28. ERPEP means Effective Radiated Peak Envelope Power.

Article 3. List of license-exempt radio devices and accompanying technical and operational conditions

1. The list of license-exempt radio devices (hereinafter referred to as the “List”) is provided in Appendix 1 enclosed herewith.

2. Technical and operational conditions applied to license-exempt radio devices are provided for in Appendix 2-20 enclosed herewith.

a) The radio device is included in the List provided in Appendix 1 enclosed herewith;

b) It meets the general requirements laid down in Article 6 of this Circular;

c) It meets corresponding technical and operation conditions specified in Appendix 2-20 enclosed herewith.

Article 5. Management and use of radio devices which are included the List but do not meet accompanying technical and operational conditions

The radio devices which are included in the List provided in Appendix 1 enclosed herewith but do not meet accompanying technical and operation conditions provided in Appendix 2-20 enclosed herewith shall not be used in Vietnam, except the following devices which may be used under the license to use radio frequency and radio devices:

1. RFID operating in the 920-923 MHz frequency band and used for non-stop electronic toll collection stations with a radiated power above 500 mW ERP to 2000 mW ERP.

2. LPWAN devices operating in the 433,05-434,79 MHz frequency band with a radiated power above 25 mW ERP to 100 mW ERP and those operating in the 920-923 MHz frequency band with a radiated power above 25 mW ERP to 306 mW ERP.

3. Radio devices placed on fishing vessels operating on the frequencies outside the 26,96-27,41 MHz frequency band under the radio frequency planning.

4. Radio terminal devices used for safety and rescue purposes and operating on the frequencies prescribed by the international organizations to which Vietnam is a signatory or prescribed in the frequency use planning but not prescribed in this Circular.

1. License-exempt radio devices used for emergency, safety, search and rescue shall be protected from harmful interference as prescribed by law when they operate in the frequency channels or bands specified in Appendix 20 enclosed herewith. The use of license-exempt radio devices in other cases may tolerate harmful interference caused by radio devices licensed to use radio frequency and those licensed to operate by competent authorities.

2. In case a license-exempt radio device causes harmful interference to the radio devices licensed to use radio frequency or those licensed to operate by competent authorities, the operation of that license-exempt device must be immediately suspended and may be resumed only when interference problems are successfully remedied.

3. License-exempt radio devices must accept harmful interference caused by devices using radio frequency for industrial, scientific and medical (ISM) purposes when they share the following ISM frequency bands:

a) Frequency band 13,553 ÷ 13,567 MHz;

b) Frequency band 26,957 ÷ 27,283 MHz;

c) Frequency band 40,66 ÷ 40,70 MHz;

d) Frequency band 2400 ÷ 2483,5 MHz;

dd) Frequency band 5725 ÷ 5875 MHz;

e) Frequency band 24000 ÷ 24250 MHz.

5. Operators/users of license-exempt radio devices with integrated remote control in model airplanes must strictly comply with regulations of law on licensing for flight activities.

6. Users of receive-only radio devices exempted from radio frequency licensing must strictly comply with regulations of laws on telecommunications and radio frequency and other relevant laws.

Article 7. Transition 

Radio devices in use that meet the requirements laid down in the Circular No. 46/2016/TT-BTTTT dated December 26, 2016 of the Minister of Information and Communications, as amended in the Circular No. 18/2018/TT-BTTTT dated December 20, 2018 of the Minister of Information and Communications but do not satisfy the requirements laid down in this Circular may continue to be used provided that such use must be stopped immediately when they are determined by radio frequency authorities to have caused harmful interference to radio devices licensed to use radio frequency or those licensed to operate by competent authorities.

Article 8. Implementation 

1. This Circular comes into force from November 28, 2021 and supersedes the following documents:

a) Circular No. 46/2016/TT-BTTTT dated December 26, 2016 of the Minister of Information and Communications.

b) Circular No. 18/2018/TT-BTTTT dated December 20, 2018 of the Minister of Information and Communications.

2. Chief of Ministry’s Office, Director of the Authority of Radio Frequency Management, heads of affiliates of Ministry of Information and Communications, and relevant organizations and individuals shall implement this Circular./.

Note 1:

Receive-only radio device is included in the List of license-exempt radio devices. Users of receive-only radio devices exempted from radio frequency licensing must strictly comply with regulations of laws on telecommunications and radio frequency and other relevant laws, and shall not be allowed to use the received information for illegal purposes.

If users of the following types of receive-only radio devices want to protect their devices from harmful interference, they are required to follow procedures for license to use radio frequency in accordance with guidelines on procedures for issuance of license to use radio frequency, leasing and lending of radio devices, and shared use of radio frequency provided by the Ministry of Information and Communications:

a) Television Receive Only (TVRO). Operators/users of TVRO stations shall comply with regulations of law on telecommunications, press, radio and television broadcasting;

b) Earth Exploration Satellite Service (EESS).

Type of radio devices: stipulate name of the licensed radio device or application which is included in the List provided in Appendix 1 enclosed herewith.

Main emission: stipulate the maximum limit on the field strength or the power of the main emission expressed in the form of Effective Radiated Power (ERP) or Effective Radiated Peak Envelope Power (ERPEP) or Equivalent Isotropically Radiated Power (EIRP) (except SART: stipulate minimum radiated power).

Spurious emission or unwanted emission: stipulate maximum limit on power of spurious emission, out-of-band emission or minimum limit on emission depletion compared to the main emission.

1.1. Conditions for use of safety and rescue channel

1.1.1. In case of emergency where people and vessels at sea may face danger, in addition to channel 9 (which serves safety and rescue information), relevant organizations and individuals may create waves to attract attention on any channels in the Table of frequency allocations when sending distress signals.

1.1.2. When receiving distress signals, radio stations must immediately stop transmitting waves on the frequency which may cause interference to distress signals and keep listening on frequencies designated for transmission of distress signals; reply and provide necessary assistance, and inform search and rescue agencies.

1.2. Conditions for use of calling channel

1.2.1. Calling channels (channel 11 and channel 19) are dedicated for making calls between fishing vessels.

1.2.2. The length of call made on the calling channel shall not exceed 1 minute. The calling station must say its name and call name of the receiving station (3 times) on the calling channel. Immediately after receiving response from the receiving station, the calling station must actively name the communication channel so that both stations communicate on such communication channel; the communication on the calling channel is not allowed.

1.3. Conditions for use of communication channel

1.3.1. Communication channel is selected from 37 channels specified in the Table of frequency allocations (excluding safety and rescue channel, and calling channels). If the selected communication channel is interfered by other stations, the communication may be transferred to another communication channel to avoid interference.

1.3.2. Communications between stations on a communication channel shall not exceed 5 minutes. If the exchange requires a period more than 5 minutes, the communication must be stopped for one minute before continued.

1.4.1. Use a power exceeding the radiated power limits prescribed in this Appendix.

1.4.2. Cause harmful interference to the safety and rescue channel.

1.4.3. Use the safety and rescue channel for making calls and communications.

1.4.4. Use the calling channel for communication (unless transmission of distress signals).

1.4.5. Make communications on the communication channel for a consecutive period of exceeding 5 minutes or generate any carrier that interferences between calls.

1.4.6. Send call or identification signals consecutively or repeatedly for a period of more than 1 minute on the calling channel.

1.4.7. Send identification signals on two or several frequencies at the same time in order to contact with the only station.
