NGHỊ ĐỊNH

CỦA CHÍNH PHỦ SỐ 63/2003/NĐ-CP NGÀY 11 THÁNG 6 NĂM 2003 QUY ĐỊNH CHỨC NĂNG, NHIỆM VỤ, QUYỀN HẠN VÀ CƠ CẤU TỔ CHỨC CỦA BỘ VĂN HOÁ - THÔNG TIN

Căn cứ Luật Tổ chức Chính phủ ngày 25 tháng 12 năm 2001;
Căn cứ Nghị quyết số 02/2002/QH11 ngày 05 tháng 8 năm 2002 của Quốc hội nước Cộng hoà xã hội chủ nghĩa Việt Nam khoá XI, kỳ họp thứ nhất quy định danh sách các bộ và cơ quan ngang bộ của Chính phủ;
Căn cứ Nghị định số 86/2002/NĐ-CP ngày 05 tháng 11 năm 2002 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của bộ, cơ quan ngang bộ;
Theo đề nghị của Bộ trưởng Bộ Văn hoá - Thông tin và Bộ trưởng Bộ Nội vụ,

NGHỊ ĐỊNH :

Điều 1. Vị trí và chức năng

Bộ Văn hoá - Thông tin là cơ quan của Chính phủ thực hiện chức năng quản lý nhà nước về văn hoá, thông tin bao gồm : di sản văn hoá, nghệ thuật biểu diễn, điện ảnh, mỹ thuật, nhiếp ảnh, triển lãm, báo chí, xuất bản, quyền tác giả đối với tác phẩm văn học - nghệ thuật, thư viện, quảng cáo, văn hoá quần chúng, thông tin cổ động; quản lý nhà nước các dịch vụ công và thực hiện đại diện chủ sở hữu phần vốn của nhà nước tại doanh nghiệp có vốn nhà nước thuộc lĩnh vực văn hoá, thông tin theo quy định của pháp luật.

Điều 2. Nhiệm vụ và quyền hạn

Bộ Văn hoá - Thông tin có trách nhiệm thực hiện nhiệm vụ, quyền hạn theo quy định tại Nghị định số 86/2002/NĐ-CP ngày 05 tháng 11 năm 2002 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của bộ, cơ quan ngang bộ và những nhiệm vụ, quyền hạn cụ thể sau đây :

1. Trình Chính phủ, Thủ tướng Chính phủ các dự án luật, pháp lệnh và dự thảo văn bản quy phạm pháp luật khác về các lĩnh vực quản lý nhà nước của Bộ;

2. Trình Chính phủ, Thủ tướng Chính phủ chiến lược, quy hoạch phát triển, kế hoạch dài hạn, 5 năm và hàng năm thuộc các lĩnh vực quản lý nhà nước của Bộ;

3. Ban hành các quyết định, chỉ thị, thông tư thuộc phạm vi quản lý nhà nước của Bộ;

4. Chỉ đạo, hướng dẫn, kiểm tra và chịu trách nhiệm thực hiện các văn bản quy phạm pháp luật, chiến lược, quy hoạch, kế hoạch sau khi được phê duyệt và các văn bản pháp luật khác thuộc phạm vi quản lý của Bộ; tuyên truyền, phổ biến, giáo dục pháp luật và thông tin về các lĩnh vực quản lý nhà nước của Bộ.

5. Về di sản văn hoá:

a) Trình Thủ tướng Chính phủ quyết định :

Quy hoạch mạng lưới bảo tàng; tổ chức và hướng dẫn thực hiện sau khi được phê duyệt;

Thành lập bảo tàng quốc gia, bảo tàng chuyên ngành;

Xếp hạng hoặc huỷ bỏ quyết định xếp hạng, khu vực bảo vệ đối với di tích quốc gia đặc biệt;

Đề nghị Tổ chức Giáo dục, Khoa học và Văn hoá của Liên hợp quốc (UNESCO) công nhận Di sản văn hoá tiêu biểu của Việt Nam là Di sản văn hoá thế giới;

Cho phép đưa bảo vật quốc gia ra nước ngoài.

b) Quyết định theo thẩm quyền :

Ban hành quy chế bảo quản, tu bổ, phục hồi di tích, thăm dò và khai quật khảo cổ; tổ chức và hoạt động của bảo tàng tư nhân;

Quy định thủ tục lập hồ sơ khoa học về di sản văn hoá phi vật thể, di vật, cổ vật, bảo vật quốc gia;

Xếp hạng hoặc huỷ bỏ quyết định xếp hạng di tích quốc gia, bảo tàng hạng I; giao di vật, cổ vật, bảo vật quốc gia cho bảo tàng nhà nước có chức năng thích hợp;

Phê duyệt dự án bảo quản, tu bổ và phục hồi di tích quốc gia và di tích quốc gia đặc biệt theo quy định của pháp luật; phê duyệt hoặc thoả thuận việc xây dựng các công trình ở khu vực bảo vệ II đối với di tích quốc gia và di tích quốc gia đặc biệt;

Thẩm định dự án bảo quản, tu bổ và phục hồi di tích quốc gia, di tích quốc gia đặc biệt, dự án cải tạo xây dựng các công trình nằm ngoài các khu bảo vệ di tích quốc gia và di tích quốc gia đặc biệt xét thấy có khả năng ảnh hưởng xấu đến di tích theo quy định của pháp luật;

Cấp phép thăm dò khai quật khảo cổ; đưa di vật, cổ vật ra nước ngoài; làm bản sao di vật, cổ vật và bảo vật quốc gia thuộc các bảo tàng quốc gia, bảo tàng chuyên ngành; quản lý việc cấp phép cho người Việt Nam định cư ở nước ngoài, tổ chức, cá nhân nước ngoài nghiên cứu, sưu tầm di sản văn hoá phi vật thể ở Việt Nam;

c) Hướng dẫn, kiểm tra hoạt động bảo vệ và phát huy giá trị di sản văn hoá;

d) Chủ trì, phối hợp với các cơ quan, tổ chức có liên quan huy động, quản lý, sử dụng các nguồn lực để bảo vệ và phát huy giá trị di sản văn hoá.

6. Về nghệ thuật biểu diễn :

a) Trình Thủ tướng Chính phủ quy hoạch đơn vị sự nghiệp của Nhà nước về nghệ thuật biểu diễn; tổ chức và hướng dẫn thực hiện sau khi được phê duyệt;

b) Ban hành quy chế hoạt động biểu diễn nghệ thuật chuyên nghiệp; quy chế tổ chức liên hoan, hội thi, hội diễn về nghệ thuật biểu diễn;

c) Hướng dẫn và kiểm tra việc cấp phép biểu diễn nghệ thuật chuyên nghiệp;

d) Quy định việc thẩm định, cấp phép chương trình, tiết mục, vở diễn của các tổ chức, cá nhân Việt Nam đi biểu diễn ở nước ngoài và của các tổ chức, cá nhân nước ngoài vào Việt Nam biểu diễn;

đ) Thống nhất quản lý việc sản xuất, phát hành băng, đĩa ca nhạc, sân khấu.

7. Về điện ảnh :

a) Trình Thủ tướng Chính phủ quy hoạch đơn vị sự nghiệp của Nhà nước về điện ảnh; tổ chức và hướng dẫn thực hiện sau khi được phê duyệt;

b) Quy định điều kiện thành lập cơ sở điện ảnh; dịch vụ và hợp tác làm phim với nước ngoài;

c) Quy định việc cấp phép xuất khẩu, nhập khẩu và phổ biến phim;

d) Quy định việc tổ chức liên hoan phim quốc gia và quốc tế, những ngày phim nước ngoài tại Việt Nam và những ngày phim Việt Nam ở nước ngoài;

đ) Quản lý phim lưu chiểu sản xuất trong nước và lưu trữ các tư liệu, hình ảnh động sản xuất ở trong nước và nước ngoài.

8. Về mỹ thuật, nhiếp ảnh, triển lãm :

a) Ban hành quy chế hoạt động mỹ thuật, nhiếp ảnh, triển lãm;

b) Lập quy hoạch tượng đài, tranh hoành tráng quốc gia;

c) Quy định việc tổ chức và trực tiếp tổ chức trưng bày, triển lãm tác phẩm mỹ thuật, nhiếp ảnh quy mô quốc gia, quốc tế.

9. Về báo chí :

a) Trình Thủ tướng Chính phủ quy hoạch mạng lưới báo chí trong cả nước, văn phòng đại diện cơ quan thường trú ở nước ngoài của các cơ quan báo chí Việt Nam;

b) Quản lý nhà nước về hoạt động báo chí trong cả nước bao gồm báo in, báo nói, báo hình, báo điện tử, thông tấn;

c) Tổ chức thông tin cho báo chí, quản lý thông tin của báo chí theo quy định của Luật Báo chí;

d) Ban hành quy chế tổ chức hội thi về báo chí;

đ) Kiểm tra báo lưu chiểu, quản lý kho lưu chiểu báo chí quốc gia;

e) Cấp và thu hồi giấy phép hoạt động báo chí; giấy phép xuất bản đặc san, số phụ, phụ trương, chương trình đặc biệt, chương trình phụ; thẻ nhà báo; cấp phép cho báo chí xuất bản ở nước ngoài phát hành tại Việt Nam;

g) Quản lý hoạt động của báo chí và nhà báo trong cả nước, phối hợp với các cơ quan hữu quan quản lý hoạt động của báo chí Việt Nam liên quan đến nước ngoài và hoạt động báo chí của người nước ngoài, tổ chức nước ngoài tại Việt Nam;

h) Thoả thuận bổ nhiệm, miễn nhiệm Tổng biên tập, Phó Tổng biên tập, Tổng Giám đốc, Phó Tổng giám đốc, Giám đốc, Phó giám đốc các cơ quan báo chí.

10. Về xuất bản:

a) Trình Thủ tướng Chính phủ quy hoạch mạng lưới xuất bản, in, phát hành sách; tổ chức và hướng dẫn thực hiện sau khi được phê duyệt;

b) Quy định điều kiện thành lập và kinh doanh về xuất bản, in, phát hành sách theo quy định của pháp luật;

c) Cấp và thu hồi giấy phép hoạt động xuất bản, hoạt động in theo quy định của pháp luật;

d) Cấp phép xuất bản xuất bản phẩm không nhằm mục đích kinh doanh cho các tổ chức Việt Nam và tổ chức nước ngoài có trụ sở tại Việt Nam theo quy định của pháp luật; quản lý việc công bố, phổ biến tác phẩm ra nước ngoài theo thẩm quyền;

đ) Quy định việc đăng ký và kiểm tra việc thực hiện kế hoạch xuất bản của các nhà xuất bản;

e) Quản lý xuất bản phẩm lưu chiểu và thẩm định xuất bản phẩm khi cần thiết;

g) Quyết định đình chỉ, thu hồi, tịch thu, cấm lưu hành và tiêu huỷ xuất bản phẩm vi phạm pháp luật;

h) Thoả thuận bổ nhiệm, miễn nhiệm Giám đốc, Phó giám đốc, Tổng biên tập, Phó Tổng biên tập nhà xuất bản.

11. Về quyền tác giả đối với tác phẩm văn học, nghệ thuật :

ưa) Trình Chính phủ quy định chế độ nhuận bút cho tác giả, chủ sở hữu tác phẩm văn học, nghệ thuật và hướng dẫn thực hiện sau khi được phê duyệt;

b) Chỉ đạo và tổ chức thực hiện các quy định của pháp luật về quyền tác giả đối với tác phẩm văn học, nghệ thuật;

c) Thực hiện các biện pháp bảo vệ quyền hợp pháp của nhà nước, tổ chức, cá nhân trong lĩnh vực quyền tác giả đối với tác phẩm văn học, nghệ thuật;

d) Quy định việc cung cấp, hợp tác, đặt hàng, sử dụng và bảo đảm quyền tác giả đối với tác phẩm nghệ thuật biểu diễn, điện ảnh phát trên truyền hình, phát thanh, mạng Internet;

đ) Hướng dẫn nghiệp vụ bảo hộ quyền tác giả đối với tác phẩm văn học, nghệ thuật cho các ngành, địa phương, doanh nghiệp, các tổ chức xã hội và công dân.

12. Về thư viện :

a) Trình Thủ tướng Chính phủ quy hoạch mạng lưới thư viện; tổ chức và hướng dẫn thực hiện sau khi được phê duyệt;

b) Quy định việc hợp tác, trao đổi sách, báo, tài liệu với nước ngoài và việc liên thông sách, báo, tài liệu giữa các thư viện;

c) Quy định điều kiện thành lập và hướng dẫn hoạt động thư viện.

13. Về quảng cáo :

a) Trình Chính phủ quy định việc thành lập và hoạt động của chi nhánh quảng cáo nước ngoài tại Việt Nam;

b) Quản lý hoạt động quảng cáo theo quy định của pháp luật.

14. Về văn hoá quần chúng, thông tin cổ động :

a) Chủ trì, phối hợp với các bộ, ngành có liên quan trình Chính phủ quy định nghi thức nhà nước theo phân công của Chính phủ;

b) Trình Thủ tướng Chính phủ quy định về thiết chế văn hoá, thông tin; tổ chức và hướng dẫn thực hiện sau khi được phê duyệt;

c) Ban hành quy chế tổ chức liên hoan, hội thi, hội diễn văn nghệ quần chúng, thông tin cổ động, tổ chức hoạt động văn hoá và dịch vụ văn hoá nơi công cộng;

d) Ban hành quy chế, hướng dẫn và chỉ đạo phong trào xây dựng đời sống văn hoá, hoạt động thông tin, tuyên truyền cổ động và việc tổ chức lễ hội.

15. Chủ trì, phối hợp với Bộ Ngoại giao và các bộ, ngành liên quan thực hiện quản lý nhà nước về công tác thông tin đối ngoại;

16. Trình Chính phủ, Thủ tướng Chính phủ các giải thưởng và danh hiệu vinh dự Nhà nước về văn hoá, thông tin;

Trình Thủ tướng Chính phủ quyết định thành lập hoặc thành lập theo thẩm quyền các Hội đồng quốc gia về lĩnh vực văn hoá, thông tin;

17. Quy định điều kiện thành lập cơ sở sản xuất, phát hành băng âm thanh, đĩa âm thanh, băng hình, đĩa hình; điều kiện cho tổ chức và cá nhân trong nước liên doanh, liên kết, hợp tác, dịch vụ với nước ngoài về di sản văn hoá, nghệ thuật biểu diễn, điện ảnh, báo chí, xuất bản; việc tài trợ, đặt hàng có sử dụng ngân sách nhà nước đối với nghệ thuật biểu diễn, điện ảnh, mỹ thuật, báo chí, xuất bản, quảng cáo;

18. Cấp phép cho tổ chức, cá nhân nước ngoài tổ chức các hoạt động văn hoá, thông tin ở Việt Nam; cấp phép xuất khẩu, nhập khẩu văn hoá phẩm, thiết bị ngành in theo quy định của pháp luật;

19. Quyết định và tổ chức thực hiện các biện pháp phòng ngừa, ngăn chặn mê tín, hủ tục, văn hoá phẩm đồi trụy và các hoạt động văn hoá, thông tin vi phạm pháp luật;

Trực tiếp tổ chức một số hoạt động văn hóa, thông tin quốc gia, quốc tế quan trọng;

20. Thẩm định và kiểm tra việc thực hiện các chương trình quốc gia, dự án đầu tư thuộc lĩnh vực văn hoá, thông tin theo quy định của pháp luật;

21. Thực hiện hợp tác quốc tế trong lĩnh vực văn hoá, thông tin theo quy định của pháp luật;

22. Tổ chức và chỉ đạo thực hiện kế hoạch nghiên cứu khoa học, ứng dụng tiến bộ khoa học, công nghệ trong lĩnh vực văn hoá, thông tin;

23. Quyết định các chủ trương, biện pháp cụ thể và chỉ đạo việc thực hiện cơ chế hoạt động của các tổ chức dịch vụ công thuộc Bộ quản lý theo quy định của pháp luật; quản lý và chỉ đạo hoạt động đối với các tổ chức sự nghiệp thuộc Bộ;

24. Thực hiện nhiệm vụ, quyền hạn cụ thể thuộc quyền đại diện chủ sở hữu phần vốn của nhà nước tại doanh nghiệp có vốn nhà nước thuộc Bộ quản lý theo quy định của pháp luật;

25. Quản lý nhà nước đối với hoạt động của các hội và tổ chức phi chính phủ trong lĩnh vực văn hoá, thông tin theo quy định của pháp luật;

26. Thanh tra, kiểm tra, giải quyết khiếu nại, tố cáo, chống tham nhũng, tiêu cực và xử lý các vi phạm pháp luật về văn hoá, thông tin thuộc thẩm quyền của Bộ;

27. Quyết định và chỉ đạo thực hiện chương trình cải cách hành chính của Bộ theo mục tiêu và nội dung chương trình cải cách hành chính nhà nước đã được Thủ tướng Chính phủ phê duyệt;

28. Quản lý về tổ chức bộ máy, biên chế; chỉ đạo thực hiện chế độ tiền lương và các chế độ chính sách đãi ngộ, khen thưởng, kỷ luật đối với cán bộ, công chức, viên chức nhà nước thuộc phạm vi quản lý của Bộ; đào tạo, bồi dưỡng về chuyên môn, nghiệp vụ đối với các tài năng văn hóa, nghệ thuật, cán bộ, công chức, viên chức, công nhân kỹ thuật trong lĩnh vực văn hoá, thông tin; xây dựng tiêu chuẩn nghiệp vụ chức danh công chức, viên chức, tiêu chuẩn, cấp bậc kỹ thuật, nghiệp vụ về văn hoá, thông tin;

29. Quản lý tài chính, tài sản được giao và tổ chức thực hiện ngân sách được phân bổ theo quy định của pháp luật.

Điều 3. Cơ cấu tổ chức của Bộ

a) Các tổ chức giúp Bộ trưởng thực hiện chức năng quản lý nhà nước :

1. Vụ Mỹ thuật và Nhiếp ảnh;

2. Vụ Thư viện;ư

3. Vụ Văn hoá dân tộc;

4. Vụ Đào tạo;

5. Vụ Kế hoạch - Tài chính;

6. Vụ Hợp tác quốc tế;

7. Vụ Pháp chế;

8. Vụ Tổ chức cán bộ;

9. Thanh tra;

10. Văn phòng;

11. Cục Di sản văn hóa;

12. Cục Nghệ thuật biểu diễn;

13. Cục Điện ảnh;

14. Cục Báo chí;

15. Cục Xuất bản;

16. Cục Bản quyền tác giả văn học - nghệ thuật;

17. Cục Văn hoá - Thông tin cơ sở.

b) Các tổ chức sự nghiệp thuộc Bộ :

1. Viện Văn hoá - Thông tin;

2. Viện Phim Việt Nam;

3. Viện Bảo tồn di tích;

4. Trường Đại học Văn hoá Hà Nội;

5. Trường Đại học Mỹ thuật Hà Nội;

6. Nhạc viện Hà Nội;

7. Trường Đại học Sân khấu - Điện ảnh Hà Nội;

8. Trường Đại học Mỹ thuật thành phố Hồ Chí Minh;

9. Nhạc viện thành phố Hồ Chí Minh;

10. Bảo tàng Hồ Chí Minh;

11. Khu di tích Chủ tịch Hồ Chí Minh tại Phủ Chủ tịch;

12. Bảo tàng Lịch sử Việt Nam;

13. Bảo tàng Cách mạng Việt Nam;

14. Bảo tàng Mỹ thuật Việt Nam;

15. Bảo tàng Văn hoá các dân tộc Việt Nam;

16. Thư viện Quốc gia Việt Nam;

17. Ban Quản lý Làng Văn hoá - Du lịch các dân tộc Việt Nam;

18. Khu Sáng tác;

19. Trung tâm Triển lãm Văn hoá - Nghệ thuật Việt Nam;

20. Trung tâm Tin học;

21. Tạp chí Văn hoá - Nghệ thuật;

22. Báo Văn hoá.

Bộ trưởng Bộ Văn hoá - Thông tin chủ trì, phối hợp với Bộ trưởng Bộ Nội vụ xây dựng phương án sắp xếp các đơn vị sự nghiệp khác hiện có thuộc Bộ, trình Thủ tướng Chính phủ quyết định.

Điều 4. Hiệu lực thi hành

Nghị định này có hiệu lực thi hành sau 15 ngày, kể từ ngày đăng Công báo, thay thế Nghị định số 81/CP ngày 08 tháng 11 năm 1993 của Chính phủ về chức năng, nhiệm vụ, quyền hạn và tổ chức bộ máy của Bộ Văn hoá - Thông tin và các quy định trước đây trái với Nghị định này.

Điều 5. Trách nhiệm thi hành

Bộ trưởng Bộ Văn hoá - Thông tin, các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ và Chủ tịch Uỷ ban nhân dân các tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Nghị định này.

DECREE

DEFINING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF CULTURE AND INFORMATION

THE GOVERNMENT

Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to Resolution No. 02/2002/QH11 of August 5, 2002 of the first session of the XIth National Assembly of the Socialist Republic of Vietnam, prescribing the list of ministries and ministerial-level agencies of the Government;
Pursuant to the Government's Decree No. 86/2002/ND-CP of November 5, 2002 defining the functions, tasks, powers and organizational structures of the ministries and ministerial-level agencies;
At the proposals of the Minister of Culture and Information and the Minister of the Interior,

DECREES:

Article 1.- Position and functions

The Ministry of Culture and Information is a governmental agency performing the function of State management over culture and information, including: cultural heritages, performing arts, cinematography, fine arts, photography, exhibitions, press, publication, copyright on literary and art works, libraries, advertising, mass culture, agitation information; performs the State management over public services and the representation of the owner of State capital portions at State-invested enterprises in the culture and information domains according to the provisions of law.

Article 2.- Tasks and powers

1. To submit to the Government or the Prime Minister bills, draft ordinances and other draft legal documents on the domains under its State management;

2. To submit to the Government or the Prime Minister development strategies and plannings as well as long-term, five-year and annual plans in the domains under its State management;

3. To promulgate decisions, directives and circulars falling under the scope of its State management;

4. To direct, guide, inspect, and take responsibility for, the implementation of legal documents, strategies, plannings and plans after they are approved, and other legal documents falling under the scope of its management; to conduct propagation and dissemination of, and education in, laws and information on the domains under its State management;

5. Regarding cultural heritages:

a/ To submit to the Prime Minister for decision:

- The planning on the network of museums, then to organize and guide the implementation after it is approved.

- The establishment of national museums and specialized museums;

- The classification of special national relics and their protection zones or the cancellation of decisions on the classification thereof;

- The permission to take national treasures abroad.

b/ To decide according to its competence:

- To promulgate regulations on preservation, repair and restoration of relics, archaeological exploration and excavation; organization and operation of private museums;

- To stipulate procedures for compiling scientific dossiers on intangible cultural heritages, relics, antiques and national treasures;

- To classify national relics or Class-I museums or cancel decisions on the classification thereof; to hand over relics, antiques and national treasures to State museums with appropriate functions;

- To approve projects for preservation, repair and restoration of national relics and special national relics according to the law provisions; to approve or negotiate on the building of works in protection zones II of national relics and special national relics;

- To evaluate projects for preservation, repair and restoration of national relics and special national relics, projects for renovation and building of works outside protection zones of national relics and special national relics according to law provisions if deeming that they may adversely affect the relics;

- To grant permits for the archaeological exploration and excavation, the taking of relics and antiques abroad; the duplication of relics, antiques and national treasures at national museums and specialized museums; to manage the granting of permits to overseas Vietnamese and foreign individuals and organizations to study and collect intangible cultural heritages in Vietnam;

c/ To guide and inspect activities of protecting and promoting the values of cultural heritages;

6. Regarding performing arts:

a/ To submit to the Prime Minister the planning on the State-run non-business units engaged in performing arts; to organize and guide the implementation after it is approved;

b/ To promulgate a regulation on professional art performance activities; a regulation on organization of festivals, contests and shows of performing arts;

c/ To guide and inspect the granting of permits for professional art performances;

d/ To provide for the evaluation and permission of performance programs, items and plays of Vietnamese organizations and individuals going abroad for performance and foreign organizations and individuals entering Vietnam for performance;

e/ To perform unified management over the production and circulation of music and stage play tapes and discs.

7. Regarding cinematography:

a/ To submit to the Prime Minister a planning on the State-run non-business cinematographic units; to organize and guide the implementation after it is approved;

b/ To prescribe conditions for the establishment of cinematographic units; for film production services and cooperation with foreign countries;

b/ To draw up a planning on national monuments and murals;

c/ To provide for the organization of, and directly organize, the national and international displays and exhibitions of fine-art and photographic works.

9. Regarding the press:

a/ To submit to the Prime Minister a planning on the national network of press agencies, foreign-based representative offices and bureaus of Vietnamese press agencies;

b/ To perform the State management over press activities nationwide, including newspapers, radio and television stations, electronic newspapers and news agencies;

d/ To promulgate a regulation on organization of press contests;

e/ To examine deposited newspapers and manage the national newspaper depository;

f/ To grant and revoke press activity permits; permits to publish special issues, supplementary issues and supplements; special programs and additional programs; press cards; to grant permits for the circulation of foreign-published newspapers in Vietnam;

g/ To manage activities of the press and journalists nationwide; to coordinate with the concerned agencies in managing the Vietnamese press's activities related to foreign countries and press activities of foreign individuals and organizations in Vietnam;

b/ To prescribe conditions for the establishment of and dealing in publication, printing and circulation activities according to the law provisions;

c/ To grant and revoke permits for publication and printing activities according to the law provisions;

f/ To manage deposited publications and appraise publications when necessary;

11. Regarding copyright on literary and art works:

a/ To submit to the Government for prescription a royalty regime for authors and owners of literary and art works and guide the implementation after its is approved;

b/ To direct and organize the implementation of the law provisions on copyright on literary and art works;

c/ To take measures to protect the legitimate rights of the State, organizations and individuals in the domain of copyright on literary and art works;

d/ To provide for the supply, cooperation on, ordering, use and guaranty of copyright on performing art and cinematographical works broadcast on television, radio and/or the Internet;

a/ To submit to the Prime Minister a planning on the network of libraries; organize and guide the implementation after it is approved;

b/ To provide for the cooperation on, exchange of books, newspapers and materials with foreign countries and the sharing of books, newspapers and materials among libraries;

13. Regarding advertising:

a/ To submit to the Government for prescription the establishment and operation of foreign advertising branches in Vietnam;

b/ To manage advertising activities according to law provisions.

14. Regarding mass culture and agitation information:

a/ To assume the prime responsibility and coordinate with the concerned ministries and branches in submitting to the Government for prescription State ceremonials;

d/ To promulgate regulations on, guide and direct, the movements for building a cultured life, information, propagation and agitation activities, and the organization of traditional rites and festivals.

15. To assume the prime responsibility and coordinate with the Ministry for Foreign Affairs and concerned ministries and branches in performing the State management over the external information work;

16. To submit to the Government or the Prime Minister State awards and honorable titles related to culture and information;

To submit to the Prime Minister for decision the establishment of national councils in the culture and information domains or establish them according to its competence;

17. To prescribe conditions for the setting up of establishments engaged in producing and/or circulating audio tapes and discs, video tapes and discs; conditions for domestic organizations and individuals to enter into joint venture, association, cooperation and services with foreign countries related to cultural heritages, performing arts, cinematography, press and publication; the financing and ordering involving the use of the State budget for performing arts, cinematography, fine arts, press, publication and advertising;

18. To grant permits to foreign organizations and individuals to organize cultural and information activities in Vietnam; to grant permits for export and import of cultural products and printing equipment according to law provisions;

19. To decide on and organize the application of measures to prevent and stop superstition, backward customs, depraved cultural products and illegal cultural and information activities;

26. To inspect, supervise and settle complaints and denunciations, to combat corruption and negative acts and handle acts of violating the legislation on culture and information, which fall under its competence;

27. To decide on and direct the implementation of its administrative reform program according to the objectives and contents of the State administrative reform program already approved by the Prime Minister;

To manage its organizational structure and payroll; to direct the implementation of the salary and entitlement, reward and disciplining regimes for State officials, employees and servants under its management; to provide professional training and fostering for cultural and art talents, officials, employees, servants and technical workers in the culture and information domains; to formulate professional criteria for State employees' and servants' titles, technical and professional criteria, levels and grades related to culture and information;

The Minister of Culture and Information shall assume the prime responsibility and coordinate with the Minister of the Interior in elaborating a scheme on re-structuring other non-business units of the Ministry and submit it to the Prime Minister for decision.

Article 4.- Implementation effect

This Decree takes implementation effect 15 days after its publication in the Official Gazette and replaces the Government's Decree No. 81/CP of November 8, 1993 defining the functions, tasks, powers and organizational structure of the Ministry of Culture and Information and previous regulations contrary to this Decree.

Article 5.- Implementation responsibilities

The Minister of Culture and Information, the other ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, and the presidents of the People's Committees of the provinces and centrally-run cities shall have to implement this Decree.
