CỦA BỘ CÔNG NGHIỆP SỐ 03/1998/TT-BCN NGÀY 20 THÁNG 3 NĂM 1998 HƯỚNG DẪN VIỆC NHẬP KHẨU HOÁ CHẤT NĂM 1998 THEO QUYẾT ĐỊNH SỐ 11/1998/QĐ-TTG NGÀY 23/01/1998 CỦA THỦ TƯỚNG CHÍNH PHỦ

Căn cứ Nghị định 74/CP ngày 01/11/1995 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và tổ chức bộ máy Bộ Công nghiệp;
Căn cứ Quyết định số 11/1998/QĐ-TTg ngày 23/01/1998 của Thủ tướng Chính phủ về cơ chế điều hành xuất nhập khẩu năm 1998;
Căn cứ tình hình thực tế về nhu cầu sử dụng các loại hoá chất, số lượng nhập khẩu năm 1997 và khả năng sản xuất trong nước năm 1998;
Bộ Công nghiệp hướng dẫn việc nhập khẩu hoá chất năm 1998 như sau:

I. NHỮNG QUY ĐỊNH CHUNG

Tất cả các doanh nghiệp thuộc mọi loại hình sản xuất, kinh doanh không phân biệt thành phần kinh tế, có đủ những điều kiện sau đây đều được phép nhập khẩu hoá chất (trừ hoá chất nêu trong Phụ lục 1) theo nhu cầu và hợp đồng kinh tế.

- Có Quyết định thành lập doanh nghiệp theo đúng những quy định của Chính phủ; có ngành nghề sản xuất, kinh doanh hoá chất hoặc có nhu cầu thực tế sử dụng hoá chất trong sản xuất, nghiên cứu;

- Có giấy phép đăng ký kinh doanh xuất nhập khẩu ngành hàng phù hợp.

II. NHỮNG QUY ĐỊNH CỤ THỂ

1. Các đơn vị có đủ điều kiện nêu tại điểm I đều được phép nhập khẩu các loại hoá chất bao gồm hoá chất kỹ thuật và hoá chất tinh khiết (trừ những loại nêu trong các Phụ lục 1 và 2) theo nhu cầu sử dụng và khả năng kinh doanh.

2. Hoá chất trung gian sản xuất hoá chất độc (không thuộc Danh mục cấm nhập khẩu - Phụ lục 1) nhập đáp ứng nhu cầu sử dụng như một nguyên liệu hoặc một chất xúc tác, chất thử trong quy trình sản xuất, nghiên cứu, thí nghiệm phải được Bộ Công nghiệp xem xét, cho phép từng trường hợp cụ thể (Danh mục hoá chất trung gian sản xuất hoá chất độc - Phụ lục 2).

3. Để khuyến khích và hỗ trợ các doanh nghiệp trong nước huy động được năng lực sản xuất đã đầu tư, đổi mới công nghệ, sản xuất hoá chất thông dụng có chất lượng tương đương hàng nhập khẩu, góp phần giảm chi phí ngoại tệ, không nhập khẩu các loại hoá chất thông dụng trong nước sản xuất đã đáp ứng nhu cầu (Danh mục hoá chất thông dụng không nhập khẩu - Phụ lục 1).

4. Những loại hoá chất trong nước có khả năng sản xuất đáp ứng cơ bản nhu cầu về số lượng và chất lượng sẽ chỉ nhập khẩu bổ sung những chủng loại, quy cách trong nước chưa sản xuất được hoặc sản xuất chưa đủ phải có ý kiến của Bộ Công nghiệp để cân đối giữa sản xuất và nhu cầu trong nước (Danh mục hoá chất thông dụng - Phụ lục 2).

5. Nhập khẩu các hoá chất là nguyên liệu sản xuất thuốc bảo vệ thực vật, các loại thuốc bảo vệ thực vật hoá chất phải tuân theo Pháp lệnh bảo vệ và kiểm dịch thực vật công bố ngày 15/02/1993 và các hướng dẫn của Bộ Nông nghiệp và Phát triển nông thôn.

6. Các hoá chất là chất gây nghiện, chất hướng tâm thần và tiền chất sử dụng trong lĩnh vực y tế, bào chế dược phẩm cần nhập khẩu phải có giấy phép của Bộ Y tế theo Nghị định 89/CP ngày 15/12/1995.

7. Cơ quan, doanh nghiệp nhập khẩu những hoá chất nêu tại Phụ lục 2 phải có văn bản theo mẫu (Phụ lục 3) gửi Bộ Công nghiệp xem xét. Trong thời hạn 7 ngày kể từ ngày nhận được văn bản đề nghị, Bộ Công nghiệp có công văn trả lời đơn vị nhập khẩu. Căn cứ ý kiến của Bộ Công nghiệp, cơ quan Hải quan giải quyết thủ tục nhập khẩu. Đối với các loại hoá chất khác không nằm trong Phụ lục 1 và Phụ lục 2, các cơ quan, doanh nghiệp trực tiếp với cơ quan Hải quan làm thủ tục nhập khẩu.

8. Tuỳ theo tính chất hoá, lý riêng, các loại hoá chất nhập khẩu phải có bao bì, đóng gói bảo đảm tiêu chuẩn an toàn khi vận chuyển và sử dụng theo những quy định hiện hành của Chính phủ.

9. Cơ quan, doanh nghiệp nhập khẩu chịu trách nhiệm quản lý và sử dụng hoá chất nhập khẩu theo đúng mục đích nhập khẩu và theo các quy định có liên quan của Chính phủ.

III. ĐIỀU KHOẢN THI HÀNH

Thông tư này có hiệu lực thi hành từ ngày 01/04/1998 đến ngày 31/03/1999.

Đối với những lô hàng hoá chất nhập khẩu đã được Bộ Công nghiệp có văn bản xác nhận trước thời điểm có hiệu lực của Thông tư này, cho phép tiếp tục thực hiện.

Bộ Công nghiệp đề nghị các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ, UBND các tỉnh, thành phố trực thuộc Trung ương, cơ quan Trung ương của các đoàn thể thông báo nội dung Thông tư này cho các Doanh nghiệp thuộc quyền quản lý của mình biết và thực hiện, đồng thời phản ánh cho Bộ Công nghiệp những vấn đề phát sinh trong quá trình thực hiện để kịp điều chỉnh cho phù hợp.

1. O-akyl (<C10 gồm cả cycloakyl) akyl (Me, Ethyl, n-propyl hay isopropyl) phosphono-fluoride;

CIRCULAR

GUIDING THE 1998 CHEMICALS IMPORT UNDER DECISION No.11/1998/QD-TTg OF JANUARY 23, 1998 OF THE PRIME MINISTER

Pursuant to Decree No.74-CP of November 1st, 1995 of the Government on the functions, tasks, powers and organizational structure of the Ministry of Industry;
Pursuant to Decision No.11/1998/QD-TTg of January 23, 1998 of the Prime Minister on the 1998 export and import management mechanism;
Based on the actual demand for chemicals of all kinds, the 1997 import volume thereof and the 1998 domestic production capacity;
The Ministry of Industry hereby guides the 1998 chemicals import as follows:

I. GENERAL PROVISIONS

All production and business enterprises of various types, regardless of their economic sectors, which fully meet the following conditions, shall be allowed to import chemicals (except for those specified in Appendix 1) according to their demand and economic contracts:

- Having decisions to establish enterprises in strict accordance with the regulations of the Government; being engaged in chemicals production and/or trading or having actual needs to use chemicals in their production or research activities;

- Having export and/or import business licenses for appropriate goods categories.

II. SPECIFIC PROVISIONS

2. Intermediate chemicals for the production of toxic chemicals (not on the list of chemicals banned from import - Appendix 1) which are imported for use as raw materials, catalysts or reagents in the processes of production, research or experiment, must be considered and permitted by the Ministry of Industry on case-by-case basis (the list of intermediate chemicals to be used for the production of toxic chemicals - Appendix 2).

3. In order to encourage and support domestic enterprises in promoting their production capacity, renew technologies and produce common chemicals with a quality equivalent to that of imported chemicals, thus reducing foreign currency expenditures, common chemicals which have been sufficiently produced in the country, meeting the domestic demand, shall not be imported (the list of common chemicals not to be imported - Appendix 1).

4. For chemicals which can be domestically produced and basically meet the demand quantitatively and qualitatively, only those of categories and specifications that have yet to be produced or insufficiently produced at home, shall be additionally imported with approval of the Ministry of Industry, so as to balance the domestic production and demand (the list of common chemicals - Appendix 2).

5. The import of chemicals to be used as raw materials for the production of plant protection drugs as well as of plant protection chemicals shall comply with the Ordinance on Plant Protection and Epidemics Control of February 15, 1993 and the guidance of the Ministry of Agriculture and Rural Development.

6. Such chemicals as addictive substances, psychonoptic agents or pre-substances to be used for medical and pharmaceutical manufacture purposes, when imported, must obtain permits from the Ministry of Health in accordance with Decree No.89-CP of December 15, 1995.

7. The agencies and enterprises importing chemicals specified in Appendix 2 shall send their written requests made according the set form to the Ministry of Industry for consideration. Within 7 days from the date of receiving the written requests, the Ministry of Industry shall send official dispatches of reply to the importing units. Basing itself on the consent of the Ministry of Industry, the customs office shall complete the import procedures. For other chemicals not specified in Appendices 1 and 2, the agencies and enterprises shall carry out the import procedures directly with the customs office.

8. Depending on their respective specific chemical and physical properties, the imported chemicals must be packed to ensure the standards of safety in transportation and use in accordance with the regulations of the Government.

9. The importing agencies and enterprises shall have to manage and use imported chemicals for right purposes and in accordance with relevant regulations of the Government.

III. IMPLEMENTATION PROVISIONS

For imported chemicals lots that had been certified in writing by the Ministry of Industry before the effective date of this Circular, they are permitted to be effected.

The Ministry of Industry requests the ministries, the ministerial-level agencies, the agencies attached to the Government, the People's Committees of the provinces and cities directly under the Central Government and the central committees of the mass organizations to inform the enterprises under their respective management of the content of this Circular for implementation, and at the same time report to the Ministry of Industry matters arising in the course of implementation for timely and appropriate adjustments.
