OF ROAD TRAFFIC INFRASTRUCTURAL STRUCTURES UNDER THE MANAGEMENT OF THE SERVICES

1. Promulgating regulations on regular
management and maintenance of road traffic infrastructure under the management
of the Services of Transport on the administrative division of Ho Chi
Minh City.

2. This Decision takes effect since the
date of signing.

Regular management and
maintenance of road traffic infrastructural structures are activities of following
up, caring and repairing minor damage, maintaining installed equipments. This
task is implemented regularly, periodically to maintain normal conditions of
exploitation and employment of road traffic infrastructural structures and
minimize generation of damage.
Article
2. Scope and regulated entities
1. Scope:
This regulation
stipulates regular management and maintenance of road traffic infrastructural
structures under the management of the Services of Transport on the
administrative division of Ho Chi Minh City including: management, technical
requirements and mangaement quality; regular maintenance of road traffic
infrastructural structures. Particularly for green parks within Saigon
Zoological and Botanical Garden, technical trench, tunnels and infrastructural
system serving bus transports shall be applied according to applicable
regulations of competent State management agencies.
2. Regulated entities:
This Decision applies to
organizations, individuals related to regular management and maintenance of
road traffic infrastructural structures under the management of the Services of
Transport on the administrative division of Ho Chi Minh City.

3. Interpretation of terms
In this Decision, some
terms and concepts are construed as follows:
1. Road traffic
infrastructural structures include road works, public lighting system,
street and park green system, drainage system.

3. Public lighting
system means a system of materials and equipments including various types
of cable (supplying power to lighting control cabinets, lights, grounding
cables, light capacity control cables); lighting control cabinets and other
materials, equipments such as traffic light posts, traffic light arms, lights,
electric safety equipments, and connectors to the Control Centre.
4. Urban greenery mean
all types of trees on streets (including shade trees grown by people or
naturally grown, ornamental trees, creepers, grass carpets on pavements, median
strips and traffic islands); trees in parks, gardens; trees in squares and
other public areas in the city.
5. Inspection of works
means a visual examination carried out by experienced people or by
specilized equipment to assess current conditions of the works for signs of
damage.
6. Management tasks mean
activities of management, establishment and use of documentation concerning the
works; inspecting, following up and updating changes; carrying out immediate
handling of problems and protection of the works during the operation of road
traffic infrastructural structures; these tasks are regularly and periodically
carried out to maintain their normal operation, to ensure traffic safety,
electricity safety and urban landscape beauty.
7. Regular maintenance
means activities of repairing minor damage, maintaing installed equipment are
regularly and periodically carried out to maintain their normal operation, and
minimize generation of damage.
8. Repairs mean
remedies of damage detected during their normal operation in order to ensure
normal operation and safety of the works.
9. Road traffic
infrastructural structure management entities mean Urban Traffic Management
Division, Saigon River Tunnel Management Unit under the Services of Transport
(hereinafter referred to as the management unit)
10. Contractors
carrying out regular management and maintenance of road traffic structures
mean any entity who takes the orders or any entity who wins a bid for supplying
public products and services and sign a direct contract with traffic
infrastructure system management unit (hereinafter referred to as the the
contract of maintenance).
11. Drainage system
includes a network of sewers and ditches for collection and conveyance of
water, detention basins, connecting works (pump stations, water treatment plant,
discharge gate) and other utitlities used for collecting, conveying and
draining stormwater, wastewater and processing wastewater.

ON MANAGEMENT TASKS
Article
4. Road system management
1. Regular patrol and
inspection of road system:
a) Conducting patrols,
inspection, detection and timely reporting to the management unit in the
following cases:
- Problems or damage to
road bed such as potholes, dangerously collapsible holes, softspots, slope
landslides, sinking tunnels of underground works, manholes higher or lower than
road bed, technical trench cover warped and causing noise;
- Problems and damage to
other works as follows:
+ Traffic lights:
inactive (light off) or working in an unsteady way, time and cycle of lighting
inconsistent causing disorder to traffic in the area;
+ Public lights: Inactive
or working in an unsteady way (light on at daytime and light off at night
time);
+ Public water drainage:
collasped, manholes’ lid broken, overspilling of water on road bed, collector’s
opening clogged by waste, soil, stone and rubbles;

+ Road lines blurred,
unclear; reflective lane markers sinking to one side, being lost or damaged;
+ Water supply pipelines:
damaged, leaking.
- Detecting and reporting
at the right time such problems as road erosion, falling and breakage of
electricity poles, cables, telecommunication cables and trees ;
- Road stretches where
congestion usually takes place and running the risk of traffic jams.
- Positions where
obstructions are placed (electricity poles, adversing poles planted in the area
intended for road traffic); areas of road-beds occupied for market meetings,
storage of materials: electricity poles, sewage pipes, rubbles, trees,...or
fallen electricity poles, materials transporting vehicles scattering materials
over, trees or architectural structures obstructing traffic visibility;
- Unsafe positions at
pavements, roadsides hindering pedestrians; positions connected to the road
under exploitation imposing hazards on traffic safety;
- Road streches
frequently flooded due to rain or tides.
- Acts of taking
possession of or encroaching road safety corridors.
b) Following up the
construction of road works in operation (construction organization, investor
and construction period...); upon notice of any act of threatening traffic
safety, the management unit must be reported immediately.

2. Ensuring traffic
order and safety:
a) Standing guard,
directing traffic at places where problems arise; ensuring safety for people
and vehicles on the road.
b) Upon notice of any
problem and any damage threatening traffic safety or likely to cause traffic
accidents, warning signs or fences must be immediately set up at the spot and
at the same time a report must be sent to the management unit for timely
handling.
c) Patching potholes,
collasped pits right away within 24 hours (the workload shall be calculated in
the plan of maintenance). In case of emergency, any measure must be employed to
ensure traffic safety and order
d) Treating softspots and
deep tracks of wheel.
e) Coordinating
frequently with relevant entities to remedy problems and situations which
affect traffic safety or damage traffic works.
g) Upon notice of any
congestion or accident, patrol officers must be present to collect information,
determine the cause, report and propose handling measures to the management
unit; cooperate with functional forces to direct the traffic.
g) Actions of collecting
information, following up and analyzing causes of road traffic accidents help
the management unit know where traffic accidents frequently happen, and their
causes (no signs, blocked view, slippery roads or loss of superrelevation,
small curve radius on topographical map...) to have an early plan of remedial
works and supplementing.
3. Modify markers,
signs, guard-walls and median strip:

- Not stained with dirt,
being clear, firm and easily noticeable;
- Ensure no warping,
deflection, blur and light reflection at night, no application of paints and
papers causing visibility obstruction;
- Sign posts must not be
warped, fallen, hidden, and stained with dirt and meeting requirements of
height;
- Warped signs must be
repaired promptly; deflected signs must be adjusted to its original place; sign
surface must be cleaned to ensure clarity.
b) Median strips,
deflected guard-walls must be adjusted to their original positions with
landscape beauty to be ensured.
4. Count of vehicles:
a) The count of vehicles
is a task which is carried out every six months on the routes defined by the
Services of Transport in accordance with the requirements of annual traffic
infrastructure management task.
b) Implementation and
processing of vehicle count data are fully executed in accordance with the
standards of regular road maintenance.
c) Vehicle count data
shall be processed and sent to the management unit in June and December
annually for follow-up and management.

a) Road bed must be
constantly kept clean and free from other obstructions; ensuring no soil,
stone, sand and waste on road bed, roadsides, curbs' edges, and median strips
(commonly called as dirty earth with length and width being regulated as ≥ 2.0m
and ≥ 0.3m respectively)
b) Depending on dirtiness
on road bed and road types, frequency of clean-ups in a month shall be arranged
(from 4-8 clean-ups/month) Task of clean-up is carried out over the entire road
bed, roadsides, islands, median strips (all soil, sand, rubbles and other
materials on road bed, in front of sewers' openings and waste screens).
c) After road bed is
cleaned up, dirty earth shall be moved out of the site to a designated place
within 24 hours,
d) Detecting and reporting
immediately to the management unit, local authorities on places being occupied
by residents for storing soil, sand, rubbles scattered over by materials
transporting vehicles or for storing electricity poles, water pipelines and
stone..., and at the same time carrying out the clean-up to hand over the site
restored to its initial conditions according to the assigned scope.
e) For national roads,
main roads, roads of high traffic volumes, to ensure traffic safety, the task
of road bed protection is encouraged to be carried out mechanically and out of
peak hours.
6. Prune trees, cut
grass and trim branches
Hacking trees, cutting
grass and trimming branches shall be done to ensure no visibility obstruction
for drivers, to traffic cones, signs, kilometer markers, traffic lights, public
lights, and ensure no negative effect on water drainage.
a) Hacking and cutting
shall be done only for trees and grass which are not subject to management,
specifically as follows:
- Within roadsides, road
slope (slope plus is within ≤ 4m; slope minus is within 0.1m from shoulders
outward and within the inside of curve), height of grass not permitted to be
higher than 0.2m.

- Use of chemicals,
sherbicides to replace cutting and controlling of grass is absolutely
permitted.
Trimming branches shall
be done for trees under the management of a particular unit. Upon notice of a
branch obstructing visibility for drivers or hiding traffic cones, signs,
kilometer markers, traffic lights, public lights, the organization in charge
shall make an immediate report to the management unit, and at the same time
coordinate with the green management unit to carry out the trimming of
branches.
7. Repair road slope
a) Repairing road slope
is done only for some specific routes.
b) Maintaining initial
conditions of slope and repairing collasped slope.
8. Drain unclogging
when it rains:
a) Drain unclogging is
carried out only for some specific routes.
b) Removing soil, stone,
and grass stuck in sewers, not to leave water spilling over on roadsides, along
roadways or across the road resulting in erosion and collaspe of slope.
Soil and garbage after
being drained shall be transported to a dedicated place, not to leave them to
drift back to sewers.

a) The works must be
registered before being put into operation and after a period of 10-15 years of
operation, registration must be done again to determine its initial technical
condition and changes of technical factors during the exploitation.
Registration dossier is instructed in the Standard of regular road maintenance.
b) Data of registration
are stored in computers at the executing entity and sent to the management
unit.
c) Management units are
permitted to use source of capital distributed annually for regular road system
maintenance to hire a lawful and qualified consultant to carry out the
registration of bridge and road.
Annually, when proposing
capital plan for the following years, management units shall check the list of
roads requiring the establishment of registration dossier and plan of
implementation expenses, and make a submission to the Ministry of Transport for
consideration and ratification.
10. Update data into
computers:
On a monthly basis, the
executing entity shall update data of maintenance as well as other happenings
such as excavation to install underground works, including positions of sinking
tunnels, data of traffic congestion, traffic accidents, floodings...into
computers, in the form of drawing files, digital maps and provide them to the
management unit when inspection is needed or on request.
11. For cases of temporary management while waiting for the
completion of inspection procedures to put the work into official operation or
the works are still in the period of maintenance, only items stipulated in
Pararaphs 1, 2, 5 and 10 hereof are executed.
Other specific cases
shall be considered and decided by the Ministry of Transport to ensure traffic
safety and road work safety.

5. Manage bridge road system

a) Monthly inspection is
aimed at assessing working conditions of bridge works, detecting damage that
causes loss of safety to the traffic and affect loading capacity of bridge
works, and at the same time monitoring damage marked from previous inspections.
b) Monthly inspection
shall be planned in details for components of the works. In case of necessity,
specialized equipment shall be employed for surveying and measurement.
Inspection results and data of surveying, measuring and monitoring damage,
solutions, and quantities to be repaired must be recorded fully in the hand
book of bridge works.
c) If damage is detected while
seen as affecting safety of bridge works, immediately report to the management
unit for an inspection plan, timely correction and ensuring traffic safety. And
at the same time, the executing entity must pro-actively apply temporary
measures to maintain safety for the works and the traffic.

- Bridge beam inspection
+ For steel bridge:
warping, sagging, deflection or breaking of beams and steel beams shall be
inspected; Special attention must be paid to bridge interconnections and
beam-beam connections.
+ For ferro-concrete
bridges, pre-stressed ferro-concrete bridges, conjugate beam bridges, cable
stayed bridges, suspension bridge: Inspect cracking, breaking and blistering of
concrete; inspect rusting and damage of steel rebar, penetration and leakage of
water under beams and bridge deck plates;
+ For arch bridges: In
addition to the requirements of ferro-concrete bridges, inspection is carried
out for cracks, breaks of motar seams and penetration of water at arch bases.
- Bridge bearings
inspection
+ Inspect deformation,
wear and little dents of rollers, joints of bearing pads, horizontal movement
of rollers, and longitudinal deflection of center line of the bridge of steel
bearings.
+ Inspect aging and
deformation of rubber bearings
+ Inspect flatness,
cleaness and ventilation of bridge bearings;
+ Inspect lubrication of
steel bridge bearings.

+ Inspect cracks, fractures,
breakages of motar seams, construction stones, weathering and corrosion of
concrete of abutment and piers;
+ Inspect erosion of
abutment foundations, deflection, sliding and sinking of abutment and piers;
+ All the cases must be
inspected for horizontal fractures of abutment piers. Special attention must be
paid to the piers and revealed part of the piles due to erosion.
+ Inspect footing and a
fourth of a bent cap
+ Inspect road bed behind
abutment
- + Inspect flow
preventing and regulating works such as: flow directing embankments, ramp
surface embankments, river edge embankments.....special attention must be paid
to stability of these works (ensuring no cracks, breaks, corrosion, sinking to
one side) and assessment of efficiency of those works;
- Inspect illegal
occupation of bridge abutments or space under bridges for storing and
stockpiling materials, for residing or trading, and other illegal installations
(power supply, postal telegraph cables, water supply pipes...)

shall be carried out in accordance with the regulation on patrol, inspection
and protection of road traffic infrastructural structures; and at the same time
detect and report in time to the management unit in the following cases:

bridge streets such as bridge loading, bridge name, no meeting on bridge, way

bridge streets obstruct visibility of drivers and riders.

losses of installation works on bridge such as power supply system, postal
telegraph cable, water supply and drainage...
i) Illegal occupations of
bridge deck, pavements for stockpiling materials or for residing, trading,
anchoring within bridge safety corridor...
k) Bridges which usually
suffer circulation of overloaded transports or traffic congestions (time,
location and causes must be specifically notified);
1) Exploitation of
anti-collision bridge piers.

a) Remove grass, garbage,
plants and obstables causing obstruction to the flow or damage to bridge
structures within bridge safety corridor.
b) Ensure free flowing
current and maintain clearance under bridge. Follow up corrosion around bridge

which accommodate daily human activities, lighting must be switched on 15
minutes earlier and off 15 minutes later in accordance with Point c, Paragraph

13. Update green park
data:
Every month, the
organization in charge must update into computers data of trees, green patches,
parks in terms of felling and movement of trees, windthrow and uprooting,
encroachment on trees, and changes of green patches, parks in area, and at the
same time provide them to the management unit when inspection is expedited or
on request.
Article
8. Manage and operate drainage system
1. Management tasks
include: mangement of the works from
collection openings, drainers, ditches, flood stop valves to discharge gate
into canals. Management of stormdrainage system: The system must be managed in
the manner of decentralized management including management of the works from
stormwater discharging gate, pipelines, canals, ditches, draining ponds,
detention basins, manholes, flood stop valves, tide stop dikes, pump stations,
wastewater treatment plant to points of discharge into the environment.
The drainage system management unit must organize the management of the
system and update sufficient data of flooding caused by rain in the
administrative division. Sewers, ditches, manholes must be regularly dredged,
repaired and maintained to ensure the flow conformable with design. Regularly
inspect and maintain manholes‘lids, collection openings and have an early plan
of dredging the drainage system; coordinate with district authorities to
develop the dredging in dry seasons (starting November annually), not to allow
any encroachment on the discharge gates, ditches. Periodically inspect and
assess quality of sewers and works which belong to the network of water
draining under decentralized management and propose a plan for replacement,
repair or develop networks by area. Particularly as follows:
a) Dredge sewers,
ditches, manholes to ensure the flow as designed, prevent and remedy problems
caused by technical manholes before, during and after rains or storms.
b) Regularly inspect,
maintain the lines of water draining ditches and sewers, manholes, water
collector’s openings and flood stop valves. Organize measures to opportunely
detect, prevent and overcome acts and signs of intrusion, and problems related
to water draining sewers, and at the same time to carry out a full report to the
Services of Transport in case any accident or incident happens.
c) Follow up and identify
causes and opportunely tackle situations causing flooding, ensure efficient
drainage, give warnings and overcome the problems related to the drainage
system assigned during days of storm and effect of tides.
d) Establish the process
of drainage system management in accordance with the requirements of management
and operation techniques; propose plans for developing networks by drainge
basin.

Concurrently propose some measure for warning and appointing people to follow
up until the problem is completely tackled;
- Detect, enumerate,
handle and propose timely handling measure for daily problems such as
settlement of soil, stone, clothes, canvas, woods....on manhole’s gutters
clogging collecting openings and hindering the flow;
- Opportunely detect and
propose a solution to the state of flooding on water draining lines assigned
for management which are likely to cause accident, and an early warning,
appoint some people to follow up until water is completely drained;

Services of Transport and the management unit; and at the same time to organize
rescue and appoint staff to clear litters at the collector’s openings and
propose necessary measures to increase draining capability and reduce the time
of flooding;
- Take photos to record
timing of the happenings of phenomena affecting drainage system.
3. Maintenance and
repair related works:
a) Repair manholes’
walls:
Surface of walls must be
ensured flat and no splitting. Walls must be ensured seamless and no leakage.

conformable in diameter and size. Ensure quality and intensity. Sewer’s surface
must be ensured not fractured, dented and honeycombed.
- Before being repaired,
photos must be taken to record timing, conditions of collapses as foundations
to identify the causes;

5. Wastewater system
management:
a) Wastewater system
management: Responsibilities defined for the mangement of wastedrainage system
cover management of connecting points, lines collecting and leading to
wastewater treatment plants and from here to discharge gates into the
invironment. Particularly as follows:
- a) Drainage system must
be managed from the connecting points, network of collecting and channelling
wastewater to the treatment plant and from here to discharge gates into the
environment.
- Owners or management
units must carry out maintenance of the drainage system as instructed and
defined by contractors of engineering, suppliers of materials, technological
equipment and comply with standards and regulations.
- When expediting the
maintenance tasks, entities engaging in these tasks must pay strict attention
to the connecting system, inspect tightness, accumulation of slurry, waste at
connecting points, manholes and sewers and make a plan of dredging, repairing
and maintaining sewers and the works throughout the network ensure
environmental sanitation according to the regulation.
- Periodically, carry out
inspection and assessment of wastewater collection system’s quality, propose
measures for replacing, repairing drainage system and the works throughout the
network; ensure quality of treated water to be discharged to the environment.
b) Dredge left-overs,
carry out remedial work, construction and clearance of pipelines, sewers, lines
collecting and directing wastewater, maintain regular drainage of wastewater.
Periodically, carry out inspection of connecting points, manholes and sewers to
make a plan of dredging, remedying and maintaining sewers and drainage works.

collection system used for both stormwater
and wastewater, regulations on drainage system set forth in Paragrahs 1 and 5
hereof shall be exercised jointly.
7. Detention basin
system management:
Owners, management units
shall take main responsibilities for managing detention basins on the
administrative division assigned, ensure to meet requirements of detention of
stormwater, wastewater, control conditions of domestic wastewater and other
types of wastewater generated and directly discharged into detention basins
during the process of production and service trading to create landscape beauty
and ecological environment.
Detention basin systems
functioning as detenting stormwater and wastewater and enviromental sanitation
in parks, zoological gardens must have a synchronous coordination between
agencies under ownership and management units of the works to ensure capability
of detention.
The management unit of
the drainage system must be responsible for identifying and maintaining steady
level of water in detention basins in order to ensure effective detention and
disposal of stormwater and wastewater into the environment.
a) Periodically, carry
out dredging and cleaning beds and embankments to ensure steady level of water
in detention basin and ensure effective detention of stormwater and other
requirements to be met.
b) Inspect, monitor
exploitation and employment of detention basins according to the regulations
stipulated by competent agencies on employment of detention basins for various
purposes to ensure functions of detention and enviromental sanitation.
c) Establish management
process, regulations on exploiting and employing detention basins.

2. On-site tasks:
- Inspect and accept all
the works under management of road traffic infrastructural structures by each
management unit;
- Inspect and accept each
work to carry out overall assessment of the targets being bidded for.
3. Acceptance criteria:
Based on requirements
stipulated in Chapter II and Chapter III of this regulation, the Services of Transport
shall instruct management units to mark each particular work as foundation for
the acceptace task.
Article
16. Regulations on marking, deduction of management expenses and settlement.
1. Marking is carried out
at least 4 times/month. Monthly score shall be calculated as an average value
of each marking in a month.
2. For any item which is
not included in the contract of bidding, order placement, score is calculated
as zero and payment value is based on percentage of the achieved scores over
the maximum scores possibly attainable.
3. When 96% to 100% of
the maximum score of all targets is attained, payment value shall achieve 100%
over the approved estimate respectively.

b) The contractor of
maintenance must ensure ventilation and capability of water collection for each
drainage line as agreed in the contract. When part of a drainage line is
inspected and evaluated as unsatisfactory, the contractor of maintenance must
rectify that part according to the regulated time and a penalty of 25% of the
contract value shall be imposed. Particularly as follows:
- The management tasks
(Paragraph 2, Article 8 of this Regulation): fail to report early on damage of
the system and there are reflections from ouside entities on the damage that
are not reported by the contractor of maintenance.
- Fail to carry out early
remedial work for damage on a drainage line and violate flood criteria
(Paragraph 3, Article 8 of this Regulation);
- In a month, upon notice
of any drainage line violating “flood criteria for each road route", a penalty
of 25% of the contract value for the works as defined in Paragraph 3, Article 8
of this Regulation shall be imposed for the first time of violation (). At the
same time the contractor of maintenance must appoint staff to coordinate with
the management unit to come up with remedial measures;
- Amount of left-over
soil exceeds the permissible limit for the dredging of sewer chambers, manholes
as stipulated in Paragraph 4, Article 8 of this Regulation.
c) When the initially
rectified part of a drainage line is re-inspected and evaluated as
unsatisfactory, the contractor of maintenance must rectify that part and a
penalty of 100% of the contract value shall be imposed.
- In a month, upon notice
of any drainage line violating “flood criteria for each road route", a
penalty of 100% of the contract value for the works as defined in Paragraph 3,
Article 8 of this Regulationin shall be imposed for the second time of
violation and over (). At the same time the contractor of maintenance must
appoint staff to coordinate with the management unit to come up with remedial
measures;
- Within a month, any
drainage line which gave rise to a penalty of 25% of the contract value
according to Paragraph 2, Article 3 of this Regulation is still not seen being
reported on the damage or there are reflections from outside entities on the
damage, a penalty of 100% of the contract value for that drainage line shall be
imposed.

Article
17. Construct and implement plan of regular maintenance
1. On a monthly basis,
based on actual situations, the management units shall establish a plan of
regular management and maintenance with items being anticipated for
implementation, establish cost estimate for the planning for the areas under
decentralized management.
2. Planning scale :
a) The contractor of
maintenance and management unit must expedite actual field survey to facilitate
the planning with accuracy and suitability for the demands for exploitation and
damage to the works.
b) Scale of planning for
regular management and maintenance must comply with the cost estimation of
regular management and maintenance which is approved and subject to total
annual estimation.
3. Inspection,
establishment and approval of regular management and maintenance plan
a) Requirements of site
inspection: Site inspection must be aimed accurately at the damage, in
conformity with management needs and regulations on maintenance of the works.
b) Inspection undertaken
by management units:
Upon receipt of notice
from the contractor of maintenance, the management unit must organize
re-inspection of the site in order to accurately assess the planning carried
out by the contractor of maintenance.

- After expediting
inspection under Section b of this Paragraph, the contractor of maintenance
shall be responsbile for completing the plan of regular management and
maintenance (including quantities, proposal of planned cost, construction
drawings) and handing it over to the management unit for consideration and
approval according to the regulations;
- Before the first of
planning month, management units must shall give approval and inform the plan
of regular management and maintenance to contractors of maintenance.
Article
18. Regulations on the implementation of remedial works
1. For remedial works at
a cost of below VND 500 million, the management unit shall decide remedial plan
on their own for the followings: name of construction parts or equipment that
need remedy and replacement; reasons and objectives of remedy or replacement;
quantity of works; planned cost, time of implementation and completion. For
works of complexity, establishment of economic-technical reports is applied.
2. In case of remedial works
being carried out in the form of economic-technical reports, annual maintenance
loan is used:
- Carry out reformation,
remedial works for works, equipment at a cost of from VND 500 million and over;
- Develop and implement
all measures to ensure traffic safety, electric safety; intensify reformation
and development of green parks;
- Implement reformation
and remedial works for problems caused to the works and equipment outside the
list under decentralized management as required by the Services of Transport.
- As for the
re-construction of ornamental grass in parks for festival events at the request
of the People’s Committee of the City at a cost of over VND 500 million,
establishment of economic-technical reports is not required.

a) Management units must
organize establishing, making submission for appraisal and approval of the
economic-technical reports in the right sequence and procedures as stipulated
by the law on construction investment. Issues of the economic-technical reports
must accord with applicable regulations; unit price and other factors of
operation cost in the economic-technical reports are unit price of fundamental
construction as regulated at current point of time;
As for green parks, in
case part of the works is not included in the unit price of fundamental
construction, the unit price for maintainng green parks shall be used according
to current regulations.
b) For remedial works for
problems to the Works, storm and flooding, management units must carry out the
implementation immediately to ensure traffic safety, protect structures of the
Works in the form of designing and executing simultaneously, but fulfill all
legal documentation, dossiers of construction quality management according to
applicable regulations.
In addition, management
units must fulfill all the requirements as stipulated in the Circular No.
30/2010/TT-BGTVT dated October 01, 2010 by the Ministry of Transport stipulating
prevention of flooding, storms and remedial works for consequences in road
traffic branches.
Chapter
VI.
QUALITY
CONTROL IN REGULAR MAINTENANCE
Article
19. General requirements
1. Tasks of quality
control in regular maintenance are carried out in accordance with the
regulations of the Law on construction, Decree No. 15/2013/ND-CP dated February
06, 2013 by the Government on construction quality control, Circular No.
10/2013/TT-BXD dated July 25, 2013 by the Ministry of Construction stipulating
in detail some issues concerning construction quality control, Decree
No.114/2010/ND-CP dated December 06, 2010 by the Government on construction
maintenance and guiding documents.
2. Construction
maintenance management dossier consists of documents as stipulated in Paragraph
2, Article 14 of the Decree No.114/2010/ND-CP dated December 06, 2010 by the
Government on construction maintenance;

3. TIME-LIMIT OF REGULAR
MAINTENANCE, REMEDIAL WORKS IS DEFINED AS FOLLOWS:
a) For bridge & road
system:
- For remedial and
patching works of below 50m2 in area, road paint work, period
of maintenance is 06 months;
- For remedial and
patching works of 50m2 and over in area, or any new
installation related work, period of maintenance is 12 months;
b) For public lighting
system and traffic lights, period of maintenance for components is two years.
c) For green parks, no
maintenance is given.
d) For the dredging of
drainage system and rivers, canals, creeks functioning as drainers, period of
maintenance is not stated. As for remedial works and installation of the
drainage system, period of maintenance is applied according to the applicable
regulations.
4. Responsibilities of
management units:
a) Instruct, inspect,
supervise and speed up contractors of maintenance to execute management and
maintenance according to applicable regulations.

c) Before the contractor
of maintenance develops the implementation, the management unit must expedite
site inspection in order to identify the planned position; not permitted to
approve false construction versus the approved design or fails to meet
requirements of construction quality control.
d) The management unit
must inspect the construction organization’s ability to meet requirements of
personnel in quantity, workmanship and qualifications, motor vehicles,
equipment; inspect compliance with current technical regulations and standards
to meet schedule, quality and quantity according to the plan, and at the same
time ensure traffic safety, labor safety, environmental sanitation inside and
outside of the construction site.
e) On a weekly basis,
supervisory staff must establish reports on works done in a week, give comments
on the implementation of the plan undertaken by the contractor of maintenance.
5. Responsibilities of
contractors of maintenance:
- Take responsibility to
the law for the implementation of regular maintenance for the Works; take
responsibility or joint responsibility for any hazard put on traffic safety due
to a lack of responsibility in the task of maintenance;
- When developing the
construction, the contractor of maintenance must meet approved quantity of
works and undertake self-inspection; ensure progress of the plan and
requirements of traffic safety, labor safety and environmental sanitation are
met.
- Report adequately on
processes, plans and results from self-inspection of regular maintenance
quality; appoint sufficient qualified staff (inclusive of a decision of
appointment by head of the contractor of maintenance) to carry out tasks of
site direction and supervision.

acceptance for regular maintenance is done on a monthly basis and by management
units.

- The contractor of
maintenance’s implementing the direction, instructions given by the management
unit:
b) On-site acceptance
tasks mean observing on-site happenings, check against the plan, the contract
to assess the Works’quality, traffic safety and environmental sanitation.
6. For material related
works, after acceptance, suppliers of public products and services must be
responsible for executing warranties according to current regulations.

c) Irrigation water
criteria:
Use source of water with
clear origin including: tap water, drilled well water, stormwater For drilled
well water being put into use for the first time, chemical criteria must be
analyzed.
d) Soil criteria:
Rich, soft, not
solidified and mixed with impurities, clay and mud.
e) Fertilizer and plant
protection drugs:
- Their names must be
included in the permissible list promulgated by the Ministry of Agriculture and
Rural Development;
- Packages must be intact
and unexpired, inclusive of a certificate of factory of the patch. With respect
to fertilizer, packages must introduce such basic criteria as Natrium,
Phosphor, Kalium, micro-elements, humidity,...

During the use of
fertilizer, plant protection drugs, irrigation water, if necessary, a council
(including representatives of the Services of Transport, management units and
contractors of maintenance) can be formed to take sample and dispatch for
analysis.
6. Remedial works for
drainage system:
Follow the regulations
set out in Article 8, Paragraph 3, Chapter II. In addition, structures of the
drainage system must meet the standards of materials according to applicable
regulations.
Article
22. Principles of determining transport distance and material price
1. These only apply to
frequently used materials such as asphalt concrete, sand, stones of various
kinds, emulsion, asphalt, fresh concrete, structures serving the drainage
system.
2. Transport distance is
calculated on the distance from the nearest supplier to metropolitan districts.
3. Material price is
determined on the lowest price stated in a price-list of construction materials
announced on a monthly basis by the Services of Construction or other
price-lists supplied by suppliers.

b) Based on test results,
if any material criterion fails to meet the regulations, the contractor must
rectify that item and at the same time incurs a penalty of 10% of the contract
value breached.
c) In a month, if the
contractor fails to undertake or delays approved plan of maintenance (without
consent of the management unit), the management unit shall deliver a written
warning to the contractor and impose a penalty of 01% of the contract value.
From the second warning to be delivered, a penalty of 02% of the contract value
shall be imposed to the contractor plus 01% for each subsequent warning. In
case a problem or accident happens due to the contractor’s failing to execute
or delaying approved plan of maintenance, the contractor shall incur all
relevant costs and at the same time bear a penalty of 05% of the contract
value.
d) Periodically or
unexpectedly, the management unit shall inspect quality of the construction
carried out by the contractor. In case of detecting some non-conformities but
they are not so serious as to cause any grave consequence, the management shall
request the contractor to expedite rectification and incur all the costs
related, and at the same time to incur a penalty of 05% of the estimated value
executed in that month. In case a serious problem happens or a problem
that may impose hazards on normal exploitation of the Works or a fatal traffic
accident caused by poor quality of the construction, the contractor shall not
only undertake the rectification but also incur all compensation costs related
and a penalty of 10% of the estimated value executed in that month.
Chapter
VII.
IMPLEMENTATION
AND VIOLATION HANDLING
Article
24. Responsibilities of management units:
1. Be totally responsible
to the law for quality of management and maintenance of the construction Works
according to the Law on Construction and the Decrees of the Government on
construction quality control, construction maintenance and other relevant legal
documents.
2. Be responsible for
following up, inspecting the implementation of regular management, maintenance
of the Works according to the regulations, executing contracting closely,
delivering financial penalties in order to early detect and remedy minor damage
caused to the Works, avoid generation of major damage, ensure safety and
exploitation conditions of traffic infrastructural works.
3. Carry out
self-construction of the plan and program of regular management and maintenance
of road traffic structures under decentralized management including particular
issues set out in this Regulation, and at the same time make submission of them
to the Services of Transport for monitoring and management.

Article
25. Responsibilities of the Services of Transport
1. Organize and instruct
management units to develop and exercise this Regulation.
2. Be responsible for
complying with the regulations on state managment on municipal transport
industries subject to the scope of management according to applicable
regulations.
3. Organize site
inspection for regular management and maintenance of the Works system according
to managed specialties. Results from each inspection shall be described in the
Works’ inspection sheet and construction journal.
4. Direct the Services of
Transport’s Inspectorate to construct a program, plan of investigating and
inspecting regular management, maintenance of the Works’ system according to
functions, authorities as stipulated in applicable regulations and this
Regulation, and at the same time to expedite unexpected investigation, inspection
of the works showing signs of violations against quality and construction
progress, the tasks ensuring safety for traffic and neighboring works.
5. During the
implementation process, in case there is any difficulty or a necessity for
admendment, supplementation to conform to actual situations, the Services of
Transport shall be responsible for working out and submit a proposal to the
People’s Committee of the city for adjustment.
Article
26. Handling of violations
1. Any organization or
individual engaging in activities of regular management and maintenance of road
traffic infrastructural structures managed by the Services of Transport on the
administrative division of Ho Chi Minh City is found to have committed any
violation against construction quality control and maintenance tasks, depending
on the seriousness of violation, it shall be handled according to the law on
handling of administrative violations, or face a criminal prosecution; In case
those violations are found to have caused damage or loss to lawful rights and
interests of organizations, individuals, the damage causing organization or
individual shall pay an indemnity for the damaged caused.
2. Management units are
responsible for following up, inspecting compliance with the regulations on
construction quality control and maintenance by organizations, individuals
operating in regular management, maintenance of road traffic infrastructural
structures in the administrative division of Ho Chi Minh City; identifying
organizations, individuals who commit repeated violation and sending proposal
to competent authorities for delivering a decision of penalty or suspending
operation temporarily or permanently in the administrative division of Ho Chi
Minh City./.
