CONSTRUCTION REGULATIONS OF VIETNAM
THE MINISTER OF CONSTRUCTION
- Pursuant
to Decree No. 15/CP dated March 4, 1994 of the Government on functions, tasks,
and organizational structures of Ministry of Construction;
- Pursuant
to Decree No. 42/CP dated July 16, 1996 of the Government promulgating
regulations on investment and construction management;
- Considering
planning and construction management demands, at request of the Director of
Department of Construction Policy, Director of Department of Architecture and
Planning Management, Director of Institute of Architecture and Construction
Standardization, and Director of Institute of Urban - Rural Planning.
HEREBY DECIDES
Article 1. Volume 1 of
Construction Regulations (General Provisions and Construction Planning
sections) is attached under this Decision.

Chapter I
GENERAL PROVISIONS REGARDING CONSTRUCTION REGULATIONS
Article 1.1 Scope
Construction Regulations
(hereinafter referred to as “Regulations”) mandate minimum and compulsory
technical requirements in all construction activities, and solutions, standards
applied to achieve such technical requirements.

2. In the
Regulations, words in regular font depict compulsory requirements whereas words
in italic depict approved solutions (see Article 1.4).
3. The
Regulations serve as technical basis for the preparation, design, appraisal,
and approval of planning, construction design schemes, construction inspection,
and construction commissioning.
4. The
Regulations include technical-related regulations in construction activities,
excluding regulations relating to administrative procedures, construction
management, public order and hygiene.
Article 1.2 Definitions
In the Regulation, the terms below
are construed as follows:
1.2.1. Construction activities
Construction activities refer to
all technical operations relating to assembly of structures and consist of 2
main stages:
1) Construction planning: consists
of producing construction planning and managing construction as per planning.
2) Construction investment and
commencement: consists of producing investment project, surveying, designing,
constructing (including repairing, renovating, dismantling) and maintaining
constructions.

National Standards refer to
Standards of Vietnam, including:
1) Government Standards, coded as
TCVN; and
2) Construction Standards, coded as
TCXD; and
3) Sector Standards, coded as TCN.
Article 1.3 Objectives
The objectives of the Regulations
are to ensure effectiveness of construction, renovation of urban areas,
residential areas, industrial parks, and structures in terms of:
1. Safety,
security, convenience for people working and living in or close to construction
sites.
2. Protection
of society benefits, including:
a) Protect living environment,
scenery, historical remnants; preserve and improve fine national traditions;

c) Satisfy national defense and
security requirements.
3. Effective use of investment,
land, and other resources.
Article 1.4 Technical
requirements
In order to fulfill sections
mentioned under Article 1.3, all construction activities must satisfy technical
requirements mentioned in chapters below, including:
1. Requirements
pertaining to land use, environmental protection, health protection, safety and
convenience for humans when developing construction planning;
2. Minimum
requirements regarding safety, hygiene, and convenience for human use when
designing construction;
3. Minimum
requirements regarding occupational safety, environmental protection, scenery
protection during construction

2. In case of
renovation, if real life circumstances do not allow the standards to be
fulfilled, appropriate solutions must be taken to fulfill as many of these
requirements as possible.
1.5.2 Approved solutions are:
1. Solutions
mentioned under the Regulations:
a) These solutions are based on
applicable National Standards and approved by the Regulations. If any of these
standards are replaced, the replacing standards shall prevail.
b) In case of any discrepancy
between the Regulations and standards, the Regulations shall prevail.
2. Or
solutions not mentioned under the Regulations but approved by competent
authority to be satisfactory.
Note:
Solutions mentioned under
1.5.2.2 are usually based on international standards, standards of foreign
countries, and are allowed in accordance with Article 1.6.
1.5.3. Typical design of elements,
parts, components of structures promulgated by the Ministry of Construction
shall be considered technical solutions approved without appraisal when
applying in construction design.

International standards and
standards of foreign countries shall be applicable in surveying, design,
construction in Vietnam
Note:
1. The
Ministry of Construction (under Circular No. 12/BXD-KHCN dated April 24, 1995
and Circular No. 78/BXD-KHCN dated July 17, 1995) has approved and allowed
application of applicable construction regulations of ISO and the UK, Germany,
USA, Japan, France, Australia that are not in the fields below:
a) Parameters: construction
climate, hydrographic geology,
b) Prevention of: fire, explosive,
storm, thunder,
c) Environmental hygiene
d) Construction safety under local
weather.
e) Occupational safety.
2) When applying international
standards and standards of foreign countries in Vietnam, ensure consistency of applied
standards. In some case, appropriate additions are required to meet conditions,
society, economic, and technical conditions of Vietnam.

NATURAL PARAMETERS IN CONSTRUCTION DESIGN
The objectives of this Chapter
are to make sure that construction planning and construction design conform to
natural conditions of Vietnam.
Article 2.1 Natural parameters
of construction sites
Natural parameters of construction
sites used for the purpose of producing planning projects and construction
design must be official parameters including:
1. Parameters under applicable
National Standards;
2. Or parameters provided by
Government authority, in case respective National Standards have not been
promulgated.
Note:
1. Regarding natural parameters,
the following standards are available:
a) Standard: “Climate parameters in
construction design - TCVN 4088-85”;

2. Regarding other natural parameters,
see “Volume 3 of Construction Regulations - Appendix - Natural parameters of

Article 2.2 Documents on
technical surveying of construction sites
Documents on technical surveying of
construction sites regarding terrain, geology, hydrographic geology,
hydrography, environmental impact study must be produced by professional
organizations with juridical persons in accordance with National Standards or
standards of foreign countries approved by the Ministry of Construction.
Note:
The list of applicable National
Standards relating to technical surveying of construction sites shall be
published by Ministry of Construction on an annual basis in the “List of
National Standards on constructions”.
Chapter III
GENERAL TECHNICAL CONDITIONS FOR CONSTRUCTION DESIGN.
The objectives of this Chapter
are to make sure that structures are designed to fit natural, human, social,
economic, and technical characteristics of Vietnam.

4. The construction satisfies fire
prevention and firefighting requirements under Article 3.4.
5. Save land, especially farmland.
3.2.2 Architectural design.
Architectural design of
constructions (general premise planning, combined shapes, interior and exterior
design, garden design) must satisfy the following requirements:
1. Conform to regulations on
construction management of the area;
2. Conform to local climate,
utilize advantages and minimize disadvantages of nature; utilize natural
ventilation and lighting.
3. Harmonize with natural and
artificial scenery of construction locations, utilize available water surface,
trees, and road; preserve fine traditions of the nation.

2. Protect wildlife sanctuaries,
historical sites, culture, architecture.
3. Ensure reasonable exploitation
of natural resources; not hinder subsequent exploitation stages.
4. Respect customs, religion,
practices of ethnic groups at construction locations.

prevention
3.4.1 Construction location
Construction location must:
1. Minimize negative impact on
residential areas and structures in neighboring areas in case of fire
2. Allow effective and safe
operation of firefighting apparatus; have convenient road system and easily
accessed water sources for firefighting.

a. prevent the ability to create a
combustible or explosive environment; use materials and elements with fire
resistance capability appropriate to the scale and occupancy of the structures;
b. isolate combustible environment
from sources of combustion,

i) Equip adequate fire detection

ii) Prepare safe and timely means
of egress for structure occupants;

1. Structures must allow safe use
throughout construction and occupation process as follows:
a. Structure stability must be
calculated to resist the following factors affecting the structure depending on
structure type:
i) The most unfavorable combination
of loads, including loads that cause gradual damage;
ii) Other impacts, including
prolonged impact.
b. Structures, structure sections,
and materials must be able to maintain regular use, must not deform, vibrate,
or have other physicochemical properties reduced more than what is allowed.
2. Structure materials must be
durable; satisfy use requirements, and must not required major repair in a
definite period of time.
3. Structural design requirements
and solutions of buildings are specified under Chapter 9.
3.5.2 Load and impact
1. Loads and actions used in structure
design must conform to requirements under TCVN 2737-95: “Loads and actions. Design
requirements”, with revision depending on monitoring results at
construction locations.

Note:
Construction of structures in
windy or stormy regions must avoid structural, architectural solutions which
when combined with storm or heavy rain will create unfavorable secondary load,
large amplitude vibrations, or water pockets. Prioritize aerodynamic structures,
traditional structures and design that can effectively resist stormy weather.
3.5.3 Flood prevention
Structures built in sea dikes and
inundation areas must be safe for occupants, resist flood, overrun by waves,
rising tide. Structures built in midlands, mountainous regions must be
protected from damage caused by flashflood, mountain erosion, soil erosion.
Article 3.6 Earthquake

3.6.1 Earthquake resistance
requirements
Depending on earthquake resistance
requirements, structures are classified into 3 levels:
1. Level 1 structures:
a. Level 1 structures are structures
of special importance, must not deform or suffer localized damage.

c. In regard to level 1 structures,
earthquake resistance solutions corresponding to the highest earthquake
magnitude regardless of rate of occurrence.
2. Level 2 structures:
a. Level 2 structures mean regular structures,
can deform in form of fissures, individual element damage as long as safety for
humans and equipment is maintained.
b. When designing level 2 structures,
design earthquake resistance corresponding to selected earthquake magnitude for
specific cases.
3. Level 3 structures:
a. Level 3 structures are structures
which when destroyed by earthquake pose a low risk of human casualties or major
economic losses.
b. Level 3 structures consist of
single-storey civil, industrial structures containing no precious assets,
regular warehouses, auxiliary structures.
c. Level 3 structures do not have
earthquake resistance requirements.
3.6.2 Earthquake magnitude

3.6.3 Earthquake resistance design
Earthquake resistance solutions and
calculations shall be selected in accordance with applicable earthquake
resistance standards.
Note:
There are no National Standards
on earthquake resistance available at the moment. During design process,
applicable standards of developed countries approved by the Ministry of
Construction are allowed for application.
Article 3.7 Corrosion prevention
3.7.1 All structure types built and
used in Vietnam’s climate must be protected by appropriate corrosion prevention
measures.
3.7.2 All selected corrosion
prevention measures must be effective, long-lasting, and economic. Protective
measures of structures and buildings susceptible to corrosion by chemicals or
organisms must be appropriate to characteristics of corroding factors (types of
chemicals or substances secreted by organisms) and how they damage the
structures.
3.7.3 Approved technical

a. Coating paint: applicable to
structures exposed to air.
b. Combined coating paint and
cathodic protection: applicable to structures in water or embedded in soil.
2. In regard to reinforced
concrete and prestressed reinforced concrete:
a. Type of cement suitable with
the environment.
b. Solutions for improving
compaction of concrete, improving concrete waterproofing capacity. Choose
concrete cover appropriate to corrosive environments.
c. Outer paint for additional
waterproofing.
d. Steel reinforcement protection
by appropriate electrochemical methods.
e. Cable bundles or
high-strength steel rebar bundle in prestressed reinforced concrete which must
be protected from rust and placed in closed channels on the side of concrete

3.9.1 Lightning protection
requirements for structures
1. Depending
on lightning protection requirements, structures (other than special structures
mentioned under Point 3 below) shall be divided into 3 levels according to
Schedule 3.9.1.
2. If a structure
requires multiple lightning protection levels, the highest level shall apply to
the entire structure.
3. Structures
with special lightning protection requirements below must conform to
specialized regulations:
a. Storage of explosive ordnance,
petroleum;
b. Power line, telephone line;
c. Radio masts, radio antennas;

1. Grounding

Article 4.1 Scope

“Construction planning” serve as the basis for producing and approving urban

residential construction planning projects shall serve as the legal basis for
introducing locations, issuing planning certificate, and issuing construction
permit.

Construction planning refers to
organization of architectural space and arrangement of structures in a specific
area from time to time and serves as the legal basis for preparing for

Building restriction areas are
areas outside of protected zones of technical structures. In these areas,
construction activities and other activities must not affect safety of the
structures in accordance with legislative documents mentioned under 4.4.2.3.

the “Ordinance on Dike” issued in 1989 and Decree No. 429/HDBT dated December

4.5.3 Construction outside of
protected zones of dikes
Construction activities outside of
protected zones of dikes must conform to the following regulations:

move away from protected zones by 10 m. If the rule above cannot be complied
with, safety measures must be taken and approved by the Ministry of Dike
Management.
2. Construction of structures
relating to safety of dikes such as piers, docks, medium-sized and large-sized
reservoirs requires consent of the Ministry of Dike.

Construction and renovation of
structures on the sides of road and outside of urban areas must comply with
regulations below:
a. Construction permit must be
applied for and complied with; aesthetic, hygiene, and traffic safety must be
guaranteed.
b) New construction (houses, storage
units, limestone kiln, brick kiln) must be at least 15 m away from road
protection corridors and at least 50 m away from highways. Structures that
require quietness and traffic safety (such as: hospitals, schools,
kindergartens) must be at least 100 m away from national highways.
c. Structures that attract large
number of people and vehicles (such as: markets, theaters, stadiums, stores,
storage units) must have sufficient parking spaces and spaces for human
occupation without affecting road traffic.
d. Telecommunication posts and
telephone posts must be separate from roads. The minimum distance between these
telecommunication and telephone posts to the roads must equal the height of
such posts. If the separation distance cannot be guaranteed, solutions approved
by competent authority governing the relevant roads must be taken.
e. Water drainage must be
guaranteed for road surface and construction sites.
g. Do not build structures which
obstruct traffic such as welcome arches, walls containing propaganda, or
monuments.
h. Junctions on main roads (into
residential areas, etc.) must be on the same elevation as the main roads, must
not lower or split on top of the main roads.

5.12.1 Urban industrial park
1. Factories must be grouped into
industrial parks, complex and reasonable in terms of production organization,
yard and storage arrangement, use of technical infrastructures, and
environmental protection.
2. Planning for construction,
renovation, and expansion of industrial complex must satisfy the following
requirements:
a. Environmental protection:
i) Comply with environmental

geography, topography, scenery, industrial aesthetic, and compatible with other
architectural spaces in urban areas. Fire separation distance between
structures must be guaranteed in accordance with Article 4.12.

3. Locations of industrial
factories
Location of factories must not
negatively affect life goals of residential areas, to be specific:
a) Factories that produce toxic
substances or environmental pollutants must be located downwind of prevailing
winds, downstream of rivers and canals of residential areas.
b) Depending on negative impact on
the environment and amount of transport entering, exiting factories, factories
shall be located:
i) Outside of urban areas: if the
factories use strong radioactive substances or combustible substances; large
industrial landfills or containing dangerous refuse.
ii) Away from civil areas: if the
factories are classified as class I or class II toxic factories (according to
classification under Appendix 4.8).
ii) Within residential areas: if
the factories are small scale, have low transport load, do not release toxic

Article 5.18 Underground
structure network
5.18.1 Urban underground structure
network (including: water supply pipelines, rainwater drainage pipelines,
wastewater drainage pipelines, gas supply pipelines, oil pipelines; electric
cables (high-voltage and low-voltage), communication cables (telephone lines,
telegraph lines, radio lines, etc.) must be designed and constructed in unison
and spare future development space.
5.18.2 Underground structure
network should be positioned along street network. Only self-flow pipelines
such as rainwater drainage, wastewater drainage are allowed beneath the roads. Roads
that are at least 60 m wide require water drainage system on both sides.
5.18.3 If road surface needs to be
upgraded to high-quality road in renovated street sections, underground
structures must relocated and positioned along median strip or pavements.
5.18.4 Vertical and horizontal
clearance from underground structures to other structures and trees must be
sufficient to not affect operation of these underground structures and not
obstruct traffic, operation of the structures during repair (Appendix 5.1)
Article 5.19 Solid waste
management
5.19.1 Toxic solid wastes must be
treated separately.
5.19.2 Concentrated urban landfills
must be positioned according to planning, outside of urban areas, downwind of
prevailing winds, downstream of rivers, lakes, and separated from civil areas
and food factories (see Point 3 below). Strips of trees are required around
landfills.
5.19.3 Handling solutions

2 years, cover the landfills with soil for planting trees. This solution is
inexpensive and applicable to many urban areas in the near future. This
solutions requires large area, distance from urban areas, and solutions for
preventing seepage and leachate.
3) Fermentation and use as
fertilizer (waste treatment plants): suitable with waste properties and climate
of Vietnam while demanding high investment thus suitable with large-scale urban
areas or cases where high hygiene requirements are needed.
4) Incineration (waste
incineration plants): expensive and only suitable for wastes from hospitals, wastes
containing toxic substances or persistent substances.

or building embankments. Raised ground elevation or crest level of embankments
must conform to irrigation planning and be higher than calculated water level. The

2. Positioning of manufacturing

When producing planning schemes,

4. Allow convenient access to
district, provincial road network and create a complete network.
5. Allow direct and convenient
access between central areas, residential areas, connect residential areas with

hydroelectricity.
6.11.2 Planning for electricity
network in residential areas of communes must be closely associated with
traffic and architecture planning. Electrical wires must not cross storage
units of combustible or explosive substances.
6.11.3 When producing planning
schemes, solutions below are allowed for application:

2. Step-down stations must be
located on the way to electricity-using households or close to the largest load
or where convenient for placement of electrical wires, minimize intersection
with roads, not obstruct or endanger production and daily activities. If
step-down stations are located in areas with lots of trees, separation distance
is required so that equipment in the stations are not affected by felled trees
and must be at least 2 m away from outer walls of the stations.

Article 7.1 Scope
7.1.1 Regulations under this
Chapter serve as the basis for producing detail planning and drafting
“Construction management charters” of planned areas.
7.1.2 In regard to areas without
approved detail planning schemes, People’s Committees of provinces and
central-affiliated cities must rely on this document to promulgate documents
guiding construction management to fit local situations.
Note:
a) The Construction Regulations
only prescribe issues relating to construction engineering. Issues pertaining
to management of urban operation (such as maintaining of order, traffic safety,
protecting of trees, preventing of noise, vibration, etc.) shall be prescribed
in relevant documents.
b) This Chapter prescribes urban
planning and architecture requirements. Other structure requirements
(structural components, fire prevention and firefighting, hygiene, safety)
c) Regulations applicable to urban
technical structures are specified under Chapter 5.

adjoin streets must be built within building line, except for structure parts
allowed to protrude out of boundary line in accordance with Article 7.4 and
Article 7.5 of this document.
3 . All structures must be designed
and built in a manner that fits planning - architecture requirements of the
area, regulations under 7.2.1, and requirements pertaining to structure
examination under Part III of this document.

houses, apartment blocks, commercial structures, manufacturing structures in
detached house blocks.
iii) Do not build additional
detached houses or terraced houses in existing apartment blocks.
2) Public structures
a) Public structures serving
education, medical, culture, and research that require quiet and hygienic
environment (kindergartens, schools, hospitals, libraries, research agencies,
etc.) must be located in areas with scenery, remote from noisy locations such
as markets, art performance venues, sports venues, playgrounds, main roads, bus
stations, railway stations, airports.
b) Public structures that
attract large number of visitors (large stores, art performance venues, sports
venues, administrative authorities) must be close to residential areas and
convenient for traffic and evacuation.
c) Schools must be located in
areas where students can reach without crossing crowded streets.
3) Structures that can cause
environmental pollution or are regularly accessed by automobiles (such as
factories, storage facilities, hospitals, wastewater pump and treatment
stations, livestock slaughterhouses, cemeteries) or have high fire, explosion
risks (storage of gas, explosive substances, chemicals, gasoline) must be
located:
a) Far from residential areas
and public structures: with sufficient sanitation clearance, safety clearance
and strips of trees according to Chapter 4;
b) Downstream and downwind of
prevailing winds.

Houses (that are occupied) must
have points of entry and exit connecting to nearby alleys and streets and
allowing emergency medical care and firefighting efforts after being built.
7.3.3 Safety and hygiene
Plots must be safe and hygienic for
occupants: no regular floods, no risk of pollution, fire, explosion, traffic
accidents.
7.3.4 Plot size
1. Plots must meet minimum area and
size requirements for construction of each type of building according to
approved planning or regulations on regional construction management.

7.12.1 Prohibition against
infringing boundaries
1. No building sections, including
equipment, pipelines, and underground sections (foundations, pipelines) must
not protrude from plot boundaries.
2. Do not discharge rainwater,
wastewater of all kinds (including air conditioner condensate), dust, vapor,
exhaust into neighboring buildings.
7.12.2 Windows, ventilation
openings, balconies
1. Starting from the second storey,
walls that are less than 2 m from plot boundaries of adjacent buildings must
not facilitate any doorway, ventilation opening, and window. (Doors, windows,
and ventilation openings are allowed on walls that are at least 2 m away from
plot boundaries of adjacent buildings).
Measures must be taken to prevent
other people from looking into the interior of adjacent buildings when such
doors are opened (by obstructing visibility or arranging windows between 2
buildings in misaligned positions).
2. Outermost edge of balconies
pointing towards adjacent buildings must be at least 2 m away from plot
boundary between 2 buildings.
3. If holders of use right of
adjacent plots agree, walls that are less than 2 m away from plot boundaries
can facilitate openings as long as flame spread prevention measures are
adopted. These openings must facilitate fixed doors (shutters or fixed glass
doors) whose lower edge is at least 2 m above floor surface. If the agreement
is annulled, the sealing of these openings shall be inevitable without further
negotiation.
4. In regard to walls adjoining
public plot (parks, parking lots), construction authority can allow fixed doors
or other decorations.

Regularly attended public
structures (schools, hospitals, theaters, stadiums, etc.) must:
