DECISION
PROMULGATING THE LIST OF TREES PROHIBITED FROM GROWING ON
THE STREETS IN HO CHI MINH CITY
PEOPLE’S COMMITTEE OF HO CHI MINH CITY
Pursuant to the Law on
Organization of the People’s Council and the People’s Committee dated November
26, 2003;
Pursuant to the Law on
Promulgation of Legal Documents of People’s Councils and People’s Committees
dated December 03, 2004;
Pursuant to the
Government’s Decree No. 64/2010/ND-CP dated June 11, 2010 on management of
urban green trees;
Pursuant to the
Circular Number 20/2005/TT-BXD dated December 20, 2005 of the Ministry of Construction
on guiding the management of urban green trees and the Circular No.
20/2009/TT-BXD dated June 30, 2009 of the Ministry of Construction on amending
the Circular No. 20/2005/TT-BXD dated December 20, 2005;
Pursuant to the
Decision No. 70/2010/QD-UBND dated September 17, 2010 of the People’s Committee
of Ho Chi Minh City promulgating the Regulation on organization and activities
of the Department of Transport of Ho Chi Minh City;

DECISION
Article 1. Enclosed
with this Decision is the List of trees prohibited from growing on the streets
in Ho Chi Minh City.
Artilcle 2. It is prohibited to grow trees on the List of trees
prohibited from growing on the streets. The organizations and units managing
urban green trees shall make plans to replace the existing trees on the streets
which are specified in the List of prohibited trees.
Article 3. This Decision shall come into force after 10 days, from the
date on which it is signed, and shall replace the Decision No. 45/2013/QD-UBND
dated October 11, 2013 of the People’s Committee of the City.
Article 4. Chief of Staff of the People’s Committee of Ho Chi Minh
City, Director of the Department of Transport, Chair-persons of the People's
Committees in districts, wards, communes and villages, Heads of Departments,
boards and sectors of the City and other related organizations and individuals
shall implement this Decision./.

The following
twenty-eight (28) trees are prohibited from growing on sidewalks and central
reservations. These trees are either fruit trees, trees that are toxic to
humans or otherwise harmful to humans and the environment.
