QUY ĐỊNH KHU DÂN CƯ, XÃ, PHƯỜNG, THỊ TRẤN, CƠ QUAN, DOANH NGHIỆP, CƠ SỞ GIÁO DỤC ĐẠT TIÊU CHUẨN “AN TOÀN VỀ AN NINH, TRẬT TỰ”

Căn cứ Luật ban hành văn bản quy phạm pháp luật năm 2015; Luật sửa đổi, bổ sung một số điều của Luật ban hành văn bản quy phạm pháp luật năm 2020;

Căn cứ Luật Công an nhân dân năm 2018;

Căn cứ Nghị định số 01/2018/NĐ-CP ngày 06 tháng 8 năm 2018 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Công an;

Theo đề nghị của Cục trưởng Cục Xây dựng phong trào bảo vệ an ninh Tổ quốc, Bộ Công an;

Bộ trưởng Bộ Công an ban hành Thông tư quy định khu dân cư, xã, phường, thị trấn, cơ quan, doanh nghiệp, cơ sở giáo dục đạt tiêu chuẩn “An toàn về an ninh, trật tự”.

Chương I

QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh, đối tượng áp dụng

1. Phạm vi điều chỉnh

Thông tư này quy định về nguyên tắc, tiêu chí, trình tự, thủ tục, thẩm quyền xét duyệt, công nhận khu dân cư, xã, phường, thị trấn, cơ quan, doanh nghiệp, cơ sở giáo dục đạt tiêu chuẩn “An toàn về an ninh, trật tự”.

2. Đối tượng áp dụng

a) Khu dân cư, xã, phường, thị trấn;

b) Cơ quan (trừ cơ quan, đơn vị lực lượng vũ trang), doanh nghiệp (trừ doanh nghiệp nhỏ, siêu nhỏ), cơ sở giáo dục (trừ cơ sở giáo dục tiểu học, mầm non, nhà trẻ);

c) Cơ quan, tổ chức, cá nhân có liên quan đến việc xét duyệt, công nhận khu dân cư, xã, phường, thị trấn, cơ quan, doanh nghiệp, cơ sở giáo dục đạt tiêu chuẩn “An toàn về an ninh, trật tự”.

Điều 2. Giải thích từ ngữ

Trong Thông tư này, các từ ngữ dưới đây được hiểu như sau:

1. “Khu dân cư” là nơi người dân, hộ gia đình cư trú tập trung trong phạm vi một khu vực nhất định, là tên gọi chung của thôn, làng, bản, ấp, buôn, phum, sóc, khóm, tổ dân phố, khu phố và đơn vị dân cư tương đương.

2. “Cơ quan” gồm: Cơ quan nhà nước, cơ quan hành chính nhà nước, các đơn vị sự nghiệp công lập, các tổ chức chính trị - xã hội, tổ chức xã hội nghề nghiệp được thành lập, hoạt động theo quy định của cấp có thẩm quyền và có trụ sở làm việc, được đảm bảo hoạt động từ ngân sách Nhà nước.

3. “Doanh nghiệp” là tổ chức có tên riêng, có tài sản, có trụ sở giao dịch, được đăng ký thành lập theo quy định của pháp luật nhằm mục đích sản xuất, kinh doanh.

4. “Cơ sở giáo dục” là tổ chức thực hiện hoạt động giáo dục trong hệ thống giáo dục quốc dân gồm nhà trường và cơ sở giáo dục khác.

Điều 3. Nguyên tắc chung

1. Việc xét duyệt, công nhận khu dân cư, xã, phường, thị trấn, cơ quan, doanh nghiệp, cơ sở giáo dục đạt tiêu chuẩn “An toàn về an ninh, trật tự” được thực hiện mỗi năm một lần.

2. Việc xét duyệt, công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” phải bảo đảm chính xác, công khai, dân chủ và đúng quy định.

3. Kết quả công nhận “An toàn về an ninh, trật tự” là căn cứ đánh giá, xét khen thưởng hằng năm về phong trào toàn dân bảo vệ an ninh Tổ quốc; xét khen thưởng, công nhận các danh hiệu có liên quan đến an ninh, trật tự.

Chương II

QUY ĐỊNH CỤ THỂ

Điều 4. Tiêu chí công nhận khu dân cư đạt tiêu chuẩn “An toàn về an ninh, trật tự”

Khu dân cư được công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” khi đạt đủ các tiêu chí sau:

1. Quý I hằng năm, chi bộ có nghị quyết, khu dân cư có đăng ký phấn đấu đạt tiêu chuẩn “An toàn về an ninh, trật tự”; 100% hộ gia đình đang cư trú trên địa bàn đăng ký tham gia xây dựng khu dân cư “An toàn về an ninh, trật tự”.

2. Triển khai, thực hiện đầy đủ các chủ trương, đường lối của Đảng, chính sách, pháp luật của Nhà nước, các quy định của địa phương về công tác bảo đảm an ninh, trật tự.

3. Không để xảy ra một trong các trường hợp sau:

a) Hoạt động chống Đảng, chống chính quyền, phá hoại khối đại đoàn kết toàn dân tộc;

b) Hoạt động phá hoại các mục tiêu, công trình trọng điểm về kinh tế, văn hóa, xã hội, an ninh - quốc phòng;

c) Tuyên truyền, phát triển tín ngưỡng, tôn giáo trái pháp luật;

d) Hoạt động lợi dụng tín ngưỡng, tôn giáo, dân tộc, tranh chấp, khiếu kiện gây phức tạp về an ninh, trật tự;

đ) Hoạt động ly khai, đòi tự trị;

e) Mâu thuẫn, tranh chấp phức tạp, kéo dài trong nội bộ Nhân dân;

g) Kích động, xúi giục, cưỡng ép, dụ dỗ, mua chuộc, lôi kéo người khác tập trung đông người khiếu nại, gây rối an ninh, trật tự công cộng hoặc lợi dụng việc khiếu nại để tuyên truyền chống Nhà nước; xâm phạm lợi ích của Nhà nước; xuyên tạc, vu khống, đe dọa, xúc phạm uy tín, danh dự của cơ quan, tổ chức, người có trách nhiệm được phân công giải quyết khiếu nại, tố cáo.

4. Tham gia, phối hợp thực hiện có hiệu quả công tác phòng ngừa tội phạm, tệ nạn xã hội và các vi phạm pháp luật khác ở khu dân cư, bao gồm:

a) Kiềm chế, kéo giảm các loại tội phạm, tệ nạn xã hội, các hành vi vi phạm pháp luật khác so với năm trước;

b) Không để xảy ra tội phạm nghiêm trọng trở lên (trừ trường hợp bất khả kháng) hoặc nếu có phải kịp thời phát hiện, sử dụng đồng bộ các biện pháp giảm thiểu hậu quả và báo cáo ngay cấp có thẩm quyền để xử lý;

c) Không phát sinh tụ điểm phức tạp về trật tự xã hội; không phát sinh người mắc tệ nạn xã hội; thực hiện có hiệu quả công tác quản lý, giáo dục, giúp đỡ các loại đối tượng đang cư trú trên địa bàn theo quy định của pháp luật;

d) Không để xảy ra cháy, nổ nghiêm trọng; tai nạn lao động chết người; sự cố nghiêm trọng theo quy định của pháp luật (trừ trường hợp bất khả kháng).

5. Lực lượng tham gia bảo đảm an ninh, trật tự ở cơ sở được đánh giá hoàn thành nhiệm vụ trở lên và không có cá nhân vi phạm bị xử lý kỷ luật.

Điều 5. Tiêu chí công nhận xã, phường, thị trấn đạt tiêu chuẩn “An toàn về an ninh, trật tự”

Xã, phường, thị trấn được công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” khi đạt đủ các tiêu chí sau:

1. Quý I hằng năm, Đảng ủy có nghị quyết; Ủy ban nhân dân xã, phường, thị trấn có kế hoạch về bảo đảm an ninh, trật tự và đăng ký phấn đấu đạt tiêu chuẩn “An toàn về an ninh, trật tự”; xây dựng, củng cố hoặc duy trì ít nhất 01 mô hình phong trào toàn dân bảo vệ an ninh Tổ quốc ở cơ sở hoạt động hiệu quả.

2. Đạt các tiêu chí quy định tại khoản 2, khoản 3, khoản 4 Điều 4 Thông tư này.

3. Công an xã, phường, thị trấn chủ động nắm chắc tình hình, kịp thời tham mưu, đề xuất cấp ủy đảng, chính quyền các chủ trương, biện pháp và tổ chức thực hiện có hiệu quả công tác bảo đảm an ninh, trật tự và xây dựng phong trào toàn dân bảo vệ an ninh Tổ quốc trên địa bàn; không có cá nhân vi phạm bị xử lý kỷ luật.

4. 100% khu dân cư, cơ quan, doanh nghiệp, cơ sở giáo dục thuộc thẩm quyền hoặc được ủy quyền quản lý trên địa bàn đăng ký, trong đó có từ 70% trở lên được công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự”.

Điều 6. Tiêu chí công nhận cơ quan, doanh nghiệp đạt tiêu chuẩn “An toàn về an ninh, trật tự”

Cơ quan, doanh nghiệp được công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” khi đạt đủ các tiêu chí sau:

1. Quý I hằng năm, tổ chức Đảng có nghị quyết chuyên đề riêng hoặc lồng ghép công tác bảo đảm an ninh, trật tự trong nghị quyết lãnh đạo, chỉ đạo hằng năm (đối với nơi có tổ chức Đảng); cơ quan, doanh nghiệp có kế hoạch về bảo đảm an ninh, trật tự và đăng ký phấn đấu đạt tiêu chuẩn “An toàn về an ninh, trật tự”; có nội quy, quy định bảo vệ cơ quan, doanh nghiệp, bảo vệ bí mật Nhà nước, bảo vệ chính trị nội bộ, an toàn lao động, phòng, chống cháy nổ, bảo vệ môi trường phù hợp với tình hình thực tiễn và quy định của pháp luật; 100% cán bộ, công chức, viên chức, người lao động được phổ biến quán triệt các nội quy, quy định nêu trên và tiêu chí xây dựng cơ quan, doanh nghiệp đạt tiêu chuẩn “An toàn về an ninh, trật tự”; có ít nhất 01 mô hình phong trào toàn dân bảo vệ an ninh Tổ quốc hoạt động hiệu quả.

2. Triển khai, thực hiện đầy đủ các chủ trương, đường lối của Đảng, chính sách, pháp luật của Nhà nước, quy chế, chương trình, kế hoạch phối hợp với lực lượng Công an (nếu có) và các quy định của địa phương về công tác bảo đảm an ninh, trật tự.

3. Không để xảy ra một trong các trường hợp sau:

a) Tuyên truyền, phát triển tín ngưỡng, tôn giáo trái pháp luật;

b) Hoạt động lợi dụng tín ngưỡng, tôn giáo, dân tộc, tranh chấp, khiếu kiện gây phức tạp về an ninh, trật tự;

c) Kích động, xúi giục, cưỡng ép, dụ dỗ, mua chuộc, lôi kéo người khác tập trung đông người khiếu nại, gây rối an ninh, trật tự công cộng hoặc lợi dụng việc khiếu nại để tuyên truyền chống Nhà nước; xâm phạm lợi ích của Nhà nước; xuyên tạc, vu khống, đe dọa, xúc phạm uy tín, danh dự của cơ quan, tổ chức, người có trách nhiệm được phân công giải quyết khiếu nại, tố cáo;

d) Đình công, lãn công trái pháp luật;

đ) Tội phạm nghiêm trọng trở lên (trừ trường hợp bất khả kháng) hoặc nếu có, kịp thời phát hiện, sử dụng đồng bộ các biện pháp giảm thiểu hậu quả và báo cáo ngay cấp có thẩm quyền để xử lý;

e) Vi phạm các quy định về bảo vệ bí mật Nhà nước;

g) Cháy, nổ nghiêm trọng; tai nạn lao động chết người; sự cố nghiêm trọng; vi phạm môi trường, an toàn vệ sinh thực phẩm gây hậu quả nghiêm trọng trở lên theo quy định của pháp luật (trừ trường hợp bất khả kháng);

h) Cán bộ, công chức, viên chức, người lao động bị xử phạt vi phạm hành chính trong lĩnh vực an ninh, trật tự hoặc mắc tệ nạn xã hội bị xử lý kỷ luật từ hình thức cảnh cáo trở lên.

4. Lực lượng bảo vệ cơ quan, doanh nghiệp đạt danh hiệu “Tập thể lao động tiên tiến” hoặc được đánh giá “Hoàn thành tốt nhiệm vụ” trở lên (đối với những nơi đủ điều kiện bình xét danh hiệu thi đua), không có cá nhân bị kỷ luật từ hình thức cảnh cáo trở lên.

5. 70% trở lên số đầu mối trực thuộc (phòng, ban, tổ, đội) đạt danh hiệu “Tập thể lao động tiên tiến” hoặc được đánh giá “Hoàn thành tốt nhiệm vụ” trở lên (đối với những nơi đủ điều kiện bình xét danh hiệu thi đua), không có cá nhân bị kỷ luật từ hình thức cảnh cáo trở lên.

Điều 7. Tiêu chí công nhận cơ sở giáo dục đạt tiêu chuẩn “An toàn về an ninh, trật tự”

Cơ sở giáo dục được công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” khi đạt đủ các tiêu chí sau:

1. Quý I hằng năm, tổ chức Đảng có nghị quyết chuyên đề riêng hoặc lồng ghép công tác bảo đảm an ninh, trật tự trong nghị quyết lãnh đạo, chỉ đạo hằng năm (đối với nơi có tổ chức Đảng), cơ sở giáo dục có kế hoạch về bảo đảm an ninh, trật tự và đăng ký phấn đấu đạt tiêu chuẩn “An toàn về an ninh, trật tự”; có nội quy, quy định bảo vệ cơ sở giáo dục, bảo vệ chính trị nội bộ, quản lý giáo dục người học, phòng, chống cháy nổ phù hợp với tình hình thực tiễn; 100% cán bộ, công nhân viên, người lao động, người dạy, người học được phổ biến quán triệt các nội quy, quy định nêu trên và tiêu chí xây dựng cơ sở giáo dục đạt tiêu chuẩn “An toàn về an ninh, trật tự”; có ít nhất 01 mô hình phong trào toàn dân bảo vệ an ninh Tổ quốc hoạt động hiệu quả.

2. Triển khai, thực hiện đầy đủ các chủ trương, đường lối của Đảng, chính sách, pháp luật của Nhà nước, quy chế, chương trình, kế hoạch phối hợp với lực lượng Công an (nếu có), các quy định của địa phương về công tác bảo đảm an ninh, trật tự; có hình thức, biện pháp phối hợp quản lý học sinh giữa cơ sở giáo dục và Ban Đại diện cha mẹ học sinh (đối với cấp học phổ thông) trong công tác bảo đảm an ninh, trật tự.

3. Không để xảy ra một trong các trường hợp quy định tại điểm a, b, c, đ, e và g khoản 3 Điều 6 Thông tư này.

4. Không để xảy ra bạo lực học đường, cán bộ, công nhân viên, người lao động, người dạy, người học phạm tội hoặc mắc tệ nạn xã hội bị xử lý kỷ luật từ hình thức cảnh cáo trở lên.

5. Lực lượng bảo vệ cơ sở giáo dục (nếu có) đạt danh hiệu “Tập thể lao động tiên tiến” hoặc được đánh giá “Hoàn thành tốt nhiệm vụ” trở lên (đối với những nơi đủ điều kiện bình xét danh hiệu thi đua), không có cá nhân bị kỷ luật từ hình thức cảnh cáo trở lên.

6. 70% trở lên số đầu mối trực thuộc (khoa, phòng, ban, tổ chuyên môn) đạt danh hiệu “Tập thể lao động tiên tiến” hoặc được đánh giá “Hoàn thành tốt nhiệm vụ” trở lên (đối với những nơi đủ điều kiện bình xét danh hiệu thi đua), không có cá nhân bị kỷ luật từ hình thức cảnh cáo trở lên.

Điều 8. Mốc thời gian đánh giá, kết quả phân loại đạt tiêu chuẩn “An toàn về an ninh, trật tự”

1. Căn cứ vào mức độ đạt các tiêu chí “An toàn về an ninh, trật tự” quy định tại Thông tư này và các tiêu chí khác do Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương quy định (nếu có) để phân loại khu dân cư, xã, phường, thị trấn, cơ quan, doanh nghiệp, cơ sở giáo dục đạt hoặc chưa đạt tiêu chuẩn “An toàn về an ninh, trật tự”.

2. Mốc thời gian đánh giá

a) Đối với khu dân cư: Mốc thời gian đánh giá từ ngày 01 tháng 11 năm trước đến ngày 31 tháng 10 năm sau;

b) Đối với xã, phường, thị trấn, cơ quan, doanh nghiệp, cơ sở giáo dục: Mốc thời gian đánh giá từ ngày 16 tháng 11 năm trước đến ngày 15 tháng 11 năm sau.

Điều 9. Trình tự, thủ tục, hồ sơ đề nghị công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự”

1. Trình tự, thủ tục đề nghị công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự”

a) Trưởng khu dân cư chủ trì cuộc họp cùng Bí thư chi bộ, đại diện Ban Công tác Mặt trận, đại diện các tổ chức đoàn thể quần chúng (nếu có) và đại diện Công an cấp cơ sở để kiểm điểm, đánh giá tình hình, kết quả thực hiện khu dân cư “An toàn về an ninh, trật tự” và hoàn tất thủ tục hồ sơ gửi về Thường trực Ban Chỉ đạo phòng chống tội phạm, tệ nạn xã hội và xây dựng phong trào toàn dân bảo vệ an ninh Tổ quốc xã, phường, thị trấn (gọi chung là cấp xã) để thẩm định và báo cáo, đề xuất Chủ tịch Ủy ban nhân dân cấp xã xét duyệt, quyết định công nhận khu dân cư đạt tiêu chuẩn “An toàn về an ninh, trật tự” trước ngày 15 tháng 11 hằng năm;

b) Thường trực Ban Chỉ đạo phòng chống tội phạm, tệ nạn xã hội và xây dựng phong trào toàn dân bảo vệ an ninh Tổ quốc cấp xã kiểm điểm, đánh giá tình hình, kết quả thực hiện việc xây dựng xã, phường, thị trấn đạt tiêu chuẩn “An toàn về an ninh, trật tự” và hoàn tất thủ tục hồ sơ gửi về Thường trực Ban Chỉ đạo phòng chống tội phạm, tệ nạn xã hội và xây dựng phong trào toàn dân bảo vệ an ninh Tổ quốc huyện, quận, thị xã, thành phố trực thuộc tỉnh (gọi chung là cấp huyện) để thẩm định và báo cáo, đề xuất Chủ tịch Ủy ban nhân dân cấp huyện xét duyệt, quyết định công nhận xã, phường, thị trấn đạt tiêu chuẩn “An toàn về an ninh, trật tự” trước ngày 20 tháng 11 hằng năm;

c) Người đứng đầu cơ quan, doanh nghiệp, cơ sở giáo dục chủ trì cuộc họp gồm đại diện cấp ủy Đảng, các tổ chức đoàn thể, lực lượng bảo vệ (nếu có), đại diện Công an cơ sở, đại diện cơ quan có thẩm quyền quản lý để kiểm điểm, đánh giá tình hình, kết quả việc xây dựng cơ quan, doanh nghiệp, cơ sở giáo dục đạt tiêu chuẩn “An toàn về an ninh, trật tự” và hoàn tất thủ tục hồ sơ báo cáo cấp có thẩm quyền (qua Thường trực Ban Chỉ đạo phòng chống tội phạm, tệ nạn xã hội và xây dựng phong trào toàn dân bảo vệ an ninh Tổ quốc) để thẩm định, xét duyệt, quyết định công nhận trước ngày 20 tháng 11 hàng năm;

d) Cục Xây dựng phong trào bảo vệ an ninh Tổ quốc, Bộ Công an thẩm định hồ sơ và báo cáo đề xuất Bộ trưởng Bộ Công an xét duyệt, quyết định công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” đối với cơ quan, doanh nghiệp, cơ sở giáo dục do các đơn vị nghiệp vụ thuộc Bộ Công an theo dõi, hướng dẫn về công tác bảo đảm an ninh, trật tự và xây dựng phong trào toàn dân bảo vệ an ninh Tổ quốc trước ngày 20 tháng 11 hằng năm.

2. Hồ sơ đăng ký và đề nghị xét duyệt, công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự”

a) Hồ sơ đăng ký

- Nghị quyết của cấp ủy Đảng lãnh đạo về công tác bảo đảm an ninh, trật tự (nơi có tổ chức Đảng);

- Kế hoạch về bảo đảm an ninh, trật tự của Ủy ban nhân dân xã, phường, thị trấn; cơ quan, doanh nghiệp, cơ sở giáo dục;

- Bản đăng ký phấn đấu đạt tiêu chuẩn “An toàn về an ninh, trật tự”.

b) Hồ sơ đề nghị xét duyệt, công nhận

- Tờ trình đề nghị xét duyệt, công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự”;

- Báo cáo kết quả xây dựng khu dân cư, xã, phường, thị trấn, cơ quan, doanh nghiệp, cơ sở giáo dục đạt tiêu chuẩn “An toàn về an ninh, trật tự”;

- Biên bản cuộc họp đánh giá tình hình, kết quả thực hiện các tiêu chí xây dựng khu dân cư, xã, phường, thị trấn, cơ quan, doanh nghiệp, cơ sở giáo dục đạt tiêu chuẩn “An toàn về an ninh, trật tự”;

- Các tài liệu khác có liên quan.

Điều 10. Thẩm quyền xét duyệt, quyết định công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự”

1. Ủy ban nhân dân cấp xã xét duyệt, ra quyết định công nhận và cấp Giấy công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” đối với các khu dân cư, cơ quan, doanh nghiệp, cơ sở giáo dục thuộc thẩm quyền hoặc được ủy quyền quản lý.

2. Ủy ban nhân dân cấp huyện xét duyệt, ra quyết định công nhận và cấp Giấy công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” đối với các xã, phường, thị trấn, cơ quan, doanh nghiệp, cơ sở giáo dục thuộc thẩm quyền hoặc được ủy quyền quản lý.

3. Ủy ban nhân dân cấp tỉnh xét duyệt, ra quyết định công nhận và cấp Giấy công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” đối với các cơ quan, doanh nghiệp, cơ sở giáo dục thuộc thẩm quyền hoặc được ủy quyền quản lý.

4. Bộ Công an xét duyệt, ra quyết định công nhận và cấp Giấy công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” đối với các cơ quan, doanh nghiệp, cơ sở giáo dục do các đơn vị nghiệp vụ thuộc Bộ Công an theo dõi, hướng dẫn về công tác bảo đảm an ninh, trật tự và xây dựng phong trào toàn dân bảo vệ an ninh Tổ quốc.

5. Tùy theo điều kiện cụ thể của từng địa phương, Ủy ban nhân dân cấp trên có thể ủy quyền cho Ủy ban nhân dân cấp dưới một cấp xét duyệt, công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” cho Cơ quan, doanh nghiệp, cơ sở giáo dục đóng trên địa bàn.

Chương III

TỔ CHỨC THỰC HIỆN

Điều 11. Hiệu lực thi hành

Thông tư này có hiệu lực kể từ ngày 10/02/2022 và thay thế Thông tư số 23/2012/TT-BCA ngày 27/4/2012 của Bộ Công an quy định về khu dân cư, xã, phường, thị trấn, cơ quan, doanh nghiệp, nhà trường đạt tiêu chuẩn “An toàn về an ninh, trật tự”.

Điều 12. Trách nhiệm thi hành

1. Thủ trưởng Công an các cấp có trách nhiệm tham mưu với cấp ủy Đảng, chính quyền cùng cấp chỉ đạo, tổ chức thực hiện Thông tư này. Đồng thời, căn cứ chức năng, nhiệm vụ, quyền hạn, tổ chức triển khai thực hiện nghiêm túc trong lực lượng Công an nhân dân.

2. Cơ quan có thẩm quyền ra quyết định và cấp Giấy công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” cho từng đơn vị đạt tiêu chuẩn “An toàn về an ninh, trật tự” theo mẫu (có phụ lục kèm theo).

3. Cục Xây dựng phong trào bảo vệ an ninh Tổ quốc, Bộ Công an có trách nhiệm chủ trì, phối hợp với các đơn vị liên quan tham mưu, hướng dẫn, kiểm tra, đôn đốc việc thực hiện Thông tư này.

Quá trình tổ chức thực hiện nếu có khó khăn, vướng mắc, Công an các đơn vị, địa phương và các cơ quan, tổ chức, cá nhân có liên quan báo cáo hoặc phản ánh về Bộ Công an (qua Cục Xây dựng phong trào bảo vệ an ninh Tổ quốc) để được hướng dẫn kịp thời./.

MẪU GIẤY CÔNG NHẬN KHU DÂN CƯ ĐẠT TIÊU CHUẨN “AN TOÀN VỀ AN NINH, TRẬT TỰ”

1. Hình thức: Hình chữ nhật, kích thước bằng khổ giấy A4 dài 297mm, rộng 210mm, kích thước bên ngoài đường diềm hoa văn dài 260mm, rộng 175mm; giấy trắng định lượng 150gram/m2. Đường diềm được trang trí bằng các họa tiết, không có hoa văn bốn góc bên ngoài đường diềm và khối hoa văn chuyển tiếp giữa quốc huy và đường diềm trang trí. Chính giữa phía trên là Quốc huy Nước Cộng hòa xã hội chủ nghĩa Việt Nam. Hình nền trắng;

2. Nội dung

(1) Dòng thứ nhất ghi Quốc hiệu: “CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” được trình bày bằng chữ in hoa, phông chữ “Times New Roman”, cỡ chữ 14, kiểu chữ đứng, đậm, mầu đen;

(2) Dòng thứ hai ghi tiêu ngữ: “Độc lập - Tự do - Hạnh phúc” được trình bày bằng chữ in thường, phông chữ “Times New Roman”, cỡ chữ 14, kiểu chữ đứng, đậm, mầu đen và ở liền phía dưới Quốc hiệu, chữ cái đầu của các cụm từ được viết hoa, giữa các cụm từ có gạch nối, có cách chữ, phía dưới có đường kẻ ngang, nét liền, độ dài bằng độ dài của dòng chữ;

(3) Dòng thứ ba ghi đơn vị có thẩm quyền ra quyết định công nhận, trình bày bằng chữ in hoa, phông chữ “Times New Roman”, cỡ chữ 18, kiểu chữ đứng, đậm, mầu đen;

(4) Dòng thứ tư ghi: “Công nhận”, phông chữ “Times New Roman”, chữ in hoa, cỡ chữ 34, kiểu chữ đứng, đậm, mầu đỏ;

(5) Dòng thứ năm ghi tên KHU DÂN CƯ được công nhận đạt tiêu chuẩn “An toàn về an ninh, trật tự” bằng chữ in thường, phông chữ “Times New Roman”, cỡ chữ căn chỉnh cho phù hợp, kiểu chữ đứng, đậm;

(6) Dòng thứ sáu ghi: Đạt tiêu chuẩn “An toàn về an ninh, trật tự” năm... bằng chữ in hoa, phông chữ “Times New Roman”, cỡ chữ, kiểu chữ đứng, đậm, màu đen;

(7) Góc bên phải: Dòng thứ nhất địa danh, ngày, tháng, năm bằng chữ in thường, phông chữ “Times New Roman”, cỡ chữ 13, kiểu chữ nghiêng, đậm, mầu đen; (8) Dòng thứ hai ghi chức vụ người có thẩm quyền công nhận đơn vị đạt tiêu chuẩn “An toàn về an ninh, trật tự" bằng chữ in hoa, phông chữ “Times New Roman”, cỡ chữ 13, kiểu chữ đứng, đậm, mầu đen; khoảng trống để ký tên, đóng dấu; (9) Dòng cuối cùng ghi tên người có thẩm quyền ra quyết định công nhận.

CIRCULAR

RESIDENTIAL AREAS, COMMUNES, WARDS, TOWNS, AGENCIES, ENTERPRISES, EDUCATIONAL INSTITUTIONS THAT MEET STANDARDS OF  “ORDER AND SECURITY"

Pursuant to Law on Promulgation of legislative documents dated June 22, 2015; the Law on amendments to some Articles of Law on Promulgation of legislative documents dated June 18, 2020;

Pursuant to the Law on People’s Public Security Force in 2018;

Pursuant to Decree No. 01/2018/ND-CP dated August 06, 2018 of Government on functions, tasks, powers, and organizational structure of the Ministry of Public Security of Vietnam;

At the request of Director General of the Department for Development of All People Protect National Security Movement of Ministry of Public Security;

The Minister of Public Security promulgates a Circular on residential areas, communes, wards, towns, agencies, enterprises, educational institutions that meet standards of  “order and security"

Chapter I

Article 1. Scope and regulated entities

1. Scope:

The Circular elaborates principles, criteria, procedures and power to considerate, approve and recognize residential areas, communes, wards, towns, agencies, enterprises, educational institutions that meet standards of  “order and security"

2. Regulated entities:

a) Residential areas, communes, wards, towns;

b) Agencies (except for military agencies and units), enterprises (except for small and micro enterprises), educational institutions (except for primary education institutions, preschools, kindergartens);

c) Other organizations and individuals relevant to consideration, approval and recognition of residential areas, communes, wards, towns, agencies, enterprises, educational institutions that meet standards of  “order and security”.

Article 2. Definitions

For the purposes of this Circular, the terms below are construed as follows:

2. “Agencies” include state agencies, state administrative agencies, public service providers, socio-political organizations, socio-professional organizations that have been established, have operated in accordance with regulations of competent authorities and have had the headquarters and the operating costs of which are covered by the state budget.

3. “Enterprise” refers to an organization with its own name, assets and transaction office. The enterprises have been established in accordance with law for the purpose of production and business.

4. “Educational institution” refers to an organization that carries out educational activities in the national education system. The educational institutions include schools and other educational institutions.

Article 3. Principles

1. The process of consideration, approval and recognition for achievement in standards of  “order and security” of residential areas, communes, wards, towns, agencies, enterprises, educational institutions in order to meet shall be conducted every year.

2. The process of consideration, approval and recognition shall ensure accuracy, publicity, democracy and legality.

3. The result of recognition is the basis for annual evaluation and commendation of the “all people protect national security” movement; consideration of commendation and recognition of titles relevant to security and order.

Chapter II

SPECIFIC PROVISIONS

The residential area will meet standards of  “order and security” if it fully meets the following criteria:

1. In the first quarter of each year, the Communist Party cell must make a resolution and the residential area shall apply for award of the “order and security” title; all households which are residing in the area register for participation in development of a residential area that meets standards of "order and security ".

2. The residential area shall effectively carry out the Communist Party’s policies and guidelines, state laws and regulations of the local authorities on assurance about security and order. 

3. The following issues shall not occur in the residential area:

a) Opposing the Communist Party and the Government and sabotaging the great national unity policies;

b) Causing obstruction in economic, cultural, social, security and national defense targets and works;

c) Disseminating and developing beliefs and religions against the law;

d) Taking advantage of beliefs, religions, ethic groups, disputes or lawsuits to complicate security and order;

dd) Carrying out secession activities, demanding independence;

g) Coercing, enticing, bribing and inciting other people to gather together to make complaints, disrupt security and public order, or taking advantage of complaints to disseminate information for opposition to the State; infringing upon the interests of the State; distorting, slandering, threatening or insulting reputation and honor of agencies, organizations and persons assigned to settle complaints and denunciations.

4. The residential area shall participate and cooperate in taking actions against crime, social evils and other violations, including:

a) Restraining and cutting down crimes, social evils and other violations compared to those of previous year;

b) Serious crimes or extremely serious crimes must not occur in the residential area (except for force majeure). Any crime shall be promptly discovered and reported to the competent authorities for handling and measures must be synchronously taken to mitigate consequences of the crime

c) The residential area shall prevent complicated gathering points that disturb social order and cases with social evils; effectively manage, educate and assist persons who are residing in the area according to regulations of the law;

d) The residential area shall prevent serious fire or explosion; fatal occupational injuries; serious incidents according to regulations of the law (except for force majeure).

5. The forces that participate in protection of security and order at the grassroots level shall be recognized for excellent performance of their tasks and none of them violates the law and is disciplined.

Article 5. Criteria for recognition of communes, wards and towns that meet standards of  “order and security”

The communes, wards and towns will meet standards of  “order and security” if they fully meets the following criteria:

2. Criteria specified in Clause 2, Clause 3, Clause 4 Article 4 of this Circular shall be satisfied;

Article 6. Criteria for recognition of agencies and enterprises that meet standards of  “order and security”

The agencies and enterprises will meet standards of  “order and security” if they fully meet the following criteria:

1. In the first quarter of each year, the Party organization shall make thematic resolution or integrate works of assurance about security and order in the annual resolution on leadership and direction (areas with the Party organization). The agencies and enterprises shall have plans on assurance about security and order and register for achievement in the standards of "order and security"; rules and regulations on protection of agencies and enterprises, protection of state secrets, protection of internal politics, labor safety, fire and explosion prevention and fighting and environmental protection in conformity with the actual situation and regulations of the law. All officials, public employees and employees shall be disseminated and thoroughly grasped the rules and regulations mentioned above and criteria for development of agencies and enterprises that meet standards “order and security”. At least one model of the “all people protect national security” movement at grassroots level operates effectively

2. The agencies and enterprises shall effectively carry out the Communist Party’s policies and guidelines, state laws and regulations, programs and plans for cooperation with the police forces (if any) and local regulations on assurance about security and order.

3. The following issues shall not occur in agencies and enterprises:

a) Disseminating and developing religions against the law;

b) Taking advantage of beliefs, religions, ethic groups, disputes or lawsuits to complicate security and order;

c) Coercing, enticing, bribing and inciting other people to gather together to make complaints, disrupt security and public order, or taking advantage of complaints to disseminate information for opposition to the State; infringing upon the interests of the State; distorting, slandering, threatening or insulting reputation and honor of agencies, organizations and persons assigned to settle complaints and denunciations.

dd) Serious crimes or extremely serious crimes must not occur in the agencies and enterprises (except for force majeure). Any crime shall be promptly discovered and reported to the competent authorities for handling and measures must be synchronously taken to mitigate consequences of the crime

e) Violating regulations on protection of state secrets;

g) Serious fire or explosion; fatal occupational injuries; serious incidents; violations against regulations on environment, food safety and hygiene that cause serious consequences according to regulations of the law (except for force majeure).

h) Officials, public employees and employees being disciplined by warning or more severe penalties for administrative violations against regulations on security and order or social evils.

4. The security forces of agencies and enterprises shall achieve the title of  “labour collective with good achievements" or shall be recognized for excellent performance of tasks or higher (for agencies and enterprises that are eligible to consider and confer emulation titles) and none of them are disciplined by warning or more severe penalties.

5. 70% of subordinate joints (departments, divisions, groups, teams, etc.) shall achieve the title of  “labour collective with good achievements" or shall be recognized for excellent performance of tasks or higher (for agencies and enterprises that are eligible to consider and confer emulation titles) and none of them are disciplined by warning or more severe penalties.

Article 7. Criteria for recognition of educational institutions that meet standards of  “order and security”

The educational institutions will meet standards of  “order and security” if they fully meets the following criteria:

1. In the first quarter of each year, the Party organization shall make thematic resolution or integrate works of assurance about security and order in the annual resolution on leadership and direction (areas with the Party organization). The educational institutions shall have plans on assurance about security and order and register for achievement in the standards of "order and security"; rules and regulations on protection of educational institutions, protection of internal politics, management and education for learners, fire and explosion prevention and fighting and environmental protection in conformity with the actual situation. All officials, public employees, employees, teachers and learners shall be disseminated and thoroughly grasped the rules and regulations mentioned above and criteria for development of educational institutions that meet standards “order and security”. At least one model of the “all people protect national security” movement at grassroots level operates effectively

3. The cases specified in points a, b, c, dd, e and g Clause 3 Article 6 of this Circular shall not occur in the educational institutions.

4. The educational institutions shall prevent school violence. None of officials, public employees, teachers, learners commits violations or social evils are disciplined by warning or more severe penalties.

5. The security forces of educational institutions shall achieve the title of  “labour collective with good achievements" or shall be recognized for excellent performance of tasks or higher (agencies and enterprises that are eligible to consider and confer emulation titles) and none of them are disciplined by warnings or more severe penalties.

6. 70% of subordinate joints (departments, divisions, groups, teams, etc.) shall achieve the title of  “labour collective with good achievements" or shall be recognized for excellent performance of tasks or higher (for educational institutions that are eligible to consider and confer emulation titles) and none of them are disciplined by warnings or more severe penalties.

Article 8. Time for assessment and the result of recognition of achievement in the standards of "order and security"

1. Whether the residential areas, communes, wards, towns, agencies, enterprises, educational institutions meet the standards of “order and security" or not shall depends on the fulfillment of the criteria for "order and security" specified in this Circular and other criteria of the People's Committees of provinces (if any).

2. Time for assessment

a) Residential areas: From November 01 of the previous year to October 31 of the following year;

b) Communes, wards, townships, agencies, enterprises and educational institutions: From November 16 of the previous year to November 15 of the following year.

1. Procedures

a) The head of the residential area shall take charge of the meeting with the Secretary of the CP cell, the representative of the Front Work Committee, the representatives of mass organizations (if any) and the representatives of polices at grassroots level to review and assess situations and results of the implementation of the standards of "order and security ", complete procedures and send application to the Standing Board of the Steering Committee for prevention of crime and social evils and development of the “all people protect national security” movement of communes, wards and towns (hereinafter referred to as “commune level”) to appraise, report and request the President of the People's Committee of commune to consider, approve and decide recognition of residential areas that meet the standards of  "security and order " before November 15 every year;

b) The Standing Board of the Steering Committee for prevention of crime and social evils and development of the “all people protect national security” movement at commune level shall review and assess situations and results of the implementation of the development of communes, wards, towns that meet the standards of "order and security ", complete procedures and send application to the Standing Board of the Steering Committee for prevention of crime and social evils and development of the “all people protect national security” movement of communes, wards and towns of provinces (hereinafter referred to as “district level”) to appraise, report and request the President of the People's Committee of district to consider, approve and decide recognition of communes, wards and towns that meet the standards of  "security and order" before November 20^th every year;

c) The head of the agency, enterprise or educational institution shall take charge of the meeting with the representative of the Party Committee, the representatives of mass organizations, security forces (if any), the representatives of the polices at grassroots level, the representatives of agencies that have power to manage in order to review and assess situations and results of development of agencies, enterprises and educational institutions that meet the standards of  "security and order" and complete procedures, application and report to competent authorities (via the Standing Board of the Steering Committee for prevention of crime and social evils and development of the “all people protect national security” movement) to appraise, approve and decide recognition before November 20^th every year;

d) The Department for development of all people protect national security movement of the Ministry of Public Security shall appraise the application, report and request the Minister of Public Security to considerate and decide recognition of achievement in the standards of ”order and security" for agencies, enterprises and educational institutions subject to monitoring and guidance of the professional units of the Ministry of Public Security on assurance about the security and order and development of the “all people protect national security” movement before November 20 every year.

2. Application for registration and recognition of achievement in the standards of “order and security”

Article 10. Power to consider, approve and decide recognition of fulfillment of "order and security" standards

1. The People's Committee of commune shall consider, approve and issue decision on recognition and grant Certificate of Fulfillment of "Order and Security " Standards to residential areas, agencies, enterprises and educational institutions under their competence or management.

2. The People's Committee of district shall consider, approve and issue decision on recognition and grant Certificate of Fulfillment of "Order and Security " Standards to communes, wards, towns, agencies, enterprises, and educational institutions under their competence or management.

3. The People's Committee of province shall consider, approve and issue decision on recognition and grant Certificate of Fulfillment of "Order and Security " Standards to agencies, enterprises and educational institutions under their competence or management.

5. According to specific conditions of each area, the superior People's Committee may authorize the inferior People's Committee (a lower level) to consider and recognize achievement in the standards of "order and security " for agencies, enterprises and educational institutions within the areas.

Chapter III

IMPLEMENTATION

Article 11: Entry into force

This Circular takes effect from February 10, 2022 and replaces Circular No. 23/2012/TT-BCA dated April 27, 2012 of the Ministry of Public Security on residential areas, communes, wards, towns, organizations, enterprises and schools that meet the standards of “order and security”

Article 12. Responsibility of implementation

1. The Chiefs of polices at all levels shall be responsible for advising the Party Committee and authorities at the same level to direct and organize the implementation of this Circular. At the same time, according to their functions, tasks and powers, strictly implement this Circular in the People's Public Security Force.

2. The competent authority shall issue a decision and grant Certificate of Fulfillment of "Order and Security " Standards to each unit that meets the standards according to the form (attached to Appendix).

3. The Department for development of all people protect national security movement of the Ministry of Public Security shall take charge and cooperate with relevant units in advising, guiding, inspecting and urging the implementation of this Circular.
