CIRCULAR
ELABORATING
THE LIST OF GOODS TRADED AND EXCHANGED BY BORDER RESIDENTS
The Circular No. 02/2018/TT-BCT dated February 27,
2018 of the Minister of Industry and Trade elaborating the List of goods traded
and exchanged by border residents, which has been effective since February 27,
2018, is amended by:
1. The Circular No. 42/2019/TT-BCT dated December
18, 2019 of the Minister of Industry and Trade on amendments to some
regulations on periodic reporting regimes promulgated or jointly promulgated by
the Minister of Industry and Trade, which has been effective since February 05,
2020.
2. The Circular No. 34/2025/TT-BCT dated June 02,
2025 of the Minister of Industry and Trade on amendments to certain Articles of
the Circular No. 02/2018/TT-BCT dated February 27, 2018 of the Minister of
Industry and Trade elaborating the List of goods traded and exchanged by border
residents, which has been effective since July 21, 2025.

Article 1. Scope
The Circular elaborates the List of goods traded
and exchanged by border residents as prescribed in clause 2 Article 12 of the
Government’s Decree No. 14/2018/ND-CP dated January 23, 2018 elaborating upon
border trade activities.
Article 2. Regulated entities
1. [2] Border residents trading and exchanging
goods across border specified in clause 1 Article 1 of the Decree No.
122/2024/ND-CP.
2. Agencies and organizations managing and
administering border trade activities.
3. Other agencies, organizations and individuals
involved in border trade activities.
Article 3. Goods traded and
exchanged across border by border residents [3]
1. Goods exported in the form of trading and
exchange by border residents shall comply with applicable laws.
2. Goods imported in the form of trading and
exchange by border residents are specified in the Appendix to this Circular.

4. In case it is needed to ensure food safety and
prevent cross-border diseases, the Ministry of Industry and Trade shall, after
discussing with related ministries and central authorities, decide to suspend
the import of several goods on the List of goods traded and exchanged by border
residents promulgated under clause 2 of this Article in each locality for a
specific period of time.
Article 4. Organizing
implementation
1. The Ministry of Public Security shall:
Instruct agencies, organizations and individuals
concerned in the implementation of regulations set out under this Circular and
inspect their implementation.
2. Every People’s Committee of border province
shall:
a) Direct the Department of Industry and Trade to
preside over and cooperate with agencies concerned in organizing the
implementation of this Circular and with related agencies in provinces in
formulating a mechanism for cooperation on management of trading and exchange
of goods of border residents in the province.
b) [4]Assign
the Department of Industry and Trade to preside over and cooperate with
relevant agencies of the province to implement the information provision regime
and send a written periodic report to the Ministry of Industry and Trade (the
Agency of Foreign Trade) via postal service before every 20th and
send ad hoc reports upon request. Statistical forms attached to the periodic
report on the trading and exchange of goods by border residents are provided in
the Appendix II to this Circular.
Article 5. Effect [5]
1. This Circular comes into force from the day on
which it is signed.

3. Any difficulties or issues that arise during the
implementation should be reported in writing to the Ministry of Industry and
Trade (the Agency of Foreign Trade) for resolution./.

The Government’s Decree No. 122/2024/ND-CP dated
October 04, 2024 on amendments to some Articles of the Decree No.
14/2018/ND-CP;
At the request of the Director General of the
Agency of Foreign Trade;
The Minister of Industry and Trade hereby
promulgates a Circular on amendments to certain Articles of the Circular No.
02/2018/TT-BCT dated February 27, 2018 of the Minister of Industry and Trade
elaborating the List of goods traded and exchanged by border residents.”

This clause is amended by clause 1 Article 1 of the Circular No. 34/2025/TT-BCT
on amendments to certain Articles of the Circular No. 02/2018/TT-BCT dated
February 27, 2018 of the Minister of Industry and Trade elaborating the List of
goods traded and exchanged by border residents, which has been effective since
July 21, 2025.

This clause is amended by clause 2 Article 1 of the Circular No. 34/2025/TT-BCT
on amendments to certain Articles of the Circular No. 02/2018/TT-BCT dated
February 27, 2018 of the Minister of Industry and Trade elaborating the List of
goods traded and exchanged by border residents, which has been effective since July
21, 2025.

This clause is amended by Article 24 of the Circular No. 42/2019/TT-BCT on
amendments to some regulations on periodic reporting regimes promulgated or
jointly promulgated by the Minister of Industry and Trade, which has been
effective since February 05, 2020.

stipulates that:
“Article 37. Effect
1. This Circular comes into force from February

34/2025/TT-BCT on amendments to certain Articles of the Circular No.
02/2018/TT-BCT dated February 27, 2018 of the Minister of Industry and Trade
elaborating the List of goods traded and exchanged by border residents, which
has been effective since July 21, 2025.
