DECREE
ELABORATING ON TRADING IN CIVIL CRYPTOGRAPHY PRODUCTS AND SERVICES,
AND EXPORT AND IMPORT OF CIVIL CRYPTOGRAPHY PRODUCTS
The Government’s Decree
No. 58/2016/ND-CP dated July 01, 2016 elaborating on trading in civil
cryptography products and services, and export and import of civil cryptography
products, which has been effective since July 01, 2016, is amended by:
The Government’s Decree
No. 53/2018/ND-CP dated April 16, 2018 on amendments to the Government’s Decree
No. 58/2016/ND-CP dated July 01, 2016 elaborating on trading in civil
cryptography products and services, and export and import of civil cryptography
products, which has been effective since April 16, 2018.
The Government’s Decree
No. 32/2023/ND-CP dated June 09, 2023 on amendments to the Government’s Decree
No. 53/2018/ND-CP dated April 16, 2018 on amendments to the
Government’s Decree No. 58/2016/ND-CP dated July 01, 2016 elaborating
on trading of civil cryptography products and services, and export and import
of civil cryptography products, which has been effective since June 09, 2023.

The Government hereby
promulgates a Decree elaborating on trading of civil cryptography products and
services, and export and import of civil cryptography products.1
Chapter I
GENERAL
Article 1. Scope
This Decree elaborates
trading in civil cryptography products and services, and export and import of
civil cryptography products; defines the list of civil cryptography products
and services and the list of civil cryptography products imported and exported
under license; regulates the inspection, examination and imposition of
penalties for administrative violations in the field of civil cryptography.
Article 2. Regulated
entities
1. Traders of civil
cryptography products and services, importers and exporters of civil cryptography
products and related organizations and individuals.
2. Organizations and
persons committing administrative violations in relation to civil cryptography;
individuals competent to make written records of and impose penalties for
administrative violations related to civil cryptography, and related
organizations and individuals.

Article 3. List of
civil cryptography products and services, List of civil cryptography products
exported and imported under license
The List of civil
cryptography products and services in the Appendix I and the List of civil
cryptography products exported and imported under license in the Appendix II
are promulgated together with this Decree2.
Article 4. Conditions
for licensing of trading in civil cryptography products and services
1. An enterprise shall be
issued with a license to trade in civil cryptography products and services upon
their fulfillment of the conditions defined in clause 2 Article 31 of the Law
on Cyberinformation Security.
2. The licensing
conditions as stated in point a clause 2 Article 31 of the Law on
Cyberinformation Security are that: The enterprise has to employ at least 02
technicians who possess at least a bachelor’s degree in electronics -
telecommunications, information technology, mathematics or information security;
the managerial personnel of the enterprise have graduated in electronics -
telecommunications, information technology, mathematics, information security
or other discipline with a training certificate in information security.
3. The licensing conditions
as stated in point dd clause 2 Article 31 of the Law on Cyberinformation
Security are that the enterprise must possess a customer and technical service
system pertinent to its business scope, target customers and product
range.
Article 5. Procedures for
issuance, amendment, re-issuance and extension of a license to trade in civil
cryptography products and services
1. A license to trade in
civil cryptography products and services shall be issued, amended, re-issued
and extended according to Article 32 and Article 33 of the Law on
Cyberinformation Security.
2. Corporate applicants
for issuance, amendment, re-issuance or extension of a license to trade in
civil cryptography products or services shall submit their applications to the
Government Cipher Committee in person, by post or via online public service
portal provided publicly by the Department of Civil Cryptography Management and
Cryptographic Product Testing, phone/facsimile number: 04-3775.6896,

Article 6. Procedures
for issuing a license to export or import civil cryptography products
1. The licensing of
export or import of civil cryptography products is subject to Article 34 of the
Law on Cyberinformation Security.
2. Corporate applicants
for a license to export or import civil cryptography products shall submit
documents to the Government Cipher Committee in person, by post or via online
public service portal provided publicly by the Department of Civil Cryptography
Management and Civil Cryptography Product Testing as mentioned in clause 2
Article 5 of this Decree.
3. Forms No. 04 and 05,
as enclosed with Appendix III to this Decree, are promulgated for use in the
application for issuance of the license to export or import civil cryptography
products.
Chapter III
INSPECTION, EXAMINATION AND IMPOSITION OF
PENALTIES
Article 7. Inspection,
examination
1. The Government Cipher
Committee shall preside over and cooperate with relevant ministries, central
authorities and local authorities to conduct inspections and examinations of
the trading in civil cryptography products and services and the use of civil
cryptography products.
2. Traders of civil
cryptography products and services and users of civil cryptography products
shall accord the inspections and examinations by competent regulatory
authorities as per the laws on inspection.

1. A fine ranging from
VND 10,000,000 to VND 20,000,000 shall be imposed for any of the following
acts:
a) Purchasing, selling,
transferring, leasing or lending the license to trade in civil cryptography
products and services or the license to export or import cryptography products;
b) Erasing or altering
the print on the license to trade in civil cryptography products and services
or the license to export or import cryptography products;
c) Failing to follow
procedures for applying for amendment upon changes of names, legal representative
or civil cryptography products or services;
d) Failing to follow
procedures for applying for re-issuance of a license lost or ruined;
dd) Fail to report or
delaying reporting to the Government Cipher Committee on the trading in civil
cryptography products and services; export or import of civil cryptography
products or the summarized information of customers;
e) Using civil
cryptography products not provided by an enterprise licensed to trade in civil
cryptography products without reporting to the Government Cipher Committee;
g) Failing to create,
retain and secure the information on customers, names, types, quantity and uses
of civil cryptography products and services.
2. A fine ranging from
VND 20,000,000 to VND 30,000,000 shall be imposed for business activities that
contravene the license to trade in civil cryptography products and services or
the license to export or import civil cryptography products.

a) Trading in civil
cryptography products and services, export or import of civil cryptography
products without a license to trade in civil cryptography products and services
or a license to export or import civil cryptography products; or trading in
civil cryptography products and services with an expired license;
b) Failing to suspend or
terminate the provision of civil cryptography products and services for
purposes of national defense, national security, social order or safety at the
request of competent regulatory authorities;
c) Failing to cooperate
with or enabling competent regulatory authorities to implement professional
measures upon requests;
d) Refusal to provide
essential information on cryptographic keys upon requests at the request of
competent regulatory authorities.
4. Additional penalties:
a) Suspend the license to
trade in civil cryptography products and services and the license to export or
import civil cryptography products in one (01) to three (03) months if any of
the violations defined in points a and b clauses 1 and 2 of this Article is
committed;
b) Confiscate exhibits or
instruments through which the violations specified in point c clauses 1 and 3
of this Article are committed.
Article 9. Authority
to impose penalties

d) Confiscate exhibits or
instruments that facilitate the administrative violations; however, the worth of
items seized shall not exceed the value of the fine as stated in point b of
this clause;
dd) Enforce remedial
measures.
3. Chairpersons of
district-level People's Committees are authorized to:

5. Police officers,
border guards, coast guards, customs officials and market surveillance
officials are authorized to impose penalties intra vires against
administrative violations concerning civil cryptography as defined in this
Decree, as per clauses 4, 5, 6, 7, Article 39, Article 40, Article 41, Article
42 and clause 4 Article 45 of the Law on Penalties for Administrative
Violations No. 15/2012/QH13 dated June 20, 2012.
Article 10. Authority
to record administrative violations in writing
Individuals holding
titles as defined in Article 9 of this Decree and civil cryptography officials
on duty are authorized to make written records of administrative violations as
per regulations.
Chapter IV
IMPLEMENTATION CLAUSE3
Article 11.
Transitional clauses
1. Corporate traders of
civil cryptography producers and services, licensed under the Government's
Decree No. 73/2007/ND-CP dated May 08, 2007 on research, manufacture,
trading and use of cryptographic items for securing information not deemed as
state secrets, are be required to re-apply for another trading license,
provided that their current license is still valid. The enterprises must apply
for licensing as per this Decree at least 30 days prior to the expiry date of
the license.
2. Enterprises requiring
but having not a license to trade in civil cryptography products or services or
to export or import civil cryptography products must apply for licensing as per
this Decree.

Article 13.
Responsibility for implementation
Ministers, Heads of
ministerial agencies, Heads of governmental agencies and Chairpersons of
provincial People's Committees are responsible for the implementation of this
Decree./.

2 The Appendix II - List of civil cryptography
products exported and imported under license enclosed with the Government’s
Decree No. 53/2018/ND-CP is replaced by the Government’s Decree No.
32/2023/ND-CP coming into force from June 09, 2023 according to Article 1 of
the Decree No. 32/2023/ND-CP.
3 Articles 3, 4 and 5 of the Government’s Decree
No. 53/2018/ND-CP on amendments to the Government’s Decree No. 58/2016/ND-CP
dated July 01, 2016 elaborating on trading of civil cryptography products and
services, and export and import of civil cryptography products, which has been
effective since April 16, 2018, stipulate that:
“Article 3.
Transitional clauses
The licenses to export
and import civil cryptography products whose names match those defined in
Vietnam's Nomenclature of exports and imports issued to enterprises shall remain
effective. The customs authority shall rely on the issued license to import and
export civil cryptography products and actual status of exports and imports to
determine HS codes and initiate customs clearance procedures.

Responsibility for implementation
Ministers, heads of
ministerial agencies, heads of Governmental agencies, Chairpersons of People's
Committees of provinces and central-affiliated cities and relevant authorities
are responsible for the implementation of this Decree./.”

export/import civil cryptography product issued to an enterprise before the
effective date of this Decree shall remain valid for completion of customs
procedures until its expiry date if name of such product matches the
corresponding description of goods in Vietnam’s Nomenclature of exports and
imports. The customs authority shall rely on Vietnam’s Nomenclature of exports
and imports, issued license to export/import civil cryptography product and
actual status of the exports/imports to determine HS codes and initiate customs
clearance procedures in accordance with regulations.
Article 3.
Responsibility for implementation
Ministers, heads of
ministerial agencies, heads of Governmental agencies, Chairpersons of People's
Committees of provinces and central-affiliated cities, relevant organizations
and individuals are responsible for the implementation of this Decree./.”

products exported and imported under license enclosed with the Government’s
Decree No. 53/2018/ND-CP is replaced by the Government’s Decree No.
32/2023/ND-CP coming into force from June 09, 2023 according to Article 1 of
the Decree No. 32/2023/ND-CP.
