KẾ HOẠCH

TRIỂN KHAI NĂM CAO ĐIỂM THANH TRA, KIỂM TRA VẬT TƯ NÔNG NGHIỆP

I. MỤC ĐÍCH, YÊU CẦU

1. Mục đích:

- Ngăn chặn hiệu quả, tạo bước chuyển căn bản, tiến tới giải quyết dứt điểm các hành vi vi phạm về sản xuất, kinh doanh, sử dụng kháng sinh trong chăn nuôi, nuôi trồng thủy sản; thuốc bảo vệ thực vật, phân bón hữu cơ, phân bón khác là giả, kém chất lượng, nhập lậu không rõ nguồn gốc.

- Chấm dứt các hành vi vi phạm về chất cấm trong chăn nuôi.

- Nâng cao nhận thức của các tổ chức, cá nhân trong việc sản xuất, kinh doanh, sử dụng thức ăn chăn nuôi; kháng sinh trong chăn nuôi, nuôi trồng thủy sản; thuốc bảo vệ thực vật, phân bón hữu cơ, phân bón khác về mức độ nguy hại đối với sức khỏe người người dân, ảnh hưởng nghiêm trọng đến sản xuất nông nghiệp.

2. Yêu cầu:

- Phân công rõ trách nhiệm của các cơ quan, đơn vị có liên quan trong việc triển khai Kế hoạch đạt kết quả cao (Thanh tra Bộ, các Tổng cục, Cục; Cơ quan Công an; Sở Nông nghiệp và PTNT, các chi cục chuyên ngành thuộc Sở).

- Xây dựng cơ chế phối hợp mang tính hệ thống, chặt chẽ giữa các cơ quan, đơn vị chức năng ở Trung ương và địa phương trong tổ chức triển khai thực hiện Kế hoạch.

- Kịp thời đôn đốc, hướng dẫn và tháo gỡ những vướng mắc trong quá trình tổ chức thực hiện Kế hoạch.

- Tổ chức sơ kết, tổng kết, rút kinh nghiệm kịp thời, hiệu quả.

II. PHẠM VI, ĐỐI TƯỢNG THANH, KIỂM TRA VÀ THỜI GIAN THỰC HIỆN

1. Phạm vi:

- Vật tư nông nghiệp, trong đó tập trung vào sản xuất, kinh doanh, sử dụng chất cấm trong chăn nuôi; kháng sinh trong chăn nuôi, nuôi trồng thủy sản không đúng quy định; thuốc bảo vệ thực vật, phân bón hữu cơ, phân bón khác là giả, kém chất lượng, nhập lậu không rõ nguồn gốc

- Triển khai trên phạm vi toàn quốc (63 tỉnh, thành phố trực thuộc Trung ương), trong đó các cơ quan Trung ương tập trung triển khai trên các địa bàn trọng điểm để rút kinh nghiệm triển khai trên diện rộng.

2. Đối tượng:

- Các cá nhân, tổ chức sản xuất, kinh doanh thức ăn chăn nuôi; kháng sinh trong chăn nuôi, nuôi trồng thủy sản; thuốc bảo vệ thực vật, phân bón hữu cơ, phân bón khác thuộc phạm vi quản lý của ngành nông nghiệp và PTNT (sau đây gọi tắt là vật tư nông nghiệp);

- Các trang trại, gia trại chăn nuôi lợn, gà, cơ sở nuôi trồng thủy sản.

- Các cá nhân, tổ chức sản xuất, chế biến, kinh doanh động vật và sản phẩm động vật (bao gồm cả thủy sản).

- Các cá nhân, tổ chức nhập khẩu, vận chuyển, buôn bán chất cấm trong chăn nuôi; kháng sinh trong chăn nuôi, nuôi trồng thủy sản không đúng với quy định pháp luật.

3. Thời gian thực hiện:

Liên tục: Từ 01/3/2016 đến 31/12/2016

III. NỘI DUNG VÀ BIỆN PHÁP TIẾN HÀNH

1. Tuyên truyền, phổ biến pháp luật sâu rộng đến các cơ quan chức năng, cá nhân, tổ chức sản xuất, kinh doanh, sử dụng, buôn bán, vận chuyển, người tiêu dùng về tác hại, quyền, trách nhiệm theo Điều 190, 191, 195, 317 của Bộ Luật Hình sự năm 2015.

2. Tăng cường công tác quản lý nhà nước trong sản xuất, kinh doanh, sử dụng các loại vật tư nông nghiệp; sửa đổi, bổ sung các văn bản quy phạm pháp luật cho phù hợp với tình hình thực tế.

3. Thanh tra, kiểm tra tập trung chủ yếu dưới hình thức đột xuất, phát hiện và chấn chỉnh kịp thời cũng như xử lý nghiêm các hành vi vi phạm của các tổ chức, cá nhân nhằm nâng cao hiệu lực, hiệu quả của công tác quản lý nhà nước.

IV. TỔ CHỨC THỰC HIỆN

1. Nguồn lực:

- Bộ Nông nghiệp và Phát triển nông thôn bố trí nguồn kinh phí cho việc thực hiện các biện pháp nghiệp vụ và hoạt động thanh tra, kiểm tra do Thanh tra Bộ, các Tổng cục, Cục chủ trì, theo đó Vụ Tài chính rà soát và cân đối bổ sung nguồn kinh phí để các cơ quan, đơn vị Trung ương tổ chức triển khai Kế hoạch.

+ Các cơ quan, đơn vị được phân công có trách nhiệm huy động nguồn lực trong hệ thống để triển khai nội dung Kế hoạch theo phân công.

+ Các Tổng cục, Cục chuyên ngành đảm bảo kinh phí cho việc phân tích mẫu.

- Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương chỉ đạo các cơ quan chức năng bố trí nguồn kinh phí cho Sở Nông nghiệp và Phát triển nông thôn, các đơn vị liên quan cho việc thực hiện các biện pháp nghiệp vụ và hoạt động thanh tra, kiểm tra và một số hoạt động khác trong Kế hoạch này.

- Nguồn lực huy động khác của các dự án (nếu có).

2. Tổ chức thực hiện (có kế hoạch chi tiết kèm theo):

a) Các cơ quan thuộc Bộ Nông nghiệp và Phát triển nông thôn

- Các đơn vị chủ trì chịu trách nhiệm xây dựng Kế hoạch triển khai cụ thể để thực hiện Kế hoạch này.

- Thanh tra Bộ, Tổng cục Thủy sản, Cục Chăn nuôi, Cục Thú y, Cục Trồng trọt phối hợp với Cục Cảnh sát phòng chống tội phạm về môi trường (C49) tổ chức trinh sát, điều tra, thu thập thông tin, phát hiện đường dây, hành vi sản xuất, buôn bán và sử dụng chất cấm trong chăn nuôi; kháng sinh trong chăn nuôi, nuôi trồng thủy sản không đúng với quy định; thuốc bảo vệ thực vật, phân bón hữu cơ, phân bón khác là giả, kém chất lượng, nhập lậu không rõ nguồn gốc. Tổ chức các cuộc thanh tra, kiểm tra, xử lý nghiêm các hành vi vi phạm.

- Phối hợp với các sở, ban, ngành, đoàn thể đẩy mạnh công tác tuyên truyền trong nhân dân để không sử dụng chất cấm; tham gia phát hiện, tố giác, đấu tranh với những đối tượng cố ý sản xuất, kinh doanh buôn bán, sử dụng chất cấm; thuốc bảo vệ thực vật, phân bón hữu cơ, phân bón khác là giả, kém chất lượng, nhập lậu không rõ nguồn gốc.

- Sử dụng hiệu quả trang, mục và đường dây nóng của Thanh tra Bộ; thông tin kịp thời, chính xác, hiệu quả cho các cơ quan thông tấn, báo chí.

- Rà soát, tham mưu chỉnh sửa các văn bản quy phạm pháp luật để đáp ứng ngay yêu cầu, nhiệm vụ.

b) Sở Nông nghiệp và Phát triển nông thôn các tỉnh, thành phố

- Sở Nông nghiệp và Phát triển nông thôn chỉ đạo các đơn vị liên quan xây dựng Kế hoạch cụ thể để triển khai thực hiện Kế hoạch này.

- Phối hợp với Sở Công an, nòng cốt là Phòng Cảnh sát PCTP về môi trường (PC49) tổ chức trinh sát, điều tra, thu thập thông tin, phát hiện đường dây, hành vi sản xuất, buôn bán và sử dụng chất cấm trong chăn nuôi; kháng sinh trong chăn nuôi, nuôi trồng thủy sản không đúng quy định; thuốc bảo vệ thực vật, phân bón hữu cơ, phân bón khác là giả, kém chất lượng, nhập lậu không rõ nguồn gốc. Tổ chức các cuộc thanh tra, kiểm tra, xử lý nghiêm các hành vi vi phạm.

- Ưu tiên bố trí nguồn lực, kinh phí để triển khai nhiệm vụ.

3. Chế độ thông tin, báo cáo:

- Các Sở Nông nghiệp và PTNT thường xuyên báo cáo Thanh tra Bộ kết quả đạt được cũng như phối hợp xử lý các tình huống vượt quá thẩm quyền.

- Thanh tra Bộ định kỳ hàng tháng tổng hợp báo cáo Bộ trưởng.

- Trong quá trình thực hiện, nếu gặp khó khăn, vướng mắc, báo cáo Bộ (qua Thanh tra Bộ) để giải quyết.

PLAN

THE PEAK YEAR FOR INSPECTION OF AGRICULTURAL MATERIALS

I. OBJECTIVES AND REQUIREMENTS

1. Objectives:

- Effectively prevent and facilitate the definite handling of violations against regulations on production, trading and use of antibiotics in breeding and aquaculture; pesticides, organic fertilizer and other fertilizers which are fake, smuggled or have poor quality or unclear origin.

- Prevent violations against regulations on banned substances used in breeding.

- Improve awareness of organizations and individuals of production, trading and use of cattle-feed, the harm of antibiotics used in breeding and aquaculture, pesticides, organic fertilizer and other fertilizers to human health, and impact of those on agricultural production.

- Establish a systematic and consistent cooperation mechanism between central and local sectorial agencies in organizing the implementation of the Plan.

- Expedite, instruct and resolve difficulties that arise during the implementation of this Plan.

- Partially and wholly sum up the implementation results of this Plan to get experience thereof in effective and timely manner.

II. SCOPE, INSPECTED ENTITEIS AND INSPECTION PERIOD

1. Scope:

- Carry out the inspection of agricultural materials, in which the inspection of the production, trading and use of banned substances in breeding; improper production of antibiotics used in breeding and aquaculture; fake or smuggled pesticides, organic fertilizer and other fertilizers or those with poor quality or unclear origin shall be focused on.

- This Plan shall be implemented nationwide (63 provinces or central-affiliated cities), in which, central-affiliated agencies shall focus on implementation of the Plan in key regions to learn experience from thereof for implementing in a large scale.

2. Entities:

- Producers and sellers of cattle-feed; antibiotics used in breeding and aquaculture; pesticides, organic fertilizer and other fertilizers under the competence of agriculture and rural development authority (hereinafter referred to as agricultural materials);

- Producers, processers and sellers of animals and animal by-products (including aquatic products).

- Importers, transporters and sellers of banned substances in breeding and antibiotics used in breeding and aquaculture inconsistently with prevailing laws.

3. Inspection period:

Uninterruptedly: From March 01, 2016 to December 31, 2016

III. INSPECTION CONTENTS AND MEASURES

1. Propagate and disseminate laws to sectorial authorities, producers, traders, users, transporters and consumers with respect to harms, rights and responsibilities as referred to in Articles 190, 191, 195, 317 of the Criminal Code in 2015.

2. Strengthen state management of production, trading and use of kinds of agricultural materials; make amendments and supplements to legislative documents according to actual situation.

3. Mainly conduct unscheduled inspection to discover and handle violations committed by entities in a timely manner in order to improve efficiency of state management task.

- Ministry of Agriculture and Rural Development shall provide funding to implement operational measures and inspection activities led by Ministry Inspectorate, general departments and departments. Accordingly, Financial Department shall check and grant additional funding to central-affiliated agencies and units to implement the Plan.

+ Assigned agencies and units shall be responsible for mobilizing internal resources to implement assigned contents of the Plan.

+ Sectorial general departments/departments shall cover expenditures for sampling and analysis.

- People’s committees of central-affiliated cities or provinces shall instruct sectorial agencies to provide funding to departments of agriculture and rural development and relevant units to implement operational measures and inspection activities, and other activities included in this Plan.

- Other resources mobilized from projects (if any).

2. Implementation (detailed plan enclosed hereto):

a) Affiliates of Ministry of Agriculture and Rural Development

- Agencies in charge of formulating the Plan must develop it in detailed for implementation.

- Ministry’s inspectorate, Directorate of Fisheries, the Department of Livestock production, Department of Animal Health and Department of Crop Production shall cooperate with the Police Department for environment-related crime prevention and control (C49) to make reconnaissance, investigation and collection of information to discover rings, production, trading and use of banned substances in breeding, and antibiotics in breeding and aquaculture inconsistently with the laws; fake or smuggled pesticides, organic fertilizer and other fertilizers or those with poor quality or unclear origin. Inspections shall be conducted to discover and strictly handle acts of violation.

- Use portal, articles and hotlines of the Ministry Inspectorate in an effective manner; provide accurate information to news and press agencies in a timely and effective way.

- Check and propose in-charge authorities to make amendments to legislative documents to meet and fulfill requirements and duties.

b) Departments of Agriculture and Rural Development of provinces or cities

- Departments of Agriculture and Rural Development shall instruct relevant units to set up detailed plans in implementation of this Plan.

- Coordinate with relevant departments/regulatory bodies/unions to strengthen propaganda activities to people to avoid using banned substances; discover, denounce and combat against entities that deliberately produce, trade and use banned substances, fake or smuggled pesticides, organic fertilizer and other fertilizers or those with poor quality or unclear origin.

- Coordinate with police departments, especially the Police Department for environment-related crime prevention and control (PC49), to make reconnaissance, investigation and collection of information to discover rings, production, trading and use of banned substances in breeding, and antibiotics in breeding and aquaculture inconsistently with the laws; fake or smuggled pesticides, organic fertilizer and other fertilizers or those with poor quality or unclear origin. Inspection shall be conducted to discover and strictly handle acts of violation.

- Arrange resources and provide funding to implement assigned duties.

3. Information provision and reporting:

- Departments of agriculture and rural development shall, on a regular basis, report to the Ministry Inspectorate of the Plan implementation results, and coordinate with the same to handle cases ultra vires.

- Difficulties that arise during the implementation of this Plan should be reported to the Ministry (via the Ministry Inspectorate) for consideration.
