LIST OF POTENTIALLY UNSAFE COMMODITIES UNDER THE MANAGEMENT
OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS
Pursuant to the Law on Product
and Goods Quality dated November 21, 2007;
Pursuant to the Law on Technical
Regulations and Standards dated June 29, 2006;
Pursuant to the Law on Radio
Frequencies dated November 23, 2009; the Law on Amendments to the Law on Radio
Frequencies dated November 09, 2022;
Pursuant to the Law on
Information Technology dated June 29, 2006;
Pursuant to the Government's
Decree No. 132/2008/ND-CP dated December 31, 2008 elaborating some of articles
of the Law on Product and Goods Quality, Decree No. 74/2018/ND-CP dated May 15,
2018 on amendments to Decree No. 132/2008/ND-CP.
Pursuant to the Government's
Decree No.154/2018/ND-CP dated November 09, 2018 on amendments to and annulment

Pursuant to the Government’s
Decree No. 48/2022/ND-CP dated July 26, 2022 on functions, tasks, powers and
organizational structure of the Ministry of Information and Communications;
At the request of the Director
of Science and Technology Department,
The Minister of Information And
Communications promulgates the List of potentially unsafe commodities under the
management of the Ministry of Information and Communications.
Article 1.
Scope
1. This Circular provides for the
list of potentially unsafe commodities under the management of the Ministry of
Information and Communications (hereinafter referred to as “the List of
category 2 commodities”); rules for management of category 2 commodities; some
cases of suspension and optional application of part/all of certain technical
regulations.
2. This Circular only applies to
commodities whose HS codes and descriptions are provided in the List of
category 2 commodities.
Article 2.
Regulated entities
This Circular applies to:
1. Organizations and individuals
involved in production and sale of commodities on the List of category 2
commodities in Vietnam.

Article 3. List
of category 2 commodities
List of category 2 commodities and
measures for management thereof:
1. The list of information
technology and communications commodities subject to certification and
declaration of conformity is provided in the Appendix I hereof.
2. The list of information
technology and communications commodities subject to declaration of conformity
is provided in the Appendix II hereof.
Article 4. Rules
for management of category 2 commodities
1. Quality of commodities on the
List of category 2 commodities shall be managed in accordance with regulations
of the Ministry of Information and Communications on certification and
declaration of conformity and inspection of quality of information technology
and communications commodities, and respective technical regulations.
2. If an integral part of a
commodity on the List of category 2 commodities is another commodity on the
same List, it is required to certify and declare its conformity with all
technical regulations applicable to both commodities.
3. Commodities on the List of
category 2 commodities that are governed by two or more national technical
regulations, certification and declaration of their conformity shall be carried
out according to such technical regulations.
4. In case of discrepancies between
regulations of a technical regulation that is promulgated before the effective
date of this Circular and regulations of this Circular, regulations of this
Circular shall prevail.

Article 5. Some
cases of exemption of category 2 commodities from certification and declaration
of conformity
1. If a commodity specified in
section 1 or section 2 of Appendix II hereof has an integrated short-range
radio device in section 2 of Appendix I or section 4 of Appendix II hereof and
does not have integrated other radio transceivers, it shall be exempted from
certification and declaration of conformity if all of the following
requirements are satisfied:
a) It is imported for internal used
by the importer;
b) The import quantity does not
exceed 03 products per category in the shipment;
c) Its frequency band and
specifications meet the technical conditions and operational conditions as set
out in Circular No. 08/2021/TT-BTTTT dated October 14, 2021 of the Minister of
Information and Communications on the List of radio equipment which is exempt
from a radio frequency license, with technical and operational conditions
attached.
2. A commodity specified in section
1 or section 2 of Appendix II hereof shall be exempted from certification and
declaration of conformity with QCVN 101:2020/BTTTT, QCVN 132:2022/BTTTT, and
the part of technical regulations that require destructive testing if all of
the following requirements are satisfied:
a) The import quantity does not
exceed 03 products per category in the shipment;
b) The importer has a written
declaration that the commodities comply with part/all of technical regulations
that require destructive testing and to take total responsibility for the
safety of the imported commodities.
3. The exemption of the commodities
specified in Clause 1 and Clause 2 of this Article from certification and
declaration of conformity shall comply with Point c Clause 2 Article 16 of
Circular No. 30/2011/TT-BTTTT dated October 31, 2011, which is amended by
Circular No. 15/2018/TT-BTTTT dated November 15, 2018 and Circular No.
10/2020/TT-BTTTT dated May 07, 2020 of the Minister of Information And
Communications.

1. Some cases of suspension,
optional application of part/all of certain technical regulations until the end
of June 30, 2025 are specified in Appendix I and Appendix II hereof.
2. From the effective date of this
Circular until the end of June 30, 2025, it is recommended to carry out
certification and declaration of conformity of the commodities of Clause 1 of
this Article with all respective technical regulations.
3. From July 01, 2025, if the
commodities specified in Clause 1 of this Article continue to be manufactured
or imported after having undergone certification and declaration of conformity
during the period from July 15, 2023 to the end of June 30, 2025, they must
undergo supplementary certification and declaration of conformity with
respective technical regulations, or undergo new certification and declaration
of conformity with respective technical regulations.
Article 7.
Effect
1. This Circular comes into force
from May 15, 2024.
2. Circular No. 04/2023/TT-BTTTT
dated May 31, 2023 of the Minister of Information And Communications
on the List of potentially unsafe commodities under the management of the
Ministry of Information and Communications and Circular No. 10/2023/TT-BTTTT
dated September 05, 2023 of the Minister of Information And Communications on suspension
of part/all of certain technical regulations in Circular No. 04/2023/TT-BTTTT
dated May 31, 2023 of the Minister of Information And Communications cease to
have effect from the effective date of this Circular.
Article 8.
Transition clauses
1. Unexpired certificates of
conformity, notifications of receipt of declaration of conformity that are
issued to commodities specified in Clause 1 Article 6 of this Circular during
the period from July 15, 2023 to before the effective date of this Circular may
to be used until their expiration dates written therein.
2. Importers may choose to complete
their declarations of conformity and apply for quality inspection of imported
goods during the period from January 01, 2024 to before the effective date of
this Circular regarding technical regulations in Circular No. 04/2023/TT-BTTTT
dated May 31, 2023 and Circular No. 10/2023/TT-BTTTT, or the technical
regulations specified in Clause 1 Article 6 of this Circular.

1. Chief of Office, Director of
Department of Science and Technology, heads of affiliates of the Ministry of
Information and Communications and relevant organizations and individuals are
responsible for the implementation of this Circular.
2. During the implementation of
this Circular, organizations and individuals have the responsibility to
promptly report the issues that occur and follow the guidelines laid down by
the Department of Science and Technology (affiliated to the Ministry of
Information and Communications).
3. The Ministry of Information and
Communications shall cooperate with the General Department of Vietnam Customs
(affiliated to the Ministry of Finance) in resolving any issue that arises from
assigning HS codes to imports that are potentially unsafe commodities within
the scope of this Circular./.

Regarding these technical regulations, the certification of conformity of the
commodities herein is optional but the declaration of conformity thereof is
compulsory.
(2)
Upon application of QCVN 47:2015/BTTTT, in addition to the requirements
enshrined in QCVN 47:2015/BTTTT, the commodities shall comply with Vietnam’s
radio frequency planning.
(3)
These types of commodities are not applicable to explosion-proof communication
equipment.
(4)
Short-range radio equipment in this section excludes receive-only radio
equipment; wideband data transmission equipment operating in the 2,4 GHz band
and having an equivalent isotropically radiated power of less than 60 mW; radio access equipment operating in the 5 GHz band and
having an equivalent isotropically radiated power of less than 60 mW. It is
only necessary to certify and declare conformity if the equipment meets the
prescribed frequency band, technical conditions and operational conditions as
set out in the Circular No. 08/2021/TT-BTTTT dated October 14, 2021 of the
Minister of Information and Communications.
Conformity
of wideband data transmission equipment and stand-alone radio access equipment
operating in one or more bands that support the 6 GHz band (5,925 GHz to 7,125
GHz) (hereinafter referred to as “Wi-Fi 6E and Wi-Fi 7 equipment”) shall only
be certified and declared provided that the manufacturer of Wi-Fi 6E and Wi-Fi
7 equipment has a written commitment confirming that the 6 GHz band has been
disabled and the user cannot activate or use this band without the
manufacturer's support.
Conformity
of equipment integrated with functions of Wi-Fi 6E and Wi-Fi 7 equipment shall
only be certified and declared provided that the manufacturer of Wi-Fi 6E and
Wi-Fi 7 equipment has a written commitment confirming that the 6 GHz band has
been disabled and the user cannot activate or use this band without the
manufacturer's support.
(5) It
is only necessary to certify and declare conformity if the equipment meets the
prescribed frequency band, technical conditions and operational conditions as
set out in the Circular No. 08/2021/TT-BTTTT dated October 14, 2021 of the
Minister of Information and Communications on List of radio equipment which is
exempt from a radio frequency license, with technical and operational
conditions attached.
(6)
Organizations and enterprises that produce, import, distribute and use base
stations and repeaters shall undertake to strictly comply with the provisions
of law on management and use of radio frequencies.
(7)
For QCVN 117:2023/BTTTT, the requirements for
Total Radiated Sensitivity (TRS) of the receiver in Article 2.2.12
and Total Radiated Power (TRP) in Article 2.2.13 of this technical regulation
are yet to be applied.

isotropically radiated power of less than 60 mW. It is only necessary to
declare conformity if the equipment meets the prescribed frequency band,
technical conditions and operational conditions as set out in the Circular No.
08/2021/TT-BTTTT of the Minister of Information and Communications.

Conformity
of equipment integrated with functions of Wi-Fi 6E and Wi-Fi 7 equipment shall
only be declared provided that the manufacturer of Wi-Fi 6E and Wi-Fi 7
equipment has a written commitment confirming that the 6 GHz band has been
disabled and the user cannot activate or use this band without the
manufacturer's support.
(5) It
is only necessary to declare conformity if the equipment meets the prescribed
frequency band, technical conditions and operational conditions as set out in
the Circular No. 08/2021/TT-BTTTT dated October 14, 2021 of the Minister of
Information and Communications on List of radio equipment which is exempt from
a radio frequency license, with technical and operational conditions attached.
(8)
For QCVN 101:2020/BTTTT, it is only compulsory to declare conformity of the
commodities herein with special safety requirements specified in Article 2.6 of
the Regulation.
(12)
It is not permitted to use measurement/test results given by any domestic or
foreign testing laboratory that has not been designated or recognized or given
by the manufacturer to assess the conformity with this technical regulation.
(13)
For QCVN 132:2022/BTTTT, where commodities use adapters, if the adapters are
attached, QCVN 132:2022/BTTTT shall be applied to test the commodities attached
with adapters; if the adapters are not attached, QCVN 132:2022/BTTTT shall be
applied to test the commodities not attached with adapters.
(14)
For QCVN 53:2017/BTTTT: the requirement for antenna in Article 2.3 of the
Technical Regulation is yet to be applied.
(15)
The electromagnetic compatibility requirements specified in this technical
regulation shall not apply.
