DECISION

LISTS OF SECTORS AND GREENHOUSE GAS EMITTING FACILITIES REQUIRED TO DEVELOP GREENHOUSE GAS INVENTORY (UPDATED)

Pursuant to the Law on Government Organization of Vietnam dated June 19, 2015; Law on amendments to some Articles of the Law on Government Organization of Vietnam and Law on Local Government Organization of Vietnam dated November 22, 2019;

Pursuant to the Law on Environmental Protection dated November 17, 2020;

Pursuant to the Government's Decree No. 06/2022/ND-CP dated January 07, 2022 on mitigation of GHG emissions and protection of ozone layer;

At the request of the Minister of Natural Resources and Environment;

The Prime Minister hereby promulgates Decision on lists of sectors and Greenhouse Gas emitting facilities required to develop Greenhouse Gas inventory (updated).

Article 1. Lists of sectors and Greenhouse Gas (GHG) emitting facilities required to develop Greenhouse Gas (GHG) inventory (updated)

2. List of GHG emitting facilities required to develop GHG inventory in the industry and trade sector specified in Appendix II;

3. List of GHG emitting facilities required to develop GHG inventory in the transport sector specified in Appendix III;

4. List of GHG emitting facilities required to develop GHG inventory in the construction sector specified in Appendix IV;

5. List of GHG emitting facilities required to develop GHG inventory in the natural resources and environment sector specified in Appendix V.

Article 2. Implementation

1. The GHG emitting facilities specified in Article 1 shall develop GHG inventory at internal level according to guidelines issued by the Ministry of Industry and Trade, the Ministry of Transport, the Ministry of Construction and the Ministry of Natural Resources and Environment; and submit their GHG inventory reports according to the Government’s Decree on mitigation of GHG emissions and protection of ozone layer.

2. People’s Committees of provinces and central-affiliated cities shall:

a) Direct relevant affiliated agencies to urge GHG emitting facilities located within their provinces and cities and included in the lists promulgated together with this Decision to develop GHG inventory according to regulations.

b) Update and adjust lists of GHG emitting facilities required to develop GHG inventory and located within their provinces and cities and submit the updated and adjusted lists to the Ministry of Natural Resources and Environment and relevant ministries that manage sectors according to regulations.

Article 3. Implementation clause

1. This Decision comes into force from October 01, 2024. The Decision No. 01/2022/QD-TTg dated January 18, 2022 of the Prime Minister shall cease to have effect from the effective date of this Decision.

2. GHG emitting facilities included in lists specified in the Decision No. 01/2022/QD-TTg but not included in lists specified in this Decision are not obliged to develop GHG inventory and submit GHG inventory reports at internal level in 2025.

3. Ministers, Heads of ministerial agencies, Heads of Governmental agencies and Presidents of People’s Committees of provinces and central-affiliated cities and legal representatives of facilities included in lists of GHG emitting facilities required to develop GHG inventory are responsible for the implementation of this Decision./.
