CIRCULAR

PROVIDING FOR EXPLORATION AND CLASSIFICATION OF RESERVES AND PRIMARY GOLD MINERAL RESOURCES

Pursuant to the Law on mineral resources No. 60/2010/QH12 dated 17 November 2010;

Pursuant to Decree No. 15/2012/ND-CP dated 09 March 2012 of the Government detailing a number of articles of the Law on mineral resources;

Pursuant to Decree No. 21/2013/ND-CP dated 04 March 2013 of the Government defining functions, duties, powers and organizational structure of the Ministry of Natural resources and Environment;

At the request of the Chief of Office of the national mineral reserves assessment Council and Director of Department of Legal Affairs;

The Minister of Natural resources and Environment issues the Circular providing for the exploration and classification of reserves and primary gold mineral resources.

Article 1. Scope of regulation

This Circular provides for the exploration and classification of reserves and primary gold mineral resources.

Article 2. Subjects of application

This Circular applies to the state management organs of mineral resources, organizations practicing mineral resources exploration, organizations and individuals implementing exploration and extraction of mineral resources and other organizations and individuals related to the activities of mineral resources.

Chapter II

NATURAL RESOURCES ASSESSMENT OF RESERVES AND NATURAL RESOURCES

Article 3. Reserves and natural resources classification

1. The primary gold mineral resources are divided into 02 groups:

a) Identified natural resources;

2. The group of identified natural resources is divided into 02 types: reserves and natural resources.

a) The type of reserves is divided into 03 levels: reserves level 111, reserves level 121 and reserves 122.

b) The type of natural resources is divided into 06 levels: natural resources level 211, 222, 331, 332 and 333.

3. The group of forecast natural is divided into 02 levels: natural resources level 334a and 334b.

4. The detailed natural resources and reserves classification table is specified in Annex 1 issued with this Circular.

Article 4. Requirements for assessment of reserves level 121

1. Geological assessment level:

a) Identifying the shape, size, bedded deposit, rule of change of form and structure inside primary gold ore body; delineating in detail the boundary of country rock layers, lenticle with or without ore not meeting the norm and the presence of faults resulted in ore shift;

b) Identifying the types of natural ore, industrial ore class with distinct properties of the mineral composition, structure, chemical composition, physico-mechanical properties and technological properties of ore;

d) Identifying the hydrogeological conditions and engineering geology, mine extraction conditions and other relevant natural factors assessed in detail to ensure the sufficient and reliable data supply to prepare the investment project for mineral extraction and mine design;

dd)The reliability of reserves must be at least 80%.

2. The delineated boundary for reserves calculation:

The reserves boundary level 121 is delineated within the controlled scope by other exploration works and (or) extraction works.

3. Assessment of feasibility regarding the techniques, technologies and economic efficiency:

a) The selection of rational technical solutions and ore exploration and processing technologies;

b) The reserves level is identifies with economic efficiency on the basis of reserves calculation criteria;

b) Division of types of natural ore and class of industrial ore based on the properties of the mineral composition, structure, chemical compositions, physico-mechanical properties and technological properties of ore;

c) The quality of primary gold ore is assessed in detail and the material composition, the physico-mechanical properties and technological properties of types of ore and the rational gold separation and selection diagram are clearly identified;

d) The hydrogeological properties and engineering geology and technical conditions for mine extraction as a basis for preparing the investment project for mineral extraction and mine design;

dd) The reliability of reserves must be at least 50%.

2. The delineated boundary for reserves calculation:

The reserves boundary level 122 is delineated within the controlled scope by other exploration works. For ore body with incomplex structure and relatively stable thickness and ore quality, the extrapolation is permitted with limit as per geological and geophysical materials but must not exceed a half of prescribed network.

3. The assessment of feasibility regarding the techniques, technologies and economic efficiency shall comply with the provisions specified in Clause 3, Article 4 of this Circular.

Article 6. Requirements for assessment of natural resource level 211

1. The level of geological assessment and boundary delineation for calculation of natural resources shall comply with the provisions in Clause 1 and 2, Article 4 of this Circular;

Article 7. Requirements for assessment of natural resource level 222

1. The requirements for geological assessment and boundary delineation for calculation of natural resources level 222 shall comply with the provisions in Clause 1 and 2, Article 5 of this Circular;

2. The requirements for assessment of feasibility regarding the techniques, technologies and economic efficiency shall comply with the provisions specified in Clause 3, Article 4 of this Circular. The natural resources level 222 is the one which has been explored but not met the reserves calculation criteria or lies in the area with prohibited or temporarily prohibited mineral activities.

Article 8. Requirements for assessment of natural resource level 333

1. Requirements for geological assessment :

a) Identifying basic lines on shape, bedded deposit and distribution of primary gold ore bodies;

b) Preliminarily identifying the thickness, structure and stability of primary gold ore bodies;

c) The quality of primary gold ore is preliminarily identified based on the result of sample taking in the natural outcrops, cleared works, trenches, wells or extrapolation as per the material of adjacent plot with more detailed geological assessment;

d) The natural factors deciding the conditions for mine extraction without required detailed assessment, mainly preliminarily known and similarly referred to adjacent areas with more detailed assessment;

2. Assessment of feasibility regarding the techniques, technologies and economic efficiency:

The extraction and processing of gold ore from such natural resources with economic efficiency or potential economic efficiency have not been identified at the time of assessment.

Chapter III

CLASSIFICATION OF MINE GROUP AND REQUIREMENTS FOR EXPLORATION TECHNIQUES

Article 9. Classification of mine group for exploration

1. Grounds for classification of mine group for exploration:

a) Based on the shape, size, bedded deposit of primary gold ore bodies, the stability of thickness and change of gold content and complexity of geological structure of ore;

b) Based on the quantitative indicators, the change of thickness, content of ore body and geological conditions for more extraction are assessed for classification of mine group for exploration;

c) Based on the arguments and specific assessment to the main primary gold ore body occupying more than 70% of mine reserve. The explored mine group estimated in the  mineral exploration project is identified in the Report on mineral exploration result.

a) Simple mine group(I);

b) Relatively complex mine group (II);

c) Complex mine group (III);

d) Very complex mine group (IV).

3. Conditions for classification of explored mine group

a) Simple mine group (I):

Including the mines or a part of mine with simple geological structure with vein-shaped ore bodies, horizontal or sloping large lenticle, ore bodies with simple shape; stable thickness of ore body, the coefficient of thickness change as per the works of no more than 40%; the content of main useful compositions evenly dispersed; the coefficient of content change as per the single sample not greater than 40% and the ore containing coefficient from 0.8-1.0;

b) Relatively complex mine group (II):

Including the mines or a part of mine from large to medium size with relatively complex geological structure with vein-shaped ore bodies and large lenticle vein; relatively stable to unstable thickness of ore body, the coefficient of thickness change as per the works from over 40% to 100%; the content of main useful compositions dispersed relatively even to uneven; the coefficient of content change as per the single sample over 40% to 100% and the ore containing coefficient from 0.7-0.8;

Including the mines or a part of mine from small to large size with complex geological structure with vein or seam-shaped ore bodies and lenticle vein, nest, cylinder; ore bodies with complex shape, unstable thickness, the coefficient of thickness change as per the works from 100-150%; the content of main useful compositions unevenly dispersed; the coefficient of content change as per the single sample from over 100% to 150% and the ore containing coefficient from 0.6-0.7;

d) Very complex mine group (IV):

Including the mines or a part of mine having very complex geological structure with ore bodies of small and very small size; shape of vein, vein network, lenticle vein, cylinder, nest…; ore bodies with very complex shape, particularly unstable thickness of ore body, the coefficient of thickness change as per the works of over 150%; the content of main useful compositions dispersed particularly unevenly; the coefficient of content change as per the single sample over 150% and the ore containing coefficient less than 0.6;

Article 10. General requirements for exploration

1. Performing exploration from general to detail, from the surface to the depth, from sparse to dense exploration network, measurement and drawing of geological map from small scale to large scale;

2. Collecting all information, data and materials of geology, hydrogeology, engineering geology, environmental geology and conditions for mine extraction in service of preparing the investment project for mineral extraction and mine design;

3. The order of exploration is done on the basis of consistency with the complexity level of geological structure, reserves scale and economic value of mine.

4. Performing the exploration in the entire area and existing depth of ore body within the boundary selected in the mineral exploration project.

2. For the exploration works and the angular closure point of exploration area, the coordinate and altitude must be identified and the contact should be made with the national coordinate network under current regulations on land surveying and geology.

3. The exploration area must use at least 02 national boundary points.

Article 12. Requirements for geological measurement and drawing

1. The measurement and drawing of geological map in primary gold exploration are done on the scale from 1/2.000 to 1/1.000, depending on the size of ore body and complexity of geological structure of mine.

2. The geological map must indicate the geological structure of mine, distribution properties of formation of magma, sediment, folds, broken faults, tectonics, variable rock zone, mineral zones, primary gold ore bodies in the mine; there are grounds for assessment of distribution properties, conditions for ore formulation, relation of mineralization with surrounding rock and main geological structure.

Article 13. Requirements for selection and arrangement of exploration works

1. Selection of exploration works:

a) In exploration of primary gold mineral, it is possible to select the excavation (trench, well, shaft) and drilling works. The exploration works selected must consist with the conditions of bedded deposit, distribution depth, geological structure, form, thickness of each ore body and covering layer;

b) At the works, the detailed samples must be taken to identify the quality and rule of distribution of types of ore, depth of weathering, wall and cylinder structure properties of ore body.

d) The drilling works must recover the highest drilling core. The rate of drilling core taking must not less than 70% with each round of drilling through rock and 85% through ore. To improve the reliability of drilling works, the methods of geophysical boreholes.

dd) For boreholes with depth over 100m, take measurement to check the deviation and sloping angle of borehole;

e) The ore bodies with large sloping angle, the method of oblique or horizontal drilling should be applied;

g) The exploration works must cut through the thickness of ore body.

2. Works arrangement and selection of exploration network density:

a) The works arrangement must ensure the comprehensive assessment of geological properties, form, size, bedded deposit condition, stability of thickness and quality of ore bodies;

b) The network of exploration works is specified in Annex 2 issued with this Circular;

c) The exploration, extraction works, natural and artificial outcrops in the exploration area must be described, measured and drew geological and formed with primary materials in a timely manner, completely and accurately under the current regulations on collection of primary materials in mineral exploration to be put on the practical material map.

2. The size of types of sample must be based on the properties of material composition distribution inside the ore body and ensure the highest reliability with complete assessment of main composition.

3. Principles of sample taking:

a) For works meeting ore, its samples must be taken continuously to ensure the grounds for delineate the boundary of ore body and streak layer. The length of channel sample is defined by the interior structure inside the ore body; the change of material composition; structure properties and physico-mechanical properties of ore;

b) The result of sample taking of each type must be shown in image;

c) The technological testing sample must be representative of the chemical composition, mineral composition, physico-mechanical properties, graininess and other properties suitable for the average composition of each type of ore, the main ore body in the mine ;

d) For large-weighted samples, it is required to take 03 samples for each natural type of ore. Take 03 small samples with each large-weighted sample for analysis, testing and comparison. The volume of large-weighted sample changes from 0.5 to 1m3. For solid ore body or with thin thickness to fail to take large-weighted sample, the ore weight is defined by the average value of small-weighted samples. Along with defining the small weight, the moisture content of the ore must also be defined.

Article 15. Requirements for sample processing

1. All of the samples shall be crushed to size of less than 1mm of grain. The next processing and shortening are done as per the processing diagram for each ore;

2. The sample processing quality must be tested systematically at stages and the compliance of sample processing diagram must also be inspected.

Article 16. Requirements for sample analysis

1. The result of sample analysis must identify the content and form of existence of main useful compositions and accompanied useful compositions (if any).

a) The content of Au and Ag in the primary gold ore is identified by the burning analysis or atomic absorption. The analysis is done under the current regulations;

b) The basic analytical sample must be analyzed for 02 compositions Au and Ag. The basic analysis is done for 100% number of samples taken at the exploration works. The harmful compositions and other compositions are identified under group sample at least equal to 10% of basic samples;

c) The group sample must be taken as representative for natural ore blocks or industrial ore classes. With group sample, in addition to composition of Au and Ag, the composition of Cu, As, Pb, Zn, Sb, WO3, S, Hg, Bi, Se, Te..should be also analysed.

d) The mineral composition, properties of structure, size of gold grains and other physical properties of ore must be studied by the petrographic, mineral, physical, chemical method and other forms of analysis;

dd) Study of technological samples:

The technological samples must studies in the laboratory and expanded laboratory. For types of ore which are new, difficult to select or with no experience in industrial production, there must be separate study programs;

The result of study of technological sample must assess the material composition of ore, defining the main technical-economic parameters of phases of gold grinding, separation, selection and recommend the rational diagram of grinding, separation, selection technology to recover the gold or silver metal.

1. The sample testing and analysis must be done regularly and systematically;

2. The control of quality of sample analysis result is done in accordance with Circular No. 62/2014/TT-BTNMT dated 09/12/2014 of the Minister of Natural Resources and Environment issuing the national technical Regulation on control of quality of analysis result of geological and mineral samples.

Article 18. Requirements for hydrogeological and engineering geological assessment

1. Requirements for hydrogeological assessment:

a) Collection of hydrogeological materials of the areas to be explored within the last 05 years;

b) The exploration result must assess the main aquifers which may flood mine, especially in the parts of mine with the most potential flooding to deal with the water drainage from mine.

c) For aquifers, it is required to define the thickness, petrographic composition, water supply conditions, relation between aquifers, surface water and underground water level and other relevant parameters;

d) It is necessary to study the chemical and biological compositions of water and assess the possibility of corrosion of concrete, metal, the useful and harmful compositions in water, effect of mine water drainage pumping to the works using underground water in the areas as well as the possibility of use of domestic water; recommend solutions related to the water supply and drainage and effect of mine drainage to the surrounding environment;

2. Requirements for engineering geological assessment

b) The exploration result must assess the durability of mine works and calculate the basic parameters of the mining pits and the stability of furnace;

c) All of the hydrogeological and engineering geological conditions and other natural factors should be assessed to meet the conditions for preparing the investment project for extraction and mine design. Where the hydrogeological and engineering geological conditions are complex and there must be a specialized assessment and survey plan. The hydrogeological and engineering geological assessment must comply with the current regulations;

Article 19. Requirements for environmental impact assessment

1. During the process of exploration, the data of environmental geology must be collected to forecast and assess main factor affecting the environment.

2. The geological hazards and negative impacts on environment caused by the primary gold ore exploration must be assessed and there should be the measures of prevention and reduction. The content and level of environmental impact assessment must be mentioned in the exploration projects.

Article 20. Requirements for assessment of technical conditions for mine extraction

1. Preliminarily assessing the boundary of mine site, sloping angle of bench face, sloping angle of pit, stripping ratio and rock and soil pressure in the wall and cylinder of ore body.

2. Assessing the areas not containing industrial gold ore as a basis for preparing investment project for mineral extraction and mine design;

2. The method of calculation of reserves and natural resources of primary gold ore must be selected consistently with structural properties of ore body in each mine. The specialized softwares are used with encouragement to calculate the reserves

3. The reserves and natural resources of gold ore that are calculated are the existing reserves in the ground, not taking account the loss upon extraction and processing and calculated in thousand ton unit for the ore reserves and kilogram unit for gold metal reserves.

4. The reserves and natural resources of primary gold ore are shown in the reserves calculation plan on the scale of /2,000 to 1/500, depending on scale and properties of ore body. The result of reserves calculation must be shown as per each ore body, reserves and natural resources level and the maximum height of 10m.

Article 22. Requirements for the highest reserves level and ratio between reserves levels

1. The highest reserves level for mine of group I and II to be explored is level 121; for mine of group III and IV, the highest reserves level for mine of group to be explored is level 122;

2. The ratio of reserves levels 121 and 122 shall be defined by the investor based on the geological properties of mine, financial ability, technical conditions for extraction and estimated extraction but must ensure the highest ratio of reserves over the total reserves of mine must not lower than 10% and must be shown in the exploration plan.

Article 23. Content and form of presentation of exploration result report

The content and form of presentation of exploration result report must comply with the Circular No. 16/2012/TT-BTNMT dated 29/11/2012 of the Minister of Natural Resources and Environment providing for the mineral exploration and mineral mine closing plan and form of mineral activity result report and form of document in the dossier for licensing the mineral activities, dossier for approving the mineral reserves and dossier for closing mineral mines.

Article 24. Effect

This Circular takes effect from 01/04/2015.

Article 25. Implementation organization

1. The office of national mineral reserves assessment Council and the General Department of Geology and Minerals of Vietnam are responsible for guiding, inspecting and implementing the provisions in this Circular.

2. Any problem or difficulty arising the implementation of this Circular should be promptly reported to the Ministry of Natural Resources and Environment for consideration and settlement./.
