CIRCULAR
ON THE MANAGEMENT OF
PRICES OF FERRY SERVICES FUNDED BY THE STATE BUDGET, UNDER CENTRAL MANAGEMENT
Pursuant to the Law on Prices dated June 19,
2023;
Pursuant to the Law on Roads dated June 27,
2024;
Pursuant to Decree No. 85/2024/ND-CP dated July
10, 2024 of the Government on elaboration of certain articles of the Law on
Prices;
Pursuant to Decree No. 56/2022/ND-CP dated
August 24, 2022 of the Government defining the functions, tasks, powers, and
organizational structure of the Ministry of Transport;
At the proposal of the Director of the Department
of Finance and the Director of the Vietnam Road Administration;
The Minister of Transport hereby issues this
Circular on the management of prices of ferry services funded by state budget,
under central management.

1. This Circular provides regulations on the
management of prices of ferry services funded by the state budget, under
central management.
2. This Circular applies to ferry terminal
management agencies, ferry service providers, and organizations or individuals
involved in managing ferry service prices for terminals funded by the state
budget, under central management.
Article 2. Subjects liable for ferry service
fees
Subjects required to pay for ferry service fees
include: pedestrians, passengers in vehicles, and operators of
rudimentary road vehicles, motor vehicles, and specialized motorcycles.
Article 3. Subjects exempt from ferry service
fees
1. Ambulances and vehicles transporting injured
persons to emergency care facilities.
2. Fire trucks operated by the Fire and Rescue
Police force or other firefighting units mobilized for fire extinguishing
missions, equipped with priority signals as prescribed by law.
3. Agricultural and forestry machinery, including
tractors, plows, tillers, weeders, and rice threshers.
4. Flood control vehicles or vehicles on urgent
missions for flood and storm prevention as mobilized by a competent authority.

6. Special-purpose vehicles operated by units
within the organizational system of the People’s Police, including:
a) Traffic patrol cars of the Traffic Police
featuring a rotating beacon light on the roof and the words “CANH SAT
GIAO THONG” (TRAFFIC POLICE) printed on both sides of the vehicle;
b) Police cars of Unit 113 with the words “CANH SAT
113” (POLICE 113) printed on both sides of the vehicle;
c) Riot police vehicles with the words “CANH SAT CO
DONG” (RIOT POLICE) printed on both sides of the vehicle;
d) Transport vehicles equipped with seating in the
cargo area used by the People’s Police on duty;
dd) Vehicles for transporting prisoners, rescue
vehicles, and other specialized vehicles used by the People’s Police;
e) Special-purpose vehicles (e.g., satellite
communication vehicles, bulletproof vehicles, counter-terrorism and riot
control vehicles, and other specialized vehicles used by the People’s Police);
g) Vehicles of the Police force engaged in urgent
missions using priority signals as prescribed by law.
7. Defense force vehicles participating in drills,
troop movements, or transportation of weapons and equipment, escorted by
military-specialized vehicles.

a) Vehicles specifically designed for funeral
services (e.g., hearses and refrigerated trucks for storing and transporting
bodies);
b) Funeral service vehicles (e.g., passenger
vehicles accompanying hearses, trucks carrying flowers, vehicles transporting
memorial photos).
9. Vehicle convoys escorted by Traffic Police
vehicles.
10. Vehicles transporting medicines, machinery,
equipment, materials, or goods to disaster-stricken areas or regions affected
by epidemics in accordance with the laws on emergencies during major disasters
or dangerous epidemics.
11. War invalids, sick soldiers, persons with
disabilities, students, and children under 10 years of age (including those
traveling by bicycle or motorbike). When using ferry services in these cases,
relevant documents (originals, certified copies, electronically certified
copies from originals, or electronic copies issued from the original register)
must be presented, such as: war or sick soldier cards; certificates for war or
sick soldiers along with citizen identification cards; student cards, citizen
identification cards, or certificates issued by schools for students.
12. Individuals and vehicles using ferry services
at Kenh Tat and Lang Sat ferry terminals on National Highway 53, and Kenh Sau
ferry terminal on National Highway 53B.
Article 4. Ferry service pricing
1. The pricing framework for ferry services is
established based on the principles and grounds stipulated in Article 22 of the
Law on Prices.
2. The Vietnam Road Administration decides on the
pricing method in accordance with legal regulations on pricing.

4. The Vietnam Road Administration is tasked with
appraising pricing plans and submitting them to the Ministry of Transport for
approval and issuance of a pricing framework for ferry services.
5. The preparation, appraisal of pricing dossiers,
issuance of pricing documents, or adjustment of prices must comply with legal
regulations on pricing.
Article 5. Pricing framework for ferry services
1. The pricing framework for ferry services
specifies the minimum and maximum fees per trip applicable to pedestrians,
vehicle passengers, and each type of vehicle crossing the river by ferry. The
ferry terminal management agency and ferry service providers determine specific
prices within the framework issued by the Ministry of Transport.
2. The pricing framework for ferry services may be
reviewed and adjusted when factors affecting price formation change.
Article 6. Management of ferry service fee
tickets
1. The printing, issuance, management, and use of
ferry service fee tickets must comply with the provisions of the law on the
management of invoices for the sale of goods and provision of services.
2. Ferry service fee tickets at ferry terminals
include two types: single-use tickets, monthly tickets.
a) Single-trip tickets: These tickets are valid for
one-time use of ferry services for one fee-paying individual;

For pedestrians, tickets must include the full name
and identity card number (or passport; driver's license for cars or
motorcycles; or a certificate of personal identification issued by the local
police station where the individual resides or temporarily resides). For
vehicles without license plates as required, tickets must state the vehicle
type, along with the full name and identity card number (or passport; driver's
license for cars or motorcycles; or a certificate of personal identification
issued by the local police station where the driver resides or temporarily
resides) of the driver. For vehicles with license plates as required, tickets
must specify the vehicle type and license plate number.
3. Tickets purchased for fee-paying individuals are
valid only for use by the specified individual at the respective ferry
terminal.
4. In the event of disasters, epidemics, natural
calamities, or other force majeure circumstances that require the ferry
terminal to suspend operations as instructed by competent authorities, the
ferry service provider must extend the validity of monthly tickets. The
extension period must equal the number of days of suspension but must not
exceed the remaining valid days of the monthly ticket from the suspension start
date.
Article 7. Price declaration
1. The Directorate for Road
of Vietnam is responsible for receiving price declaration documents and
updating the declared price information into the national pricing database for
ferry services.
2. The procedures for price declaration submission
and acceptance shall comply with the provisions of laws on pricing.
Article 8. Price posting
Entities providing ferry services must post the
prices of ferry services in accordance with Article 29 of the Law on Pricing.

Article 10. Responsibilities of ferry terminal
management agencies and ferry service providers
1. Ferry terminal management agencies are
responsible for coordinating with ferry service providers to prepare pricing
plans for ferry services; inspect and supervise the implementation of pricing
management regulations by ferry service providers.
2. Ferry service providers are responsible for:
a) Deciding specific ferry service fee prices based
on the price framework issued by state agencies;
b) Declaring, disclosing, and posting information
on pricing and subjects eligible for fee exemptions in accordance with pricing
laws;
c) Complying with regulations on inspections and
examinations as stipulated by the pricing management laws;
d) Organizing ticket sales at convenient locations
to facilitate access for vehicle owners and prevent traffic congestion;
dd) Promptly and adequately selling all types of
tickets to any individual requiring the service.

2. Inspect and monitor compliance with laws
governing the pricing of ferry services funded by the State Budget, under
central management, within its jurisdiction.
Article 12. Implementation
1. This Circular comes into force as of January 1,
2025.
2. Annul Circular No. 31/2020/TT-BGTVT dated
December 8, 2020 of the Minister of Transport on the pricing framework for
ferry services on national highways funded by the State Budget, under central
management, and Circular No. 37/2022/TT-BGTVT dated December 30, 2022 of the
Minister of Transport on the price framework for ferry services on national
highways funded by the State budget and managed by central authorities./.
