Thực hiện quy định tại Điều 56 của Luật
Điều ước quốc tế năm 2016, Bộ Ngoại giao trân trọng thông báo:
Hiệp định giữa Chính phủ Cộng hòa xã hội chủ
nghĩa Việt Nam và Chính phủ Cộng hòa Ca-mơ-run về miễn thị thực cho người mang
hộ chiếu ngoại giao hoặc hộ chiếu công vụ, ký tại Hà Nội, ngày 27 tháng 12
năm 2017, có hiệu lực từ ngày 26 tháng 12 năm 2019.
Bộ Ngoại giao trân trọng gửi bản sao Hiệp định theo
quy định tại Điều 59 của Luật nêu trên./.

Sau đây gọi là
“các Bên”
Mong muốn tăng cường và phát triển hơn nữa quan hệ
hữu nghị và hợp tác giữa hai nước;
Nhằm tạo thuận lợi cho việc trao đổi các đoàn công
tác và xuất nhập cảnh của công dân hai nước mang hộ chiếu ngoại giao hoặc hộ
chiếu công vụ trên cơ sở bình đẳng và nguyên tắc có đi có lại,
Đã thỏa thuận như sau:
Điều
1
1. Công dân một Bên, mang hộ chiếu ngoại giao hoặc
hộ chiếu công vụ còn giá trị, được miễn thị thực khi nhập cảnh, xuất cảnh và
quá cảnh lãnh thổ Bên kia.
2. Những người nêu tại Khoản 1 Điều này được phép
cư trú trên lãnh thổ Bên kia tối đa là 90 (chín mươi) ngày trong khoảng thời
gian 06 (sáu) tháng tính từ ngày nhập cảnh đầu tiên. Theo yêu cầu bằng văn bản
của cơ quan đại diện ngoại giao hoặc lãnh sự của Bên mà người đó là công dân,
Bên kia có thể gia hạn thời gian tạm trú cho những người này.
3. Những người nêu tại Khoản 1 Điều này, ngoại trừ
những người quy định tại Điều 12, nếu dự định cư trú trên lãnh thổ Bên kia hơn
90 (chín mươi) ngày hoặc làm việc, học tập, sinh sống hay thực hiện các hoạt động
khác phải được cơ quan có thẩm quyền của Bên kia cho phép và phải xin thị thực
trước khi nhập cảnh.
Điều
2
1. Công dân của mỗi Bên này mang hộ chiếu ngoại
giao hoặc hộ chiếu công vụ còn giá trị là thành viên cơ quan đại diện ngoại
giao, cơ quan lãnh sự hoặc phái đoàn đại diện tại các tổ chức quốc tế đóng trên
lãnh thổ Bên kia được miễn thị thực khi nhập cảnh, xuất cảnh và quá cảnh trong
suốt nhiệm kỳ công tác.
2. Việc miễn thị thực dành cho những người nêu tại
Khoản 1 Điều này cũng được áp dụng đối với các thành viên gia đình của họ nếu
những người này mang hộ chiếu ngoại giao hoặc hộ chiếu công vụ còn giá trị.
3. Trong vòng 90 (chín mươi) ngày kể từ ngày nhập cảnh,
những người nêu tại Khoản 1 và Khoản 2 Điều này phải hoàn tất các thủ tục đăng
ký cư trú cần thiết tại cơ quan có thẩm quyền của nước sở tại.
Điều
3
1. Công dân mỗi Bên nêu tại Điều 1
và Điều 2 Hiệp định này có thể nhập cảnh, xuất cảnh hoặc quá cảnh lãnh thổ
Bên kia qua các cửa khẩu quốc tế dành cho khách quốc tế.
2. Công dân mỗi Bên nêu tại Điều 1
và Điều 2 Hiệp định này phải tuân thủ pháp luật và quy định hiện hành của
Bên kia khi nhập cảnh, xuất cảnh, quá cảnh qua cửa khẩu và trong thời gian cư
trú trên lãnh thổ Bên đó.
Điều
4
Các cơ quan có thẩm quyền của các Bên sẽ thông báo
cho nhau qua đường ngoại giao và trong thời hạn sớm nhất có thể được về việc
thay đổi những quy định liên quan đến nhập cảnh, xuất cảnh và cư trú đối với những
người nêu tại Điều 1 và Điều 2 Hiệp định này.
Điều
5
Mỗi Bên có quyền từ chối nhập cảnh hay rút ngắn thời
hạn tạm trú trên lãnh thổ nước mình đối với bất kỳ công dân nào của Bên kia được
coi là người không được hoan nghênh.
Điều
6
Vì những lý do an ninh, trật tự xã hội và sức khỏe cộng
đồng, một Bên có thể đình chỉ một phần hoặc toàn bộ việc thi hành Hiệp định
này. Việc đình chỉ và chấm dứt việc đình chỉ này phải được thông báo ngay cho
Bên kia qua đường ngoại giao.
Điều
7
1. Thông qua đường ngoại giao, các Bên trao cho
nhau mẫu hộ chiếu ngoại giao, hộ chiếu công vụ hiện hành kèm theo thông tin chi
tiết mô tả hộ chiếu này, chậm nhất không quá 30 (ba mươi) ngày sau khi ký Hiệp
định này.
2. Các Bên sẽ trao cho nhau qua đường ngoại giao mẫu
hộ chiếu ngoại giao, hộ chiếu công vụ mới, kèm theo thông tin chi tiết mô tả hộ
chiếu này, chậm nhất không quá 30 (ba mươi) ngày trước ngày hộ chiếu này được
đưa vào sử dụng.
Điều
8
Mọi bất đồng liên quan đến việc giải thích và thực
hiện Hiệp định này sẽ được giải quyết thông qua tham vấn qua đường ngoại giao.
Điều
9
Hiệp định này có thể được sửa đổi bằng thỏa thuận
giữa các Bên thông qua hình thức trao đổi công hàm ngoại giao. Những sửa đổi
này được coi là bộ phận không tách rời của Hiệp định và sẽ có hiệu lực theo quy
định tại khoản 1 Điều 10 Hiệp định này.
Điều
10
1. Hiệp định này có hiệu lực vào ngày thứ ba mươi
(30) sau ngày nhận được qua đường ngoại giao văn bản cuối cùng của mỗi Bên
thông báo về việc đã hoàn thành các thủ tục pháp lý nội bộ cần thiết để Hiệp định
có hiệu lực.
2. Hiệp định này có giá trị vô thời hạn và việc thực
hiện Hiệp định sẽ được đánh giá ba năm một lần thông qua Nhóm công tác chung
bao gồm cơ quan thẩm quyền của hai Bên. Mỗi Bên thông báo cho Bên kia cơ quan
thẩm quyền của mình chịu trách nhiệm thực hiện Hiệp định này trong thời gian ba
tháng từ ngày Hiệp định có hiệu lực.
3. Mỗi Bên có thể chấm dứt Hiệp định này bằng cách
thông báo bằng văn bản cho Bên kia qua đường ngoại giao. Trong trường hợp này,
Hiệp định sẽ hết hiệu lực từ ngày thứ chín mươi (90) sau ngày nhận được thông
báo chấm dứt Hiệp định.
Làm tại Hà Nội, ngày 27 tháng 12 năm 2017, thành
hai bản, mỗi bản bằng tiếng Việt, tiếng Pháp và tiếng Anh; các văn bản có giá
trị như nhau. Trong trường hợp có sự giải thích khác nhau thì văn bản tiếng Anh
được dùng để đối chiếu.

AGREEMENT
BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF CAMEROON AND THE GOVERNMENT OF THE SOCIALIST
REPUBLIC OF VIET NAM ON VISA EXEMPTION FOR HOLDERS OF DIPLOMATIC OR
SERVICE/OFFICIAL PASSPORTS
THE GOVERNMENT OF
THE REPUBLIC OF CAMEROON AND THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIET
NAM
Hereinafter
referred to as the “Parties”
DESIRING to further promote the development
of friendly relations and cooperation between the two countries;
EAGER to facilitate exchange of official
visits and travels of nationals of both countries holding diplomatic or
service/official passports on the basis of equality and reciprocity;
Have agreed as follows:
Article
1
1. Nationals of one Party, who are holders of valid
diplomatic or service/official passports, shall be exempted from visa requirements
for entry into, exit from and transit through the territory of the other Party.
2. The persons mentioned in paragraph 1 of this
Article shall be permitted to stay in the territory of the other Party for a
maximum period of ninety (90) days within any six (06) month period, reckoned
from the date of first entry. Upon the request in writing of the diplomatic
mission or consular post of the Party of which the passport holders are
nationals, the other Party may extend the permit of residence for those
persons.
3. Nationals of either Party referred to in
paragraph I above, excluding the nationals referred to in Article
2 of this Agreement, who intend to enter and stay in the territory of the
other Party for a period of more than ninety (90) days or engage in work,
study, reside or other activities which shall be approved in advance by the
other Party's competent authorities, shall apply for the visa before entering
the territory of the other Party.
Article
2
1. Nationals of the one Party, holders of valid
diplomatic or service/official passports who are accredited as members of the
diplomatic mission, consular posts or representative missions to the
international organizations located in the territory of the other Party, shall
be exempted from visa requirements for entry into, exit from and transit
through the territory of the other Party for the period of their assignments.
2. The visa exemption granted to persons referred
to in paragraph 1 of this Article shall also apply to their family members,
provided that their family members are holders of valid diplomatic or
service/official passports.
3. In the period of ninety (90) days, reckoned from
the date of the first entry, persons mentioned in paragraph 1 and paragraph 2
of this Article must complete the registration procedures at the competent
authorities of the host country.
Article
3
1. Nationals of either Party referred to in Article 1 and Article 2 of this Agreement may enter into, exit
from and transit through the territory of the other Party at any border
check-point designated for international passenger traffic.
2. Nationals of either Party referred to in Article 1 and Article 2 of this Agreement shall be obligated to
comply with the applicable laws and regulations of the other Party while
crossing the border and during their stay in the territory of the other Party.

Through diplomatic channels, the competent
authorities of the Parties shall, at the earliest time as possible, inform each
other of changes of their laws and regulations concerning the entry, exit and
temporary stay of the persons referred to in Article 1 and
Article 2 of this Agreement.
Article
5
This Agreement shall not affect the right of either
Party to refuse the entry or shorten the stay of any national of the other
Party whom it may consider as persona non grata.
Article
6
For reasons of national security, public order or
public health, either Party may suspend the implementation of this Agreement in
whole or in part. Such suspension and its termination shall be communicated
immediately to the other Party through diplomatic channels.
Article
7
1. The Parties shall, through diplomatic channels,
exchange specimen of their diplomatic or service/official passports, together
with a detailed description of such passports, no later than thirty (30) days
after signing this Agreement.
2. Either Party shall, through diplomatic channels,
transmit to the other Party specimens of its modified diplomatic or
service/official passports if any, together with a detailed description of such
passports, no later than thirty (30) days before their coming into use.
Article
8
Any dispute arising from the interpretation or
implementation of this Agreement shall be resolved by consultations through
diplomatic channels.
Article
9
This Agreement may be amended by mutual consent of
the Parties by exchange of diplomatic notes. The amendments shall be considered
as integral parts of this Agreement and enter into force according to the
identical requirements as specified in paragraph 1 of Article
10 of this Agreement.
Article
10
1. This Agreement shall enter into force on the
thirtieth (30th) day following the date of receipt, through
diplomatic channels, of the latter written notification in which the Parties
notify each other of the completion of their internal legal procedures required
for the entry into force of this Agreement.
2. This Agreement is valid for an indefinite period
and would be subject to a tri-annual assessment of this implementation by a
joint follow-up committee. Each Party shall communicate to the other Party
within a period of three (03) months after its entry into force, the relevant
national Authority in charge of the implementation and follow-up of this
Agreement.
3. Each Party may terminate this Agreement by
giving a written notification through diplomatic channels to the other Party.
In that event, the Agreement ceases to be in effect on the ninetieth (90th)
day following the date of receipt of the notification of termination.
IN WITNESS WHEREOF, the undersigned, being
duly authorized by their respective Governments have signed this Agreement.
Done in HANOI, on December 27, 2017
in duplicate, each in English, French and Vietnamese languages, all text being
equally authentic. However, In case of divergence in interpretation, the
English text shall prevail.

RELATIF A
L’EXEMPTION DE VISA
POUR LES DETENTEURS DE PASSEPORTS DIPLOMATIQUES, OFFICIELS OU DE SERVICE
LE GOUVERNEMENT
DE LA REPUBLIQUE SOOALISTE DU VIET NAM
ET
LE GOUVERNEMENT
DE LA REPUBLIQUE DU CAMEROUN
(Ci-après dénommés
les “Parties”);
DÉSIREUX de promouvoir davantage les
relations d’amitié et de coopération qui existententre les deux pays;
SOUCIEUX de faciliter l’éhange de visites
officielles et les voyages des ressortissants des deux pays, détenteurs de
passeports diplomatiques, officiels ou de service, sur une base d’égalité et de
réciprocité;
Sont convenus de ce qui suit :
Article 1*':
1. Les ressortissants de l’une des Parties,
détenteurs de passeports diplomatiques, officiels ou de service en cours de
validité, sont dispensés de l’obligiation d’obtenir un visa pour l’entrée, le
transit, le séjour ou la sortie du territoire de l’autre Partie.
2. Les personnes visées au paragraphe 1 du présent
article peuvent ainsi séjourner sur le territoire de l’autre Partie pour une
période n’excédant pas quatre-vingt dix (90) jours, pour des tranches de six
(06) mois maximum, à compter de la date de la première entrée. Sur demande
écrite de la Mission diplomatique ou du Poste consulaire de la Partie dont les
détenteurs desdits passeports sont ressortissants, l’autre Partie peut
prolonger les permis de séjour au profit desdites personnes.
3. Les ressortissants de l’une quelconque des
Parties, visés au paragraphe 1 ci-dessus, à l’exclusion de ceux mentionnés à
l’article 2 du présent Accord, sont tenus de solliciter un visa avant
l’entrée sur le territoire de l’autre Partie pour un séjour dépassant quatre-vingt
dix (90) jours sur ledit territoire, ou pour y travailler, étudier, résider, ou
exercer toute autre activité nécessitant l’autorisation préalable des Autorités
compétentes du pays d’accueil.
Article 2:
1. Les ressortissants de chaque Partie, détenteurs
de passeports diplomatiques, officiels ou de service en cours de validité, qui
sont membres d’une Mission diplomatique, d’un Poste consulaire ou d’une
représentation permanente de leur Etat respectif auprès d’une organisation
internationale située sur le territoire de l’autre Partie, sont dispensés de
l’obligation d’obtenir un visa pour l’entrée, le transit, le séjour ou la
sortie du territoire de cette autre Partie, pendant la durée de leurs
fonctions.
2. L’exemption de visa accordée aux personnes visées
au paragraphe 1 du présent article s’applique également aux membres de la
famille des personnes spécifiées ci-dessus, pour autant qu’ils soient
détenteurs de passeports diplomatiques, officiels ou de service.
3. A l’issue d’une période de quatre-vingt dix (90)
jours, à compter de la date de la première entrée, les personnes visées aux
paragraphes 1 et 2 du présent article sont tenues d’accomplir les formalités
d’accrétitation requises auprés des Autorités compétentes du pays d’accueil.
Article 3:
1. Les ressortissants de chacune des Parties, visés
aux articles 1 et 2 du présent Accord, peuvent entrer, transiter ou sortir du
territoire de l’autre Partie à partir de n’importe quel poste frontière reconnu
pour le trafic international des voyageurs.
2. Les ressortissants de chacune des Parties, visés
aux articles 1 et 2 du présent Accord, sont tenus de respecter les lois et
règlements en vigueur sur le territoire de l’autre Partie au moment de leur
entrée sur ledit territoire, ainsi que durant leur séjour dans le pays
d’accueil.
Article 4:
Les Autorités compétentes des deux Parties
s’informent, dans les meilleurs délais possibles et par voie diplomatique, des
changements intervenus dans leurs lois et règlements respectifs relatifs à
l’entrée, le séjour et la sortie de leurs territoires, des personnes visées aux
articles 1 et 2 du présent Accord.
Article 5:
Chaque Partie se réserve le droit de refuser
l’entrée ou d’écourter le séjour sur son territoire des ressortissants de
l’autre Partie qu’elle considère persona non grata.
Article 6:
Chaque Partie peut, pour des raisons de sécurité
nationale, d’ordre public ou de santé publique, suspendre de manière totale ou
partielle l'application du présent Accord. Cette suspension et sa levée
subséquente sont immédiatement notifiées à l’autre Partie, par voie
diplomatique.
Article 7:
1. Les Parties échangent, par voie diplomatique,
lea spécimens en cours d’usage de leurs pasaeports diplomatiques, officiels ou
de service, accompagnés d’une description détaillée desdits passeports, au plus
tard trente (30) jours après la date de signature du présent Accord.
2. En cas de modification on de remplacement de ses
passeports diplomatiques, officiels ou de service, la Partie concernée adresse
à l’autre Partie, par voie diplomatique, les spécimens modifiés ou nouveaux
desdits passeports, accompagnés d’une description détaillée, au moins trente
(30) jours avant la date de leur mise en circulation.
Article 8:
Tout différend né de l’interprétation ou de
l’application du présent Accord est réglé par voie de consultations, par voie
diplomatique.
Article 9:
Le présent Accord peut être modifié de commun
accord par les Parties, par l’échange des notes diplomatiques. Les amendements
apportés font partie intégrale du présent Accord et entrent en vigueur après
l’accomplissement des formalités internes requises au paragraphe 1" de
l’article 10 du présent Accord.
Article 10:
1. Le présent Accord entre en vigueur trente (30)
jours suivant la date de réception de la dernière notification, faite par voie
diplomatique, de l’accomplissement par les Parties des formalités intemnes
requises pour son entrée en vigueur.
2. Le présent Accord est concIu pour une durée
indéterminée et fera l’objet d’une évaluation trienaale par un Comité conjoint
de suivi. Chaque Partie communiquera à l’autre Partie, dans un délai de trois
(03) mois suivant son entrée en vigueur, l’Autorité nationale compétente pour
la mise en ceuvre et le suivi du présent Accord
3. Chaque Partie peut, à tout moment, notifier par
écrit à l’autre Partie, par voie diplomatique, sa décision de dénoncer le
présent Accord. La dénonciation prend effet quatre-vingt dix (90) jours suivant
la date de réception de ladite notification par l’aune Partie.
EN FOI DE QUOI, les soussignés, dûment autorisés
par leurs Gouvernements respectifs, ont signé le présent Accord.
Fait à HANOI, le 27 décembre 2017, en deux (02)
exemplaires originaux en langues vietnamienne, anglaise et francaise, toutes
les versions faisant également foi. Toutefois, en cas de divergence
d'interprétation, la version anglaise prévaudra./-
