QUY ĐỊNH VỀ KIỂM DỊCH ĐỘNG VẬT, SẢN PHẨM ĐỘNG VẬT THỦY SẢN

Căn cứ Luật thú y số 79/2015/QH13 ngày 19/6/2015;

Căn cứ Luật an toàn thực phẩm số 55/2010/QH12 ngày 17/6/2010;

Căn cứ Nghị định số 199/2013/NĐ-CP ngày 26/11/2013 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn;

Theo đề nghị của Cục trưởng Cục Thú y,

Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Thông tư Quy định về kiểm dịch động vật, sản phẩm động vật thủy sản.

Chương I

NHỮNG QUY ĐỊNH CHUNG

Điều 1. Phạm vi Điều chỉnh và đối tượng áp dụng

1. Phạm vi Điều chỉnh

Thông tư này quy định chi Tiết Khoản 3 Điều 53 của Luật thú y về Danh Mục động vật, sản phẩm động vật thủy sản thuộc diện phải kiểm dịch, miễn kiểm dịch; Danh Mục động vật, sản phẩm động vật thủy sản thuộc diện phải phân tích nguy cơ trước khi nhập khẩu vào Việt Nam; Danh Mục đối tượng kiểm dịch động vật, sản phẩm động vật thủy sản; nội dung, hồ sơ kiểm dịch động vật, sản phẩm động vật thủy sản vận chuyển ra khỏi địa bàn cấp tỉnh, xuất khẩu, nhập khẩu, tạm nhập tái xuất, tạm xuất tái nhập, chuyển cửa khẩu, kho ngoại quan, quá cảnh lãnh thổ Việt Nam.

2. Đối tượng áp dụng

Thông tư này áp dụng đối với cơ quan, tổ chức, cá nhân có liên quan đến hoạt động vận chuyển động vật, sản phẩm động vật thủy sản ra khỏi địa bàn cấp tỉnh, xuất khẩu, nhập khẩu, tạm nhập tái xuất, tạm xuất tái nhập, chuyển cửa khẩu, kho ngoại quan, quá cảnh lãnh thổ Việt Nam.

Điều 2. Giải thích từ ngữ

Trong Thông tư này, các từ ngữ dưới đây được hiểu như sau:

1. Động vật thủy sản sử dụng làm giống là động vật thủy sản sử dụng để sản xuất giống, làm giống để nuôi thương phẩm, làm cảnh, giải trí hoặc sử dụng với Mục đích khác.

2. Động vật thủy sản thương phẩm là động vật thủy sản còn sống sử dụng làm thực phẩm; làm nguyên liệu chế biến thực phẩm, thức ăn chăn nuôi, thức ăn thủy sản hoặc sử dụng với Mục đích khác, trừ Mục đích làm giống.

3. Nơi cách ly kiểm dịch động vật thủy sản là nơi lưu giữ động vật thủy sản trong thời gian quy định để thực hiện việc kiểm dịch.

4. Nơi cách ly kiểm dịch sản phẩm động vật thủy sản là kho chứa hàng, phương tiện chứa đựng sản phẩm động vật thủy sản trong thời gian quy định để thực hiện việc kiểm dịch.

Điều 3. Danh Mục động vật, sản phẩm động vật thủy sản thuộc diện phải kiểm dịch, miễn kiểm dịch; Danh Mục động vật, sản phẩm động vật thủy sản thuộc diện phải phân tích nguy cơ trước khi nhập khẩu vào Việt Nam; Danh Mục đối tượng kiểm dịch động vật, sản phẩm động vật thủy sản

1. Danh Mục động vật, sản phẩm động vật thủy sản thuộc diện phải kiểm dịch, miễn kiểm dịch được quy định tại Phụ lục I ban hành kèm theo Thông tư này.

2. Danh Mục động vật, sản phẩm động vật thủy sản thuộc diện phải phân tích nguy cơ trước khi nhập khẩu vào Việt Nam được quy định tại Phụ lục II ban hành kèm theo Thông tư này.

3. Danh Mục đối tượng kiểm dịch động vật, sản phẩm động vật thủy sản được quy định tại Phụ lục III ban hành kèm theo Thông tư này

Chương II

HỒ SƠ, NỘI DUNG KIỂM DỊCH

Điều 4. Hồ sơ đăng ký, khai báo kiểm dịch

1. Hồ sơ đăng ký kiểm dịch vận chuyển động vật thủy sản sử dụng làm giống ra khỏi địa bàn cấp tỉnh; động vật thủy sản thương phẩm, sản phẩm động vật thủy sản xuất phát từ vùng công bố dịch ra khỏi địa bàn cấp tỉnh: Giấy đăng ký kiểm dịch theo mẫu 01 TS Phụ lục V ban hành kèm theo Thông tư này.

2. Hồ sơ đăng ký kiểm dịch nhập khẩu động vật, sản phẩm động vật thủy sản tiêu thụ trong nước;

a) Văn bản đề nghị hướng dẫn kiểm dịch theo Mẫu 02 TS Phụ lục V ban hành kèm theo Thông tư này;

b) Bản sao mẫu Giấy chứng nhận kiểm dịch xuất khẩu của cơ quan thẩm quyền nước xuất khẩu có xác nhận của doanh nghiệp (đối với động vật, sản phẩm động vật thủy sản có nguồn gốc từ những quốc gia, vùng lãnh thổ chưa có thỏa thuận về mẫu Giấy chứng nhận kiểm dịch với Việt Nam);

c) Bản sao Giấy phép CITES có xác nhận của doanh nghiệp đối với động vật, sản phẩm động vật thủy sản có trong Danh Mục động vật, thực vật hoang dã nguy cấp, quý, hiếm theo quy định của pháp luật Việt Nam hoặc quy định của Công ước CITES);

d) Bản sao Giấy phép nhập khẩu thủy sản của Tổng cục Thủy sản có xác nhận của doanh nghiệp đối với động vật thủy sản sử dụng để làm giống không có tên trong Danh Mục giống thủy sản được phép sản xuất, kinh doanh ban hành kèm theo Quyết định số 57/2008/QĐ-BNN ngày 02/5/2008 của Bộ Nông nghiệp và Phát triển nông thôn; động vật thủy sản làm thực phẩm không có tên trong Danh Mục các loài thủy sản sống được phép nhập khẩu làm thực phẩm ban hành kèm theo Thông tư số 04/2015/TT-BNNPTNT ngày 12/02/2015 của Bộ Nông nghiệp và Phát triển nông thôn).

3. Hồ sơ khai báo kiểm dịch nhập khẩu sản phẩm động vật thủy sản làm nguyên liệu gia công, chế biến thực phẩm xuất khẩu; sản phẩm động vật thủy sản nhập khẩu từ tàu đánh bắt hải sản nước ngoài; sản phẩm động vật thủy sản làm hàng mẫu; sản phẩm động vật thủy sản xuất khẩu bị triệu hồi hoặc bị trả về:

a) Đơn khai báo kiểm dịch theo Mẫu 03 TS Phụ lục V ban hành kèm theo Thông tư này;

b) Bản sao có xác nhận của doanh nghiệp hoặc bản gốc Giấy chứng nhận kiểm dịch của nước xuất khẩu, trừ sản phẩm động vật thủy sản nhập khẩu trực tiếp từ tàu đánh bắt hải sản của nước ngoài. Trường hợp gửi bản sao hoặc tại thời Điểm gửi hồ sơ chưa cung cấp Giấy chứng nhận kiểm dịch của nước xuất khẩu thì phải gửi bản gốc Giấy chứng nhận kiểm dịch của nước xuất khẩu khi kiểm tra hàng hóa;

c) Bản sao Giấy phép theo quy định tại Điểm c Khoản 2 Điều này;

d) Bản sao có xác nhận của doanh nghiệp các giấy tờ liên quan đến lô hàng khi xuất khẩu (Giấy chứng nhận an toàn thực phẩm nếu có, thông báo triệu hồi lô hàng của doanh nghiệp, tờ khai hải quan, bảng kê danh Mục hàng hóa) đối với sản phẩm động vật thủy sản xuất khẩu bị triệu hồi hoặc bị trả về.

4. Hồ sơ đăng ký kiểm dịch tạm nhập tái xuất, tạm xuất tái nhập, chuyển cửa khẩu, kho ngoại quan, quá cảnh lãnh thổ Việt Nam động vật, sản phẩm động vật thủy sản:

a) Văn bản đề nghị hướng dẫn kiểm dịch theo mẫu 04 TS (mẫu 05 TS đối với hàng nhập, xuất kho ngoại quan) Phụ lục V ban hành kèm theo Thông tư này;

b) Bản sao Hợp đồng thương mại có xác nhận của doanh nghiệp;

c) Bản sao Giấy phép theo quy định tại Điểm c Khoản 2 Điều này;

d) Bản sao Giấy chứng nhận mã số kinh doanh tạm nhập, tái xuất hàng hóa theo quy định có xác nhận của doanh nghiệp;

đ) Bản sao Giấy phép quá cảnh hàng hóa theo quy định có xác nhận của doanh nghiệp;

e) Bản sao Giấy phép tạm nhập tái xuất hàng hóa theo quy định có xác nhận của doanh nghiệp;

g) Bản sao Quyết định thành lập kho ngoại quan có xác nhận của doanh nghiệp, trường hợp thuê kho thì phải có Hợp đồng thuê kho ngoại quan có xác nhận của doanh nghiệp (đối với hàng nhập, xuất kho ngoại quan).

5. Hồ sơ đăng ký kiểm dịch xuất khẩu động vật, sản phẩm động vật thủy sản không dùng làm thực phẩm:

a) Đơn theo mẫu 03 TS Phụ lục V ban hành kèm theo Thông tư này;

b) Yêu cầu vệ sinh thú y của nước nhập khẩu hoặc chủ hàng (nếu có);

c) Bản sao Giấy phép xuất khẩu thủy sản của Tổng cục Thủy sản có xác nhận của doanh nghiệp (đối với các loài thủy sản xuất khẩu phải đề nghị cấp phép theo quy định tại Thông tư số 04/2015/TT-BNNPTNT ngày 12/02/2015 của Bộ Nông nghiệp và Phát triển nông thôn).

6. Hồ sơ khai báo kiểm dịch động vật, sản phẩm động vật thủy sản nhập khẩu để tiêu thụ trong nước:

a) Đơn theo mẫu 03 TS Phụ lục V ban hành kèm theo Thông tư này;

b) Bản sao có xác nhận của doanh nghiệp hoặc bản gốc Giấy chứng nhận kiểm dịch của nước xuất khẩu. Trường hợp nộp bản sao hoặc tại thời Điểm gửi hồ sơ chưa cấp Giấy chứng nhận kiểm dịch của nước xuất khẩu thì phải gửi bản gốc Giấy chứng nhận kiểm dịch của nước xuất khẩu khi kiểm tra hàng hóa.

7. Hồ sơ khai báo kiểm dịch động vật, sản phẩm động vật thủy sản tạm nhập tái xuất, tạm xuất tái nhập, chuyển cửa khẩu, kho ngoại quan, quá cảnh lãnh thổ Việt Nam:

a) Đơn theo mẫu 03 TS Phụ lục V ban hành kèm theo Thông tư này;

b) Bản sao có xác nhận của doanh nghiệp hoặc bản gốc Giấy chứng nhận kiểm dịch của nước xuất khẩu. Trường hợp gửi bản sao hoặc tại thời Điểm gửi hồ sơ chưa cung cấp Giấy chứng nhận kiểm dịch của nước xuất khẩu thì phải gửi bản gốc Giấy chứng nhận kiểm dịch khi kiểm tra hàng hóa.

Điều 5. Đăng ký kiểm dịch động vật thủy sản sử dụng làm giống vận chuyển ra khỏi địa bàn cấp tỉnh; động vật thủy sản thương phẩm, sản phẩm động vật thủy sản xuất phát từ vùng công bố dịch vận chuyển ra khỏi địa bàn cấp tỉnh

1. Trước khi vận chuyển động vật thủy sản sử dụng làm giống ra khỏi địa bàn cấp tỉnh; động vật thủy sản thương phẩm, sản phẩm động vật thủy sản xuất phát từ vùng công bố dịch ra khỏi địa bàn cấp tỉnh chủ hàng gửi 01 bộ hồ sơ đăng ký kiểm dịch theo quy định tại Khoản 1 Điều 4 của Thông tư này đến cơ quan quản lý chuyên ngành thú y cấp tỉnh hoặc cơ quan quản lý chuyên ngành thú y cấp huyện được ủy quyền (sau đây gọi là cơ quan kiểm dịch động vật nội địa).

Hình thức gửi hồ sơ: Qua đường bưu điện hoặc thư điện tử, fax sau đó gửi hồ sơ gốc hoặc gửi trực tiếp.

2. Trong thời hạn 01 ngày làm việc, kể từ ngày nhận được hồ sơ, cơ quan kiểm dịch động vật nội địa tiến hành xem xét tính hợp lệ của hồ sơ và thông báo cho chủ hàng thời gian, địa Điểm tiến hành kiểm dịch, nếu hồ sơ chưa hợp lệ thì hướng dẫn chủ hàng hoàn chỉnh hồ sơ theo quy định.

Điều 6. Kiểm dịch động vật thủy sản sử dụng làm giống xuất phát từ cơ sở nuôi trồng thủy sản chưa được công nhận an toàn dịch bệnh hoặc chưa được giám sát dịch bệnh theo quy định hoặc từ cơ sở thu gom, kinh doanh vận chuyển ra khỏi địa bàn cấp tỉnh

1. Việc kiểm dịch được thực hiện ngay tại nơi nuôi giữ tạm thời; bể, ao ương con giống của các cơ sở nuôi trồng thủy sản; cơ sở thu gom, kinh doanh.

2. Cơ quan kiểm dịch động vật nội địa thực hiện kiểm dịch như sau:

a) Kiểm tra số lượng, chủng loại, kích cỡ động vật thủy sản;

b) Kiểm tra lâm sàng;

c) Lấy mẫu kiểm tra các bệ theo quy định tại Phụ lục IV ban hành kèm theo Thông tư này;

d) Kiểm tra Điều kiệu vệ sinh thú y phương tiện vận chuyển và các vật dụng kèm theo;

đ) Cấp Giấy chứng nhận kiểm dịch theo quy định tại Điểm d Khoản 1 Điều 55 của Luật thú y;

e) Kiểm tra, giám sát quá trình bốc xếp động vật thủy sản giống lên phương tiện vận chuyển;

g) Thông báo cho cơ quan kiểm dịch động vật nội địa nơi đến qua thư điện tử hoặc fax các thông tin gồm: Số Giấy chứng nhận kiểm dịch, ngày cấp, loại hàng, số lượng hàng, tên chủ hàng, nơi hàng đến, biển kiểm soát của phương tiện vận chuyển vào 16 giờ 30 phút hàng ngày.

3. Trường hợp chỉ tiêu xét nghiệm bệnh dương tính, cơ quan kiểm dịch động vật nội địa không cấp Giấy chứng nhận kiểm dịch và tiến hành xử lý theo quy định về phòng chống dịch bệnh thủy sản.

Điều 7. Kiểm dịch động vật thủy sản sử dụng làm giống xuất phát từ các cơ sở nuôi trồng thủy sản an toàn dịch bệnh hoặc được giám sát dịch bệnh vận chuyển ra khỏi địa bàn cấp tỉnh

1. Cơ sở phải bảo đảm được công nhận an toàn dịch hoặc được giám sát dịch bệnh đối với các bệnh động vật thủy sản theo quy định tại Phụ lục IV ban hành kèm theo Thông tư này.

2. Cơ quan kiểm dịch động vật nội địa thực hiện như sau:

a) Kiểm tra Điều kiện vệ sinh thú y phương tiện vận chuyển và các vật dụng kèm theo;

b) Cấp Giấy chứng nhận kiểm dịch theo quy định tại Điểm b Khoản 2 Điều 55 của Luật thú y;

c) Kiểm tra, giám sát quá trình bốc xếp động vật thủy sản giống lên phương tiện vận chuyển;

d) Thực hiện theo quy định tại Điểm g Khoản 2 Điều 6 của Thông tư này.

Điều 8. Kiểm dịch động vật thủy sản thương phẩm xuất phát từ vùng công bố dịch vận chuyển ra khỏi địa bàn cấp tỉnh

1. Động vật thủy sản thương phẩm thu hoạch từ cơ sở nuôi không có dịch bệnh trong vùng công bố dịch, cơ quan kiểm dịch động vật nội địa thực hiện việc kiểm dịch như sau:

a) Kiểm tra số lượng, chủng loại, kích cỡ động vật thủy sản;

b) Kiểm tra lâm sàng;

c) Lấy mẫu kiểm tra tác nhân gây bệnh đối với động vật thủy sản thương phẩm cảm nhiễm với bệnh được công bố dịch theo quy định tại Phụ lục IV ban hành kèm theo Thông tư này;

d) Thực hiện theo quy định tại Điểm d, đ, e, g Khoản 2 Điều 6 của Thông tư này.

2. Động vật thủy sản thu hoạch từ cơ sở nuôi có bệnh đang công bố dịch phải được chế biến (xử lý nhiệt hoặc tùy từng loại bệnh có thể áp dụng biện pháp xử lý cụ thể bảo đảm không thể lây lan dịch bệnh) trước khi đưa ra khỏi vùng công bố dịch.

Điều 9. Kiểm dịch sản phẩm động vật thủy sản xuất phát từ vùng công bố dịch vận chuyển ra khỏi địa bàn cấp tỉnh

1. Việc kiểm dịch được thực hiện ngay tại cơ sở sơ chế, chế biến của chủ hàng.

2. Cơ quan kiểm dịch động vật nội địa thực hiện việc kiểm dịch như sau:

a) Kiểm tra số lượng, chủng loại sản phẩm động vật thủy sản;

b) Kiểm tra việc thực hiện các quy định về sơ chế, chế biến thủy sản trước khi chưa ra khỏi vùng công bố dịch;

c) Kiểm tra tình trạng bao gói, bảo quản, cảm quan đối với sản phẩm động vật thủy sản;

d) Kiểm tra Điều kiệu vệ sinh thú y phương tiện vận chuyển và các vật dụng kèm theo;

đ) Thực hiện theo quy định tại Điểm d, đ và g Khoản 2 Điều 6 của Thông tư này;

e) Thực hiện hoặc giám sát chủ hàng thực hiện việc vệ sinh, khử trùng tiêu độc phương tiện vận chuyển và các vật dụng kèm theo trước khi xếp hàng lên phương tiện vận chuyển;

g) Kiểm tra, giám sát quá trình bốc xếp sản phẩm động vật thủy sản lên phương tiện vận chuyển; niêm phong phương tiện vận chuyển; thực hiện hoặc giám sát chủ hàng thực hiện việc vệ sinh, khử trùng tiêu độc nơi tập trung, bốc xếp hàng.

2. Trường hợp sản phẩm động vật thủy sản không bảo đảm yêu cầu vệ sinh thú y, cơ quan kiểm dịch động vật nội địa không cấp Giấy chứng nhận kiểm dịch và tiến hành xử lý theo quy định.

Điều 10. Kiểm soát động vật thủy sản sử dụng làm giống tại địa phương tiếp nhận

1. Cơ quan kiểm dịch động vật nội địa tại địa phương tiếp nhận chỉ thực hiện kiểm dịch động vật sử dụng làm giống trong các trường hợp sau đây:

a) Lô hàng vận chuyển từ địa bàn tỉnh khác đến không có Giấy chứng nhận kiểm dịch hoặc Giấy chứng nhận kiểm dịch không hợp lệ;

b) Cơ quan kiểm dịch động vật nội địa phát hiện có sự đánh tráo hoặc lấy thêm động vật thủy sản giống khi chưa được phép của cơ quan kiểm dịch động vật;

c) Cơ quan kiểm dịch động vật nội địa phát hiện động vật thủy sản có dấu hiệu bệnh lý.

2. Đối với các lô hàng phải kiểm dịch cơ quan kiểm dịch động vật nội địa thực hiện việc kiểm dịch, cấp Giấy chứng nhận kiểm dịch theo quy định tại Điểm a, b, c, d và đ Khoản 2 Điều 6 của Thông tư này.

Điều 11. Kiểm dịch động vật, sản phẩm động vật thủy sản xuất khẩu không dùng làm thực phẩm

1. Đăng ký kiểm dịch

Trước khi xuất khẩu động vật, sản phẩm động vật thủy sản có yêu cầu kiểm dịch, chủ hàng gửi 01 bộ hồ sơ theo quy định tại Khoản 5 Điều 4 của Thông tư này đến Cơ quan Thú y vùng hoặc Chi cục Kiểm dịch động vật vùng trực thuộc Cục Thú y hoặc cơ quan quản lý chuyên ngành thú y cấp tỉnh được Cục Thú y ủy quyền (sau đây gọi là cơ quan kiểm dịch động vật cửa khẩu). Hình thức gửi hồ sơ: Gửi qua đường bưu điện hoặc thư điện tử, fax sau đó gửi hồ sơ gốc hoặc gửi trực tiếp.

2. Tiếp nhận và xử lý hồ sơ

Cơ quan tiếp nhận hồ sơ tiến hành kiểm tra ngay tính hợp lệ của hồ sơ, nếu chưa hợp lệ thì đề nghị chủ hàng hoàn thiện hồ sơ theo quy định.

3. Cơ quan kiểm dịch động vật cửa khẩu thực hiện kiểm dịch như sau

a) Kiểm tra số lượng, chủng loại, bao gói động vật, sản phẩm động vật thủy sản;

b) Kiểm tra lâm sàng đối với động vật thủy sản; kiểm tra cảm quan, Điều kiệu bảo quản, thực trạng hàng hóa đối với sản phẩm động vật thủy sản;

c) Lấy mẫu kiểm tra, xét nghiệm các chỉ tiêu theo yêu cầu của nước nhập khẩu hoặc của chủ hàng (nếu có), trừ các chỉ tiêu bệnh đã được công nhận an toàn dịch đối với cơ sở nuôi nơi xuất xứ của động vật thủy sản;

d) Cấp Giấy chứng nhận kiểm dịch theo quy định tại Điểm c Khoản 2 Điều 42 của Luật thú y.

4. Trường hợp chủ hàng hoặc nước nhập khẩu không yêu cầu kiểm dịch: Chủ hàng phải thực hiện kiểm dịch vận chuyển ra khỏi địa bàn cấp tỉnh theo quy định tại Điều 6, Điều 7, Điều 8, Điều 9 của Thông tư này.

5. Kiểm soát động vật, sản phẩm động vật tại cửa khẩu xuất, cơ quan kiểm dịch động vật cửa khẩu thực hiện như sau:

a) Kiểm tra Giấy chứng nhận kiểm dịch xuất khẩu;

b) Kiểm tra triệu chứng lâm sàng đối với động vật thủy sản, thực trạng hàng hóa, Điều kiện bao gói, bảo quản đối với sản phẩm động vật thủy sản;

c) Xác nhận hoặc thực hiện cấp đổi Giấy chứng nhận kiểm dịch xuất khẩu theo yêu cầu của chủ hàng.

Điều 12. Kiểm dịch động vật, sản phẩm động vật thủy sản xuất khẩu dùng làm thực phẩm

1. Chủ hàng gửi 01 bộ hồ sơ theo quy định tại Khoản 1 Điều 57 của Luật Thú y.

2. Trình tự, thủ tục, nội dung kiểm dịch thực hiện theo quy định tại Khoản 2 và 3 Điều 57 của Luật thú y.

Điều 13. Kiểm dịch động vật, sản phẩm động vật thủy sản nhập khẩu để tiêu thụ trong nước

1. Đăng ký kiểm dịch

a) Chủ hàng gửi 01 bộ hồ sơ đăng ký kiểm dịch theo quy định tại Khoản 2 Điều 4 của Thông tư này đến Cục Thú y. Hình thức gửi hồ sơ: Gửi qua đường bưu điện hoặc thư điện tử, fax sau đó gửi hồ sơ gốc hoặc gửi trực tiếp;

b) Cục Thú y gửi văn bản đồng ý kiểm dịch qua thư điện tử cho chủ hàng và cơ quan kiểm dịch động vật cửa khẩu.

2. Khai báo kiểm dịch

a) Sau khi Cục Thú y có Văn bản đồng ý, chủ hàng gửi 01 bộ hồ sơ khai báo kiểm dịch theo quy định tại Khoản 6 Điều 4 của Thông tư này đến cơ quan kiểm dịch động vật cửa khẩu trước khi hàng đến cửa khẩu nhập;

b) Cơ quan kiểm dịch động vật cửa khẩu sau khi nhận được hồ sơ hợp lệ thông báo cho chủ hàng thời gian, địa Điểm tiến hành kiểm dịch, nếu hồ sơ chưa hợp lệ thì hướng dẫn chủ hàng hoàn chỉnh theo quy định.

3. Chuẩn bị nơi cách ly kiểm dịch động vật thủy sản nhập khẩu

a) Chủ hàng có trách nhiệm bố trí địa Điểm cách ly kiểm dịch;

b) Nơi cách ly kiểm dịch được bố trí tại địa Điểm bảo đảm yêu cầu vệ sinh thú y, được cơ quan kiểm dịch động vật cửa khẩu kiểm tra và giám sát trong thời gian nuôi cách ly kiểm dịch.

Trường hợp động vật thủy sản nuôi ở lồng, bè trên biển thì phải được nuôi cách ly ở lồng, bè cách biệt với khu vực nuôi trồng thủy sản; nếu động vật thủy sản nuôi tại cơ sở trên đất liền phải được nuôi cách ly ở bể, ao riêng biệt.

c) Cơ quan kiểm dịch động vật cửa khẩu có trách nhiệm kiểm tra Điều kiệu vệ sinh thú y bảo đảm Điều kiện để cách ly kiểm dịch và thông báo kết quả kiểm tra cho chủ hàng, Cục Thú y qua thư điện tử hoặc fax, sau đó gửi bản chính.

4. Nội dung kiểm dịch

a) Cơ quan kiểm dịch động vật cửa khẩu thực hiện theo quy định tại Điều 47 của Luật thú y;

b) Đối với động vật thủy sản sử dụng làm giống: Lấy mẫu xét nghiệm các bệnh theo quy định tại Phụ lục IV ban hành kèm theo Thông tư này;

c) Đối với động vật thủy sản thương phẩm: Lấy mẫu giám sát chất tồn dư độc hại theo quy định tại Phụ lục IV ban hành kèm theo Thông tư này; chỉ lấy mẫu xét nghiệm bệnh thủy sản nếu phát hiện động vật thủy sản có dấu hiệu mắc bệnh được quy định tại Phụ lục III ban hành kèm theo Thông tư này;

d) Thời gian nuôi cách ly kiểm dịch: Không quá 10 ngày đối với động vật thủy sản làm giống, không quá 03 ngày đối với động vật thủy sản thương phẩm kể từ ngày cách ly kiểm dịch; trường hợp kéo dài hơn thời gian nêu trên thì cơ quan kiểm dịch động vật cửa khẩu thông báo đến chủ hàng bằng văn bản và nêu rõ lý do;

đ) Đối với sản phẩm động vật thủy sản: Lấy mẫu xét nghiệm các chỉ tiêu theo quy định tại Phụ lục IV ban hành kèm theo Thông tư này.

5. Cấp Giấy chứng nhận kiểm dịch

a) Trong thời gian 05 ngày làm việc kể từ khi bắt đầu kiểm dịch, cơ quan kiểm dịch động vật cửa khẩu cấp Giấy chứng nhận kiểm dịch nhập khẩu đối với sản phẩm thủy sản đạt yêu cầu, thông báo cho chủ hàng, cơ quan kiểm dịch động vật nơi đến và để chủ hàng hoàn thiện thủ tục hải quan; trường hợp kéo dài hơn 05 ngày làm việc thì cơ quan kiểm dịch động vật cửa khẩu thông báo đến chủ hàng bằng văn bản và nêu rõ lý do;

b) Ngay sau khi kết thúc thời gian nuôi cách ly kiểm dịch, cơ quan kiểm dịch động vật cửa khẩu cấp Giấy chứng nhận kiểm dịch nhập khẩu đối với động vật khỏe mạnh, các xét nghiệm bệnh theo quy định đạt yêu cầu, thông báo cho cơ quan kiểm dịch động vật nơi đến và để chủ hàng hoàn thiện thủ tục hải quan;

c) Thông báo cho cơ quan kiểm dịch động vật nơi đến qua thư điện tử hoặc fax các thông tin gồm: Số Giấy chứng nhận kiểm dịch, ngày cấp, số lượng hàng ngay sau khi cấp Giấy chứng nhận kiểm dịch.

6. Thông báo vi phạm: Trường hợp phát hiện lô hàng Vi phạm các chỉ tiêu được kiểm tra, Cục Thú y thông báo bằng Văn bản cho cơ quan thẩm quyền nước xuất khẩu tiến hành Điều tra nguyên nhân, yêu cầu có hành động khắc phục và báo cáo kết quả.

Chủ hàng có trách nhiệm thực hiện việc xử lý lô hàng vi phạm theo hướng dẫn của cơ quan kiểm dịch động vật cửa khẩu.

Điều 14. Kiểm dịch nhập khẩu sản phẩm động vật thủy sản làm nguyên liệu gia công, chế biến thực phẩm xuất khẩu; sản phẩm động vật thủy sản nhập khẩu từ tàu đánh bắt hải sản nước ngoài; sản phẩm động vật thủy sản làm hàng mẫu; sản phẩm động vật thủy sản xuất khẩu bị triệu hồi hoặc bị trả về

1. Chủ hàng gửi 01 bộ hồ sơ theo quy định tại Khoản 3 Điều 4 của Thông tư này đến cơ quan kiểm dịch động vật cửa khẩu nơi nhập hàng.

Hình thức gửi hồ sơ: Qua đường bưu điện hoặc thư điện tử, fax sau đó gửi hồ sơ gốc hoặc gửi trực tiếp.

Trong thời gian 01 ngày làm việc kể từ khi tiếp nhận hồ sơ, cơ quan kiểm dịch động vật cửa khẩu xác nhận Đơn khai báo kiểm dịch để chủ hàng làm thủ tục hải quan và thông báo cho chủ hàng thời gian, địa Điểm tiến hành kiểm dịch, nếu hồ sơ chưa hợp lệ thì hướng dẫn chủ hàng hoàn chỉnh hồ sơ theo quy định.

2. Cơ quan kiểm dịch động vật cửa khẩu thực hiện việc kiểm dịch như sau:

a) Kiểm tra Điều kiện bảo quản, quy cách bao gói, ghi nhãn, ngoại quan của sản phẩm;

b) Trường hợp nghi ngờ hoặc phát hiện hàng hóa không đảm bảo yêu cầu vệ sinh thú y thì lấy mẫu để kiểm tra các chỉ tiêu vệ sinh thú y.

3. Cấp Giấy chứng nhận kiểm dịch

a) Trong thời gian 02 ngày làm việc kể từ khi bắt đầu kiểm dịch, cơ quan kiểm dịch động vật cửa khẩu cấp Giấy chứng nhận kiểm dịch nhập khẩu đối với lô hàng bảo đảm các yêu cầu vệ sinh thú y;

b) Trường hợp lô hàng phải lấy mẫu kiểm tra: Trong thời gian 05 ngày làm việc kể từ khi bắt đầu kiểm dịch, cơ quan kiểm dịch động vật cửa khẩu cấp Giấy chứng nhận kiểm dịch nhập khẩu đối với lô hàng bảo đảm các yêu cầu vệ sinh thú y.

4. Kiểm tra giám sát sản phẩm động vật thủy sản nhập khẩu làm nguyên liệu gia công, chế biến thực phẩm xuất khẩu; hàng bị triệu hồi hoặc trả về:

a) Lấy mẫu giám sát các chỉ tiêu theo quy định tại Phụ lục IV ban hành kèm theo Thông tư này;

b) Thông báo vi phạm: Thực hiện theo quy định tại Khoản 6 Điều 13 của Thông tư này.

Điều 15. Kiểm dịch động vật, sản phẩm động vật thủy sản tạm nhập tái xuất, chuyển cửa khẩu, quá cảnh lãnh thổ Việt Nam

1. Chủ hàng gửi 01 bộ hồ sơ đăng ký kiểm dịch theo quy định tại Khoản 4 Điều 4 của Thông tư này đến Cục Thú y.

Hình thức gửi hồ sơ: Gửi qua đường bưu điện hoặc thư điện tử, fax sau đó gửi hồ sơ gốc hoặc gửi trực tiếp.

2. Cục Thú y gửi văn bản đồng ý kiểm dịch bằng thư điện tử cho chủ hàng và cơ quan kiểm dịch động vật cửa khẩu.

3. Sau khi Cục Thú y có văn bản đồng ý, trước khi hàng đến cửa khẩu chủ hàng gửi 01 bộ hồ sơ khai báo kiểm dịch theo quy định tại Khoản 7 Điều 4 của Thông tư này đến cơ quan kiểm dịch động vật cửa khẩu.

Cơ quan kiểm dịch động vật cửa khẩu thực hiện kiểm dịch theo quy định tại Điều 50 của Luật thú y.

Điều 16. Kiểm dịch động vật, sản phẩm động vật thủy sản tạm xuất tái nhập

1. Kiểm dịch tạm xuất thực hiện theo quy định về kiểm dịch xuất khẩu.

2. Kiểm dịch tái nhập thực hiện theo quy định về kiểm dịch nhập khẩu.

Điều 17. Kiểm dịch động vật, sản phẩm động vật thủy sản nhập, xuất kho ngoại quan

1. Chủ hàng gửi 01 bộ hồ sơ đăng ký kiểm dịch theo quy định tại Khoản 4 Điều 4 của Thông tư này đến Cục Thú y. Hình thức gửi hồ sơ: Gửi qua đường bưu điện hoặc thư điện tử, fax sau đó gửi hồ sơ gốc hoặc gửi trực tiếp.

2. Cục Thú y gửi văn bản đồng ý kiểm dịch bằng thư điện tử cho chủ hàng và cơ quan kiểm dịch động vật cửa khẩu.

3. Sau khi Cục Thú y có văn bản đồng ý, trước khi hàng đến cửa khẩu chủ hàng gửi 01 bộ hồ sơ khai báo kiểm dịch theo quy định tại Khoản 7 Điều 4 của Thông tư này cho cơ quan kiểm dịch động vật cửa khẩu.

4. Cơ quan kiểm dịch động vật cửa khẩu thực hiện kiểm dịch hàng hóa nhập vào kho ngoại quan như sau:

a) Cấp Giấy chứng nhận vận chuyển để chủ hàng vận chuyển hàng hóa từ cửa khẩu nhập về kho ngoại quan;

b) Tại kho ngoại quan, cơ quan kiểm dịch cửa khẩu phối hợp với cơ quan hải quan kiểm tra thực trạng lô hàng, xác nhận để chủ hàng nhập hàng vào kho ngoại quan.

5. Trước khi xuất hàng ra khỏi kho ngoại quan chủ hàng phải gửi hồ sơ khai báo kiểm dịch đế cơ quan kiểm dịch động vật cửa khẩu theo quy định sau đây:

a) Đối với sản phẩm động vật thủy sản làm nguyên liệu gia công, chế biến thực phẩm xuất khẩu hồ sơ theo quy định tại Khoản 3 Điều 4 của Thông tư này;

b) Đối với động vật, sản phẩm động vật thủy sản xuất khẩu sang nước khác hoặc tàu du lịch nước ngoài hồ sơ theo quy tại Khoản 5 Điều 4 của Thông tư này;

c) Đối với động vật, sản phẩm động vật thủy sản nhập khẩu để tiêu thụ trong nước hồ sơ theo quy định tại Khoản 6 Điều 4 của Thông tư này.

6. Cơ quan kiểm dịch động vật cửa khẩu thực hiện kiểm dịch hàng hóa xuất ra khỏi kho ngoại quan như sau:

a) Thực hiện theo quy định tại Khoản 2, 3 và 4 Điều 14 của Thông tư này đối với sản phẩm động vật thủy sản làm nguyên liệu gia công, chế biến thực phẩm xuất khẩu;

b) Thực hiện theo quy định tại Khoản 4, 5 và 6 Điều 13 của Thông tư này đối với động vật, sản phẩm động vật thủy sản tiêu thụ trong nước;

c) Thực hiện theo quy định tại Điểm a, b, d Khoản 3 và Điểm a, b Khoản 5 Điều 11 của Thông tư này; lấy mẫu kiểm tra, xét nghiệm các chỉ tiêu theo yêu cầu của nước nhập khẩu hoặc của chủ hàng (nếu có) đối với động vật, sản phẩm động vật thủy sản xuất khẩu;

d) Trường hợp lô hàng được xuất ra khỏi kho ngoại quan từng phần, cơ quan kiểm dịch động vật cửa khẩu trừ lùi số lượng hàng trên Giấy chứng nhận kiểm dịch gốc của nước xuất khẩu, lưu bản sao chụp vào hồ sơ kiểm dịch. Giấy chứng nhận kiểm dịch gốc của nước xuất khẩu sẽ được cơ quan kiểm dịch động vật cửa khẩu thu lại và lưu vào hồ sơ của lần xuất hàng cuối cùng của lô hàng.

Điều 18. Kiểm dịch động vật, sản phẩm động vật thủy sản tham gia hội chợ, triển lãm; động vật thủy sản biểu diễn nghệ thuật

1. Động vật, sản phẩm động vật thủy sản vận chuyển ra khỏi địa bàn cấp tỉnh thực hiện theo quy định tại Điều 6, Điều 7, Điều 8, Điều 9 của Thông tư này.

2. Động vật, sản phẩm động vật thủy sản nhập khẩu thực hiện theo quy định tại Điều 13 của Thông tư này

3. Khi kết thúc hội chợ, triển lãm, biểu diễn nghệ thuật: Chất thải, nước thải phải được xử lý đạt yêu cầu trước khi xả ra môi trường.

Điều 19. Kiểm dịch động vật, sản phẩm động vật thủy sản xuất khẩu mang theo người, gửi qua đường bưu điện.

1. Chủ hàng gửi 01 bộ hồ sơ đăng ký kiểm dịch đến cơ quan kiểm dịch động vật cửa khẩu theo quy định tại Khoản 5 Điều 4 của Thông tư này.

2. Cơ quan kiểm dịch động vật cửa khẩu thực hiện kiểm dịch như sau:

a) Đối với động vật thủy sản: Kiểm tra lâm sàng, lấy mẫu xét nghiệm các bệnh theo yêu cầu của chủ hàng hoặc nước nhập khẩu;

b) Đối với sản phẩm động vật thủy sản: Kiểm tra cảm quan, lấy mẫu xét nghiệm các chỉ tiêu vệ sinh thú y theo yêu cầu của chủ hàng hoặc nước nhập khẩu;

c) Hướng dẫn chủ hàng thực hiện nhốt giữ thủy sản, bao gói sản phẩm thủy sản theo quy định, niêm phong hoặc đánh dấu hàng gửi và cấp giấy chứng nhận kiểm dịch đối với động vật, sản phẩm động vật thủy sản bảo đảm yêu cầu vệ sinh thú y;

d) Hướng dẫn chủ hàng xử lý đối với động vật, sản phẩm động vật thủy sản không bảo đảm yêu cầu vệ sinh thú y để xuất khẩu.

Điều 20. Kiểm dịch động vật, sản phẩm động vật thủy sản nhập khẩu mang theo người, gửi qua đường bưu điện

1. Khi nhập khẩu động vật, sản phẩm động vật thủy sản không vì Mục đích kinh doanh, chủ hàng phải nộp 01 bộ hồ sơ khai báo kiểm dịch nhập khẩu với cơ quan kiểm dịch động vật cửa khẩu theo quy định tại Khoản 6 Điều 4 của Thông tư này.

2. Cơ quan kiểm dịch động vật cửa khẩu thực hiện kiểm dịch như sau:

a) Kiểm tra hồ sơ kiểm dịch, Giấy chứng nhận kiểm dịch của nước xuất khẩu, đối chiếu với chủng loại, số lượng, khối lượng hàng thực nhập;

b) Kiểm tra thực trạng lô hàng; Điều kiện nuôi nhốt động vật thủy sản; bao gói, bảo quản sản phẩm động vật thủy sản;

c) Trường hợp phát hiện loài thủy sản không có trong danh Mục các loài thủy sản nhập khẩu thông thường, động vật thủy sản mắc bệnh, sản phẩm động vật thủy sản có biểu hiện biến chất thì xử lý tiêu hủy hoặc trả về nước xuất khẩu;

d) Sau khi kiểm tra, động vật thủy sản khỏe mạnh, sản phẩm động vật thủy sản bảo đảm yêu cầu vệ sinh thú y; được nhốt giữ, bao gói, bảo quản theo quy định, cơ quan kiểm dịch động vật cửa khẩu cấp Giấy chứng nhận kiểm dịch nhập khẩu để chủ hàng làm thủ tục hải quan, bưu điện.

3. Không được mang theo người sản phẩm thủy sản ở dạng tươi sống.

Điều 21. vận chuyển mẫu bệnh phẩm thủy sản

1. Khi có yêu cầu nhận mẫu bệnh phẩm từ nước ngoài gửi về Việt Nam hoặc gửi mẫu bệnh phẩm từ Việt Nam ra nước ngoài, chủ hàng phải gửi 01 đơn đăng ký kiểm dịch theo Mẫu 06 TS ban hành kèm theo phụ lục V của Thông tư này đến Cục Thú y.

2. Trong thời gian 05 ngày làm việc, kể từ khi nhận được đơn đăng ký hợp lệ, Cục Thú y có trách nhiệm trả lời chủ hàng không chấp thuận hoặc chấp thuận.

3. Cơ quan kiểm dịch động vật cửa khẩu thực hiện kiểm dịch vận chuyển mẫu bệnh phẩm như sau:

a) Kiểm tra văn bản chấp thuận của Cục Thú y và các giấy tờ khác có liên quan; tình trạng bao gói, bảo quản mẫu bệnh phẩm;

b) Cấp Giấy chứng nhận vận chuyển đối với mẫu bệnh phẩm có hồ sơ hợp lệ; được bao gói, bảo quản đảm bảo yêu cầu vệ sinh thú y.

Chương III

ĐIỀU KHOẢN THI HÀNH

Điều 22. Trách nhiệm của tổ chức, cá nhân

1. Trách nhiệm của Cục Thú y

a) Kiểm tra, đánh giá năng lực và quyết định ủy quyền cho cơ quan quản lý chuyên ngành thú y cấp tỉnh thực hiện kiểm dịch và cấp Giấy chứng nhận kiểm dịch động vật, sản phẩm thủy sản xuất, nhập khẩu tại một số cửa khẩu biên giới đường bộ;

b) Chủ trì tổ chức thực hiện theo quy định tại Điểm a Khoản 1 và Điểm a Khoản 2 Điều 59 của Luật thú y;

c) Hướng dẫn các Cơ quan Thú y vùng, Chi cục Kiểm dịch động vật vùng, cơ quan quản lý chuyên ngành thú y cấp tỉnh tổ chức thực hiện kiểm dịch động vật, sản phẩm động vật thủy sản theo quy định tại Thông tư này.

2. Trách nhiệm của Cơ quan Thú y vùng, Cục kiểm dịch động vật vùng, cơ quan quản lý chuyên ngành thú y cấp tỉnh được ủy quyền

a) Thực hiện việc kiểm dịch và cấp Giấy chứng nhận kiểm dịch động vật, sản phẩm động vật thủy sản xuất, nhập khẩu theo quy định;

b) Báo cáo Cục Thú y theo tháng, quý, năm thông tin về động vật, sản phẩm động vật thủy sản xuất khẩu, nhập khẩu.

3. Trách nhiệm của cơ quan quản lý chuyên ngành thú y cấp tỉnh

a) Tổ chức thực hiện kiểm dịch động vật, sản phẩm động vật thủy sản lưu thông trong nước theo quy định tại Thông tư này và hướng dẫn của Cục Thú y;

b) Ủy quyền cho kiểm dịch viên động vật thực hiện việc kiểm dịch và cấp Giấy chứng nhận kiểm dịch động vật, sản phẩm động vật thủy sản vận chuyển ra khỏi địa bàn cấp tỉnh theo đúng quy định của pháp luật;

c) Báo cáo Cục Thú y theo tháng, quý, năm thông tin về động vật, sản phẩm động vật thủy sản lưu thông trong nước.

4. Cục Quản lý Chất lượng Nông lâm sản và Thủy sản có trách nhiệm tổ chức thực hiện kiểm dịch động vật, sản phẩm thủy sản xuất khẩu dùng làm thực phẩm theo quy định tại Thông tư này.

5. Trách nhiệm của chủ hàng

a) Chấp hành các quy định của Thông tư này, pháp luật thú y và pháp luật khác có liên quan trong việc kiểm dịch động vật, sản phẩm động vật thủy sản;

b) Thanh toán các chi phí kiểm dịch, xét nghiệm; các Khoản chi phí thực tế cho việc xử lý, tiêu hủy lô hàng không đạt yêu cầu (nếu có) theo quy định hiện hành.

Điều 23. Điều Khoản chuyển tiếp

Các loại mẫu Giấy chứng nhận kiểm dịch động vật, sản phẩm động vật thủy sản vận chuyển trong nước theo quy định tại Thông tư số 06/2010/TT-BNNPTNT ngày 02/02/2010 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn Quy định trình tự, thủ tục kiểm dịch thủy sản, sản phẩm thủy sản đã được in ấn được phép sử dụng đến hết ngày 30 tháng 6 năm 2017.

Điều 24. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 15 tháng 8 năm 2016.

2. Thông tư này thay thế các Thông tư sau đây:

a) Thông tư số 06/2010/TT-BNNPTNT ngày 02/02/2010 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn Quy định trình tự, thủ tục kiểm dịch thủy sản, sản phẩm thủy sản;

b) Thông tư số 43/2010/TT-BNNPTNT ngày 14/7/2010 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn Sửa đổi, bổ sung Điều 16 và Điều 17 của Thông tư số 06/TT-BNN-NNPTNT ngày 02/02/2010 của Bộ Nông nghiệp và Phát triển nông thôn;

c) Thông tư số 32/2012/TT-BNNPTNT ngày 20/7/2012 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về Danh Mục đối tượng kiểm dịch thủy sản, sản phẩm thủy sản; Danh Mục thủy sản, sản phẩm thủy sản thuộc diện phải kiểm dịch;

3. Thông tư này bãi bỏ:

a) Điều 5 của Thông tư số 47/2010/TT-BNNPTNT ngày 03/8/2010 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc sửa đổi, bổ sung một số Điều quy định về thủ tục hành chính của Quyết định 71/2007/QĐ-BNN ngày 06/8/2007; Quyết định 98/2007/QĐ-BNN ngày 03/12/2007; Quyết định số 118/2008/QĐ-BNN ngày 11/12/2008 và Thông tư số 06/2010/TT-BNNPTNT ngày 02/02/2010;

b) Điều 2 của Thông tư số 51/2010/TT-BNNPTNT ngày 08/9/2010 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc sửa đổi, bổ sung một số Điều của Thông tư 25/2010/TT-BNNPTNT ngày 08/4/2010 và Thông tư số 06/2010/TT-BNNPTNT ngày 02/02/2010;

c) Điều 2 của Thông tư số 53/2010/TT-BNNPTNT ngày 10/9/2010 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc sửa đổi, bổ sung một số Điều của Quyết định số 86/2005/QĐ-BNN ngày 26/12/2005 và Thông tư số 06/2010/TT-BNNPTNT ngày 02/02/2010.

CIRCULAR

PROVIDING FOR THE QUANRANTINE OF AQUATIC ANIMALS AND ANIMAL PRODUCTS

Pursuant to the Law on Animal Health No. 79/2015 / QH13 dated 19/06/2015;

Pursuant to the Law on Food Safety No. 55/2010 / QH12 dated 17/6/2010;

Pursuant to Decree No. 199/2013 / ND-CP dated 26/11/2013 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

At the request of the Director of Department of Animal Health,

The Minister of Agriculture and Rural Development issues this Circular providing for the quarantine of aquatic animals and animal products.

Article 1. Scope of regulation and subject of application

1. Scope of regulation

This Circular stipulates in detail Paragraph 3, Article 53 of the Law on Animal Health on the List of aquatic animals and animal products subject to the quarantine and non-quarantine; the List of aquatic animals and animal products subject to the analysis of risks before imported into Vietnam; the List of subjects performing the quarantine of aquatic animals and animal products; the content and dossier on quarantine of aquatic animals and animal products transported out of the provincial areas, for export, import, temporary import for re-export, temporary export for re-import, border-gate transfer, bonded warehouse transfer, transit in the territory of Vietnam

2. Subjects of application

This Circular applies to the organizations and individuals pertaining to the production, trading and transportation out of the provincial areas; for export, import, temporary import for re-export, temporary export for re-import, border-gate transfer, bonded warehouse transfer and transit in the territory of Vietnam.

Article 2. Interpretation of terms

In this Circular, the terms below are construed as follows:

1. Aquatic animals used as breed are the ones used to produce the breed, used as breed for commercial raising, ornamental and recreational purposes or for other purposes.

2. Commercial aquatic animals are the live ones which are used as food and materials for processing food, animal feed, aquafeed or for other purposes except the breeding purpose.

4. Place of isolation for quarantine of aquatic animal products is the warehouse and containers for storage of aquatic animal products within a prescribed time for quarantine.

Article 3. List of aquatic animals and animal products subject to the quarantine; List of aquatic animals and animal products subject to the analysis of risks before imported into Vietnam; List of subjects performing the quarantine of aquatic animals and animal

1. The List of aquatic animals and animal products subject to the quarantine and non- quarantine is specified in the Appendix I issued with this Circular.

2. The List of terrestrial animals and animal products subject to the analysis of risks before imported into Vietnam is specified in the Appendix II issued with this Circular.

3. The List of subjects performing the quarantine of aquatic animals and animal products is specified in the Appendix III issued with this Circular.

Chapter II

DOSSIER AND CONTENT OF QUARANTINE

Article 4. Dossier on quarantine registration and declaration

1. The dossier on quarantine registration for transportation of aquatic animals used as the breed out of the provincial areas; commercial aquatic animals and aquatic animal products coming from the disease announcement area out of the provincial areas: Certificate of quarantine registration under the form No. 01 TS in Appendix V issued with this Circular.

a) The written request for instructions on quarantine prepared under the form No. 02 TS in Appendix V issued with this Circular.

b) The copy of Certificate of export quarantine from the competent authorities of the exporting country with the enterprise’s certification (for the aquatic animals and animal products coming from the nations or territories which have not yet the agreement upon Certificate of quarantine with Vietnam);

c) The copy of CITES Permit with the enterprise’s certification for the aquatic animals and animal products named in the List of endangered species of wild fauna and flora according to the laws of Vietnam or the provisions of CITES;

d) The copy of aquatic product import Permit from the Vietnam Directorate of Fisheries with the enterprise’s certification on aquatic animals used as breeds which are not named in the List of aquatic breed permitted for business issued with the Decision No. 57/2008/QD-BNN dated 02/5/2008 of the Ministry of Agriculture and Rural Development; the aquatic animals used as food which are not named in the List of species of live aquatic animals permitted for import as food issued with the Circular No. 04/2015/TT-BNNPTNT dated 12/02/2015 of the Ministry of Agriculture and Rural Development;

3. Dossier on import quarantine declaration of aquatic animal products used as processing materials for exported food; aquatic animal products imported from foreign fishing vessels; aquatic animal products as samples; aquatic animal products recalled or returned;

a) The quarantine declaration is prepared under the Form 03 TS in Appendix V issued with this Circular;

b) The copy with enterprise’s certification or the original of Certificate of quarantine of the exporting country, except the aquatic animal products directly imported from foreign fishing vessels; in case of sending the copy or by the time of sending dossier without providing the Certificate of quarantine from the exporting country must be sent, the original of the Certificate of quarantine from the exporting country must be sent upon check of commodities;

c) The copy of Permit as stipulated under Point c, Paragraph 2 of this Article;

d) The copy with the enterprise’s certification of the papers pertaining to the batch of commodity upon export (the Certificate of food safety, if any, notice of recall of batch of commodity from the enterprise, customs declaration, list of commodities) for the aquatic animal products recalled or returned;

a) The written request for quarantine instructions under the form No.04 TS (form 05 TS for the commodities taken into and out of the bonded warehouse) in the Appendix V issued with this Circular;

b) The copy of commercial Contract with the enterprise’s certification;

c) The copy of Permit as stipulated under Point c, Paragraph 2 of this Article;

d) The copy of Certificate of business code of temporary import for re-export of commodity with the enterprise’s certification;

dd) The copy of commodity transit Permit with the enterprise’s certification;

e) The copy of Permit for temporary import for re-export of commodity with the enterprise’s certification;

g) The copy of Decision on establishment of bonded warehouse with the enterprise’s certification; in case of lease of warehouse, there must be a bonded warehouse lease Contract with the enterprise’s certification (for the commodities taken into and out of the bonded warehouse).

5. The dossier on quarantine registration of aquatic animals and animal products not use as food:

a) The application prepare under the Form No. 03 TS in Appendix V issued with this Circular;

c) The copy of aquatic product export Permit of the Vietnam Directorate of Fisheries with the enterprise’s certification (for the aquatic products to be exported, there must be a permit as stipulated in the Circular No. 04/2015/TT-BNNPTNT dated 12/02/2015 of the Ministry of Agriculture and Rural Development).

6. Dossier on quarantine declaration of aquatic animals and animal products imported for domestic consumption:

a) The application prepare under the Form No. 03 TS in Appendix V issued with this Circular;

b) The copy with enterprise’s certification or the original of Certificate of quarantine of the exporting country; in case of sending the copy or by the time of sending dossier without providing the Certificate of quarantine from the exporting country must be sent, the original of the Certificate of quarantine from the exporting country must be sent upon check of commodities;

7. The dossier on quarantine declaration of aquatic animals and animal products for temporary import for re-export, temporary export for re-import, border-gate transfer, bonded warehouse transfer and transit in the territory of Vietnam:

a) The application prepare under the Form No. 03 TS in Appendix V issued with this Circular;

b) The copy with enterprise’s certification or the original of Certificate of quarantine of the exporting country; in case of sending the copy or by the time of sending dossier without providing the Certificate of quarantine from the exporting country must be sent, the original of the Certificate of quarantine from the exporting country must be sent upon check of commodities;

1. Before transporting the aquatic animals used as breeds out of the provincial areas; the commercial aquatic animals and aquatic animal products coming from the disease announcement area transported out of the provincial areas, the commodity owner shall send a dossier on quarantine registration as stipulated under Point 1, Article 4 of this Circular to the provincial-level body of specialized veterinary management or the authorized district-level level health animal management body (hereafter referred to as the domestic animal quarantine body).

Article 6. Quarantine of aquatic animals used as breed coming from the aquaculture facilities not yet recognized to have the disease free status or their disease status are not yet monitored according to regulations or from the trading and collection facilities transporting the aquatic animals out of the provincial areas

1. The quarantine is carried out right at the temporary animal shelter; tank, breeding pond of the aquaculture facilities and trading and collection facilities.

2. The domestic animal quarantine body shall carry out the quarantine as follows:

a) Checks the amount, type and size of aquatic animals;

b) Performs the clinical check;

c) Takes specimen to check the tanks according to the provisions in Appendix IV issued with this Circular;

d) Checks the veterinary sanitary conditions of means of transportation and the accompanied objects;

dd) Issued the Certificate of quarantine as stipulated under Point d, Paragraph 1, Article 55 of the Law on Animal Health;

e) Checks and monitors the process of loading and unloading of aquatic breed animals onto the means of transportation;

3. In case of positive testing indicator result, the domestic animal quarantine body shall not issue the Certificate of quarantine and handle the case according to the regulations on prevention and control of aquatic animal diseases.

Article 7. Quarantine of aquatic animals used as breed coming from the aquaculture facilities which have disease free status or their disease status is monitored upon transportation out of provincial areas

1. The facilities must ensure the recognition of disease free status or disease surveillance towards the diseases of aquatic animals as stipulated in the Appendix IV issued with this Circular.

2. The domestic animal quarantine body shall:

a) Checks the veterinary sanitary conditions of means of transportation and the accompanied objects;

b) Issue the Certificate of quarantine as stipulated under Point b, Paragraph 2, Article 55 of the Law on Animal Health;

c) Checks and monitors the process of loading and unloading of aquatic breed animals onto the means of transportation;

d) Comply with the provisions stipulated under Point g, Paragraph 2, Article 6 of this Circular.

Article 8. Quarantine of commercial aquatic animals coming from disease announcement area transported out of the provincial areas

a) Checks the amount, type and size of aquatic animals;

b) Performs the clinical check;

c) Takes specimen to check the pathogen towards the commercial aquatic animals infected with the disease which is announced as epidemic as stipulated in Appendix IV issued with this Circular;

d) Complies with the provisions under Points d, dd, e, g, Paragraph 2, Article 6 of this Circular.

2. The aquatic animals harvested from the raising facilities with disease status being announced must be processed (processed by heat or applying specific treatment measures to ensure no spread of disease depending on each type of disease) before being taken out of the disease announcement area.

Article 9. Quarantine of aquatic animal products coming from the disease announcement area transported out of the provincial areas

1. The quarantine is carried out right at the preliminary treatment and processing facilities of the commodity owner.

2. The domestic animal quarantine body shall carry out the quarantine as follows:

a) Checks the amount, type and size of aquatic animal products;

c) Checks the condition of packaging, storage and sensory evaluation towards the aquatic animal products;

d) Checks the veterinary sanitary conditions of means of transportation and the accompanied objects;

dd) Complies with the provisions under Point d, dd and g, Article 6 of this Circular;

e) Carries out or monitors the commodity owner’s clean-up and disinfection of means of transportation and the accompanied objects before the commodities are loaded onto the means of transportation;

g) Checks and monitors the course of loading of aquatic animal products onto the means of transportation; seals the means of transportation; Carries out or monitors the commodity owner’s clean-up and disinfection of place of commodity concentration and loading and unloading.

2. Where the aquatic animal products do not ensure the veterinary sanitary condition, the domestic animal quarantine body shall not issue the Certificate of quarantine and handle the case according to the regulations

Article 10. Control of aquatic animals used as breed in the receiving localities

1. The domestic animal quarantine body in the receiving localities only carries out the inspection of animals used as breed in the following cases:

a) The batch of commodity transported from other provinces without Certificate of quarantine or with invalid Certificate of quarantine;

c) The domestic animal quarantine body detects the pathological signs of aquatic animals.

2. For the batches of commodity to be quarantined, the domestic animal quarantine body shall carry out the quarantine and issue the Certificate of quarantine as stipulated under Points a, b, c, d and dd, Paragraph 2, Article 6 of this Circular.

Article 11. Quarantine of exported aquatic animals and animal products not used as food

1. Quarantine registration

Before export of aquatic animals and animal products with required quarantine, the commodity owner shall send 01 dossier as stipulated in Paragraph 5, Article 4 of this Circular to the area animal health Body or the area animal quarantine Branch under the Department of Animal Health or the provincial-level body of specialized veterinary management authorized by the Department of Animal Health (hereafter referred to as the animal quarantine body at border gate). The way to send dossier: Send by post or email or fax and then send the original or send the dossier personally.

2. Dossier receipt and processing

The dossier receiving body shall verify the dossier validity and require the commodity owners to complete their dossiers according to regulations.

3. The animal quarantine body at border gate shall carry out quarantine as follows:

a) Checks the amount, type and packaging of aquatic animals and animal products;

c) Takes specimen to test the indicators as required by the importing country or the commodity owner (if any) except the disease indicators recognized as safety towards the raising facilities as the origin of the aquatic animals;

d) Issues the Certificate of quarantine as stipulated under Point c, Paragraph 2, Article 42 of the Law on Animal Health.

4. Where the commodity owner or the importing country does not require the quarantine: The commodity owner shall carry out the quarantine for transportation out of the provincial areas as stipulated in Article 6, 7, 8 and 9 of this Circular.

5. For the control of animals and animal products at the export border gate, the animal quarantine body at border gate shall:

a) Check the Certificate of export quarantine;

b) Check the clinical symptoms of aquatic animals, the present condition of commodities, conditions of packaging and storage of aquatic animal products;

c) Confirm, issue or change the Certificate of export quarantine as requested by the commodity owner.

Article 12. Quarantine of aquatic animals and animal products exported for food

1. The commodity owners send 01 dossier as stipulated in Paragraph 1, Article 57 of the Law on Animal Health.

Article 13. Quarantine of aquatic animals and animal products imported for domestic consumption

1. Quarantine registration

a) The commodity owner shall send 01 dossier on quarantine registration as stipulated in Paragraph 2, Article 4 of this Circular to the Department of Animal Health. The way to send dossier: Send by post or email or fax and then send the original or send the dossier personally.

b) The Department of Animal Health shall send a written approval for quarantine to the commodity owner and the animal quarantine body at border gate.

2. Quarantine declaration

a) After getting the written approval from the Department of Animal Health, the commodity owner shall send 01 dossier on quarantine declaration as stipulated in Paragraph 6, Article 4 of this Circular to the animal quarantine body at border gate before the commodities are transported to the import border gate;

b) After receiving the valid dossier, the animal quarantine body at border gate shall inform the commodity owner of the time and location for quarantine. If the dossier is not valid, it shall provide instructions for commodity owner to complete it according to regulations.

3. Preparation for place of isolation for quarantine of imported aquatic animals

a) The commodity owners shall arrange the place of isolation for quarantine;

Where aquatic animals are raised in floating fish cages or fish rafts at sea, they must be raised in isolation in floating fish cages or fish rafts separated from the areas of aquaculture; if the aquatic animals are raised in facilities on land, they must be raised in isolation in separate tank or pond.

c) The animal quarantine body at border gate shall check the veterinary sanitary conditions to ensure the satisfaction of isolation conditions for quarantine and inform the checking result to the commodity owner and the Department of Animal Health by mail or fax and then send the original.

4. Quarantine contents

a) The animal quarantine body at border gate shall comply with the provisions in Article 47 of the Law on Animal Health;

b) For the aquatic animals used as breed: Take specimen for disease testing as stipulated in Appendix IV issued with this Circular;

c) For the commercial aquatic animals: Take specimen to monitor the residue of toxic substances as stipulated in Appendix IV issued with this Circular; only take specimen for testing of aquatic disease in case of detection of aquatic animal’s signs of diseases specified in Appendix III issued with this Circular.

d) The time to raise in isolation for quarantine: No more than 10 days for aquatic animals as breed; no more than 03 days for commercial aquatic animals from the date of isolation for quarantine; where the time of isolation is longer than the above time, the animal quarantine body at border gate shall give a written notice to the commodity owner to specify the reasons;

dd) For the aquatic animal products: Take the specimen to test the indicators as stipulated in Appendix IV issued with this Circular.

5. Issue of Certificate of quarantine

b) Right after the end of time of raising in isolation for quarantine, the animal quarantine body at border gate shall issue the Certificate of import quarantine if the animals are healthy and the tests of disease meet the requirements and inform the animal quarantine body at the place of arrival for the commodity owner to complete the customs.

c) The animal quarantine body at border gate shall inform the animal quarantine body at the place of arrival by email or fax of the information, including: Certificate of quarantine, date of issue and amount of commodities right after the issue of Certificate of quarantine.

6. Notice of violation: In case of detecting the violation of indicators of the batch of commodity checked, the Department of Animal Health shall inform in writing the competent body of the exporting country to investigate the causes and take remedial measures and report the result.

The commodity owner must handle the violating batch of commodity as guided by the animal quarantine body at border gate.

Article 14. Import quarantine of aquatic animal products used as processing materials for exported food; aquatic animal products imported from the foreign fishing vessels; aquatic animal products as samples; exported aquatic animal products recalled or returned

1. The goods owner shall send 01 dossier as stipulated in Paragraph 3, Article 4 of this Circular to the animal quarantine body at border gate where the commodities are imported.

Way to send dossier: Send by post or email or fax and then send the original or send the dossier personally.

Within 01 working day after receiving the dossier, the animal quarantine body at border gate shall confirm the quarantine Declaration for the commodity owner to carry out the customs procedures and inform the commodity owner of the time and location to conduct the quarantine. If the dossier is not valid, the commodity owner shall be instructed to complete it according to regulations.

2. The animal quarantine body at border gate shall carry out the quarantine as follows:

b) In case of suspicion or detection of non-compliance with veterinary sanitary requirements of the commodities, take their specimen to test the veterinary sanitary indicators.

3. Issue of Certificate of quarantine

a) Within 02 working days from the start of quarantine, the animal quarantine body at border gate shall issue the Certificate of import quarantine to the batch of commodity which meets the veterinary sanitary requirements;

b) In case of required taking of specimen of batch of commodity: Within 05 working days from the start of quarantine, the animal quarantine body at border gate shall issue the Certificate of import quarantine to the batch of commodity which meets the veterinary sanitary requirements;

4. Check and monitoring of aquatic animal products imported as processing materials for exported food; the commodities are recalled or returned:

a) Take specimen for monitoring the indicators in accordance with the provisions in Appendix IV issued with this Circular;

b) Notice of violation: Comply with the provisions in Paragraph 6, Article 13 of this Circular.

Article 15. Quarantine of aquatic animals and animal products temporarily imported for re-exported, border-gate transfer and transit in the territory of Vietnam

1. The owner of commodity shall send 01 dossier on quarantine registration as stipulated in Paragraph 4, Article 4 of this Circular to the Department of Animal Health.

2. The Department of Animal Health shall send a written approval for quarantine by email to the commodity owner and the animal quarantine body at border gate.

3. After getting the written approval from the Department of Animal Health, before the commodities are transported to the border gate, the commodity owner sends a dossier on quarantine declaration as stipulated in Paragraph 7, Article 4 of this Circular to the animal quarantine body at border gate.

The animal quarantine body at border gate shall carry out the quarantine as stipulated in Article 50 of the Law on Animal Health.

Article 16. Quarantine of aquatic animals and animal products temporarily exported for re-imported

1. The quarantine for temporary export shall comply with the regulations on export quarantine.

2. The quarantine for temporary import shall comply with the regulations on import quarantine.

Article 17. Quarantine of aquatic animals and animal products taken into and out of the bonded warehouse

1. The commodity owner shall send 01 dossier on quarantine registration as stipulated in Paragraph 4, Article 4 of this Circular to the Department of Animal Health. The way to send dossier: Send by post or email or fax and then send the original or send the dossier personally.

2. The Department of Animal Health shall send a written approval for quarantine by email to the commodity owner and the animal quarantine body at border gate.

4. The animal quarantine body at border gate shall carry out the quarantine of commodities taken into the bonded warehouse as follows:

a) Issues the Certificate of transportation to the commodity owner for transportation from the import border gate to the bonded warehouse;

b) At the bonded warehouse, animal quarantine body at border gate shall coordinate with customs body to check the present conditions of batches of commodity and make confirmation for the commodity owner to take the commodities to the bonded warehouse.

5. Before taking the commodities out of the bonded warehouse, the commodity owner should send the dossier on quarantine declaration to the animal quarantine body at border gate according to the following provisions:

a) For the aquatic animal products used as materials for processing of exported food, the dossier is specified in Paragraph 3, Article 4 of this Circular;

b) For the aquatic animals and animal products exported to the other countries or foreign cruise ships, the dossier is specified in Paragraph 5, Article 4 of this Circular;

c) For the aquatic animals and animal products imported for domestic consumption, the dossier is specified in Paragraph 6, Article 4 of this Circular;

6. The animal quarantine body at border gate shall carry out the quarantine of commodity taken out of the bonded warehouse as follows:

a) Complies with the provisions in Paragraph 2, 3 and 4, Article 14 of this Circular for the aquatic animals and animal products used as materials for processing of exported food;

c) Complies with the provisions under Point a, b, d, Paragraph 3 and Point a, b, Paragraph 5, Article 11 of this Circular; takes specimen for testing the indicators as required by the importing country or the commodity owner (if any) for the exported aquatic animals and animal products;

d) Where the batch of commodity is taken out of the bonded warehouse in part, the animal quarantine body at border gate shall make reconciliation of amount of commodities in the original Certificate of quarantine of the exporting country, keep a copy in the quarantine dossier. The original Certificate of quarantine of the exporting country shall be recovered by the animal quarantine body at border gate and kept in the dossier of the last export of the batch of commodity.

Article 18. Quarantine of aquatic animals and animal products for display in fair, exhibition and art performance

1. The aquatic animals and animal products that are transported out of the provincial areas shall comply with the provisions in Article 6, 7, 8 and 9 of this Circular.

2. The aquatic animals and animal products that are imported shall comply with the provisions in Article 13 of this Circular.

3. Upon the end of fair, exhibition and art performance: The waste and wastewater must be treated to meet the requirements before being discharged into the environment.

Article 19. Quarantine of aquatic animals and animal products exported, carried along or sent by post

1. The commodity owner shall send 01 dossier on quarantine registration to the animal quarantine body at border gate as stipulated in Paragraph 5, Article 4 of this Circular.

2. The animal quarantine body at border gate shall carry out the quarantine as follows:

b) For the aquatic animal products: Checks the appearance, takes specimen to test the veterinary sanitary indicators as required by the commodity owner or the importing country;

c) Provides instructions for the commodity owner on keeping the aquatic animals and packaging the aquatic animal products according to regulations, seal or mark the sent commodities and issue the certificate of quarantine to the aquatic animals and animal products that meet the veterinary sanitary requirements.

d) Provides instructions for the commodity owner on handling the aquatic animals and animal products that fail to meet the veterinary sanitary requirements for export.

Article 20. Quarantine of aquatic animals and animal products imported, carried along or sent by post

1. When importing the aquatic animals and animal products not for commercial purposes, the commodity owner shall submit 01 dossier on import quarantine declaration to the animal quarantine body at border gate as stipulated in Paragraph 6, Article 4 of this Circular.

2. The animal quarantine body at border gate shall carry out the quarantine as follows:

a) Checks the quarantine dossier and Certificate of quarantine of exporting country, makes comparison with the type, amount and quantity of commodities actually imported;

b) Checks the present conditions of the batch of commodity; captivity conditions of aquatic animals; packaging and storage of aquatic animal products;

c) In case of detecting a species of aquatic animal not included in the List of commonly imported aquatic animals, aquatic animals caught with disease or with signs of degeneration, such aquatic animals shall be destroyed or returned to the exporting country;

Article 21. Transportation of specimen of aquatic specimen

1. When requesting to receive the specimen sent to Vietnam from foreign country or send the specimen from Vietnam to foreign country, the commodity owner shall have to send an application for quarantine registration under the Form No. 06 TS issued with the Appendix V of this Circular to the Department of Animal Health.

2. Within 05 working days after receiving the valid application for registration, the Department of Animal Health shall reply to the commodity owner with the approval or disapproval.

3. The animal quarantine body at border gate which carries out the quarantine shall transport the specimen as follows:

a) Checks the written approval of the Department of Animal Health and other relevant documents; condition of packaging and storage of specimen;

b) Issues the Certificate of transportation to the specimen with valid dossier, proper packaging and storage to ensure the veterinary sanitary requirements.

1. Responsibility of Department of Animal Health

a) Checks, evaluates the capacity and decide on authorizing the provincial-level body of specialized veterinary management to carry out quarantine and issue the Certificate of quarantine of imported and exported aquatic animals and animal products at some road border gates;

b) Complies with the provisions under Point a, Paragraph 1 and Point a, Paragraph 2, d 59 of the Law on Animal Health;

c) Provides instructions for the area animal health Body, the area animal quarantine Branch and the provincial-level body of specialized veterinary management to carry out the quarantine of aquatic animals and animal products in accordance with the provisions in this Circular.

2. Responsibility of the area animal health Body, the area animal quarantine Branch and the authorized provincial-level body of specialized veterinary management

a) Carry out the quarantine and issue the Certificate of quarantine of imported and exported aquatic animals and animal products according to regulations;

b) Make the monthly, quarterly and yearly reports to the Department of Animal Health on the imported and exported aquatic animals and animal products.

3. Responsibility of the provincial-level bodies of specialized veterinary management

a) Carry out the quarantine of aquatic animals and animal products domestically circulating in accordance with the provisions in this Circular and instructions of the Department of Animal Health;

c) Make the monthly, quarterly and yearly reports to the Department of Animal Health on the aquatic animals and animal products domestically circulating.

4. The National Agro-Forestry-Fisheries Quality Assurance Department shall organize the quarantine of exported aquatic animals and animal products used as food in accordance with the provisions in this Circular.

5. Responsibility of commodity owners

a) Comply with the provisions in this Circular, the law on animal health and other relevant laws in quarantine of aquatic animals and animal products;

b) Pay all expenses of quarantine, testing and actual expenses for the treatment and destruction of batches of commodity that fail to meet the requirements (if any) according to the current regulations.

Article 23. Transitional provisions

The printed forms of Certificate of quarantine of aquatic animals and animal products domestically transported as stipulated in the Circular No. 06/2010/TT-BNNPTNT dated 02/02/2010 of the Minister of Agriculture and Rural Development stipulating the order and procedures for quarantine of aquatic animals and animal products are permitted for use by the end of 30/6/2017.

b) The Article 2 of Circular No. 51/2010/TT-BNNPTNT dated 08/9/2010 of the Minister of Agriculture and Rural Development on amending and adding some Articles of the Circular No. 25/2010/TT-BNNPTNT dated 08/4/2010 and the Circular No. 06/2010/TT-BNNPTNT dated 02/02/2010;

c) The Article 2 of Circular No. 53/2010/TT-BNNPTNT dated 10/9/2010 of the Minister of Agriculture and Rural Development on amending and adding some Articles of the Decision No. 86/2005/QD-BNN dated 26/12/2005 and the Circular No. 06/2010/TT-BNNPTNT dated 02/02/2010.

4. Any difficulty or problem arising during the implementation of this Circular should be promptly reported to Ministry of Agriculture and Rural Development for timely settlement./.

1. For aquaculture facilities which are not yet recognized as having a disease free status or their disease status is not yet monitored, or trading and collection facilities: Collect the specimens once every two months for supervision of disease indicators as specified in section I hereof.

2. The prevalence of specimens collected for supervision is estimated at 10% according to the guidelines specified in section III hereof.

3. If the animals are healthy without any signs of disease based on the results of periodical disease supervision and clinical examination (supervision and examination are carried out before transporting aquatic animals out of the province), the domestic animal quarantine body shall issue the certificate of quarantine and transport these animals out of the province.

2.1. Indicators for residual chemicals, antibiotics, heavy metals and animal protection drugs:

2.3. Methods for monitoring inspection:

a. Annually, the Veterinary Department shall provide specific guidance on indicators and quantity of collected specimens of commercial aquatic products and imported aquatic products, based on the actual conditions that require the pathogens and residual amounts of hazardous chemicals to be controlled (heavy metals, animal protection chemicals, veterinary medicines and other hazardous chemicals).

b. Frequencies of specimen collection:

- Collect specimens of 01 batch of products for every 06 batch of products of same type, origin and importer. Such specimens are collected for inspection of monitorable indicators.

- If the indicators do not satisfy the requirements, the animal quarantine body at border gate shall increase the rates of collected specimens: For every 03 batches of products, collect specimens of 01 batch to compare with the unsatisfactory indicators.

c. Handling of supervision results:

- If the results of 03 consecutive inspections show that the indicators are satisfactory, such indicators shall be exempt from monitoring inspection in the following imports and until the end of the supervision.

- If the specimens of all batches of products are collected for inspection, the results shall be handled as follows:

+ For every 06 batches of products, collect the specimens of 01 batch for inspection, if the results of 03 consecutive inspections are satisfactory.

+ Continue to collect specimens of all batches of products for inspection if the results show that the indicators of specimens from 01 to 02 batches are not satisfactory.

+ Halt the imports if the results show that the indicators of specimens from 03 batches of products violate the regulations.

d. Evaluate the monitorable indicators based on the inspection results: Vietnamese and international regulations, standards and technical regulations on food safety.

dd. The animal quarantine body at border gate shall timely report about the unsatisfactory batch of products to the Veterinary Department as required.
