CIRCULAR
PROVIDING
INSTRUCTIONS ON SEVERAL ARTICLES ON LIVESTOCK PRODUCTION ACTIVITIES IN THE LAW
ON ANIMAL HUSBANDRY
Pursuant to the Government's Decree No.
15/2017/ND-CP dated February 17, 2017, defining the functions, tasks, powers and
organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Animal Husbandry dated
November 19, 2018;
Upon the request of the Director of the
Department of Livestock Production;
The Minister of Agriculture and Rural
Development promulgates the Circular providing instructions on several Articles
on livestock production activities in the Law on Animal Husbandry.

1. This Circular provides instructions for clause 3
of Article 8, point a of clause 2 of Article 23, clause 2 of Article 54, clause
3 of Article 55 and clause 3 of Article 65 in the Law on Animal Husbandry.
2. Criteria and recognition of disease-free
livestock production zones shall be subject to regulations enshrined in the
Circular No. 14/2016/TT-BNNPTNT dated June 2, 2016 of the Minister of
Agriculture and Rural Development on disease-free zones and establishments for
animal production.
Article 2. Subjects of
application
This Circular shall apply to domestic and overseas
entities and persons involved in livestock production activities within the
territory of Vietnam.
Chapter II
SPECIFIC GUIDANCE
Article 3. Regulations on
certificates of training in artificial insemination, certificates of training
in embryo transfer techniques
1. The Department of Livestock Production shall
develop the program framework and approve the period of training in artificial
insemination or embryo transfer techniques for buffalo, cows, goats, sheep and
horses.
2. Livestock production training institutions shall
design curricula and syllabi based on the aforesaid program framework decided
by the Department of Livestock Production; shall organize training activities,
and confer certificates of training in artificial insemination or embryo
transfer techniques according to sample certificates given in Appendix I
hereto.

1. Livestock farming entities and persons shall be
obliged to register their livestock production business, including livestock
breeds and the culture stock, according to Appendix II hereto.
2. Animal farming entities and persons shall be
obligated to submit the registers of their livestock production activities from
the 25th to 30th day of the month ending each quarter by
using the sample register given in Appendix III hereto.
Article 5. Regulations on
minimum safety distances from or between livestock farms
1. Principles of determination of distances from or
between livestock farms
a) Distance from a livestock farm to an affected
subject is determined as the shortest gap between an animal cage or an animal
waste dumping site to fence or boundary line of the affected subject;
b) Distance between livestock farms is the shortest
distance from an animal cage or animal waste dumping site of this livestock
farm to that of the other.
2. The minimum distance from a small-scale
livestock farm to a concentrated domestic or industrial waste disposal zone or
a residential area is 100 meters; to a school, hospital, market or source of
tap water for residential community is 150 meters.
3. The minimum distance from a medium-scale
livestock farm to a concentrated domestic or industrial waste disposal zone or
a residential area is 200 meters; to a school, hospital or market is 300 meters.
4. The minimum distance from a large-scale
livestock farm to a concentrated domestic or industrial waste disposal zone or
a residential area is 400 meters; to a school, hospital, market or source of
tap water for residential community is 500 meters.

Article 6. Regulations on
distance and honeybee flock movement practices
1. Distance between points of honeybee hive
placement
a) Point of honeybee hive placement is a place
where at least 50 domestic flocks of honeybees or 100 alien flocks of
honeybees;
b) The required minimum distance between two
placement points of domestic honeybee hives is 01 kilometer; between two
placement points of alien honeybee hives is 02 kilometers; between two
placement points of domestic and alien honeybee hives is 02
kilometers.
2. Honeybee flock movement practices
Movement of honeybee flocks shall be permitted if
honeybee flocks to be moved must be of clear origin; the planned itinerary must
be followed; appropriate means of transport must meet honeybee flock biosafety,
human and environmental safety requirements.

a) Take control of registering livestock production
and other related activities nationwide.
b) Develop the program framework (including
training contents and period) for training in artificial insemination or embryo
transfer techniques for buffalo, cows, goats, sheep and horses.
c) Carry out inspection and assessment of livestock
production activities nationwide.
2. Departments of Agriculture and Rural
Developments in provinces and centrally-affiliated cities
a) Implement regulations pertaining to livestock
production activities as set out herein within localities under their
management;
b) Conduct inspection and assessment of livestock
production activities within their remit;
c) Consolidate and send general reports on results
of register of livestock production activities taking place within their remit
to the Department of Livestock production on a periodic basis by the 10th
day of the first month of the subsequent quarter or as requested by other
competent authorities.
3. Livestock production entities or persons:
Livestock production entities and persons shall be
responsible for implementing regulations laid down herein and other provisions
of related laws.

Persons obtaining certificates of training in
artificial insemination or certificates of training in embryo transfer
techniques before the entry into force of this Circular may continue to use
these certificates.
Article 9. Entry into force
This Circular shall enter into force on January 15,
2020.
In the course of implementation of this Circular,
if there is any difficulty or query that arises, entities and persons involved
should report to the Ministry of Agriculture and Rural Development to seek its
decision on necessary amendments and supplements thereto./.
