QUYẾT ĐỊNH

CỦA BỘ TRƯỞNG BỘ GIAO THÔNG VẬN TẢI SỐ 750 /2000/QĐ-BGTVT NGÀY 30 THÁNG 3 NĂM 2000 VỀ VIỆC BAN HÀNH QUY CHẾ HUẤN LUYỆN, BỒI DƯỠNG CẬP NHẬT, THI VÀ CẤP CHỨNG CHỈ CHUYÊN MÔN HOA TIÊU HÀNG HẢI)

Căn cứ Điều 158 Bộ Luật Hàng Hải Việt Nam ban hành ngày 30-6-1990 và Nghị quyết A.485(XII) của Tổ chức Hàng hải Quốc tế (IMO);
Căn cứ Nghị định số 22/CP ngày 22-3-1994 của Chính phủ quy định nhiệm vụ, quyền hạn, trách nhiệm quản lý Nhà nước của Bộ Giao thông vận tải.
Theo đề nghị của Vụ trưởng Vụ Tổ chức cán bộ - lao động và Cục trưởng Cục Hàng Hải Việt Nam.

QUYẾT ĐỊNH

Điều 1- Ban hành kèm theo Quyết định này "Quy chế Huấn luyện, Bồi dưỡng cập nhật, Thi và cấp Chứng chỉ chuyên môn Hoa tiêu Hàng hải".

Điều 2- Quyết định này có hiệu lực sau 15 ngày kể từ ngày ký; các quy định trước đây liên quan đến tổ chức huấn luyện, bồi dưỡng cập nhật, thi và cấp chứng chỉ chuyên môn hoa tiêu hàng hải trái với những quy định ban hành kèm theo Quyết định này đều bị bãi bỏ.

Điều 3- Các ông (bà): Chánh Văn phòng Bộ, Vụ trưởng Vụ Tổ chức cán bộ - lao động, Cục trưởng Cục Hàng Hải Việt Nam và Thủ trưởng các cơ quan, đơn vị có liên quan chịu trách nhiệm thi hành quyết định này.

QUY CHẾ

HUẤN LUYỆN, BỒI DƯỠNG CẬP NHẬT, THI VÀ CẤP CHỨNG CHỈ CHUYÊN MÔN HOA TIÊU HÀNG HẢI

Chương 1

NHỮNG QUY ĐỊNH CHUNG

Điều 1: Quy chế này quy định về huấn luyện, bồi dưỡng cập nhật, tổ chức thi và cấp chứng chỉ chuyên môn hoa tiêu hàng hải cho hoa tiêu hàng hải Việt Nam.

Điều 2: Nguyên tắc chung

1. Mọi công việc huấn luyện, bồi dưỡng cập nhật, tổ chức thi và cấp chứng chỉ chuyên môn hoa tiêu hàng hải đối với hoa tiêu hàng hải Việt Nam (sau đây gọi tắt là hoa tiêu hàng hải) phải tuân theo những quy định của Quy chế này.

2. Chỉ có những hoa tiêu hàng hải đã qua huấn luyện, bồi dưỡng cập nhật, dự thi và được cấp chứng chỉ chuyên môn hoa tiêu hàng hải theo những quy định của Quy chế này mới được phép hành nghề hoa tiêu hàng hải tại Việt Nam.

3. Hoa tiêu hàng hải quá 60 tuổi không được hành nghề hoa tiêu.

Trường hợp đặc biệt, Cục trưởng Cục Hàng hải Việt Nam có thể căn cứ vào nhu cầu thực tế và đề nghị của Giám đốc tổ chức hoa tiêu hàng hải để xem xét từng trường hợp cụ thể cho phép hoa tiêu hàng hải ngoại hạng trên 60 tuổi dẫn tàu với điều kiện hoa tiêu đó phải có đủ sức khoẻ, trình độ chuyên môn, nghiệp vụ , tuổi không quá 62 và có đơn tình nguyện tiếp tục hành nghề hoa tiêu hàng hải.

4. Giám đốc tổ chức Hoa tiêu phải có Bằng Đại học Hàng hải và có thời gian hành nghề Hoa tiêu hàng hải ít nhất 5 năm; có năng lực tổ chức quản lý, am hiểu pháp luật hàng hải, pháp luật khác có liên quan của Việt Nam và các Điều ước quốc tế có liên quan về hàng hải mà Việt Nam đã ký kết hoặc công nhận.

5. Nghiêm cấm việc bố trí những người không có chứng chỉ chuyên môn hoa tiêu hàng hải, tuổi và sức khoẻ phù hợp để dẫn tàu hoạt động trong các vùng hoa tiêu hàng hải bắt buộc ở Việt Nam.

Chương 2

HỆ THỐNG CHỨNG CHỈ CHUYÊN MÔN VÀ CHỨC DANH HOA TIÊU HÀNG HẢI

Điều 3:

1. Hệ thống chứng chỉ chuyên môn hoa tiêu hàng hải bao gồm:

a) "Giấy chứng nhận khả năng chuyên môn hoa tiêu hàng hải" (sau đây viết tắt là GCNKNCM HTHH): Là chứng chỉ cấp cho các hoa tiêu hàng hải có đủ khả năng chuyên môn đảm nhiệm các chức danh hoa tiêu hàng hải đáp ứng các quy định tại Chương III và Chương V của Quy chế này.

b) "Giấy Chứng nhận Vùng hoạt động hoa tiêu hàng hải": Là chứng chỉ cấp cho các hoa tiêu hàng hải đã có GCNKNCM HTHH, đủ thời gian thực tập theo các quy định tại Chương VI của Quy chế này.

2. Mẫu các loại chứng chỉ chuyên môn hoa tiêu hàng hải:

Mẫu các loại chứng chỉ chuyên môn hoa tiêu hàng hải do Bộ trưởng Bộ Giao thông vận tải phê duyệt trên cơ sở đề nghị của Cục Hàng hải Việt Nam. Cục Hàng hải Việt Nam có trách nhiệm tổ chức in, phân phối, quản lý và hướng dẫn việc cấp, đổi chứng chỉ chuyên môn hoa tiêu hàng hải trong phạm vi cả nước.

Điều 4: Quy định về chức danh hoa tiêu hàng hải

1. Chức danh hoa tiêu hàng hải bao gồm:

a) Hoa tiêu hàng hải hạng ba;

b) Hoa tiêu hàng hải hạng nhì;

c) Hoa tiêu hàng hải hạng nhất;

d) Hoa tiêu hàng hải ngoại hạng.

2. Phạm vi được phép hành nghề của các chức danh hoa tiêu hàng hải:

Hoa tiêu hàng hải được cấp GCNKNCM HTHH hạng nào thì chỉ được phép hành nghề hoa tiêu hàng hải trên các tàu biển trong giới hạn của hạng đó theo những quy định sau:

a) Hoa tiêu hàng hải hạng ba:

Hoa tiêu hàng hải hạng ba chỉ được phép dẫn các loại tàu biển có tổng dung tích dưới 4000 GT hoặc có chiều dài tối đa đến 115 m.

b) Hoa tiêu hàng hải hạng nhì:

Hoa tiêu hàng hải hạng nhì chỉ được phép dẫn các loại tàu biển có tổng dung tích dưới 10.000 GT hoặc có chiều dài tối đa đến 145m.

c) Hoa tiêu hàng hải hạng nhất:

Hoa tiêu hàng hải hạng nhất chỉ được phép dẫn các loại tàu biển có tổng dung tích dưới 20.000 GT hoặc có chiều dài tối đa đến 175m.

d) Hoa tiêu hàng hải ngoại hạng :

Hoa tiêu hàng hải ngoại hạng được phép dẫn tất cả các loại tàu biển không giới hạn tổng dung tích hoặc chiều dài của tàu.

Chương 3

ĐIỀU KIỆN ĐỂ ĐƯỢC CẤP GIẤY CHỨNG NHẬN KHẢ NĂNG CHUYÊN MÔN HOA TIÊU HÀNG HẢI

Điều 5: Quy định về các điều kiện chung

Để được cấp GCNKNCM HTHH, phải có đầy đủ các điều kiện chung như sau:

1. Có giấy chứng nhận sức khỏe đáp ứng các tiêu chuẩn quy định hiện hành đối với hoa tiêu hàng hải;

2. Đã tốt nghiệp chuyên ngành điều khiển tàu biển ở các trường hàng hải từ bậc cao đẳng trở lên;

Nếu tốt nghiệp chuyên ngành trên ở các trường khác (như trường Hải quân, Thuỷ sản...) còn phải thoả mãn thêm điều kiện: Phải qua lớp bổ túc những môn chưa học hoặc học chưa đủ tại các Trường do Bộ Giao thông vận tải quy định và được trường đó cấp chứng chỉ hoàn thành khoá học.

3. Đã tốt nghiệp khoá huấn luyện nghiệp vụ hoa tiêu hàng hải;

4. Được bồi dưỡng cập nhật kiến thức chuyên môn và trình độ tiếng Anh chuyên ngành phù hợp với trình độ các hạng hoa tiêu hàng hải (trừ hoa tiêu hàng hải hạng ba);

5. Có đủ thời gian thực tập hoặc lượt dẫn tàu an toàn theo quy định cho từng hạng tại Điều 6 của Quy chế này;

6. Làm đầy đủ hồ sơ theo quy định của Cục Hàng hải Việt Nam.

Điều 6: Các tiêu chuẩn cụ thể

Ngoài các điều kiện chung được quy định tại Điều 5 của Quy chế này, phải thoả mãn các tiêu chuẩn cụ thể sau để được cấp GCNKNCM HTHH cho từng hạng:

1. Hoa tiêu hàng hải hạng ba:

Đã thực tập hoa tiêu hàng hải hạng ba dưới sự hướng dẫn của hoa tiêu đã có GCNKNCM HTHH với thời gian ít nhất là 36 tháng hoặc có thời gian thực tập dẫn tàu an toàn ít nhất là 300 lượt tàu và được đơn vị hoa tiêu nơi hướng dẫn thực tập xác nhận.

2. Hoa tiêu hàng hải hạng nhì:

a) Có GCNKNCM HTHH hạng ba, đã độc lập dẫn tàu an toàn ít nhất là 200 lượt tàu với cương vị hoa tiêu hàng hải hạng ba hoặc có thời gian đảm nhiệm tốt công việc của hoa tiêu hàng hải hạng ba ít nhất là 24 tháng.

b) Riêng đối với người có GCNKNCM thuyền trưởng tàu biển có tổng dung tích từ 500 GT trở lên và đã có thời gian đảm nhiệm chức danh thuyền trưởng tương ứng ít nhất 36 tháng thì được dự thi để cấp GCNKNCM HTHH hạng nhì, nhưng phải thoả mãn đủ các điều kiện sau:

i) Đã tốt nghiệp chuyên ngành điều khiển tàu biển từ bậc cao đẳng trở lên;

ii) Đã tốt nghiệp khoá huấn luyện nghiệp vụ hoa tiêu hàng hải;

iii) Có thời gian dẫn tàu an toàn ít nhất 150 lượt tàu có tổng dung tích từ 4.000 GT trở lên với cương vị thực tập hoa tiêu hàng hải hạng nhì hoặc có thời gian thực tập hoa tiêu hàng hải hạng nhì ít nhất 12 tháng và được đơn vị hoa tiêu nơi hướng dẫn thực tập xác nhận.

3. Hoa tiêu hàng hải hạng nhất:

Đã tốt nghiệp chuyên ngành điều khiển tàu biển bậc đại học; Có GCNKNCM HTHH hạng nhì, đã độc lập dẫn tàu an toàn ít nhất 200 lượt tàu với cương vị hoa tiêu hàng hải hạng nhì hoặc có thời gian đảm nhiệm tốt công việc của hoa tiêu hàng hải hạng nhì ít nhất 24 tháng; Ngoài ra phải có thời gian thực tập hoa tiêu hàng hải hạng nhất ít nhất 6 tháng hoặc đã thực tập dẫn tàu an toàn ít nhất 30 lượt tàu có tổng dung tích từ 10.000 GT trở lên dưới sự hướng dẫn của hoa tiêu hàng hải có GCNKNCM HTHH từ hạng nhất trở lên và được đơn vị hoa tiêu nơi hướng dẫn thực tập xác nhận.

4. Hoa tiêu hàng hải ngoại hạng:

Đã tốt nghiệp chuyên ngành điều khiển tàu biển bậc đại học; Có GCNKNCM HTHH hạng nhất, đã độc lập dẫn tàu an toàn ít nhất 300 lượt tàu với cương vị hoa tiêu hàng hải hạng nhất hoặc có thời gian đảm nhiệm tốt công việc của hoa tiêu hàng hải hạng nhất ít nhất 36 tháng; Ngoài ra phải có thời gian thực tập hoa tiêu hàng hải ngoại hạng ít nhất 6 tháng hoặc đã thực tập dẫn tàu an toàn ít nhất 30 lượt tàu có tổng dung tích từ 20.000 GT trở lên dưới sự hướng dẫn của hoa tiêu hàng hải có GCNKNCM HTHH ngoại hạng và được đơn vị hoa tiêu nơi hướng dẫn thực tập xác nhận.

Chương 4

CHƯƠNG TRÌNH VÀ CƠ SỞ HUẤN LUYỆN, BỒI DƯỠNG CẬP NHẬT KIẾN THỨC CHUYÊN MÔN CHO HOA TIÊU HÀNG HẢI

Điều 7:Chương trình huấn luyện, bồi dưỡng cập nhật

1. Để đáp ứng hệ thống chứng chỉ chuyên môn hoa tiêu hàng hải được quy định tại Điều 3 của Quy chế này, chương trình cho các khoá huấn luyện nghiệp vụ và bồi dưỡng cập nhật kiến thức chuyên môn cho hoa tiêu hàng hải phải đáp ứng các nội dung được quy định tại Nghị quyết A.485(XII) của Tổ chức Hàng hải Quốc tế và phù hợp điều kiện thực tế hoa tiêu hàng hải tại Việt Nam.

2. Cục Hàng hải Việt Nam có trách nhiệm chủ trì, phối hợp với các đơn vị liên quan biên soạn chương trình huấn luyện, bồi dưỡng cập nhật kiến thức chuyên môn cho hoa tiêu hàng hải để trình Bộ Giao thông vận tải phê duyệt.

Điều 8: Cơ sở huấn luyện bồi dưỡng cập nhật kiến thức mới cho hoa tiêu hàng hải (gọi tắt là cơ sở huấn luyện)

1. Các khoá huấn luyện, bồi dưỡng cập nhật kiến thức mới cho hoa tiêu hàng hải được tổ chức tại các cơ sở huấn luyện làm cơ sở để cấp mới, chuyển đổi, gia hạn GCNKNCM HTHH cho từng hạng hoa tiêu hàng hải.

2. Cơ sở huấn luyện phải đảm bảo tổ chức huấn luyện, bồi dưỡng cập nhật kiến thức mới cho hoa tiêu hàng hải theo đúng chương trình được Bộ Giao thông vận tải phê duyệt.

3. Các cơ sở huấn luyện nêu trong Quy chế này phải đáp ứng đầy đủ các điều kiện, tiêu chuẩn về cơ sở vật chất, trang thiết bị, tài liệu và đội ngũ giảng viên và được Bộ Giao thông vận tải cho phép.

4. Định kỳ hàng năm, Bộ Giao thông vận tải sẽ kiểm tra các cơ sở huấn luyện đã được Bộ cấp giấy phép. Bộ sẽ rút Giấy phép huấn luyện hoa tiêu hàng hải đối với những cơ sở không chấp hành những quy định của Bộ.

5. Các cơ sở được cấp Giấy phép huấn luyện hoa tiêu hàng hải có nghĩa vụ:

a) Tổ chức huấn luyện, bồi dưỡng cập nhật theo chương trình đã được Bộ phê duyệt.

b) Theo dõi khoá huấn luyện, bồi dưỡng cập nhật và đánh giá kết quả huấn luyện.

c) Quản lý việc huấn luyện, bồi dưỡng cập nhật bằng hệ mạng tin học nối với Trung tâm quản lý chứng chỉ của Cục Hàng hải Việt Nam.

d) Sau mỗi khoá huấn luyện, bồi dưỡng cập nhật báo cáo tình hình khoá học về Cục Hàng hải Việt nam.

Chương 5

QUY ĐỊNH VỀ THI VÀ CẤP GIẤY CHỨNG NHẬN KHẢ NĂNG CHUYÊN MÔN HOA TIÊU HÀNG HẢI

Điều 9:

Căn cứ vào nhu cầu thực tế, Cục Hàng hải Việt Nam chỉ đạo việc mở khoá huấn luyện, bồi dưỡng cập nhật và tổ chức các kỳ thi để cấp GCNKNCM HTHH cho Hoa tiêu Hàng hải Việt Nam.

Điều 10:

1. Cục trưởng Cục Hàng hải Việt nam ra quyết định thành lập Hội đồng thi Hoa tiêu Hàng hải cho mỗi kì thi tuỳ thuộc vào nội dung và quy mô của từng khoá bồi dưỡng.

Hội đồng thi Hoa tiêu Hàng hải gồm các thành viên: Chủ tịch Hội đồng là người được Cục trưởng Cục Hàng hải Việt Nam uỷ quyền, các uỷ viên là đại diện Ban chức năng của Cục, thủ trưởng cơ sở huấn luyện, đại diện cơ quan quản lí đào tạo cấp Bộ và Trưởng Ban giám khảo kì thi.

2. Ban Giám khảo các khoá thi Hoa tiêu Hàng hải do Hội đồng thi Hoa tiêu Hàng hải lựa chọn và đề nghị Cục trưởng Cục Hàng hải Việt Nam quyết định, bao gồm các thành viên có tiêu chuẩn chuyên môn sau:

a) Các Hoa tiêu Hàng hải có GCNKNCM HTHH trên một hạng của Hạng được tổ chức thi, hoặc cùng hạng đối với kỳ thi Hoa tiêu Hàng hải ngoại hạng, và đã có thâm niên đảm nhiệm chức danh Hoa tiêu Hàng hải tương ứng ít nhất là ba năm.

b) Các Thuyền trưởng Hạng nhất đã đảm nhiệm chức danh tương ứng ít nhất ba năm và các chuyên gia có uy tín về chuyên môn, nghiệp vụ.

Ngoài các tiêu chuẩn chuyên môn nghiệp vụ trên, các thành viên Ban Giám khảo phải là những người có phẩm chất đạo đức tốt , nếp sống lành mạnh, trung thực; không cửa quyền, tham nhũng và phải có kiến thức sư phạm.

Điều 11:

Hội đồng thi để cấp GCNKNCM HTHH có nhiệm vụ làm tư vấn cho Cục trưởng Cục Hàng hải Việt Nam về tổ chức chỉ đạo, giám sát các kỳ thi Hoa tiêu hàng hải, cụ thể là:

1. Xét duyệt danh sách thí sinh của các khoá thi theo các điều kiện được quy định tại chương III của Quy chế này;

2. Chuẩn bị các đề thi;

3. Điều hành và kiểm tra các kì thi;

4. Xử lý các vụ việc xảy ra trong các kỳ thi (nếu có);

5. Tổ chức chấm thi;

6. Tổng hợp kết quả của kì thi, báo cáo Cục trưởng Cục Hàng hải Việt Nam phê duyệt.

Điều 12:

1. Căn cứ biên bản của Hội đồng thi, Cục trưởng Cục Hàng hải Việt Nam ra quyết định công nhận trúng tuyển để cấp, đổi GCNKNCM HTHH cho Hoa tiêu Hàng hải.

2. Thí sinh dự thi đạt yêu cầu tất cả các môn thi theo quy định (Đạt điểm 5 trở lên trên thang điểm 10) thì được công nhận trúng tuyển kỳ thi.

3. Trường hợp thí sinh chỉ có 1/2 số môn đạt yêu cầu thì kết quả các môn này sẽ được bảo lưu trong thời gian một năm.

Điều 13

1. GCNKNCM HTHH cấp cho hoa tiêu tất cả các hạng chỉ có giá trị sử dụng trong 5 năm kể từ ngày cấp.

2. Khi hết hạn sử dụng, muốn được gia hạn hoặc đổi, xin cấp mới phải có đủ hai điều kiện sau:

a) Có tuổi và sức khoẻ phù hợp với quy định tại Khoản 3 Điều 2 và Khoản 1 Điều 5 của Quy chế này;

b) Đã đảm nhiệm chức danh phù hợp với GCNKNCM HTHH được tổng cộng 24 tháng trở lên trong vòng 5 năm.

3. Người có GCNKNCM HTHH hết hạn sử dụng đã đáp ứng tiêu chuẩn quy định tại Điểm a nhưng chưa đáp ứng được tiêu chuẩn quy định tại Điểm b Khoản 2 Điều này muốn được gia hạn, hoặc đổi, xin cấp mới thì phải qua thời gian thực tập ít nhất 3 tháng.

Điều 14:

Trong trường hợp Hoa tiêu Hàng hải có hành vi vi phạm pháp luật gây hậu quả thì tuỳ theo mức độ vi phạm, Cục trưởng Cục Hàng hải Việt Nam có quyền tạm đình chỉ hành nghề Hoa tiêu hoặc thu hồi chứng chỉ chuyên môn của Hoa tiêu Hàng hải. Việc thu hồi chứng chỉ chuyên môn Hoa tiêu Hàng hải do Hội đồng thi Hoa tiêu Hàng hải đề nghị Cục trưởng Cục Hàng hải Việt Nam xem xét, quyết định.

Chương 6

QUY ĐỊNH VỀ CẤP GIẤY CHỨNG NHẬN VÙNG HOẠT ĐỘNG HOA TIÊU HÀNG HẢI

Điều 15:

Căn cứ vào GCNKNCM HTHH đã cấp, thời gian thực tập, Cục trưởng Cục Hàng hải Việt Nam ra quyết định cấp "Giấy Chứng nhận Vùng hoạt động hoa tiêu hàng hải "theo những nguyên tắc sau:

1. Những người đã có GCNKNCM HTHH và đã qua thực tập điều động dẫn tàu an toàn theo quy định tại Điều 6 của Quy chế này ở khu vực nào thì được cấp "Giấy Chứng nhận Vùng hoạt động hoa tiêu hàng hải" cho khu vực đó.

2. Việc cấp "Giấy Chứng nhận Vùng hoạt động hoa tiêu hàng hải" do Giám đốc tổ chức hoa tiêu hàng hải đề nghị và có xác nhận về khả năng thực tế dẫn tàu của hoa tiêu đó của giám đốc cảng vụ hàng hải tại khu vực dẫn tàu.

Điều 16:

"Giấy Chứng nhận Vùng hoạt động hoa tiêu hàng hải" có thời gian sử dụng bằng thời hạn sử dụng của GCNKNCM HTHH được cấp và trong khoản thời gian GCNKNCM HTHH còn giá trị sử dụng thì:

1. Hoa tiêu hàng hải được cấp "Giấy Chứng nhận Vùng hoạt động hoa tiêu hàng hải" cho khu vực hoa tiêu hàng hải nào thì chỉ được phép hành nghề hoa tiêu hàng hải tại khu vực đó.

2. Hoa tiêu hàng hải chuyển đến khu vực khác phải qua một thời gian thực tập ít nhất 06 tháng và chỉ sau khi được cấp "Giấy Chứng nhận Vùng hoạt động hoa tiêu hàng hải" tại khu vực đó thì mới được phép hành nghề hoa tiêu.

Chương 7

ĐIỀU KHOẢN THI HÀNH

Điều 17:

1. Những quy định về tiêu chuẩn thi và cấp chứng chỉ chuyên môn hoa tiêu hàng hải ban hành kèm theo Quyết định số 2384/QĐ-PC ngày 17/11/1994 của Bộ trưởng Bộ Giao thông vận tải vẫn tiếp tục có hiệu lực cho tới khi Cục Hàng hải Việt Nam tổ chức được khoá thứ nhất huấn luyện, bồi dưỡng cập nhật và tổ chức thi, cấp các loại chứng chỉ chuyên môn hoa tiêu hàng hải theo những quy định của Quy chế này.

2. Cục Hàng hải Việt Nam có trách nhiệm chuẩn bị và trình Bộ Giao thông vận tải để phê duyệt dự thảo chương trình huấn luyện, bồi dưỡng cập nhật, đề án về cơ sở huấn luyện và mẫu chứng chỉ chuyên môn hoa tiêu hàng hải theo những quy định của Quy chế này trước ngày 01/02/2001.

Điều 18:

1. Cục Hàng hải Việt Nam hướng dẫn cách thức, thủ tục và thực hiện chuyển đổi các loại chứng chỉ chuyên môn Hoa tiêu Hàng hải cũ sang chứng chỉ chuyên môn Hoa tiêu Hàng hải mới tương ứng.

2. Việc chuyển đổi Bằng Hoa tiêu Hàng hải và Giấy phép vùng hoạt động hoa tiêu hàng hải đã được cấp theo những quy định kèm theo Quyết định số 2384/QĐ-PC ngày 17/11/1994 của Bộ trưởng Bộ Giao thông vận tải sang các GCNKNCM HTHH và Giấy Chứng nhận Vùng hoạt động hoa tiêu hàng hải mới tương ứng phải hoàn thành trước ngày 01/02/2005.

3. Các loại Bằng Hoa tiêu Hàng hải và Giấy phép vùng hoạt động hoa tiêu hàng hải đã được cấp theo những quy định kèm theo Quyết định số 2384/QĐ-PC ngày 17/11/1994 của Bộ trưởng Bộ Giao thông vận tải tiếp tục có giá trị sử dụng đến ngày 01/02/2005.

4. Sau ngày 01/02/2005, các loại Bằng Hoa tiêu Hàng hải và Giấy phép vùng hoạt động hoa tiêu hàng hải nói tại Khoản 3 Điều này sẽ hết hiệu lực.

Điều 19:

Cục trưởng Cục Hàng hải Việt Nam phối hợp với Vụ trưởng Vụ Tổ chức cán bộ và lao động tổ chức hướng dẫn, kiểm tra thực hiện Quy chế này.

DECISION

ISSUING THE REGULATION ON THE MARITIME PILOTAGE TRAINING, UPDATE FOSTERING, EXAMINATION AND GRANTING PROFESSIONAL CERTIFICATES THEREOF

Pursuant to Article 158 of Vietnam’s Maritime Code promulgated on June 30, 1990 and Resolution A.485(XII) of the International Maritime Organization (IMO);
Pursuant to the Government’s Decree No. 22/CP of March 22, 1994 defining the tasks, powers and State management responsibilities of the Ministry of Communications and Transport;
At the proposals of the director of the Department for Organization, Personnel and Labor and the director of the Vietnam Maritime Bureau,

DECIDES:

Article 1.- To issue together with this Decision the Regulation on maritime pilotage training, update fostering, examination and granting professional certificates thereof.

Article 2.- This Decision takes effect 15 days after its signing; All the earlier provisions related to the organization of maritime pilotage training, update fostering, examination and granting professional certificates thereof, which are contrary to the Regulation issued together with this Decision, are hereby annulled.

Article 3.- The Director of the Ministry’s Office, the director of the Department for Organization, Per-sonnel and Labor, the director of the Vietnam Maritime Bureau and the heads of the concerned agencies and units shall have to implement this Decision.

Chapter I

GENERAL PROVISIONS

Article 1.- This Regulation provides for the maritime pilotage training, update fostering, examination and granting professional certificates thereof to Vietnamese maritime pilots.

Article 2.- General principles

1. All the maritime pilotage training, update fostering, examinations and granting professional certificates thereof to Vietnamese maritime pilots (hereinafter referred to as maritime pilots) must comply with the provisions of this Regulation.

2. Only those maritime pilots who have gone through training and update fostering, taken examination and obtained professional maritime pilotage certificates as prescribed in this Regulation, may practice maritime pilotage in Vietnam.

3. Maritime pilots aged over 60 years are not allowed to practice pilotage.

In special cases, the director of the Vietnam Maritime Bureau may base himself/herself on the practical demand and the proposal of the director of the Maritime Pilots’ Organization to consider and permit on the case-by-case basis maritime pilots aged over 60 to pilot ships on conditions that they are in good health, professionally qualified and not older than 62 years and voluntarily make an application for continuing their maritime pilotage job.

5. It is strictly forbidden to appoint persons who have no professional maritime pilotage certificates and fail to meet the age and health requirements to pilot ships operating in Vietnamese maritime zones where maritime pilotage is compulsory.

Chapter II

SYSTEM OF PROFESSIONAL MARITIME PILOTAGE CERTIFICATES AND MARITIME PILOTS’ TITLES

Article 3.- The system of professional maritime pilotage certificates includes:

a/ The "certificates of professional maritime pilotage qualification" (hereinafter abbreviated to CPMPQs), being certificates granted to maritime pilots who are professionally qualified for holding different maritime pilots’ titles, meeting the requirements prescribed in Chapter III and Chapter V of this Regulation.

b/ The "maritime pilotage zone certificates", being certificates granted to maritime pilots who have been granted CPMPQs and completed their probation duration as prescribed in Chapter VI of this Regulation.

2. Forms of these types of professional maritime pilotage certificates:

The forms of these types of professional maritime pilotage certificates shall be approved by the Minister of Communications and Transport at the proposal of the Vietnam Maritime Bureau. The Vietnam Maritime Bureau shall have to organize the printing, distribution, management of professional maritime pilotage certificates and guide the granting and change thereof nationwide.

Article 4.- Provisions on maritime pilots’ titles

a/ Third-class maritime pilots;

b/ Second-class maritime pilots;

c/ First-class maritime pilots;

d/ Premium-class maritime pilots.

2. Scope of practice by different maritime pilots’ titles:

Maritime pilots shall be only permitted to practice maritime pilotage on sea-going ships according to the limits of their respective CPMPQs as prescribed below:

a/ For third-class maritime pilots:

Third-class maritime pilots shall be only permitted to pilot sea-going ships with a total tonnage of under 4,000 GT or a maximum length of 115 meters.

b/ For second-class maritime pilots

c/ For first-class maritime pilots:

First-class maritime pilots shall be only permitted to pilot sea-going ships with a total tonnage of under 20,000 GT or a maximum length of 175 meters.

d/ For premium-class maritime pilots:

Premium-class maritime pilots shall be permitted to pilot all kinds of sea-going ships irrespective of their total tonnage and length.

Chapter III

CONDITIONS FOR BEING GRANTED CPMPQS

Article 5.- Provisions on general conditions

To be granted CPMPQs, maritime pilots must fully meet the following conditions:

1. Having the certificate of health which satisfies the criteria currently prescribed for maritime pilots;

For maritime pilots who have obtained a degree in sea-going ship navigation from other colleges or universities (such as the Navy Colleges, the Aquatic Resources College...), they must also satisfy the condition that they have graduated from refresher training courses on subjects not yet studied or inadequately studied at such colleges or universities, as prescribed by the Ministry of Communications and Transport, and have been granted certificates of completion of such training courses.

3. Having graduated from the training course on professional maritime pilotage;

4. Having been provided with update professional knowledge and specialized English language proficiency required for different classes of maritime pilots (except for third-class maritime pilots);

5. Having completed the probation time or completed an adequate number of times of safely piloting ships, as prescribed for each class in Article 6 of this Regulation;

6. Having prepared a full dossier as prescribed by the Vietnam Maritime Bureau.

Article 6.- Specific criteria

Apart from the general conditions specified in Article 5 of this Regulation, to be granted CPMPQs for each class of maritime pilots, maritime pilots must fully meet the following specific conditions:

1. For third-class maritime pilots:

Having worked on probation as third-class maritime pilots under the guidance of pilots, who have got CPMPQs, for a period of at least 36 months or for a time during which they have safely piloted ships for at least 300 times, which is certified by the piloting unit that guides the probation.

a/ Having obtained third-class CPMPQs, having safely piloted ships by themselves for at least 200 times in the capacity as third-class maritime pilots or having well performed a third-class maritime pilot’s tasks for at least 24 months.

b/ Particularly for those persons who have got professional maritime qualification certificates for working as captains of sea-going ships with a total tonnage of 500 GT or more and have assume the corresponding title of ship’s captain for at least 36 months, they may take an exam for being granted second-class CPMPQs given that they fully meet the following conditions:

i/ Having a college or higher-level degree in sea-going ship navigation;

ii/ Having graduated from a training course on maritime pilotage profession;

iii/ Having safely piloted ships for at least 150 times, with a total tonnage of 4,000 GT or more, in the capacity as second-class maritime pilot on probation or having worked on probation as second-class maritime pilots for at least 12 months, which is certified by the piloting unit that guides the probation.

3. For first-class maritime pilots:

Having obtained a university degree in sea-going ship navigation; having obtained a second-class CPMPQ, having safely piloted ships on their own for at least 200 times in the capacity as a second-class maritime pilot or having well performed a second-class maritime pilot’s tasks for at least 24 months; In addition, they must have worked on probation as first-class maritime pilots for at least six months or have safely practiced the piloting of ships with a total tonnage of 10,000 GT or more for at least 30 times, under the guidance of maritime pilots who have got first-class or higher-level CPMPQ, which is certified by the piloting unit that guides the probation.

4. For premium-class maritime pilots:

Having obtained a university degree in sea-going ship navigation; having obtained a first-class CPMPQ, having safely piloted ships on their own for at least 300 times in the capacity as first-class maritime pilots or having well performed a first-class maritime pilot’s tasks for at least 36 months; In addition, they must have worked on probation as premium-class maritime pilots for at least six months or have practiced the piloting of ships with a total tonnage of 20,000 GT or more for at least 30 times, under the guidance of maritime pilots who have got premium-class CPMPQs, which is certified by the piloting unit that guides the probation.

PROFESSIONAL TRAINING AND UPDATE FOSTERING PROGRAMS AND ESTABLISHMENTS FOR MARITIME PILOTS

Article 7.- Training and update fostering programs

1. In order to satisfy the system of professional maritime pilotage certificates prescribed in Article 3 of this Regulation, the program of professional training and update fostering courses for maritime pilots must embrace all the contents specified in Resolution A.485(XII) of the International Maritime Organization and conform to the practical conditions of maritime pilotage in Vietnam.

2. The Vietnam Maritime Bureau shall have to assume the prime responsibility and coordinate with the relevant units in compiling the professional training and update fostering program for maritime pilots and submit it to the Ministry of Communications and Transport for approval.

Article 8.- Training and update fostering establishments for maritime pilots (called training establishments for short)

1. Training and update fostering courses for maritime pilots held at training establishments shall serve as basis for granting, changing and extension of CPMPQs for each class of maritime pilots.

2. The training establishments must ensure the organization of training and update fostering for maritime pilots in strict conformity with the program already approved by the Ministry of Communications and Transport.

3. The training establishments mentioned in this Regulation must meet all the conditions and criteria on material base, equipment and facilities, teaching materials and staff and be licensed by the Ministry of Communications and Transport.

4. Annually, the Ministry of Communications and Transport shall inspect the training establishments already licensed by itself. Where an establishment fails to observe the Ministry’s regulations, it shall have its license for training of maritime pilots revoked by the Ministry.

a/ Organize training and update fostering according to the program approved by the Ministry;

b/ Monitor the training and update fostering courses and evaluate the training results;

c/ Manage the training and update fostering through the computerized system connected with the Certificates Management Center of the Vietnam Maritime Bureau;

d/ After each training or update fostering course, report on its proceedings to the Vietnam Maritime Bureau.

Chapter V

PROVISIONS ON THE EXAMINATION AND GRANTING OF CERTIFICATES OF PROFESSIONAL MARITIME PILOTAGE QUALIFICATION

Article 9.- Basing itself on the practical demand, the Vietnam Maritime Bureau shall direct the organization of training and update fostering courses as well as the exams for granting CPMPQs to Vietnamese maritime pilots.

Article 10.-

1. The director of the Vietnam Maritime Bureau shall issue decision on the setting up of a Maritime Pilotage Examination Council for each exam, depending on the contents and size of each fostering course.

2. The jury of each maritime pilotage exam shall be selected by the Maritime Pilotage Examination Council and proposed to the director of the Vietnam Maritime Bureau for decision. Such a jury shall be composed of:

a/ Maritime pilots who have CPMPQs of one class higher than the class for which the exam is held or of the same class for exams of premium-class maritime pilots but have assumed the corresponding maritime pilot’s title for at least three years;

b/ First-class shipmasters who have assumed the corresponding title for at least three years and professionally prestigious maritime pilotage specialists.

Apart from the above-mentioned professional criteria, the jury’s members must be also persons who have good ethic qualities, a healthy life style, are honest, uncorrupt, non-authoritarian and knowledgeable of pedagogy.

Article 11.- The Examination Council set up for the granting of CPMPQs shall perform the task of advising the director of the Vietnam Maritime Bureau on the direction and supervision of maritime pilotage exams. Concretely:

1. Considering and approving the lists of candidates on the basis of the conditions prescribed in Chapter III of this Regulation;

2. Preparing examination questions;

3. Administering and supervising the exams;

4. Handling incidents (if any) occurring during the exams;

6. Summing up the exam results, reporting them to the director of the Vietnam Maritime Bureau for approval.

Article 12.-

1. Basing himself/herself on the minutes of the Exam Jury, the director of the Vietnam Maritime Bureau shall issue decisions to recognize each maritime pilot’s passing of the exam so as to grant or change the CPMPQ for him/her.

2. A candidate who meets the set requirements of all exam subjects (getting mark 5 on the 10-point marking scale) shall be recognized as having passed the exam.

3. Where a candidate meets the requirements of only half of the exam subjects, the results of these subjects shall be reserved for one year.

Article 13.-

1. The CPMPQs granted to maritime pilots of all classes shall be valid for use for five years from the date of their granting.

2. Upon the expiry of his/her certificate, if a maritime pilot wishes to extend, change or apply for a new one, he/she must meet the two following conditions:

a/ Meeting the age and health requirements prescribed in Clause 3, Article 2 and Clause 1, Article 5 of this Regulation;

3. Those with expired CPMPQs, who meet the criterion specified at Point a but not the criterion specified at Point b, Clause 2 of this Article, and wish to extend, change their certificates or apply for new ones, shall have to work on probation for at least three months.

Article 14.- Where a maritime pilot commits a law-breaking act, entailing consequences, depending on the seriousness of his/her violation, the director of the Vietnam Maritime Bureau shall be entitled to temporarily suspend his/her job or revoke his/her CPMPQ. The revocation of a CPMPQ shall be proposed by the Maritime Pilotage Examination Council to the director of the Vietnam Maritime Bureau for consideration and decision.

Chapter VI

PROVISIONS ON THE GRANTING OF MARITIME PILOTAGE ZONE CERTIFICATES

Article 15.- Basing himself/herself on the granted CPMPQs and the probation time, the director of the Vietnam Maritime Bureau shall issue decisions to grant maritime pilotage zone certificates on the following principles:

1. Those who have got CPMPQs and practiced piloting ships safely as prescribed in Article 6 of this Regulation in any zone shall be granted maritime pilotage zone certificates for such zone.

2. The granting of maritime pilotage zone certificates to maritime pilots shall be proposed by the director of the Maritime Pilots’ Organization, enclosed with the certification of such maritime pilots� actual ship pilotage capability, by the director of the port authority of the ship-piloting zone.

Article 16.- The maritime pilotage zone certificates have the use term equal to that of the granted CPMPQs, and, within the duration when the CPMPQs remain valid:

1. Maritime pilots may pilot ships only in the zones determined in their maritime pilotage zone certificates.

Chapter VII

IMPLEMENTATION PROVISIONS

Article 17.-

1. The provisions on the criteria for taking examination and being granted certificates of professional maritime pilotage qualification issued together with the Ministry of Communications and Transport’s Decision No. 2384/QD-PC of November 17, 1994 shall remain effective pending the Vietnam Maritime Bureau’s organization of the first training and update fostering course, organization of exams and granting of professional maritime pilotage certificates under the provisions of this Regulation.

2. The Vietnam Maritime Bureau shall have to prepare and submit to the Ministry of Communications and Transport for approval a draft training and update fostering program, a scheme on training establishments and forms of professional maritime pilotage certificates under the provisions of this Regulation before February 1st, 2001.

Article 18.-

1. The Vietnam Maritime Bureau shall guide the mode and procedures for changing old types of professional maritime pilotage certificates to corresponding new professional maritime pilotage certificates.

2. The change of maritime pilotage diplomas and maritime pilotage zone licenses already granted under the regulations issued together with the Ministry of Communications and Transport’s Decision No. 2384/QD-PC of November 17, 1994 to new corresponding CPMPQs and maritime pilotage zone certificates must be completed before February 1st, 2005.

3. All types of maritime pilotage diplomas and maritime pilotage zone licenses already granted under the regulations issued together with the Ministry of Communications and Transport’s Decision No. 2384/QD-PC of November 17, 1994 remain valid for use until February 1st, 2005.

Article 19.- The director of the Vietnam Maritime Bureau shall coordinate with the director of the Department for Organization, Personnel and Labor in organizing the guidance and inspecting the implementation of this Regulation.
