CIRCULAR

ON MANAGEMENT AND ORGANIZATION OF ONLINE TEACHING IN GENERAL EDUCATION INSTITUTIONS AND CONTINUING EDUCATION INSTITUTIONS

Pursuant to the Education Law dated June 14, 2019;

Pursuant to the Government’s Decree No. 69/2017/ND-CP dated May 25, 2017 on functions, duties, powers and organizational structure of the Ministry of Education and Training;

Pursuant to the Government’s Decree No. 127/2018/ND-CP dated September 21, 2018 stipulating responsibility for state management of education;

Pursuant to the Government’s Decree No. 64/2007/ND-CP dated April 10, 2007 on information technology application in state agencies' operations;

At the request of the Director Generals of Primary Education Department, Secondary Education Department, Continuing Education Department and Information Technology Department;

The Minister of Education and Training hereby promulgates a Circular on management and organization of online teaching in general education institutions and continuing education institutions.

GENERAL PROVISIONS

Article 1. Scope and regulated entities

1. This Circular provides for management and organization of online teaching of general education curricula and continuing education curricula at lower secondary and upper secondary levels (hereinafter collectively referred to as “general education curricula”), including organization of online teaching and educational activities (hereinafter collectively referred to as “teaching”); technical infrastructure for online teaching; and responsibilities of relevant regulatory bodies, organizations and individuals.

2. This Circular is applicable to general education institutions, continuing education institutions and other educational institutions adopting general education curricula and continuing education curricula at lower secondary and upper secondary levels (hereinafter collectively referred to as “general education institutions”); teachers; students; and relevant organizations and individuals.

Article 2. Definitions

In this Circular, the terms below are construed as follows:

1. online teaching system” means an online teaching software system and IT infrastructure (hereinafter collectively referred to as “online teaching infrastructure”) that enable the management and organization of teaching via the Internet, including direct online teaching software; online learning management system; and online learning content management system.

2. online teaching” means teaching activities organized via the online teaching system.

3. online teaching supporting direct teaching in general education institution” refers to online teaching of a part of a lesson or topic in the general education curricula to support direct teaching of this lesson or topic in the general education  institution.

Article 3. Purposes of online teaching

1. Support or replace direct teaching in general education institutions to enable general education institutions to improve their teaching quality and complete the general education curricula.

2. Improve capacity for IT application and communication in teaching and learning; promote digital transformation in the education sector.

3. Increase student’s access to education, and enable students to learn anytime, anywhere.

Article 4. Rules for online teaching

1. Online teaching contents must ensure learning outcomes of the general education curricula.

2. Ensure minimum conditions in terms of online teaching infrastructure and teachers must meet online teaching requirements.

3. Comply with existing regulations of law on information safety, data, personal information and intellectual property.

Article 5. Online teaching activities

1. Online teaching activities shall be organized according to lessons or topics of the general education curricula, ensuring interactions between the teacher and their students during the teaching process.

2. Main activities of students learning online include attending online classes organized by teachers; participating in learning activities and assessments at the request of teachers; using learning contents from online teaching educational resources; raising and answering questions with teachers and other students.

3. Main activities of teachers teaching online include organizing online classes to teach and provide learning instructions for students; giving assignments and assessing learning results of students; monitoring and supporting students when they use learning contents from online teaching educational resources; providing students with advice and assistance, and answering questions from students.

4. Heads of general education institutions have the power to decide to organize online teaching supporting direct teaching in their general education institutions and online teaching replacing direct teaching in their general education institutions during the time where their students cannot come to school due to force majeure reasons.

Article 6. Assessment in online teaching

1. Online learning results of students shall be regularly assessed throughout the teaching process. Forms of regular assessments in online teaching shall conform to regulations on regular assessments of the Ministry of Education and Training.

2. Online learning results of students shall be periodically assessed in general education institutions according to regulations on periodic assessments of the Ministry of Education and Training.

In case students cannot come to their general education institutions for a periodic assessment due to force majeure reason, the periodic assessment shall take place online; heads of the general education institutions have the power to decide on the form of the periodic assessment according to regulations of the Ministry of Education and Training, ensuring that the assessment is organized in an accurate, fair, objective and honest manner.

1. Online teaching educational resources shall be formulated based on the general education curricula, including multimedia lessons; testing and practice instructions; simulation software; practice and assessment questions and exercises; and reference and supporting documents according to regulations of the Ministry of Education and Training.

2. Online teaching educational resources must be suitable for contents of lessons, learning topics and teaching activities of teachers and students; have scientific and pedagogical values and be appropriate to historical traditions, culture, moral values and fine traditions and customs of Vietnam.

3. Online teaching educational resources used in a general education institution must be approved by the specialized team and head of the general education institution.

Article 8. Management and retention of online teaching documents

1. Online teaching documents to be managed and retained in general education institutions include:

a) Documents on and proof of satisfaction of the requirements mentioned in Articles 9, 10 and 15 of this Circular;

b) Data on the online teaching process on the online teaching system;

c) Detailed online teaching plans and direct teaching plans in the general education institution by date for each subject and educational activity;

d) Documents on assessment of the learning process and results of students according to regulations in Article 6 herein.

Chapter III

ONLINE TEACHING INFRASTRUCTURE

Article 9. Online teaching software system

The online teaching software system may be employed separately or together with the following types of software:

1. Direct online teaching software

Direct online teaching software shall have the following basic functions:

a) Allow teachers to organize direct online teaching to teach and provide instructions; give assignments to all students participating in the same learning space via visual, audio and writing channels (screen sharing), and deliver online teaching educational resources to students;

b) Allow students to interact and exchange information in real time with the teacher and each other in the same learning space.

a) Allow teachers to retain and deliver online teaching educational resources to students; give assignments and assess learning results of students; monitor and support students when they use learning contents from online teaching educational resources; provide students with advice and assistance, and answer questions from students;

b) Allow students to access and use learning contents from online teaching educational resources; participate in learning activities and assessments at the request of their teachers; raise and answer questions with the teachers and other students in the same learning space;

c) Allow general education institutions to manage documents, learning progress and learning results of students and teaching activities of teachers; support management of other information at the request of general education institutions and local education authorities;

3. Online learning content management system

The online learning content management system shall have the functions of the online learning management system mentioned in Clause 2 herein and the tools that allow teachers to design learning content and online teaching educational resources.

Article 10. Information technology infrastructure

IT infrastructure supporting management and organization of online teaching must meet the following minimum requirements:

1. Configurations of Internet connection and connecting devices, computers and terminal devices are suitable for installation of the online teaching software system; teachers and students are able to access and use functions of the online teaching software system to carry out online teaching activities and assessments according to regulations in Articles 5 and 6 herein.

2. There are solutions for information safety assurance and regulations on data and personal information protection as per the law for online teaching.

Chapter IV

RESPONSIBILITIES OF REGULATORY BODIES, ORGANIZATIONS AND INDIVIDUALS

Article 11. People’s Committees of provinces and central-affiliated cities

1. Direct provincial authorities, central authorities, district-level People’s Committees and relevant regulatory bodies to organize online teaching in localities under their management.

2. Formulate mechanisms and policies for assistance with online teaching infrastructure.

3. Allocate funding for provision of training and refresher courses in online teaching skills and professional qualifications to teachers and management officials and assurance of technical conditions for online teaching.

Article 12. Departments of Education and Training

1. Advise People's Committees of provinces and central-affiliated cities on plan promulgation, resource allocation and directing provincial authorities, central authorities and relevant regulatory bodies to cooperate with Departments of Education and Training in organizing online teaching in their provinces.

2. Organize training and refresher courses in online teaching skills and professional qualifications for teachers and management officials.

Article 13. District-level People’s Committees

1. Direct Bureaus of Education and Training and relevant regulatory bodies to start online teaching in their districts.

2. Allocate resources for assurance of online teaching infrastructure in their districts.

3. Allocate funding for training and refresher courses in online teaching skills and professional qualifications for teachers and management officials.

Article 14. Bureaus of Education and Training

1. Advise district-level People's Committees on plan promulgation and allocation of resources to general education institutions under their management for online teaching organization.

2. Organize training and refresher courses in online teaching skills and professional qualifications for teachers and management officials.

3. Direct general education institutions under their management to organize online teaching; inspect, supervise and resolve difficulties arising from teaching and assessment of online learning results of these institutions.

Article 15. General education institutions

Responsibilities of heads of general education institutions:

a) Decide the form of online teaching based on guidelines from competent authorities; determine targets or expected outcomes of online teaching to ensure teaching quality;

b) Formulate online teaching plans as appropriate to quality assurance conditions of general education institutions;

c) Organize training and refresher courses in online teaching skills and professional qualifications for teachers and staff involved in online teaching to ensure quality;

d) Assign responsibilities to management officials, teachers, staff and students and cooperate with parents in online teaching organization;

dd) Develop, select and appraise educational resources used in online teaching;

e) Notify online teaching form and plans for assessment of online learning results to students and parents;

g) Organize and manage online teaching as planned;

h) Direct receipt of learning products and assessment of learning results of students;

2. Ensure conditions in terms of online teaching facilities and infrastructure as well as online teaching educational resources and teachers must meet online teaching requirements.

3. Develop online teaching requirements and online teaching rules of general education institutions in accordance with regulations of this Circular.

4. Publish regulations related to online teaching, education plans and online teaching assurance conditions, and collect tuition as per existing regulations.

5. Send relevant management officials, teachers and staff to training and refresher courses in methods and skills necessary for online teaching organization.

6. Inspect, supervise and assess efficiency of online teaching organization, promptly resolve difficulties arising from online teaching organization; on a biannual basis, at the end of each semester, evaluate and draw lessons from online teaching organization and send a compilation of all difficulties, causes thereof and propositions to Bureaus of Education and Training and Departments of Education and Training, which will report to competent authorities for consideration.

Article 16. Teachers and staff

1. Teachers and staff may participate in training and refresher courses in methods and skills necessary for IT application and shall be capable of organizing online teaching activities.

2. Teachers shall teach and assess online learning results of students according to plans of their general education institutions and ensure that educational objectives are met according to regulations; create a friendly learning environment and enhance interactions and information connection with their students; and regularly cooperate with parents in organizing online teaching.

3. Staff shall carry out system engineering management and employ IT tools to support teachers and students where necessary.

1. Strictly comply with online teaching rules; join all learning activities as requested by their teachers and general education institutions; actively participate in learning activities and educational activities according to plans of their teachers and general education institutions.

2. Proactively contact teachers or support staff while learning online for timely guidance and assistance.

Chapter V

IMPLEMENTATION CLAUSE

Article 18. Effect

This Circular comes into force from May 16, 2021.

Article 19. Implementing responsibilities

Chairpersons of People’s Committees of provinces and central-affiliated cities, heads of Departments of Education and Training, Chairpersons of district-level People’s Committees, heads of Bureaus of Education and Training, heads of general education institutions and relevant organizations and individuals shall implement this Circular.
